The activism of institutional investors tends more and more toward the supervision and control of the behavior of the managers of big companies. In this article, we present a model based on the creation of an activism index that lets us evaluate such activism's effect on the sensitivity of the investment policies of a company in the face of financial variables and market variables. To test our assertions, we analyze firm-level data for United Kingdom, Germany, France, Denmark, and Spain during (...) the period 1995-2004. Our results point to a significant reduction in the sensitivity of company investment decisions in the face of these variables, especially relative to intangible capital, as a result of the neutralizing effect of activism on the high agency costs of free cash flow and on the information asymmetries of the market. Nature Network Groups hosted an invited workshop on 'Theories of Consciousness' during the second semester of 2009. There were presentations by each of 15 authors active in the field, followed by debate with other presenters and invitees. A week was allocated to each of the theories proposed; general discussion threads were also opened from time to time, as seemed appropriate. We offer here an account of the principal outcomes. Numerous eukaryotic DNA processing enzymes, such as DNA polymerases and ligases, bind the processivity factor PCNA, which acts as a platform to recruit and regulate the binding of enzymes to their DNA substrate. Multiple PCNA‐interacting motifs (PIPs) are present in these enzymes, but their individual structural and functional role has been a matter of debate. Recent cryo‐EM reconstructions of high‐fidelity DNA polymerase Pol δ (Pol δ), translesion synthesis DNA polymerase κ (Pol κ) and Ligase 1 (Lig1) bound to a DNA (...) substrate and PCNA demonstrate that the critical interaction with PCNA involves the internal PIP proximal to the catalytic domain. The ancillary PIPs, located in long disordered regions, are instead invisible in the reconstructions, and appear to function as flexible tethers when the enzymes fall off the DNA. In this review, we discuss the recent structural advancements and propose a functional hierarchy for the PIPs in Pol δ, Pol κ, and Lig1. (shrink)

Jewish law has a history stretching from the early period to the modern State of Israel, encompassing the Talmud, Geonic and later codifications, the Spanish Golden Age, medieval and modern responsa, the Holocaust and modern reforms. Fifteen distinct periods are separately studied in this volume, each one by a leading specialist, and the emphasis throughout is on the development of the institutions and sources of the law.

The distribution pattern of the meiotic machinery in known eukaryotes is most parsimoniously explained by the hypothesis that all eukaryotes are ancestrally sexual. However, this assumption is questioned by preliminary results, in culture conditions. These suggested that Acanthamoeba, an organism considered to be largely asexual, constitutively expresses meiosis genes nevertheless—at least in the lab. This apparent disconnect between the “meiosis toolkit” and sexual processes in Acanthamoeba led to the conclusion that the eukaryotic ancestor is asexual. In this review, the “meiosis (...) toolkit” is rigorously defended, drawing on numerous research articles. Additionally, the claim of constitutive meiotic gene expression is probed in Acanthamoeba via the same transcriptomics data. The results show that the expression of the meiotic machinery is not constitutive in Acanthamoeba as claimed before. Furthermore, it is argued that this would have no implications for understanding the nature of the eukaryotic ancestor, regardless of the result. (shrink)

The importance of Adam Ferguson as part of the Scottish Enlightenment has been well established, with concentration on his social and political thought. George Turnbull has not been as well studied, but the valuable recent anthology by M. A. Stewart and Paul Wood has incited new interest. This paper selects a narrow aspect of their thought, their views on the social role of knowledge, which show common as well as complementary aspects. As educators who published their enhanced class notes, their (...) concern for providing positive motivations for their students is evident from their writings. Moral philosophy courses in general attempted to prepare graduates to assume responsible roles in society. Turnbull emphasizes the inspirational value of order and beauty in nature, while Ferguson's particular interest is in the value of learning efforts and knowledge development as part of the cumulative progress of civilization. We believe that a joint review of their thought can provide a rich source of possibly inspirational and motivational themes that could be helpful for professionals and educators in any culture. These topics are discussed here in the broader context of the Scottish Enlightenment. (shrink)

Husserl on the Ego and its Eidos (Cartesian Meditations, IV) ALFREDO FERRARIN THE THEORY OF the intentionality of consciousness is essential for Husserl's philosophy, and in particular for his mature theory of the ego. But it runs into serious difficulties when it has to account for consciousness's transcendental constitution of its own reflective experience and its relation to immanent time. This intricate knot, the inseparability of time and constitution, is most visibly displayed in Husserl's writings from the 192os up (...) to the notion of the eidos ego in the fourth Cartesian Meditation. In this paper I want to dwell on the most problematic aspects of this theory. After a few preliminary remarks about the intentionality of consciousness (sec- tion 1), I try to place the theory of the substrate of habitualities in the context of Husserl's evolution on the issue of the reflection of the ego on itself (section ~). Husserl's Entwicklungsgeschichte on the topic of the pure ego has already been the object of important scholarly works, of which Kern's 1964 Husserl und Kant seems to me the best example. But what the secondary literature does not do is develop thematically the ambiguities of Husserl's definitions of consciousness and temporality in a unitary and comprehensive way. While I follow the lead of Berger, Broekman, Kern, Marbach,' and others, I find that their work does not sufficiently stress the difficulties at the core ofintentionality and reflective time- consciousness. Therefore, although section 2 is a necessary presupposition for drawing some critical conclusions in the final two sections, it does not exhaust my theme. After clarifying the peculiarity of the notions of essence, intuition, tran- scendental and apriori, as well as their irl:educibility to a Kantian meaning, I turn to the "de facto transcendental ego" resulting from eidetic variation (section 3) in order to introduce an examination of temporality. The difficul- ties in the twofold requirement, namely, that consciousness be the identical subject of its Erlebnisse and be synthetically unified in time, concern the unity, primacy, and mutual relation of time and consciousness in the constitution of our experience. They have been heady pointed out by Ricoeur in his commen- tary on the Cartesian Meditations. But what I want to argue in section 4, going beyond Ricoeur's text, is that the tension between temporally constituted and constitutive consciousness in the ego's reflection on its own retentions and protensions does not simply make the question of time ambiguous, but has crucial and problematic bearings on the very definition of consciousness as intentionality. This article seeks to take a step towards recognizing that science can deal with the concrete and individual as well as the universal. I shall concentrate on some of Aristotle’s texts, as there is a long tradition going back to Aristotle, according to which science deals only with the universal, although his work also contains texts of a very different tenor. He tries to improve the process of definition as an attempt to bring science closer to the concrete, but ends (...) up realizing that there are some unreachable limits. There is, however, a second Aristotelian approach to the problem in Metaphysica M 10, a passage which takes scientific rapprochement to the individual further by introducing a distinction between science in potential and science in act. The former is universal, but the latter deals with individual substances and processes. Aristotle himself acknowledges here that in one sense science is universal and in another it is not, a position that raises important ontological and epistemological problems. XIX español, el autor analizó los casos de importantes intelectuales como Juan Donoso Cortés, Jaime Luciano Balmes, Juan Valera, Marcelino Menéndez Pelayo, Alfredo Adolfo Camus y Nicolás Serrano. Con ello se cumplió parte del plan de desmontar la tesis frecuentemente aceptada de una "ausencia" de Vico en España. Este plan se viene a desarrollar ahora con una nueva aportación investigadora en la que el autor muestra y analiza (...) tres importantes casos más de recepción viquiana: la del ecléctico historiador Fermin Gonzalo Morón, la del renovador neoescolástico Ceferino González, y la del fundador de la escuela jurídica catalana Manuel Durán y Bas. Con ellos el autor confirma su tesis de que Vico es apreciado, tanto desde la recepción positiva como desde la crítica, como un pensador modemo y heterodoxo de considerable valía.In his former paper on Vico’s reception during the XIX century in Spain, the author reviewed such significant intellectuals as Juan Donoso Cortés, Jaime Luciano Balmes, Juan Valera, Marcelino Menéndez Pelayo, Alfredo Adolfo Camus and Nicolás Serrano. In so doing, the task of dislodging the thesis so frequently held that there is a Vico’s "absence" in Spain was partially accomplished. This task is taken up again in a recent investigation where the author analyzes and assesses three further important cases related with the Spanish Vichian reception: that of eclectic historian Femín Gonzalo Morón, the neo-scholastic Ceferino González and finally the Catalan legal school founder Manuel Durán y Bas. With those examples the author aims to validate his claim that Vico was indeed acknowledged both as a modern and heterodox thinker by the positive as well as by the critical reception. (shrink)

This content analysis examines the ways that genocide is included in the high school world history content standards of eleven states with legislative mandates requiring genocide education, as well as if the content standards in those states differ from those of states without mandated genocide education. The null curriculum theorizes that the content that is not taught may be as important as what is taught; this lens allows for a nuanced analysis of the ways that genocide is included and excluded (...) in state standards. The findings suggest that states with legislative mandates requiring genocide education do not necessarily have high school world history content standards that require genocide education. The content standards in states with legislative mandates often omit acts of genocide, refrain from using the term “genocide,” and frame genocides as less important than the Holocaust, perpetuating the null curriculum of genocides. BackgroundInformed consent as stipulated in regulatory human research guidelines requires volunteers to be well-informed about what will happen to them in a trial. However, researchers may be faced with the challenge of how to ensure that a volunteer agreeing to take part in a clinical trial is truly informed. This study aimed to find out volunteers’ comprehension of informed consent and voluntary participation in Human Immunodeficiency Virus (HIV) clinical trials during the registration cohort.MethodsWe conducted a qualitative study among volunteers who (...) were enrolled in the registration cohort of HIV clinical trials in Dar es Salaam, Tanzania. A purposive sampling strategy was used to obtain twenty study participants. The data were collected between June and September 2020 using a semi-structured interview guide. In-depth interviews were used to collect the data to obtain deep insights of the individual study participants on the comprehension of informed consent and participation in the clinical trial. A thematic analysis approach was used to analyze the data. Themes and subthemes were supported by the quotes from the participants.ResultsVolunteers described comprehension of informed consent from different perspectives. They reported that various components of the informed consent such as study procedure, confidentiality, risk and benefits were grasped during engagement meetings. Furthermore, the volunteers’ decision to participate in the registration cohort was voluntary. However, trial aspects such as health insurance, free condoms, and medical checkups could have indirectly influenced their reluctance to withdraw from the study.ConclusionEngagement meetings may increase the comprehension of informed consent among potential participants for HIV clinical trials. However, trial incentives may influence participation, and thus future research should focus on the challenges of giving incentives in the study. This will ensure comprehension and voluntary participation in the context of HIV clinical trials. (shrink)

Given a rich environment, how do we decide on what information to use? A view of a single entity (e.g., a group of birds) affords many distinct interpretations, including their number, average size, and spatial extent. An enduring challenge for cognition, therefore, is to focus resources on the most relevant evidence for any particular decision. In the present study, subjects completed three tasks—number discrimination, surface area discrimination, and convex hull discrimination—with the same stimulus set, where these three features were orthogonalized. (...) Therefore, only the relevant feature provided consistent evidence for decisions in each task. This allowed us to determine how well humans discriminate each feature dimension and what evidence they relied on to do so. We introduce a novel computational approach that fits both feature precision and feature use. We found that the most relevant feature for each decision is extracted and relied on, with minor contributions from competing features. These results suggest that multiple feature dimensions are separately represented for each attended ensemble of many items and that cognition is efficient at selecting the appropriate evidence for a decision. In this introduction to part 3 of the Common Knowledge symposium “Antipolitics,” the journal's editor argues that, apart from sortition, the best guarantees of safety in a democracy are, first, to augment judicial oversight of all political processes and, second, to exclude politicians from the process of selecting judges. “There can never be too much judicial interference,” he writes, “in what politicians regard as their domain.” The author reached this conclusion during attempts by the newly elected Israeli government, in the (...) spring of 2023, to make itself absolute by eliminating checks on its conduct that the Supreme Court had been developing and applying since the 1950s. Traditional Jewry and Judaism being notoriously hypernomian, the resistance to legality on the part of the ruling coalition has conveyed an aura of antinomian heresy. The choice in Israel appears to be between antipolitics and antinomianism, rather than between Left and Right politically—and the antipolitical model in Israel of a superintendent judiciary and an autonomous attorney general is arguably superior to the American prototype, even from the perspective (“all men are created equal..., endowed by their Creator with certain unalienable Rights”) that we have come to regard as quintessentially American. In this paper, I propose that Derrida’s writing on the impossibility of justice has the potential for fruitful dialogue with Ruth Chang’s contemporary account of practical rationality. For Derrida, making a just decision must always come with a moment of undecidability, a “leap” into the unknown with an experience of doubt and anxiety that continues to “haunt” the decision-maker. By contrast, in her work on rationality, Chang proposes that hard decisions are difficult to make because the alternatives are “on a (...) par,” such that there are no rational differences between the alternatives that would contribute to choosing one over the other. Hard decisions are made by expressing one’s own rational agency, generating will-based reasons to commit to or “drift” into one of the alternatives. Derrida writes of anxiety, doubt, and impossibility, yet Chang writes of commitment, agency, and rationality. Despite these differences, there are important comparisons and connections between the two accounts that are worth exploring. I suggest that the moment of the decision which Derrida describes as heterogeneous to knowledge can be understood as a moment of parity in which there is a lack of given reasons, as explained by Chang. Chang’s account of rational agency provides an interpretation of how decision-making is possible despite the undecidability as described by Derrida. This notion of commitment and agency as explained by Chang is not incompatible with Derrida’s insistence that the responsible decision is haunted by anxiety and doubt. Instead, I suggest that Derrida’s writing highlights uncertainty as central to understanding the nature of hard choices and how to navigate the demands of justice. (shrink)

The claim is that because they are responsible for what has happened to them, others are not obligated to (...) pay for their care. In a different context, it is claimed that because patients are, or should be, responsible for the kind of treatment they receive. They therefore need to be informed about the treatment options available to them so that they can decide which of these treatments, if any, they will undergo. The lecture provides an account of responsibility that fits claims of both of these kinds and explains how they are related. (shrink)

Is God's foreknowledge compatible with human freedom? One of the most attractive attempts to reconcile the two is the Ockhamistic view, which subscribes not only to human freedom and divine omniscience, but retains our most fundamental intuitions concerning God and time: that the past is immutable, that God exists and acts in time, and that there is no backward causation. In order to achieve all that, Ockhamists distinguish ‘hard facts’ about the past which cannot possibly be altered from ‘soft facts’ (...) about the past which are alterable, and argue that God's prior beliefs about human actions are soft facts about the past. The ineffectiveness of some elders and deacons of Maranatha Reformed Church of Christ to implement their functions and duties contributed to the deterioration of the spiritual and material sustainability of the church. To counteract this corrosion, the church established a training team that instituted an informal programme as a means of revitalising elders and deacons. After running a pilot project to test the training programme, the team presented its report to the General Church Assembly. A selective interpretation of informal education (...) can contribute to a misguided and limited perception of informal knowledge and acquisition as uncivilised and unsustainable. In this article, the researcher seeks to articulate the formal and informal dynamics of informal education. He employed an exploratory concurrent design of mixed methods research within an indigenous paradigm to analyse the report on training of elders and deacons. The researcher used a convenience sampling strategy to select the authors of the report, namely four trainers and four trainees, with whom he conducted a focus group discussion. Although strategically formulated, the learning activities and resources were continuously innovated in the informal programme for elders and deacons. The conclusion reached is that the learning process in informal education is flexible and mutually edifying for educators and trainees.Contribution: Education for the proclamation of the gospel and church governance is not intended exclusively for ministers or theologians. Despite their diversity, elders and deacons need to be educated on the proclamation of the gospel according to the teachings of their church, using their respective contexts. Informal education, which comprises formal and informal dynamics, can contribute towards addressing the problem of untrained elders and deacons. (shrink)
