By lopsided majorities, the U.S. Supreme Court, in a series of cases, persistently commanded the lower courts to condition the admission of proffered expert testimony on the demonstrated validity of the proponents’ claims of expertise. In at least one broad area – the so-called forensic sciences – the courts below have largely evaded the Supreme Court's holdings. This paper aims to try to explain this massive defiance by the lower courts in terms of social epistemology.

Is medicalization always harmful? When does medicine overstep its proper boundaries? The aim of this article is to outline the pragmatic criteria for distinguishing between medicalization and over-medicalization. The consequences of considering a phenomenon to be a medical problem may take radically different forms depending on whether the problem in question is correctly or incorrectly perceived as a medical issue. Neither indiscriminate acceptance of medicalization of subsequent areas of human existence, nor criticizing new medicalization cases just because they are medicalization (...) can be justified. The article: (i) identifies various consequences of both well-founded medicalization and over-medicalization; (ii) demonstrates that the issue of defining appropriate limits of medicine cannot be solved by creating an optimum model of health; (iii) proposes four guiding questions to help distinguish medicalization from over-medicalization. The article should foster a normative analysis of the phenomenon of medicalization and contribute to the bioethical reflection on the boundaries of medicine. (shrink)

Thanks to its inexhaustible wealth of imagery, Scripture has throughout the centuries been inspiring many artists who launched themselves into a true and proper 'visual' exegesis, as they tried to communicate Truth through the images they created. This articles studies one of Nicolas Poussin's paintings as an example of this interpretative (...) genre. Poussin is one of the fathers of visual exegesis in the West. The paper tries to illustrate how, by painting some Gospel narrative, the artist situates his very person within an interpretative tradition that calls for attention. On the other hand, though, it is the artist himself or herself who rephrases the content of the narrative through techniques of the imagination that do shed new light on Christ's own action. _The Bounds of Reason: Habermas, Lyotard & Melanie Klein on Rationality_ is a highly original yet accessible study of the debate between modernity and postmodernity. Emilia Steuerman clearly explains the modernity/postmodernity dispute by examining the problem that has driven the whole debate: whether the use of reason is an emancipatory or enslaving force. Steuerman clearly sets out this debate by critically examining the arguments of two of its key proponents, Jurgen Habermas and Jean-François Lyotard. She clearly explains Habermas' defence (...) of modernity and his attempt to salvage Enlightenment ideas of truth, justice, and freedom through the use of reason. She contrasts this with Lyotard's postmodernism and his scepticism about the use of reason, and its claims to universalism and objectivity. Throughout, Steuerman contrasts the Habermas-Lyotard debate with important insights from psychoanalytic theory, and shows how Habermas' notions of intersubjectivity and a community of shared language users can be compared and contrasted with Melanie Klein's theory of object relations. Celem artykułu jest podsumowanie filozoficznego sporu na temat autentyczności emocji wywoływanych przez środki psychofarmakologiczne. Praca jest głosem w szerszej bioetycznej dyskusji na temat ulepszania ludzi, a w szczególności ulepszania nastroju. W pierwszej części pracy przedstawiono dwa przeciwstawne bioetyczne stanowiska: wrogich idei ulepszania ludzi biokonserwatystów oraz entuzjastycznych transhumanistów. W drugiej części artykułu wykazano, w jaki sposób nieporozumienie między obydwoma stanowiskami może wynikać z innego sposobu definiowania pojęcia autentyczności. W trzeciej części problem autentyczności emocji rozpatrzono na hipotetycznym przykładzie przyjemności wywoływanej przez „pigułkę (...) szczęścia”. (shrink)

The fundamental problem of Jan Srzednicki’s new epistemology is the question: how thoughts surpass the resistance of that what is ontologically present, how this process is possible? In Srzednicki’s opinion, thinking is a process of distancing from the pressure of ontological presence. His ideas offer a splendid inspiration for philosophy of medicine which attempts to answer the question “whether (and how) a disease is cognizable?” This question refers directly to and is translated into the question of the capacity to diagnose (...) particular diseases. Answering to the above stated question whether disease is cognizable we should answer in the affirmative, however, in a “modified” form that its pre-cognitive resistance to reality is formed at the articulated level. Somewhat intuitively we feel the presence of a disease before we express it in words as a disease according to our scientific or informal thought style. (shrink)

Teacher persistence has been a growing issue in recent decades. This raises the problem of the sustainability of the teaching workforce, the professionalism of working teachers and preserving the quality of education. In this study we aim to create and test an empirical model that makes it possible to predict teachers’ plans to remain in or leave the profession. Proceeding from earlier research, this study focuses on investigating the role of motivations, job demands, and school climate as potential factors of (...) teacher retention. A sample of 373 teachers responded to an electronic questionnaire compiled using questions from FIT-Choice, Norwegian Teacher Self-Efficacy Scale, and the Delaware School Climate Survey. Structural equation modelling was applied to find the model that predicts teachers’ plans to remain in or leave the profession. The findings revealed two main factors – the combination of perceived teaching ability and intrinsic motivation, and job security – that have a positive impact on plans to continue teaching. Perceived teaching ability and intrinsic motivation, in turn, is affected by relations with students and maintaining discipline in class. Emotional exhaustion and workload impacting the latter, predict the risk of attrition. Contrary to earlier research, age and years of teaching experience appeared to be unrelated to plans to continue teaching. (shrink)

We believe with the publication of our Lexicon Spinozanum, that we are meeting a need in Spinoza historiography which has been pointed out by scholars, but has never before been satisfied. In the intro duction of his Spinozas philosophische Terminologie (Leipzig, 1913), G. T. Richter promised "a Spinozistic Lexicon in which the meaning of each term is set out on an historical basis in alphabetical order". In 1924, in the Report, i.e., Nachbericht, of his four volume edition of the complete (...) works of Spinoza (Heidelberg), C. Gebhardt promised a complementary volume comprising, among other things, a general index. However, neither the one nor the other were ever published. The hope of seeing this gap quickly filled has been reiterated recently by Di Vona: "The compilation of a Spinozistic index is a task of the history of philosophy, the execution of which would gratify all scholars". (Di V on a, Studi suIt' ontologia di Spinoza, Florence, 1960). We do not know how closely our Lexicon Spinozanum corresponds to what Richter and Gebhardt projected. We believe, however, that there are common requirements at the basis of works of this sort. In our procedure and in the delimitation of our scope, we have set for ourselves two main criteria: that of clarity and that of completeness. We hope we hav:e not deviated from them too much. Avec l’entrée massive dans l’usage du nom « émotion » comme nom générique de toutes les manifestations psychologiques, due à la vulgarisation du discours de spécialité de la psychologie, des arts, etc., il existe la tentation de considérer ce nom, du point de vue linguistique, uniquement comme un hyperonyme et même comme un « nom général », du sommet ou des fondements du lexique. Cet article présente un point de vue nouveau : il montre que, par ses propriétés morphologiques, syntaxiques (...) et anaphoriques, le nom émotion est aussi un nom de base, du même niveau lexical que peur, joie, tristesse, etc., que l’on a pu considérer comme ses hyponymes. Les hormones sexuelles sont des objets hybrides et complexes à la frontière du sexe et du genre. Dès lors qu’elles sont synthétisées sous forme pharmaceutique, elles peuvent attribuer des caractéristiques sexuelles au corps de manière partiellement exogène à celui-ci. Il s’en suit que l’utilisation clinique qui en est faite est socialement réglementée. À travers une analyse de divers contextes d’utilisation des hormones observés à Bahia, au Brésil, cet article montre que le dualisme sexuel est le produit de pratiques de régulation (...) biomédicales qui visent à encadrer la circulation des hormones. Le sens du terme local « hormônio » n’est pas pleinement recoupé par celui d’hormone, qu’il excède. L’emploi commun qui est fait au Brésil du singulier procure au terme « hormônio » une qualité fluide et homogène. Dans ce contexte, les hormones sont comprises comme une sorte de substance qui peut circuler entre les corps. Cette conceptualisation des hormones comme une substance a des implications pour le statut ontologique des corps et révèle la relative plasticité de la relation sexe/genre. (shrink)

Literary narratives are well recognised for their power to foster engagement with complex social themes. Transmedia narratives, which present the same story in different media, can help advance both critical multimodal discourse studies and multiliteracies pedagogies. To harness this potential, we need to develop methods for systematically relating media affordances to discourse-semantic patterns and the broad social themes these patterns construct in narratives, and ensure these methods build on the knowledge learners bring to the classroom. This article introduces a social (...) semiotic method for analysing transmedia narratives and illustrates its ability to reflect the persuasive power of narrative and build on young children's critical multimodal awareness. This is achieved through a case study comprising data from three adaptations of the same award-winning narrative - animated film (Joyce, W. (Producer), Joyce, W., & Oldenburg, B. (Directors) (2011). This article examines the topic of protest mapping during the rise of Occupy Wall Street in the United States in 2011–2012. It focuses on various practices of protest mapping, including a con­sideration of how space (public, urban, or of the protest camp) is represented in the visual sources discussed. It also addresses the qualitative difference between protest mapping and other mapping practices, as well as the categorization of protest mapping terms. Using the method of source analysis and online research, the (...) article adopts, as its key concept for studying protest as a multi-threaded phenomenon, the notion of détournement. This concept was first described in 1957 by Gil Wolman and Guy Debord, and from the early 1960s was used as a creative method and also a revolutionary strategy by the avant-garde artistic group, the Situationist International. The categories of stasis, dynamism, and spatiality will also be important points of reference. (shrink)

The phenomena of truth, truthfulness, veracity and “truthiness” discussed widely in logic, epistemology as theory of science and gnoseology as general theory of knowledge, have received many interpretations—and not a single one to be generally accepted. Discussions continue not only upon narrow technical, operational questions of the predicate calculus and/or propositions calculus, but also on logic-gnoseological problems, one of which casts doubt on the maxim “logic is the house of truth,” and the other highlights the laxity of the opposition of (...) “truth—falsehood” meanings as the main categories of the two-valued logic. These evaluations of proposition do not in fact oppose each other in the sense of a contradiction. Verity and falsity are controversial (opposite), but not contradictory (antithetical) concepts; it is truth and non-truth that are contradictory. Therefore, there is not only the possibility, but also the reality of the existence of a field, or zone, of transition between the values “true—false.”. (shrink)

Despite recent efforts by the Artificial Intelligence (AI) community to move towards standardised procedures for documenting models, methods, systems or datasets, there is currently no methodology focused on use cases aligned with the risk-based approach of the European AI Act (AI Act). In this paper, we propose a new framework for the documentation of use cases that we call use case cards, based on the use case modelling included in the Unified Markup Language (UML) standard. Unlike other documentation methodologies, we (...) focus on the intended purpose and operational use of an AI system. It consists of two main parts: firstly, a UML-based template, tailored to allow implicitly assessing the risk level of the AI system and defining relevant requirements, and secondly, a supporting UML diagram designed to provide information about the system-user interactions and relationships. The proposed framework is the result of a co-design process involving a relevant team of EU policy experts and scientists. We have validated our proposal with 11 experts with different backgrounds and a reasonable knowledge of the AI Act as a prerequisite. We provide the 5 use case cards used in the co-design and validation process. Use case cards allows framing and contextualising use cases in an effective way, and we hope this methodology can be a useful tool for policy makers and providers for documenting use cases, assessing the risk level, adapting the different requirements and building a catalogue of existing usages of AI. The aim of this article is to explore how metaphor is mobilized to frame and describe the lived experience of dementia in a corpus of illness narratives compiled from 10 blogs initiated and maintained by individuals diagnosed with early-onset dementia. The article is set against the background of contemporary healthcare practices and discourse around chronic illness and focuses on the metaphors that patients use to communicate about their dementia experience in relation to three basic psychological needs: autonomy, competence and relatedness, (...) which are essential for human well-being and are heavily challenged in complex medical situations. Results are discussed in terms of the framing metaphors provide of the emotional, psychological impact of dementia and their implications for patient-centered care. This study expands prior work by researching metaphors used for a condition that has been scarcely explored from this point of view and by focusing on the patient’s perspective exclusively. (shrink)
