: A rich array of twelfth to fifteenth century Arabic texts captures the advent of a supererogatory prayer known as ṣalāt al-raghā’ib, on the eve of the first Friday of the month of Rajab in late eleventh-century Jerusalem, and its wide dissemination. This corpus offers an unusually vivid picture of the formation and the transformation of a medieval bid’a, or, of an ‘invention of tradition’. Combining our expertise in Islamic law and in Ayyūbid and Mamluk era history, we use this (...) corpus for an in-depth study of popular piety, power politics, scholarly polemics and legal discourse. Twenty eight translated excerpts of various texts are presented in this paper, preceded by a detailed introduction. Exploring legal reasoning in its concrete political and social context provides a nuanced understanding of the development, mass proliferation and ensuing debate over a highly controversial and extraordinary potent religious practice. Psychological studies of touch and blindness have been fraught with controversy. Within this field there remains an important theoretical divide. Many researchers have taken a cognitive approach to the study of touch and blindness, relating these to higher order processes, such as memory and concept formation. Others adopt a theoretical perspective, arguing that it not necessary to consider the 'internal representation' of the stimuli, when investigating touch - thus people make use of information from the physical biomechanical properties of their (...) limbs as they assess the physical properties of objects. In addition, psychologists differ in the relative importance they place on the modality of sensory stimulation for subsequent perceptual experiences. Some psychologists argue that touch can do many of the things that are accomplished by vision, and claim that the mode of sensory stimulation is not critically important for perception, arguing that much information can be obtained through non-visual modalities. Others suggest that there are important consequences of a lack of visual experience, arguing for the importance of multiple forms of sensory input for conceptual development. New to the Debates in Psychology series, Touch, Representation, and Blindness brings together the leading investigators in these areas, each presenting the evidence for their side of the debate. An introductory chapter sets the theoretical and historical stage for the debate, and a concluding chapter draws together the different views and ideas set forth by the contributors, summarizing and resolving the discussion. Jhdt. ins Lateinische ubersetzte und zunachst Aristoteles zugeschriebene neuplatonische Schrift, gehort zu den zentralen philosophischen Texten, die an den Universitaten des 13. Jhdts. gelesen werden. Ihr anonymer Autor entwickelt darin eine an Proklos angelehnte, jedoch zugunsten der Schopfungstheologie der monotheistischen Religionen abgewandelte Ontologie. Der Kommentar bildet eine wichtige Quelle fur Erkenntnisse zu Entstehung und Inhalt des Buches. Auch zeigt er die Arbeitsweise eines der grossten Denker des (...) lateinischen Mittelalters und ist ein wichtiger Baustein fur das Verstandnis des philosophischen und theologischen Werkes Thomas von Aquins, in dem er immer wieder auf das Buch von den Ursachen zuruckgreift. Organisationen spielen in modernen Gesellschaften eine zentrale Rolle. Der Beitrag geht davon aus, dass in den mittlerweile etablierten Formen von Ethik und Ethikberatung in Einrichtungen des Gesundheitssystems eine angemessene Reflexion des Organisationsbezugs oft ausbleibt bzw. eine besondere Herausforderung darstellt. Wir konzipieren deshalb eine „prozedurale Organisationsethik“, die sich kritisch mit der organisationalen Passung der Prozesse ethischer Reflexion auseinandersetzt. Daraus lassen sich als Anregung für Theorie und Praxis von ethischen Prozessen praktische Schlussfolgerungen ableiten. Sie betreffen die Orte der Differenzsetzung für die Frage (...) nach dem Guten; die ethischen Hintergrundtheorien und die Frage nach der organisatorischen Verknüpfung der Reflexionssettings. Definition of the problem Organisations play a vital role in modern societies. This article presumes a lack of sufficient organisational reflection of well-established forms of ethics and ethics counselling in institutions belonging to the health sector or sees particular challenges where it is implemented. Arguments We have therefore conceived a procedural type of organisational ethics which critically examines the organisational fit of processes in terms of ethical reflection, leading to practicable suggestions. Ethics consultation in institutions of the healthcare system has been given a standard form based on three pillars: education, the development of guidelines and concrete ethics consultation in case conferences. The spread of ethics committees, which perform these tasks on an organizational level, is a remarkable historic achievement. At the same time it cannot be denied that modern ethics consultation neglects relevant aspects of care ethics approaches. In our essay we present an “ethics of care” approach as well as an (...) empirical pilot project—“Ethics from the bottom up”—which organizes ethics consultation based on this focus. Findings and philosophy of the project will be discussed as far as relevant for ethics consultation in the healthcare system. (shrink)

Ferrara, A Guide to Research in Music Education, 5th Edition (Lanham, Maryland: Scarecrow Press, Inc., 2005)Jack HellerIt is curious that Lawrence Ferrara disagrees with Jack Heller and Edward. J. P. O'Connor's view1 that "philosophy" is not "research," yet in the chapter headings in the book A Guide to Research in Music Education, (...) 5th Edition, Chapter 4 is labeled "Philosophical Inquiry," while other chapters are labeled "Qualitative Research," "Nonexperimental Research," "Quantitative Research," and "Historical Research" (italics added). Why not "Philosophical Research?" Maybe he, too, believes that philosophy is not research.In our Handbook Chapter2 we pointed out that research should be systematic and based on "empirical observation." To make things worse we said that research should try to provide "unbiased evidence." Ferrara ascribes to us a positivistic view that we did not make nor believe. That view, according to Ferrara is that the "key reason for their [our] dismissal of philosophical inquiry (notice inquiry not research) as a bona fide research design is the invariable criterion that they [we] assign to all research if it is indeed research: to present 'unbiased evidence.'" [End Page 89] We still believe that research should try to be as objective as possible while realizing that all observations are researcher dependent and have error. Research should strive to reduce error as much as possible.My reading of Kuhn's The Structure of Scientific Revolutions does not conflict with what was written in our Chapter. We did not claim that data are unbiased but rather that research should try to limit bias and try to interpret observations that can be supported by specific behavior.Philosophy, or more properly model building, should lead research. Assumptions that appear in a model are just that. They are assumptions. Not fact; not unbiased opinion. But these assumptions or philosophical conclusions should not be called research in music education because they do not provide any behavioral evidence as support. The deductive process used in philosophy (syllogistic reasoning, for example) should help to develop hypotheses that can be investigated by an inductive process (data collection). Philosophy is a time honored scholarly activity. We certainly do not mean to diminish its importance. All research should have a philosophical underpinning that should produce a theoretical model. This model then should be tested by research. Our Handbook Chapter takes this position. Philosophy is philosophy, not research.Ferrara paraphrases Rom Harre3 by stating thatthere are at least three realms of scientific research and theory: the first realm is marked by ordinary perception in which what is known is based on observable and empirically verifiable facts; in the second realm, perception may catch up with conception–there is a promise of technological development... through which researchers will eventually be able to 'observe' and empirically verify what they only conceived (as in philosophical inquiry) as the probable explanation; and in the third realm there are genuine theoretical acts of imagination... that will never be directly (italics added) perceived, for example, empirically observed or verified.Ferrara points out that this "positivist dictum [the Harre quote above]... is unrealistic in relation to actual (italics added) scientific research and practice."4 It is not clear to which "actual scientific research and practice" Ferrara refers. This entire view is misguided. Ferrara does not believe "the methodology of the natural sciences can appropriately be utilized in the human sciences and arts research, retaining the level of objectivity (italics added) achieved in the natural sciences." Who does Ferrara believes carries out natural science research? Are they not humans, constrained by the same problems of observation that all humans encounter? Are their observations more "objective" as Ferrara seems to believe? The natural scientist, like all other researchers, faces the issue of error in observing phenomena that all researchers face. In ‘The Choice Theory of Contracts’, we advance a claim about the centrality of autonomy to contract. Since publishing Choice Theory, we have engaged dozens of reviews and responses; here, we reply to Robert Stevens, Arthur Ripstein, and Brian Bix. All this rigorous debate confirms for us one core point: contract’s ultimate value must be autonomy, properly understood and refined. Autonomy is the telos of contract and its grounding principle. In Choice Theory, we stressed the proactive facilitation component of autonomy, (...) in particular, the state’s obligation regarding contract types. Here, we highlight two additional, necessary implications of autonomy for contract: regard for future selves and relational justice. These three aspects of autonomy shape the range, limit, and floor, respectively, for the legitimate use of contract. They provide a principled and constrained path for law reform. (shrink)

This article outlines the contributions of the Kraków School to the field of science and religion. The Kraków School is a group of philosophers, scientists, and theologians who belong to the milieu of the Copernicus Center for Interdisciplinary Studies. The members of the group are engaged in inquiries pertaining to the relationship between theology and various sciences, in particular cosmology, evolutionary theory, and neuroscience. The article includes a presentation of the historical background of the School, as well as its main (...) original contributions pertaining to the history of the interactions between science and religion, the rationality and mathematicity of the universe, theology of science, and the role of logic in theology. The literature on brain activity in depression and anxiety is reviewed with an on highlighting discrepancies and inconsistencies. In particular, and posterior asymmetries have been reported for both depression anxiety, but the magnitude and direction of these asymmetries has been We propose that by identifying subtypes of depression and anxiety of these inconsistencies can be explained. In addition, we review suggesting that issues of comorbidity are important to consider in to account for regional brain activity in depression and anxiety.

This provocative book attempts to resolve traditional problems of identity over time. It seeks to answer such questions as 'How is it that an object can survive change?' and 'How much change can an object undergo without being destroyed'? To answer these questions Professor Heller presents a theory about the nature of physical objects and about the relationship between our language and the physical world. According to his theory, the only actually existing physical entities are what the author calls (...) 'hunks', four-dimensional objects extending across time and space. Instead, we propose that representations are rich right from the beginning of a child’s life, and that they are driven mainly by acting and interacting in the physical and social world. The more variety in a child’s interactional experience (i.e., synchrony, sequentiality, and prediction), the (...) more enriched and abstracted the representations become. We review literature providing evidence for the ways in which infants’ development toward symbolic communication benefits from repeated social (inter)action and consider some implications for computational approaches. Every domain-specific ontology must use as a framework some upper-level ontology which describes the most general, domain-independent categories of reality. In the present paper we sketch a new type of upper-level ontology, which is intended to be the basis of a knowledge modelling language GOL (for: 'General Ontological Language'). It turns out that the upper- level ontology underlying standard modelling languages such as KIF, F-Logic and CycL is restricted to the ontology of sets. Set theory has considerable mathematical power and (...) great flexibility as a framework for modelling different sorts of structures. At the same time it has the disadvantage that sets are abstract entities (entities existing outside the realm of time, space and causality), and thus a set-theoretical framework should be supplemented by some other machinery if it is to support applications in the ripe, messy world of concrete objects. In the present paper we partition the entities of the real world into sets and urelements, and then we introduce several new ontological relations between these urelements. In contrast to standard modelling and representation formalisms, the concepts of GOL provide a machinery for representing and analysing such ontologically basic relations. (shrink)

We investigate the processing of wh questions in Niuean, a VSO ergative–absolutive Polynesian language. We use visual‐world eye tracking to examine how preference for subject or object dependencies is affected (a) by case marking of the subject (ergative vs. absolutive) and object (absolutive vs. oblique), and (b) by the transitivity of the verb (whether the object is obligatory). We find that Niuean exhibits (a) an effect of case, whereby dependencies of arguments with absolutive case (whether subjects or objects) are preferred (...) over dependencies of arguments with ergative or oblique case, and (b) an effect of transitivity, whereby dependencies of obligatory objects (i.e., of transitive verbs) are preferred over dependencies of optional objects (i.e., of intransitive verbs). These results constitute evidence against theories that appeal to a universal subject advantage, or to the linear distance between filler and gap. Instead, the effect of case is consistent with a frequency‐based account: Because absolutive case has a wider syntactic distribution than ergative or oblique, absolutive dependencies are easier to process. The effect of transitivity reflects sensitivity of the parser to whether or not an argument is obligatory. We propose that these two strategies could be unified if the parser prefers dependencies with arguments that are more likely to materialize. (shrink)

While speakers have been shown to adapt to the knowledge state of their addressee in choosing referring expressions, they often also show some egocentric tendencies. The current paper aims to provide an explanation for this “mixed” behavior by presenting a model that derives such patterns from the probabilistic combination of both the speaker's and the addressee's perspectives. To test our model, we conducted a language production experiment, in which participants had to refer to objects in a context that also included (...) a visually misleading object whose function was either known to both partners, or known just to the speaker but not the addressee. Modeling results indicate that the experimental findings cannot be explained by assuming that speakers tailor a referring expression solely to their own perspective or to the perspective of their addressee. Instead, accounting for the behavioral pattern requires an approach where both perspectives influence the choice of referring expressions. Nevertheless, in our situation, speakers consider their partner's perspective more than their own. (shrink)

The article deals with larger stretches of talk-in-interaction and argues in favor of a descriptive approach, which integrates the structural requirements of global organization, the special type of sequential orderliness within larger units as well as the genre-orientation of these units. Drawing on previous work in conversation analysis, discourse analysis and the sociological genre analysis, the article introduces GLOBE as an analytical tool which functionally links discourse units to conventionalized communicative purposes. GLOBE reconstructs the interactive achievement of genre-oriented discourse units (...) in a three-branch analysis of jobs, devices and forms. The analytical potential of GLOBE is demonstrated in the exemplary genre-contrastive analysis of a narrative, an explanative and an argumentative excerpt. On the basis of the analyses of the three genres, the overarching constitution of genre-oriented global units is then explicated. (shrink)

Recently, more and more talking is going on about “other universes” (different ones from “our”), the number of which may be infinite. Speculations on this topic emerged in effect of the discussions on the issue of the anthropic principle, and the so-called inflation scenario. In truth, this kind of speculations are hardly recognized as scientific theories, however, they (...) may be included in a sort of “scientific fringe” fulfilling a beneficial heuristic function.All of the speculations regarding numerous universes boil down to the juggling of probabilities, i.e. to the applying of the theory of probability to the universes’ set. However, without probabilistic measure being introduced onto this “set” (as it is not known whether it is a set in a technical sense of this term)—and there is no knowledge at all as to how to do this—such considerations may not go beyond a vague intuition.The producing of other universes usually results from an assumption that the disturbing of original circumstances, of values of physical constants, or of other parameters characterizing the universe is possible. On the other hand, the idea of the final theory seems to assume that the mathematical structure of this theory should be rigid, i.e. that the disturbing of its parameters leads on to the very same structure. This would have eliminated the possibility of the existence of other universes.The idea of infinite number of universes sometimes has an anti-theological undertone: there is no need for assuming purposeful acting of the Creator, since all possibilities are fulfilled. The reaction of a theologian may be as follows: Just the same, God may create just a single universe, as much as an infinite number of universes. Background Much like academic-industry partnerships, industry financial support of patient advocacy organizations has become very common in recent years. While financial conflicts of interest between PAOs and industry have received more attention in recent years, robust efforts to mitigate these conflicts are still limited. Main body The authors outline the possible benefits and ethical concerns that can result from financial interactions between biomedical companies and PAOs. They argue that the use of novel strategies, such as the creation of a standing (...) ethics committee, could be helpful in managing FCOIs and ensuring the warranted trust of PAO’s constituents. Although ethics committees to address FCOIs are common in the academic context, its use by PAOs is still limited. The authors conclude by describing the process of development and implementation of such an ethics committee at the Crohn’s & Colitis Foundation. Conclusions While collaborations with industry can result in conflicts of interest, PAOs can develop strategies to address those conflicts. One such strategy is the creation of a standing independent ethics committee to guide PAOs on new and/or existing programs and protocols as they pertain to their industry relationships. (shrink)
