This article argues that state government actors concerned about gun violence prevention should prioritize enactment of robust firearm purchaser regimes at the state level. First, the article outlines the empirical evidence base for purchaser licensing. Then, the article describes how state governments can design this policy. Next, the article assesses the likelihood that purchaser licensing legislation will continue to be upheld by federal courts. Finally, the article addresses the implications of this policy, aimed at curbing gun deaths, for equally important (...) racial justice priorities. Taken together, these various considerations indicate that purchaser licensing policies are among the most effective firearm-focused laws state governments can enact to reduce gun deaths within the existing federal legislative and legal frameworks. Much has been written about the fittingness, epistemic, and standing norms that govern blame. In this paper, we argue that there exists a norm of blame that has yet to receive philosophical discussion and without which an account of the ethics of blame will be incomplete: a norm proscribing comparatively arbitrary blame. By reflecting on the objectionableness of comparatively arbitrary blame, we stand to elucidate a substantive, and thus far overlooked, norm governing our attributions of responsibility. Hoping to expand upon public philosophy endeavors within higher education, the following captures the story behind the course Dialogue, Integration, and Action. The course has yielded a number of innovative pedagogical tools and engagement strategies likely to be of value to philosophy instructors seeking to explore a more participatory, experiential educational approach. As a transdisciplinary, community-engaged philosophy class, it engages students in the theories and practices of deliberative democracy and activism, encouraging the development of dialogic skills for their personal, professional, (...) and civic lives. By documenting the community-instructor-student collaborative design of the university course; the feminist pragmatist philosophic commitments underlying its design; the community-led and student-facilitated dialogue and the subsequent public report, as well as the impact of this work on the students, the community partner, and the instructor, the article highlights the benefits and the challenges of undergraduate philosophic engagement that emerges from and responds to place-based needs. Surgical expertise does not have a clear definition and is often culturally associated with power, authority, prestige, and case number rather than more objective proxies of excellence. Multiple models of expertise progression have been proposed including the Dreyfus model, however, they all currently require subjective evaluation of skill. Recently, efforts have been made to improve the ways in which surgical excellence is measured and expertise is defined using artificial intelligence, video recordings, and accelerometers. However, these aforementioned methods of assessment are (...) still subjective or indirect proxies of expertise, thus uncovering the neural mechanisms that differentiate expert surgeons from trainees may enhance the objectivity of surgical expertise validation. In fact, some researchers have already suggested that their neural imaging-based expertise classification methods outperform currently used methods of surgical skill certification such as the Fundamentals of Laparoscopic Surgery scores. Such imaging biomarkers would not only help better identify the highest performing surgeons, but could also improve residency programs by providing more objective, evidence-based feedback and developmental milestones for those in training and perhaps act as a marker of surgical potential in medical students. Despite the potential advantages of using neural imaging in the assessment of surgical expertise, this field of research remains in its infancy. This systematic review identifies studies that have applied neuromonitoring in assessing surgical skill across levels of expertise. The goals of this review are to identify the strongest neural indicators of surgical expertise, the limitations of the current literature on this subject, the most sensible future directions for further study. We found substantial evidence that surgical expertise can be delineated by differential activation and connectivity in the prefrontal cortex across multiple task and neuroimaging modalities. Specifically, novices tend to have greater PFC activation than experts under standard conditions in bimanual and decision-making tasks. However, under high temporal demand tasks, experts had increased PFC activation whereas novices had decreased PFC activation. Common limitations uncovered in this review were that task difficulty was often insufficient to delineate between residents and attending. Moreover, attending level involvement was also low in multiple studies which may also have contributed to this issue. Most studies did not analyze the ability of their neuromonitoring findings to accurately classify subjects by level of expertise. Finally, the predominance of fNIRS as the neuromonitoring modality limits our ability to uncover the neural correlates of surgical expertise in non-cortical brain regions. Future studies should first strive to address these limitations. In the longer term, longitudinal within-subjects design over the course of a residency or even a career will also advance the field. Although logistically arduous, such studies would likely be most beneficial in demonstrating effects of increasing surgical expertise on regional brain activation and inter-region connectivity. Background:The belief that we can control our thoughts is not inevitably adaptive, particularly when it fuels mental control activities that have ironic unintended consequences. The conviction that the mind can and should be controlled can prompt people to suppress unwanted thoughts, and so can set the stage for the intrusive return of those very thoughts. An important question is whether or not these beliefs about the control of thoughts can be reduced experimentally. One possibility is that behavioral experiments aimed at (...) revealing the ironic return of suppressed thoughts might create a lesson that could reduce unrealistic beliefs about the control of thoughts. Aims: The present research assessed the influence of the thought suppression demonstration on beliefs about the control of thoughts in a non-clinical sample, and among individuals with obsessive-compulsive disorder (OCD). Method: In Study 1, we assessed the effect of the thought suppression demonstration on beliefs about the control of thoughts among low and high obsessive individuals in the non-clinical population (N= 62). In Study 2, we conducted a similar study with individuals with OCD (N= 29). After 100+ years of studying syllogistic reasoning, what have we learned? Well, Riesterer and colleagues suggest that we have learned to throw away most of the data! The sad fact is that the conclusion of “No Valid Conclusion” (NVC) is one of the most frequently selected responses in syllogistic reasoning but these “majority data” have been ignored by most researchers. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

People with anorexia nervosa commonly exhibit social difficulties, which may be related to problems with understanding the perspectives of others, commonly known as Theory of Mind processing. However, there is a dearth of literature investigating the neural basis of these differences in ToM and at what age they emerge. This study aimed to test for differences in the neural correlates of ToM processes in young women with AN, and young women weight-restored from AN, as compared to healthy control participants. Based (...) on previous findings in AN, we hypothesized that young women with current or prior AN, as compared to HCs, would exhibit a reduced neural response in the medial prefrontal cortex, the inferior frontal gyrus, and the temporo-parietal junction whilst completing a ToM task. We recruited 73 young women with AN, 45 WR young women, and 70 young women without a history of AN to take part in the current study. Whilst undergoing a functional magnetic resonance imaging scan, participants completed the Frith-Happé task, which is a commonly used measure of ToM with demonstrated reliability and validity in adult populations. In this task, participants viewed the movements of triangles, which depicted either action movements, simple interactions, or complex social interactions. Viewing trials with more complex social interactions in the Frith-Happé task was associated with increased brain activation in regions including the right TPJ, the bilateral mPFC, the cerebellum, and the dorsolateral prefrontal cortex. There were no group differences in neural activation in response to the ToM contrast. Overall, these results suggest that the neural basis of spontaneous mentalizing is preserved in most young women with AN. (shrink)

We expect that consensus meetings, where researchers come together to discuss their theoretical viewpoints, prioritize the factors they agree are important to study, standardize their measures, and determine a smallest effect size of interest, will prove to be a more efficient solution to the lack of coordination and integration of claims in science than integrative experiments.

Supporting children to successfully transition from primary to secondary school is of utmost importance for several reasons, including to prevent future emotional and behavioural problems. Level Up is a novel, UK-based intervention consisting of five online group sessions, straddling the summer holidays, and providing at-risk children and their parents/carers with skills to manage their behaviour, emotions, and relationships to support their transition to secondary school. A prior evaluation of Level Up reported a need to better describe the mechanisms of change. (...) This study therefore evaluated the experiences of children and their parents/carers regarding the facilitators and barriers to engagement and change, and the perceived impact. Fourteen children and 17 parents/carers were interviewed. Identified barriers and facilitators were: (1) Having a safe, supportive, and fun space, (2) Learning through connection, (3) A family approach, (4) Problematic group dynamics, and (5) Connecting through video calls. Perceived impact was described as: (1) Empowering children, (2) Supporting children socially, (3) Supporting parents and carers in their parenting role, and (4) Supporting a successful transition to secondary school. Another theme (5) describes some families’ experiences of limited impact. These findings can be used to better understand how to support children in their school transition. (shrink)

Despite the frequency of stillbirths, the subsequent implications are overlooked and underappreciated. We present findings from comprehensive, systematic literature reviews, and new analyses of published and unpublished data, to establish the effect of stillbirth on parents, families, health-care providers, and societies worldwide. Data for direct costs of this event are sparse but suggest that a stillbirth needs more resources than a livebirth, both in the perinatal period and in additional surveillance during subsequent pregnancies. Indirect and intangible costs of stillbirth are (...) extensive and are usually met by families alone. This issue is particularly onerous for those with few resources. Negative effects, particularly on parental mental health, might be moderated by empathic attitudes of care providers and tailored interventions. The value of the baby, as well as the associated costs for parents, families, care providers, communities, and society, should be considered to prevent stillbirths and reduce associated morbidity. Cultural effects can influence the results of causal genetic analyses, such as Mendelian randomisation, but the potential influences of culture on genotype–phenotype associations are not currently well understood. Different genetic variants could be associated with different phenotypes in different populations, or culture could confound or influence the direction of the association between genotypes and phenotypes in different populations.

Interpersonal sensitivity, particularly threat of potential exclusion, is a critical condition in borderline personality disorder (BPD) which impairs patients’ social adjustment. Current evidence-based treatments include group components, such as mentalization-based group therapy (MBT-G), in order to improve interpersonal functioning. These treatments additionally focus on the therapeutic alliance since it was discovered to be a robust predictor of treatment outcome. However, alliance is a multidimensional factor of group therapy, which includes the fellow patients, and may thus be negatively affected by the (...) exclusion-proneness of BPD patients. The aim of this pilot study was to examine the predictive value of threat of social exclusion for the therapeutic alliance in MBT-G. In the first part of the study, social exclusion was experimentally induced in 23 BPD inpatients and 28 healthy subjects using the Cyberball paradigm, a virtual ball tossing game. The evoked level of threat was measured with the Need-Threat Scale (NTS) which captures four dimensions of fundamental human needs, i. e. the need for belongingness, for self-esteem, for control, and for a meaningful existence. In the second part of the study, therapeutic alliance was measured on three dimensions, the therapists, the fellow patients and the group as a whole, using the Group-Questionnaire (GQ-D). BPD patients scored higher in their level of threat according to the NTS in both, the inclusion and the exclusion condition. The level of threat after exclusion predicted impairments of the therapeutic alliance in MBT-G. It was associated with more negative relationships, lower positive bonding and a lower positive working alliance with the fellow patients and lower positive bonding to the group as a whole whilst no negative prediction of the alliance to the therapists was found. Consequently, our translational study design has shown that Cyberball is an appropriate tool to use as an approach for clinical questions. We further conclude that exclusion-proneness in BPD is a critical feature with respect to alliance in group treatments. In order to neutralize BPD patients’ exclusion bias, therapists may be advised to provide an “inclusive stance”, especially in initial sessions. This edited collection enriches scholarship on Arendt by considering her contributions to and reflections on the history of thought. The chapters bring Arendt into new conversations with her contemporaries, as well as examining the themes of Arendt's writing in light of her engagement with philosophical and literary history.

The objective of Working Group 4 of the COST Action NET4Age-Friendly is to examine existing policies, advocacy, and funding opportunities and to build up relations with policy makers and funding organisations. Also, to synthesize and improve existing knowledge and models to develop from effective business and evaluation models, as well as to guarantee quality and education, proper dissemination and ensure the future of the Action. The Working Group further aims to enable capacity building to improve interdisciplinary participation, to promote knowledge (...) exchange and to foster a cross-European interdisciplinary research capacity, to improve cooperation and co-creation with cross-sectors stakeholders and to introduce and educate students SHAFE implementation and sustainability. To enable the achievement of the objectives of Working Group 4, the Leader of the Working Group, the Chair and Vice-Chair, in close cooperation with the Science Communication Coordinator, developed a template to map the current state of SHAFE policies, funding opportunities and networking in the COST member countries of the Action. On invitation, the Working Group lead received contributions from 37 countries, in a total of 85 Action members. The contributions provide an overview of the diversity of SHAFE policies and opportunities in Europe and beyond. These were not edited or revised and are a result of the main areas of expertise and knowledge of the contributors; thus, gaps in areas or content are possible and these shall be further explored in the following works and reports of this WG. But this preliminary mapping is of huge importance to proceed with the WG activities. In the following chapters, an introduction on the need of SHAFE policies is presented, followed by a summary of the main approaches to be pursued for the next period of work. The deliverable finishes with the opportunities of capacity building, networking and funding that will be relevant to undertake within the frame of Working Group 4 and the total COST Action. Este artículo analiza el carácter asistemático de Arendt y Foucault, el cual, lejos de denotar falta de rigurosidad, se erige en un modo particular de investigación que adopta la forma de un laboratorio de pensamiento en el que ambos son como “sismógrafos” que, al conjugar la reflexión filosófica junto con el análisis histórico, detectan, por una parte, el agotamiento de conceptos que de tanto ser usados por la tradición de la filosofía política entran en desuso y, por otra, captan puntos (...) frágiles tanto en nuestras costumbres nocivas como en nuestros hábitos de pensar, actuar y sentir. Para llevar a buen puerto lo anterior: primero se examinan dos prejuicios que pueden erigirse frente a Arendt y Foucault y que son fruto de los particulares estilos de investigación de estos autores. Luego, se abordan en tópicos separados tanto el estilo asistemático como el modo histórico, específico y contingente con el cual Arendt y Foucault acometen sus respectivas indagaciones, el cual se ve reflejado en la “separación y discriminación afinada” de conceptos y problemas abordados por ellos. Finalmente, se formula el asunto de la verdad en ambos, así como el singular modo en que lo enfrentan: en Arendt la verdad ligada a la responsabilidad personal y en Foucault articulada con la producción de subjetividad. As a political thinker nurtured in early 20th-century German, Hannah Arendt is most often identified with the Greek philosophical tradition. This article argues that the crisis in reality that threw her into politics also, though unacknowledgedly, threw her into ‘Jewish modes of thinking’ as an alternative source where she found the Greek tradition lacking. This claim is controversial, given Arendt’s vehement criticisms of any recourse to the absolute, or metaphysical truths in the realm of politics. Nevertheless, and consistent with (...) a number of early 20th-century Jewish thinkers (Rosenzweig, Levinas, Buber, Shestov) who explicitly identified the Hebrew God not as the metaphysical but as the condition of possibility for authentic freedom under conditions of finitude, one finds in Arendt a move towards an understanding of the seat of human freedom that sits far more comfortably in the Jerusalem than in the Athens tradition. Specifically, in her emphasis on natality and genuine futurity, one senses a strong resonance with the notion of pure creation in the Hebrew Bible, as one does, notably, in her insistence that forgiveness and promises (covenants) form the two pillars for human sociality. Throughout the history of Jewish thought, one consistently finds precisely this Arendtian struggle to represent a model of law that holds the tension between binding fidelity to promises, memory and the past, and an openness to futurity, to the infinity of interpretation that gives meaning to those promises. Closely resembling the midrashic tradition, Arendt’s political community of speech is one in which meaning is open ended and plural, allowing for the binding together that sustains a polity, while also opening up to the radically new of each new birth. Background:In Ontario, Canada, patients who lack decision-making capacity and have no family or friends to act as substitute decision-makers currently rely on the Office of the Public Guardian and Trustee to consent to long-term care (nursing home) placement, but they have no legal representative for other placement decisions.Objectives:We highlight the current gap in legislation for difficult transition cases involving unrepresented patients and provide a novel framework for who ought to assist with making these decisions and how these decisions ought to (...) be made.Research design:This paper considers models advanced by Volpe and Steinman with regard to who ought to make placement decisions for unrepresented patients, as well as current ethical models for analyzing how these decisions should be made.Participants and research context:We describe an anonymized healthcare transition case to illustrate the fact that there is no legally recognized decision-maker for placement destinations other than long-term care facilities and to show how this impacts all stakeholders.Ethical considerations:The case provided is an anonymized vignette representing a typical transition case involving an unrepresented patient.Findings:As a result of a gap in provincial legislation, healthcare providers usually determine the appropriate placement destination without a clear framework to guide the process and this can cause significant moral distress.Discussion:We argue for a team decision-making approach in the short term, and a legislative change in the long-term, to respect the patient voice, evaluate benefit and risk, enhance collaboration between healthcare providers and patients, and promote social justice. We believe that our approach, which draws upon the strengths of interprofessional teams, will be of interest to all who are concerned with the welfare and ethical treatment of the patients for whom they care.Conclusions:One of the main strengths of our recommendation is that it provides all members of the healthcare team (including nurses, social workers, therapists, and others) an increased opportunity to advocate on behalf of unrepresented patients. In this paper, I will attempt a defense of Hannah Arendt’s usage of the social/political distinction in her “Reflections on Little Rock,” demonstrating that not only is it tenable but also helpful. After distinguishing between her (in)famous distinction between the social and political spheres, I will use the notions of “power,” which is compatible with political freedom, and “force,” which is not, to analyze the strategy of governmentally enforced integration. What I hope to show is that althoughschools are of (...) the utmost political importance, governmental force cannot solve social prejudice, and it cannot legitimately be used outside of the sphere of establishing and protecting legal equality. I will further elucidate Arendt’s illustrative passage on how an integration effort might politically engage problems of exclusion and inequality in schools without having to resort to force to solve social problems and without reducing politics to instrumental administration. The article examines the writings of one of the most influential political philosophers, Hannah Arendt, and specifically focuses on her views regarding the distinction between the private and the public and the transformation of the public to the social by modernity. Arendt’s theory of human activity and critique of modernity are explored to critically evaluate the social contributions and implications of reproductive technologies especially where the use of such technologies is most dominant within Western societies. Focusing on empirical studies (...) on new reproductive technologies in Israel, it is argued, powerfully demonstrates Arendt’s theory, and broadens the perspectives through which society should evaluate these new technologies towards a more reflective understanding of its current laws and policies and their affect on women more generally. This paper examines the political significance of discursive activity in the private sphere in the thought of Hannah Arendt, Václav Havel, and Victor Klemperer. Against criticisms of Arendt which claim that she pays too much attention to the public sphere and consequently misses the importance of the private sphere in her analysis of political action, this paper highlights important insights in Arendt’s writing on family and friendship and the ability of these relationships to act as havens where discourse can (...) thrive. What emerges from the analysis is a rich agonistic discourse ethics. The paper employs the respective thought of Havel and Klemperer to highlight Arendt’s work on the political significance of private virtues for promoting an awareness of responsibility. Především pak nabízí interpretaci klíčového oddílu knihy, v němž spočívá vlastní jádro arendtovského návrhu „nové politické vědy“. Ústředním pro politický řád se ukazuje být rozdíl mezi pramenem moci a pramenem autority, která politickému řádu propůjčuje stabilitu. Příspěvek dokládá, že Arendtová v zakladatelském aktu politického společenství spatřuje dva „bludné kruhy“ – bludný kruh legitimity moci a bludný kruh legitimity zákonů. (...) Zatímco s prvním bludným kruhem si zdařilá americká revoluce věděla rady, druhý bludný kruh, který odkazuje k potřebě autority sankcionující pozitivní zákonodárství, ji uvedl do teoretických obtíží. Daniel Ciunajcis Marcin Moskalewicz Time-Space of History. Transcendental Conditions of Practicing History as PoliticsThe article deals with the issue of time-space in modern historiography, and the main thesis is that time-space is a transcendental condition of the possibility of the practice of history and that modern victory of time over space has various negative implications that are underscored and analyzed. In the first part of the article, the authors present classical asymmetric concepts – Greeks vs. Barbarians and Christians vs. (...) Pagans – as analyzed by Reinhardt Koselleck. In the second part of the article, the advent of a new Christian temporality is being examined via Karl Barth’s interpretation (as presented in his Dogmatics in Outline) of Pontius Pilate’s last judgment over Jesus Christ. In this context three aspects of temporality are being discerned: the horizon of expectation represented by Jesus Christ, the space of experience represented by the Jewish community and eternity represented by Pontius Pilate. Pilate is recognized as taking the place of God in the political order: himself an embodiment of state, a symbol of its transcendence, and a transcendental condition of possibility of modern political life. In the third part the authors defend the thesis that thinking is an embodied phenomenon. While applying and criticizing Hannah Arendt, they indicate that thinking should be taken as an original source of human temporality and as a condition of possibility of organizing external space. The authors emphasize Arendt’s conception of a metaphor as a bridge between the sensible and the supersensible, with due attention to both differences and similarities between thinking and acting. Next, the authors analyze some consequences of their thesis for storytelling and political history being organized today mostly according to mere chronological paradigm. In the fourth part of the article, the authors pay attention to spatial organization of politics, arguing against Karl Schlögel, who claims that in late modern times national historiography was responsible for the dominance of the spatial paradigm. The argument defended is that even in the case of seemingly spatial organization of politics and history – as for example in a map – the temporal order is playing a predominant, even if hidden, role, and that space is being analyzed and valued according to temporal criteria. The predominantly temporal dynamics of modernization and modern supremacy of the future – as presented in the Geschichtliche Grundbegriffe Lexicon by Bielefeld School – is interpreted as a sign of loss and a symptom of narrowing our image of history. This article seeks to illuminate the figure of the child in democratic politics by arguing that children play a constitutive role as temporary outsiders who present both renewal and risk to the demos. Using Hannah Arendt’s concept of natality, we begin with an ontological account of children as new individuals that are central to renewing democratic freedom and plurality. In the second section, we explore how children can be conceived in terms of political risk by focussing on Arendt’s debate (...) with Ralph Ellison concerning the desegregation of American schools in the 1960s. Their arguments about whether children should appear in politics underscores the constitutive role that child–adult relationships play in debates about the normative fabric of democratic society. Finally, we use the radical democratic theory of Chantal Mouffe to argue that children can be characterised as an excluded group of potential adversaries that appear in political contests over claims to represent the demos. From this perspective, the article reveals that children are central figures in democratic politics because they are constituents of an unknown future polity. (shrink)

While behaviourist psychology had proven its worth to the US military during the Second World War, the 1950s saw behaviourism increasingly associated with a Cold War discourse of ‘totalitarianism’. This article considers the argument made in Hannah Arendt’s The Origins of Totalitarianism on totalitarianism as a form of behaviourist control. By connecting Arendt’s Cold War anti-behaviourism both to its discursive antecedents in a Progressive-era critique of industrial labour, and to contemporaneous attacks on behaviourism, this paper aims to answer two (...) interlocking questions: Why was behaviourism overtaken by cognitivism as the dominant theoretical orientation of psychologists in the 1960s, and what role did the concept of language play in this shift? La presente exposición, tal como lo sugiere su título, se articulará en tres tiempos, debiendo aportar cada uno su propia luz a la noción de sentido común y así poner en evidencia su fertilidad. Se evocará en primer lugar la figura de Shaftesbury, a quien se puede considerar sobre este punto como un precursor de Kant, incluso si se hace con todas las reservas necesarias- ya que los marcos teóricos de sus respectivos pensamientos difieren considerablemente. En seguida, sin poder desarrollarlo (...) plenamente, nos esforzaremos por indicar el corazón de la noción de sentido común en la tercera Crítica de Kant, su alcance más significativo. Para concluir, se evocará una posibilidad de relectura política de este texto kantiano, relectura que se encuentra bajo la pluma de Hannah Arendt, quien rescata los rasgos más prometedores de esta noción de sentido común para el pensamiento contemporáneo. Com o escopo de revisitar a relação entre biopolítica e direitos humanos, as linhas que se seguem se dedicam ao diálogo que Giorgio Agamben estabelece com Hannah Arendt. The origens of totalitarianism e The human condition, publicados respectivamente em 1951 e 1958, e Homo sacer: il potere sovrano e la nuda vita e Mezzi senza fine: note sulla politica, publicados em 1995 e 1996, serão as referências mais proeminentes. O diálogo será, todavia, orientado pelo cortejo da ajuda humanitária. Devemos (...) levar a sério as hipóteses do filósofo italiano a esse respeito. Por um lado, o humanitário surge no nosso século purificado de todo comprometimento político, contribuindo para consolidar a compreensão da vida como mera vida, vida biológica, simples fato de ser vivente. Por outro lado, aferrando-se contraditoriamente na visão da “vida nua” como aquela desprovida de direitos, podemos observar que a ajuda humanitária substitui o reconhecimento, a atribuição e a garantia de direitos. A distribuição de cestas básicas e remédios adia sempre mais o gesto de reconhecimento da igualdade, a justa atribuição de direitos e a garantia de oportunidades para o exercício de direitos, levando-nos ao ponto de não mais evitar as suspeitas deque uma secreta solidariedade,celebrada entre os organismos internacionais de ajuda humanitária e as forças que deveriam combater, embala os sonhos contemporâneos. Recent thinking on human rights, at least among the left, has divided along lines that have become familiar from other contemporary political debates. There are those who ground the discourse of rights in an ethical responsibility to fellow human beings in situations of suffering and oppression; for others, suspicion with respect to just such an ethical stance is their point of departure. They see in the ethical perspective at best a radical depoliticization of the struggle for human rights—its biopolitical reduction (...) to humanitarian aid to suffering others who are thereby accorded the status of ‘bare life’—and at worst a cover for a quasi-imperialist imposition of neo-liberal values according to which what ultimately deserves political protection and preservation is the right to entrepreneurial initiative and aspiration. Yet another form of leftist critique of the ostensibly post-political, ethical inflection of rights discourse takes aim at a line of thought most often linked to a series of mostly French philosophers—above all Emmanuel Levinas, but also Jean-Francois Lyotard, Jacques Derrida, and more recently Judith Butler—who in various ways have sought to ground philosophy in an ‘ethics of the Other’. The essay explores these positions and proposes a new thinking about human rights oriented by what Hannah Arendt referred to as the ‘dark background’ of human life. (shrink)

As a political thinker nurtured in early 20th-century German, Hannah Arendt is most often identified with the Greek philosophical tradition. This article argues that the crisis in reality that threw her into politics also, though unacknowledgedly, threw her into ‘Jewish modes of thinking’ as an alternative source where she found the Greek tradition lacking. This claim is controversial, given Arendt’s vehement criticisms of any recourse to the absolute, or metaphysical truths in the realm of politics. Nevertheless, and consistent with (...) a number of early 20th-century Jewish thinkers who explicitly identified the Hebrew God not as the metaphysical but as the condition of possibility for authentic freedom under conditions of finitude, one finds in Arendt a move towards an understanding of the seat of human freedom that sits far more comfortably in the Jerusalem than in the Athens tradition. Specifically, in her emphasis on natality and genuine futurity, one senses a strong resonance with the notion of pure creation in the Hebrew Bible, as one does, notably, in her insistence that forgiveness and promises form the two pillars for human sociality. Throughout the history of Jewish thought, one consistently finds precisely this Arendtian struggle to represent a model of law that holds the tension between binding fidelity to promises, memory and the past, and an openness to futurity, to the infinity of interpretation that gives meaning to those promises. Closely resembling the midrashic tradition, Arendt’s political community of speech is one in which meaning is open ended and plural, allowing for the binding together that sustains a polity, while also opening up to the radically new of each new birth. Within contemporary debates on civil disobedience, Hannah Arendt’s work offers an alternative to both moral and legal approaches by offering a political view of disobedience based on what she terms a principle of dissent at the heart of constitutional democracies. In this sense, she separates disobedience from the moral claims of individual conscience as well as the restrictions imposed by legalistic conceptions. In this article, I first consider Arendt’s views on conscience and the arguments she makes for a Socratic (...) notion of conscience understood as a by-product of thinking, as well as her arguments against conscience-based versions of disobedience such as that developed by Kimberley Brownlee. Second, I consider Arendt’s defence of a political notion of disobedience and her arguments against legal approaches such as those advocated by John Rawls and William Scheuerman. (shrink)
