In this paper, we present an approach to commonsense causal explanation of stories that can be used for automatically determining the liable party in legal case descriptions. The approach is based on, a core ontology for law that takes a commonsense perspective. Aside from our thesis that in the legal domain many terms still have a strong commonsense flavour, the descriptions of events in legal cases, as e.g. presented at judicial trials, are cast in commonsense terms as well. We present (...) design principles for representing commonsense causation, and describe a process-based approach to automatic identification of causal relations in stories, which are described in terms of the core ontology. The resulting causal explanation forms a necessary condition for determining the liability and responsibility of agents that play a role in the case. We describe the basic architecture and working of, the demonstrator we are constructing to test the validity of our process oriented view on commonsense causation. This view holds that causal relations are in fact abstractions constructed on the basis of our commonsense understanding of physical and mental processes. (shrink)

An objection to shifty epistemologies such as subject-sensitive invariantism is that it predicts that agents are susceptible to guaranteed losses. Bob Beddor (Analysis, 81, 193–198, 2021) argues that these guaranteed losses are not a symptom of irrationality, on the grounds that forgetful agents are susceptible to guaranteed losses without being irrational. I agree that forgetful agents are susceptible to guaranteed losses without being irrational– but when we investigate why, the analogy with shifty epistemology breaks down. I argue that agents with (...) shifty epistemologies are susceptible to guaranteed losses in a way which is a symptom of irrationality. Along the way I make a suggestion about what it takes for an agent to be coherent over time. I close by offering a taxonomy of shifty epistemologies. (shrink)

The paper provides an OWL ontology for legal cases with an instantiation of the legal case Popov v. Hayashi. The ontology makes explicit the conceptual knowledge of the legal case domain, supports reasoning about the domain, and can be used to annotate the text of cases, which in turn can be used to populate the ontology. A populated ontology is a case base which can be used for information retrieval, information extraction, and case based reasoning. The ontology contains not only (...) elements for indexing the case (e.g. the parties, jurisdiction, and date), but as well elements used to reason to a decision such as argument schemes and the components input to the schemes. We use the Protégé ontology editor and knowledge acquisition system, current guidelines for ontology development, and tools for visual and linguistic presentation of the ontology. (shrink)

One might well wonder—is there a category under which every thing falls? Offering an informative account of such a category is no easy task. For nothing would distinguish things that fall under it from those that don’t—there being, after all, none of the latter. It seems hard, then, to say much about any fully general category; and it would appear to do no carving or categorizing or dividing at all. Nonetheless there are candidates for such a fully general office, including (...) thing, being, entity, item, existent, and—especially—object.[ It is not obvious that there is any fully general category (whether object or otherwise). Accordingly, not all accounts of object assign it to a fully general category, instead allowing that there are non-objects. On those views, object does indeed divide. Accounts of object, then, differ with respect to whether there are non-objects. And this is not the only fault line. Other dimensions of difference include what objects there are and what objects are. Mereological nihilism is the view that no objects have proper parts. Despite how counter‐intuitive it is, it is taken quite seriously, largely because it solves a number of puzzles in the metaphysics of material objects – or so its proponents claim. In this article, I show that for every puzzle that mereological nihilism solves, there is a similar puzzle that (a) it doesn’t solve, and (b) every other solution to the original puzzle does solve. Since the solutions to the new (...) puzzles apply just as well to the old puzzles, the old puzzles provide no motivation to be a mereological nihilist. (shrink)

In this paper, I articulate and argue for a new truthmaker view of ontological commitment, which I call the “General Truthmaker View”: when one affirms a sentence, one is ontologically committed to there being something that makes true the proposition expressed by the sentence. This view comes apart from Quinean orthodoxy in that we are not ontologically committed to the things over which we quantify, and it comes apart from extant truthmaker views of ontological commitment in that we are not (...) ontologically committed to the truthmakers of our sentences. The lesson to be learned from the paradoxical St. Petersburg game and Pascal’s Mugging is that there are situations where expected utility maximizers will needlessly end up poor and on death’s door, and hence we should not be expected utility maximizers. Instead, when it comes to decision-making, for possibilities that have very small probabilities of occurring, we should discount those probabilities down to zero, regardless of the utilities associated with those possibilities.

In this paper, I offer a new theory of grounding. The theory has it that grounding is a job description that is realized by different properties in different contexts. Those properties play the grounding role contingently, and grounding is the property that plays the grounding role essentially. On this theory, grounding is monistic, but ‘grounding’ refers to different relations in different contexts. First, I argue against Kit Fine’s monist univocalism. Next, I argue against Jessica Wilson’s pluralist multivocalism. Finally, I introduce (...) monist multivocalism, explicate three versions of it (of which the above is one), and show its advantages. Die Studie untersucht die grundlegende Neuorientierung der deutschen theologischen Friedensethik seit dem Ende des Ost-West-Konflikts. Sie bietet Orientierung hinsichtlich der Denk- und Erkenntniswege führender katholischer und evangelischer Friedensethiker und damit der wesentlichen Entwicklungen der theologischen Friedensethik in Deutschland in der harten Schule der neuen Realitäten seit dem Ende der Blockkonfrontation. Dabei arbeitet sie heraus, welche normativen Vorgaben für friedensdienliches Handeln die deutsche theologische Friedensethik in Wahrnehmung ihrer Verantwortung für die Welt angesichts der neuen gewaltförmigen Konflikte unserer Gegenwart entworfen hat.

This paper examined the existence of gender differences in the degree to which leader’s perceptions of successor potential is influenced by interpersonal fit. In Study 1 (n = 97 leaders and n = 280 followers) multi-source field data revealed that for male leaders, ratings of followers’ potential as successors were positively related to interpersonal fit, measured by the degree to which followers’ saw their leadership as being close and interpersonal (i.e., being coaching, transformational and leading by example). For female leaders, (...) these relationships were absent, suggesting that they are less driven by interpersonal fit. In Study 2 (n = 311 leaders) a scenario study provided causal evidence that male leaders rated potential successors more positively when they perceived greater interpersonal fit with followers, whereas female leaders’ successor ratings where not informed by fit perceptions. We discuss the theoretical and practical implications for gendered leadership successor perceptions in organizations. (shrink)

This book reflects the increasing significance of musical performance studies in recent decades. Originally published as separate essays over thirty years, the twelve chapters have been refashioned as a monograph which is both scholarly in nature and intensely personal, building on the author's extensive musical experience, most notably as a pianist. Hence the primary focus on piano music by Chopin, Schubert, Liszt, Brahms and Rachmaninoff. The book's cross-cutting themes nevertheless apply to diverse performance idioms and domains. By exploring themes in (...) complementary ways, the book offers broad insights into musical ontology, epistemology and semantics while demonstrating various methodologies now used to study performance. Among other things, it highlights the powerful effects that experiencing music in performance can have on those who take part in it, in any capacity. There are many practical insights too. A variety of ethical objections have been raised against the military employment of uninhabited aerial vehicles (UAVs, drones). Some of these objections are technological concerns over UAVs abilities’ to function on par with their inhabited counterparts. This paper sets such concerns aside and instead focuses on supposed objections to the use of UAVs in principle. I examine several such objections currently on offer and show them all to be wanting. Indeed, I argue that we have a duty to protect an (...) agent engaged in a justified act from harm to the greatest extent possible, so long as that protection does not interfere with the agent's ability to act justly. UAVs afford precisely such protection. Therefore, we are obligated to employ UAV weapon systems if it can be shown that their use does not significantly reduce a warfighter's operational capability. Of course, if a given military action is unjustified to begin with, then carrying out that act via UAVs is wrong, just as it would be with any weapon. But the point of this paper is to show that there is nothing wrong in principle with using a UAV and that, other things being equal, using such technology is, in fact, obligatory. (shrink)

Researchers in all management specialties have discussed and investigated the important role values play in personal and organizational phenomena. However, because research on values has been performed in a wide range of social science disciplines and at different levels of analysis, much of thiswork has been uninformed by other work and is neither well integrated nor systematized, resulting in a great deal of confusion concerning the topic. This article attempts to add order and clarity to this area of research by (...) proposing a framework of values research based on level of analysis and by cataloguing and reviewing the vast theoretical and empirical research in light of this framework. Over the past decade, a number of accounting and financial reporting frauds have led to lost stock wealth, destroyed public trust, and a worldwide recession that called for necessary reform. Regulatory responses and systemic reforms quickly followed, and we show that, while necessary, these reforms are insufficient. The purpose of this paper is to forward virtuous professionalism as a necessary path toward restoring financial reporting systems. We take the position of external observer and analyze the accounting profession over time to (...) assess what has transpired within our financial reporting systems. Our analysis reveals that the combined influence of commercialism and regulatory response has led to a systemic decline in accounting’s professional ideals and, as a result, an erosion of public trust. We then propose virtuous professionalism as a necessary process for restoring financial reporting systems based on sociological, professional, and philosophical theories. We argue that virtuous professionalism is necessary for restoring the public servant identity of the accounting professional. We conclude that efforts to restore financial reporting systems should begin with reforms that restore professional identity shaped by virtues. (shrink)

We investigate the dynamics of sensory integration for perceiving musical performance, a complex natural behavior. Thirty musically trained participants saw, heard, or both saw and heard, performances by two clarinetists. All participants used a sliding potentiometer to make continuous judgments of tension (a measure correlated with emotional response) and continuous judgments of phrasing (a measure correlated with perceived musical structure) as performances were presented. The data analysis sought to reveal relations between the sensory modalities (vision and audition) and to quantify (...) the effect of seeing the performances on participants' overall subjective experience of the music. In addition to traditional statistics, functional data analysis techniques were employed to analyze time-varying aspects of the data. The auditory and visual channels were found to convey similar experiences of phrasing but different experiences of tension through much of the performances. We found that visual information served both to augment and to reduce the experience of tension at different points in the musical piece (as revealed by functional linear modeling and functional significance testing). In addition, the musicians' movements served to extend the sense of phrasing, to cue the beginning of new phrases, to indicate musical interpretation, and to anticipate changes in emotional content. Evidence for an interaction effect suggests that there may exist an emergent quality when musical performances are both seen and heard. The investigation augments knowledge of human communicative processes spanning language and music, and involving multiple modalities of emotion and information transfer. (shrink)

As a way forward in assessing how the Old Testament wisdom tradition might speak to decisions in a modern medical context, in this paper, I propose exploring the iconographic function of the “tree of life” in the Old Testament, which is consistently associated with both wisdom as well as life and health, in order to tease out two-related issues that can help in providing a Christian theological framework for thinking about the problem of the medicalization of risk: first, how should (...) the natural and good human desire for health and long life be framed in terms of the pursuit of wisdom? And, second, how might a sapientially formed character approach risk and uncertainty in making medical decisions? The answers to these questions help establish a framework in which more specific questions related to the medicalization of risk can be assessed. As such, this paper is deliberately programmatic and perspectival rather than prescriptive. (shrink)

I argue that the wave function ontology for quantum mechanics is an undesirable ontology. This ontology holds that the fundamental space in which entities evolve is not three-dimensional, but instead 3N-dimensional, where N is the number of particles standardly thought to exist in three-dimensional space. I show that the state of three-dimensional objects does not supervene on the state of objects in 3N-dimensional space. I also show that the only way to guarantee the existence of the appropriate mental states in (...) the wave function ontology has undesirable metaphysical baggage: either mind/body dualism is true, or circumstances which we take to be logically possible turn out to be logically impossible.“While our theory can be extended formally in a logically consistent way by introducing the concept of a wave in a 3N-dimensional space, it is evident that this procedure is not really acceptable in a physical theory... ” (Bohm 1957, 117). Contrary to Block's assertion, “identity-crowding” does not provide an interesting instance of object-seeing without object-attention. The successful judgments and unusual phenomenology of identity-crowding are better explained by unconscious perception and non-perceptual phenomenology associated with cognitive states. In identity-crowding, as in other cases of crowding, subjects see jumbled textures and cannot individuate the items contributing to those textures in the absence of attention. Block presents an attenuated sense in which identity-crowded items are seen, but this is irrelevant to the debate about (...) phenomenal experience of an object in the absence of object-attention. Finally, even unconscious object perception in identity-crowding likely involves an attention-like selective process. (shrink)

Time is what clocks are used to measure. Information about time tells the durations of events and when they occur and which events happen before which others, so time plays a very significant role in the universe’s structure, including the structure of our personal lives. But carefully describing time’s properties has led to many unresolved issues, both philosophical and scientific.

Conspiracy theories (CTs) are widespread ways by which people make sense of unsettling or disturbing cultural events. Belief in CTs is often connected to problematic consequences, such as decreased engagement with conventional political action or even political extremism, so understanding the psychological and social qualities of CTs belief is important. CTs have often been understood to be “monological”, displaying the tendency for belief in one conspiracy theory to be correlated with belief in (many) others. Explanations of monologicality invoke a nomothetical (...) or “closed” mindset whereby mutually supporting beliefs based on mistrust of official explanations are used to interpret public events as conspiracies, independent of the facts about those events (which they may ignore or deny). But research on monologicality offers little discussion of the content of monological beliefs and reasoning from the standpoint of the CT believers. This is due in part to the “access problem” (Wood & Douglas, 2015): CT believers are averse to being researched because they often distrust researchers and what they appear to represent. We used several strategies to address the access problem, and investigated the symbolic resources underlying CTs by reconstructing a conspiracy worldview - a set of beliefs held by CT believers about important dimensions of ontology, epistemology, and human agency. To do this, we analysed media documents, conducted field observation, and engaged in semi-structured interviews,. We describe six main dimensions of a conspiracy worldview: Views of the nature of reality, the self, the outgroup, the ingroup, action, and the future. We also describe a typology of five types of CT believers, which vary according to their positions on each of these dimensions. Our findings converge with prior explorations of CT beliefs but also revealed novel aspects: A sense of community among CT believers, a highly differentiated representation of the outgroup, a personal journey of conversion, variegated kinds of political action, and optimistic belief in future change. These findings are at odds with the typical image of monological CT believers as paranoid, cynical, anomic and irrational. For many, the CT worldview may rather constitute the ideological underpinning of a nascent pre-figurative social movement. (shrink)

In turn, business colleges and their international accrediting body are increasing their efforts to make students more aware of the social context of corporate activity. Business education literature lacks data on student attitudes toward such education. This study found that postscandal business students, particularly women, are indeed interested in it. Their interest is positively related to their past donation, volunteerism, and (...) non-profit organization membership activities, whether limited or extensive. Some evidence supports the proposition that education can modify internal principles over time. We offer suggestions for classroom and program uses of these findings in hopes of enriching the vision of future business managers. (shrink)
