In Japan, although various arguments exist regarding the appropriateness of the death penalty, nationwide public opinion polls regarding the death penalty revealed that 85.6% of respondents supported maintaining the death penalty in 2009. Under these circumstances, it is worthwhile to deliberate the ethical and social issues surrounding the death penalty as depicted in Japanese films from medical humanities perspectives. In the present paper, we discuss two recent films concerning the death penalty, 13 kaidan directed by Masahiro Nagasawa, 2005 and Kyuka (...) directed by Hajime Kadoi, 2007. The two films describe the impact of execution on the executioners, secrecy of executions, rehearsal of the execution, and voluntary participation in execution. They depict the current situation surrounding the death penalty and execution, as well as everyday life on death row, in detail. Serious concerns about current execution procedures were also described. The two films seem to try to tell the audience that there is something strange in killing people in perfect order with good will in the name of law and justice. They show the officer‘s instinctive aversion provoked by the execution and make us think about what it means to kill a human. (shrink)

How should the Japanese death penalty system stand in the future? While banning the death penalty has become a global trend, Japanese public opinion still supports it, and the government continues to strongly insist retention of the system. Despite worldwide criticism towards Japanese opinion, until very recently have been no reductions in death penalty sentences or executions. Both abolitionist and retentionist countries have strong arguments to support their opinions, thus there is no decisive argument that overwhelmingly refutes others. Consideration for (...) the feelings of the murder victim’s family is significant, and there are certain actions perpetrated by the criminal which seem unforgivable and for which nothing can compensate. At the same time, homicide is a violence that should never be acceptable and therefore cannot be justified, and human error will always allow for the possibility of wrongful convictions. The authors argue that the death penalty should be abolished in principle, but we cannot deny the existence of a criminal for whom the death penalty would be appropriate. Ethically, it would be questionable to accept life imprisonment without parole as an alternative. We are of the position that there is no definite conclusion concerning the ethicality of the death penalty. (shrink)

Humans have great locomotor adaptability to environmental demands, which has been investigated using a split-belt treadmill with belts on both the left and right sides. Thus far, neuromuscular control in split-belt locomotor adaptation has been evaluated by analyzing muscle activities at the individual muscle level. Meanwhile, in the motor control field, the muscle synergy concept has been proposed. Muscle synergies are considered the fundamental building blocks of movement and are groups of coactive muscles and time-varying activation patterns, thereby, reflecting the (...) neurophysiological characteristics of movement. To date, it remains unclear how such muscle synergies change during the adaptation and de-adaptation processes on the split-belt treadmill. Hence, we chronologically extracted muscle synergies while walking on the split-belt treadmill and examined changes in the number, muscle weightings, and temporal activation patterns of muscle synergies. Twelve healthy young males participated, and surface electromyography signals were recorded bilaterally from 13 lower-limb muscles. Muscle synergies were extracted by applying non-negative matrix factorization to the EMG data of each leg. We found that during split-belt walking, the number of synergies in the slow leg increased while an extra synergy appeared and disappeared in the fast leg. Additionally, the areas under the temporal activation patterns in several synergies in both legs decreased. When both belts returned to the same speed, a decrease in the number of synergies and an increase in the areas under the temporal activation patterns of several synergies were temporally shown in each leg. Subsequently, the number of synergies and the areas under the temporal activation patterns returned to those of normal walking before split-belt walking. Thus, changes in the number, muscle weightings, and temporal activation patterns of synergies were noted in the split-belt locomotor adaptation, suggesting that the adaptation and de-adaptation occurred at the muscle synergy level. The subject of this paper is the meaning and significance of habit formation, or habituation, in Aristotle’s Nicomachean Ethics. According to Aristotle, ethics is an intellectual activity that helps an individual become a good person. Moreover, habituation is essential for becoming a good person. Aristotle believes that habituation, which helps us become good people, is possible by making “actions in accordance with virtues” our habits. Habituation is a keystone concept in Aristotle’s ethics. However, contrary to the importance given to the (...) concept of habituation, Aristotle’s remarks on habituation are curiously poor and fragmentary. Several researchers have been baffled by this contradiction and have produced different perplexing interpretations. This paper attempts to shed light on Aristotle’s views on the path to virtue from a new perspective by clarifying three points: 1. According to Aristotle, habituation is something that adults with life experience should attempt to overcome their vices. 2. The “action” that constitutes the substance of habituation is the trial and error through which the learner achieves his or her own “middle point” (i.e., virtue), without following ready-made examples. 3. The reason Aristotle did not offer an in-depth explanation of this issue is that the hard work of habituation is already a “virtuous” and “noble” action in and of itself. (shrink)

This article offers a new interpretation of Plato’s method of collection and division as formulated in the Phaedrus, in light of a detailed examination of the surrounding context. It argues that Socrates carefully distinguishes the characteristic operations of the method from its applications. It shows that collection and division are to be construed independently of one another, and that the collection of F-ness is equivalent to the procedure for the definition of F-ness; and it clarifies three kinds of application that (...) are mentioned in the Phaedrus: simple definition, definition supplemented with division, and scientific analysis. The following essay is an attempt to a) bridge the gap between habit in the ordinary sense of the word and the concept of habit as described by philosophers, using the various characteristics of habitual behaviors that shape daily life as a clue and b) clarify what it means to question the meaning of habit in general. What philosophers from Aristotle to Thomas Aquinas, to Ravaisson, to Dewey have regarded as habit is very different from the common usage of the (...) noun “habit.” The word “habit” commonly refers to automatically repetitive, nonreflective behavior that does not require the intervention of the will. In contrast, philosophers have regarded the essence of habit to be the free exercise of advanced abilities that require concentration and tension. The following essay confirms that 1) habits are a way of returning to ourselves and are impossible to imitate, 2) we should distinguish habits from "routines" and "rituals,” and 3) the problem of the formation of habit is one of “transcendence.”. Ronald Coase has been a vigorous critic of mainstream economic theory, arguing that it is unrealistic and that a good theory is realistic. The attributes "realistic" and "unrealistic" appear in three senses at least in Coase: one related to narrow ness and breadth; another related to abstracting from particularities (and the issue of "blackboard economics"); and the third related to correspondence with the legal. This does not yet make Coase an advocate of realism. It is therefore separately argued that each (...) of the three kinds of "realisticness" as a property of theories is consistent with realism as a theory of theories. (shrink)

The tone of this paper is largely critical. Therefore, I would like to begin by praising Donald McCloskey and Arjo Klamer for their exciting and provocative initiative in the metatheory of economics. They have done us a great favor by opening our eyes to some hidden aspects in the intellectual practices of economists. They have shown that economics is rhetoric; it is persuasion, discourse, conversation, and negotiation, to use their favorite phrases. They have provided plausible arguments and illuminating examples to (...) convince us of the literary character of economic reasoning, notwithstanding the formal languages used by economists and the positivist pretensions typical of the self-image of the discipline. However, McCloskey and Klamer have been less successful in trying to convince us of what economics is not. In particular, it concerns me that they have opened up a gap between rhetoric and realism. They seem to think that because economics has a rhetorical character, it cannot be understood in realist terms. I will argue that this view is mistaken: rhetoric and realism do not exclude each other, but rather they are capable of being combined in a coherent methodology of economics. It is a valuable contribution to import the insights of the newly rehabilitated rhetoric to the metatheory of economics; but it is unnecessary to marry them with enthusiasm about the fashionable anti-realism of Richard Rorty and others. While this is my overall thesis, it is clear that only initial steps towards its substantiation can be taken in this paper. I intend to proceed as follows. I will first make an attempt to locate the problem at hand in the history of the metatheory of economics. Then I will point out those elements in rhetorical metatheory as practiced and defended by Klamer and McCloskey that apparently have anti-realist or non-realist assumptions or implications, either directly or via considerations of scientific rationality. Next I will formulate a few concepts of realism, the differences between which have been ignored in the methodology of economics to this day. Then I will make preliminary attempts to inquire into the mutual compatibility of the rhetorical insights provided by McCloskey and Klamer and realism in this context. I will show that, in principle, there should be no insurmountable obstacles to combining the two; in some of its senses, realism will even turn out to be presupposed by the rhetorical approach. I do not primarily intend to argue for realism as such in this paper. Instead, I will argue for the compatibility of realism and rhetoric. The argument is based on Klamer's and McCloskey's own commitments; in this sense, the argument is immanent to their rhetorical approach. As a final point, I will argue that one should not be indifferent about realism: it does make a difference in economics and in the methodology of economics whether rhetoric is accepted with or without realism. As concerns over the negative social and environmental impacts of industrial agriculture become more widespread, efforts to define and regulate sustainable agriculture have proliferated in the US. Whereas the USDA spearheaded previous efforts, today such efforts have largely shifted to Tripartite Standards Regimes (TSRs). Using a case study of the Leonardo Academy’s initiative to develop a US sustainable agriculture standard, this paper examines the standards-development process and efforts by agribusiness to influence the process. Specifically, we analyze how politics operate in (...) seemingly “depoliticized” TSRs, and how agribusiness and the USDA use “framing practices” and procedural complaints to influence the standard-development process. We contend that although governance mechanisms are a potentially powerful tool for advocates of alternative agrifood, their efficacy may be constrained by science-based requirements, an agribusiness countermovement, and a captured state. This book addresses the philosophical question of "What is landscape?" From the birth of the genre of "landscape painting" in the 16th century, Western culture has valued landscapes in terms of their "picturesque" or "painterly" qualities. The creation of the "English landscape garden" was influenced by landscape painting, and "picturesque travel," which became popular in England in the 18th century, sought to recreate the experience of viewing landscape paintings in nature. 1. The book labels this view of landscape that seeks (...) the epitome of landscape in "picturesque" images reminiscent of landscape painting as "the aesthetics of spectacular scenery," traces its genealogy from the late 16th century to the early 19th century, and reveals its "anti-modern" character. 2. It asserts that the "aesthetics of spectacular scenery" is a dystopia of "hortus conclusus," drawing upon John Ruskin's criticism of the "picturesque." 3. The book then clarifies that landscape must be defined not as an "image," but as the "horizon." The "horizon" is the periphery of our consciousness, always present yet somehow perceived. However, certain stimuli draw our attention to this non-thematic object of consciousness. When the non-thematic becomes unexpectedly thematic, the landscape appears to us as the very "thing that was the horizon." The landscape is not an image or a physical structure. To experience a landscape is to receive "what was the horizon" exactly as it is given and to experience it in the context of the world as a whole. (shrink)

Background Physical restraints are routinely employed to ensure patient safety in Japanese acute care. Little is known about nursing students' perspectives and how they begin to question their value and knowledge in the face of restraint experiences in clinical practice. Objective To investigate nursing students’ questions about patient restraints and how they understand the ethics of the use of restraints in nursing. Research design Qualitative descriptive research using narrative analysis. Participants and research context Experiential data were generated and thematically analyzed (...) from semi-structured interviews with 16 nursing students who had completed their bachelor’s degree program requirements. Ethical considerations The study was approved by academic and clinical ethics agencies. Participants provided written informed consent. Results Physical restraints were encountered in 16 incidents, 3 with children and 13 with older patients with dementia. Students struggled to comprehend the policies and protocols of restraint use and worried their use was primarily for security rather than therapeutic purposes. Five themes were identified: (1). Questioning the tension between person-centered care, patient autonomy, and restraints, (2). Questioning the nature of restraints in which participants analyzed the policies and protocols around restraint use, (3). Questioning the professional nursing self whereby students reflected on how restraint use challenged their nursing values, and (4). Questioning professional nursing practice, in which students explored how restraints fit within a nursing perspective and positioned themselves as patient advocates. Students encountering physical restraints should ask questions based on values of patient-centeredness, autonomy, and advocacy. There is a need for education that facilitates reflection and questioning so that it informs students’ ethical thinking which may enhance nurse advocacy to reduce restraint use. Conclusions Restraints provide contexts in which students must face tensions between nursing values and clinical reality. Further research on nursing education strategies within non-psychiatric settings is needed to reduce physical restraints. (shrink)

Nursing students face various ethical issues, which may cause stress, that require coping strategies. This study investigated the thoughts and feelings underlying the coping behaviors adopted by nursing students when addressing ethical issues. Semi-structured interviews were conducted from September to October 2011 with 11 students enrolled at University A who had completed basic nursing and specialty practicums and consented to participate in the study. Data were analyzed using qualitative methods. The participant narratives about ethical issues encountered during clinical practicums were (...) organized into four themes and 20 scenarios. The ethical issues concerned the attitudes and conduct of nurses, doctors, physical therapists, and other medical professionals. Seven coping behaviors were identified. The results revealed that nursing students waver between valuing their relationships with nurses and their relationships with patients when they encounter an ethical issue. When their relationships with nurses were emphasized, their ethical values were restructured. These findings suggest the need to address the affective domain early on in lectures and in-class practice, and to create an environment in which students taking practicums can easily express their feelings and internal value system changes. His concept of Kasane-egaki (...) is also often cited as a core concept of his theory of time.1 The main aim of this paper is to first overview the works of Ōmori since there is only a limited amount of his translated work so far.2 Consecutively, the paper focuses on Ōmori’s theory of kotodama and its related arguments with an intention to expand his concept of Kowaburi into the ethics of online encounters during the pandemic.The world in 2020 was suddenly forced to face the pandemic caused by COVID-19. What COVID-19 alerted us to is tremendous, and there are countless problems that the invisible virus has revealed. Among those are the hidden problems of contemporary society, not limited to the discrimination among races, gender, and jobs (white-collars versus essential workers), the problem of zoonosis, and the related environmental problems (climate change and intrusion into wild nature) caused by over-exploitation of nature. In developed countries, most students and those serving as intellectual workers face their daily lives being overly occupied with online lectures and meetings. COVID-19 worked to normalize remote work, which further normalized and forced our everyday life to shift to cyberspace. [End Page 101]In introducing and overviewing Ōmori’s philosophy, this paper attempts to see the current situation through Ōmori’s philosophy to draw out some ethical implications related to non-physical online encounters and how we can perceive human interactions and relationships under such conditions. Under the constraints caused by COVID-19, humans’ limitless desires to interact with others are expanding more so to the sphere of cyberspace, leading to technological development, such as VR. In short, first, the paper overviews Ōmori’s philosophy. Second, through the overview of Ōmori’s philosophy, the paper seeks adaptable philosophy of his that may work as soft binding grounding ethics for cyberspace encounters where substantial bodily encounters are void. In doing so, the paper intends to draw out weak binding ethics implied in Ōmori’s philosophy that may work to empathetically engage with others in cyberspace where embodied encounters with others are dissolved.Ōmori Shōzō and His Philosophy: A Short Introduction and OverviewIn his short essay introducing the Japanese philosophy of the 1970s, Yasuo Kobayashi coined the term “Komaba quartet” by selecting four active eminent philosophers based on the Komaba campus at the University of Tokyo.3 Among them is Ōmori Shōzō (1921–97), aligning with Hiromatsu Wataru (1933–94), Sakabe Megumi (1936–2009), and Inoue Tadashi (1926–2014). Ōmori is the oldest of the Komaba quartet and received higher education before World War II. He served at the Naval Technology Institute Mitaka Laboratory during the war with his physics degree from the Tokyo Imperial University.4 After the war, he studied philosophy at the University of Tokyo with an interest in phenomenology, leading him to study at Harvard and Stanford in the United States.During his professorship at the University of Tokyo, he inspired countless students who are now leading the philosophy academy in Japan, such as Noe Keiichi (1949–) and Noya Shigeki (1954–). In the round-table discussion titled “Explanatory Round-Table on the Charm of Ōmori’s Philosophy,” four of his former students—Iida Takashi and Tanji Nobuharu, in addition to Noe and Noya—worked on selecting his works. We can easily discriminate self-produced from externally generated sensory signals. Recent studies suggest that the prediction of the sensory consequences of one’s own actions made by forward model can be used to attenuate the sensory effects of self-produced movements, thereby enabling a differentiation of the self-produced sensation from the externally generated one. The present study showed that attenuation of sensation occurred both when participants themselves performed a goal-directed action and when they observed experimenter performing the same action, although they clearly (...) reported that the tones were produced by other during action observation and by themselves during their own action. These results suggest that sensory prediction of action modulates ongoing auditory processing irrespective of who produces the sounds and that the explicit judgment of agency does not necessarily rely on the same mechanisms on which implicit perceptual measures such as sensory attenuation rely. The ordeal of `Comfort Women' who were sexually enslaved by the Japanese Imperial Military during the Second World War became widely known in the 1990s through these women's accounts of their experience. Instead of considering their narratives as historical data which reflect the `true' historical past, this article locates them within a broader framework of thinking of narratives. Drawing on the understanding of narrative as a key to the self and the subject which has been developed in narrative research, as (...) well as Judith Butler on interpellation and Gayatri Chakravorty Spivak on subaltern agency, this article argues that the `Comfort Women's' testimonies should not be read one-dimensionally in the light of `truth' and `falsity', but should rather be considered as the site of their subject-formation. This study investigates the choice of genitive forms (the woman’s book vs. the book of the woman) in the English of Japanese-English bilingual returnees (i.e. children who returned from a second language dominant environment to their first language environment). The specific aim was to examine whether change in language dominance/exposure influences choice of genitive form in the bilingual children; the more general question was the extent to which observed behaviour can be explained by cross linguistic influence (CLI). First, we compared (...) the choice of genitive form between monolingual Japanese speakers and bilinguals who had recently returned to Japan from an English monolingual environment. Second, we tracked changes in genitive preference within bilingual children, comparing their performances upon return to Japan to those of one year later. Results show that CLI alone is insufficient to explain the difference in genitive evaluation between bilinguals and monolinguals, as well as the intra-group bilingual variation over time. We suggest that both CLI and general processing considerations couple together to influence the changes in genitive preference. (shrink)
