Drug promotion should be evaluated according to its impact on health, access to information, informed consent, and wealth. Drug promotion currently does more harm than good to each of these objectives because it is usually misleading. This is a systemic problem. Whilst improved regulation and education will address it to some degree, major reforms to payment systems for drug companies and doctors are also required. Until all these systemic reforms can be put in place, the best policy option is to (...) ban the promotion of drugs to doctors and the public. Consequently, pending major reforms, it is appropriate for governments to restrict drug promotion as much as is politically achievable. (shrink)

This essay responds to the polyphonic and prismatic reflections stemming from Subjects That Matter: Philosophy, Feminism, and Postcolonial Theory (2019), especially as the connective and creative works included in this forum seek holistic, profoundly interdisciplinary, and transcontinental discussions on intersectionality and philosophical practice. I seek vibrant, productive connections between diverse projects by attempting to engage a few salient aspects of these contributions as they intersect with the book’s overall stated aims, primarily because my interlocutors’s work leads out of the book (...) rather than burrows into it. This is precisely the forum’s aspirational trajectory, for it showcases multiplicity, discontinuity, divergence, plurality, and profusion, not to dubiously claim the mantle of radicalism, but to move toward systemic change through the precarious, difficult, and essentially historical task of building coalitions. My hope remains that through these lovingly orchestrated moments of exegetical exchange, which confound and limit rather than insulate our habitual disciplinary lexicons, we may roil Eurocentric identity politics and its impoverished understanding of difference. Upshot: I discuss convergences between the approach of the authors and my work aiming for a theory of organisms. Many believe that the ethical problems of donation after cardiocirculatory death (DCD) have been "worked out" and that it is unclear why DCD should be resisted. In this paper we will argue that DCD donors may not yet be dead, and therefore that organ donation during DCD may violate the dead donor rule. We first present a description of the process of DCD and the standard ethical rationale for the practice. We then present our concerns with DCD, including the following: (...) irreversibility of absent circulation has not occurred and the many attempts to claim it has have all failed; conflicts of interest at all steps in the DCD process, including the decision to withdraw life support before DCD, are simply unavoidable; potentially harmful premortem interventions to preserve organ utility are not justifiable, even with the help of the principle of double effect; claims that DCD conforms with the intent of the law and current accepted medical standards are misleading and inaccurate; and consensus statements by respected medical groups do not change these arguments due to their low quality including being plagued by conflict of interest. Moreover, some arguments in favor of DCD, while likely true, are "straw-man arguments," such as the great benefit of organ donation. The truth is that honesty and trustworthiness require that we face these problems instead of avoiding them. We believe that DCD is not ethically allowable because it abandons the dead donor rule, has unavoidable conflicts of interests, and implements premortem interventions which can hasten death. These important points have not been, but need to be fully disclosed to the public and incorporated into fully informed consent. These are tall orders, and require open public debate. Until this debate occurs, we call for a moratorium on the practice of DCD. (shrink)

This essay furthers debate about the burgeoning science of Probabilistic Event Attribution (PEA) and its relevance to imminent climate policy decisions. It critically examines Allen Thompson and Friederike Otto’s recent arguments concerning the implications of PEA studies for how the United Nations Framework Convention on Climate Change (UNFCCC) policy framework should be revised during the 2016 ‘review and decision.’ I show that their contention that PEA studies cannot usefully inform decision-making about adaptation policies and strategies is misguided and argue that (...) the current UNFCCC treaty, the “Paris Agreement,” supersedes their proposed revision. In educational hypermedia environments, students are often confronted with potential sources of distraction arising from additional information that, albeit interesting, is unrelated to their current task goal. The paper investigates the conditions under which distraction occurs and hampers performance. Based on theories of volitional action control it was hypothesized that interesting information, especially if related to a pending goal, would interfere with task performance only when working on easy, but not on difficult tasks. In Experiment 1, 66 students learned about (...) probability theory using worked examples and solved corresponding test problems, whose task difficulty was manipulated. As a second factor, the presence of interesting information unrelated to the primary task was varied. Results showed that students solved more easy than difficult probability problems correctly. However, the presence of interesting, but task-irrelevant information did not interfere with performance. In Experiment 2, 68 students again engaged in example-based learning and problem solving in the presence of task-irrelevant information. Problem-solving difficulty was varied as a first factor. Additionally, the presence of a pending goal related to the task-irrelevant information was manipulated. As expected, problem-solving performance declined when a pending goal was present during working on easy problems, whereas no interference was observed for difficult problems. Moreover, the presence of a pending goal reduced the time on task-relevant information and increased the time on task-irrelevant information while working on easy tasks. However, as revealed by mediation analyses these changes in overt information processing behavior did not explain the decline in problem-solving performance. As an alternative explanation it is suggested that goal conflicts resulting from pending goals claim cognitive resources, which are then no longer available for learning and problem solving. Many industry leaders and academics from the field of machine ethics would have us believe that the inevitability of robots coming to have a larger role in our lives demands that robots be endowed with moral reasoning capabilities. Robots endowed in this way may be referred to as artificial moral agents. Reasons often given for developing AMAs are: the prevention of harm, the necessity for public trust, the prevention of immoral use, such machines are better moral reasoners than humans, and (...) building these machines would lead to a better understanding of human morality. Although some scholars have challenged the very initiative to develop AMAs, what is currently missing from the debate is a closer examination of the reasons offered by machine ethicists to justify the development of AMAs. This closer examination is especially needed because of the amount of funding currently being allocated to the development of AMAs coupled with the amount of attention researchers and industry leaders receive in the media for their efforts in this direction. The stakes in this debate are high because moral robots would make demands on society; answers to a host of pending questions about what counts as an AMA and whether they are morally responsible for their behavior or not. This paper shifts the burden of proof back to the machine ethicists demanding that they give good reasons to build AMAs. The paper argues that until this is done, the development of commercially available AMAs should not proceed further. (shrink)

It has been the subject of extensive affirmative lobbying by academic medical centers, pharmaceutical and biotech companies, genetic disease advocacy groups, and civil rights organizations. It has overcome vehement objections by employers and insurers. Its final passage, however, has been thwarted by a few Congressional leaders, who have prevented enactment despite overwhelming bipartisan support in both houses (...) of Congress.Based on this legislative history, one could not help but assume that the Genetic Information Nondiscrimination Act is a revolutionary piece of legislation that, if finally enacted, would provide extensive, effective, and comprehensive protection against genetic discrimination in health insurance and employment Unfortunately, such an assessment would be incorrect. Experiments involving the transplantation of human stem cells and their derivatives into early fetal or embryonic nonhuman animals raise novel ethical issues due to their possible implications for enhancing the moral status of the chimeric individual. Although status-enhancing research is not necessarily objectionable from the perspective of the chimeric individual, there are grounds for objecting to it in the conditions in which it is likely to occur. Translating this ethical conclusion into a policy recommendation, however, iscomplicated by the fact that (...) substantial empirical and ethical uncertainties remain about which transplants, if any, would significantly enhance the chimeric individual’s moral status. Considerations of moral status justify either an early-termination policy on chimeric embryos, or, in the absence of such a policy, restrictions on the introduction of pluripotent human stem cells into early-stage developing animals, pending the resolution of those uncertainties. The paper presents an extended argument for the claim that mental content impacts the computational individuation of a cognitive system (section 2). The argument starts with the observation that a cognitive system may simultaneously implement a variety of different syntactic structures, but that the computational identity of a cognitive system is given by only one of these implemented syntactic structures. It is then asked what are the features that determine which of implemented syntactic structures is the computational structure of the (...) system, and it is contended that these features are certain aspects of mental content. The argument helps (section 3) to reassess the thesis known as computational externalism, namely, the thesis that computational theories of cognition make essential reference to features in the individual's environment. It is suggested that the familiar arguments for computational externalism?which rest on thought experiments and on exegesis of Marr's theories of vision?are unconvincing, but that they can be improved. A reconstruction of the visex/audex thought experiment is offered in section 3.1. An outline of a novel interpretation of Marr's theories of vision is presented in section 3.2. The corrected arguments support the claim that computational theories of cognition are intentional. Computational externalism is still pending, however, upon the thesis that psychological content is extrinsic. (shrink)

Cognitive gadgets puts forward an ambitious claim: language, mindreading, and imitation evolved by cultural group selection. Defending this claim requires more than Heyes' spirited and effective critique of nativist claims. The latest human “cognitive gadgets,” such as literacy, did not spread through cultural group selection. Why should social cognition be different? The book leaves this question pending. It also makes strong assumptions regarding cultural evolution: it is moved by selection rather than transformation; it relies on high‐fidelity imitation; it requires specific (...) cognitive adaptations to cultural learning. Each of these assumptions raises crucial yet unaddressed difficulties. (shrink)

The HIPAA Privacy Rule is notoriously weak because of its incomplete coverage, numerous exclusions and exemptions, and limited rights for individuals. The three areas in which it provides the most protection are fundraising, marketing, and research. Provisions of the 21st Century Cures Act, pending in Congress, and the Notice of Proposed Rulemaking to amend the federal research regulations, awaiting final regulatory action, would weaken the privacy protections for research. If these measures are adopted, the HIPAA Privacy Rule would have so (...) little value that it might not be worth the aggravation and burden. (shrink)

The present study examined how the pre-war debate of the US decision to invade Iraq (in March 2003) was discursively constructed in the US/British mainstream newspaper opinion/editorial (op/ed) argumentation. Drawing on theoretical insights from critical discourse analysis and argumentation theory, I problematised the fallacious discussion used in the pro-war op/eds to build up a ‘moral/legal case’ for war on Iraq based on adversarial (rather than dialogical) argumentation. The proponents of war deployed ‘instrumental rationality’ (ends-justify-means reasoning), ‘ethical necessity’ (Bush’s ‘Preemption Doctrine’) (...) and ‘humanitarian virtue’ (the bombing of Iraq to ‘save’ Iraqis from Saddam’s pestilent tyranny) to justify the pending invasion of Iraq. Their arguments intertextually resonated with Bush administration’s ‘war on terror’ rhetoric in a way that created a form of indexical association through ‘recontextualisation’. The type of arguments marshalled by the pro-war op/ed commentators uncritically bolstered the set of US official ‘truth claims’ and ‘presuppositions’. (shrink)

In the wake of the emergence and rapid development of nanoethics there swiftly followed fundamental criticism: nanoethics was said to have become much too involved with speculative developments and was concerning itself too little with actually pending questions of nanotechnology design and applications. If this diagnosis is true, then large parts of nanoethics are misguided. Such fundamental criticism must surely either result in a radical reorientation of nanoethics or be refuted for good reasons. In this paper, I will examine the (...) critics’ central arguments and, building on this scrutiny, formulate an answer to these alternatives. The results lead to conclusions which allow explaining and unfolding the thesis of this paper that instead of speculative nanoethics we should better speak of and develop explorative philosophy of nanotechnology. Huey P. Newton remains one the left’s intellectual enigmas. Although lauded for being the leader of the Black Panther Party, Newton is relatively unacknowledged as an intellectual. This article challenges the neglect of Newton’s thought by shedding light on his theory of empire, and the present-day value of returning to his thought. The article centres on how Newton’s critique of what he called ‘reactionary intercommunalism’ prefigures many of the elements found in the work of Hardt and Negri on empire. This (...) comparison will be used to show how Newton not only foresaw elements of the rise of contemporary neoliberal globalization, but also offered an idea of political solidarity and revolutionary politics for such a context. The article concludes by highlighting how Newton’s ideas about the need for a war of position based on ‘survival pending revolution’ presents a more theoretically and empirically salient conceptualization of resistance than his successors. Is there a notion of contradiction—let us call it, for dramatic effect, “absolute”—making all contradictions, so understood, unacceptable also for dialetheists? It is argued in this paper that there is, and that spelling it out brings some theoretical benefits. First it gives us a foothold on undisputed ground in the methodologically difficult debate on dialetheism. Second, we can use it to express, without begging questions, the disagreement between dialetheists and their rivals on the nature of truth. Third, dialetheism has an (...) operator allowing it, against the opinion of many critics, to rule things out and manifest disagreement: for unlike other proposed exclusion-expressing-devices (for instance, the entailment of triviality), the operator used to formulate the notion of absolute contradiction appears to be immune both from crippling expressive limitations and from revenge paradoxes—pending a rigorous nontriviality proof for a formal dialetheic theory including it. We suggest that pain processing has a modular architecture. We begin by motivating the (widely assumed but seldom defended) conjecture that pain processing comprises inferential mechanisms. We then note that pain exhibits a characteristic form of judgement independence. On the assumption that pain processing is inferential, we argue that its judgement independence is indicative of modular (encapsulated) mechanisms. Indeed, we go further, suggesting that it renders the modularity of pain mechanisms a default hypothesis to be embraced pending convincing counterevidence. In The Enterprise of Knowledge, I proposed a general theory of rational choice which I intended as a characterization of a prescriptive theory of ideal rationality. A cardinal tenet of this theory is that assessments of expected value or expected utility in the Bayesian sense may not be representable by a numerical indicator or indeed induce an ordering of feasible options in a context of deliberation. My reasons for taking this position are related to my commitment to the inquiry-oriented approach (...) to human knowledge and valuation favored by the American pragmatists, Charles Peirce and John Dewey. A feature of any acceptable view of inquiry ought to be that during an inquiry points under dispute ought to be kept in suspense pending resolution through inquiry. (shrink)

The Bermuda Principles for DNA sequence data sharing are an enduring legacy of the Human Genome Project. They were adopted by the HGP at a strategy meeting in Bermuda in February of 1996 and implemented in formal policies by early 1998, mandating daily release of HGP-funded DNA sequences into the public domain. The idea of daily sharing, we argue, emanated directly from strategies for large, goal-directed molecular biology projects first tested within the “community” of C. elegans researchers, and were introduced (...) and defended for the HGP by the nematode biologists John Sulston and Robert Waterston. In the C. elegans community, and subsequently in the HGP, daily sharing served the pragmatic goals of quality control and project coordination. Yet in the HGP human genome, we also argue, the Bermuda Principles addressed concerns about gene patents impeding scientific advancement, and were aspirational and flexible in implementation and justification. They endured as an archetype for how rapid data sharing could be realized and rationalized, and permitted adaptation to the needs of various scientific communities. Yet in addition to the support of Sulston and Waterston, their adoption also depended on the clout of administrators at the US National Institutes of Health and the UK nonprofit charity the Wellcome Trust, which together funded 90% of the HGP human sequencing effort. The other nations wishing to remain in the HGP consortium had to accommodate to the Bermuda Principles, requiring exceptions from incompatible existing or pending data access policies for publicly funded research in Germany, Japan, and France. We begin this story in 1963, with the biologist Sydney Brenner’s proposal for a nematode research program at the Laboratory of Molecular Biology at the University of Cambridge. We continue through 2003, with the completion of the HGP human reference genome, and conclude with observations about policy and the historiography of molecular biology. (shrink)

In the near future developments in non-invasive prenatal testing may soon provide couples with the opportunity to test for and diagnose a much broader range of heritable and congenital conditions than has previously been possible. Inevitably, this has prompted much ethical debate on the possible implications of NIPT for providing couples with opportunities for reproductive choice by way of routine prenatal screening. In view of the possibility to test for a significantly broader range of genetic conditions with NIPT, the European (...) Society of Human Genetics and American Society of Human Genetics recommend that, pending further debate, prenatal screening for reproductive choice should only be offered where concerning serious congenital conditions and childhood disorders. In support of this recommendation, the ESHG and ASHG discuss a number of ethical issues on which they prompt further debate: the informational privacy of the future child, the trivialization of abortion, the risk of information overload, and issues of distributive justice. This paper responds to this call with further reflection on each ethical issue and how it relates to the moral justification of providing couples with opportunities for meaningful reproductive choice. The paper concludes that whilst there may be good reasons for qualifying the scope of any unsolicited prenatal screening offer to serious congenital conditions and childhood disorders, if prenatal screening is justified for providing couples with opportunities for meaningful reproductive choice, then health services may have obligations to empower couples with the same opportunity where concerning other conditions. This article deals with the educational challenge of responding to the pending ecological crisis (and many other future apocalyptic scenarios that haunt our imagination). It seems we are living in a time when we have given up on the idea that progress is possible or desirable, and this questions education at its roots. In order to find a proper educational response that befits our time, it is requested that we gain a new sense of orientation (which is no longer aimed (...) at progress). This is an idea I pick up from the recent work of Bruno Latour, which is the focus of the first part of the paper. In the second part, I start fleshing out what this new orientation could look like by turning to the work of Immanuel Kant (usually regarded as one of the most outspoken defenders of education geared to progress). Nonetheless, I try to read Kant against himself, so as to show how orientation can be understood in a non-modernist manner. I connect this in the third part to the radically immanent and empiricist work of William James, and draw out in the final section how a combined reading of Kant and James offers the orientation we need. Inflationists have argued that truth is a causal-explanatory property on the grounds that true belief facilitates practical success: we must postulate truth to explain the practical success of certain actions performed by rational agents. Deflationists, however, have a seductive response. Rather than deny that true belief facilitates practical success, the deflationist maintains that the sole role for truth here is as a device for generalisation. In particular, each individual instance of practical success can be explained only by reference to a (...) relevant instance of a T-schema; the role of truth is just to generalise over these individualised explanations. I present a critical problem for this strategy. Analogues of the deflationist’s individualised explanations can be produced by way of explanation of coincidental instances of practical success where the agent merely has the right false beliefs. By deflationary lights, there is no substantive explanatory difference between such coincidental and non-coincidental instances of practical success. But the non-/coincidental distinction just is an explanatory distinction. The deflationist’s individualised explanations of non-coincidental instances of practical success must therefore be inadequate. However, I argue that the deflationist’s prospects for establishing an explanatory contrast between these cases by supplementing her individualised explanations are, at best, bleak. The inflationist, by contrast, is entitled to the obvious further explanatory premise needed to make sense of the distinction. As such, pending some future deflationary rejoinder, the deflationary construal of the principle that true belief facilitates practical success must be rejected; and with it the deflationary conception of truth. It is possible for a causal factor to raise the probability of a second factor in some situations while lowering the probability of the second factor in other situations. Must a genuine cause always raise the probability of a genuine effect of it? When it does not always do so, an "interaction" with some third factor may be the reason. I discuss causal interaction from the perspectives of Giere's counterfactual characterization of probabilistic causal connection (1979, 1980) and the "contextual unanimity" (...) model developed by, among others, Cartwright (1979) and Skyrms (1980). I argue that the contextual unanimity theory must exercise care, in a new way that seems to have gone unnoticed, in order to adequately accommodate the phenomenon, and that the counterfactual theory must be substantially revised; although it will still, pending clarification of a second kind of revision, be unable to accommodate a kind of interaction exemplified in cases like those described by Sober (1982). In 2006 the Government issued a White Paper in which it proposed a ban on human-animal embryo research pending greater clarity on its potential. The Commons Select Committee on Science and Technology initiated an Inquiry and concluded that such research was necessary and should be permitted immediately. The Government agreed and this is reflected in revised legislation. The Government has issued guidelines on the gathering and use of scientific advice and evidence, designed to ensure that these are “credible, reliable and (...) objective.” This article tests the Committee’s approach in the light of its remit and these, and other, relevant guidelines and concludes that it failed to meet these standards. Rather, it effectively ceded to an interest group the regulation of its own activities. The article ends by suggesting alterations to the Committee’s remit and composition designed to ensure that the public interest is better protected in future. (shrink)

Given the importance of the issue of scientific objectivity in our democratic societies and the significant development of citizen science, it is crucial to investigate how citizen science may either undermine or foster scientific objectivity. This paper identifies a variety of epistemic risks and benefits that participation of lay citizens in scientific inquiries may bring. It also discusses concrete actions and pending issues that should be addressed in order to foster objectivity in citizen science programs.

The potential development of self-driving cars (also known as autonomous vehicles or AVs – particularly Level 5 AVs) has called the attention of different interested parties. Yet, there are still only a few relevant international regulations on them, no emergency patterns accepted by communities and Original Equipment Manufacturers (OEMs), and no publicly accepted solutions to some of their pending ethical problems. Thus, this paper aims to provide some possible answers to these moral and practical dilemmas. In particular, we focus on (...) what AVs should do in no-win scenarios and on who should be held responsible for these types of decisions. A naturalistic perspective on ethics informs our proposal, which, we argue, could represent a pragmatic and realistic solution to the regulation of AVs. We discuss the proposals already set out in the current literature regarding both policy-making strategies and theoretical accounts. In fact, we consider and reject descriptive approaches to the problem as well as the option of using either a strict deontological view or a solely utilitarian one to set AVs’ ethical choices. Instead, to provide concrete answers to AVs’ ethical problems, we examine three hierarchical levels of decision-making processes: country-wide regulations, OEM policies, and buyers’ moral attitudes. By appropriately distributing ethical decisions and considering their practical implications, we maintain that our proposal based on ethical naturalism recognizes the importance of all stakeholders and allows the most able of them to take actions (the OEMs and buyers) to reflect on the moral leeway and weight of their options.
