Tracking the relationship between the theory of press control and the realities of practicing daily press censorship prior to publication, this volume on the suppression of dissent in early modern Europe tackles a topic with many elusive and under-researched characteristics. Pre-publication censorship was common in absolutist regimes in Catholic and Protestant countries alike, but how effective it was in practice remains open to debate. The Netherlands and England, where critical content segued into outright lampoonery, were unusual for hard-wired press (...) freedoms that arose, respectively, from a highly competitive publishing industry and highly decentralized political institutions. These nations remained extraordinary exceptions to a rule that, for example in France, did not end until the revolution of 1789. Here, the author’s European perspective provides a survey of the varying censorship regulations in European nations, as well as the shifting meanings of ‘freedom of the press’. The analysis opens up fascinating insights, afforded by careful reading of primary archival sources, into the reactions of censors confronted with manuscripts by authors seeking permission to publish. Tortarolo sets the opinions on censorship of well-known writers, including Voltaire and Montesquieu, alongside the commentary of anonymous censors, allowing us to revisit some common views of eighteenth-century history. How far did these writers, their reasoning stiffened by Enlightenment values, promote dissident views of absolutist monarchies in Europe, and what insights did governments gain from censors’ reports into the social tensions brewing under their rule? Over the last eight years, there has been a sharp increase in government censorship and officially sponsored persecution of the Moroccan free press. The Moroccan press still enjoys greater freedoms now than under the late King Hassan II, thanks to the liberalization efforts he facilitated toward the end of his life, which were also continued in the early years of his son’s reign. However, the freedoms media activists worked so hard to obtain at the end of the last century have (...) rapidly begun to erode, particularly after the 2003 terrorist attacks in Casablanca. Morocco remains an important Arab ally to both the United States and Europe, but the monarchy risks that relationship by tightening the reigns on speech and violating international human rights laws. Moreover, the monarchy puts itself at risk domestically every time it imprisons a journalist or imposes a bankrupting fine on a popular periodical, as Moroccan human rights groups grow less enchanted by their king. Over the last two years, criminal charges against the media have increased significantly, causing some publications to close and leaving a number of journalists in jail for their writings. In addition, since 2008, the Moroccan government has begun to censor the Internet, arresting bloggers and satirists and temporarily suspending access to popular websites, such as YouTube. This article explores Morocco's obligations under international and domestic law relating to freedom of expression and examines some recent court cases involving the Moroccan media. (shrink)

Hume’s “Of Liberty of the Press” was translated into Danish as early as 1771. It is not widely known that Denmark was the first country officially to declare (...) freedom of the press and that a lively debate broke out once such freedom was declared. Hume’s essay was put to work in that debate. The story of this translation provides insights into the influence of Hume’s ideas in peripheral countries in Europe, and of Denmark in continental European ideas. Among other things, here we have an example of Hume’s work used in a concrete propaganda battle.The Danish translation of Hume’s essay was published as the last of three supplemental essays in a 31-page pamphlet entitled Mr. F. During the communist era, Radio Free Europe (RFE) was Romania's favorite radio station. This paper analyzes the role of RFE in everyday life in the strictly controlled Romanian communist state by looking at the broadcasts of RFE's Romanian Department, their audience, and their impact. Drawing largely on the RFE archives at the Vera and Donald Blinken Open Society Archives (OSA) and the former secret police files at the National Council for the Study of the Securitate Archives (CNSAS), it investigates (...) how radio waves mediated and channeled information while preparing people to embrace political and cultural change. The paper focuses on the circulation of knowledge, media confluences, and human agency. The rituals that developed around the secrecy which governed the listening process, the personal requests, attitudes, and opinions expressed in letters to RFE, and oral and written testimonies, coupled with the disproportionate and, at times, extreme reactions of the communist state, together reveal the carving out of individual spaces that allowed for the preservation of the “self” during Nicolae Ceausescu's dictatorship. At such critical historical moments, the connection became visible. Through an analysis of recent media representations in which RFE figures, such as Cold Waves, this study also looks at how RFE shaped personal memories of communist times. (shrink)

Throughout Iran’s modern history, control of the public sphere has remained in the hands of the state. With virtually no trace of a civil society, public opinion has played only a minimal role in influencing state affairs. The 1979 Islamic revolution could be viewed as a break in this historical trend, but public opinion retreated into the background once the clerics solidified their power -- and then kept it by invoking religious orthodoxy to deflect any challenges. Thus, it should have (...) been no surprise that the press revolution, which began in the late 1990s as Mohammad Khatami came to power, collapsed a few years later. While an array of newspapers and journals are still published in Iran today, the persecution of leading editors and publishers with pro-reform sympathies has successfully cleared the field of any real threat to the status quo.The early theorists of the reform movement that came to be identified with President Khatami saw a free and independent press as a vital part of an Islamic Repub lic. For centuries, they argued, the state had used its control over the media -- first the publication of books, then newspapers and finally radio and television -- to push society toward the rulers’ desired ends. In contrast, the reformers saw a free press as the best way to foster open debate and political and social pluralism, unleashing forces that would allow society at large to determine its own fate. In other words, there could be no pre-determined end, shaped by fiat. Their chosen weapon in the battle for a civil society was the newspaper, a medium with a rich history in Iran of social and political activism. Persian newspapers, particularly those published abroad and smuggled into Iran in the nineteenth and early twentieth centuries, had been responsible for remarkable changes in the political landscape. They introduced liberal social and political ideas from Europe and provided readers with a new, simplified language in which to debate such notions. Most important of all, the early press helped create the very idea of society as a political actor in its own right. Within months of Khatami’s move to the Presidential Palace, his new appointees in the Ministry of Culture and Islamic Guidance unleashed a “press revolution.” They quickly streamlined the issuing of publication licenses; countered Iran’s traditional centralism by encouraging the rise of local and provincial newspapers; eased the financial hardships of independent publishers; and sought protection under the existing Press Law for controversial editors and commentators facing the hostility of the ruling clerics. The result was a wave of entrepreneurial and journalistic creativity unmatched since the Constitutional Revolution of 1906-1911.By the spring of 2000, the hard-line clerics had had enough. They used their almost complete control of the public space to shut the door on the “press revolution” and to drive their critics, including many learned clerics, back into private dissent. Dozens of newspapers were closed and prominent journalists were prosecuted, most for violating so-called Islamic norms; anything like public discourse was forced back into the shadows. The ease with which the clerical establishment crushed the free press reflected the basic weaknesses and miscalculations of the reform movement. The senior theologians had established themselves as far back as the Constitutional Revolution as the final arbiters of freedom of expression under Islam. Without a wholesale re-evaluation of the role of the clergy and the very concept of freedom in a religious system of government, this power was destined to go unchecked. The reformers had also put too much emphasis on a free press, in the absence of any other real building blocks of civil society. Newspapers were expected to play the roles of political parties, of independent think tanks and, in the case of Jameah and Tous, of exemplars of social, political and economic independence. This mad play of writing —Stéphane Mallarmé Somewhere in between mathematics and theory, light and dark, physicality and projection, oscillates the poetry of Alessandro De Francesco. The texts hold no periods or commas, not even a capital letter for reference. Each piece stands as an individual construction, and yet the poetry flows in and out of the frame. Images resurface from one poem to the next, haunting the reader with reincarnations of an object lost in the (...) grass or a representation of a pear in a Dutch still life, embedded in cycles of cinematic close ups and multiple dimensions. As a whole, De Francesco’s oeuvre suggests, to use the title of one of his works, a redefinition —linguistic, epistemological, personal. The poem The End (un’agenda) (The End (an agenda)) opens with a quote by literary theorist Maurice Blanchot, which may be translated as follows: Speaking is not seeing. Speaking frees thought from this optical imperative that in the Western tradition, for thousands of years, has subjugated out approach to things, and induced us to think under the guaranty of light or under the threat of its absence.[1] In writing, De Francesco seeks to redefine our approach to things. His poems, like Blanchot’s writings, speak to both illuminate and to obscure. The reader hangs in an absence of reality within language that necessitates an attempt at interpretation, yet renders such a search ultimately futile. De Francesco draws the anonymous images that appear in this poem from the city of Paris, his current home. The fragmented narrative depicts an inner doubt of realness, calling for a confirmation of a physical existence beyond verbalization and cogitation. Cyclical references to film throw into question the reliability of the reality he creates. The light, sometimes red and safe, other times absent and murky, cannot necessarily be trusted as a guaranteed means of illumination. Blanchot’s distinction between language and visualization, and the relationship of each to reality, though linked specifically to The End (un’agenda) , can be a lens through which to read any of the three works that follow. assente obliqua (absent oblique) is composed of descriptions of six still life paintings, ranging from Dutch masterpieces of the seventeenth century to 1960s minimalism. The actual images of the paintings are absent, and the text is the sole source and object of a virtual reality created around the artwork. “Absent oblique” refers to the light source placed outside of the frame, which both informs and distracts viewing of the scene. Although mere description can be unreliable and unsatisfying in its necessary limitation, the representational act of description is shown as more than just a human want. It is a need, a means by which to grapple with an unsure reality. As the illustrations progress, they descend into abstraction and chaos. The precariously placed plate triggers the movement: the bottle bursts and the objects collapse into the movement of a tracking film camera. corpo estraneo in moto ascensionale (foreign body in ascending motion) is prose poetry in action. Its objective tone of description is skewed by the subjectivity of the narrative as horrific images are relayed in fragmented but matter-of-fact manner. A “foreign body” is both a mass of cancerous cells, and a corporeal description, and the poem takes the reader on a journey back and forth between the two, destination unclear. Beyond a questioning of the real, corpo estraneo in moto ascensionale is an examination of the possible. De Francesco’s poetry becomes a camera obscura through which to observe the constant flux of light and dark that blurs our reality. His work is colored by the idea of apo koinou , a Greek term meaning “from the common” that involves a construction of two clauses with a shared word or phrase. Through such melting of meaning, De Francesco creates a fluid ambiguity that is nonetheless grounded in bodily concepts. In assente obliqua , the reader is confronted with a description of a still life that rapidly transforms into a more chilling scene: the membrane of the mushroom in the basket emerges behind the white cloth a body could hide itself that asks for help In the realm of pure description, there is a mushroom that peeks out from behind a white cloth in a basket. Behind the white cloth, too, there could be a body, hiding, asking for help. Such an elision elicits disorienting mistrust in temporality, but also expands the planar possibilities of syntactical meaning. A white cloth is not merely a construct in still life painting, but veil that both shields and reveals potential mysteries. It is a proposed alternative to a traditional Western binary of subjectivity and objectivity. The apo koinou construction is rare in modern English, having slipped out of use after its resurgence in Old English poetry. De Francesco reintroduces this blur of object and subject relations into a modern light. He draws inspiration from a device used by Gruppo 63 founder and avant-garde poet Antonio Porta tended toward repetition of phrases in third person perspective. In Italian, it is perfectly grammatically correct to omit the subject, including only a verb conjugation. Gender, even humanity unknown, the subject dissolves into the action, thus giving to the poetry the power to change the reader’s perception of who or what is actually acting. To further push the relative boundaries of experience, De Francesco expands his written poetry into what he calls “reading environments.” In these sound experiments, De Francesco’s voice reading his poetry is manipulated by real time digital voice processing. The written is transformed to the spoken, and then injected with currents of electric sound. “At each activation of word in the darkness,” (from The End (un’agenda) ) language is permutated into a nonphysical yet all-encompassing being. In these projects, realized all over Europe, De Francesco continues his examination of the word’s potency beyond the page and into an “n-dimensional space,” where the lines between nature and affect are intertwined. To publish excerpts of De Francesco’s oeuvre is to show screen shots of full-length film, to read pull quotes from a philosophy treatise. In these poems, there are questions, not to be answered, but to be questioned again. Hardback, $37.00.Paul Sagar's invigorating book is a reconsideration of Adam Smith in the sense that it challenges much that is received wisdom in current scholarship. First and foremost, it rejects (...) the idea that Smith was preeminently a moral philosopher concerned with the threat to civic virtue posed by commercial society, and yet intent on giving commercial society a moral vindication nevertheless. Sagar—rightly, in my view—wants us to recognize Smith as having been a political thinker. Too much work on Smith still assumes that there is not much to say [End Page 323] about his political thought because he regarded all but the most minimal government as an obstacle to the proper functioning of markets. Smith is supposed to be a "classical liberal" bent on preserving as much natural liberty as possible in the face of government's relentless overextension of its powers of regulation. In Adam Smith's Politics: An Essay in Historiographic Revision (Cambridge: Cambridge University Press, 1978), Donald Winch rejected that approach to Smith in favor of a portrait of the author of The Theory of Moral Sentiments and The Wealth of Nations as an eighteenth-century thinker with an eighteenth-century thinker's concerns. Sagar's project is quite different. This is a book on Smith's political thought that does not once deploy the term 'Whig.' Sagar's Smith does not wholly float free of his historical situation—the questions he addresses are those posed by the end of feudalism and the advent of modernity—but situating him in the particular circumstances of Britain in the age of revolutions is not Sagar's concern. As Sagar sees it, the fundamental issues addressed by Smith's political thought concern the distinctive form taken by commercial society in the modern era. Smith, according to Sagar, held that all advanced societies are commercial societies. Commercial society as such needed no vindication. The question, rather, was what kind of commercial society a modern state wanted to be. That was a political question insofar as it was a question about the kind of freedom that mattered and about the kind of institutions needed to make that freedom a reality.Defined in maximally general terms, freedom for Smith was the absence of domination, where domination is understood as a lack of security in respect of one's physical safety and possessions. The condition of the poor and powerless had always been one of subjection to the will of the rich and powerful. What changed that, according to Smith, was implementation of the rule of law. This is in itself not a new reading of Smith, but what distinguishes Sagar's version of it is the care with which he examines both the place of the rule of law in Smith's historical account of the emergence of liberty in modern Europe and the precise nature of the connection between the rule of law and freedom. First, on Sagar's view, there needed to be a comprehensive picture of domination and slavery, which had been the normal condition of almost everyone for almost all of human history. Then there needed to be an explanation of how it was that, at one particular historical moment, domination was slowly but surely challenged by the emergence of law and law courts considered as independent of political power. In England, this was the story of the common law and of judges who held office for life, rather than at the pleasure of traditional possessors of power. It was the story of security in property, of the backing of property by law, and it was a largely urban story, of burghers who managed to enlist monarchs on their side in the battle against the barons. It was, in other words, in large part a medieval story, and one consequence is that there was more to say about the rise of liberty in the modern age than that it was caused inadvertently by... Ernst Mach’s philosophical ideas were warmly received in America, which already had a pragmatist tradition close to Machian empiricism and budding schools of philosophy, psychology, and physics more or free of the neo-Kantian influences which were a strong academic competitor to the spread of empiricism in Europe. The founding pragmatists Charles Sanders Peirce and William James engaged directly with Mach and Paul Carus, the editor of the Monist and publisher of the Open Court press actively translated and published Mach’s (...) works for the American public. A generation later when members of the Vienna Circle sought Academic posts in elite American universities, the ground was well prepared for their arrival as Holton and Stadler have described. Beneath the surface however, the American reaction to Mach was not one of naïve admiration but fairly staunch criticism, which Mach himself appreciated and welcomed. Peirce was highly critical of Mach’s mechanics in a review and Peirce famously described Mach’s empiricism as akin to riding a horse to death. In some ways, Peirce himself had anticipated aspects of Mach’s views on mind and body, a surprising discovery I made recently. Even Carus, who declared himself an admirer, was highly critical of Mach’s theory of economy of thought. James, too, who admired Mach greatly, had major disagreements with Mach on so-called sensations of innervation in psychology, and although’s James’ own radical empiricist essays owed much to Mach’s neutral monist ideas in the Analysis, James broke away from what he saw as Mach’s excessive physical reductionism, rejecting the monism about nature that was Mach’s trademark. In short Mach’s ideas acted as a stimulus to American thinkers, but they had their own tradition and they were able to resist his authority and contribute in reverse to Mach’s own refinement of his positions. Food trade is of economic importance for both developed and developing countries. Food, however, is a special commodity. Firstly, the lack of food -- hunger, under-nourishment, and starvation -- is one of the world's pressing moral problems. But food is not only special because it is necessary for our survival; food is also special because it is strongly related to our social and cultural identity. Two recent transatlantic trade conflicts over food -- over the use of artificial growth hormones in (...) beef production and over the use of biotechnology in food production -- show that food is a specific commodity. In these trade-conflicts, the obligations flowing from free-trade treaties collide with the cultural and social meanings of food. Current international trade agreements neglect this point and force countries to fight their case in the field of food safety science. This causes a bias in the discussion. Europe's resistance towards artificial growth hormones and GM-food is not strictly science based; it is also culture based. For a fair resolution of trade-conflicts, this needs to be accommodated in international trade legislation. With the help of the notion of public reason I defend that precaution with regard to scientific uncertainty, and the possibility for compulsory labelling with regard to sensitive non-nutritional properties of foodstuffs, need to be incorporated in international food trade regulations. BrownLiving the Truth: A Theory of Action Klaus Demmer Washington, D.C.: Georgetown University Press, 2010. 179 pp. $34.95.Klaus Demmer is one of the most influential Catholic moral theologians in Europe since Vatican II. Unfortunately, he is relatively unknown in America. Living the Truth is only the second of his works to be translated into English, although other translations are (...) anticipated. In Living the Truth, Demmer provides an incredibly balanced and nuanced work of fundamental moral theology and brims with insights. Not content with easy answers or oversimplifications, Demmer seeks in this book not only to chart a way between apparent opposites but also to synthesize the best of both into a new unity.For example, Demmer returns regularly to the question of the foundation and role of moral norms. Norms are indispensable in the life of the “ethical personality,” the person who is fully alive as a human being. They serve to open a person to the truth and to freedom and help to make a space for genuinely good, free, and vibrant action. However, norms are not at the heart of Demmer’s ethics, either as a discipline or in actual life. He also speaks of the ways in which a person establishes norms for herself even as he is careful to avoid relativism or subjectivism. Acknowledging that norms derived from a natural law ethics are true and important and that Christian morality may not be able to add any propositional content to natural law, he also argues at length that Christianity does in fact significantly shape a natural law ethics into something that is both deeper and more expansive. For Demmer, the Christian context changes the basis and meaning of morality. Although frustratingly spare with examples, he brings to the fore the difference between grounding human dignity in human nature as reason can grasp it and grounding it more specifically in the image and likeness of God and the love shown in the incarnation and redemption.Demmer’s moral theology is profoundly human and existential; it is immersed in the context and texture of real human experience. In many ways, it is very pastoral. It certainly manifests a depth of psychological insight into the nature and workings of the human mind, for example, in analyzing the ways in which people fall into pride and self-deception (33–37).Living the Truth’s concern with truth and truthfulness is an important and timely theme. Once again, Demmer synthesizes distinct elements. Truthfulness is a multifaceted reality, referring both to internal and external forces. Systematically [End Page 227] grounding his ethics in a robust classical metaphysic, Demmer understands the “true,” the “good,” and “being” to be related as transcendentals (42). The “truth” opens one up to “goodness,” which in turn allows for the flourishing of the human person. Far from being restrictive, the truth opens up possibilities for true freedom. But this only occurs when it is internalized as “truthfulness,” a virtue of many dimensions that Demmer unfolds throughout the book, particularly in the last of the three main parts.Living the Truth is very dense. It definitely is not an undergraduate text. Both the meaning of individual sentences and the flow of Demmer’s thought are elusive at times. Many subsections discuss a range of ideas and seem at times to wander. Even readers with a strong background in moral theology will find it necessary to reread and think carefully in order to catch the precise meaning of specific phrases and follow the argument. Hospice is the premiere end of life program in the United States, but its requirement that patients forgo disease-directed therapies and that they have a prognosis of 6 months or less means that it serves less than half of dying patients and often for very short periods of time. Palliative care offers careful attention to pain and symptom management, added support for patients and families, and assistance with difficult medical decision making alongside any and all desired medical treatments, but it (...) does not include a comprehensive system of care as is provided by hospice. The practice of palliative care and hospice is filled with sometimes overt (requests for hastened death in an environment where such acts are legally prohibited) and other times covert (the delay in palliative care referral because the health care team believes it will undermine disease directed treatment) ethical issues. The contributors to this volume use a series of case presentations within each chapter to illustrate some of the palliative care and hospice challenges with significant ethical dimensions across the three overarching domains: 1) care delivery systems; 2) addressing the many dimensions of suffering; and 3) difficult decisions near the end of life. The contributors are among the most experienced palliative care, hospice and ethics scholars in North America and Western Europe. For Waters, the free-flowing economic exchange (...) enabled by globalization does not inherently conflict with Christian tradition, and it can be harnessed in a responsible manner to share and communicate the goods of creation. He argues that breaking down global barriers to market participation expresses a preferential option for the poor and provides a means for achieving the work of the Spirit by spreading the materials goods that lift people out of poverty and alleviate suffering. The book's primary contribution is its broad explanation of recent work on the economics of globalization and Waters's ability to put this literature into a theological conversation. The argument is particularly timely for Christian ethicists who are concerned with developing the tools to respond to expanding movements toward isolationism and economic protectionism in the United States and Europe.Part 1 of Just Capitalism claims that moral theology has not properly interrogated the common view that affluence fundamentally conflicts with the Christian tradition. By contextualizing both the biblical sources and the traditional theological voices that support this view, Waters shows that these sources assumed an economic model in which resources are scarce and wealth is built by exploiting the poor. Instead, Waters argues that our present economic system is based on increasing productivity, and therefore wealth is not necessarily exploitative. In fact, he claims that the pursuit of affluence can be beneficial for helping to lift people out of poverty. Rather than retreating from engagement with wealth and the market, Christians should recognize that free exchange is a necessary, though not sufficient, condition for human flourishing (15). [End Page 213]In part 2, Waters develops a notion of koinonia, whereby human flourishing depends on communicating the goods of creation in the associations of civil society. Responding to worries about the homogenizing forces of market economies that make individuals into producers and consumers, Waters offers the church as a communicative association that stands in tension with capitalist markets by cultivating reciprocity instead of consumption, breaking down barriers in a gathering community, and being nonterritorial in its scope (150–51). Because communicative associations like the church are essential to the vitality of civil society, the challenge is to "embrace the dynamism of global markets in order to promote more widespread prosperity," while establishing the requisite political stability that allows these associations to exist (159).Nevertheless, Waters does not spend much time elaborating on specific moments when the church should come into conflict with capitalism—he notes that his reservations only give him "two-and-a-half-cheers" for globalization, rather than three (14–15). In his desire to show compatibility with globalization, he neglects to give a sense of when communicative associations could justifiably remove themselves from the system of exchange. This relates to Waters's final chapter on capitalist responses to environmental devastation, which relies on his earlier development of a stewardship model, one that seems to reduce creation to its instrumental value for human "delight" (89–90, 92, 111, 115). Waters admits that the pursuit of affluence requires short-term environmental damage, especially in developing countries; nevertheless, he thinks that affluent societies will better preserve the environment (through "national parks and wildlife preserves") (217), and some environmental exploitation is needed to form these affluent societies. The paper discusses the role of networks in cognition on two levels: on the level of the organization of ideas, and on the level of interpersonal communication. Any interesting system of ideas forms a network: ideas presented in a linear order (the order forced upon us by verbal expression) will necessarily convey a distorted picture of the underlying patterns of thought. Networks of ideas typically consist of a great number of nodes with just a few links, and a small number (...) of hubs with very many links; that is, they are, to employ Albert-László Barabási's term, "scale-free." Barabási fits into a specific tradition: Hungarians had an early influence on the philosophy of networks, and on the philosophy of communication as developed at Marshall McLuhan's Toronto Circle. In fact, this was the circle in which certain Hungarian and Austrian ideas on mediated collective thinking first came together—a telling testimony to the conditions of disturbed communication and idiosyncratic networking typical of East-Central Europe, past and present. The nodes-and-hubs pattern is characteristic, too, of social networks, in particular of scholarly and scientific networks. The paper analyses the role of "invisible colleges"—informal groups of scientific elites through whom the communication of information both within a field and across fields is channelled. By way of conclusion the notion of a new type of personality, the "network individual," is discussed: the network individual is the person reintegrated, after centuries of relative isolation induced by the printing press, into the collective thinking of society—the individual whose mind is manifestly mediated, once again, by the minds of those forming his/her smaller or larger community. This paper presents an account of the ethical and conceptual relationship between free speech and press freedom. Many authors have argued that, despite there being some common ground between them, these two liberties should be treated as properly distinct, both theoretically and practically. The core of the argument, for this “unbundling” approach, is that conflating free speech and press freedom makes it too easy for reasonable democratic regulations on press freedom to be portrayed, by their opponents, as part of a (...) programme of illiberal censorship. While we acknowledge the important grain of truth in that argument, we try to show how the alternative, “unbundling” approach can also be used to undermine or mischaracterise democratically justifiable opposition to media regulations in despotic regimes. In light of the problems on both sides, we defend a contextually-variable account of the relation between these two liberties. (shrink)

The debate over press liberty before and during the pre-Revolutionary era (1763-1775) in America reveals how a once-unified, if rudimentary, tradition gave rise to two sophisticated and contrary doctrines, aspects of which continue to infuse current free speech discourse. The vague, republican and liberal discourse of the `free and open' press bifurcated as a result of the competing political and ideological forces involved in the pre-Revolutionary crisis. Through an examination of this historical debate over press liberty, this essay seeks to (...) recast two current scholarly debates . First, this study undermines the polarized debate over early American political thought and substantiates recent abstract attempts to demonstrate the complex relationship between republicanism and liberalism. Second, this interpretation uncovers a central dynamic in the development of the American tradition of press liberty, thus calling into question a wide variety of previous studies that ignore this crucial feature. This thought-provoking monograph provides a systematic, philosophically-grounded reconceptualisation of press freedom and press regulation. In a major departure from orthodox norms, the book argues that press freedom and coercive independent press regulation are not mutually exclusive; that newspapers could be made to compensate their victims, through regulation, without jeopardising their free speech rights; that their perceived public watchdog status does not exempt them; and, ultimately, that mandatory press regulation is not unconstitutional. In doing so, the book questions our most deeply-held, (...) intuitive beliefs about the press and its role in society. Why do we say the printed press has a duty to act as a public watchdog when there is no legally enforceable apparatus by which to ensure it does? Why does government constantly recommend that the press regulate itself when history shows this model always fails? Why do victims of press malfeasance continue to suffer needlessly? By deconstructing the accepted view of press freedom and mandatory regulation, this book shows that both are deeply misunderstood. The prevailing notion that the press must serve the public is an empty relic of Victorian ideology that is both philosophically incoherent and legally unjustifiable. A majority of the countries in the world are still considered "developing," with a per capita income of less than U$1,000. Hahn (2008, Journal of Business Ethics 78, 711–721) recently proposed an ambitious business ethics research agenda for integrating the "bottom-of-the-pyramid" countries (Prahalad and Hart, 2002, Strategy and Competition 20, 22–14) through sustainable development and corporate citizenship. Hahn's work is among the growing field of research in comparative business ethics including the global business ethics index (Michalos, 2008, Journal of Business (...) Ethics 79(1), 9–19; Scholtens and Dam, 2008, Journal of Business Ethics 75(3), 273–284; Tsalikis and Seaton, 2008, Journal of Business Ethics 75(3), 229–238). This article is complementary to Hahn's work and it advocates an urgent need for business ethics researchers to globally integrate the bottom-of-thepyramid countries through a fundamental re-definition of the global economic triad, including the United States, Western Europe, and Japan [Ohmae, 1985, Triad Power: The Coming Shape of Global Competition (New York: Free Press)]. The definition that we propose is based on business systems and institutional perspectives that include the bottom-of-the-pyramid countries. We also propose to broaden the research in business ethics to enable comparisons across business systems indifferent income levels. (shrink)

The unexpected resounding NO of the Greek referendum of the 5th July to continued austerity echoed a great disapproval and rejection of a ‘Germany-dominated Europe’ and a strong claim for radical change in Europe while fuelling reactions, which in social networks were discursively and symbolically constructed to express and intensify anti-Brussels and anti-Germany sentiments and to mobilise resistance. The present paper sets out to investigate how discursive constructions and representations of the Self and the Other contributed to bringing (...) closer the NO partisans and to reinforcing a discourse of resistance for political, economic and social change. Relying on comments from Tsipras’ Facebook page, this study lies within Critical Discourse Studies and uses corpus-based methodologies to detect the most frequent words and semantic fields, which seemed to be building a dichotomous discourse between US and THEM while enhancing an in-group cohesiveness around the pre-referendum charismatic personality of Alexis Tsipras. Pp. vii + 244.David Loy's most recent work, A Buddhist History of the West: Studies in Lack, constitutes an intellectual history of Europe from what he calls a "Buddhist perspective." His obvious goals (...) in this book are (1) to develop a heuristic device, if not a mature methodology, out of the Buddhist intellectual tradition and to apply it to matters that are not necessarily related to the Buddhist tradition, and (2) to reread European history from a new standpoint. I have to confess that I am not a historian and thus cannot evaluate Loy's historical claims; however, from my perspective as a scholar of Buddhist and comparative philosophy, it seems to me that not only does Loy succeed on both counts but his study of European history from what he calls the perspective of lack reveals astonishing yet previously barely highlighted insights into European thought. It also undermines, in a methodological slight of hand that at times evokes Michel Foucault's approach, the conventional assumptions about the dominant paradigms of the generally accepted periods of European history. I do not want to claim that Loy's methodology resembles Foucault's "archaeology" in any way; however, it does demonstrate that discourses and time periods are fluid rather than static and that their paradigm depends on, and changes in accordance with, the perspective of the historian.For example, seen from Loy's perspective of lack, the central and most formative event of European history was neither the Renaissance nor the Enlightenment, but the Papal Revolution of the late eleventh century. In general, Loy's book is filled with observations and indictments of common myths that are not only provocative in nature but sure to challenge many of the presuppositions that the proponents of the so-called Western World hold dear. In concrete terms, Loy seems to focus on and examine not so much European intellectual history but the myths that are used to argue for the superiority of the "West": freedom, progress, romantic love, the sanctity of the nation-state, and free-market capitalism.Loy chooses as his standpoint "a Buddhist perspective," namely the "perspective of lack." He takes as his basic assumption the dictum he borrows from early Buddhism and, as he adds, psychotherapy, namely that humans have to live with the basic frustration-Loy's translation of dukkha, which is usually rendered as "suffering"-that reality does not conform to our innermost desires. We desire immortality but cannot avoid the impermanence of all living beings. The awareness of our impermanence not only shatters our sense of and quest for a self, but it also [End Page 580] arouses the "immediate and terrifying (because quite valid) suspicion... that "'I' am not real right now" (p. 3).This frightening sense of lack propels humans onto what Norman Brown calls the Oedipal project, that is, the attempt to create oneself. This sense of lack, Loy remarks, is common to all religions, but what separates Buddhism from most other religious traditions is that it does not offer a self and some kind of immortality, on the one hand, and refrains from reifying this sense of lack as, for example, "sin," on the other. Rather, Buddhism, to Loy, can be "understood as a way to resolve our sense of lack" (p. 6). With regard to his present project, Loy asks, "[i]f that (the sense-of-the-self's sense of lack) gives us insight into the individual human condition, can it also shed light on the collective dynamics of society and nations?" (p. 8). In other words, Loy asks how the interpretation of European history would change if one were to choose the primary Buddhist assumption, namely the deep anxiety over one's future death and present-day insignificance and groundlessness, as one's starting point.However, Loy is quick to argue that this standpoint is not unique to Buddhism, and he corroborates his perspective on lack with the findings of psychotherapy, mostly the... The increasing number of residents and citizens with non-Western cultural backgrounds in the European Union (EU) has prompted the question of whether EU member states (and other Western democracies) can accommodate the newcomers and maintain their free polities (‘liberal democracies’). The answer depends on how important – if at all – cultural groundings are to democratic polities. The analysis of a fascinating Habermas-Ratzinger debate on the ‘pre-political moral foundations of the free-state’ suggests that while legitimacy originates on the will of (...) the citizens that conform the political community, liberal democracies might not be completely free from moral principles implicit in their political culture. This possibility has normative implications for the political future of the EU - and of the West in general - particularly regarding immigration, integration and citizenship policies. (shrink)
