Qualsevol que es llegeixi aquest llibre s'adonarà que molts d'aquests mites amb els quals ens han promès la felicitat no són ni tan sòlids, ni tan certs, ni tan "progres" com sembla. The Philosophy of Right presents us with a vision of bureaucratic paternalism that is designed to check the excesses of free markets set in motion by the triumph of natural-law thinking, which abstracted the principles of private property and subjective freedom from the institutions that had tamed them and situated them in a stable context. Against these excesses Hegel pits the agricultural estate, which has not succumbed to natural-law thinking; and a “universal estate” of bureaucrats who are educated (...) in Hegel’s philosophy itself, freeing them of the natural-law conflation of human needs with arbitrary and endlessly expanding preferences. Taught by Hegel to look after the needs of the organic whole that is society rather than the gratification of their own preferences, the task of the bureaucrats of the universal estate is to curb the tendency of free markets to produce the social preconditions for an alienated “rabble” to bring down the system. Though Hegel rejects Marx’s theory of class, he nevertheless anticipates Marx’s idea of the exploitation of one class by another. How, though, do we align this proto-marxist dichotomy between rich and poor with Hegel’s official theory of class; his tripartite theory of estates? Liberados el romanticismo y el idealismo del lastre secular de su vínculo imaginario con la “catástrofe alemana” deviene una vez más posible recurrir a ellos para repensar los problemas teóricos y prácticos del presente y localizar nuevos instrumentos conceptuales para su solución. En este contexto recobran interés numerosos temas que fueron objetos privilegiados de reflexión por parte de los pensadores románticos e idealistas. El romanticismo exaltó la Revolución Francesa como un acontecimiento epocal de reivindicación de los derechos de los individuos (...) contra la opresión de las formas anquilosadas de la religión y la organización estatal. Los pensadores románticos se rebelaron contra el orden burgués en todas sus formas, contra la pauta ubicua de la razón económico-instrumental. Para Kant, lo que es útil e intercambiable no posee dignidad, sino precio. El rechazo romántico de la exhaustiva reducción del mundo a mercancía conduce a la recuperación del valor infinito de la naturaleza, en esa medida, a su “reencantamiento”. En una misma línea, el romanticismo preconiza tendencialmente todos los fenómenos no cuantificables, aquéllos que no permiten ser calculados en términos mercantiles: la corporeidad, el erotismo, la pasión, la imaginación y la fantasía, el arte y la poesía, lo telúrico, la diversidad individual y cultural. El idealismo, por su parte, busca una síntesis entre la concepción ilustrada del mundo material y la visión pre-moderna del mismo. El resultado de esa mediación es la explicitación de las estructuras del propio espíritu humano presentes en su comprensión del mundo, toda vez que para el idealismo el mundo es siempre la teoría de la mente humana sobre el mundo. El pensamiento ilustrado pudo por ello confundir la filosofía de la naturaleza de los idealistas con una visión de lo material viciada de antropomorfismo, más próxima a la mística y a los bestiarios medievales que a las ciencias naturales de la Edad Moderna. El idealismo, por el contrario, encuentra en esta suerte de principio antrópico de toda teoría un factor de liberación moral y política. La toma de conciencia de que es el sujeto el que crea sistemas de sentido y que, por tanto, éstos deben reflejar en sí mismos su origen humano, implica el corolario de que con las teorías –sea cual sea el ámbito de la realidad que ellas busquen explicar– se trata en verdad de dispositivos de ordenamiento para el conocimiento y la acción construidas por la propia subjetividad humana; en esta medida, en su origen no se encuentran datos brutos de un supuesto orden natural que debe, por tanto, ser respetado sacralmente, sino la propia comunidad de sujetos vivientes. Aunque haya dejado tras de sí y olvidado el proceso de mediaciones que le dio origen, aunque se presente, pues, como replegado sobre sí mismo y, en esa medida, como la suma de re-presentaciones de un orden encontrado en el mundo, cada sistema de ideas contiene el conjunto de prácticas subjetivas inferenciales que lo constituyeron y que fueron realizadas por múltiples sujetos en plexos históricos concretos. El idealismo consiste en explicitar a la subjetividad actuando en el objeto y, con ello, en conminar el peligro de la mutación de las teorías en ideologías. El fundamento último de la libertad descansa para el idealismo menos en el orden determinado que funciona como condición de posibilidad del ejercicio de la libertad que en el modo de autoconcepción de la propia subjetividad. A partir del mundo de las autoconcepciones del sujeto –para Hegel se trata del ámbito específico del sujeto que ha devenido por ello mismo absoluto– derivan luego, como sus corolarios prácticos, las formas concretas de ordenamiento social y político. Si bien asume en sí numerosos motivos románticos, el idealismo aspira también a una mediación de esos elementos con las contribuciones teóricas de la Ilustración, con la que guarda entonces una relación menos crítica que el romanticismo. Fruto de este espíritu más ecuménico y menos orientado a la ruptura, defiende una concepción más pacífica de la racionalidad capitalista y el mundo burgués. Hegel reivindica así el rol positivo del mercado con su división social del trabajo y una concepción menos revolucionaria y más reformista de la vida política. El neoliberalismo contemporáneo se concibe a sí mismo como el sistema que resulta naturalmente del principio de la libertad negativa. Una tesis central del idealismo alemán es que para que sea posible el ejercicio de la capacidad de decidirse autónomamente por diferentes metas es necesario el marco efectivo de la libertad positiva. Sin la presencia de un orden racional con poder coercitivo sobre los miembros de la sociedad para regular su conducta, la libertad negativa de esos miembros, a primera vista disminuida y parcialmente cercenada por aquel orden, no es en la práctica posible. O presente artigo busca analisar de que modo os problemas da segurança e da economia das punições passam a ser centrais no cálculo político-econômico da racionalidade neoliberal. Como propõe Michel Foucault em seu curso Nascimento da Biopolítica, de 1979, a tecnologia de governo neoliberal conceberia o aparato estatal como “efeito móvel de um regime de governamentalidades múltiplas”. É o enfoque econômico, portanto, que permitirá pôr à prova a eficácia da ação governamental, a partir da avaliação do custo-benefício das intervenções na (...) esfera do mercado e da sociedade, conforme a proposição dos teóricos neoliberais. Essa crítica mercantil direciona-se ao que é concebido como “dispêndio” das ações econômicas do poder público, dado que o mercado se torna “uma espécie de tribunal econômico permanente em face do governo”, como sugere Foucault. Nesse cenário, no qual se ampliam as demandas punitivas, a eficiência de atuação do sistema de justiça criminal dos Estados será medida pela avaliação do mercado e da economia, tendo em vista os seus efeitos. Tratar-se-á, então, de refletir sobre o funcionamento do poder punitivo em moldes econômicos, isto é, pela via da problematização dos custos da delinquência e dos modos de torná-los o menos dispendioso possível e com a máxima eficiência. RESPONSABILIDADE ESTATAL NOS CRIMES COMETIDOS CONTRA OS DIREITOS HUMANOS DURANTE A VIGÊNCIA DA DITADURA MILITAR BRASILEIRA.

The article discusses selected findings from two Norwegian studies among real‐estate agents and real‐estate students, and their relevance for real‐estate education in professional ethics. The survey data‐set indicates that the industry morality of real‐estate agents is more peer‐group oriented, less individualistic and more intersubjective than in other comparable Norwegian industries. The qualitative material shows how respondents perceive and discuss three professional role conflict scenarios in a rule‐ or consequence‐focused pattern. En A Letter Concerning Toleration John Locke argumenta en favor de la tolerancia religiosa afirmando que el Estado no puede mejorar la vida de las personas forzándolas a vivir de acuerdo con creencias que ellas no suscriben. Más recientemente, Ronald Dworkin y Will Kymlicka han desarrollado argumentos similares. En el caso del primero, contra ciertas políticas paternalistas; en el del segundo, en apoyo de la tesis liberal de la neutralidad estatal. Mi propósito en el presente artículo es analizar la plausibilidad (...) de dichos argumentos concebidos como una defensa de la tesis de la neutralidad estatal. Intentaré demostrar que ambas versiones del argumento fracasan. En la sección II, cuestionaré la capacidad de los argumentos para respaldar las conclusiones que aspiran establecer, sin objetar la plausibilidad de las premisas involucradas. En la sección III, desarrollaré tres objeciones contra la concepción del bienestar crítico que constituye el corazón de ambas versiones del argumento. For a variety of reasons, Hegel's theory of the estates remains an unexpected and unappreciated feature of his practical philosophy. In fact, it is the key element of his social philosophy, which grounds his more properly political philosophy. Most fundamentally, it plays this role because the estates provide the forms of visibility required by Hegel's distinctive theory of self-determination, and so the estates constitute conditions for the possibility of human agency as such. With respect to political agency in particular, this (...) ramifies into the view that the estates are social preconditions for legal and political practices, forms of political participation in their own right, and conditions of possibility of moderate government (three functions also attributed to the estates by Montesquieu). One of the most common terms in late-medieval discourse is “estate” in its Latin or vernacular forms: status, estat, estado, stato, stav, stat, stand, etc. Its basic sense, derived from stare and common to a wide variety of meanings in various contexts, can be recognized in such modern English equivalents as “status,” “station,” “estate,” “stately,” “state,” “standing,” and the like. Its secondary, particular meanings, however, cannot be regularly perceived on this basis, and in all cases there are problems (...) beneath the surface due to the structural differences between Alteuropa and the “modern” world of the nineteenth century, as well as the postmodernity of the twentieth. This study examines the apparently well-established rule that the equitable doctrine of conversion operates on a contract to grant an interest only so long as it is specifically enforceable. It observes that in principle and in practice there is good reason to believe this not to be the case. It looks at the original culture of conversion, in terms of the historical relationship of property and contract from which it emerged, but suggests that the specific enforceability rule first arose out (...) of the narrowness of the original availability of common injunctions. But when, in the late nineteenth century, common injunctions began to lie more expansively and the rule could have been discarded, it was in fact preserved, and indeed insisted upon. It is suggested that this was because adherence to the old narrow view on common injunctions and to its concomitant, the specific enforceability rule in estate contracts, served the purposes of the Chancery lawyers who were contemporaneously adopting a restrictive attitude to the effects of the Judicature Acts 1873–5, by emphasizing the distinctiveness of equitable institutions. However, such views were not a doctrinally necessary consequence of that attitude, and, given the a priori unsuitability of the specific performance rule, there seems no reason why it should not nowadays be regarded as obsolete. But the lessons which equity had thus had to learn by experience can usefully be extrapolated into conclusions of more general applicability for legal development. (shrink)

The thesis that an analysis of property rights is essential to an adequate analysis of the state is a mainstay of political philosophy. The contours of the type of government a society has are shaped by the system regulating the property rights prevailing in that society. Views of this sort are widespread. They range from Locke to Nozick and encompass pretty much everything else in between. Defenders of this sort of view accord to property rights supreme importance. This case study chronicles the entrepreneurial and real estate investment activities of a recent Ph.D. graduate in business administration. The protagonist learns that clear focus is necessary for entrepreneurial success and that trust does not mix with entrepreneurship and negotiation. Ethics are sometimes problematic for entrepreneurs.

The economic reactivation of Cartagena harbour from sixteenth century constitutes an importatn gap in the spanish historiography. This development, motivated mainly because of the repulse of its comercial function, it will be a good phocus of atraction for the foreigner merchant, which, in a narrow relation with the mercantile autochtonous bourgeoise, will dominate the hasrbour activity, comercial and finance of the city, forming a powerfull urban oligarchy.

After the French Revolution, the codification movement led to the introduction of the Dutch Civil Code and the Commercial Code of 1838. These codifications were generally regarded as the bedrock of a dogmatic system in which little space was left for customs and customary law. Mercantile jurists, such as Holtius and Levy, were opponents of the legalistic approach of the new codifications. They tried to separate mercantile law from civil law in order to protect mercantile law from (...) excessive legalistic influences. According to them, mercantile law was characterised by internationality, custom as its main source of law, continuity through an extended mercantile legal history and by good faith and mutual trust between the merchants. Out of these, the historicity and homogeneity of a strong community of merchants are particularly in line with a traditional and conservative view on society. Holtius and Levy, however, had little in common with their Christian-conservative contemporaries. On the one hand, they rather seemed to foreshadow the kind of liberal-conservatism as expressed by Hayek during the 20th century. On the other hand, their ideas have much in common with different lex mercatoria –traditions developed by authors as Goldman and Schmitthoff. On the aspects of historicity and internationality Holtius and Levy seem to have much in common with Hayek whereas concerning communality and the legal nature of customary law there are more similarities with the lex mercatoria-traditions. Argues that during the late Imperial period, all three main religious strains in China embraced an ethic that everyone should engage in labor as a crucial component to their personal enlightenment and their duty to society. This is what brings together new Chan (Zen in Japanese) Buddhism; new religious Daoism; and new Confucianism. All three new religions had to overcome traditional elitist biases and moral concerns about working for individual material results. To overcome traditional assumptions and practices, as well as (...) to embrace the priority of working for one's livelihood, required the religious practitioners to resolve tensions within their own minds and often with precepts of earlier forms of their religious traditions. The final section of the book focuses on the changing social status of merchants, their enhanced self-confidence in their identity and profession, and their manifestation of the new work ethics in their mercantile activities, especially from 1500 to 1820. Although much has been written globally about the key issues of corporate governance in REITs, there are not enough studies inspired by the systematic literature review method. This study reviews the literature on corporate governance in real estate investment trusts (REITs) published after 2004 and addresses three interrelated research questions. We examined 77 peer-reviewed journal articles using a systematic literature review approach. We found that there has been a rise in studies since 2010, with a brief decrease in 2015 (...) and 2017 before increasing again in 2016. Moreover, the vast majority of the studies were published in the areas of economics/econometrics/finance and business/management/accounting. In addition, most of the papers are single-country studies, and the minority are multi-country. The majority of the papers are focused on the USA and Asia. Pretendemos ahondar críticamente en las condiciones psicosociales y antropológicas de un mundo donde las mujeres y los hombres van quedando _rebasados _por una combinación a veces explosiva de velocidad mercantil y capitalismo mundializado. La tecnofilia, verdadero fetichismo de nuestro tiempo, opera a pleno rendimiento como uno (...) de los discursos ideológicos legitimadores de ese proceso histórico por medio del cual los hombres empequeñecen ante su propia creación; hombres _desbordados _por la potencia apabullante de un conjunto de desarrollos tecnocientíficos que, y esto es crucial, se despliegan con relativa e inquietante autonomía y siguiendo dinámicas que en muchas ocasiones no responden a necesidades humanas reales. La tecnología, que nunca es políticamente inocente, adquiere proporciones y alcances inusitados cuando, además, su despliegue responde a una lógica acumulativa capitalista de carácter ilimitado. This study evaluates responses to the Real Estate Ethical Code. Voice Stress Analysis (VSA) is used to evaluate the responses of real estate sales people to ethically-based questions. The process and the responses given enabled the authors to gain insight into pressure-causing ethical situations and to explore new uses of VSA. Some respondents were stressed while following the ethical code guidelines. Others showed no stress about breaking the formal code. The study reaffirms that the presence of formal ethical (...) guidelines does not assure that the rules will be willingly followed. (shrink)

This article adopts an ecological view of cognition to analyze the role of the environment in scaffolding metaphorical experience. Using ethnographic material collected from two real estate showrooms in China, we describe how each showroom setting is equipped with to-be-phenomenologically-experienced objects designed to stimulate desirable sensorimotor experiences and altered bodily states during the guided showroom tours. By analyzing the qualities of such settings and identifying the processes through which visitors become environmentally coupled—including active and passive touch in highly organized (...) auditory, olfactory, and gustatory environs—we demonstrate how the showrooms constitute an affordance space for enacting metaphoricity through doubleness in experience. Implications for conceptual metaphor theory relating to the nature of environments and bodies are discussed. (shrink)

This article uses sociological role theory to help understand ethical challenges faced by Norwegian real estate agents. The article begins with an introductory case, and then briefly examines the strengths and limitations of using legal definitions and rules for understanding real estate agency and real estate agent ethics. It goes on to argue that the ethical challenges of real estate agency can be described and understood as a system of conflicting roles with associated rights and duties, (...) in particular sales agent, intermediary and adviser sub-roles. The arguments are developed using exploratory findings from a survey of Norwegian real estate agents and from several focus groups. The article then suggests the use of various intranet tools as a kind of action research aimed at putting ethics on the real estate agents' agenda, working to develop a collective conscience and collective selfcriticism among the agents, and, in doing so, building bridges between academic research and the practical working world of the agents. The main narratives of prevailing ideas of the Fourth Estate were articulated in the era of traditional mass media, and these traditional narratives are challenged by the changing media landscapes. This raises the question whether traditional narratives of the Fourth Estate should be maintained. We will argue – through a close reading of Derrida’s reflections on the relationship between communicative significance and silence, combined with a deliberative ideal for democracy – that the new structures of communication call for (...) a Fourth Estate that focuses on creating spaces for flexible structures of silence in the public sphere. The Fourth Estate has an obvious assignment of counteracting problematic structures of silence. In this article, we will, however, bring out assignments of creating spaces of silence in the public sphere: by silencing certain dominant voices, making room for an increased lack of answers and creating an awareness of the insufficiencies of the public spheres. La découverte d’un nouveau mois à Ténos et l’identification d’un graveur à Paros conduisent à formuler de nouvelles hypothèses sur le problème des sûretés réelles en droit grec. L’examen du registre de Ténos (IG XII 5, 872) en vue de sa réédition a fait apparaître une erreur de découpage entre les actes 17 et 18 chez les éditeurs antérieurs, qui n’ont pas reconnu le nom d’un mois, Èrès[iôn], équivalent du mois délien Arèsiôn attesté depuis peu à Andros, l’île voisine. En (...) faisant disparaître une clause obscure de ce document, cette découverte invite à réexaminer le fonctionnement d’un gage hypothécaire d’un type particulier, l’apotimèma dotal, auquel l’un des actes du registre fait allusion. Ce point acquis, on aborde ce qui fait par contraste la spécificité de la vente avec faculté de rachat (prasis épi lysei) : à Ténos comme à Athènes, elle se caractérise par un transfert de propriété immédiat au profit du créancier, au moyen d’un acte de vente complété le cas échéant par un contrat de location. Le rapprochement entre une borne récemment découverte à Paros (SEG 54, 794) et une célèbre loi sur les archives, gravée par le même lapicide, permet en dernier lieu de préciser la relation entre la prasis épi lysei et les pratiques d’archivage public à l’époque hellénistique. The article is devoted to the experience of postmodern representation of the metaphysics of corporeality. The meaning of A. Artaud’s “Theatre of Cruelty” is shown as a living act of ontologization of the body through the pain phenomenon. The game of mercantile and thinking participant in the action is distinguished. The purpose of scientific research: to distinguish between psychological and metaphysical experiences as those that determine the bodily and carnal goals of the participants; accordingly, to show the actions of (...) selfish and selfless roles with their ability to pass or block pain. Objectives of the research: to investigate the mechanisms of postmodern understanding of the metaphysics of the body through A. Artaud’s experience; to present the sphere of the Theater of Cruelty as the destiny of mankind to be a participant in the horrible and to be able to sympathize with it; to highlight the game of mercantile and selfless participant in ambiguous actions; to emphasize pain as a criterion of ontologizing the body; to show the places of the Theater of Cruelty in action on living examples. The scientific novelty lies in the view of the metaphysics of corporeality through the Theater of Cruelty and existential pain. Being a man of postmodern thinking, A. Artaud considers metaphysics in action and shows corporeality by a joint action, which is an event. (shrink)

Sin embargo, tras tanto esfuerzo, las soluciones a los problemas de la teoría de la pena son tan variadas como variados son los autores que se han aproximado intelectualmente a ellos. Además, de entre todas las posiciones dogmáticas, ninguna parece llevar la delantera en la dialéctica académica actual. Frente a aquel (...) fenómeno, esta obra pretende arrancar el acercamiento a la institución punitiva desde su base, que no es otra que el comportamiento humano. Si aceptamos que el castigo estatal es una de las formas de control social de conductas, resulta interesante comenzar conociendo cómo se comporta el ser humano con relación a los fenómenos punitivos. Desde ese punto inicial se pueden confirmar empíricamente las intuiciones que se esconden tras una gran parte de las teorías de la pena y construir una justificación propia de la misma que, aceptando tanto la complejidad del comportamiento humano como la de los efectos del castigo en el mismo, reconozca una vigencia todavía muy fuerte (aunque también muy diversa) de las teorías tradicionalmente denominadas como prevención general negativa y positiva. Además, este modo de aproximación también consigue explicar la pervivencia del «irracional» pensamiento retributivo y el encaje de las más modernas teorías del fair play. En suma, facilita construir un modelo de justificación de la pena complejo y netamente consecuencialista fundamentado en realidades empíricamente constatables, lo que, por un lado, vacuna a esta posición frente a críticas puramente valorativas y, por otro, pretende que la discusión general se desarrolle sin perder de vista el mundo de lo fáctico. Anglo-Swedish scholarly correspondence from the mid-eighteenth century contains repeated mentions of two merchants, Abraham Spalding and Gustavus Brander. The letters describe how these men facilitated the exchange of knowledge over the Baltic Sea and the North Sea by shipping letters, books and other scientific objects, as well as by enabling long-distance financial transactions. Through the case of Spalding and Brander, this article examines the material basis for early modern scholarly exchange. Using the concept of logistics to highlight and relate several (...) mercantile practices, it examines ways of making scholarly knowledge move, and analyses merchants’ potential motives for offering their services to scholarly communities. As logisticians in the Republic of Letters, these merchants could turn their commercial infrastructure into a generator of cultural status valid in both London and Stockholm. Using mercantile services, scholarly knowledge could in turn traverse the region in reliable, cost-effective and secure ways. The case of Spalding and Brander thus highlights how contacts between scholarly communities intersected with other contemporary modes of transnational exchange, and it shows how scholarly exchange relied on relationships based on norms different from the communalism often used to characterize the early modern Republic of Letters. Thus the article suggests new ways of studying early modern scholarly exchange in practice. (shrink)

This paper explores Kant's account of marriage and its relevance to contemporary debates over same-sex marriage. Kant's defense of marriage is read against debates unfolding in Prussia in the 1790s, when the question of whether marriage was a "universal estate" was a central point of debate surrounding the Prussian Legal Code of 1794. By reading Kant's arguments in light of this historical context, and in comparison with those offered by his contemporaries, Fichte and von Hippel, this article shows both (...) that the debates about marriage in the 1790s mirror contemporary tensions, and that Kant took a "middle path" that innovatively defended marriage as a basic feature of the state. As a result of financial difficulties confronting American agriculture, public debate is focusing on longterm options for restoring economic stability and growth to the agricultural economy. Many believe that just as homeowners in small communities throughout the nation have been served by the development of a secondary market for residential mortgages sponsored by the federal government, farmers throughout the country would similarly benefit from the development of a secondary market for farm real estate mortgages. This paper discusses issues relating (...) to the development of a secondary market for agricultural real estate loans. The concept of a secondary market for agriculture is of considerable interest to Congress, as evidenced by recent enactment of the Agricultural Credit Act of 1987 which established the Federal Agricultural Mortgage Corporation (“Farmer Mac”) to create a secondary market for farm real estate loans. The first section discusses the general nature of secondary markets and their purposes, with particular attention given to the secondary market for home mortgages because it served as a model for a secondary market for farm loans. Section two discusses basic differences between agriculture and housing, and section three provides a brief discussion of federal credit subsidies designed to help meet social and economic goals by influencing the allocation of credit to particular sectors of the economy such as housing and agriculture. Potential benefits and costs associated with the development of a secondary market for agriculture are discussed in section four. (shrink)

This paper outlines Hans Ulrich's reworking of the Lutheran doctrine of the estates. He conceives the estates as descriptions of the new patterns of social life that God has promised to found and secure. This emphasis on the divine activity of generating social order is an expression of Ulrich's agreement with common and familiar criticisms of the doctrine, and why he nevertheless believes it indispensable for an evangelical ethic. A construal of the traditional doctrine of the estates that is unique (...) even in his native Lutheran context, it aims not at conservatism, but at a more thoroughly theological and therefore critical relationship to social order than rival theories much more inclined to revisionist rhetorical stances. In a contemporary context in which moral certainties and categories can be disputed at the most fundamental levels, Ulrich's theology seeks a form of theological reasoning that genuinely seeks the illumination of Christian beliefs about reality by taking other moral languages seriously. Members of licensed occupations benefit from legal standards that limit entry into their professions. Is it ethical for these professionals to give political support to these standards? I examined the case of real estate brokers and found that their educational requirements raise average commissions by one quarter of a percentage point, costing consumers $5.4 billion per year without improving the quality of brokerage services. The case raises interesting ethical issues which are difficult to resolve.
