The reversal of Roe v. Wade by the U.S. Supreme Court allowed the states to regulate terminations of pregnancy more autonomously than during 1973–2022. Those who think that women should be legally entitled to abortions at their own request are suggesting that annulling the reversal could be an option. This would mean continued reliance on the interpretation of privacy that Roe v. Wade stood on. The interpretation does not have the moral support that its supporters think. This can be shown (...) by recalling the shortcomings of Judith Jarvis Thomson’s famous violinist example and its application to abortion laws. Philosophically better reasons for not restricting access to abortion can be found in a simple principle of fairness and in sensible theories on the value of human life. Whether or not philosophy has any use in the debate is another matter. Legal decisions to regulate terminations are probably based on pronatalist state interests, shared by the apparently disagreeing parties and immune to rational argumentation. (shrink)

Predatory grooming is a form of abuse most familiar from high-profile cases of sexual misconduct, for example, the Nassar case at Michigan State. Predatory groomers target individuals in a systematic effort to lead them into relationships in which they are vulnerable to exploitation. This is an example of a broader form of epistemic misconduct that Leydon-Hardy describes as epistemic infringement, where this involves the contravention of social and epistemic norms in a way that undermines our epistemic agency. (...) In this chapter, Leydon-Hardy looks at the distinctive epistemic harm caused by epistemic infringement. She argues that this harm cannot be understood simply as the victim’s having a false belief, or even as her being alienated from her belief-forming mechanisms. A deeper understanding of the harm caused by infringement shows that it stems from damage to one’s epistemic agency, and indeed, to one’s personhood. (shrink)

The transition to the market economy, which began in Russia more than 30 years ago, has dramatically affected the performance of the Russian academic sphere. The market transformation in the country coincided with significant changes in the global academia. Bureaucratization and obsession with performance indicators have been very welcomed by the Russian system and have been incorporated in various academic excellence programs adopted in the country. A closer look at these programs reveals that the real driving force behind the initiatives (...) is not public spiritedness of the country’s policymakers but wishes of various groups to be engaged in the rent-seeking activities of contemporary Russia. The present paper focuses on the interplay between the predatory publishing industry and the apparent encouragement of fraudulent practices by some universities in Russia. It highlights the problem of “predatory universities” and explains the evolution of such strategies in the academic sphere of the country. The Russian case allows to look at the problems of the global academia from a new angle. It should be acknowledged that the predatory publishing industry is much greater than it seems within the initial “open access” model. It is clear that the authors are very often not less predators than the publishers, and this predatory ecosystem has been significantly expanded beyond the merely publisher-author interactions. Moreover, the noticeable players in these predatory markets are universities and governments that play with the systems designed by the leading citation databases and global ranking organisations, which apparently also benefit from these arrangements. Over the past year, aggressive billing practices have been exposed at a number of hospitals in the United States. Despite the fact that a widower had paid $16,000 of his late wife's bill of $18,740, some 20 years after the incurrence of the bill a teaching hospital held a lien on his home for $40,000 in interest. Many years earlier the hospital had seized his bank account, and now the 77-year-old man was destitute. Only tremendous publicity caused the hospital to (...) back down. That same week, another nonprofit teaching hospital reportedly drove a 25-year-old uninsured woman from New York City while dunning her for a $19,000 bill for a two-day stay for an appendectomy. In California, a patient was forced into bankruptcy in 2000 by a for-profit hospital from a day-and-a-half stay in the hospital that did not include any surgery but totaled $48,000 in hospital bills. These have become common stories as hospitals aggressively market, bill, collect, and foreclose, just like any other corporation. Until 2017, global academia relied on two now-defunct Jeffrey Beall “predatory” OA publishing blacklists to select their choice of publishing venue. Despite vast efforts to build the state, profound political order in rural Afghanistan is maintained by self-governing, customary organizations. Informal Order and the State in Afghanistan explores the rules governing these organizations to explain why they can provide public goods. Instead of withering during decades of conflict, customary authority adapted to become more responsive and deliberative. Drawing on hundreds of interviews and observations from dozens of villages across Afghanistan, and statistical analysis of nationally representative surveys, Jennifer Brick Murtazashvili (...) demonstrates that such authority enhances citizen support for democracy, enabling the rule of law by providing citizens with a bulwark of defence against predatory state officials. Contrary to conventional wisdom, it shows that 'traditional' order does not impede the development of the state because even the most independent-minded communities see a need for a central government - but question its effectiveness when it attempts to rule them directly and without substantive consultation. The War on Terror is an ambiguous term that has been used to circumvent the international laws of warfare. Instead of moving toward peace by way of limited warfare, and instead of preserving the independence of war and peace, War on Terror advances by masking itself in a fog of peace; it proliferates by overlapping the logic of “war-time” and “peace-time” operations. The fog of peace—as it shall herein be called—is a condition wherein the uncertainty qua “fog” of war,2 along (...) with its militarized logic, overlaps with and eventually replaces civilian peace-time-and-spaces. The War on Terror is thus not a limiting of war by way of the conventional modern mechanisms of international law and diplomacy; it is a continuation of war by other means, including the use covert, often black-boxed methods of information-capture and surveillance. Globally, states are expanding the powers of intelligence organs and deploying covert mass surveillance programs in the name of counter-terrorism. In this manner, counter-terrorism policies become instruments enabling states to become predatory, especially in relation to civilians. If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? The occasion of both myth and literature is the social life of the species which, in Starobinski's sense, is a history of continual eviction; but as regards the apparatus of thought by which this social life is reflected (...) in art it is more a history of assimilation and repetition. "The work of the brain," to cite a recent article in Scientific American, "is to create a model of a possible world rather than to record and transmit to the mind a world that is metaphysically true…Different worlds are presumably constructed by similar species."1 And, presumably, similar worlds are constructed by similar species. In lieu of an abstract, here is a brief excerpt of the content:Walking the Bodhisattva Path/Walking the Christ PathU.S. Conference of Catholic BishopsCatholics and Buddhists brought together by Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB) met 20-23 March 2003 in the first of an anticipated series of four annual dialogues. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at the (...) City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. The literature addressing bias and fairness in AI models (fair-AI) is growing at a fast pace, making it difficult for novel researchers and practitioners to have a bird’s-eye view picture of the field. In particular, many policy initiatives, standards, and best practices in fair-AI have been proposed for setting principles, procedures, and knowledge bases to guide and operationalize the management of bias and fairness. The first objective of this paper is to concisely survey the state-of-the-art of fair-AI methods and (...) resources, and the main policies on bias in AI, with the aim of providing such a bird’s-eye guidance for both researchers and practitioners. The second objective of the paper is to contribute to the policy advice and best practices state-of-the-art by leveraging from the results of the NoBIAS research project. We present and discuss a few relevant topics organized around the NoBIAS architecture, which is made up of a Legal Layer, focusing on the European Union context, and a Bias Management Layer, focusing on understanding, mitigating, and accounting for bias. Whenever the state of a biological system is not determined solely by present conditions but depends on its past history, we can say that the system has memory. Bacteria and bacteriophage use a variety of memory mechanisms, some of which seem to convey adaptive value. A genetic type of heritable memory is the programmed inversion of specific DNA sequences, which causes switching between alternative patterns of gene expression. Heritable memory can also be based on epigenetic circuits, in which a (...) system with two possible steady states is locked in one or the other state by a positive feedback loop. Epigenetic states have been observed in a variety of cellular processes, and are maintained by diverse mechanisms. Some of these involve alternative DNA methylation patterns that are stably transmitted to daughter molecules and can affect DNA–protein interactions (e.g., gene transcription). Other mechanisms exploit autocatalytic loops whereby proteins establish the proper conditions for their continued synthesis. Template polymers other than nucleic acids (e.g., components of the cell wall) may also propagate epigenetic states. Non‐heritable memory is exemplified by parasitic organisms that bear a signature of their previous host, such as host‐controlled modification of phage DNA or porin hitchhiking in predatory bacteria. The heterogeneous nature of the examples known may be indicative of widespread occurrence of memory mechanisms in bacteria and phage. However, the actual extent, variety and potential selective value of prokaryotic memory devices remain open questions, still to be addressed experimentally. Overdiagnosis is an emerging problem in health policy and practice: we address its definition and ethical implications. We argue that the definition of overdiagnosis should be expressed at the level of populations. Consider a condition prevalent in a population, customarily labelled with diagnosis A. We propose that overdiagnosis is occurring in respect of that condition in that population when the condition is being identified and labelled with diagnosis A in that population ; this identification and labelling would be accepted as (...) correct in a relevant professional community; but the resulting label and/or intervention carries an unfavourable balance between benefits and harms. We identify challenges in determining and weighting relevant harms, then propose three central ethical considerations in overdiagnosis: the extent of harm done, whether harm is avoidable and whether the primary goal of the actor/s concerned is to benefit themselves or the patient, citizen or society. This distinguishes predatory, misdirected and tragic overdiagnosis; the degree of harm moderates the justifiability of each type. We end with four normative challenges: methods for adjudicating between professional standards and identifying relevant harms and benefits should be procedurally just; individuals, organisations and states are differently responsible for addressing overdiagnosis; overdiagnosis is a matter for distributive justice: the burdens of both overdiagnosis and its prevention could fall on the least-well-off; and communicating about overdiagnosis risks harming those unaware that they may have been overdiagnosed. Psychopaths appear to be ‘creatures apart’ – grandiose, shameless, callous and versatile in their violence. I discuss biological underpinnings to their pale affect, their selective inability to discern fear and sadness in others and a predatory orienting towards images that make most startle and look away. However, just because something is biologically underpinned does not mean that it is innate. I show that while there may be some genetic determination of fearlessness and callous-unemotionality, these and other features of the (...) personality may arise from developmental failures in the interpersonal reception of their emotions, needs and their sense of self. One is unlikely to be able to own inner experiences if shamed for having them, or if, having them, one does not know how to regulate and soothe. So psychopaths may learn to attend away and suppress them. Rather than a fully inherited difficulty, they may have become unable to reflect on inner states, so meta-emotions and self-reflective emotions like guilt and shame do not fully arise. They retain enough sensitivity to know their difference, and hide. I suggest that psychopaths are characterised by a nested sense of self, arising from the surprising effect of shame on these seemingly shameless characters. They do not have an integrated sense of self across context or across time or in relation to a generalised social other. With a nested sense of self, diminished intensity and scope of affective experience (in both directly experienced and vicarious forms) they lack textured access to a personal, owned and integrated past. Thus they lack the kind of access to the past required for a motivationally compelling planning of the future. They lack the emotional investment in the future that enables us to overcome the motivation to act opportunistically and myopically. These individuals live strangely in time. They have a fugitive sense of self and live nimbly among many pasts. They present an elegant and coherent mask to the person they are addressing in the moment and generate possible futures without conviction. (shrink)

Theoretically, this essay is a psycho-social reflection on the patrimonial character of Philippine political democracy. Many scholars attest that Philippine politics is marred by oligarchic rule composed of elite families, knitted by blood and marriage, who use state resources to perpetuate themselves into public office. These officials control and exploit the economic and political landscape to rule and govern the lives of the Filipino people. Hence, I argue that the patrimonial culture is a social pathology and has imbibed other (...) names such as patron-client democracy, cacique democracy, predatory oligarchic state, and bossism. This type of social malady highlights the coercive forms of control in the Philippine political arena and, thus, expanding oligarchic power relations over and above the interest of the people. Money and power are the main causes why this social malady persists. However, more than that, I want to add that the persistence of patrimonial culture in the Philippines lies probably in what Freud calls the introjected father image, which unconsciously becomes the standard of authority. Further, I contend that, like the Oedipus rivalry, fear is a primordial element in the introjection of this authority figure which began at the nascent of the Spanish rule. Particularly, the abuses and atrocities of the colonizers over the natives created a deep-seated traumatic experience that would later fortify the immanence of a patrimonial power structure in the Philippines. Hence, a psycho-social approach could perhaps unearth these 'events' that perpetuate a patrimonial culture in our country. I believe that excavating our collective experiences could probably help us in our search for leaders who could usher us towards real liberation. (shrink)

This article seeks to illumine the street-level, internal, meshing of social structure, strategy and experience in the contemporary black American ghetto by dissecting the practices of a professional `hustler' who works the streets of Chicago's South Side. A socioanalytic interpretation of Rickey's life - his background, worldview and social attachments, as well as his techniques of coping and methods of predatory entrepreneuralism - shows how individual strategies of survival at the core of today's `dark ghetto' can aggregate into a (...) trajectory of collective destruction that gives all appearances of being self-inflicted, even as it is determined by the twofold retrenchment of market and state and by the social entropy that these determine. Through an ironic historical reversal, it is whites who, having vanished from the social universe and consciousness of ghetto residents, have become the `invisible men' of the new sociospatial structure of relegation that consigns poor urban blacks to an internecine war with neither victors nor end. The analysis of a single individual lifeworld thus serves to illumine the whole system of material and symbolic relations, visible and invisible, local and societal, that compose the late 20th-century ghetto as instrument of relegation and lived reality. Algorithmic vision, the computational process of making meaning from digital images or visual information, has changed the relationship between the image and the human subject. In this paper, I explicate on the role of algorithmic vision as a technique of algorithmic governance, the organization of a population by algorithmic means. With its roots in the United States post-war cybernetic sciences, the ontological status of the computational image undergoes a shift, giving way to the hegemonic use of automated facial recognition technologies (...) towards predatory policing and profiling practices. By way of example, I argue that algorithmic vision reconfigures the philosophical links between vision, image, and truth, paradigmatically changing the way a human subject is represented through imagistic data. With algorithmic vision, the relationship between subject and representation challenges the humanistic discourse around images, calling for a critical displacement of the human subject from the center of an analysis of how computational images make meaning. I will explore the relationship between the operative image, the image that acts but is not seen by human eyes, and what Louise Amoore calls an “emergent subject,” a subject that is made visible through algorithmic techniques. Algorithmic vision reveals subjects to power in a mode that requires a new approach towards analyzing the entanglement and invisiblization of the human in automated decision-making systems. (shrink)

This article undertakes a critical examination of the political philosophy of Richard Rorty with special reference to his treatment of patriotism, pragmatism and democracy. Pragmatism, especially in the work of John Dewey, provided an energetic defence of American democracy, claiming that American democratic culture did not require any philosophical lessons from European social theory. American pragmatism is in this sense a celebration of indigenous political traditions. In his defence of pragmatism and patriotism against the cosmopolitanism of Left cultural critics, Rorty (...) advocates pragmatic ethnocentrism. Through a parallel commentary on socialist internationalism, this article asks whether ‘democracy in one country’ - the United States of America - is either feasible or compatible with the critical legacy of pragmatism. In its response to the growth of international terrorism, especially in its ‘liberation of Iraq’, the United States is in danger of becoming a ‘predatory democracy’. While Rorty has in the past argued that America cannot function as a global policeman, the trend of contemporary international relations is to create an American Empire. The article concludes by arguing that Rorty’s patriotism functions as ‘a final vocabulary’ that contradicts his postmodernism and makes it difficult for modern pragmatism to remain a critical theory. The article discusses in a broader historical context the well-known thesis of V. I. Lenin that capitalism was formed as a result of a change in the behavior of large merchants, who, after the state achieves political unity and forms a unified market, switch from trade to the organization of production. Researchers of the 17th century Siberia do not find historical confirmation of Lenin’s scheme, however, it is quite applicable to other countries of the early modern period and to (...) the mechanism of the early stage of the colonial expansion of European powers (I. R. Sokolovsky, 2019). At the same time, J. Diamond’ research pointed out the boundary between “normal” human behavior in the new lands and the behavior of the colonizers of the early modern period. This boundary is a rational or quasi-rational accounting of one’s actions. M. Heidegger calls this approach Gestell. Gestell considers the surrounding world as a calculated resource for self-increasing profit. Using the example of a Swiss wine merchant who died in North America in 1736, the Italian micro-historian K. Ginzburg showed how the merchants and “capitalists” actually acted and what the Gestell that determined their actions looked like in everyday life: predatory appropriation of material and labor resources is gradually getting a solid base of rational calculation.
