In lieu of an abstract, here is a brief excerpt of the content:Philosophy and Literature 26.1 (2002) 224-238 [Access article in PDF] Bookmarks A Hanging Judge Denis Dutton "CORNERING THE MARKET ON CHUTZPAH," blared the headline on one review, and in tone it wasn't alone. It's not often that a book by a public intellectual has received as much media attention—mostly vilification and scorn—as Richard A. Posner's Public Intellectuals: A Study of Decline (Harvard University Press, $29.95). Three reasons for (...) this stand out. First, there's the sheer audacity of including a list of the top hundred public intellectuals, drawn from a larger list of 546 names. This invites endless dispute over how the list was generated, who is on it, who is left off, where each one stands, and why. Second, there is the fact that Posner has managed in the book to offend half of the public intellectuals you'd expect to be called on to review it—almost as though he made a list of potential reviewers and worked in a swipe at each. Finally, he has tapped into the deep antipathy humanist intellectuals have to seeing a beloved topic treated quantitatively, with statistics and applications of social and economic theory, replete with graphs and algebraic formulae. And after all, what topic is more beloved by the intellectuals than they themselves? That Posner would actually treat such important people as a demographic type, sorting them in terms of race, age, field, politics, sex—why, he even asks why so many are Jews. It's outrageous... and delicious.Definitions first. The idea of an intellectual, Posner says, should not be identified merely with having highbrow, cultivated tastes, being especially creative, or having high intelligence. All of these things are possible without being an intellectual, which Posner thinks ought to denote the application of the mind to "political matters in the broadest sense of that word, a sense that includes cultural matters when they are [End Page 224] viewed under the aspect of ideology, ethics, or politics (which may all be the same thing)." There is therefore a vague redundancy in the term "public intellectual," since the placing of ideas in a larger public context, acting as social critic, is what the intellectual most essentially does. In our age of vast communication media, it is also done con-spicuously in public, through op-eds, public radio interviews, and on TV clips with the regulation public-intellectual bookcase as a backdrop. This concern with larger moral issues means that for Posner paradigm individuals would therefore include the likes of John Dewey, Bertrand Russell, Hannah Arendt, Arthur Koestler, Edmund Wilson, Susan Sontag, and most powerfully in Posner's mind, George Orwell: people who write about literature, art, science, and so forth from a broadly political or ideological perspective. For example, when Allan Bloom writes about rock and roll, he is not doing so as a music critic but as a philosopher who sees it as a symptom and source of social degradation. That's echte public intellectual work (and rather bad work in this particular case, Posner believes). That it is done for a broader public is also a crux for Posner, who leaves omits John Rawls from his list, because as influential as Rawls is as a philosopher, he does not address a larger public in the way that Richard Rorty and Martha Nussbaum do.The decline referred to in Posner's title is a decline in the actual worth of public intellectuals' work, not in their media celebrity, which has grown roughly inversely to the value of what they do. This invidious situation has followed, in Posner's view, the proliferation of academics in the ranks of public intellectuals. From the nineteenth century, with such names as Thoreau, J. S. Mill, Herbert Spencer, Matthew Arnold, and Tocqueville, to well into the twentieth, with the likes of Max Eastman, Edmund Wilson, H. G. Wells, and Dwight Macdonald, the great tradition of public intellectuals had its life outside of universities. Bertrand Russell and the Nature of Propositions offers the first book-length defence of the Multiple Relation Theory of Judgement (MRTJ). Although the theory was much maligned by Wittgenstein and ultimately rejected by Russell himself, Lebens shows that it provides a rich and insightful way to understand the nature of propositional content. In Part I, Lebens charts the trajectory of Russell’s thought before he adopted the MRTJ. Part II reviews the historical story of the theory: What led Russell to deny (...) the existence of propositions altogether? Why did the theory keep evolving throughout its short life? What role did G. F. Stout play in the evolution of the theory? What was Wittgenstein’s concern with the theory, and, if we can’t know what his concern was exactly, then what are the best contending hypotheses? And why did Russell give the theory up? Moreover, he argues that the MRTJ does most of what we could want from an account of propositions at little philosophical cost. ABSTRACT:In a series of reports the United Nations Special Representative on the issue of Human Rights and Transnational Corporations has emphasized a tripartite framework regarding business and human rights that includes the state “duty to protect,” the TNC “responsibility to respect,” and “appropriate remedies” for human rights violations. This article examines the recent history of UN initiatives regarding business and human rights and places the tripartite framework in historical context. Three approaches to human rights are distinguished: moral, political, and legal. (...) It is argued that the tripartite framework’s grounding of the responsibility of TNCs to respect human rights is properly understood as moral and not merely as a political or legal duty. A moral account of the duty of TNCs to respect basic human rights is defended and contrasted with a merely strategic approach. The main conclusion of the article is that only a moral account of the basic human rights duties of TNCs provides a sufficiently deep justification of “the corporate responsibility to respect human rights” feature of the tripartite framework. Em primeiro lugar, é considerada a ideia de existência simbólica na lógica de MacColl, ao mesmo tempo que se assinalam os problemas que, na perspectiva de Bertrand Russell, estão associados com a auta-referência e o significado da classe-nula. Por outro lado, o artigo demonstra também até que ponto a própria perspectiva de Russell não está livre de problemas, de ambiguidades e de mudanças de opinião. (...) In recent years, a hierarchical view of reality has become extremely influential. In order to understand the world as a whole, on this view, we need to understand the nature of the fundamental constituents of the world. We also need to understand the relations that build the world up from these fundamental constituents. Building pluralism is the view that there are at least two equally fundamental relations that together build the world. It has been widely, though tacitly, assumed in a (...) variety of important metaphysical debates. However, my primary aim in this paper is to argue that this has been a mistake. I will show that serious problems concerning the relationship between building and fundamentality afflict pluralism and are likely fatal to it. I claim that, for better or worse, our best hope is building singularism, the view that there is a single most fundamental building relation. I conclude by examining the advantage that singularist accounts enjoy over their pluralist rivals. (shrink)

The impact of socially responsible corporate behavior on economic performance is a major preoccupation of managers today. This article explores the links between narrowly defined constructs: stakeholder orientation, environmental proactivity and profitability, from the perspectives of stakeholder theory and resource-based theory. We collected data on the food and beverage, and household and personal products industries. Using structural equation modeling, this paper makes two contributions. We found a negative link between companies simply having a higher stakeholder orientation and profitability. Importantly, however, (...) environmental proactivity not only had a positive impact on profitability, but also appeared to mediate the relationship between stakeholder orientation and profitability. In other words, if a company is more environmentally proactive, it will be more attentive to a broad array of stakeholders, and this will in turn contribute positively to profitability. (shrink)

Le chapitre suivant se veut une réflexion plus générale sur les motivations philosophiques qui commandent des jugements si opposés sur le statut ontologique et épistémologique de la psychologie du sens commun. This article applies the Kantian doctrine of respect for persons to the problem of sweatshops. We argue that multinational enterprises are properly regarded as responsible for the practices of their subcontractors and suppliers. We then argue that multinationalenterprises have the following duties in their off-shore manufacturing facilities: to ensure that local labor laws are followed; to refrain from coercion; to meet minimum safety standards; and to provide a living wage for employees. Finally, we consider and reply to the objection that (...) improving health and safety conditions and providing a living wage will cause greater harm than good. (shrink)

Tout en s’inscrivant dans une théorie des droits des animaux « abolitionniste », cet article entend montrer que, sous réserve du respect de certaines conditions, il n’est pas nécessairement condamnable sur le (...) plan moral d’autoriser la perpétuation des animaux domestiques – en particulier des animaux de compagnie. Ainsi, je tenterai de montrer que s’il est vrai, toutes choses égales par ailleurs, qu’il est moralement acceptable de mettre au monde des enfants sur la base d’un désir égoïste, alors il l’est aussi de laisser venir au monde des animaux de compagnie pour une raison semblable. Le fait d’avoir un enfant ou un animal de compagnie ne mobilisent pas nécessairement les mêmes enjeux éthiques. Je ferai valoir que malgré certaines contraintes, la vie des animaux de compagnie peut tout à fait être enviable. Enfin, j’indiquerai en quoi le premier argument fournit des pistes pour penser le statut légal des animaux de compagnie. | : Because of the injustices domestic animals suffer today, some animal rights theorists claim that the relationship between humans and domestic animals is intrinsically unjust, and that therefore we should not allow domestic animals to breed. I try to show in this paper that, provided that some specific conditions are respected, it is possible to allow the perpetuation of domestic animals—especially pets—while being consistent with an “abolitionist” animal rights theory. Thus, I will try to show that if, all other things being equal, it is morally acceptable to have a child based on a selfish desire, then it is morally acceptable to have a pet for the same reason. Having a child does not lead to the same ethical issues as having a pet. I will show that, despite some constraints, a pet’s life can be perfectly enjoyable. Finally, I will show how the first argument can help us to think about the legal status of pets. (shrink)

A folk tune is brief enough to be readily grasped and remembered as a whole; it has an inner unity that makes it shapely to the ear and mind. As a temporal event, or succession of notes, it consists of a little tour through a sonic landscape; so that as we follow the course we recognize its topography; the setting forth, the approach to a turning point, a moment of heightened interest, a pause of retrospection or anticipation, a homecoming. It (...) falls naturally into related, self-defining stages of its whole extent, revealing balance, contrast, and decision. The balance normally relies on approximately the same number of stresses in corresponding phrases; the contrast usually on tonal sequence and management; the decision appears in cadential statement, and held, or repeating, notes, like signposts at an intersection or junction. Because the tune is seized as a whole, and because several parts have these mutual references, we gain already the suggestion of stanzas of a certain pattern and identical length. Since the phrasal cadences get their weight and meaning from their relative emphasis and relation to the tonic, they inherently prompt corresponding verbal emphases of rhyme or pause. By their perceptible division or separation they exert, moreover, a pressure on the verbal partner, so that the total syntactical and rhetorical structure is palpably affected, and restricted, by their influence. The globalizations of capital markets in the last 20 years has led to a historic degree of financial integration in the world. It is clear, however, that globalization is not conducive to a complete homogeneity of financial markets and institutions. Among others, one element of diversity is the importance of the impact of corruption in emerging countries. Corruption decreases the credibility of financial institutions and markets. Scandals and unethical behavior in financial institutions erode confidence in such firms. Relying on neoinstitutional (...) literature, this article focuses on the link between corruption and organizational isomorphism in financial institutions in emerging countries. Therefore, our aim is to examine the institutional reasons for corruption in financial institutions in emerging countries. Our structural equation model is based on empirical research in financial institutions in emerging countries. A questionnaire was administrated to 70 top executives of financial institutions in 18 different emerging countries. (shrink)

The ancient, interlinked questions about the role of chance in the living world and the origins of life, gained new relevance with the development of molecular biology in the twentieth century. In 1970, French molecular biologist Jacques Monod, joint winner of the 1965 Nobel Prize in Physiology or Medicine, devoted a popular book on modern biology and its philosophical implications to these questions, which was quickly translated into English as _Chance and Necessity_. Nine years later, Belgian thermodynamicist Ilya Prigogine, 1977 (...) winner of the Nobel Prize in Chemistry, published a popular book on the history and philosophy of natural sciences with Belgian philosopher Isabelle Stengers. Translated into English under the title _Order out of Chaos_ and widely discussed, the whole book can be seen as a response to Monod on these biological and philosophical questions. This study will trace this intellectual controversy between two Nobel Prize winners defending two opposing scientific and philosophical visions of the living world, rooted in two different scientific disciplines. Alexander Bird has a two-part argument to the effect that God could only have created a world without physical evil by changing either the laws or the initial conditions of the universe, and that no such world would be at all like ours: so God is not responsible for physical evil. I argue that both parts of his argument fail.
