This paper analyzes the ergodic hypothesis in the context of Boltzmann’s late work in statistical mechanics, where Boltzmann lays the foundations for what is today known as the typicality account. I argue that, based on the concepts of stationarity (of the measure) and typicality (of the equilibrium state), the ergodic hypothesis, as an idealization, is a consequence rather than an assumption of Boltzmann’s account. More precisely, it can be shown that every system with a stationary measure and an equilibrium state (...) (be it a typical state with respect to the phase space or the time average) behaves essentially as if it were ergodic. I claim that Boltzmann was aware of this fact as it grounds both his notion of equilibrium, relating it to the thermodynamic notion of equilibrium, and his estimate of the fluctuation rates. Policy‐makers, bioethicists, and patient advocates have been engaged in a fierce battle about the merits and potential harms of a federal right‐to‐try law. This debate about access to investigational medical products has raised profound questions about the limits of patient autonomy, appropriate government regulation, medical paternalism, and political rhetoric. For example, do patients have a right to access investigational therapies, as the right‐to‐try movement asserts? What is government’s proper role in regulating and facilitating access to drugs that are still in (...) development? In this review, we analyze the history of the right‐to‐try movement, review the arguments put forth by supporters and opponents of the legislation, and consider the movement’s consequences. Two possible scenarios may emerge. One is that the right‐to‐try pathway may fail to meaningfully increase patient access to investigational products. Alternatively, certain companies may attempt to rely on the federal right‐to‐try legislation to sell investigational products, taking advantage of the provision that allows for direct costs, as there is currently no clear mechanism for enforcement or monitoring of cost calculations. ABSTRACT In this survey we have investigated the experiences and attitudes of Danish physicians regarding end‐of life decisions. Most respondents have made decisions that involve hastening the death of a patient, and almost all find it acceptable to do so. Such decisions are made more often, and considered ethically more acceptable, with the informed consent of the patient than without. But both non‐resuscitation decisions, and decisions to provide pain relief in doses that will shorten the patient's life, have been made (...) and found acceptable by at least 50% of the respondents, even when there is no informed consent. Furthermore, 12% have doubled morphine dosages with fixed intervals, thus providing doses substantially higher than that necessary to control pain, without the informed consent of the patient. Two per cent have helped in assisted suicide, and 5% have administered a lethal injection at the patient's request. Respectively 37% and 34% find these last two practices ethically acceptable. Amongst those that do not find them acceptable, the most important reasons to be opposed are, the doctrine of double effect, the doctrine of doing and allowing, and the view that human life is sacred. Amongst supporters, the most important reasons mentioned are, that the patient's right to self‐determination should be respected, the view that a patient should not be forced to suffer, and the view that the patient has a right to be helped to a dignified death. This article elucidates the spatial order that underpins the politics of the Anthropocene – the ecological nomos of the earth – and criticizes its imperial origins and legacies. It provides a critical reading of Carl Schmitt’s spatial thought to not only illuminate the spatio-political ontology but also the violence and usurpations that characterize the Anthropocene condition. The article first shows how with the emergence of the ecological nomos seemingly ‘natural’ spaces like the biosphere and the atmosphere became politically charged. This (...) challenges the modernist separation between natural facts and political norms. It then underlines the imperial origins of this nomos by introducing the concept of air-appropriation understood as the colonization of atmospheric space by CO2 emissions. Instead of assuming that the ecological nomos represents a transition from a colonial to an ecological and cosmopolitan world order, focusing on air-appropriation highlights forms of ecological imperialism that go along with the new nomos. Accordingly, the article calls for a just redistribution of ecospace that takes into account the imperial legacies and ongoing effects of air-appropriation. (shrink)

The fifth chapter of _Experience Embodied_ is devoted to Herder’s theory of cognition and the epistemic merits of the capacity for ‘sympathy’, or ‘empathy’ – what Herder calls _Einfühlung_, and which Waldow renders more accurately as ‘affective immersion’. I situate Waldow’s reading of Herder as a member of the epistemological tradition within the debate on Herder’s relationship to the Enlightenment. Waldow’s reading, I contend, is congruent with the view of Herder as an Enlightenment, rather than anti-Enlightenment, figure. I focus on (...) what Waldow calls ‘the problem of the conceivability of difference’ (Waldow 2020, 185) and how she charts Herder’s proposed method of Einfühlung and the need for ‘affective immersion’ to address this problem. However, I also identify three potential problems, which Waldow does not address, that can arise when _Einfühlung_is taken too far: the first is that it may lead to relativism, and thus to incoherence; the second is reductionism, which can eliminate, rather than draw attention to, difference – thereby achieving the opposite goal; while the third is that relying solely on _Einfühlung_as a method can lead us into error, as it is speculative and lacks an external truth criterion. This paper draws attention to Foucault’s genealogy of critique. In a series of inquiries, Foucault traced the origins and trajectories of critical practices from the ancient tradition of parrhesia to the enlightenment and the (neo)liberal critique of the state. The paper will elucidate the insights of this history and argue that Foucault’s turn to the genealogy of critique also changed the valence of his theoretical assumptions. Foucault developed a more affirmative practice of genealogy that not only discredits truth claims by (...) tracing them back to their inglorious origins. Rather, he presents a politics of truth as a complex interaction of (governmental) power-knowledge and critique that questions the power effects of truth and rationality. This genealogy of critique contributes to current problematizations of critique by thinkers like Boltanski, Latour and Rancière in highlighting the role of epistemological and technical critique of social rationalization and political reason. If we are capable of changing our minds—of rejecting, that is, one hypothesis for another—the issue becomes one of the criteria which govern our choices. Are they, as [Stanley] Fish would argue, dependent on "beliefs" and "assumptions"? Perhaps, at some very fundamental level, they are. But I do not think Fish has succeeded in showing them to be so. Certainly the criteria are independent of anything so specific as beliefs about the nature of literature or the human mind. Who among (...) us, for example, whatever the object of interpretation, would choose one on the grounds of its greater inconsistency, or on the grounds of its accounting for fewer of the facts that we want to explain, or on the grounds of its being unnecessarily complicated? On the contrary, do we not tend to argue, as Fish does so effectively, as if counterexamples and inconsistencies tell against an hypothesis? It may be the case that our cherished beliefs often make it difficult in practice even to formulate our questions in ways that allow such criteria as I have hinted at to come into play. Narratives surrounding ionizing radiation have often minimized radioactivity’s impact on the health of human and non-human animals and the natural environment. Many Cold War research policies, practices, and interpretations drove nuclear technology forward by institutionally obscuring empirical evidence of radiation’s disproportionate and low-dose harm—a legacy we still confront. Women, children, and pregnancy development are particularly sensitive to exposure from radioactivity, suffering more damage per dose than adult males, even down to small doses, making low doses a cornerstone of concern. Evidence (...) of compounding generational damage could indicate increased sensitivity through heritable impact. This essay examines the existing empirical evidence demonstrating these sensitivities, and how research institutions and regulatory authorities have devalued them, willingly sacrificing health in the service of maintaining and expanding nuclear technology. Radiation’s disproportionate impacts should now be the research and policy focus, as society is poised to make crucial and long-lasting decisions regarding climate change mitigation and future energy sources. We discuss Boltzmann’s probabilistic explanation of the second law of thermodynamics providing a comprehensive presentation of what is called today the typicality account. Countering its misconception as an alternative explanation, we examine the relation between Boltzmann’s H-theorem and the general typicality argument demonstrating the conceptual continuity between the two. We then discuss the philosophical dimensions of the concept of typicality and its relevance for scientific reasoning in general, in particular for understanding the reduction of macroscopic laws to microscopic laws. Why are some autocrats able to personalize power within their regimes while others are not? Past studies have focused on the balance of power between the autocrat and his or her supporting coalition of peer or subordinate elites, but we find that often the crucial relationship is between the autocrat and the “old guard”—retired leaders, party elders, and other elites of the outgoing generation. Using an original data set of authoritarian leadership transitions, we argue that when members of the old (...) guard retain oversight capacity over their incoming successor, he or she is less likely to overturn power-sharing arrangements and consolidate individual power. We illustrate this argument with a case study of three leadership transitions in China between 1989 and 2012. This study’s findings advance our understanding of elite politics and intergenerational conflict in authoritarian regimes. (shrink)

This article deals with scientific advice to the public where the relevant science is subject to public attention and uncertainty of knowledge. It focuses on a tension in the management and presentation of scientific uncertainty between the uncertain nature of science and the expectation that scientific advisers will provide clear public guidance. In the first part of the paper the tension is illustrated by the presentation of results from a recent interview study with nutrition scientists in Denmark. According to the (...) study, nutrition scientists feel their roles as ‘‘public advisers’’ and ‘‘scientists’’ differ in that the former involves an expectation that they will provide unambiguous advice of the kind that might relegate scientific uncertainty to the background. In the second, more general, part of the paper we provide a normative analysis of different strategies of dealing with the tension. The analysis is structured around the extremes of either total concealment or full openness regarding scientific uncertainty. The result of analysis is that scientific advisers should not simply ‘‘feed’’ scientific conclusions to the public. They should rather attempt to promote the ability and willingness of the public to assess and scrutinize scientific knowledge by displaying uncertainties in the scientific basis of advice. On the other hand, scientific advisers must accommodate the public’s need for guidance. Such guidance should be restricted by careful consideration of what it is relevant for the public to know in order to evaluate scientific advice in practical terms. (shrink)

Advance directives (ADs) have for some time been championed by ethicists and patient associations alike as a tool that people newly diagnosed with dementia, or prior to onset, may use to ensure that their future care and treatment are organized in accordance with their interests. The idea is that autonomous people, not yet neurologically affected by dementia, can design directives for their future care that caregivers are morally obligated to respect because they have been designed by autonomous individuals. In this (...) paper, we first criticize the idea that ADs can retain moral authority in severe dementia by arguing that it is paradoxical. Second, we consider two arguments that initially seem to refute this critique of ADs, but we eventually dismiss them. The first argument states that ADs retain moral authority in severe dementia because autonomously formed interests, for example, ADs, can only be appropriately discarded by autonomous persons. This we term the historical autonomy argument. We dismiss it by demonstrating how we, in analog cases, are not obligated to continue to respect autonomously formed interests even though they have been discarded under nonappropriate conditions. The second argument is that ADs can be justified by what we term external interests. While we agree that people with severe dementia plausible can be said to have external interests, we show that ADs cannot express such interests and hence cannot be justified by them. We conclude that none of the discussed arguments support the use of ADs and because of this, the idea of ADs should be reassigned. (shrink)

Formal control systems are a common instrument to align employees’ interests with those of managers and companies. However, research shows that employees perceive formal controls as a sign of distrust and restraint, which can lead to costs of control in the form of lower employee cooperation and effort. We propose that charitable giving reduces these costs of control. We draw on the halo effect and propose that corporate charitable giving alters employees’ perception of and reaction to formal controls. In a (...) laboratory experiment, we find that charitable giving by a company creates a higher level of employee trust in a manager who decides to implement a control and a more positive assessment of formal control. These positive effects of charitable giving lead to lower costs of control compared to the absence of charitable giving. We thereby provide an example of how charitable giving as a corporate social responsibility activity yields positive benefits by altering the behavior of internal company stakeholders. (shrink)

In _I Can Learn from You_, Michael Reichert and Richard Hawley—the authors of _Reaching Boys, Teaching Boys_—set out to probe deeply into the relational dynamics that help boys succeed as learners. Drawing on interviews with students and teachers in thirty-five schools across six countries, they examine the particular ways boys extend and receive empathy—modes of interaction that remain consistent across a wide range of schools, teachers, countries, and cultures. The book shows how teachers can help boys form productive learning (...) relationships and how schools can support the development of teachers’ relational capacities. It is difficult to translate the title “Wissen und Glauben” (Knowledge and Faith, see Romans 11:33 and I Corinthians 13:13) into English, because there ist a debate between Kant, Jacobi, Fichte and Hegel behind it. But faith can only achieve its richness and its public effectiveness together with knowledge, the πλήρωμα of faith needs knowledge. Knowledge on the other hand can neither take its depth nor reach its totality without faith. Knowledge that wants to enlighten itself must rely on faith. Faith shows knowledge that it is neither fully founded on man nor can it be fully considered as an image of the universe. On the one hand faith is criticism of self-empowered knowledge, on the other hand it is the way to surpass knowledge and to complete it. (shrink)

Although microfinance organizations are generally considered as inherently ethical, recent events have challenged the legitimacy of the sector. High interest rates and the excessive profitability of some market leaders have raised the question of how to define a fair profit level for social enterprise. In this article, we construct a fair profit framework based on four dimensions: profitability, social mission, pricing, and surplus distribution. We then apply this framework using an empirical sample of 496 microfinance institutions. Results indicate that satisfying (...) all four criteria is a difficult, although not impossible, task. According to our framework, 24 MFIs emerge as true double bottom line organizations. These MFIs are characterized by higher outreach to women, lower portfolio risk, and higher productivity in high-density environments such as South Asia. We argue that excessive profits can be better understood relative to pricing, the outreach of the MFI, and organizational commitment to clients in the form of reduced interest rates. (shrink)

Abstract.Mandatory risk assessment is intended to reassure concerned citizens and introduce reason into the heated European controversies on genetically modified crops and food. The authors, examining a case of risk assessment of genetically modified oilseed rape, claim that the new European legislation on risk assessment does nothing of the sort and is not likely to present an escape from the international deadlock on the use of genetic modification in agriculture and food production. The new legislation is likely to stimulate the (...) kind of emotive reactions it was intended to prevent. In risk assessment exercises, scientific uncertainty is turned into risk, expressed in facts and figures. Paradoxically, this conveys an impression of certainty, while value-disagreement and conflicts of interest remain hidden below the surface of factuality. Public dialogue and negotiation along these lines are rendered impossible. The only option left to critics is to resort to claims of fear and to call for new risk assessments to be performed, on and on again. Science is allowing itself to be abused by accepting the burden of proof in matters more suited to reflection and negotiation. The specific challenge to science would be to take care of itself – rethinking the role and the limitations of science in a social context, and, thereby gaining the strength to fulfill this role and to enter into dialogue with the rest of society. Scientific communities appear to be obvious candidates for prompting reflection and dialogue on this issue. (shrink)

The parents of Charlie Gard, who was born August 4, 2016, with an exceedingly rare and incurable disease called mitochondrial DNA depletion syndrome, fought a prolonged and heated legal battle to allow him access to experimental treatment that they hoped would prolong his life and to prevent his doctors from withdrawing life-sustaining care. Charlie's clinicians at the Great Ormond Street Hospital in London believed that the brain damage Charlie had suffered as a result of frequent epileptic seizures, along with many (...) other severe disabilities, would render any innovative therapy futile, and they disagreed with his parents’ wishes to use an experimental therapy. They felt it in Charlie's best interest that he be allowed to die. A battle ensued among Charlie's parents, his doctors, and a guardian who had been appointed to represent him that drew the attention of politicians and prominent persons from all over the world. The case was much in the news over the past year, but it has also been frequently misunderstood. (shrink)

Despite the rapid adoption of technology in human resource departments, there is little empirical work that examines the potential challenges of algorithmic decision-making in the recruitment process. In this paper, we take the perspective of job applicants and examine how they perceive the use of algorithms in selection and recruitment. Across four studies on Amazon Mechanical Turk, we show that people in the role of a job applicant perceive algorithm-driven recruitment processes as less fair compared to human only or algorithm-assisted (...) human processes. This effect persists regardless of whether the outcome is favorable to the applicant or not. A potential mechanism underlying algorithm resistance is the belief that algorithms will not be able to recognize their uniqueness as a candidate. Although the use of algorithms has several benefits for organizations such as improved efficiency and bias reduction, our results highlight a potential cost of using them to screen potential employees during recruitment. The paper discusses recent proposals by Carroll and Chen, as well as Barbour, Koslowski, and Mercati to explain the arrow of time without a Past Hypothesis, i.e. the assumption of a special initial state of the universe. After discussing the role of the Past Hypothesis and the controversy about its status, we explain why Carroll's model - which establishes an arrow of time as typical - can ground sensible predictions and retrodictions without assuming something akin to a Past Hypothesis. We (...) then propose a definition of a Boltzmann entropy for a classical N-particle system with gravity, suggesting that a Newtonian gravitating universe might provide a relevant example of Carroll's entropy model. This invites comparison with the work of Barbour, Koslowski, and Mercati that identifies typical arrows of time in a relational formulation of classical gravity on shape space. We clarify the difference between this gravitational arrow in terms of shape complexity and the entropic arrow in absolute spacetime, and work out the key advantages of the relationalist theory. We end by pointing out why the entropy concept relies on absolute scales and is thus not relational. (shrink)

AbstractBohmian mechanics grounds the predictions of quantum mechanics in precise dynamical laws for a primitive ontology of point particles. In an appraisal of the de-Broglie–Bohm theory, the paper discusses the crucial epistemological and conceptual role that a primitive ontology plays within a physical theory. It argues that quantum theories without primitive ontology fail to make contact with observable reality in a clear and consistent manner. Finally, it discusses Einstein’s epistemological model and why it supports the primitive ontology approach.

When Professor Georges Gurvitch, the highly esteemed occupant of the chair of philosophy at the University of Strausbourg before World War ll and the author of a series of brilliant studies in the pluralist philosophy of law, referred to Pierre—Joseph Proudhon as the central figure in the development of modern social and judicial philosophy, the basis of his highly flattering judgment was the philosophy of law that serves as the basis of Proudhon’s mutualism, a socio-legal conceptualization that had not only (...) greatly infiuenced Gurvitch’s own thinking but which had exerted tremendous infiuence as well over the thought of such outstanding social theorists as Herzen, Tolstoi, and Kropotkinl To state, therefore, that Proudhon was not only the first to call himself an anarchist but also “the most important" anarchist thinker of the modern period} is to establish his right to be heard. We are not entitled to skip lightly over his conception of law and justice as past generations have done. After outlining Proudhon’s legal theory and his conception of natural right, this paper will attempt to demonstrate that Proudhon’s thinking on law is an outstanding contribution to modern political theory. It is not too much to say, in fact, that his philosophy of law and natural right stands as a highly suggestive antidote to the hopeless confusion in contemporary political theory, a confusion that stems not only from the cloudy conception of justice posited by the social contract theorists but from the defective conception of justice advanced by the advocates of state socialism as well. The history of the human face is the history of its social coding and the media- conditions of its appearance. The best way to explain the »selfie«-practices of today’s digital culture is to understand such practices as both participative and commercialized cultural techniques that allow their users to fashion their selves in ways they consider relevant for their identities as individuals. Whereas they may put their image of themselves front stage with their selfies, such images for being socially shared have (...) to match determinate role-expectations, body-norms and ideals of beauty. Against this backdrop, collectively shared repertoires of images of normalized subjectivity have developed and leave their mark on the culture of digital communication. In the critical and reflexive discourses that surround the exigencies of auto-medial self-thematization we find reactions that are critical of self-representation as such, and we find strategies of de-subjectification with reflexive awareness of their media conditions. Both strands of critical reactions however remain ambivalent as reactions of protest. The final part of the present article focuses on inter-discourses, in particular discourses that construe the phenomenon of selfies thoroughly as an expression of juvenile narcissism. The author shows how this commonly accepted reading which has precedents in the history of pictorial art reproduces resentment against women and tends to stylize adolescent persons into a homogenous »generation« lost in self-love.
