This paper looks at the history of identification in England over the past 1,000 years. It contends that techniques and technologies of identification do not identify a single entity but a number of forms of personality, including the juridical person, the citizen and the deviant. Individuals can be the bearers of more than one of these personalities at the same time, or over the course of their life. These personalities are created by social performances to which people (...) are trained to react conventionally. As such identity, and its identification, is a social and cultural phenomenon, rather than a ‘thing’. Each of the personalities noted above has been identified historically in differing ways -through possessions or techniques in the case of the juridical person, though the community in the case of the citizen, and on, or through, the body in the case of the deviant. In the contemporary world these distinctions are being effaced, as all forms of identification are being reduced to the body and the database. This levelling of social forms of being has implication for what it means to be a person in our society, and for public perceptions of new techniques and technologies of identification. (shrink)

Personal positions and voices of a patient diagnosed with borderline personality disorder and the therapist during long-term psychotherapy were studied aiming to find differences in the patterns formed in these aspects of subjectivity according to the level of elaboration of the change episodes achieved by the patient. This case study considered a stage of qualitative analysis where change episodes of the patient were traced through the Change Episodes Model. Later, through the Model of Analysis of Discursive Positioning in Psychotherapy, the (...) voices and personal positions of the patient and her therapist were identified in each of the change episodes. In the stage of quantitative analysis, dynamic patterns in the voices and personal positions were established, accounting for hypothetical attractors using the Space State Grid technique in each of the three different levels of subjective elaboration that constitute the change episodes. The results established differentiated dynamic patterns in the change episodes, coherent with the patient’s change process, and formation of propositive/reflective specific patterns as the patient evolved in the three different levels of subjective elaboration. The above suggests that a subjective transformation process is displayed, and this is manifested in the different voices and personal positions that emerged as the change episodes evolve. The identified dynamic patterns can be considered nonlinear and emergent subjective exchanges between the patient and the therapist throughout the psychotherapy. (shrink)

The ‘public’ character of the kind of rule of law theorizing with which Lon Fuller was engaged is signalled especially in his attention to the very notion of being a ’legal subject’ at all. This point is central to the aim of this paper to explore the animating commitments, of substance and method alike, of a particular direction of legal theorizing: one which commences its inquiry from an assessment of conditions of personhood within a public legal frame. Opening up this (...) inquiry to resources beyond Fuller, the paper makes a novel move in its consideration of how the political theorist Hannah Arendt’s reflections on the ‘juridical person’ might aid a legal theoretical enterprise of this kind. The paper proposes to grasp handwritten signature as a metaphysical invention of the so-called “Western” civilization, where the signature is supposed to make possible juridical identification of the person who wrote it. However, despite this expectation of reliability, the Western handwritten signature is an aporetic sign, which is considered to be authentic (unrepeatable) and conventional (repeatable) at the same time. Because the signature is a sign of juridical identification and its authenticity can always be forged, Jacques (...) Derrida tries to deconstruct the contradictory functioning of Western metaphysics, which leads to confusion in our expectations of authenticity and identity in our uses of signatures. By proposing a new reading of Derridean texts concerning writing, the paper focuses on the pragmatical paradox that grounds our contradictory legal politics of signing: because the exact manual reproduction of a line is impossible, no one can satisfy the legislative obligation to sign conformably to the model signature. That’s the aporia of trace’s recognition, which establishes the signature as a sign: on the one hand, the signature is supposed to represent the juridical identity of the person who traced it; on the other hand, the signature, which constantly changes its graphical form, makes every certain identification impossible. In order to question the juridical identity traditionally guaranteed by the signature, this paper invites to grasp the legal practice of signing as a subversive performativity, which is produced during the passage between recognition of juridical identity requested by the law and its simultaneous and inevitable transgression. Finally, the paper proposes a new approach to the signature as a visual performance of the self, based on a reevaluation of the altercation between Jacques Derrida and John Searle concerning the iterative character of traces and performatives. To introduce the issue of the tracking and identification of human agents, I examine the ability of an agent to track a human person and distinguish this target from other individuals: The ability to perform person identification. First, I discuss influential mechanistic models of the perceptual recognition of human faces and people. Such models propose detailed hypotheses about the parts and activities of the mental mechanisms that control the perceptual recognition of persons. However, models based on perceptual (...) recognition are incomplete theories of person identification because they do not explain several identification behaviors that are fundamental to human social interactions. Furthermore, recognition-based models tend to appeal to the controversial concept of the “identity” of a person without explaining what determines personal identity and persistence. To overcome these limitations, I propose to integrate the face-recognition program into a broader causal-historical theory of identification. The causal-historical theory of identification complements models focused on perceptual recognition because it can account for the types of non-perceptual identification overlooked by the face-recognition program. Moreover, it can decompose the identification behaviors into tracking processes that succeed or fail to be sensitive to causal characteristics of a target. I illustrate these advantages with a discussion of the difference between the tracking of a person understood as either a causally continuous biological organism or a psychologically continuous mind. Finally, I argue that the causal-historical theory provides a theoretical framework for investigating the tracking of relations between a target and its contextual and historical attributes, such as a target's possessions. The Hebrew phrase tikkun olam means repairing, mending or healing the world. Today, the phrase tikkun olam, particularly in liberal Jewish American circles, has become a slogan for a diverse range of topics such as activism, political participation, call and pursuit of social justice, charities, environmental issues and healthy nutrition. Moreover, the presidents of the United States who attend Jewish religious days and Jewish ceremonies state the tikkun olam in its Hebrew origin, pointing out its origin embedded in the Judaism (...) and a religious rule and/or an obligation that is important in Jewish tradition and thought. Nevertheless, when we look at the context of religious literature in which the phrase is used, it is seen that, although it is difficult to make a clear definition, it does not reflect modern/widespread uses and their meanings. Furthermore, tikkun olam is an ignored and even rejected concept by the Rabbinic Judaism which claims to represent the tradition and its current representative Orthodox Judaism. This fact is also seen in the usage and prevalence of the term in the U.S. and Israel. Thus, in this article, especially with reference to the norms of Mishnah, the religious-juristicial contexts and possible meanings of the phrase of tikkun olam, the notion of tikkun olam in Jewish liturgy and its implied meaning and the Kabbalistic understanding of tikkun will be presented, the development, changing and conversion of the phrase in modern age and its contemporary usage areas and reinterpretations will be demonstrated.Summary: Recently and especially in the U.S., the Hebrew phrase tikkun olam are used as a slogan in a widespread manner such as for activism, political participation, social justice, all kinds of charities, environmental issues, counter terrorism and healthy nutrition. Such a common usage of the phrase is largely the result of its literal meaning and ambiguity. Hence, this article aims to explore the place of the concept of tikkun olam in Jewish religious literature and its variations and semantic changes. Tikkun olam, literally means the repairing, mending or healing the world. However, regarding its religious context, it is difficult to determine what it means accurately. In time, some has used the tikkun olam as a legislative justification for changing specific laws, some has attributed to it an eschatological meaning which indicates to the mesianic age, and some has dicussed it in the context of mystical sense. The first usage of the phrase of tikkun olam in the Jewish religious literature was simply in the form of “because of tikkun olam” in Gittin epistle, a tractate of Mishnah and Talmud. Here, the phrase was used as a reason of a judgment concerning to the subjects of marriage, divorcement, slavery, captivity etc. In the context of these subjects tikkun olam indicates to the similar meanings like “repairing, organizing, healing, changing the world; regulating and improving the society, maintaining the social order, and prioritizing the common good. In fact, the concept of tikkun olam as the reason of the judgements in these matters is likely related to a juridical reason that intends to ensure the personal and public welfare such as clarifying the marital status of woman, to prevent the capture and seizure from Jewish society, and to deal with economy and identification of juridical status of the slaves.The other reference to tikkun olam appears in the second part of the aleinu prayer. However, the notion of tikkun olam in the aleinu prayer refers to a situation that happens in God’s Kingdom if Torah and halakhah are followed carefully. Hence, the aleinu prayer’s tikkun olam points out eschatological expectation which desires a messianic age, but not the socio-political and ecological concerns of the world as in the current fields and meanings.The modern idea of tikkun olam is also associated with the Jewish mystical movement, Kabbalah. Nonetheless, the concept of tikkun in Kabbalah is not a concept related to the socio-political circumstances of the world where we live in, but it is related to the restoring of the divine world. In order to restoring the divine world, human should fulfill the commands by studying Torah and have a spiritual and moral rehabilitation process by engaging in ascetic practices.The use of the phrase of tikkun olam gradually progress in the socio-political life of the U.S. The first use of the expression of tikkun olam in the U.S. was in the 1950’s by Shlomo Bardin, the founder of the Brandeis Camp Institute in California. Bardin asserted that the Aleinu prayer was the most important expression of Jewish values, particularly the expression “le-taken olam be-malchut shaddai” that is typically translated as “when the world shall be perfected under the reign of the God.” Bardin suggested that these words referred to the obligation of Jews to work for a more perfect world. The concept of tikkun olam entered contemporary usage by the way of its being preferred as a name to those such as social justice and charity programmes which was launched by the Reformist and Conservative groups in the second half of the twentieth century. In 1970s, United Synagogue Youth which is the national youth foundation of the conservative movement adopted the expression of tikkun olam and changed the title of its social action programs from “Building Spiritual Bridges” to “Tikkun Olam.” Nowadays, United Synagogue Youth proceeds all of its social activities and tzedakah programs through the tikkun olam project.By the end of 1970’s, New Jewish Agenda, an organization devoted itself to the religious and social values, acknowledged the slogan of “Tikkun Olam” as the spirit of its ideology. In 1986, Michael Lerner entitled a left-oriented liberal publication with the concept of Tikkun by claiming that this concept represented the origin of Judaism, and he take an important role on making the concept have a prevalence.Pittsburgh Platform organized in 1999 by the Reformist Jewish Movement emphasized that people must perform the most significant moral principles in the relationships with all non-Jewish people and all other creatures. This platform also stated that making the world a better place with the help of God would quicken the upcoming the messianic age. The tikkun understanding of the Reformist movement evolved to more universal realm by embracing the non-Jewish people, as well. Over the last two decades, successive presidents of the U.S. who attended in the ceremonies of Jewish religious days and Jewish assemblages have contributed to the prevalence and usefulness of tikkun olam by mentioning the phrase of tikkun olam in Hebrew, expressing that this is an essential principle of Judaism and addressing that this has a central role in Jewish tradition and thought. On the other hand, this concept does not have an important or a central place in Rabbinic Judaism and even in Orthodox Jewish communities which are the current representatives of Rabbinic Judaism. Moreover, Reformist, Conservative, and Reconstructionist American Jews who are considered on the liberal side of the politics has put the concept on the current use and the world’s agenda. Thus, the phrase of the tikkun olam is more popular in non-Judaic milieux in the U.S. than the Jews in Israel. This article examines the views of Latin American philosophers on the process of formation of the Latin American subject of history, its characteristic features, as well as the role of the intellectual in this process. The main objective of this paper is to demonstrate the position of the prominent Argentine philosopher A. A. Roig, and to compare his position with the position of another well-known representative of the philosophy of liberation (E. Dussel). In this paper therefore, Roig's works devoted to (...) the philosophical interpretation of the process of formation and development of Latin American national thought are analyzed. It is established that in the writings of this thinker the activity of Latin American people appears as the activity of a single collective subject of history. During the study, we conclude that both philosophers (Roig and Dussel), come to the same idea in different ways: the intellectual identity of the Latin American collective subject of history is based on the history of interaction between the people of Latin America and Europe, unique in its dramatic nature and same for the entire continent. Defining and identifying causal intervention effects for transmissible infectious disease outcomes is challenging because a treatment – such as a vaccine – given to one individual may affect the infection outcomes of others. Epidemiologists have proposed causal estimands to quantify effects of interventions under contagion using a two-person partnership model. These simple conceptual models have helped researchers develop causal estimands relevant to clinical evaluation of vaccine effects. However, many of these partnership models are formulated under structural assumptions that preclude realistic (...) infectious disease transmission dynamics, limiting their conceptual usefulness in defining and identifying causal treatment effects in empirical intervention trials. In this paper, we propose causal intervention effects in two-person partnerships under arbitrary infectious disease transmission dynamics, and give nonparametric identification results showing how effects can be estimated in empirical trials using time-to-infection or binary outcome data. The key insight is that contagion is a causal phenomenon that induces conditional independencies on infection outcomes that can be exploited for the identification of clinically meaningful causal estimands. These new estimands are compared to existing quantities, and results are illustrated using a realistic simulation of an HIV vaccine trial. (shrink)

It is well known that Hegel’s Philosophy of Right initiated, when it first appeared, a dispute about his philosophy in general that has not abated to the present day. The initial grounds for this dispute included: Hegel’s often virulent attacks, in the Philosophy of Right, on contemporaries such as Fries, Hugo, and von Haller; the question of his political stance within Prussia, which was then rapidly developing into a reactionary, authoritarian state; in other words, the question of Hegel’s political accommodation, (...) the question of his attitude to natural law, and so on. For a long time, therefore, the philosophical dispute was shaped by the political interests of the day. The struggle against Hegel’s philosophical system as a whole even resorted to personal defamation of the philosopher, so that, by revealing personal weakness, his system and the influential school of followers he had attracted could be discredited. Likewise, the diverse attempts at an adequate assessment of the historical influence of Hegel’s philosophy have come to a head. The two main questions, also deriving their inspiration from differing interpretations of the Philosophy of Right, are: How legitimate are the various Marxist references to Hegel as either the forerunner of Marxism or its principal opponent? How legitimate is the accusation that Hegel, by developing a totalitarian theory of the state, prepared the ground for twentieth century fascism, especially National Socialism? As previous research has pointed out, an adequate assessment of such relations will have to deal very carefully with Hegel’s position in his own day. For example, apart from his attitude to the situation in Prussia, his attitude to the most important event of the age, the French Revolution, must be examined. Furthermore, comparative perspectives must be established, so that the distinctive shape of Hegel’s philosophy of right can be seen clearly, against the background of the European constitutional debates of the day. In the last analysis, however, the essence of the disagreement still stems from the problem of the proper political classification of Hegel’s philosophy of right. (shrink)

How do we acquire a mental representation of our own face? Recently, synchronous, but not asynchronous, interpersonal multisensory stimulation between one’s own and another person’s face has been used to evoke changes in self-identification . We investigated the conscious experience of these changes with principal component analyses that revealed that while the conscious experience during synchronous IMS focused on resemblance and similarity with the other’s face, during asynchronous IMS it focused on multisensory stimulation. Analyses of the identified common factor (...) structure revealed significant quantitative differences between synchronous and asynchronous IMS on self-identification and perceived similarity with the other’s face. Experiment 2 revealed that participants with lower interoceptive sensitivity experienced stronger enfacement illusion. Overall, self-identification and body-ownership rely on similar basic mechanisms of multisensory integration, but the effects of multisensory input on their experience are qualitatively different, possibly underlying the face’s unique role as a marker of selfhood. This paper assesses the first-person authority account (FPA) of gender, according to which X's self-identification of what X's gender is, is the final say on what X's gender is, such that if others disagree, they are mistaken. One main reason in support of FPA is respecting X's autonomy—that is, overriding X's self-identification amounts to denying X's autonomy. Ozturk criticizes this view using analogies of religious and patriotic self-identifications, such that there are cases in which someone can permissibly claim (...) that another is not, say, a true Muslim or a true patriot. This implies that there might also be cases of permissible rejections of gender self-identification. Ozturk offers instead the negotiative theory of identity, according to which it is permissible to reject a self identification as long as three constraints are satisfied: no harm is done to the self-identifier, and their privacy and dignity are not violated. A person, usually a child, enters civilization after having been raised by wolves or kept in some kind of cruel captivity. The outsider perspective on domestication ensuing in an edge of a culture's self-recognition of its clumsier attributes, what has been taken for granted becomes apparent, is brought to the foreground with the stranger and made questionable. Amusement follows naïve questions or observations such as Kaspar Hauser in the Herzog film, The Enigma of Kaspar Hauser, when Kaspar notes that while in his room he is engulfed by it, but when he looks at the tower he can turn away and it disappears. Ergo, the room is larger than the tower. How entertaining. The aberrant one destabilizes the comforting cultural normative. Places become seen as mere impressions out of space, a patterning, a rut that not everyone lives in like us. This is one figure of the feral. The naiveté that begs all the questions. As a figure for a certain philosophical disposition, the rapidity of one’s saccade scans the environment, intuits it’s space, not from an initial thaumazein or a Critchlean sense of disappointment, but from a child-like naiveté bent on survival. To serve the naïve is merely one form of critique, and it is not nearly used enough in lieu of the critique that provides answers. How dull. It is not necessary to be an outsider to entrench a critique with naiveté. After having forced to suffer in the most parched and rocky terror, itself for so long rooted upwards of fifty feet into the ground upon which it grows, even a grapevine can spontaneously produce a white grape on a red vine. The curious feral can arise from within, and like pinot grigio, it adds variety without admonishing its roots. There is also the feral dog. Not raised by wolves, but humans. Founded in place the figure of this feral denies this place. The trajectory of this feral roves from the cultivated to uncultivated, or in speaking of plants from controlled to volunteer, finding the necessary nutrients and survival patterns on its own. Finding other places, reaching out into space testing its fertility. And when introduced into a foreign environment, it withers or flourishes. We would like to attempt a thesis at this juncture and to accept neither feral figure in its entirety, but to argue for the intimate conjunction between a cultivated place and its resonance with the space it procures for its nest and kin. There is no para-academic. We all have day jobs. 'Para-academic' seeped through the cracks as an adjective in the call to frame publishing dedicated to the critical rigor expected by academic publishing, but to deny the limitations of guarded legitimation through capital means. Open-access holds hands with this parasitic descriptor. Para-academic publishing's refusal to adhere to the valuation of locked access of a site, the site “of a desperate initiation to the empty form of value,” 1 seeks to recognize not merely an inclusive interpretation of significance, but the significance of thinking practice. The practice inside the paywalls of academic 'education' is held in a deathgrip by its infatuation with value and information, both empty without the apprehension of human experience, the barbaric yawp. “I can't breathe in here.” It is not that a para-academic practice leads one to the childish wonder of Kaspar Hauser who wonders about the spatiality of his room. It is the academic legitimation that distorts that one can hold the understanding of both in a constellation of place and space. Led to believe there is only a place for things, we are led to disillusionment. It is also not that a para-academic practice relinquishes itself to the invasive growth outside of careful cultivation, an abandonment of pleasantries for the toothy growl of a predator. It is the academy's fear that thought does not require capital to signify value. Some of the most nutritious meals can be foraged. Defining a para-academic practice is not outlining a place of accreditation of the practice, it is the recognition that any place is subject to modulation by the space it inhabits as well as creates. The para-academic practice keeps an eye of the creation of spaces, follows those paths that eat themselves in the name of academia. This is not unlike Red Peter's report to the academy, only successful if we report in idle idiosyncratic banalities that we have once again become victorious in our acculturation and nullification within the confines of accredited mush and our trajectory of wild rigor is defeated in our desire for recognition as recognizable in this place. Weeds are integral to the functioning of a large ecosystem. The manicured garden is entirely reliant on its keeper. The pansy can also go wild once neglected, the daisy definitely does.... a universe comes into being when a space is severed or taken apart. The skin of a living organism cuts off an outside from an inside. So does the circumference of a circle in a plane. Already claimed by a stabilizing suspension, the terms enter specificity of ‘this is this’. Another correlation: activity and the individual. And we'd like to argue that this place is not a limiting specification, but a practice undulating daily, by the minute. And we call this practice the para-academic practice. The academic can, and we argue should, be active para-academically, to escape the bounds, recognizing no site specific place as a place to rest on or the place to grab the Kafka's top and wonder at its disobedience not to continue. Yet, the para-academic practice must maintain the desire for rigor in scholarship. Indeed desiring past itself to claim a more naïve rigor, one that does not take its form for granted. Without a para-academic practice, the scholar spends half the time merely working on behalf of a hierarchy, to maintain it, and the other measly amounts of time are in the name of thinking, but only in name. Not to mention the amount of debt it takes to attend the halls of higher education. Not to mention the snoring tenures. Not to mention the barely scraping by adjuncts. Not to mention the materials that shake the very force of producible theory. Not to mention when swimming in texts becomes slogging through data. Academia is a barbaric food chain and it is our claim that there is, as always, an imperative for thought to move, with Heidegger, beyond the logics of calculation and planning, to a time of its own. In the United States, approximately 2.53 million people sustain a concussion each year. Relative to adults, youth show greater cognitive deficits following concussion and a longer recovery. An accurate and reliable imaging method is needed to determine injury severity and symptom resolution. The primary objective of this study was to characterize concussions with diffusion tensor imaging. This was performed through a normative Z-scoring analysis of DTI metrics, fractional anisotropy, axial diffusivity, and radial diffusivity, to quantify patient-specific injuries and identify commonly (...) damaged brain regions in paediatric concussion patients relative to healthy controls. It was hypothesized that personalizing the detection analysis through normative Z-scoring would provide an understanding of trauma-induced microstructural damage. Concussion patients were volunteers recruited from the Emergency Department of the McMaster Children’s Hospital with a recent concussion, 9 males and 17 females, mean age 14.22 ± 2.64, while healthy paediatric brain DTI datasets were obtained from an MRI data repository. Significant abnormalities were commonly found in the longitudinal fasciculus, fronto-occipital fasciculus, and corticospinal tract, while unique abnormalities were localized in a number of other areas reflecting the individuality of each child’s injury. Total injury burden, determined by the number of regions containing outliers per DTI metric per patient, was used as the metric to quantify the overall injury severity of each patient. The primary outcome of this analysis found that younger patients experienced a significantly greater injury burden when measured using fractional anisotropy. These results show that DTI was able to detect microstructural changes caused by concussion, on a per-person basis, and has the potential to be a useful tool for improving diagnostic accuracy and prognosis of a concussion. One of the central questions within contemporary debates about collective intentionality concerns the notion and status of the we. The question, however, is by no means new. At the beginning of the last century, it was already intensively discussed in phenomenology. Whereas Heidegger argued that a focus on empathy is detrimental to a proper understanding of the we, and that the latter is more fundamental than any dyadic interaction, other phenomenologists, such as Stein, Walther and Husserl, insisted on the importance (...) of empathy for proper we-experiences. In this paper, I will present some of the key moves in this debate and then discuss and assess Husserl’s specific proposal, according to which reciprocal empathy, second-person engagement and self-alienation are all important presuppositions for group-identification and we-identity. Roderick Chisholm has proposed a novel theory of reference and belief involving the undefined notion of directly attributing a property. He uses direct attribution to account for Castañeda’s “he, himself” puzzle and for beliefs de re. He affirms as an axiom of his theory principle P1: if x directly attributes z to y, then x is identical to y. I shall argue that principle P1 is defective in that it prevents the identification of x with y and thus renders (...) Chisholm’s theory incapable of expressing a wide range of psychological phenomena. Thus the theory is an inadequate model of psychological reality. (shrink)

Harry Frankfurt has published On Inequality, but this is not the first time he has written about this subject. Frankfurt already criticized a rationalistic notion of equality on other occasions (Frankfurt, 1987 & 1997). In these works he says a rationalistic notion of equality cannot fit in with our belief that agents possess their own volitional necessities, which shape volitional structures of the human will. However, Frankfurt's explanatory connection between volitions, love and identification make it difficult to talk about (...) personal freedom. (shrink)

There has been increasing interest in the attributes of successful entrepreneurs. Increasingly, too, research on entrepreneurship has focused on the identification of personality traits conducive to entrepreneurial success. The present study moves away from predicting entrepreneurial success and instead focuses on exploring and describing the personality traits of a successful entrepreneur, namely Steve Jobs. A psychobiographical case study design and qualitative approach were employed to explore the extent to which Steve Jobs displayed the personality traits identified by Rauch and (...) Frese. Data collection and analysis were guided by three linked sub-processes proposed by Miles and Huberman, which include data reduction, data display and conclusion drawing and verification. The findings of this study show that, over the course of the subject’s life, the personality traits identified by Rauch and Frese as conducive to successful engagement in entrepreneurial activities were displayed, namely need for achievement, risk-taking, innovativeness, autonomy, internal locus of control, and self-efficacy. In so far as it can be argued that these personality traits inherently predisposed Steve Jobs to achieve the success he displayed as an entrepreneur, the findings of this study affirm the relevance of the personality trait perspective in describing and understanding the life course of successful entrepreneurs. The article analyses legal preconditions for personal identification in physical and electronic space (hereinafter – cyberspace). Analysis of legal governing of identification in physical space is followed by the analysis of the same in cyberspace. Compulsory elements of identification in physical space and compulsory and non-compulsory elements of identification in cyberspace are provided which leads to conclusions about problem aspects concerning personal identification in cyberspace and related legal governing. This scientific article consists of four main (...) chapters. The first chapter „Identity and Personal Identification“ looks into identity, its content and elements alongside with personal identification. The second chapter „Personal Identification in Physical Space“ scrutinizes legal preconditions of identification in physical space in Lithuania. The third chapter „Personal Identification in Cyberspace“ looks into elements of legally regulated and non-regulated personal identification in cyberspace and discusses identity of a person in cyberspace. The fourth chapter „Electronic Identity of a Person and Legal Regulation“ analyzes and systematizes elements of electronic identity of the person and presumes their reliability and mandatory legal governing. Dennett’s recent defense in this journal of the heterophenomenological method and its supposed advantages over Husserlian phenomenology is premised on his problematic account of the epistemological and ontological status of phenomenological states. By employing Husserl’s philosophy of science to clarify the relationship between phenomenology and evidence and the implications of this relationship for the empirical identification of ‘real’ conscious states, I argue that the naturalistic account of consciousness Dennett hopes for could be authoritative as a science only by virtue (...) of the very phenomenological evidences Dennett’s method consigns to the realm of fiction. The paper presents a semiotic interpretation of the phenomenological debate on the notion of person, focusing in particular on Edmund Husserl, Max Scheler, and Edith Stein. The semiotic interpretation lets us identify the categories that orient the debate: collective/individual and subject/object. As we will see, the phenomenological analysis of the relation between person and social units such as the community, the association, and the mass shows similarities to contemporary socio-semiotic models. The difference between community, association, and mass provides an explanation (...) for the establishment of legal systems. The notion of person we inherit from phenomenology can also be useful in facing juridical problems raised by the use of non-human decision-makers such as machine learning algorithms and artificial intelligence applications. There is no way of losing track of the subject in ‘I’-thoughts, since there is no way of forming dynamic Fregean thoughts. I conclude by arguing that one’s capacity to think of oneself self-consciously is not exhausted by the presence or absence of linguistic devices such as ‘I’. Fast and accurate recognition of teammates is crucial in contexts as varied as fast-moving sports, the military, and law enforcement engagements; misrecognition can result in lost scoring opportunities in sport or friendly fire in combat contexts. Initial studies on teammate recognition in sport suggests that athletes are adept at this perceptual ability but still susceptible to errors. The purpose of the current proof-of-concept study was to explore the trainability of teammate recognition from very brief exposure to vision of the whole-body (...) form and motion of a previously unknown individual. Participants were divided into three groups: a 4-week training group who were also the actors for the test and training footage, a 2-week training group, and a no-training group. Findings revealed significant differences between the training groups and their improvement from the pre-to post-test on Response Accuracy and Movement Time. The current study found the best performance in the 4-week Training group. The biggest improvement was found in the 2-week training group, whilst no significant improvement was made in the Control group. These results suggest that training was effective, but also indicate that having initially performed the movements as actors may have led to improvements in baseline testing and ultimately the best results, thus physical performance of skills combined with video-based training may reduce the amount of time needed to improve teammate identification. Every year, thousands of undocumented Mexican workers enter the United States. Their presence, together with the settlement of undocumented and legal immigrants from many other countries, constitutes the source of one of the most persistent ideological conflicts in American history: the conflict over immigrants' rights. Official discourses in many cases identify being Hispanic with poor performance at school, drug abuse, poverty and violence. However, aside from mainstream images of who immigrants are, little research has been done on the identity that (...) immigrants themselves build and project, and on the processes that affect the formation of such identity. In this article I investigate identity through discourse analysis, looking specifically at linguistic strategies used by a group of undocumented Mexican immigrants to identify characters in storytelling. I argue that immigrants use ethnic identity as a central identification category for self and others in their stories, showing that ethnic mentions are widespread in story orientations, and that they exhibit different degrees and types of relevance depending on their relationship with the interactional context and/or the story world. Ethnic mentions are used in stories to affirm certain characteristics of one's own identity and of the identity of others via the presentation and evaluation of behaviors. In argumentative stories disputable behaviors are openly attributed to out groups, and so these stories help speakers to build images of who they are and how they stand in relation to others. In stories of personal experience, the connections between identities and behaviors are implicit, but they still respond to socially established expectations. Thus, individual stories also contribute to build those expectations about how belonging to certain ethnic groups may affect action in particular domains of life. The pervasiveness of ethnic identification in immigrant stories cannot be understood without resorting to wider social processes that frame the immigration experience of undocumented Mexican workers. In this case, I stress the importance of the pressure that the ideology of race and ethnicity, enacted through public discourse at all levels, exerts on every individual in American society. We examined how presentations of organ donation cases in the media may affect people’s decisions about organ donation issues. Specifically, we focused on the combined effect of the information about the number of recipients saved by the organs of one deceased person and the identifiability of the donor and the recipient in organ donation descriptions, on people’s willingness to donate the organs of a deceased relative. Results suggest that reading about more people who were saved by the organs of a (...) deceased donor does not increase willingness to donate. Replicating earlier research, we found that reading about a case of organ donation involving an identified deceased donor, deceased willingness to donate. However, this effect was attenuated when participants read about more recipients who were saved by the donation. Importantly, the presentation that prompted the greatest willingness to donate a deceased relative’s organs was the one that featured an unidentified donor and only one identified recipient. Finally, an explorative investigation into participants’ subconscious thoughts of death following the organ donation story revealed that identifying a deceased organ donor prompts more thoughts of death in the perceiver. The first-person authority view (FPA) is the current dominant view about what someone’s gender is. According to FPA the person has authority over her own gender identity; her sincere self-identification trumps the opinions of others. There are two versions of FPA: epistemic and ethical. Both versions try to explain why a person has authority over her own gender identity. But both have problems. Epistemic FPA attributes to the self-identifier an unrealistic degree of doxastic reliability. Ethical FPA implies the existence (...) of an unreasonably strong and unqualified obligation on the part of others not to reject the person’s identification. This essay offers an alternative: the negotiative theory of identity. Unlike epistemic FPA, the negotiative theory doesn’t presume the reliability of self-directed beliefs. Unlike ethical FPA, the negotiative theory doesn’t imply an obligation not to reject. Instead, it contends that an act of rejection is morally permissible if and only if it respects three ethical and epistemic constraints. In doing so, the negotiative theory combines the strengths and avoids the weaknesses of both versions of FPA, and gives us substantive insight into how far first-person authority reaches in terms of grounding rights and obligating others. The narrative view of personhood suggests that we as persons are constituted by self-narratives. Self-narratives support not only the sense of personal persistence but also agency. However, it is rarely discussed how self-narratives promote or hinder personal well-being. This paper aims to explore what a healthy self-narrative looks like. By reframing a famous debate between Strawson and Schechtman about narrative personhood, I argue that self-narratives can hinder our personal well-being when affective identification leads to inflexible self-images, illustrated with (...) the examples of imposter syndrome and rationalization. Furthermore, I explore how having a healthy self-narrative is not about disengaging from one's personal past and future, but about fostering affective identification in ways that allow flexible self-images. The problem of the legal person is a central issue in legal philosophy and the theory of law. In this article I examine the semantic meaning of the concept of the person in Russian philosophy at the turn of the twentieth century, considered to be the "Golden Age" of Russian legal thought. This provides an overview of the conception of the personality in the context of different legal approaches (theory of natural law, legal positivism, the psychological legal doctrine, and the (...) sociological school of law). I indicate a polemic among the theories of the person and attempts to create an integral concept of the legal subject. In addition I present an analysis of the relation between the concepts of the legal subject and the moral person, which personify fundamental features of law and morality. In order to demarcate the notions of individual and the legal subject, I focus on doctrines of the artificial person or the juridical person. (shrink)

This article argues that the concept of personhood is intrinsically relational and that a relational understanding of created personhood can be derived from divine personhood and understood systematically in relation to itself, the pre-personal world and to other persons. Insofar as this set of three relationships is understood to be dislocated by sinful self-enclosedness in the penultimate reality and standing in contradiction to the ultimate reality retrospectively constituting it, the article suggests that all created personhood at present could be (...) called ‘potential’ personhood. The article then examines the concept of personhood maintained by Alberto Giubilini and Francesca Minerva in their recent paper on ‘after-birth abortion’ in comparison to Johannes Fischer’s discussion of embryonic stem cell research and personhood. In response to both, the article concludes that it is not possible at present for humans to make a concrete external identification of the divine relation that internally constitutes created personhood. As a result, the article proposes adopting a veil of ignorance with reference to the status of embryonic personhood, as it would be worse to deny the status of personhood to an actual person than to attribute personhood to a non-person. Fregoli delusion is the mistaken belief that some person currently present in the deluded person's environment is a familiar person in disguise. The stranger is believed to be psychologically identical to this known person even though the deluded person perceives the physical appearance of the stranger as being different from the known person's typical appearance. To gain a deeper understanding of this contradictory error in the normal system for tracking and identifying known persons, we conducted a detailed survey of (...) all the Fregoli cases reported in the literature since the seminal Courbon and Fail paper. Our preliminary reading of these cases revealed a notable lack of definitional clarity. So, we first formulated a classification scheme of different person misidentification delusions so as to identify those cases that qualified as instances of Fregoli according to the above characterization: the mistaken belief that a known person is present in the environment in a different guise to his or her typical appearance. We identified 38 clear cases of this type and set out to answer a series of questions motivated by current hypotheses about the origin of the Fregoli delusion. We asked whether the patients misidentified particular strangers, made reference to the misidentified known persons using wigs or plastic surgery , misidentified many different strangers or only one, showed other symptoms , and made inferences about the motives of the known persons in disguise. We conclude by discussing the implications of our findings for current hypotheses concerning the origin of the Fregoli delusion. (shrink)

Purpose. This article clarifies the significance of the person’s social self-identification as a basis for civilization and institutional explanation of national self-identification in Ukraine. Theoretical basis. The authors found that the analysis of the cultural and anthropological principles of national self-identity reveals two main opposed concepts: the concept of "eastern" cultural and social self-identity of Ukraine, which correlates with the metaphor of the split between "East" and "West", and the concept of "western" projection of the European future of (...) Ukraine, which correlates with the metaphor of the bridge between "East" and "West". These concepts reflect the options for the citizens of Ukraine to make a personal choice of the way in achieving social self-identity. Douglas North’s concept of "open-access order" states and "limited access order" states can be used as a basis for an alternative, pragmatic approach to choice the criteria of national self-identity. Originality. National self-identification is a result of the choice of the person’s self-identification: still the person takes into account the history of the nation, the ethnic diversity of the nation, its cultural and civilizational characteristics. The philosophical-anthropological approach contributes to the demystification of the grounds of social self-identification, revealing the decisive role of the personal choice in shaping the new institutional foundations of national self-identity. Harmonization of the social institutions of Ukraine with the institutions of the European Union and the international community institutions opens wide opportunities for Ukraine’s successful integration into the "open-access order" societies. The clarification of the value and symbolic aspects of national self-identity in Ukraine contributes to the successful functioning of these institutions. Multilingualism is an adequate response to the global challenge of the reconstruction of Ukraine’s national self-identity. The education system is a key area for introducing multilingualism. Conclusions. The development, justification and systematization of cultural and institutional criteria for choosing the best ways to strengthen of national self-identity in Ukraine are a prerequisite for the successful self-identification of Ukrainian citizens in a complex and ever-changing global world. Many of the differences between empirical/psychological and conceptual/philosophical approaches to the mind can be resolved using a more precise language that is sensitive to both. Distinguishing identification from identity and identification as from identification with, and then defining the experiential concept of the per sonat, provides a walking bridge. Applying the new terminology to increasing degrees of dissociation, from non-pathological cases to multiple personality, shows how our psychologies can profit from philosophical analysis while our philosophies can revise (...) themselves according to empirical data. Redefining the psychological structures of persona, personality, and self in terms of an experientially more precise conceptual vocabulary, including the per sonat, avoids the pitfalls of the old approaches and provides insights into the nature of human consciousness that lead both to therapeutic results in psychotherapy and a long-overdue conceptual revision in the philosophy of personal identity. Among the practical conclusions is that for legal purposes MPD should not be considered as a multiple person phenomenon but, rather, as a phenomenon of one person who, simultaneously, is identified as many selves. Among the theoretical conclusions is that a person qua person consists not just in a biology and a psychology but also a philosophy. (shrink)

The fast development of synthetic media, commonly known as deepfakes, has cast new light on an old problem, namely—to what extent do people have a moral claim to their likeness, including personally distinguishing features such as their voice or face? That people have at least some such claim seems uncontroversial. In fact, several jurisdictions already combat deepfakes by appealing to a “right to identity.” Yet, an individual’s disapproval of appearing in a piece of synthetic media is sensible only insofar as (...) the replication is successful. There has to be some form of identity between the content and the natural person. The question, therefore, is how this identity can be established. How can we know whether the face or voice featured in a piece of synthetic content belongs to a person who makes claim to it? On a trivial level, this may seem an easy task—the person in the video is A insofar as he or she is recognised as being A. Providing more rigorous criteria, however, poses a serious challenge. In this paper, I draw on Turing’s imitation game, and Floridi’s method of levels of abstraction, to propose a heuristic to this end. I call it the identification game. Using this heuristic, I show that identity cannot be established independently of the purpose of the inquiry. More specifically, I argue that whether a person has a moral claim to content that allegedly uses their identity depends on the type of harm under consideration. (shrink)

The book offers new answers to two central questions that have been heavily debated, especially in recent years, in the debate on so-called de se skepticism: Is there something special about first-person thinking? And how does it relate to other forms of self-consciousness? The answer to the first question is a resounding "yes." This assertion is justified by the double-reflexive structure, motivational force, and specific concern that first-personal thinking involves. Regarding the second question, the book concludes that there are non-linguistic (...) forms of self-consciousness. However, these should not be understood as representational contents or non-relational properties, but as mental relations that, without themselves being represented, can contribute to the phenomenal character of conscious states. In this respect, the book also provides a justification for the rarely considered impure intentionalism. (shrink)

This paper focuses on three theories of personal identity that incorporate the idea that personal identity is the result of a person’s adopting certain attitudes towards certain mental states and actions. I call these theories subjective theories of personal identity. I argue that it is not clear what the proponents of these theories mean by “personal identity”. On standard theories, such as animalism or psychological theories, the term “personal identity” refers to the numerical identity of persons and its analysis (...) provides the persistence conditions for persons. I argue that if the subjective theories purport to provide a criterion of numerical personal identity, they fail. A different interpretation may suggest that they purport to provide a non-numerical type of identity for the purpose of providing plausible analyses of certain identity-related practical concerns. I argue that the criteria the subjective theories provide fail to capture several of the identity-related concerns. As a result, this interpretation must be rejected as well. (shrink)

The issues of organizational wrongdoing damage organizational performance and limit the development of organizations. Although organizational members may know the wrongdoing and have the opportunity to blow the whistle, they would keep silent because of the interpersonal risks. However, leaders can play an important role in shaping employee whistleblowing. This study focuses on discovering the mechanisms of how authentic leaders influence employee whistleblowing with a sample from China. Results demonstrate that authentic leadership is positively related to internal whistleblowing. Team psychological (...) safety partly mediates the relationship between authentic leadership and internal whistleblowing. Personal identification partly mediates the relationship between authentic leadership and internal whistleblowing. The study contributes to the extant theory by filling the gap between leadership and whistleblowing. (shrink)
