The concept of constituent power plays a major part in modern political and legal theory- in how we think about the political. This book tackles the twofold issue of public authority and public autonomy in the modern conception of the political by analysing the notion of constituent power, its function in the modern political apparatus, and debates about its meaning and function in our own context. Focusing on contemporary debates on constitutionalism "beyond" the state, Geneviève Nootens assesses the prospects for (...) recasting the notion of constituent power in a polycentric setting that challenges state sovereignty as embodying the autonomy of the political. In doing so, she argues that constituent power belongs with the conceptual apparatus of a theory of government peculiar to a statist way of knowing, and being into, the world, and that it is too much dependent upon the statist framework for it to have critical purchase on new mappings of public authority. Nootens stresses the critical need to frame public authority appropriately if we are to conceptualize a conception of collective political agency that can sustain public autonomy in the current era. A renewed approach to democratic ethics is needed, one that takes into consideration the management of complexity and memory in a global world. The expansion of democratic ethics for the stewardship of a postnational, postmetaphysical, and postsecular world is the object of this book. It takes as its point of departure current proposals for global democratic justice, but extends these by incorporating contemporary European ideas on border and existential ethics. The privilege of democratic citizenship includes our conscious involvement with our (...) historical destinies, and with others whom we inevitably encounter on our journey of contemporary politics. A post-heroic approach to democratic ethics, one which takes violence and injustice seriously, yet understands the constraints posed on us as historical beings, is necessary. The practices of civility, such as they arise from a normative democratic universe and the ever-increasing role of civil society, can be harnessed for a transborder ethics. The examination of a contemporary democratic anthropology that includes a phenomenology of violence further clarifies the importance of intersubjective processes of encounter, dialogue, and recognition. Le Comité consultatif de Bioéthique de Belgique fête ses 15 ans et établit le bilan de ses activités: ses avis ont-ils aidé les parlementaires et ministres à se former une opinion sur des sujets délicats? Ont-ils proposé des réponses aux questions auxquelles sont confrontées les comités d'éthique médicale des hôpitaux? Comment y ont évolué certaines valeurs traditionnellement fondatrices de notre société? À l'avenir, quels sont les enjeux éthiques que le grand public souhaiterait voir traités par le Comité?

La préface des Principes oppose les quatre premiers degrés d'une sagesse empirique, fondée sur les notions communes, l'expérience sensible et la fréquentation d'autrui dans la conversation ou la lecture (IX, B, 5), à la morale la plus achevée qu'il situe ainsi au sommet du système : " Toute la philosophie est comme un arbre, dont les racines sont la métaphysique, le tronc est la physique et les branches qui sortent de ce tronc sont toutes les autres sciences, qui se réduisent (...) à trois principales, à savoir la médecine, la mécanique et la morale ; j'entends la plus haute et la plus parfaite morale, qui présupposant une entière connaissance des autres sciences, est le dernier degré de la sagesse. Peu de philosophies ont suscité autant d’interprétations que celle de Descartes : celui-ci répond-il fondamentalement à une orientation scientifique ou à une orientation métaphysique? Est-il le père de l’idéalisme moderne, le promoteur d’un nouveau rationalisme ou le philosophe de l’expérience intérieure, soucieux de justifier la croyance réaliste au monde extérieur? Pourtant, Descartes decouvre avec Beeckman la physico-mathematique, qui applique une methode mathematique a toute la nature. Optique, dioptrique et meteores occupent ses annees parisiennes. Aux Pays-Bas, il consacre neuf mois au commencement de la metaphysique, mais l'abandonne quand il apprend l'existence de faux soleils. Leur explication lui fait elargir la science a l'ensemble du Monde a partir de la lumiere. Il fera connaitre sa (...) methode dans le Discours, avec un resume de sa metaphysique. Comment Descartes avait-il ete incite a demontrer que l'existence de Dieu est plus certaine que les mathematiques? Quels furent les themes nouveaux des Meditations? Alors, l'arbre de la philosophie va deployer ses branches, jusqu'a ce dernier fruit, la generosite. Seule la mort interrompt La Recherche de la Verite, son principal bien en cette vie. (shrink)

Relatively compact biography of the seventeenth-century French philosopher is determined to reverse the slander of scandal in vogue among Descartes' recent biographers and to modify the view of his intellectual development.

Research regarding the drivers of acceptance of clinical decision support systems by physicians is still rather limited. The literature that does exist, however, tends to focus on problems regarding the user-friendliness of CDSS. We have performed a thematic analysis of 24 interviews with physicians concerning specific clinical case vignettes, in order to explore their underlying opinions and attitudes regarding the introduction of CDSS in clinical practice, to allow a more in-depth analysis of factors underlying acceptance of CDSS. We identified three (...) general themes from the results. First, ‘the perceived role of the AI’, including items referring to the tasks that may properly be assigned to the CDSS according to the respondents. Second, ‘the perceived role of the physician’, referring to the aspects of clinical practice that were seen as being fundamentally ‘human’ or non-automatable. Third, ‘concerns regarding AI’, including items referring to more general issues that were raised by the respondents regarding the introduction of CDSS in general and/or in clinical medicine in particular. Apart from the overall concerns expressed by the respondents regarding user-friendliness, we will explain how our results indicate that our respondents were primarily occupied by distinguishing between parts of their job that should be automated and aspects that should be kept in human hands. We refer to this distinction as ‘the division of clinical labor.’ This division is not based on knowledge regarding AI or medicine, but rather on which parts of a physician’s job were seen by the respondents as being central to who they are as physicians and as human beings. Often the respondents’ view that certain core parts of their job ought to be shielded from automation was closely linked to claims concerning the uniqueness of medicine as a domain. Finally, although almost all respondents claimed that they highly value their final responsibility, a closer investigation of this concept suggests that their view of ‘final responsibility’ was not that demanding after all. This book describes the repertoire and uses of referring expressions by French-speaking children and their interlocutors in naturally occurring dialogues at home and at school, in a wide-range of communicative situations and activities. Through the lens of an interactionist and dialogical perspective, it highlights the interaction between the formal aspects of the acquisition of grammatical morphemes, the discourse-pragmatic dimension, and socio-discursive, interactional and dialogical factors. Drawing on this multidimensional theoretical and methodological framework, the first part of the book deals with (...) the relation between reference and grammar, while the second part is devoted to the role of the communicative experience. Progressively, a set of arguments is brought out in favor of a dialogical and interactionist account of children's referential development. This theoretical stance is further discussed in relation to other approaches of reference acquisition. Thus, this volume provides researchers and students with new perspectives and methods for the study of referring expressions in children. (shrink)

La diminution du poids institutionnel des religions dans notre société ne signifie pas pour autant que les hommes se détournent d'interrogations fondamentales touchant à leur identité profonde, à leur origine et à leur destination, au sens de leur vie ici-bas, à l'éventualité d'une vie après la mort. Que ces questions continuent d'occuper la pensée humaine, chacun est à même d'en faire le constat, et la science elle-même les a investies avec des moyens renouvelés. Ce qui a changé dans les dernières (...) décennies, c'est peut-être la manière d'appréhender ces interrogations fondamentales : on recueillait autrefois les réponses en se référant à sa religion d'appartenance ou en puisant dans un ensemble de discours et de pratiques proprement ésotériques ; aujourd'hui, la recherche de principes directeurs qui soient à même de donner un sens à l'existence n'échappe pas au mouvement général de sécularisation et de globalisation qui a radicalement transformé nos cultures. Anticipant cette tendance, Ostad Elahi s'était interrogé, il y a plus de cinquante ans, sur les conditions d'une sagesse contemporaine partagée, capable d'intégrer la dimension spirituelle, et fondée sur les principes fondamentaux communs aux différentes religions. Sous le titre Quelle sagesse pour notre temps?, cet ouvrage entend ouvrir une réflexion sur les modalités que peut prendre la recherche d'une telle sagesse adaptée à notre époque, à la fois conforme à l'idéal d'autonomie de l'individu moderne et ouverte à ses aspirations les plus profondes. Quels en seraient les principes? Parviendra-t-on à les dégager en s'accordant sur des valeurs éthiques et spirituelles universelles? Et si oui, comment est-il possible de les mettre en oeuvre? This article reports on Flemish college students’ news orientations and their uses of traditional and new media for news within a public service media environment. We used five homogeneous focus groups that covered variation in news media use. The analysis of the focus groups revealed major differences in news behaviors and attitudes between participants who mainly depended on traditional media for news, and those who also went online for news. While a growing body of research reports on young people’s increasing (...) use of online media for news, particularly among those that are most disengaged with traditional news media, our findings indicated that only the most eager news-users were motivated to gather information online. Additionally, we found that traditional media, in particular national quality papers and the Flemish public service newscast, were still the main reference points for public affairs information among our participants. In light of the growing use of tablets for news reading and mobile news consumption behaviors, this study examined whether an innovative way of structuring news on the tablet that mimics mobile news behaviors reinforced attention for, and learning from, news. Specifically, it was theorized that the chronological and associative structuring of news articles into so-called developing news stories would lead to more attention for news, and better recall and comprehension of news, than the linear print newspaper structure that newspaper (...) publishers continue to copy from print to tablet. A multiple-day experiment was set up using the eye-tracking method to measure and control for attention. The results show that the developing news structure increased comprehension of news substantively, independently of attention effects; no effects were found on attention and factual recall. (shrink)

La defense d'un profond humanisme dont les racines puisent dans la Renaissance ainsi que le souci permanent d'une pedagogie exemplaire ont guide Genevieve Giudicelli-Delage durant toute sa carriere. Professeur emerite de l'Universite Paris 1 Pantheon-Sorbonne, ou elle a notamment dirige pendant de nombreuses annees le DEA devenu Master II de droit penal et politique criminelle en Europe, redactrice en chef de la Revue de science criminelle et de droit penal compare pour les editions Dalloz, presidente de l'Association de recherches penales (...) europeennes (ARPE), directrice de l'Ecole du Centre Ouest des avocats a Poitiers, Genevieve Giudicelli-Delage n'a cesse d'oeuvrer pour un depassement des frontieres disciplinaires et geographiques dans l'approche du phenomene criminel, ce dont temoignent en particulier son engagement en faveur du developpement du droit compare et son attachement a repousser les lignes d'horizons juridiques. Son regard sur le droit penal a profondement marque des generations d'etudiants et de doctorants. Par ses recherches individuelles, comme par les recherches collectives qu'elle mene admirablement, elle a egalement contribue au rayonnement doctrinal du droit penal en general, et de certaines de ses disciplines telles que le droit penal des affaires, le droit international penal, le droit penal europeen ou la procedure penale. C'est donc au chercheur comme au pedagogue que nous avons souhaite rendre hommage par ces Melanges regroupant une soixantaine d'auteurs, anciens eleves/collegues/amis, universitaires et/ou praticiens reunis autour du theme Humanisme et justice, que le Professeur Giudicelli-Delage a, par un soin constant, nourri et questionne durant toutes ses annees d'exercice. In deze tijd van secularisering is het begrijpelijk dat men de filosofie van de religie vaak wil beperken tot een kritiek van de religie en tot de kritische bespreking van de bekende godsbewijzen. 0Dit handboek kiest voor een andere aanpak. De filosofie van de religie is geen monolithische discipline. Filosofie van de religie is soms een binnen-religieuze aangelegenheid waarin de filosofie wordt ingezet als een hulpwetenschap voor de theologie, soms gaat het om een zuiver rationele aangelegenheid, soms domineert een naturalistische (...) blik en soms poogt men vooral de betekenis van het religieuze te verhelderen. Al deze modellen van filosofie van de religie komen hieraan bod en worden in hun historische ontwikkeling besproken. Daarom vertrekt dit handboek niet van de 'gedachte God' van metafysici en wetenschappers ('des philosophes et des savants', Pascal), maar veeleer van de geleefde religie ('la religion vécue', 'lived religion') om na te gaan hoe het religieuze in de praktijk functioneert en wat de betekenis ervan is: "Wat betekent het religieus te zijn?" is een belangrijker vraag dan "Is religie waar?".
