This article sets out a framework for distinguishing three kinds of norms governing past sexual (mis)conduct and our responses to it: wrongfulness norms, excusability norms, and accountability norms. The framework provides conceptual tools for making sense of (and understanding the limits of) three distinct responses commonly offered by those accused of past sexual misconduct: “But that used to be okay!” “But everybody used to think that was okay!” and “But that was so long ago!”.

This is an introduction to a special number of Midwest Studies discussing the 2008 global financial crisis and the ethical issues it raised. The immediate origins of the crisis are discussed, as are some of the exotic financial instruments involved, and some of the strategies for valuing and trading these instruments. This is necessary background for attributions of moral responsibility and blame to both individuals and institutions in the American financial system and its counterparts elsewhere in the developed world.

Morality can help guide behavior and facilitate relationships. Although moral judgments by autistic people are similar to neurotypical individuals, many researchers argue that subtle differences signify deficits in autistic individuals. Moral foundation theory describes moral judgments in terms of differences rather than deficits. The current research, aimed at assessing autistic individuals’ moral inclinations using Haidt’s framework, was co-designed with autistic community members. Our aim was to describe autistic moral thinking from a strengths-based perspective while acknowledging differences that may pose interpersonal (...) challenges among autistic youth. We assessed 25 autistic and 23 neurotypical children’s moral judgments using the Moral Foundations Questionnaire for Kids. We used semi-structured interviews and qualitative analysis with a subset of participants to describe children’s moral reasoning. Analyses suggested that autistic and neurotypical children make similar judgments about moral transgressions across all five moral foundations. General linear mixed modeling showed that the greatest predictor of recommending punishment was how bad children deemed moral transgressions to be. We also found a trend that autistic children were more likely to recommend punishment for harmless norms violations than were neurotypical children. Future research could use longitudinal methods to understand the development of moral judgments among autistic and neurotypical children. (shrink)

One of the core challenges presented by ascriptions of moral responsibility to corporations is to identify who or what is being held responsible. A significant source of controversy in attempts to answer this challenge is whether or not responsibility can fall on a ‘corporate entity’ distinct from the individuals that make it up. In this article I argue that both sides of this debate have incorrectly assumed that the possession of moral agency is a necessary condition for holding moral responsibility. (...) I go on to argue that it is sufficient for a corporate entity to be a ‘morally significant system’, that is a non-agential system created by moral agents, and I develop an account of such systems. I conclude by setting out the implications of this analysis for our practices of holding corporations morally responsible. (shrink)

In 'Law as a Leap of Faith' Gardner's analogy of faith in law to faith in God may seem outlandish. But consider the implications of the positions Gardner's jurisprudential views assemble: law can give us reason to do what we would otherwise not have reason to do - in fact it can give us reason to do what would otherwise be immoral. This is the implication of a commitment to law's capacity to give exclusive reasons, on one hand, together with (...) the commitment, on the other, that any given law is valid because of its sources and not its moral merits. In his final lectures and writings, Fichte continued to assert that his philosophy opened up a new word, one that he still associated with Kantian thought, although the horizon of his thinking had changed since 1801. The essay reveals this second horizon, on which Fichte worked until the end of his life. It asserts the reality of an absolute being and the ideality of the world representing the outer appearance or the existence of an absolute being, a world that is (...) nothing more than knowledge, seeing, an image of being and the images that form life. With this theory Fichte takes an original position in the history of Western philosophy.In seinen letzten Vorlesungen und Schriften behauptet Fichte weiterhin, dass seine Philosophie eine neue Welt eröffnet, die er immer noch mit dem kantischen Denken in Verbindung setzt, obwohl sich sein Denkhorizont seit 1801 verändert hatte. A conventional wisdom about the progress of physics holds that successive theories wholly encompass the domains of their predecessors through a process that is often called reduction. While certain influential accounts of inter-theory reduction in physics take reduction to require a single "global" derivation of one theory's laws from those of another, I show that global reductions are not available in all cases where the conventional wisdom requires reduction to hold. However, I argue that a weaker "local" form of reduction, (...) which defines reduction between theories in terms of a more fundamental notion of reduction between models of a single fixed system, is available in such cases and moreover suffices to uphold the conventional wisdom. To illustrate the sort of fixed-system, inter-model reduction that grounds inter-theoretic reduction on this picture, I specialize to a particular class of cases in which both models are dynamical systems. I show that reduction in these cases is underwritten by a mathematical relationship that follows the broad prescriptions of Nagel/Schaffner reduction, and support this claim with several examples. Moreover, I show that this broadly Nagelian analysis of inter-model reduction encompasses several cases that are sometimes cited as instances of the "physicist's" limit-based notion of reduction. The relationship whereby one physical theory encompasses the domain of empirical validity of another is widely known as “reduction.” Elsewhere I have argued that one influential methodology for showing that one physical theory reduces to another, associated with the so-called “Bronstein cube” of theories, rests on an oversimplified and excessively vague characterization of the mathematical relationship between theories that typically underpins reduction. I offer what I claim is a more precise characterization of this relationship, which here is based on a (...) more basic notion of reduction between distinct models of a single physical system. Reduction between two such models, I claim, rests on a particular type of approximation relationship between group actions over the models’ state spaces, characterized by a particular function between the model state spaces and a particular subset of the more encompassing model’s state space. Within this approach, I show formally in what sense and under what conditions reduction is transitive, so that reduction of a model 1 to another model 2 and reduction of model 2 to a third model 3 entails direct reduction of model 1 to model 3. Building on this analysis, I consider cases in which reduction of a model 1 to a model 3 may be effected via distinct intermediate models 2a and 2b, and motivate a set of formal consistency requirements between distinct “reduction paths” having the same models as their “end points”. These constraints are explicitly shown to hold in the reduction of a model of non-relativistic classical mechanics to a model of relativistic quantum mechanics, which may be effected by a composite reduction that proceeds either via a model of non-relativistic quantum mechanics or a model of relativistic classical mechanics. I offer some brief speculations as to whether and how this sort of consistency requirement might serve to constrain the reductions relating other theories and models, including the relationship that the Standard Model and general relativity must bear to any viable unification of these frameworks. Isaac Newton’s views on the mind–body relation are of interest not only because of their somewhat unique departure from popular early modern conceptions of mind and its relation to body, but also because of their connections with other aspects of Newton’s thought. In this paper I argue that (1) Newton accepted an interesting sort of mind–body monism, one which defies neat categorization, but which clearly departs from Cartesian substance dualism, and (2) Newton took the power by which we move our (...) bodies by thought alone to be a member of the family of forces that includes gravity and electricity. Time and again, Newton draws an analogy between the ultimate cause and nature of the volitional powers of mind and the ultimate cause and nature of these other forces. (shrink)

Since the 1980s Catholic moralists have discussed whether the use of condoms to prevent the transmission of the virus that causes AIDS is morally permissible. In 2004 Rev. Martin Rhonheimer argued that the use of condoms by HIV-discordant married couples, although not prudent or advisable, was nevertheless not intrinsically wrong. Many other Catholic moralists strongly disagreed with him. This paper analyzes both sides of the argument and concludes that the practice is not morally permissible even for an infertile married couple (...) because the use of a non-perforated condom, by preventing male ejaculation into the vagina, deprives the act of its essential ordination to procreation. I distinguish two types of reduction within the context of quantum-classical relations, which I designate “formal” and “empirical”. Formal reduction holds or fails to hold solely by virtue of the mathematical relationship between two theories; it is therefore a two-place, a priori relation between theories. Empirical reduction requires one theory to encompass the range of physical behaviors that are well-modeled in another theory; in a certain sense, it is a three-place, a posteriori relation connecting the theories and the domain of (...) physical reality that both serve to describe. Focusing on the relationship between classical and quantum mechanics, I argue that while certain formal results concerning singular \ limits have been taken to preclude the possibility of reduction between these theories, such results at most provide support for the claim that singular limits block reduction in the formal sense; little if any reason has been given for thinking that they block reduction in the empirical sense. I then briefly outline a strategy for empirical reduction that is suggested by work on decoherence theory, arguing that this sort of account remains a fully viable route to the empirical reduction of classical to quantum mechanics and is unaffected by such singular limits. Integrative social contracts theory (ISCT) has been an influential theory in normative business ethics for well over a decade, drawing attention both as an object of criticism and as a source of inspiration. In this paper I argue that, despite this attention, the fact that it is a genuinely pluralistic theory, in the tradition of pluralistic theories of political philosophy, is often overlooked. It is in the notion of moral free space that this pluralism is most clearly expressed. This oversight (...) is unfortunate for two reasons. Firstly, it prevents the potential of ISCT, as a normative theory of business ethics, from being appreciated fully; secondly, it leads us to ignore resources that could help tackle its most problematic flaws. In this second respect, I show how some of these flaws could be addressed by paying closer attention to the similarities between ISCT and John Rawls' theory of Political Liberalism. (shrink)

In whose voice does the criminal law speak, and why does it matter? Miriam Gur-Arye argues that the answer to the first question depends on the kind of duty violated by the crime at issue. In some cases (say, election fraud or tax evasion), the criminal law speaks in the voice of the polity—but in other cases (say, murder or rape), it speaks in the voice of human beings. Or so argues Gur-Ayre. Not surprisingly, perhaps, a lot depends on what (...) one means by the voice of the criminal law. In this paper, I defend two related arguments. First, the criminal law typically claims to speak in the voice of the polity, even if, in practice, it often fails to do so. Second, where the criminal law does speak in the voice of the polity, its doing so can contribute to its own justification. (shrink)

The requirement of naturalness has long served as an influential constraint on model-building in theoretical particle physics. Yet there are many ways of understanding what, precisely, this requirement amounts to, from restrictions on the amount of fine-tuning that a model can exhibit, to prohibitions on sensitive dependence between physics at different scales, to the requirement that dimensionless parameters defining the Lagrangian of a theory all be of order one unless they are protected by a symmetry. This workshop aims to clarify (...) the relationships among these concepts of naturalness and their connection to the hierarchy problem, as well as to assess arguments for and against imposing various forms of naturalness as a requirement on particle physics model-building. In recent years, Swedish women belonging to a post-migrant generation have made their voices against racism and social inequality prominent within public debate. Engaging in segregated and economically deprived suburbs, these women make use of art in order to counter stereotypical narratives of themselves and their communities. Based on interviews from two research projects, Accessing Utopia and Gendered Islamophobia in Sweden, this article aims to understand the complexities in using art to protest racist structures and stereotypes. In what ways are (...) the young women making room for their own creative expressions in Swedish society, while countering processes of othering? How does the work of representation affect them? What meaning do the women give to the platforms and networks they have been involved in? This article shows that the women’s early experiences of othering and meeting likeminded youths play a central role in order to either enter or create collective platforms where they can creatively engage in expressing their subjectivities and counter society’s controlling images. Projects and platforms such as Revolution Poetry and Swedish hijabis provided collective self-care through support and confidence building among youths from marginalized communities. These platforms can be seen as an artistic homeplace for the interlocutors. The article also shows that the work of representation is sometimes felt as limiting. The activism the women engage in is a deeply personal struggle for self-valuation and seeking ways to live a life on one’s own terms. (shrink)

Gorsevski situates her study of nonviolent rhetoric less within its humanistic and religious inheritance, drawing instead on a contrast with existing models of rhetoric. As a strategy for rhetorical and political action, Gorsevski takes nonviolence to be instructive of new ways to reconfigure both rhetorical studies and social movement strategy.It is important to note that Gorsevski's need to study peaceful means of relating to others is driven as much by a love of rhetorical theory as by a passion for translating an understanding of nonviolent rhetoric into strategies for activists. As such, this book provides a solid introduction to rhetorical theory, including an appendix on the connection between rhetoric and nonviolence that details what activists have to gain from each. In addition, instructors will find useful a chapter on the specifics of incorporating nonviolence into speech communication classrooms.Peaceful Persuasion's greatest contribution to rhetorical studies is the careful drawing out of the many ways that a rhetorical take on nonviolence has become increasingly necessary. To make this solid case, Gorsevski draws on four very diverse case studies of nonviolent rhetoric. In a move that is both surprising and refreshing, Gorsevski's case studies do more than provide exemplars of how critics may read nonviolence as a powerful rhetorical strategy; each helps to further delineate the key characteristics of what has been, until now, a relatively undefined area of rhetorical action.Gorsevski's gift to her readers is the ability to demonstrate the rich subtleties of nonviolence through very different contexts. The case studies [End Page 89] draw from such different sources that at first seem disorienting. Upon reflection, it becomes clearer that they greatly complicate our notions of nonviolence, redressing the disservices of previous bleary analyses that configured nonviolence only by its lack of violence rather than according to its fruitful range of seemingly contradictory strategies. The cavernous distances each study crosses illuminate the multiplicity of forms, meanings, and strategies that nonviolence may take. As such, any definition of nonviolence that I may provide in this short review does a serious disservice to the depth that Gorsevski creates through her sometimes disjointed case studies.The case studies serve at least dual purposes, as each provides an analysis that extends our understandings of nonviolence in action as it also offers instructive mini-lessons for the further development of rhetorical studies. In the first case study, Gorsevski provides a contextualized analysis of critics' interpretations of the film The Spitfire Grill, which she shows to be reflective of the "predominantly accepting orientation that rhetoric and film critics hold for the idea that humans are characterized by "innate aggression" and violence" (68). For Gorsevski, this study demonstrates that nonviolence as a lens can be applied to a range of texts just as well as any other approach to rhetoric. Gorsevski moves her analysis of nonviolent rhetoric into the geopolitical realm for her study of President of Macedonia Kiro Gligorov's historic first speech before the United Nations. She takes his speech as evidence of the usefulness of pragmatic nonviolence, which entails "noncooperation or defiance of political adversaries in order to decry a perceived injustice" (72). Gligorov's speech illustrates that nonviolence and violence are best seen less as equivalent than, rather, as operating on a sliding scale. The idea that ‘business ethics’ picks out a distinct discipline within ethical theory is contentious; in particular, it is unclear why theoretical approaches to moral and political philosophy cannot satisfactorily address ethical concerns in the context of business activity, just as they can in the context of other human activities. In response, I argue that some features of the business environment require more focused analysis than currently available. This environment is characterised by the presence of large social groups – business (...) organisations – that are not political in nature, but yet wield considerable power and are the vehicles for complex forms of collective action. The most pressing ethical concern raised by such collective action is collective moral responsibility. I develop an account of collective responsibility that is tailored to business organisations and that combines a number of strands of moral thought – a desert-based account of moral responsibility that is of a kind with that typically applied to individual humans; a pluralistic account of how collective responsibility is generated that is rooted in irreducible group-level properties; and a moderate approach to social ontology that sees nothing mysterious in ‘distinct’ collective entities. From this starting point I develop two detailed models that illustrate how business organisations can constitute distinct collective entities that may be held morally responsible. The first shows how such organisations may satisfy the conditions required to hold moral agency, which is typically assumed to be a prerequisite for moral responsibility. The second breaks with this tradition and argues for the possibility of ‘non-agential’ moral responsibility in cases where complex organisational structures mediate the actions of the moral agents that populate them. I conclude by showing how this distinct organisational-level responsibility, far from insulating organisation members from personal culpability, illustrates quite distinct standards against which such individuals may be judged. This article introduces a critical commentary to Hannah Arendt’s interpretation of Kant in her Lectures on Kant’s Political Philosophy. The author follows the scheme of what Arendt considers the three Kantian human perspectives: man as a rational being, man as an animal species, and man as a synthesis of the rational and the sensitive. Arendt’s research focuses on the contribution that the Kantian theory of the reflexive judgment can bring to a political theory, following the distinction between actor and spectator.

This book provides the first serious, sustained philosophical investigation of the criminal prosecution of domestic violence. It provides a theoretical framework for understanding ongoing debates regarding the criminal justice system's response to domestic violence.

This paper considers the so-called explanatory gap between brain activity and conscious experience. A number of different, though closely related, explanatory gaps are distinguished and a monistic account of conscious experience, a version of Herbert Feigl’s “twofold-access theory,” is advocated as a solution to the problems they are taken to pose for physicalist accounts of mind. Although twofold-access theory is a version of the mind-body identity thesis, it in no way “eliminates” conscious experience; rather, it provides a parsimonious and explanatorily (...) fruitful theory of the consciousness-body relation which faithfully preserves the nature of conscious experience while going quite far in “bridging” the various explanatory gaps distinguished below. This article provides a comparative analysis of various methodologies employed in building arguments regarding prostitution law and policy, and reflects on the proper aims of legal philosophy more generally. Taking Peter de Marneffe’s Liberalism and Prostitution (OUP 2010 ) as a launching point for these reflections, the article offers a mostly favourable review of the book as a whole, and defends the philosophical method as one (amongst other) valuable ways to argue about prostitution.

I show explicitly how concerns about wave function collapse and ontology can be decoupled from the bulk of technical analysis necessary to recover localized, approximately Newtonian trajectories from quantum theory. In doing so, I demonstrate that the account of classical behavior provided by decoherence theory can be straightforwardly tailored to give accounts of classical behavior on multiple interpretations of quantum theory, including the Everett, de Broglie-Bohm and GRW interpretations. I further show that this interpretation-neutral, decoherence-based account conforms to a general (...) view of inter-theoretic reduction in physics that I have elaborated elsewhere, which differs from the oversimplified and often ambiguous picture that treats reduction simply as a matter of taking limits. This interpretation-neutral account rests on a general three-pronged strategy for reduction between quantum and classical theories that combines decoherence, an appropriate form of Ehrenfest's Theorem, and a decoherence-compatible mechanism for collapse. It also incorporates a novel argument as to why branch-relative trajectories should be approximately Newtonian, which is based on a little-discussed extension of Ehrenfest's Theorem to open systems, rather than on the more commonly cited but less germane closed-systems version. In the Conclusion, I briefly suggest how the strategy for quantum-classical reduction described here might be extended to reduction between other classical and quantum theories, including classical and quantum field theory and classical and quantum gravity. The global financial crisis that began in 2007 concentrated attention on the morality of banking and financial activities. Just as mainstream businesses became increasingly defined by their financial performance, banks, it seemed, got themselves - and everyone else - into trouble through an over-emphasis on themselves as commercial enterprises that need pay little attention to traditional banking virtues or ethics. While the GFC had many causes, criticism was legitimately levelled at banks over the ethics of mortgage creation, excessive securitisation, executive (...) remuneration, and high-pressure customer sales tactics, amongst other things. These criticisms mirror those that have been levelled at the business more generally, particular in the last decade, although the backdrop provided by the GFC is more dramatic, and the outcomes of supposed wrongdoing more severe. This book focuses on business ethics after the GFC; not on the crisis itself, but how we should respond to it. The GFC has focused minds on the proper role of ethics in the understanding and conduct of business activity, but it is essential to look beyond the crisis to address the deeper challenges that it highlights. The aim of this volume is to present examples of the latest philosophically-informed thinking across a range of ethical issues that relate to business activity, using the banks and the GFC - the consequences of which continue to reverberate - as a point of departure. The book will be of great value to researchers, academics, practitioners, and students interested in business, ethics in general, and business ethics in particular. (shrink)

A recently popular formulation of the Higgs naturalness principle prohibits delicate cancellations between running renormalized Higgs mass parameters and EFT matching corrections, by contrast with the principle’s original formulation, which prohibits delicate cancellations between the bare Higgs mass parameter and its quantum corrections. While the need for this latter cancellation is sometimes viewed as unproblematic since bare parameters are thought by some to be divergent and unphysical, renormalized parameters are finite and measurable, and the need for delicate cancellations between the (...) renormalized Higgs mass parameter and EFT matching corrections is therefore considered by some to constitute a more salient formulation of the Higgs naturalness problem. Here, we argue that to the contrary, the need for fine tuning of the renormalized Higgs mass parameter is an eliminable, unphysical artifact of renormalization scheme, and that this severely weakens the grounds for regarding it as a problematic instance of fine tuning. In doing so, we highlight what we take to be a number of important conceptual lessons about the physical interpretation of model parameters in QFT. (shrink)

The strong embodied mind thesis holds that the particular details of one’s embodiment shape the phenomenological and cognitive nature of one’s mind. On the face of it, this is an attractive thesis. Yet strong embodiment faces a number of challenges. In particular, there are three prominent misconceptions about the scope and nature of strong embodiment: 1) that it violates the supposed multiple realizability of mentality; 2) that it cannot accommodate mental representation; and 3) that it is inconsistent with the extended (...) mind thesis according to which mentality extends, not only beyond brain, but beyond body as well. In this paper, we seek to dispel these three misconceptions by explaining what strong embodiment does and does not entail. (shrink)

In 1973, Nickles identified two senses in which the term `reduction' is used to describe the relationship between physical theories: namely, the sense based on Nagel's seminal account of reduction in the sciences, and the sense that seeks to extract one physical theory as a mathematical limit of another. These two approaches have since been the focus of most literature on the subject, as evidenced by recent work of Batterman and Butterfield, among others. In this paper, I discuss a third (...) sense in which one physical theory may be said to reduce to another. This approach, which I call `dynamical systems reduction,' concerns the reduction of individual models of physical theories rather than the wholesale reduction of entire theories, and specifically reduction between models that can be formulated as dynamical systems. DS reduction is based on the requirement that there exist a function from the state space of the low-level model to that of the high-level model that satisfies certain general constraints and thereby serves to identify quantities in the low-level model that mimic the behavior of those in the high-level model - but typically only when restricted to a certain domain of parameters and states within the low-level model. I discuss the relationship of this account of reduction to the Nagelian and limit-based accounts, arguing that it is distinct from both but exhibits strong parallels with a particular version of Nagelian reduction, and that the domain restrictions employed by the DS approach may, but need not, be specified in a manner characteristic of the limit-based approach. Finally, I consider some limitations of the account of reduction that I propose and suggest ways in which it might be generalised. I offer a simple, idealised example to illustrate application of this approach; a series of more realistic case studies of DS reduction is presented in another paper. (shrink)
