Adolescents are routinely treated differently to adults, even when they possess similar capacities. In this article, we explore the justification for one case of differential treatment of adolescents. We attempt to make philosophical sense of the concurrent consents doctrine in law: adolescents found to have decision-making capacity have the power to consent to—and thereby, all else being equal, permit—their own medical treatment, but they lack the power always to refuse treatment and so render it impermissible. Other parties, that is, individuals (...) who exercise parental responsibility or a court, retain the authority to consent on an adolescent’s behalf. We explore four defences of the doctrine. We reject two attempts to defend the asymmetry in the power to consent to and refuse medical treatment by reference to transitional paternalism. We then consider and reject a stage of life justification. Finally, we articulate a justification based on the distinctiveness of adolescent well-being. (shrink)

This article is about the information relevant to decision-making capacity in refusal of life-prolonging medical treatment cases. We examine the degree to which the phenomenology of the options available to the agent—what the relevant states of affairs will feel like for them—forms part of the capacity-relevant information in the law of England and Wales, and how this informational basis varies across adolescent and adult medical treatment cases. We identify an important doctrinal phenomenon. In the leading authorities, the courts appear to (...) count the first-personal phenomenology of the available options among the information that adolescents seeking to refuse life-prolonging treatment must understand and appreciate in order to possess capacity; adults are not held to this (higher) standard. We evaluate this differential treatment in light of philosophical work on transformative choice—decisions involving options whose sensory character, and effect on our values and preferences, are grasped only through experience itself. This article is written by a descendant of enslaved Africans and explores the theological significance of Black bodies. Black bodies have been commodified, controlled and coerced by White hegemony, often lacking agency and self-determination. Using personal experience and contextual analysis, this article, drawing on Black theology inspired reflections, argues that we need to rethink how we conceive of Black bodies ethically, if Black lives are to really matter. The rehabilitation of Black bodies is achieved (...) through a theological reappraisal of holiness and sacraments, underpinned by an embodied pneumatology, in which Black bodies are shown to be sacramental and worthy of mattering in a world underpinned by White supremacy. This article speaks to existential challenges facing Black people, predominantly of Caribbean descent, to live in what continues to be a White dominated and White entitled society. Working against the backdrop of the ‘Black Lives Matter’ movement that originated in the United States, this article analyses the socio-political and cultural frameworks that affirm Whiteness whilst concomitantly, denigrating Blackness. The author, a well-known Black liberation theologian, who is a child of the Windrush Generation, argues that Western Mission Christianity (...) has always exemplified a deep-seated form of anti-Blackness that has helped to shape the agency of Black bodies, essentially marking them as ‘less than’. This theological base has created the frameworks that have dictated the sematic belief that Black bodies do not really matter and if they do, then they are invariably second-class ones when compared to White bodies. In the final part of the article, the author outlines the ways in which Black theology in Britain, drawing on postcolonial theological and biblical optics, has sought to critique the ethnocentrism of White Christianity in Britain in order to assert that ‘Black Lives Do Matter’. ObjectiveHead and neck cancer treatments are known to significantly affect functionality and appearance, leading to an increased risk for body image disturbances. Yet, few longitudinal studies exist to examine body image in these patients. Based on a conceptual model, the current study aimed to determine, in patients newly diagnosed with HNC: the prevalence, level, and course of body image concerns; correlates of upon cancer diagnosis body image concerns; predictors of immediate post-treatment body image concerns; and association between body image concerns (...) and levels of anxiety, depression, suicidal ideation, support, and alcohol and drug misuse.MethodsTwo hundred and twenty-three, newly diagnosed with a primary HNC were assessed using structured clinical interviews and psychometric measures at three, and 6 months after diagnosis. Primary outcome was 3-month, as it was most salient to body image disturbance. Multiple linear regression analyses were conducted on the potential body image predictors, based on the model.ResultsSixty-eight percent of patients with HNC presented some level of body image concerns. Body image concerns at baseline and post-treatment were significantly related and significantly increased from pre- to post-treatment. Immediately post-treatment, 89% presented some level of body image concerns. Correlates of body image concerns in patients with HNC at baseline included: physical symptom burden, difficulties with communication and eating, coping with the cancer diagnosis using denial, suicidal ideation, and having had a past anxiety diagnosis. When controlling for sociodemographic and medical variables, body image concerns in patients with HNC in the immediate post-treatment were predicted by: baseline body image, physical symptom burden, and neuroticism.ConclusionThis longitudinal study helps identify patients more susceptible to experience body image disturbance following head and neck cancer. Clinicians ought to pay special attention to body image concerns upon cancer diagnosis, physical symptom burden, and neuroticism, and may want to target these factors in future preventive interventions. Using Chicago as our case, this article puts forth a notion of black placemaking that privileges the creative, celebratory, playful, pleasurable, and poetic experiences of being black and being around other black people in the city. Black placemaking refers to the ways that urban black Americans create sites of endurance, belonging, and resistance through social interaction. Our framework offers a corrective to existing accounts that depict urban blacks as bounded, plagued by violence, victims and perpetrators, (...) unproductive, and isolated from one another and the city writ large. While ignoring neither the external assaults on black spaces nor the internal dangers that can make everyday life difficult, we highlight how black people make places in spite of those realities. Our four cases – the black digital commons, black public housing reunions, black lesbian and gay nightlife, and black Little League baseball – elucidate the matter of black lives across genders, sexualities, ages, classes, and politics. Contemporary biologists are not agreed on the question of whether there are any human races, despite the widespread scientific consensus on the underlying genetics. For most purposes, however, we can reasonably treat this issue as terminological. What most people in most cultures ordinarily believe about the significance of “racial” difference is quite remote, I think, from what the biologists are agreed on. Every reputable biologist will agree that human genetic variability between the populations of Africa or Europe or Asia is (...) not much greater than that within those populations; though how much greater depends, in part, on the measure of genetic variability the biologist chooses. If biologists want to make interracial difference seem relatively large, they can say that “the proportion of genic variation attributable to racial differences is … 9 – 11%.”1 If they want to make it seem small, they can say that, for two people who are both Caucasoid, the chances of difference in genetic constitution at one site on a given chromosome are currently estimated at about 14.3 percent, while for any two people taken at random from the human population, they are estimated at about 14.8 percent. The statistical facts about the distribution of variant characteristics in human populations and subpopulations are the same, whichever way the matter is expressed. Apart from the visible morphological characteristics of skin, hair, and bone, by which we are inclined to assign people to the broadest racial categories—black, white, yellow—there are few genetic characteristics to be found in the population of England that are not found in similar proportions in Zaire or in China; and few too which are found in Zaire but not in similar proportions in China or in England. All this, I repeat, is part of the consensus . A more familiar part of the consensus is that the differences between peoples in language, moral affections, aesthetic attitudes, or political ideology—those differences which most deeply affect us in our dealings with each other—are not biologically determined to any significant degree.[…]In this essay, I want to discuss the way in which W. E. B. Du Bois—who called his life story the “autobiography of a race concept”—came gradually, though never completely, to assimilate the unbiological nature of races. I have made these few prefatory remarks partly because it is my experience that the biological evidence about race is not sufficiently known and appreciated but also because they are important in discussing Du Bois. Throughout his life, Du Bois was concerned not just with the meaning of race but with the truth about it. We are more inclined at present, however, not to express our understanding of the intellectual development of people and cultures as a movement toward the truth; I shall sketch some of the reasons for this at the end of the essay. I will begin, therefore, by saying what I think the rough truth is about race, because, against the stream, I am disposed to argue that this struggle toward the truth is exactly what we find in the life of Du Bois, who can claim, in my view, to have thought longer, more engagedly, and more publicly about race than any other social theorist of our century. 1. Paul (Noûs 36:578–596, 2002; Noûs 40:623–659, 2006, The Handbook of Mereology, forthcoming) has argued for a bundle theory of objects that analyzes the bundling relation between properties and objects in terms of parthood relations. In this paper I argue that any mereological bundle theory with the explanatory power of Paul’s theory will entail the principle of the identity of indiscernibles (PII). This is problematic, since similar bundle theories seem to fall to Max Black’s two sphere counterexample to (PII). I (...) argue, however, that a fully developed mereological bundle theory provides a new way of interpreting Black’s two sphere universe that dispels the counterexample. I argue that this solution to Black’s puzzle is superior to other solutions on offer, and consequently that mereological bundle theory is an attractive ontological strategy for friends of (PII). The Nation of Islam (NOI) has intrigued American society since its inception in 1930. Historically, the religio-nationalist organization has been the object of admiration for its uncanny ability to reform the lives of downtrodden blacks. At the same time, the NOI has garnered condemnation for the controversial, racialized and divisive doctrine that it espouses. This condemnation has led to a dismissal of the NOI’s doctrine as reactionary, bigoted, and fanciful myth-making. In recent decades however, scholars have begun interrogating the doctrine (...) of the NOI. Rather than dismissing it, scholars in various fields have recognized the critical and phenomenological nature of its doctrine as it goes about the “mental, physical, and spiritual resurrection” of black Americans. In this article, I interrogate three of the most controversial claims of the NOI: The White man is the devil, the Black man is God, and its endorsement of the separation of Blacks into their own territory. Viewed through the lens of phenomenology, I submit that the NOI’s doctrine and actions should be viewed as the establishment of an emancipative and recuperative “Phenomenology of Blackness” that counters a lifeworld built upon the disembodiment and dehumanization of Black bodies. Reframing the NOI’s doctrine in this way positions it as a linguistic, religiously stylized, praxis-oriented critical hermeneutic phenomenology. (shrink)

Rapid actions to persons holding weapons were simulated using desktop virtual reality. Subjects responded to simulated (a) criminals, by pointing the computerÕs mouse at them and left-clicking (simulated shooting), (b) fellow police officers, by pressing the spacebar (safety signal), and (c) citizens, by inaction. In one of two tasks Black males holding guns were police officers while White males holding guns were criminals. In the other, Whites with guns were police and Blacks with guns were criminals. In both tasks (...) Blacks or Whites holding harmless objects were citizens. Signal detection analyses revealed two race effects that led to Blacks being incorrectly shot at more than Whites: a perceptual sensitivity effect (when held by Blacks guns were less distinguishable from harmless objects) and a response bias effect (objects held by Blacks were more likely to be treated as guns). Using the Implicit Association Test (IAT), recent experiments have demonstrated a strong and automatic positive evaluation of White Americans and a relatively negative evaluation of African Americans. Interpretations of this finding as revealing pro-White attitudes rest critically on tests of alternative interpretations, the most obvious one being perceivers’ greater familiarity with stimuli representing White Americans. The reported experiment demonstrated that positive attributes were more strongly associated with White than Black Americans even when (a) pictures of equally unfamiliar Black (...) and White individuals were used as stimuli and (b) differences in stimulus familiarity were statistically controlled. This experiment indicates that automatic race associations captured by the IAT are not compromised by stimulus familiarity, which in turn strengthens the conclusion that the IAT measures automatic evaluative associations. © 2000 Academic Press.. In Interplay of Things Anthony B. Pinn theorizes religion as a technology for interrogating human experiences and the boundaries between people and other things. Rather than considering religion in terms of institutions, doctrines, and creeds, Pinn shows how religion exposes the openness and porousness of all things and how they are always involved in processes of exchange and interplay. Pinn examines work by Nella Larsen and Richard Wright that illustrates an openness between things and traces how pop art and (...) readymades point to the multidirectional nature of influence. He also shows how Ron Athey's and Clifford Owens' performance art draws out inherent interconnectedness to various cultural codes in ways that reveal the symbiotic relationship between art and religion as a technology. Theorizing that antiblack racism and gender- and class-based hostility constitute efforts to close off the porous nature of certain bodies, Pinn shows how many artists have rebelled against these attempts to counter openness. One of the best gimmicks on the cognitive science conference circuit is the demonstration of inattentional blindness. Many readers of this journal must have already been exposed to it. For the rest we will briefly describe a striking and popular demonstration. It typically evolves during a conference talk, where the presenter provides the audience with a stimulus in the form of a small video clip of six people, three in white, three in black, who pass two basket balls around. (...) The instruction is to count the number of passes made by the players in white. When the movie is over, the presenter asks for a response, someone provides it, and he then goes on to elicit a report: 'Did anyone notice something strange during the film?' Usually, only those who have seen the film before have, but they are not allowed to answer. The film is then replayed, but this time, the audience is instructed to look out for anything unusual. Muted, surprised laughter goes through the auditorium when someone dressed as a gorilla enters into the scene of kids playing, confronts the spectators, bangs his chest, and slowly walks out again. It seems incredible that it went unnoticed the first time around, and yet those who have been exposed to the experiment before can testify that the gorilla was indeed there in both showings of the film. Crespi & Badcock (C&B) provide a novel hypothesis outlining a role for imprinted genes in mediating brain functions underlying social behaviours. The basic premise is that maternally expressed genes are predicted to promote hypermentalistic behaviours, and paternally expressed genes hypomentalistic behaviours. The authors provide a detailed overview of data supporting their ideas, but as we discuss, caution should be applied in interpreting these data.

This study examines the idea of consciousness as a phenomenal reality in the writings of legendary civil rights figures, Howard W. Thurman and Huey P. Newton. Thurman is best known for his 1949 title, Jesus and the Disinherited, which is said to have inspired Dr. Martin Luther King, while Newton is best known for his work with The Black Panthers.

In 1988, the California state legislature passed the California Street Terrorism Enforcement and Prevention Act, which allowed courts to “enhance” the sentences of offenders who have been proven to "promote, further, or assist in any criminal conduct by gang members." It bundled together criminality, policing, and incarceration in ways that drew upon the fears of the black/latino Others that were imminent in panics surrounding the “crack epidemic” and inner-city crime. Jumping to April 2016, the Salvadoran government has passed strikingly (...) similar legislation, which centers on reclassifying gang-associated crimes as terroristic; in essence under their new laws gang affiliation is a terrorist. This, too, has been enacted in the midst of panic about gang violence and low-level warfare between gangs and the Salvadoran state. The adoption of US-style anti-gang approaches by the Salvadoran government is not new. In 2003, the right-wing government passed mano dura [“iron fist”] policies that sought to address increases in gang associate crime with zero-tolerance, tough-on-crime measures. Law enforcement received expanded leeway to target and arrest gang members, especially those from Mara Salvatrucha 13 and Barrio 18. Despite the lack of sustained reductions in violent crime, the mano dura policies have remained and will only be exacerbated by the new legislation. (shrink)

In recent years there has been a significant growth in interest of the so-called 'law in context' extending legal studies beyond black letter law. This book looks at the relationship between statute law and legal practice. It examines how law is applied in reality and more precisely how law is perceived by the general public in contrast to the legal profession. The authors look at a number of themes that are central to examining ways in which myths about law (...) are formed, and how there is inevitably a constitutive power aspect to this myth making. At the same time they explore to what extent law itself creates and sustains myths. Sara Suleri has written recently, in Meatless Days, of being treated as an "otherness machine"-and of being heartily sick of it.20 Perhaps the predicament of the postcolonial intellectual is simply that as intellectuals-a category instituted in black Africa by colonialism-we are, indeed, always at the risk of becoming otherness machines, with the manufacture of alterity as our principal role. Our only distinction in the world of texts to which we are latecomers is that we can mediate it to our (...) fellows. This is especially true when postcolonial meets postmodern; for what the postmodern reader seems to demand of Africa is all too close to what modernism-in the form of the postimpressionists-demanded of it. The role that Africa, like the rest of the Third World, plays for Euro-American postmodernism-like its better-documented significance for modernist art-must be distinguished from the role postmodernism might play in the Third World; what that might be it is, I think, too early to tell. What happens will happen not because we pronounce on the matter in theory, but will happen out of the changing everyday practices of African cultural life.For all the while, in Africa's cultures, there are those who will not see themselves as Other.
