The second article, in which the author suggests an analysis of other three authors' state of nature models and tries to define the role of the models in their respective law concepts. The analysis demonstrates that all three models share same basic idea, which is the concept of an independent reasonable individual; this very idea is what these different models are based upon. The concept of an individual itself does not have a substantiation.

Résumé Cet article traite des rapports entre les processus naturels et l’intervention humaine à partir d’une réflexion sur la sélection en matière d’’insémination artificielle animale et humaine. Il étudie comment les discours de promotion et de justification de l’insémination se traduisent dans les pratiques des professionnels, dans la France du XXe siècle. De l’entre-deux-guerres jusqu’à l’institutionnalisation des banques de sperme dans les années 1970 et 1980, la sélection est au cœur de négociations sociales constantes. Initialement promue à des fins de (...) sélection drastique, l’insémination artificielle humaine relève principalement d’une « production du normal ». La sélection se heurte, en médecine, à des contraintes à la fois normatives, structurelles et matérielles qui en restreignent le périmètre, l’intensité et la portée, y compris avec les techniques de la génétique humaine. Il s’agit alors de comprendre dans quelles conditions une sélection de facto voire un eugénisme systémique peuvent exister en dépit de la forte vigilance éthique revendiquée par les acteurs. Are ecosystems morally considerable-that is, do we owe it to them to protect their “interests”? Many environmental ethicists, impressed by the way that individual nonsentient organisms such as plants tenaciously pursue their own biological goals, have concluded that we should extend moral considerability far enough to include such organisms. There is a pitfall in the ecosystem-to-organism analogy, however. We must distinguish a system’s genuine goals from the incidental effects, or byproducts, of the behavior of that system’s parts. Goals seem capable (...) of giving rise to interests; byproducts do not. It is hard to see how whole ecosystems can be genuinely goal-directed unless group selection occurs at the community level. Currently, mainstream ecological and evolutionary theory is individualistic. From such a theory it follows that the apparent goals of ecosystems are mere byproducts and, as such, cannot ground moral considerability. (shrink)

The Aesthetic Dimensions of Educational Administration and Leadership provides an aesthetic critique of educational administration and leadership. It demonstrates the importance of aesthetics on all aspects of the administrative and leadership world: the ways ideas and ideals are created, how their expression is conveyed, the impact they have on interpersonal relationships and the organizational environment that carries and reinforces them, and the moral boundaries or limits that can be established or exceeded. I argue that the debate about the reason-giving character of perception, and, derivatively, the contemporary debate about the nature of the conceptual content of perception, is best viewed as a confrontation with refined versions of the following three independently plausible, yet mutually inconsistent, propositions: Perceptual apprehension Some perceptions provide reasons directly Exclusivity Only beliefs provide reasons directly Bifurcation No perception is a belief I begin with an evaluation and refinement of each proposition so as to crystallize the source of the (...) difficulties that dominate our thinking about the reason-giving character of perception. I argue that the contemporary literature is broadly split between those denying Bifurcation and those denying Perceptual apprehension. Though Exclusivity, too, has been target to criticism, its grip on our thinking has all too often been underestimated. As a result, a proper denial or modification of Exclusivity is yet wanting. Overcoming Exclusivity involves a considerable challenge that has not been adequately acknowledged or met—to develop a substantive account of nonconceptual apprehension. Getting a clearer understanding of the nature, the source, and possible resolution of this challenge is the primary aim of this paper. (shrink)

This article presents a new reading of Fichte’s aesthetics that differs from a primarily functionalist interpretation of the imagination and art. It demonstrates that the “hovering” (Schweben) of the creative imagination should be viewed as the first principle of Fichte’s aesthetics, in which the latter consists of a triad of the pleasant, the beautiful and the sublime. Moreover, it argues that in the text Ueber Geist und Buchstab in der Philosophie (1795/1800) Fichte created a real and original monogram of the (...) hovering creative imagination, a monogram whose theoretical basis stems from Kant’s concept of the monogram in the 1st Critique as a “wavering sketch”. It contends that this overlooked but key artistic and practical example of a monogram opens up new perspectives for Fichtean aesthetics, further confirming that its first principle should be explicitly identified with the theory of the hovering imagination in the Grundlage der gesammten Wissenschaftslehre of 1794/95. Résumé Les auteurs distinguent classiquement topologie et ontologie temporelles et entreprennent de montrer que le choix d’une ontologie temporelle, mais aussi d’une ontologie générale, a des conséquences sur les propriétés de la topologie temporelle. Ils choisissent comme point de départ de cette démonstration l’application du principe d’indépendance d’Armstrong à l’ontologie temporelle et plus spécialement à la transitivité. Leur conclusion est que le choix de ce principe pose des problèmes très difficiles pour l’ontologie temporelle, autant que pour la topologie temporelle.

This article presents a new interpretation of the notorious "Horen" dispute between Schiller and Fichte by examining the text that was the catalyst for it, Fichte’s "On Spirit and Letter in Philosophy" (1795-1800), from the overlooked perspective of Schiller’s 1793 essay "On Grace and Dignity". It demonstrates that the Horen dispute is based on a theoretical misunderstanding rather than an irreconcilable opposition, arguing that Schiller’s notion of grace as beauty in movement provides the idealism and aesthetics of Fichte’s Wissenschaftslehre with (...) a powerful conceptual tool that was lacking in Kant’s critical philosophy. Peter Menzies has developed a novel version of the exclusion principle that he claims to be compatible with the possibility of mental causation. Menzies proposes to frame the exclusion principle in terms of a difference-making account of causation, understood in counterfactual terms. His new exclusion principle appears in two formulations: upwards exclusion — which is the familiar case in which a realizing event causally excludes the event that it realizes — and, more interestingly, downward exclusion, in which an event causally (...) excludes its realizer. This paper shows that one consequence of Menzies’s proposed solution to the problem of mental causation is a ubiquitous violation of the principle of closure — a fact that forces him into a trilemma to which we see no satisfactory response. Le développement d’un droit de regard des institutions collectives sur les corps gestants et surtout d’une injonction à « se savoir et se faire savoir » enceinte remonte au xvie siècle au moins. Or la reconnaissance d’un état de grossesse et sa datation ont toujours constitué une double incertitude, face à laquelle divers procédés d’observation corporelle ont été mis en œuvre au cours des siècles. L’article aborde cette question dans le temps long (de l’époque moderne à la fin du xxe (...) siècle) en comparant les modalités et les enjeux pratiques de la détection des grossesses dans un certain nombre de situations d’ordre médico-légal : affaires d’infanticide (datant surtout du xixe siècle), lutte contre l’avortement (fin xixe-milieu xxe siècle), dossiers administratifs relatifs au non-versement d’allocations prénatales (1945-1970). Cette histoire de la socialisation de la gestation permet d’identifier les jeux d’expertise, de médiations et de négociations auprès de femmes enceintes se disant non informées de leur propre état et propose une histoire sociale du doute, de la corporéité et de la conscience de soi. The paper describes a thread that binds past beliefs and practices with current technology and how that might be used to interpret current artistic progress. This requires an examination of Gnostic ideas, and an account of scientific and metaphysic research into the idea of networked systems and connectivity. The implementations and development of different codes as tools for sound composing is discussed. Two apparently contradictory contemporary trends are identified: (a) the growing homogenization of consumer culture that can be seen as (...) digital reincarnation of the common elements of ancient folk music and (b) the distribution and fragmentation of musical sources and outlets from which new structures and perceptions can emerge. I will present these trends and their foundations and tie them with current artistic development. (shrink)

The aim of this paper is twofold. First, we clarify the notion of immunity to error through misidentification with respect to the first-person pronoun. In particular, we set out to dispel the view that for a judgment to be IEM it must contain a token of a certain class of predicates. Rather, the importance of the IEM status of certain judgments is that it teaches us about privileged ways of coming to know about ourselves. We then turn to examine how (...) perception, as a state with nonconceptual content, can give rise to judgments that are IEM. On one view, the ‘inheritance model’ of immunity, perception gives rise to such judgments because perception itself is IEM. We argue that this model is misguided, and, instead, suggest and elucidate an alternative view: perception gives rise to judgments that are IEM by virtue of containing implicitly self-related or self-concerning information. Friedrich Schiller (1759-1805) is now regarded by many readers and scholars not simply as a poet, historian, or playwright, but as a genuine philosopher in his own right. -/- The following research articles in French and English are devoted to understanding the relationship between Schiller’s philosophy and German idealism, especially some of the chief figures associated with the inception and extended development of this movement: Kant, Reinhold, Fichte, Schelling, Hegel, and Lotze. -/- In the last twenty years in particular, ground-breaking (...) edited collections have appeared on the content and legacy of Schiller’s thought. The present volume of articles, however, is one of the first to attempt a broader investigation of Schiller’s connection to German idealism, in which the contributions have above all been written by scholars of German idealism itself. -/- The aim of this volume is to furnish foundational material for better answering the question: To what extent should Friedrich Schiller be considered a German idealist? Naturally, the response to this question depends on one’s conception of German idealism, a point discussed below. This paper assesses Fodor’s well-known argument from multiple realizability to nonreductive physicalism. Recent work has brought out that the empirical case for cross-species multiple realizability is weak at best and so we consider whether the argument can be rebooted using a “thin” notion of intraspecies multiple realizability, taking individual neural firing patterns to be the realizers of mental events. We agree that there are no prospects for reducing mental events to individual neural firing patterns. But there are more plausible candidates (...) for the neural realizers of mental events out there, namely, global neural properties such as the average firing rates of neural populations, or the local field potential. The problem for Fodor’s argument is that those global neural properties point towards reductive versions of physicalism. (shrink)
