We show that R.J. Thompson’s groupsFandTare bi-interpretable with the ring of the integers. From a result by A. Khélif, these groups are quasi-finitely axiomatizable and prime. So, the groupTprovides an example of a simple group which is quasi-finitely axiomatizable and prime. This answers questions posed by T. Altınel and A. Muranov in [2], and by A. Nies in [12].

Resumen La argumentación es una forma de discurso en la que un hablante defiende una postura en una discusión. El presente trabajo se enfoca en la complejidad argumentativa y los recursos evaluativos y evidenciales que caracterizan las disputas de niños de diverso nivel socioeconómico. Se analizaron 94 disputas entre niños de 4 años y otros niños (5 a 10 años) en situaciones de juego espontáneo registradas en hogares de sectores socioeconómicos medio y bajo. El análisis identificó diferencias marginales en la (...) complejidad argumentativa entre los grupos. Por su parte se hallaron diferencias significativas en recursos de evaluativos de emocionalidad y en los evidenciales deónticos y exclamativos a favor de los sectores de nivel socioeconómico bajo. Los sectores medios registraron un mayor empleo de expresiones de causalidad y conectores. Los resultados se discuten a la luz de los hallazgos de investigaciones previas. Abstract Argumentation is a type of discourse in which a speaker defends a claim in a discussion. The present work focuses on the argumentative complexity and the evaluative and evidential resources that characterize the disputes of children of different socioeconomic levels. We analyzed 94 disputes between 4-year-old children and other children (5 to 10 years old) in situations of spontaneous play registered in homes of middle and low socioeconomic status (SES). The analysis identified marginal differences in argumentative complexity between the groups. On the other hand, significant differences were found in evaluative expressions of emotion and in deontic and exclamatory evidential markers, more frequently used by the low SES group. The mid SES group tends to use a higher number of expressions of causality and connectors. The results are discussed with reference to the findings of previous research. (shrink)

Su principal objeción, como bien ya se deja ver en Ley y juicio, es que esta teoría se queda en la pura abstracción de los textos jurídicos y no toma en consideración los aspectos concretos de la realidad a la que las categorías normativas se deben aplicar Este trabajo pretende justificar que ya en estos textos tempranos el pensador alemán identifica que uno (...) de los principales problemas del positivismo jurídico radica en el hecho de que se construye sobre la base de una interpretación ontológica del ser humano que resulta inadecuada. En particular, argumentaremos que Schmitt aboga por una comprensión del fenómeno jurídico que se erija sobre la base de la consideración de la existencia humana concreta, lo que importa, a su vez, el reconocimiento de ciertas estructuras fundamentales y originarias que operan en todo conocimiento humano. ABSTRACT In his first legal texts, Schmitt repeatedly engages in criticizing what is known as “legal positivism”'. His main objection, as it is well seen in Law and Judgment, is that this theory remains in the pure abstraction of legal texts and does not take into account the concrete aspects of reality to which the normative categories should apply. This work aims to justify that in those first texts, the German thinker identifies that one of the main issues of legal positivism lies in the fact that it is built based on an inadequate ontological interpretation of the human being. In particular, we will argue that Schmitt defends an understanding of the legal phenomenon that is constructed based on the consideration of concrete human existence, which in turn means the recognition of certain fundamental and original structures that operate in all human knowledge. En particular, veremos que la especulación filosófica de esta naturaleza, en caso de ser realizada adecuadamente, aclara las condiciones de posibilidad de la unio mystica. A su vez, argumentaremos que el recto uso de la razón (...) trae a la luz los límites de esta facultad en el contexto de la experiencia de lo divino. El mapa de ruta que hemos trazado para la justificación de nuestra hipótesis es el siguiente: comenzaremos elucidando el concepto misticismo (1), para luego argumentar que la reflexión filosófico-trascendental tributa a esta tradición por medio de la elucidación, por vía racional y discursiva, de las condiciones de posibilidad de la unio mystica (2). Intellectual character education has been primarily expressed in terms of educating for intellectual virtues (EFIV). This aim of teaching intellectual virtues has received some challenges, such as how it fails to articulate adequate action guidance through exemplarist pedagogy, and how it neglects the pervasiveness of intellectual vice among students. To respond to these challenges, this paper considers the aim of educating against intellectual vices (EAIV) – teaching students not to develop intellectual vices or weakening those that they have already developed (...) – which comes with the emergence of vice epistemology. More specifically, I look at how negative epistemic exemplars can be used as a classroom strategy for EAIV, and demonstrate how this could address the aforementioned weaknesses of EFIV. (shrink)

In this philosophical paper, we explore computational and biological analogies to address the fine-tuning problem in cosmology. We first clarify what it means for physical constants or initial conditions to be fine-tuned. We review important distinctions such as the dimensionless and dimensional physical constants, and the classification of constants proposed by Lévy-Leblond. Then we explore how two great analogies, computational and biological, can give new insights into our problem. This paper includes a preliminary study to examine the two analogies. Importantly, (...) analogies are both useful and fundamental cognitive tools, but can also be misused or misinterpreted. The idea that our universe might be modelled as a computational entity is analysed, and we discuss the distinction between physical laws and initial conditions using algorithmic information theory. Presenting the challenges that face digital age citizens as philosophical, as opposed to technological, this paper explores the underpinning structure of digital civics through an overview of its four foundational pillars and their informing scholarship. Through this framework and the literature that supports it, a set of five key concepts are identified as a useful guide for developing digital civics initiatives, including policy and educational interventions. In closing, this work urges the further exploration of the conceptual underpinnings of digital civics (...) to improve future formulations of digital civics and digital citizenship endeavours. In this paper, we point out that explainability is useful but not sufficient to ensure the legitimacy of algorithmic decision systems. We argue that the key requirements for high-stakes decision systems should be justifiability and contestability. We highlight the conceptual differences between explanations and justifications, provide dual definitions of justifications and contestations, and suggest different ways to operationalize justifiability and contestability.

Philosophy lacks criteria to evaluate its philosophical theories. To fill this gap, this essay introduces nine criteria to compare worldviews, classified in three broad categories: objective criteria (objective consistency, scientificity, scope), subjective criteria (subjective consistency, personal utility, emotionality), and intersubjective criteria (intersubjective consistency, collective utility, narrativity). The essay first defines what a worldview is and exposes the heuristic used in the quest for criteria. After describing each criterion individually, it shows what happens when each of them is violated. From the (...) criteria, it derives assessment tests to compare and improve different worldviews. These include the is-ought, ought-act, and is-act first-order tests; the critical and dialectical second-order tests; the mixed-questions and first-second-order third-order tests; and the we-I, we-it, and it-I tests. The essay then applies these criteria and tests to a concrete example, comparing the Flying Spaghetti Monster deity with Intelligent Design. For another application, it draws more general fruitful suggestions for the dialogue between science and religion. (shrink)

Driven by the increasing availability and deployment of ubiquitous computing technologies across our private and professional lives, implementations of automatically processable regulation (APR) have evolved over the past decade from academic projects to real-world implementations by states and companies. There are now pressing issues that such encoded regulation brings about for citizens and society, and strategies to mitigate these issues are required. However, _comprehensive yet practically operationalizable_ frameworks to navigate the complex interactions and evaluate the risks of projects that implement (...) APR are not available today. In this paper, and based on related work as well as our own experiences, we propose a framework to support the conceptualization, implementation, and application of _responsible_ APR. Our contribution is twofold: we provide a holistic characterization of what responsible APR means; and we provide support to operationalize this in concrete projects, in the form of leading questions, examples, and mitigation strategies. We thereby provide a scientifically backed yet practically applicable way to guide researchers, sponsors, implementers, and regulators toward better outcomes of APR for users and society. (shrink)

This paper aims at bridging a gap between the history of American animal behavior studies and the history of sociobiology. In the post-war period, ecology, comparative psychology and ethology were all investigating animal societies, using different approaches ranging from fieldwork to laboratory studies. We argue that this disunity in “practices of place” explains the attempts of dialogue between those three fields and early calls for unity through “sociobiology” by J. Paul Scott. In turn, tensions between the naturalist tradition and the (...) rising reductionist approach in biology provide an original background for a history of Edward Wilson’s own version of sociobiology, much beyond the William Hamilton’s papers usually considered as its key antecedent. Naturalists were in a defensive position in the geography of the fields studying animal behavior, and in reaction were a driving force behind the various projects of synthesis called “sociobiology”. In the last 25 years, several philosophers and scientists have challenged the historical consensus that nonhuman animals cannot be moral agents. In this article, I examine this challenge and the debate it has provoked. Advocates of animal moral agency have supported their claims by appealing to non-rationalist accounts of morality and to observations of animal behavior. Critics have focused on the dangers of anthropomorphism and have argued that we cannot know animals’ states of mind with any certainty. Despite the strengths (...) of the arguments for animal moral agency, the critics’ skeptical counter-challenges seem to bring this debate to a stalemate. However, I suggest that recent philosophical work focusing on personal experiences with animals may reveal a way to dissolve skeptical concerns and offer new insights about the role of animals in morality. An important challenge when creating automatically processable laws concerns open-textured terms. The ability to measure open-texture can assist in determining the feasibility of encoding regulation and where additional legal information is required to properly assess a legal issue or dispute. In this article, we propose a novel conceptualisation of open-texture with the aim of determining the extent of open-textured terms in legal documents. We conceptualise open-texture as a lever whose state is impacted by three types of forces: internal forces (the (...) words within the text themselves), external forces (the resources brought to challenge the definition of words), and lateral forces (the merit of such challenges). We tested part of this conceptualisation with 26 participants by investigating agreement in paired annotators. Five key findings emerged. First, agreement on which words are open-texture within a legal text is possible and statistically significant. Second, agreement is even high at an average inter-rater reliability of 0.7 (Cohen’s kappa). Third, when there is agreement on the words, agreement on the Open-Texture Value is high. Fourth, there is a dependence between the Open-Texture Value and reasons invoked behind open-texture. Fifth, involving only four annotators can yield similar results compared to involving twenty more when it comes to only flagging clauses containing open-texture. We conclude the article by discussing limitations of our experiment and which remaining questions in real life cases are still outstanding. (shrink)

Much of the recent scholarship on the problem of political accountability in Africa leans toward the proposition that it is largely a post-colonial phenomenon that was caused by the destruction of the democratic institutions that were inherited by Africa's political elites. By replacing the democratic institutions they inherited from European colonial powers with quasi-democratic and downright despotic structures, it is argued that African elites became increasingly unaccountable and, in the process, destroyed their otherwise robust economies and impoverished the vast majority (...) of their citizens. In reality, however, the problem of political accountability in Africa is far more complex than that in its origins, character and manifestations. This paper critically examines notions and models of political accountability to demonstrate that the sources of the problem of accountability in Africa are both domestic and external. I argue that, contrary to widespread perception that African states suffer from impunity and lack of accountability, African governments have demonstrated a remarkable degree of responsiveness or accountability in their external relations while remaining virtually unaccountable to their own citizens. Therefore, the solution to the problem of political accountability in Africa should include a combination of internal reforms as well as the concerted support of the international community to generate a robust and sustained demand for accountability of African governments to their citizens. Social learning is likely to include affective processes: it is necessary for newcomers to discover what value to attach to objects, persons, and events in a given social environment. This learning relies largely on the evaluation of others’ emotional expressions. This study has two objectives. Firstly, we compare two closely related concepts that are employed to describe the use of another person’s appraisal to make sense of a given situation: social appraisal and social referencing. We contend that social referencing constitutes (...) a type of social appraisal. Secondly, we introduce the concept of affective social learning with the hope that it may help to discriminate the different ways in which emotions play a critical role in the processes of socialization. The International Federation of Accountants (IFAC) has recently issued a revised "Code of Ethics for Professional Accountants" (IFAC Code). As a requirement for membership in IFAC, a national accounting organization must either adopt the IFAC Code or adopt a code of conduct that is not "less stringent" than the IFAC Code. In this paper, we examine the extent to which 158 national accounting organizations have adopted the revised IFAC Code as their own. Our results indicate that 80 of our sample (...) organizations have adopted the IFAC Code (sometimes with minor modifications), while the remaining 78 opted not to utilize the model IFAC Code. We then test the hypothesis that national accounting organizations in lower income economies would be less likely to adopt the IFAC Code than those in high income economies. Our results do not support the hypothesis. We argue that one potential reason for such a finding is that adopting the IFAC Code may be a cost effective means of adopting a code of ethics for organizations in lower income economies. (shrink)

Philosophers agree that an important part of our knowledge is acquired via testimony. One of the main objectives of social epistemology is therefore to specify the conditions under which a hearer is justified in accepting a proposition stated by a source. Non-reductionists, who think that testimony could be considered as an a priori source of knowledge, as well as reductionists, who think that another type of justification has to be added to testimony, share a common conception about children development. Non-reductionists (...) believe that infants and children are fundamentally gullible and their gullibility could be seen as an example for justifying testimony, while reductionists believe that this gullibility is merely an exception that should be taken into account. The objective of this paper is to review contemporary literature in developmental psychology providing empirical grounds likely to clarify this philosophical debate. What emerges from current research is a more elaborated vision of children’s attitude toward testimony. Even at a very young age, children do not blindly swallow information coming from testimony; doubtful or contradictory information is automatically screened by their cognitive system. Even if they are unable to give positive reasons for the acceptance of a given testimony, young children are not gullible. Such empirical findings tend to call into question the radical opposition between reductionism and non-reductionism. (shrink)

Psychologists have emphasized children's acquisition of information through firsthand observation. However, many beliefs are acquired from others' testimony. In two experiments, most 4yearolds displayed sceptical trust in testimony. Having heard informants' accurate or inaccurate testimony, they anticipated that informants would continue to display such differential accuracy and they trusted the hitherto reliable informant. Yet they ignored the testimony of the reliable informant if it conflicted with what they themselves had seen. By contrast, threeyearolds were less selective in trusting a reliable (...) informant. Thus, young children check testimony against their own experience and increasingly recognise that some informants are more trustworthy than others. (shrink)

This paper argues that the definition of food justice must be defined in more participatory terms. Current accounts of food justice tend to emphasize distributional inequalities. However, there is broad recognition that these distributional inequalities are the result of participative inequalities and that the participation of marginalized groups in advocacy plays an important role in creating just food systems. In addition, thinking of food justice in more participative terms also suggests a more well-rounded and comprehensive approach to dealing with inequalities (...) within the food system. One manner in which the concept of food justice can be redefined to better capture the importance of participative justice is by considering what is required for informed consent. (shrink)

In this work, Colleen Clements presents her case for the need to subject the field of bioethics to a critical external analysis apart from the current postmodern assumptions. Clements argues that, since the 1970s, bioethics has refuted human values in favour of political consensus building. This failure to recognize basic human values in the ethical critique of modern medicine has lead to a dehumanization of the medical system by the field. Pour comprendre quels ont été les effets du principe de développement durable sur l’entreprise et quelles sont les méthodes de gestion du risque environnemental utilisées par les opérateurs économiques, il est nécessaire de distinguer entre l’approche « produits » et l’approche « holistique ». L’approche « produits », c’est-à-dire l’approche centrée sur la conception et la consommation des marchandises ou des (...) services, a été développée en premier. L’approche « holistique », plus globale, a pour mission d’englober toute l’activité économique, de la production des biens et des services à leur distribution, en passant par le financement de l’activité et le transport des biens. Sans prétendre à l’exhaustivité, sont présentés de nombreux dispositifs relevant de modalités, de natures et de ressorts très divers : la sécurité des produits, la labellisation et la certification, la responsabilité sociale et environnementale, le devoir d’information, le devoir de vigilance, le financement vert (avec les green bonds ). This article argues for a more diverse approach to the appearance of enslaved persons in Greek historiography through an analysis of the Persian navy's battlefield tour of Thermopylae in Book 8 of Herodotus’ Histories. Previous approaches to slavery in Greek historiography have rightly commented on the cultural awkwardness to Greek authors of slaves’ extensive involvement in ancient warfare. However, this is only one aspect of how slaves featured in historiographical narrative. Herodotus continually problematizes the methods of enquiry and many characters (...) within his work engage in enquiry-like activities. Book 8 itself is no different, with much of the action involving errors in human perception. The appearance of helots amongst the heroic dead at Thermopylae is intended both as a narrative reveal, since their presence has not previously been known to the reader, and as a comment on the contestation of Greek identity, which is framed at the start of Book 8 with a series of direct addresses to different groups of Greeks, all of whom take a different approach to their participation in the Persian Wars. Hence what appears to be an incidental detail can in fact be understood in the wider, thematic context of the Histories and especially that of the books concerning the Persian Wars. (shrink)

La justice prédictive séduit en ce qu’elle promet une justice plus sûre et meilleure. Pourtant, sa dénomination même, son utilisation, ses symboles, sa légitimité et ses effets méritent d’être critiqués et discutés.

On parle beaucoup aujourd’hui de la nécessité d’imposer une formation aux médiateurs. Cette obligation n’existe pas encore mais elle impliquerait de déterminer précisément selon quel modèle on désire professionaliser la fonction de médiateur.

L’horizon temporel de la responsabilité de l’État n’a cessé de s’étendre au cours des dernières décennies. Vers le passé d’une part, avec l’apparition de contentieux liés à l’histoire et, notamment, à certains scandales sanitaires, et vers l’avenir d’autre part, avec l’émergence de contentieux climatiques qui esquissent les contours d’une justice intergénérationnelle. Cet article analyse ce mouvement et certains des obstacles auxquels il confronte le juge administratif.

Les propositions de réforme de la responsabilité pour troubles anormaux du voisinage semblent claires et opportunes ; elles permettent au juge la recherche de solutions équilibrées entre le droit à la tranquillité, à une vie paisible et saine et les enjeux du vivre ensemble, qu’ils soient économiques, sociaux et environnementaux.

S’interroger sur les risques et les responsabilités juridiques liés à l’artificialisation du corps humain, c’est se demander quel est le rôle du droit pour répondre à ces nouveaux enjeux? Quel droit de l’artificialisation du corps humain, quel droit de l’hybridation homme-technologie pouvons-nous imaginer eu égard aux risques nouveaux? Ce serait un droit capable de surveiller la fabrication des dispositifs artificiels, d’éviter les risques, de garantir l’indemnisation des victimes de dysfonctionnements, enfin de protéger la personne humaine. Ainsi, le rôle du droit (...) est de trois ordres : premièrement, contrôler la mise sur le marché des dispositifs médicaux destinés au corps humain ; deuxièmement, protéger les victimes de dispositifs médicaux déficients ; troisièmement et plus généralement, protéger la personne humaine. In November 1996, Catherine Clément and Julia Kristeva began a correspondence exploring the subject of the sacred. In this collection of those letters Catherine Clément approaches the topic from an anthropologist's point of view while Julia Kristeva responds from a psychoanalytic perspective. Their correspondence leads them to a controversial and fundamental question: is there anything sacred that can at the same time be considered strictly feminine? The two voices of the book work in tandem, fleshing out ideas and (...) blending together into a melody of experience. The result is a dialogue that delves into the mysteries of belief -- the relationship between faith and sexuality, the body and the senses -- which, Clément and Kristeva argue, women feel with special intensity. Although their discourse is not necessarily about theology, the authors consider the role of women and femininity in the religions of the world, from Christianity and Judaism to Confucianism and African animism. They are the first to admit that what they have undertaken is "as impossible to accomplish as it is fascinating." Nevertheless, their wide-ranging and exhilarating dialogue succeeds in raising questions that are perhaps more important to ask than to answer. (shrink)

We propose a rational method for addressing an important question—who deserves to be an author of a scientific article? We review various contentious issues associated with this question and recommend that the scientific community should view authorship in terms of contributions and responsibilities, rather than credits. We propose a new paradigm that conceptually divides a scientific article into four basic elements: ideas, work, writing, and stewardship. We employ these four fundamental elements to modify the well-known International Committee of Medical Journal (...) Editors (ICMJE) authorship guidelines. The modified ICMJE guidelines are then used as the basis to develop an approach to quantify individual contributions and responsibilities in multi-author articles. The outcome of the approach is an authorship matrix, which can be used to answer several nagging questions related to authorship. (shrink)

These include the following propositions: the cooperation at larger and larger scales, the existence of larger scale processes, the enhancement of the tuning as the universe cycle repeats, the transmission between universes and the motivations to produce a new universe.
