Health systems are integrating medical-legal partnerships (MLPs) into clinical care and increasingly center “complex care” patients. These patients have intersecting medical and social needs and often face systemic inequities that exacerbate their chronic health conditions. This paper describes a role for MLPs in hospital quality initiatives; examines the ethics of MLPs assisting with guardianship and institutionalization of hospital patients including marginalized groups; and advocates for MLP interventions designed to address intersectional and ethical concerns.

This study focuses on CEO hubris and its effect on corporate unethical behaviour—pollution in particular, and in addition examines critical institutional contingencies [state ownership, political connection and industrial competition] which may moderate this effect. With data from over-polluting listed firms based on the real-time pollution monitoring system in transitional China from 2015 to 2017, we find that CEO hubris is significantly positively related to firm pollution, and that the moderating role of SO is not significant, that PC positively moderates the (...) hubris–pollution relationship and that industrial competition negatively moderates this relationship. These findings contribute to research on the upper echelon theory, institutional theory and the growing literature on emerging economies. (shrink)

The role of board secretaries is a unique institutional feature in China. Individuals in this senior executive role are responsible for coordinating information disclosure. We study the impact of board secretaries on management earnings forecasts and find that their legal expertise, accounting expertise and foreign experience help improve management earnings forecast quality. The quality of forecasts, as indicated by their occurrence, frequency, precision and accuracy, is also positively associated with the role duality and equity holdings of board secretaries and negatively (...) associated with their political connection. The quality of forecasts is found to increase the compensation of board secretaries. Finally, we show that the equity holding of board secretaries reduces litigation risks and increases corporate philanthropic giving. (shrink)

With the global pandemic of COVID-19, it has been striking psychological burdens on individuals. Under this background, more and more people get wellbeing by watching live broadcasts. However, the psychological mechanism behind this phenomenon is still a black box. This study finds that when people watch a live broadcast and interact with anchors and other people, an interaction ritual chain is formed, and emotional energy is generated, thus making people experience and understand the meaning of the live interaction ritual chains. (...) Under the effect of the meaning transfer model, people will generate wellbeing. Specifically, the basic meaning of live interaction drives people’s generation of wellbeing. The meanings of self-participation, self-display, self-concept, and self-renewal play a role in mediation in enhancing people’s wellbeing with the basic meaning of live broadcast interaction. This paper evaluates Tu Wei-ming's proposal that the Confucian ideal model of human society should be viewed as a fiduciary community. To do the evaluation, I provide a systematic elaboration of Tu's proposal, which is essentially absent in Tu's writings, and a systematic explication of the Confucian theory of fiduciarity, which is supposed to be the theoretical foundation of Tu's proposal but is completely absent in the studies of Confucianism, including Tu's own. On the basis of these studies, I conclude (...) that the notion of fiduciary community is entailed by the Confucian tradition; tapping the resource of the Confucian tradition for appreciating, supporting and justifying a properly defined model of fiduciary society is practically relevant and important to the modern world; however, given Tu's own definition, the model of fiduciary community does not sufficiently characterise the Confucian ideal society. In the end, I suggest a new way to study Confucian social ideals. (shrink)

Business groups dominate the economic landscape in many economies around the world. While business groups overcome the institutional voids arising due to inefficiencies of external markets, they also possess market power, which could be economically and socially counterproductive, especially for unaffiliated firms. Drawing on the transaction cost and industrial organization economics, we examine whether the presence of business group affiliated firms in industries restricts the entry of unaffiliated firms or firms affiliated with small- and medium-size business groups. Findings based on (...) Indian firms suggest that investments by business group affiliated firms in an industry have an inverted U-shaped relationship with the investment by unaffiliated firms. However, investments by firms affiliated with large-sized business groups have a U-shaped relationship with the investment by affiliates of small and medium business groups. These findings suggest that the market power of business groups and entry barrier relationship is contingent on the size of the business groups. (shrink)

P2P (Peer-to-Peer) file-sharing or file-swapping has led to many disputes about copyright laws and has become “a worldwide problem.” This paper first describes the development of P2P and then discusses some of the disputes concerning Chinese copyright laws. Given the difficulties in implementing copyright laws in China and many other countries, this paper next analyzes the reasons why and the conditions under which P2P developed, its impact on music production, and some other general economic, social, and ethical implications of this (...) technology. The paper recognizes, on the one hand, the significance of P2P as an advanced technology for popularizing music and sharing human and spiritual values with more people, on the other hand, it points to several critical issues caused by the current illegal use of this technology for sharing copyrighted music files: e.g., the serious damage to music production and the infringement on copyright holders’ interests. It is hypothesized argue that the technological conditions, social demands, and problems with the current type of music production have deepened the present crisis, and a new type of music production is sought. Legislation should enhance such a development, support P2P technology in the interest of the public, protect copyrights, and regulate P2P stakeholders’ interests in a balanced manner according to the ethics of law. This brief note aims at contributing to the study of the reception of parabiblical narratives in hadith literature and Islamic historiography. Taking the Testament of Abraham as a case study, it sets out to analyse a particular literary motif shared by this text and an early version of the miʿrāǧ (Ascension) of the Prophet Muhammad. The comparative analysis demonstrates that the Testament of Abraham could have provided a number of elements for the redaction of at least one particular section of (...) the miʿrāǧ. This hypothesis finds support in other cases of textual correspondence between several sections of the Testament of Abraham and other Islamic works such as the Tafsīr of Muqātil ibn Sulaymān (d. 150/767), the unedited Kitāb Mubtadaʾ al-dunyā wa-qiṣaṣ al-anbiyāʾ of Abū Ḥuḏayfa al-Buḫārī Isḥāq ibn Bišr (d. 206/821) and Ibn ʿAsākir’s Taʾrīḫ madīnat Dimašq (d. 571/1176). The examined material thus throws additional light on the continuity between late antique apocrypha and nascent Arabic literature. (shrink)

Focus of this article is Bernard's definitions and ideas surrounding power (potestas). The first section will outline terminology drawing a distinction between Bernard 's use of the terms potestas and auctoritas. Auctoritas is used less frequently by Bernard and is limited to descriptions of eccíesiastical matters; it is not predicated to the functions of a secular ruler whether king or emperor Conversely, potestas has a wide variety of uses and applications including descriptions of the power of God, the secular power (...) and the ecclesiastical power which is defined as potestas ligandi et solvendi. Given its range of meanings and uses, potestas is not a technical term for Bernard. Rather potestas is a biblical term of which the frequency and prevalence in the text of the Vulgate certainly influenced Bernard. Since Bernard uses potestas in both ecclesiastical and secular descriptions, other terms are helpful in drawing distinctions between the two spheres, e.g. ministerium and dominium, which as contrasting terms provide a point of entry into this discussion. Turner (bio)Jackson and Fulford have written an impor-tant paper which addresses an area of increasing interest in the United States—the relationship between religious/spiritual experiences and psychopathology. Using primarily the Present State Examination as the diagnostic framework, the authors describe in rich clinical detail three patients where certain phenomena lead to a possible diagnosis of (...) schizophrenia. However, the patients’ outcomes were uniformly positive—how can this be? The authors argue persuasively for the importance of a contextual assessment “in which psychotic phenomena themselves are embedded in the values and beliefs of the person concerned.” In this commentary, we will first present innovations in the DSM-IV relevant to cultural and religious/spiritual issues, which complement the authors’ conclusions, and then comment upon the paper from this perspective.In the DSM-IV Introduction (1994), a section entitled “Ethnic and Cultural Considerations” provides a rationale for innovations in DSM-IV that better enables its use with culturally diverse individuals: “A clinician who is unfamiliar with the nuances of an individual’s cultural frame of references may incorrectly judge as psychopathology those normal variations in behavior, belief, or experience that are particular to the individual’s culture. For example, certain religious practices or beliefs (e.g., hearing or seeing a deceased relative during bereavement) may be misdiagnosed as manifestations of a Psychotic Disorder” (xxiv). In the introduction, three types of information are cited: 1) sections entitled “Age, Gender and Cultural Considerations” in the text of ninety diagnostic categories discuss clinical variations due to these factors; 2) an Outline for Cultural Formulation designed to assist the clinician in systematically evaluating and reporting the impact of the individual’s cultural context; and 3) a Glossary of Culture-Bound Syndromes. These innovations, based on recommendations of the NIMH Workgroup on Culture, Diagnosis and Care to the Task Force on DSM-IV, are described in extensive detail in an important recent book (Mezzich, Kleinman, Fabrega, and Parron 1996).As an example of the importance of the Age, Gender, and Cultural Consideration section relevant to religious and spiritual experiences, consider the section in the text describing schizophrenia, where the following appears: “Clinicians assessing the symptoms of Schizophrenia in socioeconomic or cultural situations that are different from their own must take cultural differences into account. Ideas that may appear to be delusional in one culture (e.g., sorcery and witchcraft) may be commonly held in another. Secondly, in the analogous section of the text describing Brief Psychotic Disorder, the following appears: “It is important to distinguish symptoms of Brief Psychotic Disorder from culturally sanctioned response patterns. For example, in some religious ceremonies, an individual may report hearing voices, but these do not generally persist and are not perceived as abnormal by most members of the person’s community” (303).The Outline for Cultural Formulation provides the clinician a concise tool to specify the following information concerning the cultural context that is relevant to clinical care: cultural identity of the individual, cultural explanations of the individual’s illness, cultural factors related to psychosocial environment and levels of functioning, cultural elements of the relationship between the individual and the clinician, and overall cultural assessment for diagnosis and care. Religion is explicitly mentioned in the third section so as to encourage the assessment of “the role of religion... in providing emotional, instrumental, and information support” (1994, 844). This outline for cultural formulation is more fully explicated in a recent chapter by Lu, Lim, and Mezzich (1995).A major innovation in DSM-IV relevant to this topic is the new diagnostic category entitled Religious or Spiritual Problem defined as follows: “This category can be used when the focus of clinical attention is a religious or spiritual problem. Linear regression and its variants have been widely used for classification problems. However, they usually predefine a strict binary label matrix which has no freedom to fit the samples. In addition, they cannot deal with complex real-world applications such as the case of face recognition where samples may not be linearly separable owing to varying poses, expressions, and illumination conditions. Therefore, in this paper, we propose the kernel negative ε dragging linear regression method for robust classification on noised and nonlinear (...) data. First, a technique called negative ε dragging is introduced for relaxing class labels and is integrated into the LR model for classification to properly treat the class margin of conventional linear regressions for obtaining robust result. Then, the data is implicitly mapped into a high dimensional kernel space by using the nonlinear mapping determined by a kernel function to make the data more linearly separable. Finally, our obtained KNDLR method is able to partially alleviate the problem of overfitting and can perform classification well for noised and deformable data. Experimental results show that the KNDLR classification algorithm obtains greater generalization performance and leads to better robust classification decision. (shrink)

Based on data collected from a representative-sample survey conducted in five Chinese cities (Shanghai, Guangzhou, Wuhan, Chengdu, and Hangzhou) in the middle of 2008, this study examines the behavioral orientations of Chinese middle class toward the local elections which are held in urban areas, and the attitudinal orientations of Chinese middle class toward the current regime. The results indicate that there is a strong division within the group of the middle class, especially along the lines of the relationship with the (...) state. Therefore, this study suggests that the Chinese middle class is a class without a shared class identity. (shrink)

We use the framework of TTE, the representation approach to computable analysis, which allows (...) to define natural computability for a variety of operators. Over the last several decades many abortion advocates have attempted to spread confusion and doubt concerning the beginnings of human life. A particularly cynical strategy has involved invoking the authority historical thinkers, especially Doctors of the Church, to support the claim that (at least) early abortion does not constitute homicide because the early embryo is not yet fully human. Anyone familiar with context of these historical thinkers should realize that their specific judgments regarding abortion are now obsolete in virtue of (...) their primitive scientific understanding of embryology. In what follows, I summarize the Aristotelian embryology that explains why these historical thinkers held the views that they did. I then explore how we should best understand their broader ethical views in light of our vastly superior contemporary knowledge of human embryology. Unsurprisingly, it turns out that if we apply the contemporary empirical findings of embryology the very same metaphysical and ethical principles informing the thinking of the historical figures supports the prolife position. Philosopher Ludwig Wittgenstein had an enormous influence on twentieth-century philosophy even though only one of his works, the famous Tractatus Logico-Philosophicus, was published in his lifetime. Beyond this publication the impact of his thought was mainly conveyed to a small circle of students through his lectures at Cambridge University. Fortunately, many of his ideas have survived in both the dictations that were subsequently published, and the notes taken by his students, among them Alice Ambrose and the late Margaret Macdonald, (...) from 1932 to 1935. These notes, now edited by Professor Ambrose, are here published, and they shed much light on Wittgenstein's philosophical development. Among the topics considered are the meaning of a word and its relation to common usage, rules of grammar and their relation to fact, the grammar of first person statements, language games, and the nature of philosophy. The paper addresses the work of Ukrainian artist Maria Kulikovska, who resorts to military equipment as artistic materials and to destruction as an artistic method. In the first section, I contextualize Kulikovska’s performative sculpture within art history, claiming that it can be regarded as Destruction Art. In the second section, I turn to Catherine Malabou’s concept of “destructive plasticity” as a philosophical tool of an aesthetics of war, which offers a sound theoretical framework to further understand the implications of Kulikovska’s (...) artistic activity. In the third section, I focus on the main material adopted by Kulikovska, ballistic soap, showing how the artist materially deconstructs inherited dichotomies that keep informing our understanding of wars. By considering the artistic practice of a feminist artist (M. Kulikovska) through the lens of feminist scholarship (K. Stiles, C. Malabou, J. Butler), the paper investigates the relations between war and the arts from a situated perspective. (shrink)

This article focuses on possible convergences between phenomenology and anthropology and underlines their contributions to the analysis of a specific topic. In its reconstructive dimension it departs from Edmund Husserl’s positions in the letter he addressed to Lucien Lévy-Bruhl in 1935, in particular on the relationship between humanity and the surrounding word (Umwelt) and on the opposition between historical societies and primitive ahistorical societies. After having noted some critical points emerging from Husserl’s considerations, this text retraces some of its repercussions (...) on the thought of Maurice Merleau-Ponty and Jacques Derrida, whose diverging interpretations open up different ways of examining the relationship between the respective phenomenological and anthropological perspectives. Finally, with the aim of rethinking the contributions of these two fields to address the problem of the co-participation and the differentiations between the archaic and the current in descripted social structures by Lévy-Bruhl, this text turns to the specific temporality of totemic presentifications, which should become phenomenologically more detailed.
