People v. Strauss-Kahn is an ideal lens through which to examine the operation of a criminal justice system that privileges the presumption of guilt, or, to use the words of the US Supreme Court in the 2012 decisions Lafler v. Cooper and Missouri v. Frye, has become “a system of pleas, not a system of trials.” It is both an excellent example of a transparent and objective invocation of the criminal sanction, and a sharp counterpoint to the vast (...) majority of cases where law enforcement conclusions are privileged and rarely second-guessed. As analyses of wrongful convictions have sadly but inevitably demonstrated, the screening methods of police and prosecutors are fallible. Moreover, the prevalence of “tunnel vision” once the decision to charge has been made means that few cases experience the kind of post-indictment investigation and reevaluation seen in the prosecution of Dominique Strauss-Kahn. Stage by stage, the Strauss-Kahn case illustrates how to counterbalance the presumption of guilt and give expression to the presumption of innocence in the pretrial period through vigilantly-invoked and enforced due process protections. Drawing from this examination, the paper will then explore how to approach this model process in the more standard cases, which typically see a fraction of the judicial, law enforcement, and defense resources afforded Dominique Strauss-Kahn. The Strauss-Kahn prosecution offers several insights, three of which will be sketched at the paper’s conclusion: a requirement that prosecutorial decision-making be subject to a reasonable doubt standard; vigilant and early enforcement of the prosecutor’s obligation to disclose information that is favorable to the accused; and finally, a requirement that a prosecutor explain in writing any decision to dismiss the felony charges in indicted felony cases, so that the factual, legal and policy bases of these decisions (numbering almost one quarter of New York’s superior court felony cases annually) can be analyzed and publicized. When Dominique Strauss-Kahn, then head of the IMF, was arrested on charges of sexual assault arising from events that were alleged to have occurred during his stay in an up-market hotel in New York, a sizeable portion of French public opinion was outraged - not by the possibility that a well-connected and widely-admired politician had assaulted an immigrant hotel worker, but by the way in which the accused had been treated by the American authorities. I shall argue (...) that in one relatively minor respect, Strauss-Kahn’s defenders were correct. They were correct to argue that the parading of Strauss-Kahn before the press, in handcuffs - the so-called perp walk - constituted a form of punishment; and thus that it contravened the principle that criminal punishments should only be administered after a fair trial. So-called ‘expressive’ theorists of punishment hold that a form of harsh treatment can only constitute a form of punishment if it has an expressive role. Within the expressive family, we can distinguish between views on which the primary target of the communication to be the society of which either offender, or victim, or both are members—what I call ‘Denunciatory Views’, and views which take the principle target of penal communication to be the offender—such as Antony Duff’s Communicative View. I shall argue that on both a minimal account of punishment and on either kind of expressive view, ‘perp walks’ are a form of punishment. (shrink)

In this paper, we analyze the recent public scandal involving Nafissatou Diallo and Dominique Strauss-Kahn to offer an account of the role affectability imbalances play in process-based invisibility. Process-based invisibilities, in this paper, refer to predictable narrative gaps within public narratives that can be aptly described as disappearances. We demonstrate that compromised, complex social identities, maladjusted webs of reciprocity, and a failure to fully appreciate basic affectability in large part cause affectability imbalances. Ultimately, we claim that affectability (...) imbalances and the three imbricated conditions that facilitate such imbalances—complex social identities, reciprocity, and basic affectability—are integral features of process-based invisibility. Informed by medical science and biotechnology, Karoline Georges’s novel Under the Stone offers a reflection on suffering bodies and imagines responses to an overwhelming sense of fear and passivity that embodied trauma and the world’s many crises can create. In line with the editors’ reclaiming of the milieu for the medical humanities, I draw on Deleuze and Guattari’s geophilosophy and Sara Ahmed’s notions of stranger and encounter for reading the novel’s spatialization of oppressive power dynamics and its imagination of subversive (...) emergence. I also complicate the literary text’s discourse on space and body by relying on wonder studies to examine further its alternative forms of careful attunement enacted through the protagonist’s affective and disembodied awakening, the latter fueled by his escape from “the incessant movement of automatic components that delineat[e] [his] presence in the world” (Georges 2016, 61). Happening from and because of the Tower’s milieu, this escape becomes a mitigating force to physical, affective, and social struggles. I thus contend that Georges’s text provides thought-provoking material about the functions and effects of art for addressing the dangers and promises of bioethics, body sovereignty, and life protection. Epistemology is an important philosophical discipline, yet little research has directly addressed its aims and criteria of success. This study closes the gap by offering epistemological functionalism as a fully worked-out meta-epistemological framework that accommodates not only questions of traditional epistemology, but also more recent developments such as naturalism, social epistemology, pragmatism and feminism.

One of the outstanding thinkers of our time offers in this book his final words to posterity. Studies in Platonic Political Philosophy was well underway at the time of Leo Strauss's death in 1973.

There is a growing resurgence in the study of psychedelic medicines for the treatment of mental health and substance use disorders. However, certain early investigations are marred by questionable research methods, abuses against research participants, and covert Central Intelligence Agency financial involvement. The purpose of this study was to understand how and to what extent people of colour and other vulnerable populations, specifically, individuals who were incarcerated or incapacitated due to mental health issues, were exploited during the first wave of (...) psychedelic research in the USA. To do so, we reviewed available empirical publications according to current ethical standards. Variables of interest included race and ethnicity of participants, population vulnerability, drug administration conditions, informed consent and undue influence. Our findings draw attention to the history of research abuses against people of colour in Western psychedelic research. In light of these findings, we urge a call-to-action to current psychedelic researchers to prioritise culturally inclusive and socially responsible research methods in current and future studies. More controversial have been PGD to select the sex of the child-to-be for “family balancing”, PGD for mere susceptibility to disease and for late-onset disorders such as Alzheimer diseas, and most controversially, PGD to create a donor child who is Human Leukocyte Antigen (HLA-matched with a preexisting sibling in need of stem cell transplant. This article presents the critique of cybernetics as central to the history of one of the twentieth century’s most infamous avant-garde movements: the Situationist International (SI). Bringing together and analysing a series of seemingly marginal events in the build-up to May ’68, this article shows how the SI’s portrait of cybernetics as an emerging form of social power and control foreshadows later developments in French radical thought. This little-noted trajectory in the situationist movement also highlights the ways in which aesthetics, (...) theory, and politics are inextricably tied together in the events of May ’68. (shrink)

The analysis of identity in cases of memory loss, particularly in Alzheimer’s disease, sheds light on relevant philosophical and practical concerns, such as decision-making processes, autonomy, and the improvement of interaction with patients. Literature on psychological continuity recognizes identity when there are no disruptions in memory, which is certainly not the case in Alzheimer´s disease. Narrative identity, particularly in its relational and non-relational versions, delivers tools which are not exempt from difficulties. Either the caregivers’ narrative or the patient’s narrative is (...) dismissed. Furthermore, if there is a contradiction of narratives in relational theories, we are advised to either find the best narrative or seek agreement. However, one option rejects one narrative, while the other is unattainable in practice for the case in question. Hence, we propose drawing from ironism (Rorty, 1989), which suggests duality of dialogues when dealing with problems. This will be used to defend that the narratives of both, a person with Alzheimer and those close to them, are valid when constituting identity of the former. In this case, we will articulate and defend relational ironism, which allows us to embrace inconsistent narratives without seeking agreements. According to this, personal identity in this case is in constant tension between the narratives of those who suffer Alzheimer’s disease and the narratives of those close to them. We close illustrating possible benefits for how best to interact with patients. (shrink)

Biological attention to evolution and animal life has primarily emphasized a filiative approach that, although important, overlooks crucial dimensions highlighted by an ecological approach to animal human societies. Increased attention to singular animals and critical scrutiny of the operating definitions of society and culture indicates that vast dimensions of this area have been overlooked and remain to be studied. It is particularly important to pursue the aspects of signification, meaning, individuation, and subjectivity. Attention to animal human societies, or to animal (...) cultures that develop in the heart of human cultures, shows that humans and animals often form extimate relations based on particular aspects of animal subjectivity. With certain species we share a dense form of intertwining built on natural, cultural, and biographical histories. Beyond that, an argument on biosemiotic grounds maintains that culture is intrinsic to the living. (shrink)

Control of DNA supercoiling by the free-energy of hydrolysis of ATP that involves gene expression is analyzed in terms of three levels of unconnected metabolic pathways. These are synthesis and breakdown of topoisomerase mRNAs, synthesis and breakdown of topoisomerase proteins and supercoiling and relaxation of DNA. The so-called square-matrix method previously developed for the control of metabolic pathways, is extended to deal with this hierarchical control system. It turns out that also in this case, the matrix of control coefficients is (...) equal to the inverse of the so-called elasticity matrix, which contains all relevant elasticity coefficients as well as information about the structure and connectedness of the pathways involved. For a simpler case of a hierarchy of two systems, we demonstrate that the explicit matrix inversion method may be replaced by an implicit method in which the regulatory effects that run through the other level are described by an additional elasticy coefficient which may then be treated as if local. Relations between humans and animals occur under myriad forms and with profound richness. However, taking account of these relations often poses a considerable difficulty. That humans have a strong interest in many other animals, and that humans give rise to a reciprocal interest among many animals, is an important cultural and evolutionary occurrence. Common living and the sharing of territory often give rise to social ties between humans and animals. It is important to study the material dimensions that render possible (...) friendship between species. Distance often complicates the material proximity of these relations. The human voice and music are significant conduits of communication between species. Excessive focus on formal symbolic communication has often occluded the significant affective exchange that takes place between species by means of human voice and language. Music, as explored by Jim Nollman, constitutes a “privileged vector” of interspecies communication. (shrink)

The analysis of the golden Mithras’ bas-relief in the Museum of the Baths of Diocletian in Rome confirms the Platonic Chiasma. The scene admits two diagonals starting from each corner. One passes through the sun and the other through the moon. The sun god is also shown with an object in his left hand, which may be a soul or a sacred heart. This would confirm that the slab shows the opposition between metempsychosis (lunar) and resurrection (solar). The analysis of (...) the Barberini fresco is of great interest. It shows that the Platonic Chiasma falls exactly within the celestial gates of Capricorn and Cancer. The solar line is superimposed on a line already present on the fresco. Finally, sacred geometry helps to explain some strange-looking reliefs from the Danube region. (shrink)

La dimension temporelle, qui nous est la plus familière, reste aussi la plus énigmatique. Vivant dans le temps, réussissons-nous à le penser? Malgré les progrès des techniques qui en maîtrisent la mesure, sa nature se dérobe encore. Faut-il s'obstiner à le capter en son unité ultime, comme le fit toute une tradition métaphysique? Cet essai s'organise autour d'une intuition centrale : il n'y a de temps que montré et mesuré ; le temps n'est jamais " pur ". Une mesure fait (...) apparaître du temps, mais cette émergence ne se limite pas à notre " temps des horloges ". Elle se déploie en fonction de gestes humains qui sont autant d'inventions de rythmes et dont les conséquences sont éthiques. Ce renouvellement de la problématique temporelle, tout en impliquant une réflexion sur la mutation des paradigmes scientifiques, s'accomplit aussi bien en dialogue avec les grandes philosophies de la temporalité, d'Aristote à Heidegger, qu'avec des penseurs contemporains (Ricœur, Derrida). Les Lois ne sont pas le dialogue de Platon le plus connu, ni a fortiori le plus commente. Strauss nous en donne ici un commentaire magistral: serre, il epouse toutes les sinuosites du texte et en revele toute la subtilite. Ce commentaire, publie apres la mort de l'auteur, mais entierement termine, est le fruit d'une vie entiere de meditation de l'oeuvre de Platon. A ce titre, il constitue un exemple privilegie de l' art de lire les textes de l'antiquite (...) de Leo Strauss. Le dialogue des Lois, en tant qu'il traite les questions de la loi politique et de la loi divine, a tres tot alimente les reflexions de Strauss sur le probleme theologico-politique qui est central dans ses recherches. Can we say that the mathematical signs refer, beyond the mathematical sense, to ideal objects which would correspond to this sense and realize it? Parallel to this, if Husserl affirms that the intuition of essences and sensitive intuition participate in the same generic concept of intuition as a giving act, can we however affirm that mathematical evidence is giving ideal objects such as sensitive perception gives individual objects?We show that the notions of object and evidence have a different status and (...) other modalities in mathematics than in other fields, and that the notion of categorical intuition must be replaced by that of categorical fulfilment, which designates the totality of theoretical procedures by which knowledge is validated. Against the temptation of the universalization of concepts, we advocate a regional phenomenology, practiced closely to the fields of thematized objects and their specific mode of access. (shrink)

Le cogito cartésien a fait l’objet de critiques essentielles de la part de Kant et Husserl : Descartes aurait substantialisé, réifié et mondanisé le cogito au lieu de la saisir dans sa pureté transcendantale. Nous faisons ici retour aux textes cartésiens, afin de déterminer si ces critiques sont légitimes ou si la pensée cartésienne a davantage anticipé la pensée transcendantale que ne l’estimaient Kant et Husserl.
