Large Language Models (LLMs) could be a useful tool for lawyers. However, empirical research on their effectiveness in conducting legal tasks is scant. We study securities cases involving cryptocurrencies as one of numerous contexts where AI could support the legal process, studying GPT-3.5’s legal reasoning and ChatGPT’s legal drafting capabilities. We examine whether a) GPT-3.5 can accurately determine which laws are potentially being violated from a fact pattern, and b) whether there is a difference in juror decision-making based on complaints (...) written by a lawyer compared to ChatGPT. We feed fact patterns from real-life cases to GPT-3.5 and evaluate its ability to determine correct potential violations from the scenario and exclude spurious violations. Second, we had mock jurors assess complaints written by ChatGPT and lawyers. GPT-3.5’s legal reasoning skills proved weak, though we expect improvement in future models, particularly given the violations it suggested tended to be correct (it merely missed additional, correct violations). ChatGPT performed better at legal drafting, and jurors’ decisions were not statistically significantly associated with the author of the document upon which they based their decisions. Because GPT-3.5 cannot satisfactorily conduct legal reasoning tasks, it would be unlikely to be able to help lawyers in a meaningful way at this stage. However, ChatGPT’s drafting skills (though, perhaps, still inferior to lawyers) could assist lawyers in providing legal services. Our research is the first to systematically study an LLM’s legal drafting and reasoning capabilities in litigation, as well as in securities law and cryptocurrency-related misconduct. (shrink)

Edward Harold Fulcher Swain (1883?1970) developed a unique idea about the importance of forests, advocating the creation of a new society based upon forests, and he pursued policies to implement his unique vision of forestry when he served as the Director of Queensland's Forestry Board from 1918 to 1924 and the Forestry Commissioner for New South Wales from 1935 to 1948. Swain's beliefs developed out of a combination of his Australian experiences and connections with foresters in the British Empire and (...) America. When he could not convince Australian elites about the need to create a forest-based society, he asked foresters at the 1947 Empire Forestry Conference in London to assert the primacy of forestry in land management in the British Empire. Many foresters positively received parts of Swain's argument, but his ideas could never be fully implemented in the British Empire because of the dominance of agrarian doctrines of development in post-Second World War colonial planning and the rapid process of decolonization. Swain's life sheds light onto current debates among historians about the origin and legacy of forestry in Australia and the British Empire. His ideas, many that parallel the basic tenets of modern environmentalism, require historians to rethink the relationship between Empire forestry and environmentalism. (shrink)

This thousand-page book contains one third of the text of Samuel Pepys's diary, along with maps, a chronology, a glossary of archaic words, and an unusually helpful index, The diary, written in commercial short-hand, spans the 1660s, a decade in which power passed from the Roundheads to Charles II, London was ravaged by plague and then by fire, the English repeatedly fought the Dutch, and Pepys grew to be one of the most important civil servants in the land ("the father (...) of the English Navy", according to some). The diary, which I know only in this abridged version, has given me more sheer pleasure than any other book I have ever read. Writing for himself alone, Pepys had no sense of posterity looking over his shoulder with judgments about public, historic importance. He selected things for inclusion in the diary purely on the basis of how they struck him. This grand subjectivity would be fatal in a dull or passive or insensitive writer, but in Pepys it makes the work fresh and vibrant, constantly surprising, unlike anything else in literature. Even when describing an "important" scene, he is still his natural self and gives touches of his own behaviour, like this at the King's coronation: But so great a noise, that I could make but little of the Musique; and endeed, it was lost to everybody. But I had so great a list to pissse, that I went out a little while before the King had done all his ceremonies.... Not just his behavior, but also his reactions. (shrink)

The massive expansion of information from the seventeenth century placed considerable demands on mental capacity, and individual scholars responded with strategies of memory training and note?taking that prompted, relieved or replaced memory. It has been acknowledged how cowpox inoculation (vaccination) and smallpox inoculation (variolation) stimulated new forms of record keeping and the standardization and tabulation of medical data for scientific analysis and to inform public policy. Yet the key figure in these developments, Edward Jenner, while a careful observer who thought (...) hard about the patterns he discerned, did not take good notes either from his reading or of his observations. He depended a great deal on his memory, especially a remarkable visual memory, consolidating his recollections and refining his thinking more through conversation and familiar letters than careful note?taking and writing. It was rather in the work of the practitioners who took up Jenners? writings, including some laymen and women, that we find the keeping of records of their vaccinations, in order to provide patient records and to report the results to friends, colleagues and a wider public. Gordon Kaufmann's recent book, God the Problem, provokes reflection on the notion of the world os God's body. He is concerned to indicate the intelligibility in a secular age of discourse about God's transcendence. The thrust of his position is clearly toward the concept that the world is God's body, but he rejects abruptly any suggestion that this is acceptable. In the following pages I will look briefly at Kaufmann's own position, raise some questions about it, and propose Whiteheadian thought (...) as being more faithful to some of Kaufmann's intentions. The decades following the civil rights and decolonization movements of the sixties and seventies - termed the post-soul era - created new ways to understand the aesthetics of global racial representation. Daphne Lamothe shows that beginning around 1980 and continuing to the present day, Black literature, art, and music resisted the pull of singular and universal notions of racial identity. Developing the idea of 'Black aesthetic time' - a multipronged theoretical concept that analyzes the ways race and time collide (...) in the process of cultural production - she assesses Black fiction, poetry, and visual and musical texts by Paule Marshall, Zadie Smith, Tracy K. Smith, Dionne Brand, Toyin Ojih Odutola, and Stromae, among others. Lamothe asks how our understanding of Blackness might expand upon viewing racial representation without borders - or, to use her concept, from the permeable, supple place of Black aesthetic time. Lamothe purposefully focuses on texts told from the vantage point of immigrants, migrants, and city dwellers to conceptualize Blackness as a global phenomenon without assuming the universality or homogeneity of racialized experience. In this new way to analyze Black global art, Lamothe foregrounds migratory subjects poised on thresholds between not only old and new worlds, but old and new selves. (shrink)

Mental health-care clinicians report that they hold patients responsible for morally objectionable behaviour but at the same time consider blaming attitudes to be inappropriate. These practices present a conundrum for all Strawsonian theories of responsibility. In response to this conundrum, Pickard has proposed severing the Strawsonian connection between being responsible and being an appropriate target of blaming attitudes. In this article I will argue that her solution fails to explain the practices at stake and provide an alternative solution that uncovers (...) an under-theorized stance we take towards those whose abilities are underdeveloped or compromised. Background Genome scientists and Ethical, Legal, and Social Implications of genetics (ELSI) scholars commonly inhabit distinct research cultures – utilizing different research methods, asking different research questions, and valuing different types of knowledge. Collaborations between these two communities are frequently called for to enhance the ethical conduct of genomics research. Yet, little has been done to qualitatively compare genome scientists’ and ELSI scholars’ perspectives on collaborations with each other and the factors that may affect these collaborations.Methods 20 semi-structured interviews with (...) US-based genome scientists and ELSI scholars were conducted between June–September 2021. Interviews were analyzed using inductive thematic analysis.Results Genome scientists and ELSI scholars provided different understandings of the value and goals of their collaborations with each other. Genome scientists largely perceived ELSI expertise to be relevant for human subjects research; they described ELSI scholars as communicators who help the public and/or study participants better understand genomics research. In comparison, ELSI scholars viewed themselves as developing and implementing policies; they expressed frustration at how scientists can misunderstand their research methods or negatively perceive them. A combination of factors – both structural (e.g., criteria for promotion) and cultural (e.g., perceptions of what colleagues value and respect) – seemed to shape these diverging perspectives.Conclusion Academic institutions, funders, and researchers commonly call for collaborations between genome scientists and ELSI scholars, but under-consider how their different conceptual frameworks, research methods, goals, norms, and values, conjoin to affect such partnerships. Acknowledging, exploring, and addressing the complex interplay between these factors could help to more effectively facilitate collaborations between genome scientists and ELSI scholars. (shrink)

Global supply chains often distribute value inequitably among the Global North and South. This perpetuates poverty and contributes to indecent work in raw material-producing countries, thus creating challenges to sustainable development. For decades, corporate social responsibility, social entrepreneurship, and sustainable business model innovations have aimed to distribute value more equitably across global value chains, for instance via fair trade, alternative trade, and direct trade. This article examines a novel and hitherto understudied innovation for equitable value distribution in global supply chains: (...) “value chain profit sharing.” We draw on interview and archival data from two cases of social entrepreneurs working in the coffee sector to develop a generalized model. One of the model's key features is that the entrepreneur pays suppliers in multiple installments that reflect market conditions (as opposed to a single lump sum based on prediction). We show how this can increase value creation, appropriation, and equitable distribution. Although our research suggests that this model may be highly contingent on leaders' skills, resources, sense of place, and accountability to suppliers, we find no evidence that its applications are limited to specific countries or sectors. Our research further extends extant theory by showing how “value chain profit sharing” may relieve some of the tensions often associated with sustainable business models, including distributing value to suppliers while maintaining financial solvency; creating value while pursuing a social mission; providing benefits to suppliers without curtailing their market opportunities; responding to market conditions while maintaining commitments to suppliers; and scaling without diluting benefits. It thereby contributes to the literatures on sustainable business model innovations, equitable value distribution in global supply chains, novel application of revenue-sharing contracts, and innovative methods of profit sharing. It furthermore provides actionable guidance for social entrepreneurs, corporate social responsibility practitioners, and supplier cooperatives aiming to achieve more equitable value distribution and sustainable supply chains. We frequently speak of certain things or phenomena being built out of or based in others. Making Things Up concerns these relations, which connect more fundamental things to less fundamental things: Karen Bennett calls these 'building relations'. She aims to illuminate what it means to say that one thing is more fundamental than another.

In this paper I provide a forward-looking account of the difference between the responsibility of children and the responsibility of adults. I do so by means of criticizing agency-cultivation accounts of responsibility. According to these accounts, the justification for holding a person to a norm is the cultivation of their moral agency, and children are, just like adults, considered responsible to the extent that they can have their moral agency cultivated in this manner. Like many forward-looking accounts, these accounts claim (...) that the purpose of holding adults to norms is similar to the purpose of holding children to norms. I argue that the justifications for holding adults to norms are different because of the particular ways in which adults can be in moral disagreement with one another, and the consequences that this has. Moral disagreement is relevant to consequentialist accounts because it impacts on whether and how we can secure beneficial outcomes via holding someone to a norm. One of the upshots of this analysis is that the forward-looking justification for holding adults to norms is qualitatively different from how and why we should hold children to norms. (shrink)

We investigated the automaticity of implicit sequence learning by varying perceptual load in a pure perceptual sequence learning paradigm. Participants responded to the randomly changing identity of a target, while the irrelevant target location was structured. In Experiment 1, the target was presented under low or high perceptual load during training, whereas testing occurred without load. Unexpectedly, no sequence learning was observed. In Experiment 2, perceptual load was introduced during the test phase to determine whether load is required to express (...) perceptual knowledge. Learning itself was unaffected by visuospatial demands, but more learning was expressed under high load test conditions. In Experiment 3, we demonstrated that perceptual load is not required for the acquisition of perceptual sequence knowledge. These findings suggest that perceptual load does not mediate the perceptual sequence learning process itself, supporting the automaticity of implicit learning, but is mandatory for the expression of pure perceptual sequence knowledge. In this paper I ask what implicit attitudes tell us about our freedom. I analyze the relation between the literature on implicit attitudes and an important subcategory of theories of free will—self-disclosure accounts. If one is committed to such a theory, I suggest one may have to move to a more social conceptualization of the capacity for freedom. I will work out this argument in five sections. In the first section, I discuss the specific theories of free will that are (...) central to this paper. In the second section, I will show that implicit-bias research raises questions about people’s capacities to exercise free will. In the third section, I will consider how an individual may overcome these failures and argue that the individual ability for self-regulation is significantly limited. One could stop here and conclude that free will is a limited capacity. But I argue that this conclusion would be too hastily drawn. I will instead continue to ask what would be required for free will. By discussing how failures of free will are due to social structures and may be therefore repaired by changing social structures in section 4, I will arrive at an alternative conclusion about the capacity for free will in section 5. This article evaluates communicative approaches to responsibility within the Strawsonian tradition. These approaches consider reactive attitudes to be forms of moral address and consider responsiveness to moral address a condition on responsible agency. The article consists of a critical and a positive part. In the first part, I identify a risk for these theories. They often provide an overly narrow account of how we can communicate with others about perceived moral disregard. I argue that, when read this way, a conversational (...) approach has implausible implications and falls prey to a familiar objection to Strawsonian theory: it would incorporate social injustices inherent to our responsibility practices. In particular, it would affirm ableist attitudes towards autistic individuals, by exempting them as moral agents on the basis of irrelevant criteria. In the second part, I propose an inclusive reading of the communicative approach. This inclusive account steers clear of ableism towards autistic individuals and accommodates diversity. Although it is also derived from our practices and psychologies, it does not incorporate the biases and injustices that are part of those practices, and instead it provides us with a means to criticize them. That conditional, if-then reasoning does not emerge until 4–5 years has long been accepted. Here we show that children barely 3 years old can do conditional reasoning. All that was needed was a superficial change to the stimuli: When color was a property of the shapes rather than of the background, 3-year-olds could succeed. Three-year-olds do not seem to use color to inform them which shape is correct unless color is a property of the shapes themselves. While CD requires integrating (...) color and shape information, the dimensional change card sort task requires keeping those dimension cognitively separate – inhibiting attention to one when sorting by the other. For DCCS, a superficial change to the stimuli that is the inverse of what helps on CD enables 3-year-olds to succeed when normally they do not until ∼4⁤12 years. As we and others have previously shown, 3-year-olds can succeed at DCCS when color is a property of the background, instead of a property of the stimulus. Our findings on CD and DCCS suggest that scaffolding preschoolers’ emerging conceptual skills by changing the way stimuli look enables 3-year-olds to demonstrate reasoning abilities long thought beyond their grasp. Evidently, children of 3 years have difficulty mentally separating dimensions of the same object and difficulty mentally integrating dimensions not part of the same object. Our present CD findings plus our earlier DCCS findings provide strong evidence against prominent cognitive complexity, conditional reasoning, and graded memory theories for why 3-year-olds fail these two tasks. The ways we have traditionally queried children may have obscured the budding reasoning competencies present at 3 years of age. (shrink)

There is now a general consensus amongst philosophers in the values in science literature that values necessarily play a role in core areas of scientific inquiry. We argue that attention should now be turned from debating the value-free ideal to delineating legitimate from illegitimate influences of values in science, a project we dub “The New Demarcation Problem.” First, we review past attempts to demarcate the uses of values and propose a categorization of the strategies by where they seek to draw (...) legitimacy from. Next, we propose a set of desiderata for what we take to be a satisfactory solution and present a case study where conflicting sets of values clearly impinge on science, but where the legitimacy of their influence is ambiguous. We use these desiderata and the case study to illustrate what we take to be the strengths and weaknesses of current strategies. To be clear, our goal is not to answer the question we pose, but to articulate a framework within which a solution can be judged. (shrink)

This chapter provides a review of the hypothesis that synesthetic-like perception is present in infants and toddlers. Infants and very young children exhibit evidence of functional hyperconnectivity between the senses, much of which is reminiscent of the cross-sensory associations observed in synaesthetic adults. As most of these cross-sensory correspondances cannot be easily explained by learning, it is likely that these represent natural associations between the senses. In average adults, these 'natural associations' are felt only intuitively rather than explicitly. These observations (...) have led to the proposal of the 'neonatal synaesthesia hypothesis', which purports that all individuals are born synaesthetic, with explicit conscious perception of these natural cross-modal associations dissipating over development in typical individuals. This dissipation is likely the result of experience-dependent synaptic pruning and/or inhibition of cross-sensory neural connections. At the same time, cross-modal associations matching those common in the environment might be assumed to be learned. This hypothesis is re-evaluated in light of recent research findings, and is examined in the context of current evolutionary models of neuronal recycling and emerging evidence of longitudinal changes in children with synaesthesia. This paper presents the NeoCrawler – a tailor-made webcrawler, which identifies and retrieves neologisms from the Internet and systematically monitors the use of detected neologisms on the web by means of weekly searches. It enables researchers to use the web as a corpus in order to investigate the dynamics of lexical innovation on a large-scale and systematic basis. The NeoCrawler represents an innovative web-mining tool which opens up new opportunities for linguists to tackle a number of unresolved and under-researched issues (...) in the field of lexical innovation. This paper presents the design as well as the most important characteristics of two modules, the Discoverer and the Observer, with regard to the usage-based study of lexical innovation and diffusion. Abstract: In this article, we explore what are ethical forms of holding service users responsible in mental health care contexts. Hanna Pickard has provided an account of how service users should be held responsible for morally wrong or seriously harmful conduct within contexts of mental health care, called the clinical stance. From a clinical stance one holds a person responsible for harm, but refrains from emotionally blaming the person and only considers the person responsible for this conduct in a detached (...) sense. Her account is based on what are considered best practices in the treatment of people with borderline personality disorder and addiction. We ask if this account generalizes across different diagnostic criteria and different clinical contexts. To begin to answer this question, we compare the clinical stance to an account of what are considered best practices in the treatment of service users at a specialized clinic for people with autism spectrum disorder in the Netherlands. We refer to this alternative account as the nurturing stance and highlight relevant similarities and differences between the clinical stance and the nurturing stance. We conclude with suggestions for further research and theorizing. (shrink)

Communication and cultivation accounts of responsibility argue that blaming has an important communicative and agency-cultivating function when addressed at someone we consider to be deserving of blame. On these accounts, responsible agents are agents who can understand negative reactive attitudes and are sensitive to their moral-agency cultivating function. In this paper I examine our reproachful engagements with agents whose moral agency is underdeveloped or compromised. I discuss how these engagements compare to blaming on CC accounts and argue reproachful engagements can (...) have an important communicative and agency-cultivating pointe. I then go on to propose an addition to CC-accounts that explains how underdeveloped and compromised agents can be held responsible. I will show how this addition resolves ambiguities in accounts from McKenna, Vargas and McGeer. I conclude the paper by anticipating an objection CC accounts could raise: that reproach and blame are co-extensive. (shrink)

How can we motivate ourselves to do what we think we ought? How can we deliberate about personal values and priorities? Bennett Helm argues that standard philosophical answers to these questions presuppose a sharp distinction between cognition and conation that undermines an adequate understanding of values and their connection to motivation and deliberation. Rejecting this distinction, Helm argues that emotions are fundamental to any account of value and motivation, and he develops a detailed alternative theory both of emotions, desires (...) and evaluative judgements and of their rational interconnections. The result is an innovative theory of practical rationality and of how we can control not only what we do but also what we value and who we are as persons. (shrink)
