This review article analyses Tarunabh Khaitan’s attempt in his recent book, A Theory of Discrimination Law, to identify the central purpose and justification of discrimination law. Khaitan sets out to determine the key features of discrimination law through rigorous comparative analysis, and to locate a solid normative foundation for its provisions. He concludes that discrimination law is structured around an ‘obsession’ with combating group disadvantage, ie relative forms of disadvantage between different groups whose membership is defined by morally irrelevant or (...) valuable personal characteristics such as gender, race and disability. He goes on to make a strongly argued liberal case as to why discrimination law is justified in seeking to minimise the negative impact on individual liberty of group disadvantage. Certain aspects of his analysis fail to capture the full complexity of discrimination law and the moral concerns which underpin its functioning. However, in general, Khaitan’s arguments make an invaluable contribution to the diffuse theoretical literature on discrimination law, and are bound to become a major point of reference in conceptual debates about this highly significant area of law. Aim To examine the contribution of programme year and demographic factors to medical students’ perceptions of evidence-based classification categories of professional misconduct. Methods Students at an Irish medical school were administered a cross-sectional survey comprising 31 vignettes of professional misconduct, which mapped onto a 12-category classification system. Students scored each item using a 5-point Likert scale, where 1 represents the least severe form of misconduct and 5 the most severe. Results Of the 1012 eligible respondents, 561 students completed the survey, (...) providing a response rate of 55%. Items pertaining to disclosure of conflict of interest were ranked as the least severe examples of professional misconduct, and this perception was highest among finalyear students. While ratings of severity declined for items related to ‘inappropriate conduct not in relation to patient’ and ‘inappropriate use of social media’ between years 1 and 3, ratings for both categories increased again among clinical cycle students. Conclusions Increased clinical exposure during years 4 and 5 of the undergraduate programme was associated with better recognition of the importance of selected professional domains. Disclosure of conflict of interest is identified as an area of medical professionalism that requires greater emphasis for students who are at the point of transition from student to doctor. (shrink)

Thomas Kuhn had little to say about scientific change in biological science, and biologists are ambivalent about how applicable his framework is for their disciplines. We apply Kuhn’s account of paradigm change to evolutionary microbiology, where key Darwinian tenets are being challenged by two decades of findings from molecular phylogenetics. The chief culprit is lateral gene transfer, which undermines the role of vertical descent and the representation of evolutionary history as a tree of life. To assess Kuhn’s relevance to this (...) controversy, we add a social analysis of the scientists involved to the historical and philosophical debates. We conclude that while Kuhn’s account may capture aspects of the pattern of an episode of scientific change, he has little to say about how the process of generating new understandings is occurring in evolutionary microbiology. Once Kuhn’s application is limited to that of an initial investigative probe into how scientific problem-solving occurs, his disciplinary scope becomes broader. (shrink)

This study explores consumer expectations and attitudes related to gender-based price discrimination. Although much research has focused on pay inequalities and gender diversity, considerably less attention has been focused on situations in which men and women are charged different prices based on gender. In two studies, expectations and attitudes toward gender-based price discrimination are examined. In Study 1, two scenarios related to prices at hair salon and dry cleaning services were manipulated to measure expectations and attitudes toward gender-based price discrimination. (...) We found that the nature of the service results in expectations of price differences between men and women. We also found men expect gender-based pricing more than women. In Study 2, qualitative research was conducted to reveal the cognitions that men and women experience when exposed to gender-based price discrimination. (shrink)

Recent discoveries of geographical patterns in microbial distribution are undermining microbiology’s exclusively ecological explanations of biogeography and their fundamental assumption that ‘everything is everywhere: but the environment selects’. This statement was generally promulgated by Dutch microbiologist Martinus Wilhelm Beijerinck early in the twentieth century and specifically articulated in 1934 by his compatriot, Lourens G. M. Baas Becking. The persistence of this precept throughout twentieth-century microbiology raises a number of issues in relation to its formulation and widespread acceptance. This paper will (...) trace the conceptual history of Beijerinck’s claim that ‘everything is everywhere’ in relation to a more general account of its theoretical, experimental and institutional context. His principle also needs to be situated in relationship to plant and animal biogeography, which, this paper will argue, forms a continuum of thought with microbial biogeography. Finally, a brief overview of the contemporary microbiological research challenging ‘everything is everywhere’ reveals that philosophical issues from Beijerinck’s era of microbiology still provoke intense discussion in twenty-first century investigations of microbial biogeography. In this paper, I aim to clarify the role of ‘wonder’ in education. Most of us who work in education want to provide valuable experiences for our students, and we want them to be driven by intrinsic values such as truth and recognition of the dignity of human existence. However, whilst I echo many of the sentiments espoused by advocates of the utility and ethical significance of wonder, I contend that some recent developments—and in particular, Schinkel’s argument that ‘deep’ (‘contemplative’ (...) or ‘cosmic’) wonder has a ‘fundamental’ role in education—are misconceived. This is, I argue, because any concept deployable within educational spaces (whether formal or informal) must pay due regard to the conceptual constraints of the concept of ‘education’; that is, attention must be paid to the role of ‘learning’. Schinkel’s proposals are, I suggest, vulnerable to a critique of sentimentalism and excessive romanticism. As such, they offer little in terms of practical import for educators. As I will propose, if we are to take ‘wonder’ seriously in educational contexts, we must pay attention to the purpose of wonder as an epistemic emotion; namely, aiming for knowledge and understanding, and getting there requires sensitivity to practical know-how and conceptual competence. ISBN 978-3-7278-1728-3.The “magisterial development” of the title of this monograph consists of the (...) move from binding the efficacy of the Mass and sacraments exclusively to the Passion of Christ to the recognition of the efficacy and exemplarity of the Lord’s Resurrection as well. Langevin also traces the increasing recognition of the Mass and sacraments not only as empowered by but also as signifying the paschal mystery of Good Friday and Easter and memoralizing both.Part 1 is a long series of readings of strategically chosen texts from Pius XII’s Mediator Dei (1947), from the Second Vatican Council’s Sacrosanctum Concilium (1963), and from John Paul II’s Catechism of the Catholic Church (1997) on the Mass and sacraments and liturgy. These texts are very closely read, and the reading is a sort of model of how the inquiring theologian should approach magisterial sources. The first chapter of part 2 charts the soteriological effects of both the Passion and the Resurrection according as they are extended to us in baptism and the Eucharist. The second and last [End Page 467] chapter of part 2 does two things. First, it explains the motion charted in part 1 by adducing some of its historical causes. Second, it provides systematic insight into the term of the motion.Mediator Dei appreciates Christ especially as offering sacrifice and the Mass especially as the memorial and application of that sacrifice. As Christ’s sacrifice is an exercise of the virtue of religion, so also is our participation in that sacrifice: we render the debt of justice we owe God, and in the way exclusive to rendering a debt to God, by way of sacrifice. Salvation is configuration to Christ—to his Passion. However, while the very sacrifice of Christ is made present, it must be the risen Christ who acts now in the Mass, and communion is reception of the Body and Blood of the risen Christ, though the encyclical rather emphasizes that the signification of the Mass is the signification of the passion. Generally, “for Pius, the Passion is more important and active than the Resurrection in the sacramental economy.” The encyclical’s discussion of the liturgical year is more expansive, however, since the year renders all the mysteries and not just the Passion present and in their saving effects. The encyclical is thus open to a further reflection on the Resurrection that it itself does not take up.Sacrosanctum Concilium teaches that baptism gives us to participate in the entire paschal mystery. Its insistence that the Mass is principally to be understood in a sacrificial key follows Pius, but it is more open to seeing the Mass and the sacraments as also memorializing the Resurrection and bringing it to bear on our salvation. For one thing, it drops the framework according to which the liturgy is understood first and foremost as an exercise of the virtue of religion, which allows other aspects more easily to come to the fore. Thus the Mass and the sacraments are seen in relation to the entire paschal mystery, now appreciated in its unity, and not only to the meritorious work of the Passion and sacrifice of the Lord, for it is the entire paschal mystery that works salvation, going beyond the mode of merit that is exclusive to the Passion. Even in SC 47, the principal text on the Mass, which came to assert the sacrificial nature of the Mass at the insistence of many council fathers, there is an express connection of the Mass with the Resurrection such that the relation of the Mass to the entire paschal mystery comes to expression.
