The aim is to review the decisions of the Central Elections Committee and of the Supreme Court regarding disqualification of lists in Israel. Two major questions are addressed: When should tolerance have its limits?; and, What constraints on liberty should be introduced in order to safeguard democracy? The judicial analysis focuses attention on the issue of whether the justices acted in accordance with the law. Consideration is given to the written law and to existing normative considerations which allow justices (...) an exegetic latitude. It is argued that theNeiman decision of 1984 was flawed, that the Court was erroneous in ignoring the licensing effect of its decision, and that democracy does not have to allow a violent list propounding the destruction of democracy to act in order to fulfil its aim. It is neither morally obligatory, nor morally coherent, to expect democracy to place the means for its own destruction in the hands of those who either wish to bring about the physical annihilation of the state, or to undermine democracy. These two cases are the only cases in which democracy has to introduce self-defensive measures and to deny representation in parliament to violent lists that convey such ideas, and that act to realize them. Justification depends on context: even if E on its own justifies H, still it might fail to justify in the context of D. This sort of effect, epistemologists think, is due to defeaters, which undermine or rebut a would-be justifier. I argue that there is another fundamental sort of contextual feature, disqualification, which doesn't involve rebuttal or undercutting, and which cannot be reduced to any notion of screening-off. A disqualifier makes some would-be justifier otiose, as direct testimony sometimes does (...) to distal testimony, and as manifestly decisive evidence might do to gratuitous evidence on the same team. Basing a belief on disqualified evidence, moreover, is distinctively irrational. One is not necessarily irresponsible. Instead one is turning down a free upgrade to a sleeker, stabler basis for one's beliefs. Such an upgrade would prevent wastes of epistemic effort, since someone who bases her belief on a disqualified proposition E will need to remember E and rethink her belief should E ever be defeated. The upgrade might also reduce reliance on unwieldy evidence, if E is relevant only thanks to some labyrinthine argument; and if even ideal agents should doubt their ability to follow such arguments, even they should care about disqualifiers. As Justin Biddle and I have argued, climate skepticism can be epistemically problematic when it displays a systematic intolerance of producer risks at the expense of public risks : 261–278, 2015). In this paper, I will provide currently available empirical evidence that supports our account, and I discuss the normative consequences of climate skepticism by drawing upon Philip Kitcher’s “Millian argument against the freedom of inquiry.” Finally, I argue that even though concerns regarding inappropriate disqualification of dissent are reasonable, (...) a form of “targeting” dissent—namely revealing manufactured dissent—is required in order to identify epistemically detrimental dissent and, thus, to protect scientific and public discourse. I argue that sports clubs should be punished for bad behaviour by their fans in a way that affects the club’s sporting success: for example, we are justified in imposing points deductions and competition disqualifications on the basis of racist chanting. This is despite a worry that punishing clubs in such a way is unfair because it targets the sports team rather than the fans who misbehaved. I argue that this belies a misunderstanding of the nature of sports clubs and (...) of the nature of sporting success. Further, I argue that fans should want to be held responsible in such a way because it vindicates the significant role that they play in the life of their club. (shrink)

In a previous paper (Compléments pour une théorie des distorsions cognitives, Journal de Thérapie Comportementale et Cognitive, 2007), we did present some elements aimed at contributing to a general theory of cognitive distortions. Based on the reference class, the duality and the system of taxa, these elements led to distinguish between the general cognitive distortions (dichotomous reasoning, disqualification of one pole, minimization, maximization) and the specific cognitive distortions (disqualifying the positive, selective abstraction, catastrophism). By also distinguishing between three levels (...) of reasoning – the instantiation stage, the interpretation stage and the generalization stage – we did also define two other cognitive distortions: over-generalization and mislabeling (Théorie des distorsions cognitives : la sur-généralisation et l'étiquetage, Journal de Thérapie Comportementale et Cognitive, 2009). This article addresses the question how to restore the biggest possible amount of fairness after a discovery of doping infringement. I will analyse eight actions that could be taken: disqualification and re-ranking, change in official result, medal stripping and medal re-awarding, ban, rematch, legal action, apology and forgiveness. I conclude that the best way to restore the biggest possible amount of fairness seems to be a selected combination of actions. I also propose that re-ranking and medal re-awarding should be (...) accompanied by a ceremony in which the new winners are celebrated because they typically did not have the possibility of enjoying their success in front of the original audience. Law 49/2018, of August 14, created the Portuguese legal regime of the assisted decision-making (capacity), thus eliminating the legal institutes of interdiction and disqualification, provided for in the Civil Code (CC). The aim of this legal regime was to embed a new vision of disability based on a model of rights, that grants people with disabilities an independent and autonomous life and reflects the acceptance of the International Convention on the Rights of Persons with Disabilities (CRPD) guidelines. This essay argues that the deontological view of morality is connected to extreme and massive forms of violence through a kind of phenomenological necessity. In the first main section, I examine one family of such violence, which usually comes under the label of “religious violence”. I argue that it is not the religious element but the disqualification of context from the realm of justification which characterizes such violence. In the second main section, I examine the phenomenology of duty to (...) conclude that duty, by definition, denies any normative relevance to context. In the third main section, I use this sketch of a phenomenology of duty to propose a hypothesis about the underpinnings of the connection between mass violence and duty, namely, that the notion of duty carries with it the exclusion of moderation, and places the agent before an impossible situation that can only be resolved by violence. One reason is widespread self-deception about the motivations for pursuing art. We often hear artists explain their commitment to art by a desire to express themselves or develop their gifts. We hear of a love of beauty or the challenges of craft or the chance for insight into self and world. Frequently, artists describe being called to art, a feeling of being chosen by art rather than choosing it. These are familiar accounts of what makes a life or career in art worth pursuing. Professional fasting ultimately becomes a path to truth for the hunger artist. In the figure of the hunger artist, Kafka captures one self-delusion common among artists.IIn "A Hunger Artist," Kafka charts the decline of an accomplished artist.1 Kafka tells us that the artist, a practitioner of what the author describes as a now forgotten genre of performance art known as professional fasting, garners a degree of notoriety for his ability to sustain fasts of death-defying lengths. Half-art, half-sport, Kafka's professional fasting amounts to sitting in a contained but public space such as a cage, where the fast is observable round-the-clock by watchers whose job is to verify its authenticity. The fast is also subject to the attention of paying spectators. Presumably, it is this commercial element as well as the secular hubbub surrounding the fast that most distinguishes it from religious fasting (out of which artistic fasting must have emerged sometime in previous centuries, had Kafka also bothered to concoct a history of the practice). A professional fast typically lasts for periods of up to the biblically resonant forty days, after which the artist is carried from his cage with great fanfare to a modest, performance ending breakfast. Through the practice of fasting, the hunger artist lifts self-denial and by implication, self-control, to the level of virtuosity. The grace of the fast and even a sense of moderate contentment in it are part of what is on display for the audience.Notwithstanding a light routine of bonhomie, Kafka's hunger artist remains distant from his audience. He is neither buoyed by their adoration nor deflated by their vulgarity. Instead, the hunger artist seems entirely sustained by his practice. In his self-possession, we glimpse a familiar ideal of the authentic artist devoted to his practice for the sake of its intrinsic rewards. Indeed, doubts about the authenticity of his performance only fuel the hunger artist's determination. Far from insulted by the zeal of official observers, the hunger artist welcomes their vigilance. In their distrust of the hunger artist, the most severe of watchers convey a respect for the practice of professional fasting. Their desire to scrupulously ratify the authenticity of his effort is also an endorsement of its value. Cet article retrace le profond renouvellement de la conception traditionnelle du groupe ethnique (ou de l’ethnie) mené au cours des années 1970 par l’anthropologie européenne et la sociologie américaine. La disqualification du groupe ethnique comme objet doté d’une consistance et d’une réalité intangible, a rendu possible de l’envisager comme catégorie de perception orientant les processus d’identification et d’altérisation engagés dans les actions et dans les contextes de ces actions. Cette approche constructiviste a remis en cause les postulats holistes sous-jacents (...) aux deux disciplines ici envisagées et a conduit à considérer la culture plutôt comme une implication que comme le fondement des appartenances. Si les contrastes culturels jouent un rôle central dans l’organisation sociale ethnique, ils sont circonstanciels et situés et leur fonction de marques d’appartenance n’implique pas l’existence de totalités cohérentes, comme autant d’univers juxtaposés. Ainsi l’approche de l’ethnicité rejoint-elle les efforts contemporains de courants de l’anthropologie, qui au-delà de la remise en cause de l’ethnie, récuse l’idée qu’aux différences de comportements descriptibles correspondent des différences de mentalité, et qui sans rejeter la notion de culture cherchent à refonder les significations partagées à distance du culturalisme. The question of social medicine provides the opportunity to engage in a critical reading of Foucault's theory of biopower. The analyses dedicated by Foucault to `the birth of social medicine' represent one of the few examples of a thorough application of that theory. They allow Foucault to show the heuristic value of the biopolitical hypothesis at the level of the most concrete historical materiality, and not just at that of the general history of the forms of governmentality. These analyses, however, (...) also allow the historiographical and political limits of the biopolitical hypothesis to come to light. From the perspective of the history of sciences as well as from that of the analysis of the modalities of social critique in the first half of the nineteenth century, Foucault appears to provide an interpretation that is too continuist and tends to homogenise the historical phenomena. The disqualification of social medicine relies in part on simplifications that continue to bear great significance today in view of the current transformations in the social question. (shrink)

Does John Henri Newman also suffer from the ‘anti-trinitarian fearfulness’ Karl Rahner sees as a characteristic feature of western theology? Rahner refers with that disqualification to a tendency in theology to prefer the gifts of the Spirit to the gift of the Spirit and to the metaphorical interpretation of texts about indwelling. Two texts by Newman are analysed: a Pentecost sermon on indwelling and his Lectures on Justification. In the sermon there is no sign of that anti-trinitarian fearfulness. But (...) since that sermon could be viewed as an occasional piece, the more wide ranging Lectures are also analysed. In these Lectures Newman argues that both the protestant and catholic theologians are too quickly satisfied in their discussions of justification, since they are pointing either to faith or to spiritual renovation, since they take not into consideration the basis of both faith and renovation: the presence of the Spirit. Moreover, he argues explicitly for a literal understanding of the biblical text about indwelling. Newman is often seen as the invisible peritus of the Second Vatican Council. On the basis of the texts analysed one can argue that he can be considered a forerunner for the current renaissance of the theology of the Trinity as well, be it that more research needs to be done to give this conclusion a broader basis. Trata-se, portanto, de um ensaio especulativo produzido em torno do diagnóstico de um desmoronamento catastrófico da distinção fundamental da episteme moderna, a distinção (...) entre as ordens cosmológica e antropológica, sugerindo uma cartografia precária dos corpos ingovernáveis ancorada em uma sutil arte política: a arte de segurar o céu pelas diferenças. Essa arte almeja atravessar o abismo que historicamente separou um povo com filosofia em oposição aos povos com mito, construindo pontes que incitem a Filosofia da educação e seus praticantes a se situarem na equivocidade dos mundos e aí habitar. The paper discusses the current medical practice of "gender verification" in sports from an ethical point of view. It takes the recent public discussion about 800-meter runner Caster Semenya as a starting point. At the World Championships in Athletics 2009 in Berlin, Germany, Semenya was challenged by competitors as being a so called "sex impostor". A medical examination to verify her sex ensued. The author analyses whether athletes like Semenya could claim a right not to know that is generally acknowledged (...) in human genetics and enforced by international and national genetic privacy laws. The relevance of this right for genetic diagnosis in sports is discussed. To this end, the interests of the athlete concerned and of third parties are balanced according to the expected benefits and harms. Harm is documented in a number of cases and includes unjustified disqualification, severe sex and gender identity crisis, demeaning reactions, social isolation, depression and suicide. Benefits are dubious as most cases of intersex are considered irrelevant for sports competition. It has to be concluded that the benefits to be gained from "gender verification" in sports via genetic testing do not outweigh the grave individual disadvantages. The current practice of athletic associations to largely ignore the right of competitors not to know does not comply with prevailing ethical provisions on the protection of sensitive personal data. Therefore, genetic "gender verification" in sports should be abolished. (shrink)

Ever since the early decades of this century, there have emerged a number of competing schools of ecology that have attempted to weave the concepts underlying natural resource management and natural-historical traditions into a formal theoretical framework. It was widely believed that the discovery of the fundamental mechanisms underlying ecological phenomena would allow ecologists to articulate mathematically rigorous statements whose validity was not predicated on contingent factors. The formulation of such statements would elevate ecology to the standing of a rigorous (...) scientific discipline on a par with physics. However, there was no agreement as to the fundamental units of ecology. Systems ecologists sought to identify the fundamental organization that tied the physical and biological components of ecosystems into an irreducible unit: the ecosystem was their fundamental unit. Population ecologists sought, instead, to identify the biological mechanisms regulating the abundance and distribution of plant and animal species: to these ecologists, the individual organism was the fundamental unit of ecology, and the physical environment was nothing more than a stage upon which the play of individuals in perennial competition took place. As Joel Hagen has pointed out, the two schools were thus dividied by fundamentally different and irreconcilable assumptions about the nature of ecosystems.Notwithstanding these divisive efforts to elevate the image of ecology, the discipline remained in the shadows of American academia until the mid-1960s, when systems ecologists succeeded in projecting ecology onto the national scene. They did so by seeking closer involvement with practical problems: they argued before Congress that their approach to the theoretical problems of ecology was uniquely suited to the solution of the impending “environmental crisis.” With the establishment of the International Biological Program, they succeeded in attracting unprecedented levels of funding for systems ecology research. Theoretical population ecologists, on the other hand, found themselves consigned to the outer regions of this new institutional landscape. The systems ecologists' successful capture of the limelight and the purse brought the divisions between them and population ecologists into sharper relief — hence the hardening of the division of ecology observed by Hagen.45I have argued that the population biologist Richard Levins, prompted by these institutional developments, sought to challenge the social position of systems ecology, and to assert the intellectual priority of theoretical population ecology. He attempted to do so by articulating a nontrivial and rather carefully thought out classification of ecological models that led to the disqualification of systems analysis as a legitimate approach to the study of ecological phenomena. I have suggested that — ultimately —Levins's case against systems analysis in ecology rested on the view that an aspiration to realism and prediction was incompatible with an interest in theoretical issues, a concern that he equated with the search for generality. He sought to reinforce this argument by exploiting the fact that systems ecologists had staked their future on the provision of technical solutions to the problems of the “environmental crisis”: he associated systems ecologists' aspiration to realism and precision with a concern for practical issues, trading on the widely accepted view that practical imperatives are incompatible with the aims of scientific inquiry.46 These are plausible, but nonetheless questionable, claims which have now become an integral part of ecological knowledge. And finally, I hope to have shown how even the most abstract levels of scientific argument are shaped by political considerations, and how discussions of the conceptual development of modern ecology might benefit from a greater consideration of its historical and social dimensions.47. In this paper we study collective identity functions that deal with formation of clubs. Usually the choice offered to individuals is to cast a vote in favor of qualification or not, and the final outcome is qualification or non-qualification. In this context we show that independent collective identity functions are naturally characterized by voting rules, and in particular, consent rules can be represented by one single collection of weighted majorities. In addition, we consider the extended model where voters are allowed (...) to abstain and we distinguish between disqualification and a neutral outcome. We show that this environment allows agents to act in different capacities that cannot be distinguished in the original formulation of the problem. (shrink)

A central tenet of truthmaker theory is that necessitation is necessary for truthmaking (NEC). This paper defends NEC in a novel, piecemeal way, namely by responding to a potential counterexample involving a changing past. If Carter won a race at t1 but is later disqualified at t2, then Carter no longer won at t1. A wholly past event seems to have changed in the future. The event makes ‘Carter won the race at t1’ (RACE) true between t1‐2 but fails to (...) make it true at t2. So, we have a potential counterexample to necessitation: a truthmaker of RACE fails in another context to make the same truthbearer RACE true. I argue that the best solution to this challenge is not that there are different truthbearers at t1‐2 and t2 (the semantic response), or that RACE was never true because of the future disqualification or will always be true despite the future disqualification. The best solution is to accept that the past can change: past events can change based on what happens in the future (e.g., via their effects). This paper's novel defence of necessitation will illustrate the importance of utilising explicitly ontological and commonsensical tools in accounting for truth. (shrink)

Despite the importance of the “historiographical revolution” in Kuhn’s work, he did not carry out a specific study about it. Without a systematic investigation into it, he even affirms that the “old” historiography of science (OHS) is unhistorical, suggesting its summary disqualification in the face of his “new historiography” of science (NHS). My wider project, of which this paper is a part, is to better discuss the issue of the justification of the NHS. In this paper, I discuss the (...) justification (and the genesis) of the OHS, focusing on Condorcet and Comte and resorting especially to Koyré. This will allow us to understand that the relation between the OHS and the NHS is a new instance of inter-theoretical incommensurability. And, indeed, that the NHS is not stricto senso a new historiography. It is the same historiography used for other disciplines (art, philosophy), which in the twentieth century begins to be applied to science as well. (shrink)

The notion of the ‘division of physiological labour’ is today an outdated relic in the history of science. This contrasts with the fate of another notion, which was so frequently paired with the division of physiological labour, which is the concept of ‘morphological differentiation.’ This is one of the elementary modal concepts of ontogenesis. In this paper, we intend to target the problems and causes that gradually led biologists to combine these two notions during the 19th century, and to progressively (...) dissociate them, retaining only the concept of differentiation by the early 20th century. We shall adhere to the following: 1. The primitive economic concept of the division of labour is not a descriptive notion denoting a type of organisation of labour, but an etiological one: the idea of a causal relationship between this type of organization and the improvement of the whole. 2. This concept rapidly interested naturalists such as Henri Milne-Edwards, who were keen to find a rational ground for hierarchizing living forms based on anatomical complexity. 3. The validation of this notion in the realms of biology was subject to at least two conditions which were far from being fully satisfied. This did not prevent, however, the initial success of the concept of the division of physiological labour during the second half of the 19th century. 4. Finally, the gradual disqualification, within the Darwinian theoretical context, of the conception of an intrinsic hierarchical rank of organisms, led to a lack of interest in the concept of the physiological division of labour, at least in its non-Darwinian and non-ecological variant. The Controversy over the Existence of the World (henceforth Controversy) is the magnum opus of Polish philosopher Roman Ingarden. Despite the renewed interest for Ingarden’s pioneering ontological work whithin analytic philosophy, little attention has been dedicated to Controversy's main goal, clearly indicated by the very title of the book: finding a solution to the centuries-old philosophical controversy about the ontological status of the external world. -/- There are at least three reasons for this relative indifference. First, even at the time (...) when the book was published, the Controversy was no longer seen as a serious polemical topic, whether it was disqualified as an archaic metaphysical pseudo-problem, or taken to be the last remnant of an antiscientific approach to philosophy culminating in idealism and relativism. Second, Ingarden’s reasoning on the matter is highly complex, at times misleading, and even occasionally faulty. Finally, his analysis is not only incomplete – Controversy being unachieved – but also arguably aporetic. -/- One may wonder, then, why it is still worth excavating this mammoth treatise to study an issue apparently no longer relevant to contemporary philosophy. Aside from historical and exegetical purposes, which are of course very interesting in their own right, Ingarden’s treatment of the Controversy remains one of the most detailed and ambitious ontological undertakings of the twentieth century. Not only does it lay out an incredibly detailed map of possible solutions to the Controversy, but it also tries to show why the latter is a genuine and fundamental problem that owes its hasty disqualification to various oversimplifications over the course of the history of philosophy. -/- In this chapter, I first give an overview of Ingarden’s method, which relies mainly on a combinatorial analysis. Then, I summarize his examination of possible solutions to the Controversy, and determine which ones can be ruled out on ontological grounds. Finally, I explain why this ambitious project ultimately leads to a theoretical impasse, leaving Ingarden unable to come up with a definitive solution to the Controversy – regardless of the fact that the book is unachieved. I argue that his analysis of the problem yields a more modest but nonetheless valuable result. (shrink)

In contemporary political philosophy, the disqualification of the problematic of alienation has to a large extent rested on the conviction that the norms of democracy, justice, and the good life provide a sufficient framework within which to outline a social critique that is politically pertinent. The paradox is that, at the very moment when such a conviction was becoming widespread, its validity was being refuted by the historical reality. It would appear that the casting-off of the Fordist system has (...) seen the emergence of a different set of social pathologies which, if they are to be adequately thematised and criticised, require the activation of the notion of alienation. Resumo O entendimento de Friedrich Nietzsche sobre Friedrich Schiller é bem conhecido e culmina em 1888, na desqualificação que se tem com “Schiller: ou o trompetista moral de Säckingen”. Mas é sabido que suas considerações são contraditórias, mudando com frequência nas diferentes etapas de sua vida produtiva. A monografia de Nicholas Martin marca um ponto de viragem no que diz respeito a este tema, refutando a disseminada compreensão de que somente o jovem Nietzsche teria experimentado admiração por Schiller, depois vindo (...) a assumir distância cada vez maior. A dívida de Nietzsche para com Schiller, segundo Martin, é constante, e manifesta-se sobretudo em sua recepção das cartas estéticas. O que se pretende fazer ver aqui, seguindo a tradição de Wolfgang Riedel, é que o ensaio Sobre a poesia ingênua e sentimental [Über naive und sentimentalische Dichtung] é tão ou mais importante neste contexto sobretudo quando dirigimos nosso enfoque para o contexto da crítica cultural. Várias declarações de Nietzsche, por exemplo, formulada em 1870, “não estou em condições de empregar essa terminologia esplendorosamente schilleriana para o inteiro e mais amplo domínio de toda a arte”, confirmam tal suposição, e uma vez que, no mesmo momento de elaboração de O nascimento da tragédia no espírito da música, ele se propõe a “[…] fortalecer o conceito do ingênuo e do sentimental”, tem-se justificada a intenção de relacionar ambas as obras-chave de ambos os Dichterphilosophen [filósofos poetas] do ponto de vista da crítica cultural.Friedrich Nietzsche's opinion about Friedrich Schiller is well known and culminates in 1888 in the disqualification “Schiller: oder der Moral-Trompeter von Säckingen”, but at the same time it is recognized that his considerations are contradictory and that they change in the different moments of his productive life. Nicholas Martin's study from 1996 marks a caesura in this subject by refuting the widespread view that only the young Nietzsche experienced admiration for Schiller and that there was a growing distance afterwards. Nietzsche's debt to Schiller, according to Martin, is constant and is manifested above all in his reception of the aesthetic letters. We would like to demonstrate in the tradition of Wolfgang Riedel that the essay Über naive und sentimentalische Dichtung is equally or even more important in this context, especially when it is approached from the standpoint of cultural criticism. Several statements by Nietzsche, such as the one formulated in 1870 “Ich bin nicht im Stande, jene herrliche Schillersche Terminologie auf das ganze weiteste Bereich aller Kunst anzuwenden” confirm this assumption, and when, at the very moment when Die Geburt der Tragödie aus dem Geist der Musik was being prepared, Nietzsche proposed that the “[…] Begriff des Naiven und des Sentimentalistischen ist zu steigern”, the attempt to link both key works of the two Dichterphilosophen from the point of view of cultural criticism is justified. L'objectif du present travail est avant tout de retracer le celebre clivage cartesien entre pensee et corps, a partir d'une analyse epistemologique de la disqualification - operee par Descartes - du role cognitif de l'imagination. L'auteur approfondit, d'un point de vue phenomenologique, trois solutions symptomatiques de l'epoque moderne, pour repenser le statut anthropologique et politique du sujet de facon unitaire: la tentation de reduire le corps a une idee, comme on le voit dans l'interpretation hegelienne de Malebranche; la reaction (...) anti-cartesienne du medecin-philosophe Cabanis, avec son ambition d'expliquer la pensee en termes d'emergence de la matiere corporelle; et enfin la tentative, que l'auteur met a l'epreuve a partir de Rosmini, de parler du corps sans renoncer a son alterite inquietante, mais en evitant aussi l'impasse dualiste.". Ce livre commence avec un problème de nomination de ce que l'on appelle économie et avec la disparition du terme chrématistique. Il pose l'hypothèse qu'il s'agit d'un problème métaphysique d'interprétation du réel et du monde. Le livre continue avec l'hypothèse étrange qui consiste à dire que la disparition du terme chrématistique est en lien avec la transformation substantielle et radicale du terme poièsis. Il pose alors la thèse qu'il y a une source fondamentale pour penser le problème de l'agir et (...) de l'opérativité et pour interpréter ce que l'on nomme une économie de l'œuvre. Enfin ce livre indique des manières de lire l'œuvre moderne et contemporaine en supposant qu'il y a eu, à cet endroit, un irrémédiable tournant : c'est ce que nous appelons critique de la poièsis. Ce livre pourra être lu de trois manières différentes et conjointes : comme un traité métaphysique de l'opérativité et de la disqualification des agir, comme un traité esthétique pour la lecture moderne du concept de poièsis (autrement dit de l'œuvre et de ses crises) et enfin comme un traité de philosophie politique en vue de faire face à ce qui tient de notre extrême et scandaleux contemporain. Este ensayo forma parte del intento, anunciado en otros trabajos, por acercar el pensamiento del absurdo y la rebelión del escritor argelino Albert Camus a la fenomenología husserliana. Como primer paso indispensable para conseguir dicho acercamiento, se lleva a cabo una revisión crítica de la descalificación que el mismo Camus hace de Husserl y de la fenomenología en su libro El mito de Sísifo. Además de cuestionar el sentido y los términos de la descalificación camusiana, y en particular la anacrónica (...) acusación a Husserl de dar un “salto” a la Razón eterna, se pone de relieve cómo puede encontrarse en la fenomenología —que siempre fue fenomenología de la vida concreta— ese “gusto por lo concreto, el sentido de la condición humana”, que Camus echaba de menos en ella.This essay is part of the attempt, announced in other places, to bring the thought of the absurd and the rebellion of the Algerian writer Albert Camus closer to Husserlian phenomenology. As a first and unavoidable step to achieve this rapprochement, a critical review is made of the disqualification that Camus makes of Husserl and of phenomenology in his book The Myth of Sysiphus. Besides questioning the sense and the terms of Camus’ disqualification, and particularly his anachronistic accusation to Husserl of making a “leap” into eternal Reason, it is outlined how can be found in phenomenology —which always was a phenomenology of concrete life—the very “taste for the concrete, the sense of human condition”, that Camus missed in it. Owen Flanagan's arguments concerning qualia constitute an intermediate position between Dennett's “disqualification” of qualia and the thesis that qualia represent an insurmountable obstacle to constructive naturalism. This middle ground is potentially attractive, but it is shown to have serious problems. This is brought out via consideration of several classic areas of dispute connected with qualia, including the inverted spectrum, Frank Jackson's thought experiment, Hindsight, and epiphenomenalism. In the beginning, Savransky's book offers a copious list of many worlds that we may or may not inhabit or even know about: a world where the dead are persons with whom the living confer, a world where part of the year the sun never sets, a world where sorcery-lions stalk their victims, a world where fictional characters give advice to novel readers, a world where immortal fungi live in disturbed forests, and and and (without end). This is a “world (...) of many worlds,” say Marisol de la Cadena and Mario Blaser; a “pluralistic universe,” says William James. But neither phrase tells us what the world is like. They only stand for a practical and burning question at a time when the erasure of differences goes on at a breathtaking pace and the worlds face globalizing forces that fracture the multiple practices through which beings exist.These attempts at world erasures were and are by no means inevitable, and Savransky offers us, more precious than any explanation, a story about the past that helps us feel important aspects of what continues to occur. The story concerns the fraction of Magellan's circumnavigating crew arriving back in Spain in 1522, and by retelling it Savransky gives us a striking sense of the crew not so much having crossed the globe as having invented it. As in Jules Verne's novel Around the World in Eighty Days (1872), the journey legitimized the conception of a unified reality, a globe, everywhere of the same quality, whose local particularities are but obstacles to overcome, resources to exploit, or exotic mysteries to visit. The main effort of Savransky's book, then, is to gather means that might empower ways of thinking, feeling, and living in a brazen reversal of Verne's title—around the day in eighty (or a thousand) worlds.Savransky is by no means alone in this task, and many anthropological and philosophical proposals have contributed. He comments on some of these with a view to learning from their inventiveness rather than to pointing out their shortcomings. Still, we have learned from the fate of such proposals and experiments the startling ease with which the vision of a unified reality can creep back into the best attempts at thinking about a world of many worlds. Take, for instance, the language of ontology that has enabled us to hear from other worlds things of which we could not imagine reality was capable. But then, as Savransky shows, those gains are nearly lost when ontology turns into a turn—the “ontological turn”—and the anthropologists sail off around the world, posing the question “What is your ontology?” to people who could not care less about ontology.From James especially, Savransky borrows many proposals, two of which I will mention here. First is the need to reclaim philosophical Realism from those who made it a weapon of disqualification. James himself was the keen proponent of a Realism that we might call generic: “reality feels like itself,” any experience is real, and no experience should be required to justify its existence. Second, if “reality feels like itself,” then we may expect to experience “worldquakes” whenever we happen to brush up against other worlds. Perhaps the most compelling meaning that we may assign, following James, to pluriverse, is the notion and experience of “the” world being not only more than one, but also more than many—a sense of the real as inseverable from a more. Thus Savransky writes, along these lines, that “the pluriverse is not a world we dream might come about—it is what makes us dream.”. (shrink)

At the Barnes Foundation in 1931, Matisse undertook the painting of a large decorative panel entitled La Danse. Its stakes are considerable: the disqualification of the painting-form and the drawing-genre, in favor of an environmental art infused with a decorative vitalism that redefines the architectural function itself at the deepest level, beyond any question of site-specificity.

Parmi les philosophies qui tentent de faire face à la crise de la rationalité, certaines, plus radicales que d’autres, en proposent une fondation reposant sur des principes qui se veulent exempts de toute présupposition. Ainsi K. O. Apel entend opérer une refondation de la rationalité éthique et cognitive en considérant les activités communicationnelles et argumentatives. Il s’agit d’élaborer une «pragmatique transcendantale» dont le processus d’étayage auto-réflexif s’appuie sur la «contradiction pragmatique» dans laquelle tombent ses éventuels contradicteurs. Une telle prétention n’est-elle (...) pas exorbitante ? Les sceptiques grecs ont élaboré une approche pragmatique du sens qui leur permet d’éviter la disqualification de leur énonciation, ce qui permet, en transposant leurs conceptions à la lumière des théories contemporaines du langage, d’échapper à la critique de Apel. On peut dès lors reconnaître le caractère constitutif de l’activité communicationnelle, sans prétendre en proposer une fondation ultime de type transcendantal, ni préjuger de son orientation éthique. Resterait à se demander s’il est possible de reconstruire une rationalité minimale compatible avec la posture sceptique. (shrink)

In this paper, the term “qualifying disqualification” is introduced to express an intersection of several different types of power that are differentiated as disciplinary, sovereign, and biopolitical formations. The paper concurs with a viewpoint that has emerged in much post-Foucauldian scholarship that these should not be understood as replacing each other in a historically emerging, linear succession. The resulting question is how to interpret instances of their convergence and intersection – for example, are they best understood as mutually consolidating? (...) The paper points to the friction caused by a simultaneity of heterogeneous formations of power given that they are understood to “subjectivise” differently. In turn, different understandings and conducts of “capacity” and “qualification” correspond to those differences in addition to different techniques of inclusion, exclusion, and exception. “Qualifying disqualification” is proposed as a terminology to express this friction. The fields in which its implications are explored include critical race studies, “capacity”-based rights arguments, and new interpretations of power in the work of Foucault, particularly as theorised in his Collège de France lectures. Foucault prononce en 1981 un cours qui marque une inflexion décisive dans son chemin de pensée et le projet ébauché dès 1976 d'une Histoire de la sexualité. C'est le moment où les arts de vivre deviennent le foyer de sens à partir duquel pourra se déployer une pensée neuve de la subjectivité. C'est le moment aussi où Foucault problématise une conception de l'éthique comprise comme l'élaboration patiente d'un rapport de soi à soi. L'étude de l'expérience sexuelle des Anciens permet ces (...) nouveaux déploiements conceptuels. Dans ce cadre, Foucault analyse des écrits médicaux, des traités sur le mariage, la philosophie de l'amour ou la valeur pronostique des rêves érotiques, afin d'y retrouver le témoignage d'une structuration du sujet dans son rapport aux plaisirs (aphrodisia) antérieure à la construction moderne d'une science de la sexualité, antérieure à la hantise chrétienne de la chair. L'enjeu est en effet d'établir que l'imposition d'une scrupuleuse et interminable herméneutique du désir constitue l'invention du christianisme. Mais pour cela, il importait de ressaisir la spécificité irréductible des techniques de soi antiques. Dans cette série de leçons, qui annoncent clairement L'Usage des plaisirs et Le Souci de soi, Foucault interroge particulièrement le primat grec de l'opposition actif/passif sur les distinctions de genre, ainsi que l'élaboration par le stoïcisme impérial d'un modèle de lien conjugal prônant une fidélité sans faille, un partage des sentiments, et conduisant à la disqualification de l'homosexualité. L’illégitimité de la bande dessinée a une histoire. Elle est le fruit de processus historiques mêlantcritiques de la bande dessinée et efforts de réhabilitation. L’après-guerre a été une période-clé dans ladisqualification de la bande dessinée, alors principalement publiée dans les journaux pour enfants,d’importantes mobilisations en affirmant le caractère criminogène et démoralisateur. Ces discours onttrouvé une validation et une consécration institutionnelles à travers l’adoption de la loi du 16 juillet 1949,qui a organisé, jusqu’à nos jours, un contrôle des publications de bande (...) dessinée. A maxima,ce contrôle a opéré une disqualification en pratique de cette forme d’expression. A minima, il a en tout casentretenu l’image de la bande dessinée comme une forme potentiellement dangereuse, certainement peuéducative, de toute façon faiblement légitime. C’est en ce sens que la loi de 1949 a contribué àl’institutionnalisation, et donc à la relative pérennité, de l’illégitimité de la bande dessinée.The illegitimacy of the comic strip has its own history. It is the result of historical processes that havecombined criticism of comic strips with efforts to rehabilitate them. The post-war years were a pivotal timein the process of disqualifying comic strips as considerableefforts were made to assert their criminalising and demoralising nature. This type of discourse was institutionalisedand enshrined in France by the Act of 16 July 1949, which – until today – has organised controls over the publication of comic strips. At the very least, these controls have sustainedthe view of comic strips as a potentially dangerous, definitely non-educational and scarcely legitimate form,and have even gone so far as to disqualify them entirely in practice. Thus did the Act of 1949 help toinstitutionalise, on a relatively enduring basis, the illegitimate nature of the comic strip. (shrink)

Si Marx aujourd'hui doit retrouver la radicalité qui a porté en ses premiers commencements sa pensée révolutionnaire, il faut rompre définitivement avec les évidences les mieux établies de son interprétation. La pensée de Marx, loin de pouvoir être rattachée au sol du matérialisme, s'enracine au plus profond de l'idéalisme allemand dans ce mouvement de pensée qui vient contester en ses fondements ultimes la métaphysique et son ordre, l'ordre d'un entendement captif de l'horizon borné de la positivité. Pensée de subversion de (...) l'ordre de la positivité, la pensée de Marx se laisse alors définir comme un mouvement de déstabilisation du monde, mise en abyme de son fondement. Cette disqualification an-archique de l'arche est au principe de la pensée de la révolution radicale et de la mise en question fondamentale du pouvoir. Dans l'espace ouvert par cette double Bestimmung, idéaliste, an-archique, la pensée de Marx, en opposition à toute interprétation qui y voit une pensée du social, définit un individualisme radical qui se veut la critique absolue de toute volonté d'édification d'un nouvel ordre, individualisme qui ne laisse plus rien prévaloir qui fasse violence à la valeur de sens de l'autonomie.The road to Marx's thought supposes as its condition a movement of radical depositioning in relation to the classically established guidelines for journeying through his work. Marx's thought, in opposition to any interpretation which sees therein a reflection on the social sphere, defines a radical form of individualism which is intended as the absolute criticism of any desire to construct a new order, an individualism which allows absolutely nothing which might obstruct the value of the meaning of autonomy to prevail. Historical progress has largely been described in terms of the power to order social and ecological realities according to the interests of a few. Their concepts, images, and metaphors have transmitted knowledge (both explicit and tacit) that has come to be regarded as received wisdom. This kind of power, which has shaped (as well as described) history, has belonged primarily to men; whereas women's nature and, accordingly, their power have been defined primarily in terms of sexuality. Men's control of women's (...) sexuality is therefore the source of the disqualification of women as free agents‐that is, as significant participants in, say, scientific and religious meaning‐giving processes. Thus morality requires reevaluation of our assumptions about human nature. Most importantly, it demands that female sexuality be considered within the context of rationality and spirituality. (shrink)
