It is the purpose of this paper to address ethical issues concerning the development and application of Assistive Technology at Workplaces (ATW). We shall give a concrete technical concept how such technology might be constructed and propose eight technical functions it should adopt in order to serve its purpose. Then, we discuss the normative questions why one should use ATW, and by what means. We argue that ATW is good to the extent that it ensures social inclusion and consider four (...) normative domains in which its worth might consists in. In addition, we insist that ATW must satisfy two requirements of good workplaces, which we specify as (a) an exploitation restraint and (b) a duty of care. (shrink)

The purpose of this paper is to defend an understanding of social participation that spells out inclusion as a dispositional property. I assume that an agent must occupy at least one position within a social order so that he is leastways partially included. The fact that a social position is open to someone means that he has the opportunity to take it. However, disputed is how "having the opportunity" should be understood exactly. My thesis, which I will develop and defend (...) in the context of this article, is: Since the appropriate application context decides whether the role characteristics of an agent actually become manifest, participation is a dispositional property. Therefore, a role is not open to someone only if he cannot claim a certain status for himself, even though he is in the relevant context. It is thus not a logical or metaphysical modality, but a normative modality that is relevant in terms of the openness of a role. Hence, social participation consists in a normative status that takes effect when certain conditions occure. (shrink)

This article aims to make progress towards an account of social cohesion and participation in terms of which we can better understand how groups of people come to constitute stable social orders. It argues for a conceptual distinction between "inclusion" and "integration" and sheds new light on their theoretical relationship. While "integration" refers to group members' willingness to act in accordance with the given norms of a social structure, "inclusion" is linked to their participation opportunities. The connection between ‚image‘ and ‚imagination‘ is then explored in texts on metaphysics and aesthetics by Christian Gottfried Bardili and Wilhelm Traugott Krug. With his ‚Law of Complementation‘, Bardili offers a solution to the problem of the mediation of the senses and the intellect. A political sociologist examines the concept of universal, egalitarian citizenship and assesses the prospects for developing democratic solidarity at the global level.

There is a fear of death that persistently eludes adequate explanation by contemporary philosophers of death. The reason for this is their focus on mortal harm issues, such as why death is bad for the person who dies. Claims regarding the fear of death are assumed to be contingent on the resolution of questions about the badness of death. In practice, however, consensus on some mortal harm issues has not resulted in comparable clarity on mortal fear. I contend we cannot (...) do justice to fear of death unless we detach it from theories about the badness of death, including the overwhelmingly-popular deprivation theory. The case for this involves disambiguation of certain aspects of mortal harm, a broad conception of what is involved in accounting for an emotion, and close attention to the nature of the fear in question. The source of fear of death is our departure from a context in which self-directed emotions have coherent application; our attitudes become ‘unmoored,’ in Samuel Scheffler’s phrase. While this does not result in a fear that is sui generis, it does demand that we remove the object of fear from the realm of well-being in order to make sense of it. (shrink)

Cartesian separation and enlightenment have led to a widespread conceptual separation of science and technology. Consequently a certain philosophical tradition holds pure science as a metaphysical striving for irrefutable truth that is morally neutral and only ( dirty?) applications as morally accountable. An opposite extreme position holds scientists responsible for everything that is done with their discoveries. Based on an interpretation of science to be a social construct and the observation that moral criteria are the results of social processes the (...) paper demonstrates by the example of synthetic chemistry that science is not an elite end in itself and as such is not free from obligation to moral criteria. The moral responsibility of a scientist, which arises from his professional expertise, is limited to the available knowledge of his discipline. The moral responsibility, which he carries beyond that as responsible acting human, derives from the cultural identity and the normative values under which his action is carried out. This conclusion is illustrated by the examples of DDT, Aspirin and Heroin. (shrink)

Background Ethically, informed consent regarding randomised controlled trials (RCTs) should be understandable to patients. The patients can then give free consent or decline to participate in a RCT. Little is known about what patients really understand in consultations about RCTs. Methods Cancer patients who were asked to participate in a randomised trial were surveyed using a semi-standardised interview developed by the authors. The interview addresses understanding, satisfaction and needs of the patients. The sample included eight patients who participated in a (...) trial and two who declined. The data were analysed on the basis of Mayring's qualitative analysis. Results Patients' understanding of informed consent was less developed than anticipated, especially concerning key elements such as randomisation, content and procedure of RCTs. Analysing the result about satisfaction of the patients, most of the patients described their consultations as hectic and without advance notice. Health limitations due to cancer played a decisive role. However, most of the patients perceived their physician to be sympathetic. Analysing the needs of patients, they ask for a clear informed consent consultation with enough time and adequate advance notice. Conclusion This study fills an important empirical research gap of what is ethically demanded in an RCT consultation and what is really understood by patients. The qualitative approach enabled us to obtain new results about cancer patients' understanding of informed consent, to clarify patients' needs and to develop new ideas to optimise the informed consent. Most scholars dealing with neo-Kantianism emphasize the existence of an explicit origin that characterizes neo-Kantianism as a clearly defined ‘movement’ with certain objects. In spite of the fact that differences between various neo-Kantian authors are mentioned in the current discourse (e. g. ‘Südwestdeutsche’ and ‘Marburger Schule’) scholars claim a singular unity of all neo-Kantian debates represented in the problem of ‘Geltung’. This is used to construct a certain relevance of neo-Kantianism in today’s philosophy. My contribution will pursue a historical approach (...) following Klaus Christian Köhnke’s and Ulrich Sieg’s demands. Instead of sketching systematic topics I pay further attention to the context in which an essence of neo-Kantianism was claimed or rejected. In doing so I will examine the discussions on the doctrine of postulates in Kant’s philosophy mainly led by Hans Vaihinger’s ‘Philosophy of As If’ and the impact of Eduard von Hartmann on the genesis of neo-Kantianism. I conclude that the definition of a consistent neo-Kantian ‘movement’ was an effect of rejecting spiritualist interpretations of the doctrine of postulates and in the following a rejection of the whole doctrine as ‘mysticism’ in canonical Kant interpretations. Engaging in self-narrative is often touted as a powerful antidote to the bad effects of illness. However, there are various examples of what may broadly be termed “aversion” to illness narrative. I group these into three kinds: aversion to certain types of illness narrative; aversion to illness narrative as a whole; and aversion to illness narrative as an essentially therapeutic endeavor. These aversions can throw into doubt the advantages claimed for the illness narrator, including the key benefits of repair to (...) the damage illness does to identity and life-trajectory. Underlying these alleged benefits are two key presuppositions: that it is the whole of one’s life that is narratively unified, and that one’s identity is inextricably bound up with narrative. By letting go of these assumptions, illness narrative advocates can respond to the challenges of narrative aversions. (shrink)

I am interested in fear of non-existence, which is often discussed in terms of fear one’s own death, or as it is sometimes called, fear of death as such. This form of fear has been denied by some philosophers. Cognitive theories of the emotions have particular trouble in dealing with it, granting it a status that is simultaneously paradigmatic yet anomalous with respect to fear in general. My paper documents these matters, and considers a number of responses. I provide examples (...) from philosophy and literature of fear of non-existence, and distinguish it from other death-related fears. I then look at the success that cognitive theories of the emotions have had in dealing with other “problematic” fears, such as phobias, and examine how the solutions here fail to apply to fear of non-existence. The problem lies with the perceptual-centred model of fear that is typically called upon. Against this I recommend a retreat to a belief-centred model for fear of non-existence. I argue that there are other fears that are better explained by a belief-centred rather a perceptual-based approach. This reinforces the plausibility of the belief-centred model, and goes some way to alleviating the anomalous and problematic status of the fear of non-existence. (shrink)

The psychological writing of Jung and the post-Jungians is all too often ignored as anachronistic, archaic and mystic. The paper starts with a thesis on the dialectical structure of modern law that goes back the European revolutionary tradition and constitutes a legal structure that is at once emancipatory and repressive. Once it became democratic the modern nation states has solved more or less successfully the crises that emerged in modern Europe since the 16th Century. Yet, this state did not escape the dialectical snares of modern law and modern legal regimes. It’s greatest advance, the exclusion of inequalities presupposed (...) the exclusion of the internal other of blacks, workers, women etc, and the other that stemmed from the non-European world that furthermore was under European colonial rule or other forms of European, Northamerican and Japanese imperial control. Yet, the wars and revolutions of the 20th Century let to a complete reconstruction, new foundation and globalization of all national and international law. The evolutionary advance of the 20th Century was the emergence of world law, and this enabled the construction of international and national welfarism and the global expansion of the exclusion of inequalities. Nevertheless the dialectic of enlightenment came back again and led to new forms of postnational domination, hegemony, oppression and exclusion. Based on recent insight into the thalamocortical system and its role in perception and conscious experience, a unified pathophysiological framework for hallucinations in neurological and psychiatric conditions is proposed, which integrates previously unrelated neurobiological and psychological findings. Gamma-frequency rhythms of discharge activity from thalamic and cortical neurons are facilitated by cholinergic arousal and resonate in networks of thalamocortical circuits, thereby transiently forming assemblies of coherent gamma oscillations under constraints of afferent sensory input and prefrontal attentional mechanisms. If perception is based (...) on synchronisation of intrinsic gamma activity in the thalamocortical system, then sensory input to specific thalamic nuclei may merely play a constraining role. Hallucinations can be regarded as underconstrained perceptions that arise when the impact of sensory input on activation of thalamocortical circuits and synchronisation of thalamocortical gamma activity is reduced. In conditions that are accompanied by hallucinations, factors such as cortical hyperexcitability, cortical attentional mechanisms, hyperarousal, increased noise in specific thalamic nuclei, and random sensory input to specific thalamic nuclei may, to a varying degree, contribute to underconstrained activation of thalamocortical circuits. The reticular thalamic nucleus plays an important role in suppressing random activity of relay cells in specific thalamic nuclei, and its dysfunction may be implicated in the biological vulnerability to hallucinations in schizophrenia. Combined with general activation during cholinergic arousal, this leads to excessive disinhibition in specific thalamic nuclei, which may allow cortical attentional mechanisms to recruit thalamic relay cells into resonant assemblies of gamma oscillations, regardless of their actual sensory input, thereby producing an underconstrained perceptual experience. I compare and assess two significant and opposing approaches to the self with respect to what they have to say about death: the anti-narrativist, as articulated by Galen Strawson, and the narrativist, as pieced together from a variety of accounts. Neither party fares particularly well on the matter of death. Both are unable to point towards a view of death that is clearly consistent with their views on the self. In the narrativist’s case this inconsistency is perhaps not as explicit (...) but is in the end more entrenched. (shrink)

This article discusses two views associated with narrative conceptions of the self. The first view asserts that our whole life is reasonably regarded as a single unit of meaning. A prominent strand of the philosophical narrative account of the self is the representative of this view. The second view—which has currency beyond the confines of the philosophical narrative account—is that the meaning of a life story is dependent on what happens at the end of it. The article argues that the (...) connection between these two views is more tentative than often supposed: philosophical narrativists that see life as a single unit of value and meaning nonetheless provide grounds for arguing that the end of life is not the best and may be a particularly bad time to approach and intervene in the matter of how well one's life as a whole has gone. The truth potential of art is realized not only by great art (of educated elites) but also by the cultural industry that has become the art of the masses. Great art and cultural industry do not only contradict one another but often interpenetrate and overlap subversively. Especially in critical periods of crisis (and revolution) great art and cultural industry go together with political action. However, in more counterrevolutionary periods as nowadays post-truth democracy, Adorno's gloomiest interpretation of the cultural industry becomes (...) topical again. (shrink)

Performing and listening to music occurs in specific situations, requiring specific media. Empirical research on music listening and appreciation, however, tends to overlook the effects these situations and media may have on the listening experience. This article uses the sociological concept of the frame to develop a theory of an aesthetic experience with music as the result of encountering sound/music in the context of a specific situation. By presenting a transdisciplinary sub-field of empirical studies, we unfold this theory for one (...) such frame: the classical concert. After sketching out the underlying theoretical framework, a selective literature review is conducted to look for evidence on the general plausibility of the single elements of this emerging theory and to identify desiderata. We refer to common criticisms of the standard classical concert, and how new concert formats try to overcome alleged shortcomings and detrimental effects. Finally, an empirical research program is proposed, in which frames and frame components are experimentally manipulated and compared to establish their respective affordances and effects on the musical experience. Such a research program will provide empirical evidence to tackle a question that is still open to debate, i.e., whether the diversified world of modern-day music listening formats also holds a place for the classical concert – and if so, for what kind of classical concert. The complex figure of Theodor Adorno has made a lasting impact on modern political and philosphical development. Deeply interested in the flowering of modern art and an accomplished musician who was close to Schoenberg's circle, he was profoundly affected by revolutionary Marxism, although he always resisted its institutionalized manifestations. Adorno sought to highlight the negative characteristics of the Enlightenment while at the same time emphasizing its positive and empancipatory aspects. In both politics and philosophy he preferred the spontaneous to the (...) orthodox, the experimental to the conventional. His life's work rejects the capitalist system of the twentieth-century while at the same time acknowledging and affirming its creative cultural achievements. Hauke Brunkhorst's book is the first English-language assessment of Adorno's life and work. He stresses the links between Adorno and the dialectical thinking of Hegel and Marx, but also emphasizes the connection between Kant and Adorno. The book sheds new light on Adorno's negative dialectic and is an important contribution to the debate on this celebrated philosopher. (shrink)

The author of Critical Theory of Legal Revolutions discusses three major fields of objection against his outline of an evolutionary theory of public and international law. In the first part he discusses problems of action theory. There are at issue, first, the role of negation and moral resentment for the constitution of a normatively relevant social praxis, then the emergence of social systems within and from the context of the life-world, and the relation of revolutionary and gradual learning processes. The (...) second part discusses the relation of his theory to postcolonial and feminist studies. Finally, the debate centers in part III on the dialectic of Enlightenment. The problem of alienation and negativity is at stake, closely related to the negative aesthetic of law and the intertwinement of repression and emancipation within the legal form. In the end, it is an open question if we today still can rely on the negative aesthetic and hidden utopian form of law, or if we have already fallen back to constitutional kitsch and façade. Technological advancement has an ambivalent character concerning the impact on biodiversity. It accounts for major detrimental environmental impacts and aggravates threads to biodiversity. On the other hand, from an application perspective of environmental science, there are technical advancements, which increase the potential of analysis, detection and monitoring of environmental changes and open a wider spectrum of sustainable use strategies.The concept of biodiversity emerged in the last two decades as a political issue to protect the structural and functional basis of earthbound (...) life. In this respect, it represents a great challenge for science, in particular for ecology, which is the scientific discipline mainly involved in contributing to understand biodiversity issues.In this paper, we state a strong necessity for ecologists to work in close connection with other disciplines and within their own discipline across the different organisation levels. Each level has some specific properties to which ecological terminology has been adapted, and joint views are necessary to understand complex networks. In this context, ecological theory provides the background to analyse biological complexity and the relationship of structure and dynamics on different integration levels and provides the interface to mediate social and political issues.Important features of new technologies for advances in ecological theory refer to an increase in information processing capacities, more efficient automatic data acquisition and device operation, and an increase in resolution.One crucial consideration we analyse is the trend that a quantitative development in one particular discipline may open a new potential for qualitative advancement in other disciplines when the quantitative advancement is applied in a new disciplinary context.We illustrate these qualitative developments that are based on technological advancements and which helped to advance ecological theory qualitatively with two examples: The underlying mechanisms causing regularly oscillating rodent populations are subject to a decade long discussion in ecology. Using the possibilities of modern information processing, it is possible to represent the discussed hypotheses in an integrative object oriented model and analyse how the underlying causal net works. The second example originates from biosafety research dealing with the environmental impact of genetically modified organisms. The project GenEERA develops a complex up-scaling procedure from below field-level information to the landscape scale in order to investigate spread and persistence of GM oil seed rape under different scenarios. The approach gives an example, how ecological modelling can be used to combine different information levels to derive conclusions on a higher spatial scale.In an overall conclusion we relate the described approaches to a wider system analytical context in which we interpret theory developments and biodiversity issues with a system theoretical description of growth processes. We obtain the view that in self-organising systems there is a tendency for autonomous development which tends to be dominating far away from capacity limitations. However, while approaching capacity limitations, a tendency towards closer coupling of internal and external cause-effect networks emerges. We also find that the relation of biodiversity, ecosystem services, and social dynamics can be interpreted in this framework. In this context, the demand for closer interdisciplinary cooperation to solve existing problems appears as an indication of emerging capacity limitations both, in the theoretical as well as in the physical domain. If during arousal thalamocortical self-organisation is underconstrained by sensory input, then attentional mechanisms alone may determine the content of perception and hallucinations may arise.
