O presente artigo pretende esclarecer a problemática da epistemologia como fundamento para a compreensão filosófica das ciências. Para isso, contamos com a visão do filósofo francês Gaston Bachelard (1884-1962), focando principalmente no seu texto O racionalismo aplicado (publicado em 1949) e a sua teoria que busca demonstrar a complexidade presente nas linhas de pensamento construídas na história da filosofia: o empirismo e o racionalismo.

Tendo como foco o racismo na vida da “mulher de cor” que ainda nos dias de hoje, em uma pirâmide social, se encontram em desvantagem quanto aos demais indivíduos. Faz parte dos objetivos também trazer à tona a reação do oprimido como consequência natural dos séculos de silenciamento, privação e desumanização, analisando os mecanismos institucionais para pacificação social. O presente estudo investigou as relações entre qualidade de vida e presença de sintomas depressivos e ansiosos em profissionais da saúde que estão atuando com pacientes infectados pela COVID-19, em um hospital da região metropolitana de Porto Alegre. Setenta e um participantes (84,5% mulheres), com média de idade de 30 anos (± 6,7), responderam ao questionário sociodemográfico, ao Inventário de Depressão deBeck II, ao Inventário de Ansiedade de Beck e à Escala de Qualidade de Vida “WHOQOL-bref”. Dos profissionais amostrados, observou-se (...) escores significativamente maiores de depressão (64,8%) do que ansiedade (50,7%). Identificou-se que quanto maiores os escores de ansiedade e de depressão, menores os escores de qualidade de vida. Diante dos resultados, observou-se associações significativas em relação aos sintomas depressivos, aos sintomas ansiosos e à qualidade de vida. Concluiu-se que é de grande relevância abordar essa temática, visto que o prejuízo à saúde mental desses profissionais deve ser considerado, principalmente em tempos de pandemia. (shrink)

Este artigo tem como objetivo central analisar a necessidade de repensar o Direito e, em particular, o Constitucionalismo, devido às constantes transformações sociais e à crescente complexidade das relações interconectadas na sociedade global. Inicialmente, aborda-se o Direito Constitucional como uma teoria do conhecimento, explorando as três matrizes epistemológicas que permitem analisar o Constitucionalismo em diferentes contextos históricos. O problema central envolve a busca por uma teoria adequada para analisar e propor soluções para questões jurídicas globais, destacando a abordagem pragmática-sistêmica baseada (...) na Teoria dos Sistemas Sociais Autopoiéticos de Niklas Luhmann. Com ênfase nessa matriz epistemológica, o artigo explora a Teoria dos Sistemas Sociais de Luhmann, bem como diferentes abordagens para a Autopoiese e a terceira fase do constitucionalismo, o Constitucionalismo Social, com foco nos Fragmentos Constitucionais, teoria desenvolvida por Gunther Teubner. A justificativa para essa análise baseia-se na adequação da Teoria dos Sistemas Sociais em um contexto pós-moderno, onde problemas e respostas jurídicas transcendem fronteiras nacionais. O artigo adota uma metodologia sistêmico-construtivista com base nos pressupostos da sociologia de Luhmann e utiliza abordagens monográficas e técnicas bibliográficas para explorar abordagens contemporâneas em Direito Constitucional. Conclui-se que, diante dos desafios jurídicos globais, o Constitucionalismo tradicional limitado aos Estados Nacionais é insuficiente, e a Teoria dos Sistemas Sociais Autopoiéticos de Niklas Luhmann oferece uma abordagem adequada para lidar com a crescente complexidade. This study focuses on retraction notices from two major Latin American/Caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

Aldo Leopold (1887-1948) foi um professor e pesquisador que contribuiu para o campo da ecologia da vida selvagem, destacando-se no ambientalismo norte-americano do século XX. O objetivo deste artigo é discutir sob uma perspectiva filosófica a conservação da biodiversidade adotada por Aldo Leopold a partir de análise de trechos da sua última obra A sand county almanac and sketches here and there (1949). O livro, elaborado em seus anos de experiência na fazenda da família, apresenta uma série de ensaios com (...) uma abordagem ecológica da relação do ser humano com a natureza. As duas primeiras partes contêm ensaios resultantes da leitura da paisagem, adotando a perspectiva de elementos bióticos e abióticos do ambiente, assim como, ponderações resultantes de sua experiência profissional. A terceira parte da obra traz reflexões de caráter filosófico a respeito da estética da conservação e ética da Terra promovendo uma reinterpretação da identidade humana e do relacionamento com a terra. This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who worked (...) on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. In this urbane and witty book, Ronald de Sousa disputes the widespread notion that reason and emotion are natural antagonists.

This work empirically tests the concept of the ‘whistleblowing triangle,’ which is modeled on the three factors encapsulated by the fraud triangle (pressure or financial incentives, opportunity and rationalization), in the Indonesian context. Anchored in the proposition of an original research framework on the whistleblowing triangle and derived hypotheses, this work aims to expand the body of knowledge on this topic by providing empirical evidence. The sample used is taken from audit firms affiliated with both the big 4 and non-big (...) 4 companies operating in Indonesia. The results of analysis using the PLS-PM method found a significant relationship between the components of the whistleblowing triangle and the intention of blowing the whistle. We found that financial incentives are the most significant predictor of auditors’ intention to blow the whistle in Indonesia. Other components, such as opportunity and rationalization, also play an important role in supporting auditors’ intention to blow the whistle. Our findings also suggest that related pressures are the top priority for audit firms in Indonesia to consider in increasing whistleblowing intention. We expand the previous literature on whistleblowing which has been derived from the components of the fraud triangle (Brown et al. in Account Public Interest 16(1):28–56, 2016; Smaili and Arroyo in J Bus Ethics, 10.1007/s10551-017-3663-7, 2017) by adding empirical evidence. Este artigo visa analisar modos de axiologizar o bem-estar na escola em enunciados produzidos por alunos do 9º ano do ensino fundamental de uma escola municipal do interior baiano. Interessa-nos, especialmente, compreender como os sujeitos semiotizam, em seus enunciados, o que consideram o evento mais marcante de suas experiências ao longo dos anos finais do ensino fundamental e o que isso nos informa sobre os valores ali mobilizados relativos ao papel social e institucional da escola e(m) suas modalidades de convivência (...) intersubjetiva. As análises destacam que as memórias verbo-visualmente materializadas não se limitam a registros, abrigados na consciência, mas são repositórios de experiências afetivas de e em diversos cronotopos. O fato de as memórias apresentadas recobrirem diferentes eventos interacionais oferecem-nos uma visão crítica dos estudantes de como percebem e matizam complexidades das interações por eles rememoradas e enunciadas. Trabalhos, como o nosso, que se interessam pelos afetamentos de alunos, contribuem, localmente, para que o contexto escolar seja (re)(des)coberto, tensionando como percepções sociais são semiotizadas em horizontes apreciativos de experiências. Este artigo visa analisar indícios verbo-visuais de episódios de mal-estar enunciados por alunos que integram turmas da modalidade Educação de Jovens Adultos (EJA) em uma escola do interior baiano. Dedicamo-nos, especialmente, a compreender como os sujeitos semiotizam situações de embaraço social vivenciadas em salas de aula e(m) seus (d)efeitos. Como referencial teórico, partimos de pressupostos da Análise Dialógica do Discurso, da Clínica da Atividade e de outras categorias discursivas para lermos, a partir de uma dimensão axiológica, o corpus que é (...) composto por duas biograficzines. A análise dos dados registra que os (res)sentimentos dos discentes, que se deixam materializar em termos verbo-visuais, deflagram situações que ilustram a complexidade de dinâmicas que perfazem interações didáticas no ambiente escolar. Trabalhos como o nosso contribuem para tensionar a realidade escolar-profissional possibilitando a exploração de outros ângulos de nossas atividades como sujeitos sociais. (shrink)

In this paper I explain the impact of phenomenological philosophy in the conceptions of Luís Cabral de Mancada about law and juridical experience. Stressing that Moncada was the first scholar in Portugal who made an extensive use of phenomenological doctrines within his own field of research, I show that Husserl, Hartmann, and Scheler were the most influential thinkers for him. As a matter of fact, they had a positive impact on Moncada’s conceptions about Law, the axiological realm, the State, and (...) jusnaturalism. (shrink)

In this paper, I stress the importance of Luís Cabral de Moncada for the resettlement of the Philosophy of Law in the Portuguese university. I focus my attention on the overthrown of Positivism, and, as a consequence, on the reintroducing of axiological and ethical issues in the foundations of positive law. In so doing, I consider the relevance Phenomenology had for Moncada’ s theory of law, namely the theory of eidetic insight, and, particularly, the phenomenology of values. Pensar nas cidades que construímos é constituir também a construção de um olhar para os corpos que ocupam esses espaços. Neste trabalho, buscamos mergulhar na experiência da sexualidade-em-situação de homens gays da cidade de Campos dos Goytacazes - RJ. A história da construção da cidade se entrelaça em memórias de opressão e violências que até hoje se perpetuam na situação dos corpos desses homens, que a partir de suas trajetórias e experiências, resgatam memórias das situações que viveram e ainda vivem (...) na cidade. Há, portanto, a urgência de um imperativo de mudança que vai acontecendo individualmente e coletivamente, indicando que as suas experiências reivindicam e extrapolam as estruturas que um dia impediram seus corpos de existirem. In this paper, I analyze Carlos Cossio’s theory of law, and how his theory was a reaction to Kelsen’s juridical positivism. The most important aspect I highlight is the logical abstract normativism defended by Kelsen, and how it was overcome by a transcendental and existential theory of law, which Cossio develops in a close relationship to Husserl and Heidegger views.

The justification of Natural Law is a very controversial issue, not only after the Positivist’s rebuttals, but since its very anthropological foundations in the early modern age. In this paper, I try do give an account of Natural Law and natural rights in terms of a phenomenological description of the background of normative intentionality. Taking a genetic stance, I go from the positive norm and the intentionality that constitutes it to the underling pregiveness that supplies the condition of its possibility. (...) I exhibit it as the experience of the live-world, and I analyze it as an intersubjective world, where persons are given as equals and worth-counting. This is the very root of the concept of human dignity. Starting from it, I develop an account of the sense and content of the concept of Human Rights as a set of eidetic laws creating the framework for authentic human relationships. (shrink)

Este artigo visa analisar a narrativa (auto)biográfica de estudantes de Pedagogia em uma universidade pública da região do Vale do São Francisco, localizada no território de Petrolina-PE em contexto de pandemia da COVID-19. Para refletir sobre a formação a partir da escrita de si, pautamo-nos, teórica e metodologicamente, em Heidegger, Josso, Freire, Ribeiro, Passeggi, Sousa e Lima. Neste artigo, comtempla-se respostas referentes à como os estudantes se sentiram no processo de formação docente em meio a pandemia e o que (...) esperavam do futuro. A turma do curso de Pedagogia era composta por 19 estudantes, deste total, 17 participaram da atividade da escrita da carta a si. Como estratégia de análise, utilizou-se o método do círculo hermenêutico “heideggeriano”. Assim, as informações foram organizadas em três temas de sentido, sendo: saúde mental na pandemia; ensino remoto versus ensino presencial; e planejamento de carreira. Percebeu-se, por meio das cartas, a preocupação quanto ao ensino remoto, assim como os planos de futuro, com intenção contribuir socialmente para uma educação humana e facilitadora de aprendizagens. Notou-se, ainda, que os estudantes refletiram sobre o bem-estar na profissão, buscando o sentido de suas ações, além de demarcarem o suporte financeiro, emocional, familiar e formativo. (shrink)

In _The End of the Cognitive Empire_ Boaventura de Sousa Santos further develops his concept of the "epistemologies of the south," in which he outlines a theoretical, methodological, and pedagogical framework for challenging the dominance of Eurocentric thought. As a collection of knowledges born of and anchored in the experiences of marginalized peoples who actively resist capitalism, colonialism, and patriarchy, epistemologies of the south represent those forms of knowledge that are generally discredited, erased, and ignored by dominant cultures of (...) the global North. Noting the declining efficacy of established social and political solutions to combat inequality and discrimination, Santos suggests that global justice can only come about through an epistemological shift that guarantees cognitive justice. Such a shift would create new alternative strategies for political mobilization and activism and give oppressed social groups the means through which to represent the world as their own in their own terms.
