ABSTRACTPolitical rule depends upon public discourse as it requires negotiation and compromise of conflicting interests. Public discourse includes activities that can be described as cause lawyering, lobbying, and rule entrepreneurship. The rule of law supports public discourse through, inter alia, the right to petition. The right to petition requires identification of those engaged in public discourse through petition. This requirement reflects a principle of general application. Solicitors owe an ethical duty to support the rule of law, including the right to (...) petition. Lawyers without a specific duty to uphold the rule of law have ethical duties to maintain the reputation of the legal system and their legal profession. Lawyers, including solicitors, are frequent contributors to public discourse. Lawyers sometimes resist identifying the clients or client groups they represent in public discourse on the ground of the need to protect client confidentiality. This paper takes as its starting point the phenomenon of young lawyers in ethical crisis. The teaching of ethics in the classroom and the ethos and environment of the law firm have created dissonance: knowing what it is right to do but being unable to do it. In examining this phenomenon, we develop the idea of commitment as a source of duty, loyalty, and courage that enables someone to accept and overcome reluctance to act ethically. Our conceptual framework combines two (...) models: Fineman’s radical view that vulnerability is universal, but ameliorated by the assets available to the individual, and Rest’s four component model that provides a taxonomy of precursors for ethical action and resilience. We consider how the structures and the relationships between law schools, regulators and law firms, acting in combination, support or degrade ethical resilience and development of a commitment to ethical action. We close by considering how changes to the structure planned by one regulator in England and Wales deplete the assets available to the young lawyer and thereby the profession. (shrink)

What happens when the meaning of life based on a divine revelation no longer makes sense? Does the quest for transcendence end in the pursuit of material success and self-absorption? For political and literary theorists working on race, Ralph Ellison’s Invisible Man is a canonical text. Most political theorists approach the novel through what this essay calls a “martyr reading,” though martyrdom is just one of several political strategies explored in the work. This essay highlights an alternative in Ellison’s repertoire. The “trickster reading” developed here better accounts for several key scenes in the novel and also shows the limits of martyrdom as a technique of democratic politics. While other democratic (...) theorists have identified Ellison with redemptive or deliberative aims, the novel’s references to Homer’s Odyssey, with its own trickster-hero, license a trickster reading of Invisible Man. Tricksters do not take on suffering, loss, or sacrifice in the hope of redemption nor are they necessarily committed to the virtues of deliberation. Instead, they evade sacrifice by resorting routinely to irony, cunning, and refusal. This reading demonstrates the importance of these techniques to Ellison’s vision and to our politics today. One of the many faces of Islam in Indonesia is the abangan Muslims or the abangans. As one of the most populous Muslim groups in the country, it is important to know them. To understand Indonesian Islam or Muslims, one cannot overlook them. The article argues that, amid recent escalating Muslim–Christian tension in the country, this majority Muslim group can play a significant role in enhancing Muslim–Christian relations in the future, on account of their worldview that emphasizes and maintains cosmic (...) harmony and balance of all existence. Their open and syncretic attitudes toward other religions may foster religious tolerance and coexistence. These are attested in the author’s personal engagement with them. It is suggested that Christians be more inclusive toward them, but, at the same time, be critical in engaging their worldview. These attitudes are necessary for building a mutual and peaceful Muslim–Christian relationship in the region. (shrink)

Indonesia is recognized as a nurse exporting country, with policies that encourage nursing professionals to emigrate abroad. This includes the country’s adoption of international principles attempting to protect Indonesian nurses that emigrate as well as the country’s own participation in a bilateral trade and investment agreement, known as the Indonesia–Japan Economic Partnership Agreement that facilitates Indonesian nurse migration to Japan. Despite the potential trade and employment benefits from sending nurses abroad under the Indonesia–Japan Economic Partnership Agreement, Indonesia itself is suffering (...) from a crisis in nursing capacity and ensuring adequate healthcare access for its own populations. This represents a distinct challenge for Indonesia in appropriately balancing domestic health workforce needs, employment, and training opportunities for Indonesian nurses, and the need to acknowledge the rights of nurses to freely migrate abroad. Hence, this article reviews the complex operational and ethical issues associated with Indonesian health worker migration under the Indonesia–Japan Economic Partnership Agreement. It also introduces a policy proposal to improve performance of the Indonesia–Japan Economic Partnership Agreement and better align it with international principles focused on equitable health worker migration. Most phobias are focussed on a small number of fear-inducing stimuli (e.g., snakes, spiders). A review of the evidence supporting biological and cognitive explanations of this uneven distribution of phobias suggests that the readiness with which such stimuli become associated with aversive outcomes arises from biases in the processing of information about threatening stimuli rather than from phylogenetically based associative predispositions or “biological preparedness.” This cognitive bias, consisting of a heightened expectation of aversive outcomes following fear-relevant stimuli, generates and maintains (...) robust learned associations between them. Some of the features of such stimuli which determine this expectancy bias are estimates of how dangerous they are, the semiotic similarity between them and their aversive outcomes, and the degree of prior fear they elicit. Ontogenetic and cultural factors influence these features of fear-relevant stimuli and are hence important in determining expectancy bias. The available evidence does not exclude the possibility that both expectancy biases and specific evolved predispositions coexist, but the former can explain a number of important findings that the latter cannot. The Toronto experience suggests that there may be several general lessons for academic health sciences complexes to learn from the Olivieri/Apotex affair regarding the ethics, independence, and integrity of clinical research sponsored by for profit enterprises. From a local perspective, the OAA occurred when there already was a focus on the complex and changing relationships among the University of Toronto, its medical school, the fully affiliated teaching hospitals, and off campus faculty because of intertwined interests and responsibilities. The OAA became (...) a catalyst that accelerated various systemic reforms, particularly concerning academic/industry relations. In this article, the evolving governance framework for the Toronto academic health sciences complex is reviewed and these policy and process reforms discussed. These reforms have created collaborative activity among research ethics boards and contract research offices of the partner institutions, and allowed the joint university/hospital ethics centre to play a role in governance and policy, while respecting the missions and mandates of the involved institutions. Although few of the policies are dramatically innovative, what is arguably novel is the elaboration of an overarching governance framework that aims to move ethics to a central focus in the academic complex. Time alone will tell how sustainable and effective these changes are. (shrink)

First published in 1962. Kant’s philosophical works, and especially the _Critique of Pure Reason_, have had some influence on recent British philosophy. But the complexities of Kant’s arguments, and the unfamiliarity of his vocabulary, inhibit understanding of his point of view. In _Kant’s Theory of Knowledge _an attempt is made to relate Kant’s arguments in the _Critique of Pure Reason _to contemporary issues by expressing them in a more modern idiom. The selection of issues discussed is intended to present a (...) continuous argument, of an epistemological kind, which runs centrally through the _Critique_. The argument deals with essentially with the problems, raised in the Transcendental Analytic, about the status of categories. It deals with certain preliminary assumptions made in setting these problems, and discusses the way in which the various sections of the Analytic contribute to their solution. It also deals with Kant’s criticisms of traditional metaphysics, and ends with an account of his effort in the Third Antinomy to resolve the conflict between freedom and causality, and so to effect a transition of knowledge to moral philosophy. I argue that the Hume of the Treatise maintains an account of knowledge according to which (i) every instance of knowledge must be an immediately present perception (i.e., an impression or an idea); (ii) an object of this perception must be a token of a knowable relation; (iii) this token knowable relation must have parts of the instance of knowledge as relata (i.e., the same perception that has it as an object); and any perception that satisfies (i)-(iii) is an instance (...) of knowledge. I then apply this account to the case of sense perception. I argue that Hume holds that relations of impressions can be intuited, are knowable, and are necessary. For Hume, these relations constitute sensory knowledge. While Hume is rightly labeled an empiricist for many reasons, a close inspection of his account of knowledge reveals yet another way in which he deserves the label. (shrink)

In this paper, I will argue that Locke is a substance dualist in the general sense, in that he holds that there are, independent of our classificatory schema, two distinct kinds of substances: wholly material ones and wholly immaterial ones. On Locke’s view, the difference between the two lies in whether they are solid or not, thereby differentiating him from Descartes. My way of establishing Locke as a general substance dualist is to be as minimally committal as possible at the (...) outset, especially with respect to the classic debates on Locke’s positions in this domain, including those concerning substrata, real essences, and the like. Nonetheless, I show that minimal commitments about Locke’s primary/secondary quality distinction are sufficient to derive some substantive conclusions about his positions on these issues, as well as that he is a general substance dualist. This book provides a sustained and penetrating critique of a wide range of views in modern cognitive science and philosophy of the mind, from Turing's famous test for intelligence in machines to recent work in computational linguistic theory. While discussing many of the key arguments and topics, the authors also develop a distinctive analytic approach. Drawing on the methods of conceptual analysis first elaborated by Wittgenstein and Ryle, the authors seek to show that these methods still have a great deal (...) to offer in the field of the cognitive theory and the philosophy of mind, providing a powerful alternative to many of the positions put forward in the contemporary literature. In contrast to many aspects of the social responsibility of business, CSR scholarship has been largely silent on the issue of the payment of corporate tax. This is curious because such tax payments are often considered a fundamental and easily measured example of a company’s citizenship behavior. However, because the payment of corporate tax can often be legally avoided, this activity represents a boundary condition for CSR. If the law and CSR suggest that a company should pay its fair share (...) of tax, yet many successful companies actively avoid this social obligation, should they be considered socially irresponsible. This paper explores the issue of tax avoidance and the implications it has for any credible definition and measure of CSR. It also highlights an aspect of corporate practice that is deliberately hidden from public view. (shrink)

Hylomorphism is the Aristotelian theory according to which substances are composites of matter and form. If my house is a substance, then its matter would be a collection of bricks and timbers and its form something like a structure that unites those bricks and timbers into a single substance. Contemporary hylomorphists are divided on how to understand forms best, but a prominent group of theorists argue that forms are emergent powers. According to such views, when material components are arranged appropriately, (...) a novel substance emerges with the power to impose unity on its components through time. I argue that these accounts of form fall prey to a bootstrapping problem, and so, suffer from issues of redundancy, given plausible assumptions about inherence. In their place, I suggest an ontologically minimalist conception of forms as collective manifestations of the powers of matter. (shrink)
