This book offers a comprehensive account of vitalism and the Romantic philosophy of nature. The author explores the rise of biology as a unified science in Germany by reconstructing the history of the notion of “vital force,” starting from the mid-eighteenth through the early nineteenth century. Further, he argues that Romantic Naturphilosophie played a crucial role in the rise of biology in Germany, especially thanks to its treatment of teleology. In fact, both post-Kantian philosophers and naturalists were guided by teleological (...) principles in defining the object of biological research. The book begins by considering the problem of generation, focusing on the debate over the notion of “formative force.” Readers are invited to engage with the epistemological status of this formative force, i.e. the question of the principle behind organization. The second chapter provides a reconstruction of the physiology of vital forces as it was elaborated in the mid- to late-eighteenth century by the group of physicians and naturalists known as the “Göttingen School.” Readers are shown how these authors developed an understanding of the animal kingdom as a graded series of organisms with increasing functional complexity. Chapter three tracks the development of such framework in Romantic Naturphilosophie. The author introduces the reader to the problem of classification, showing how Romantic philosophers of nature regarded classification as articulated by a unified plan that connects all living forms with one another, relying on the idea of living nature as a universal organism. In the closing chapter, this analysis shows how the three instances of pre-biological discourse on living beings – theory of generation, physiology and natural history – converged to form the consolidated disciplinary matrix of a general biology. The book offers an insightful read for all scholars interested in classical German philosophy, especially those researching the philosophy of nature, as well as the history and philosophy of biology. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. This paper focuses on the _ethics of how_ to approach the introduction of MAiD as an organizational ethics challenge, a focus that diverges from the traditional focus in healthcare ethics on the _ethics of why_ MAiD is right or wrong. It describes a method co-designed and implemented by ethics and medical leadership at a tertiary hospital to develop a values-based, grassroots response to the decriminalization of assisted dying in Canada. This organizational ethics engagement method embodied core tenants that drew inspiration (...) from a variety of sources, including poetic ones. These tenants are: make the problem bigger; focus on values; cultivate open moral spaces; and trust emergence. The paper describes how these tenants were put into practice in order to create a rigorous and sustainable MAiD program that delivers high-quality care to patients and families while honoring the moral diversity of the hospital workforce. One of the goals in sharing this method is to provide a roadmap for healthcare organizations in Canada and other jurisdictions around the world that are facing the challenge of responding to patient requests for MAiD following the decriminalization of this care option. We characterize Hegel’s stance on biological purposiveness as consisting in a twofold move, which conceives organisms as intrinsically purposive natural systems and focuses on their behavioral and cognitive abilities. We submit that a Hegelian stance is at play in enactivism, the branch of the contemporary theory of biological autonomy devoted to the study of cognition and the mind. What is at stake in the Hegelian stance is the elaboration of a naturalized, although non-reductive, understanding of natural purposiveness.

This study assessed the attitudes and needs of physicians and health professional staff at a tertiary care hospital in Canada regarding the introduction of physician assisted dying (PAD) during 2015–16. This research aimed to develop an understanding of the wishes, concerns and hopes of stakeholders related to handling requests for PAD; to determine what supports/structures/resources health care professionals (HCP) require in order to ensure high quality and compassionate care for patients requesting PAD, and a supportive environment for all healthcare providers (...) across the moral spectrum. This study constituted a mixed methods design with a qualitative descriptive approach for the study’s qualitative component. A total of 303 HCPs working in a tertiary care hospital completed an online survey and 64 HCPs working in hospital units with high mortality rates participated in 8 focus group discussions. Both focus group and survey data coalesced around several themes to support the implementation of PAD following the decriminalization of this practice: the importance of high quality care; honoring moral diversity; supporting values (such as autonomy, privacy, beneficence); and developing resources, including collaboration with palliative care, education, policies and a specialized team. This study provided the foundational evidence to support the development of the PAD program described in other papers in this collection, and can be a model for gathering evidence from stakeholders to inform the implementation of PAD in any healthcare organization. This essay explores the connection between representation and explanation in the sciences. I suggest that scientific representation schemes be viewed as pragmatic tools for acquiring the sort of articulated awareness that is the hallmark of nontrivial knowledge. Crystal field theory in chemistry illustrates this perspective. Certain representations achieve the status of being paradigmatically explanatory, thereby shaping models of intelligibility. In turn, these explanatory preferences serve largely to define and differentiate disciplinary communities by implicitly endorsing particular epistemic aims and values. Human extinction is something generally deemed as undesirable, although some scholars view it as a potential solution to the problems of the Earth since it would reduce the moral evil and the suffering that are brought about by humans. We contend that humans collectively have absolute intrinsic value as sentient, conscious and rational entities, and we should preserve them from extinction. However, severe threats, such as climate change and incurable viruses, might push humanity to the brink of extinction. Should that (...) occur, it might be useful to envision a successor to humans able to preserve and hand down its value. One option would be to resort to humanoid robots that reproduce our salient characteristics by imitation, thanks to AI powered by machine learning. However, the question would arise of how to select the characteristics needed for our successors to thrive. This could prove to be particularly challenging. A way out might come from an algorithm entrusted with this choice. In fact, an algorithmic selection both at the social and at the individual level could be a preferred choice than other traditional ways of making decisions. In this sense, reflecting on human extinction helps us to identify solutions that are also suitable for the problems we face today. (shrink)

We outline an alternative to both scientific and liberal naturalism which attempts to reconcile Sellars’ apparently conflicting commitments to the scientific accountability of human nature and the autonomy of the space of reasons. Scientific naturalism holds that agency and associated concepts are a mechanical product of the realm of laws, while liberal naturalism contends that the autonomy of the space of reason requires that we leave nature behind. The third way we present follows in the footsteps of German Idealism, which (...) attempted to overcome the Kantian chasm between nature and agency, and is thus dubbed ‘post-Kantian.’ We point to an overlooked group of scholars in the naturalism debate who, along with recent work in biology and cognitive science, offer a path to overcome the reductive tendencies of empiricism while avoiding the dichotomy of logical spaces. We then bring together these different streams of research, by foregrounding and expanding on what they share: the idea of organisms as living agents and that of a continuity without identity between life and mind. We qualify this as a bottom-up transformative approach to rational agency, which grounds cognition in the intrinsically purposive nature of organisms, while emphasizing the distinction between biological agency and full-fledged mindedness. The theoretical perspectives of intersectionality and poststructuralism have contributed meaningfully to advancing issues of social injustice within the realm of women's health research. However, the question of whether the two approaches are epistemologically commensurate has been at the heart of a polarized debate within third‐ and fourth‐wave feminist literature in recent years. In this paper, we draw on the extant literature to explore existing dilemmas within this debate and critically reflect on points of epistemological tension and congruence between the two (...) perspectives. It will be demonstrated that intersectionality and poststructuralism, especially feminist poststructuralism, represent concordant theoretical perspectives and a synthesized theoretical framework for application in qualitative research into women's health will be proposed. We argue that an intersectional feminist poststructuralist framework contributes to a deepened analysis of women's disparate healthcare experiences, and the social mechanisms, power relations, and discourses that mediate these experiences, while offering avenues for advocacy and political praxis on a multitude of levels. In this paper I develop a conception of joint practical deliberation as a special type of shared cooperative activity, through which co-deliberators jointly accept reasons as applying to them as a pair or group. I argue, moreover, that the aspiration to deliberative “pairhood” is distinguished by a special concern for mutuality that guides each deliberator’s readiness to accept a given consideration as a reason-for-us. It matters to each of us, as joint deliberators, that each party’s (individual) reasons for accepting something (...) as a reason-for-us support a conception of our relationship as one characterized by mutual, non-instrumental concern for one another. In a recent paper, Cassinadri raised substantial criticism about the possibility of using moral reasons to endorse the hypothesis of extended cognition over its most popular alternative, the embedded view. In particular, Cassinadri criticized 4 of the arguments we formulated to defend EXT and argued that our claim that EXT might be preferable to EMB does not stand close scrutiny. In this short reply, we point out—contra Cassinadri—why we still believe that there are moral reasons to prefer EXT over EMB, (...) hence why we think that the former is more inclusive and more progressive than the latter. Several experimental studies have reported that an otherwise robust regularity—the disparity between Willingness-To-Accept and Willingness-To-Pay—tends to be greatly reduced in repeated markets, posing a serious challenge to existing reference-dependent and reference-independent models alike. This article offers a new account of the evidence, based on the assumptions that individuals are affected by good and bad deals relative to the expected transaction price (price sensitivity), with bad deals having a larger impact on their utility (`bad-deal’ aversion). In light of the impact of work on human flourishing, an intractable problem for political theorists concerns the distribution of meaningful work in a community of moral equals. This article reviews a number of partial solutions that a well-ordered society could draw upon to provide equality of opportunity for eudemonistically meaningful work and to minimize the impact of bad work upon those who perform it. Even in view of these solutions, however, it is not likely that opportunities for meaningful work (...) can be guaranteed for all people, which carries an implication that, even in well-ordered societies, it is likely that not all people will flourish. The author argues that the limitedness of meaningful work is not a reason to reject the normative claim that meaningful work is integral in flourishing, nor is it a reason against working to transform social and political institutions to increase opportunities for meaningful work. The aim of this article is to question the nature of the socio-anthropological approach in Lefort’s thought. The author explores the complex relationship between Lefort and the Durkheimian French school of sociology in four stages: in the first, he shows Lefort as a sociologist ‘worthy of its name’ or, in other words, a sociologist interested in questioning the ‘institution of the social’. In the second, he focuses on the disturbing elements that Lefort introduces: the political and the division into the (...) French sociological approach. In the third stage, he focuses his attention on the sociological approach in Lefort’s way of thinking about democratic society. Finally, he concludes by referring to Lefort’s apparent opposition between philosophy and social sciences – and the errors that this may have engendered – in order to demonstrate the continuity of Lefort’s sociological approach. We begin our commentary by summarizing the commonalities and differences in cognitive phenomena across cultures, as found by the seven papers of this topic. We then assess the commonalities and differences in how our various authors have approached the study of cognitive diversity, and speculate on the need for, and potential of, cross-disciplinary collaboration.

To date, business ethicists, corporate social responsibility scholars as well as management theorists have been slow to provide a comprehensive and critical scrutiny of the Living Wage concept. The aim of this article, therefore, is to conceptualize the living wage in its philosophical as well as practical dimensions in order to open up the ethical implications of its introduction and implementation by companies. We set out the legal, socio-institutional and economic contexts for the debates around the LW and review arguments (...) for, and against, it. Key philosophical arguments from the perspectives of sustainability, capability and externality are invoked and discussed in order to demonstrate the issues and challenges involved for companies, state and civil society actors. Relevant examples from the private sector are examined to demonstrate some of the practical issues involved when the LW is introduced by employers. The article also recommends avenues for a research agenda into the LW for business ethicists, CSR and management researchers in contexts such as the UK, where a voluntary, rather than mandatory, approach to the implementation of the LW is adopted. Clinical Ethics, Ahead of Print. ObjectiveThe purpose of this study was to assess if a relationship existed between audiologists’ perceptions of moral distress, occupational wellbeing, and patient-practitioner orientation.DesignThe Moral Distress Thermometer, Health and Safety Executive Management Standards Indicator Tool and Patient-Practitioner Orientation Scale was sent out to all audiologists registered with the professional body Audiology Australia.Study sample: A total of 43 audiologists completed the questionnaires.ResultsUsing a multiple linear regression model there was no evidence of a relationship between patient-practitioner orientation and (...) either moral distress or occupational wellbeing. However, an association between higher moral distress and lower occupational wellbeing was demonstrated. The occupational wellbeing subscales of ‘managerial support’, ‘peer support’, ‘relationships’, ‘role’, and ‘change’ were strongly associated with poorer scores on moral distress.ConclusionFor our sample of audiologists, ethical conflict appeared to be linked to reduced job satisfaction. There is a need to consider ways of providing supportive organisational structures in which ethical conflicts can be openly discussed and negotiated in order to improve occupational wellbeing in the profession. Medical Assistance in Dying (MAiD) in Canada has had a tumultuous social and legal history. In the 6 years since assisted dying was decriminalized by the Canadian Parliament in June 2016, the introduction of this practice into the Canadian healthcare system has been fraught with ethical challenges, practical hurdles and grass-roots innovation. In 2021, MAiD accounted for approximately 3.3% of all Canadian deaths annually, and more patients are seeking MAiD year over year as this option becomes more widely know. Unfortunately, (...) some patients who want MAiD are unable to access it in a timely manner because of a lack of willing MAiD providers. This introduction describes statistics about the uptake of MAiD in Canada and the challenges presented by Canadians’ rapid acceptance of this end of life care option. In this special edition of HEC Forum about the implementation of MAiD in Canada, authors depict a range of ethical challenges and strategies to address issues related to MAiD access and quality, organizational engagement, clinician recruitment and retention, and support for a morally diverse workforce. In each article, the authors reflect on the question: What are the practical ethics involved in introducing assisted dying into a new healthcare context, and how can ethicists and ethics resources collaborate with stakeholders to ensure the integration of ethical considerations as this practice continues to evolve? This paper explores the theory and practice of embodied epistemology or mindful embodiment in ethics case consultation. I argue that not only is this epistemology an ethical imperative to safeguard the integrity of this emerging profession, but that it has the potential to improve the quality of ethics consultation (EC). It also has implications for how ethics consultants are trained and how consultation services are organized. My viewpoint is informed by ethnographic research and by my experimental application of mindful embodiment (...) to the development of an ethics consultation service. My argument proceeds in four phases. First I explore the notion of ‘situatedness’ in the bioethics literature, identifying gaps in the field's theories as they apply to EC. I then describe my theoretical approach to embodiment grounded in critical-interpretive medical anthropology and autoethnography. I use embodiment to refer to a moral epistemology grounded in the body, comprised of the interplay of physical, symbolic, intersubjective and political elements. Third, I describe how mindful embodiment can inform the role of the ethics consultant and the development of effective training techniques, vocabularies and processes for EC. I also discuss the benefits of this orientation, and the potential harms of ignoring the embodied dimensions of EC. My goals are to expose the fallacy of the ‘theory-practice gap’, to demonstrate how my own EC practice is deeply informed by this theoretical orientation, and to argue for a wider definition of what ‘counts’ as relevant theory for ethics consultation. In this paper I explore the issue of how our personal life is given to us in experience as a whole to be actively shaped and determined. I examine in detail Husserl’s analysis of the kind of experience responsible for this achievement, which he terms Überschau and which thus far has never been addressed by scholars of phenomenology. First, I locate Überschau in the context of self-determination and highlight the difference between the unthematic pre-givenness of life in the phenomenon of (...) self-awareness and the actual, i.e. thematic givenness of life in acts of Überschau. Second, I contextualize Husserl’s discovery of Überschau in his analyses of ethical life and the possibility of a universal epoché. I argue that for Husserl the very possibility of ethical life and of phenomenology itself rest on the totalizing apprehension of one’s life rendered possible by Überschau. In the third section I spell out the essential characteristics of Überschau by contrasting this peculiar kind of consciousness with reproductive forms of consciousness such as recollection and expectation, which otherwise might be easily conflated with Überschau. In section four I reply to a possible objection to the very possibility of Überschau based on the consideration of the infinitely open stream of time-consciousness. I argue that the possibility of Überschau is tightly connected with the egological nature of consciousness as understood by Husserl. The ego does not coincide with its own conscious acts and thus enjoys a special vantage point on the totality of its own life. To conclude, I advance a speculative suggestion about the phenomenological origin of Überschau in the structure of self-awareness. This opens up a variety of possible lines of research that would connect Husserl with philosophers such as Augustine or Heidegger who are more immediately associated with the issue of personal life and its unity or lack thereof. Previous research showed that story illustrations fail to enhance young preschoolers' memories when they accompany a pre-recorded story (e.g., Greenhoot and Semb, 2008 ). In this study we tested whether young children might benefit from illustrations in a more interactive story-reading context. For instance, illustrations might influence parent-child reading interactions, and thus children's story comprehension and recall. Twenty-six 3.5- to 4.5-year-olds and their primary caregivers were randomly assigned to an Illustrated or Non-Illustrated story-reading condition, and parents were instructed to “read (...) or tell the story” as they normally would read with their child. Children recalled the story after a distracter and again after 1 week. Analyses of the story-reading interactions showed that the illustrations prompted more interactive story reading and more parent and child behaviors known to predict improved literacy outcomes. Furthermore, in the first memory interview, children in the Illustrated condition recalled more story events than those in the Non-Illustrated condition. Story reading measures predicted recall, but did not completely account for picture effects. These results suggest that illustrations enhance young preschoolers' story recall in an interactive story reading context, perhaps because the joint attention established in this context supports children's processing of the illustrations. Abstract. What kind of consciousness is best prepared to undertake effective interdisciplinary explorations in religion and science in our twenty-first century context? This paper draws on the thought of theologian David Tracy and psychologist and philosopher of religion James W. Jones to suggest that negation and ecstasy are mutually conditioning factors that go into the shaping of just such a consciousness. Healthy, constructive modes of relating to the disciplinary other imply the emergence of a transformed way of knowing and being (...) wherein the scholar countenances the loss of controlling and autonomous ways of relating (negation), and precisely in that loss, enters into shared spaces of mutually illuminative and transformative understanding (ecstasy). According to a traditional view, logical validity consists in necessary truth preservation. Such an account has been argued to carry an apparent commitment to a unique property of truth to be preserved from premises to conclusion. Recent discussions, however, have concluded that if the metaphor of truth preservation is carefully unpacked, no need for a unique property is there. All is needed is that certain structural relations among instantiations of truth properties hold. Against this view, we argue that a unique (...) general truth property is indeed required by logical validity. We first show that the unpacking should be correctly understood since it imposes constraints on the concept and the properties of truth. We then demonstrate that, under such constraints, a general property is not imposed by truth preservation but by another feature of validity: its uniformity. Finally, some options that could be attempted to resist this result are discussed, showing that (strong) truth pluralism and deflationism are affected in different ways. (shrink)

Reflecting on ‘human development’ theorists face conceptual confusion, borne out experientially by contemporary ecological, social, and economic crises. Since concepts create realities (i.e. justify and motivate practices), and philosophers create concepts, it is important to consider how philosophers might respond to conceptual difficulties caused by the modern era’s still influential ‘binary’ paradigm, exemplified by the law of the excluded middle, which entails a discursive split between modernism’s ultimately predictable cosmos and postmodernism’s insistence on fundamental chaos. Supposedly obliged to choose between (...) opposites, theorists are caught between the necessity and iniquity of both. This impasse sets up conditions for what Lyotard calls ‘differends,’ and constrains our power to create responsible concepts. To show that Morin’s ‘generalised complexity’ takes us beyond the modernist/postmodernist impasse, I take up his injunction to promote ‘an epistemological reversal,’ starting from the notion of ‘open system’ and moving through ‘emergence’ and ‘organization’ to ‘logical complexity.’ Our epistemological task accordingly is to establish strategies for interpreting multiple dimensions of phenomenal reality, given the irreducibly complex relation of co-implication between mutually negating opposites. I agree with Cilliers that deconstruction is exemplary in this respect, but aim to broaden the adventure by suggesting ideas for a ‘pragmatics of complexity’ involving vocabulary, concepts, strategies, metaphors, and heuristics derived also from other philosophers and psychoanalytic theorists. The difficulty of complex thought is that it must face messes ... interconnectedness among phenomena, fogginess, uncertainty, contradiction. However, we can elaborate some conceptual tools, some principles for this adventure, and we can begin to perceive the face of the new paradigm of complexity that should emerge. Though widely derided by popular psychologists and self-help writers as an emotionally toxic and destructive response, blame has many defenders among contemporary moral philosophers. Blaming wrongdoers has been thought to express deep commitment to moral values and norms, to be intimately bound up with practices of holding others responsible, and to be an important exercise of moral agency. In this paper I push against the grain of such defenses of blame just enough to articulate what seems right in the more (...) popular lines of critique. I distinguish between blame as a reactive attitude and blaming as a speech act, and argue that some disagreement over the value of blame can be explained by the fact that blaming, as a speech act, takes several distinct forms. Critiques of blame, I suggest, properly target what we might call judgmental or strongly verdictive blaming, the sort of blaming that passes judgment on the wrongdoer him- or herself, and treats him or her as deserving of the blamer’s hostile or “punishing” reactions. This kind of blaming, I argue, tends to foreclose engagement in further moral dialogue with wrongdoers, an effect that is particularly destructive in therapeutic contexts. In such contexts, it is often more appropriate—and more constructive—to hold others answerable without blaming them in the strongly verdictive sense. I argue, moreover, that strongly verdictive blame may be similarly destructive outside of straightforwardly therapeutic contexts, and I challenge the idea that there is in any case a sharp or clear dividing line between therapeutic and non-therapeutic responses to wrongdoers. Holding answerable in a non-judgmental mode is a response that may have a therapeutic dimension, but it nonetheless engages a wrongdoer as a moral peer and partner in moral dialogue. This account of non-judgmental answerability, I suggest, captures much of what moral philosophers have taken to be valuable about blame, while accommodating the insights of those who criticize its more toxic forms. Online controlled experiments, also known as A/B tests, have become ubiquitous. While many practical challenges in running experiments at scale have been thoroughly discussed, the ethical dimension of A/B testing has been neglected. This article fills this gap in the literature by introducing a new, soft ethics and governance framework that explicitly recognizes how the rise of an experimentation culture in industry settings brings not only unprecedented opportunities to businesses but also significant responsibilities. More precisely, the article (a) introduces a (...) set of principles to encourage ethical and responsible experimentation to protect users, customers, and society; (b) argues that ensuring compliance with the proposed principles is a complex challenge unlikely to be addressed by resorting to a one-solution response; (c) discusses the relevance and effectiveness of several mechanisms and policies in educating, governing, and incentivizing companies conducting online controlled experiments; and (d) offers a list of prompting questions specifically designed to help and empower practitioners by stimulating specific ethical deliberations and facilitating coordination among different groups of stakeholders.
