Using St. Thomas Aquinas's natural law philosophy and Divine Exemplar argument to prompt new discussion of ethical questions that lawyers and judges should confront, the author delivers a complete occupational profile for the professional conduct of judges and lawyers. This text challenges current beliefs and suggests a return to the "roots" of the system, in which reason, virtue, and justice guide the law and its practice.

Already in his 1913 Ideen I, Husserl claimed that there are two types of intuition: experiencing, that is, sense, intuition and ideal intuition. The former provides us with contingent facts, whereas the latter provides essences. Commenting on this dichotomy in his own book-length work, Appearance and Sense, published in 1914, Shpet believed Husserl had overlooked an important and distinct type of phenomenon that we call “social” and thereby omitted a corresponding third type of intuition that reveals the social function or (...) purpose of a thing. This oversight on Husserl’s part led him to claim that an “I,” or ego, stood behind or possessed the human individual’s consciousness. Husserl failed to notice that we can and do meaningfully speak of a social consciousness that, as such, belongs to no single individual. Apart from the “evidence” of ordinary language, Husserl’s strict dichotomy leaves unaddressed how we can proceed from external appearances to their understanding, which cognitively is always in terms of concepts, traditionally called “universals.” That is, we frame our experiences and express them verbally, the words employed being meaningful to us and hopefully to “the other.” Realizing the problem of transiting from the intuition of the contingent to that of the ideal, Shpet in early 1917 downplayed the difference, preferring to call them different degrees of seeing with different conscious attitudes. He called the conscious “seeing” associated with an understanding of words “intelligible intuition.” With an interest in historical methodology predating his acquaintance with phenomenology, Shpet recognized that the only tool available to the historian is the words appearing on documents, which serve as signs. How we understand these signs forms the study of hermeneutics, which functions as the epistemology of history. However, the fear remains that if we conceive the understanding of signs and “intelligible intuition” subjectively, we lapse into a psychologism. We must not forget the social origin of language, that language is no more the possession of an individual than is consciousness. The sense of words is established in an intersubjective context. Thus, Shpet turned to a study of language much as he had previously turned to consciousness and saw neither as subjective. (shrink)

This book provides a new all-round perspective on the life and work of Edgar Zilsel (1891-1944) as a philosopher, historian, and sociologist. He was close to the Vienna Circle and has been hitherto almost exclusively referred to in terms of the so-called “Zilsel thesis” on the origins of modern science. Much beyond this “thesis”, Zilsel’s brilliant work provides original insights on a broad number of topics, ranging from the philosophy of probability and statistics to the concept of “genius”, from the (...) issues of scientific laws and theories to the sociological background of science and philosophy, and to the political analysis of the problems of his time. Praised by Herbert Feigl as an “outstanding brilliant mind”, Zilsel, being as a Social-Democrat of Jewish origins, mostly led a life of hardship marked by emigration and coming to a sudden and tragic end by suicide in 1944. The impossibility of an academic career has hindered the reception of Zilsel’s scientific work for a long time. This volume is a contribution to its late reception, providing new insights especially into his work during his years in Vienna; moreover, it shows the heuristic value of Zilsel’s ideas for future Scholar research – in philosophy, history, and sociology. -/- (ISSN: 0929-6328). The purpose of our study was to measure the relationship between performance on various attentional tasks and hypnotic susceptibility. Healthy volunteers participated in a study, where they had to perform several tasks measuring various attention components in a waking state: sustained attention, selective or focused attention, divided attention and executive attention in task switching. Hypnotic susceptibility was measured in a separate setting by the Waterloo-Stanford Groups Scale of Hypnotic Susceptibility, Form C .We found no significant correlation between any of the (...) attentional measures and hypnotic susceptibility. Highly hypnotizables did not prove to be superior to or worse than the other individuals in any of the tests.These results do not support the neuropsychophysiological model of hypnosis, as they show no consistent relationship between hypnotic susceptibility and waking attentional performance. This book presents a comprehensive study of the influence of Immanuel Kant’s Critical Philosophy in the Russian Empire, spanning the period from the late 19th century to the Bolshevik Revolution. It systematically details the reception bestowed on Kant’s ideas during his lifetime and up to and through the era of the First World War. The book traces the tensions arising in the early 19th century between the imported German scholars, who were often bristling with the latest philosophical developments in their (...) homeland, and the more conservative Russian professors and administrators. The book goes on to examine the frequently neglected criticism of Kant in the theological institutions throughout the Russian Empire as well as the last remaining, though virtually unknown, embers of Kantianism during the reign of Nicholas I. With the political activities of many young radicals during the subsequent decades having been amply studied, this book focuses on their largely ignored attempts to grapple with Kant’s transcendental idealism. It also presents a complete account of the resurgence of interest in Kant in the last two decades of that century, and the growing attempts to graft a transcendental idealism onto popular social and political movements. The book draws attention to the young and budding Russian neo-Kantian movement that mirrored developments in Germany before being overtaken by political events. (shrink)

Ethnic prejudice can lead to exclusion and hinder social integration. Prejudices are formed throughout socialization, and social norms inform individuals about the acceptability of prejudice against certain outgroups. Adolescence is a crucial period for the development of intergroup attitudes, and young people are especially prone to follow the norms they perceive in their reference groups. At the same time, the effect of perceived norms on prejudice in school classes has been rarely studied. In Hungary, where prejudice against the Roma is (...) widespread and there is no clear social norm proscribing prejudiced manifestations, this topic is especially relevant. In the present paper, based on multi-level analyses of panel data from Hungarian ninth-graders, we find that adolescents adjust their attitudes to those they perceive to be dominant among their classmates and that classmates serve as more important reference groups than teachers do. More contact with Roma is found to be associated with less prejudice against them. Looking at school classes, we find that at the beginning of the school year, many students underestimate the rejection of prejudiced expressions in their classes. By the end of the year, many students are found to adjust their own attitudes to the falsely perceived class norm. Based on our findings, we argue that school classes should be treated as important normative contexts for the socialization of intergroup attitudes and should receive special attention from both scholars and practitioners working in the fields of prejudice research and reduction. Furthermore, we suggest that teachers can most successfully hinder prejudices by working on a common, visible, shared class norm rather than “teaching” students that prejudices are not acceptable. Die Autoren zeigen das anhand der nur teilweise erforschten Interaktion zwischen den Wissenschaftsphilosophen des deutschen und französischen Sprachraums. Das Buch liefert neue Erkenntnisse zur Rolle der Philosophiekongresse in Prag 1934 und Paris 1937 sowie zur Bedeutung einzelner Akteure wie Marcel Boll, der die Rezeption des Logischen Empirismus in Frankreich beförderte. Die Spuren, die Ernst Mach, aber auch der weniger bekannte deutsche Physiologe und Hirnforscher Ewald (...) Hering in der französischen Wissenschaftsphilosophie hinterliessen, verfolgen die Autoren bis hin zu den Ideen Jean Piagets. Im Mittelpunkt des Buchs stehen Philosophen aus Frankreich, Deutschland und Österreich und ihre Leistung, die Wissenschaften nicht nur erkenntnistheoretisch und logisch durchleuchtet, sondern auch erkannt zu haben, dass ihre theoretische Struktur nur dann vollständig erfasst werden kann, wenn ihre praktische Dimension mit einbezogen wird. Dafür steht Henri Poincaré, der die tragende Rolle der Konventionen für die Theoriebildung in der Mathematik herausstellte. Sichtbar wird der Bezug zur Praxis auch in Moritz Schlicks Überlegungen zu einer auf Empirie basierenden Ethik oder in der Arbeit Otto Neuraths, der eine aus den modernen Wissenschaften gewonnene Konzeption menschlichen Erkennens für das Projekt der gesellschaftlichen Aufklärung fruchtbar machen wollte. The article shows how two domains of Neurath’s broad and multifaceted work are related to each other: the concepts and methods he wanted to implement in political economics, on the one hand, and the methods of visualization that he and his interdisciplinary team developed at the Social and Economic Museum of Vienna, on the other. Some of Neurath’s suggestions in both domains are surprisingly modern even today.

This paper focuses on the narrative aspect of Seneca’s idea of self-transformation. It compares Seneca’s viewpoint with some modern notions of the narrative self to highlight some parallels and significant differences between the ancient and modern conceptions and it establishes the reading of some parts of De Brev. Vit. in the context of other passages as concerned with the narrative self. The paper argues, amongst other points, that in Ep. 83.1–3, Seneca extends the practice of meditatio (ethically directed self-examination) by (...) incorporating the construction of a narrative self into this process, in dual roles, as examiner and examined. It concludes that Seneca expected us to avail ourselves of a similar self-assessment based on a dialogue with philosophical texts. (shrink)

Traditionally, dream research focuses on accounting for typical psychological features of dream experiences characteristic of different sleep stages in terms of the global physiological features of the sleep stages in question. However, as subtle differences got into the forefront of enquiry, as, for example, in questions concerning between-stage similarities and within-stage differences of mentations, this methodology became insufficient. What recent findings and theoretical developments suggest is that understanding mental activity during sleep requires studying the fine-grained characteristics of the phenomenal features (...) of individual dreams, which, in turn, demands identifying specific neural processes that might underlie different characteristics of the experiences, and tracking their changes not just between but also within standard sleep stages. The paper argues that such a shift of focus from describing global stages to understanding the significance of local changes results in a true paradigm shift in dream research that can break away from the tradition of thinking about sleep mentation in terms of discrete categories, and offers a novel way of looking at dreams as forming a multidimensional continuum. The issue of whether the phenomenology presented in Ideen I was a metaphysical realism or an idealism came to the fore almost immediately upon its publication. The present essay is an examination of the relation of Gustav Shpet, one of Husserl’s students from the Göttingen years, to this issue via his understanding of phenomenology and, particularly, of the phenomenological reduction, as shown principally in his early published writings. For Shpet, phenomenology employs essential intuition without regard to experiential intuition. If we (...) look on transcendental idealism as the label for this methodology, which disregards but does not deny either the empirical or its correlative species of intuition, then Shpet was such an idealist, all the while adhering to a metaphysical realism. In this way, Shpet could proclaim phenomenology to be the fundamental philosophical discipline without precluding the possibility of other philosophical disciplines insofar as they were conducted in relation to consciousness taken not as the “possession” of a human individual, but eidetically and thus not a “possession.”. Philipp Frank"s book Relativity – a richer truth1 shows something we do not find very often after World War 2: a philosopher of science acting as a public intellectual. Taking part in the Conference on Science, Philosophy and Religion, Philipp Frank intervened in the public debate about the causes of Nazism and how to defend democracy and liberalism against totalitarian ideas and politics. Could philosophy of science contribute to such a struggle? Philipp Frank thought it could, he even thought that (...) Philosophy of Science should play a crucial role in it. It"s obvious that this position should be of some interest for philosophers in Austria and Europe today. Of course, any serious analysis of Frank"s position would have to take the whole historical constellation into account. Between the beginning of the conference in 1940 and the publication of the book in 1951 the historical situation had dramatically changed. And therefore one has to distinguish several political dimensions in Frank"s arguments. Let me just make a short remark on the plurality of political perspectives Frank"s discourse opened up. Philipp Frank defined the role science should play in democracy not only in contrast to the role of science as it was conceived by totalitarian governments. Of course he criticised the Nazis" and Soviets" �philosophies of science� several times. But he also made very clear that in the 40ies and 50ies not even the majority of scholars and university teachers in the US supported the specific view of science which Frank thought was so important to the advancement of democracy. His rather critical comments on the teaching of science in the post war / cold war period show what he thought the really important political impact of science was. As far as I can see, these comments did not loose their significance. (shrink)

Otto Neurath (1882-1945) was a highly unorthodox thinker both in philosophy and economics. The contributions to this sparkling new book conclude that Neurath touched on many of the most critical problems of economic theory during its formative years as a modern discipline. His economics provide insights into the foundational problems of modern economics and should encourage contemporary economic theorists to critically reflect their own hidden presumptions.

Why concern oneself with Otto Neurath’s economic thought in its historical context? Could anything be more out of fashion than a theory proposing a centrally managed planned economy? Than the views of a theorist whose ideas on in-kind economic planning drove the notion of economic planning to its utmost extreme ? Indeed, Neurath’s ideas appeared too radical and utopian even for the social democrats of the 1920s. So why give even a second thought to them today? Would it not be (...) better to follow the advice a colleague gave me in the 1980s and to pass over Neurath’s “youthful sins” silently so as not to tarnish the reputation that – finally, after a lengthy delay – has been accredited to Neurath for his impressive philosophical achievements within the framework of logical empiricism?In the years since the 1980s, however, Neurath’s economic writings have attracted much more interest than anyone would previously have suspected. Today we are aware of the fact that Neurath formulated ideas at an unexpectedly early stage that are currently relevant in ecological economy, social choice theory and developmental economy. And that his reflections vis-à-vis “associational socialism” could provide interesting impulses for a new theory of socialism. Viewed from this perspective, Neurath’s status is secure as a precursor of theoretical developments and debates that are in full swing today. But is that enough? After all, if the role of the precursor is an endearing one, isn’t it also quite thankless? For even in the areas in which Neurath can be regarded as a precursor, the relevant questions are posed today with far greater precision and with reference to current facts – so why should anyone concern oneself with a precursor whose fundamental assumptions differ so greatly from those of the overwhelming majority of economists working today? This volume offers a critical examination of the early works of Vladimir Solov'ëv, Russia's most famous and systematic philosopher. It presents a philosophical critique of his early writings up to 1881 from an immanent viewpoint and examines Solov'ëv's intended contributions to philosophy against the background of German Idealism, including Schopenhauer, and the positivism of his day. Karaim is a severely endangered language belonging to the Turkic language family and its only surviving dialect is Northwest Karaim with speakers in Lithuania and Poland. In the past few years numerous Karaim translations of the Bible have been discovered. Some of these are among the oldest texts written in this language. The authors present some of the oldest Karaim texts known today as well as recently discovered Karaim translations of the entire Tanakh. It is shown how these recent research (...) results have broadened our knowledge regarding the Karaim written heritage. Furthermore, some preliminary conclusions are drawn on the relationships among the manuscripts and the biographies of the copyists and translators involved in their creation. Textual similarities between sources created separately in communities located far from one another in the regions of Crimea, Lithuania, Volhynia, and Galicia suggest that a common Karaim tradition of Bible translation must once have existed. Moreover, the textual complexity and the use of sophisticated translation techniques in the oldest known texts support the claim that they were based on older texts or on a well-established oral tradition of translation.
