Capacity evaluation has become a widely used assessment device in clinical practice to determine whether patients have the cognitive ability to render their own medical decisions. Such evaluations, which might be better thought of as “capacity challenges,” are generally thought of as benign tools used to facilitate care. This paper proposes that such challenges should be reconceptualized as significant medical interventions with their own set of risks, side effects, and potentially deleterious consequences. As a result, a cost–benefit analysis should be (...) implemented prior to imposing such capacity challenges, and efforts should be made to minimize such challenges in situations where they are unlikely to alter the course of treatment. L’immigration de populations d’origine musulmane en Europe, à partir des années 1960, a ouvert un chapitre inédit des relations entre l’Europe et l’islam. En effet, une partie de ces populations a renoué avec son identité religieuse et s’est dotée d’une infrastructure d’organisations et de mosquées. Cela s’est fait parallèlement au processus de réveil de l’islam qui concerne l’ensemble du monde musulman. On mesure l’ampleur des enjeux liés à cette présence. Les musulmans exigent bien plus que des appels au dialogue ou (...) aux relations interculturelles. Et on ne peut pas postuler de leur part une simple assimilation à l’Occident. Apparaît l’urgence de mettre en place des lieux de débat et d’approfondissement d’idées où les interpellations réciproques, sur un pied d’égalité, entre non-musulmans et musulmans puissent s’argumenter. Les thèmes de ces débats prévisibles peuvent aller de la vision du religieux et de ses fondements à la place du religieux dans les sociétés et à ses rapports avec l’espace public, en passant par le rapport aux pluralismes des visions du monde. Dans cet article nous avons essayé d'examiner la valeur de l'attribution traditionelle du commentaire De Anima à Simplicius. En comparant ce traité aux grands commentaires de Simplicius (sur les Catégories, la Physique et le De Caelo d'Aristote), nous avons été en effet frappés par les divergences de style, et de langue, ainsi que par la différente manière de commenter. Dans la première partie nous démontrons que l'auteur de l'In D.A. a écrit également la Metaphrasis in Theophrastum, qui nous a été (...) transmise sous le nom de Priscien le Lydien. 1° Dans le In D.A. l'auteur renvoie à une de ses œuvres, qu'il appelle „Epitomé de la Physique de Théophraste". En réalité, cette référence se rapporte à un passage de la Métaphrase de Priscien, où la même problématique est exposée dans des termes identiques. — 2° Une comparaison détaillée, qui porte sur l'ensemble des deux œuvres, nous révèle une telle ressemblance de style et de pensée — il y a même des phrases à peu près identiques — qu'elle ne peut s'expliquer que par l'hypothèse de l'identité de l'auteur. Dans la deuxième partie nous essayons d'identifier l'auteur de ces deux œuvres qui pourtant nous ont été transmises sous deux noms différents. L'étude de la tradition directe et indirecte n'apporte guère de solution, puisque l'attribution des deux textes, l'un à Simplicius, l'autre à Priscien, y paraît très solide. Ce n'est donc que par une critique interne de l'In D.A., notamment par la confrontation avec les commentaires de Simplicius, dont l'attribution est certaine, que la question pourra être tranchée. 1° Dans l'In D.A. l'auteur renvoie trois fois à son commentaire sur la Physique. Pourtant, il est bien difficile de retrouver dans le grand commentaire de Simplicius trois passages dont le contenu et surtout le vocabulaire prouvent que l'auteur s'y réfère. — 2° Dans l'In D.A. on ne retrouve pas les traits caractéristiques de la méthode de commenter de Simplicius, ni l'approche du texte par la documentation historique, ni les longues discussions avec les exégètes antérieurs, ni l'exposé prolixe et bien structuré; d'autre part aucun des commentaires de Simplicius ne témoigne de la phraséologie tortueuse de notre oeuvre, ni de ses formules stéréotypées. — 3° La différence doctrinale est encore plus importante. Nulle part chez Simplicius n'apparaît la théorie de l'âme comme όριστική, qui est si fondamentale dans l'In D.A. (όρίζω y est un concept-clé). Les rares digressions de l'In D.A. à propos de questions physiques et logiques ne correspondent pas aux exposés de Simplicius sur les mêmes problèmes. Ainsi nous avons confronté la doctrine de la ‚physis', de l'âme et de son ‚automotion’ et enfin le rapport entre le ‚genre’ et les différences ‚constitutives’ et ‚diérétiques’. De tout cela se dégage une telle divergence entre l'In D. A. et les autres commentaires qu'elle ne peut s'expliquer par une évolution chez Simplicius lui-même. L'in D.A. lui est donc faussement attribué; et puisque nous avons établi que ce commentaire est du même auteur que la Métaphrase, nous pouvons conclure qu'il a été vraisemblablement écrit par Priscien le Lydien, un philosophe néoplatonicien dont nous savons seulement qu'il a accompagné Damascius et Simplicius en exil en Perse. Zur leichteren Veranschaulichung der mathematischen Darstellung betrachtet Verfasser zuerst diejenigen Systeme, deren innerer Zustand sich durch ein einziges Parameterc bestimmen lässt. Die zeitliche Entwicklung eines leblosen Systems dieser Klasse werde durch die Differentialgleichung $$\frac{{dc}}{{dt}} = kf...$$ dargestellt, wot=Zeit, undk eine Funktion der äusseren Parameterα, Β, γ. ist. Im Falle eines jeden (...) Systems sind die äusseren Parameterα, Β, γ. charakteristische individuelle Funktionen der Zeit. Misst manc am. Zeitpunktt, so lässt sich die Zukunft des Systems vermittelst der Gleichung berechnen, wenn die zukünftigen Werte der äusseren Parameter gegeben sind. Solche Systeme nennt Verfasser nicht-historische Systeme. Im Falle der lebenden Systeme werde die zeitliche Entwicklung durch die Integral-differentialgleichung $$\frac{{dc}}{{dt}} = k_1 f_1 + \mathop \smallint \limits_{t - \lambda }^t k_2 f_2 dt........$$ dargestellt, wof 1 undf 2 Funktionen des Zustandsparametersc, undk 1 undk 2 Funktionen der äusseren Parameter sind. Das Zeitintegral erstreckt sich auf das vergangene Zeitintervalt-λ →t, woλ einen positiven endlichen konstanten Wert besitzt. Diese Systeme nennt Verfasser historische Systeme. Setzt manH für das darin enthaltene Integralglied, so verwandelt sich die Gleichung in: $$\frac{{dc}}{{dt}} = k_1 f_1 + H..........$$ Misst man nunc am Zeitpunktt, so kann man in diesem Fall die Zukunft des Systems ohne Kenntnis des historischen GliedsH nicht berechnen. Das Vorkommen des historischen IntegralgliedsH nennt Verfasser Chronoholismus. Man kann deshalb die historischen Systeme auch chronoholistische Systeme nennen. Die biologische Interpretation dieser Betrachtungsweise wird vom Verfasser diskutiert, und die Gleichung auf Systeme mit erblichen Eigenschaften ausgedehnt. Es werden zuletzt Systeme mit vielen Zustandsparametern in gewissen einfachen Fällen kurz behandelt. L'interprétation biologique de cette faÇon de traÎter les systèmes vivants est discutée par l'auteur, qui étend l'équation pour le faire représenter aussi les propriétés héréditaires des Êtres vivants. A partir d'une compréhension de la relation fondamentale entre l'angoisse et le courage s'éclaire la valeur proprement humaine de l'amour humain, de la rencontre, de la confrontation et de la liaison entre le Moi et le Toi comme une existence sous la forme du Nous - la „liebende Wirheit” dont parle Binswanger. Le mysterium tremendum de l'amour personnel pour (...) un ‘étranger’ - qui n'est donc n i la mère n i le père - est un risque existentiel par essence, c'est le franchissement du seuil vers une forme nouvelle de l'existence du Dasein. C'est la raison pour laquelle la route vers le Toi passe par l'angoisse et que l'engagement dans cette voie présuppose un Moi libre, courageux et responsable. C'est ce que nous apprend déjà le dicton : „Qui veut épouser la fille du roi doit d'abord supporter le tremblement de l'angoisse”. Le courage qui est ici nécessaire s'accomplit dans la liberté heureuse de ce qu'on a appelé le „discours-révélant” -par lequel le „langage-du-désir” de notre inconscience originelle est assumé et qu'il accomplit sa signification. Dans toutes les sciences, même en physique, la réflexion sur les expériences, les concepts et les explications oblige à repenser l'opposition de la nature et de l'esprit. C'est en raison de cela que la psychologie s'est vue contrainte de revoir la conception traditionelle concernant la relation de l'âme et du corps. Le corps est un système d'équilibres intérieurs qui ont une signification et qui, dans le courant de l'existence sont formés, entretenus, troublés et rétablis. En tout cela motivations psychologiques et (...) occasions corporelles sont intimement mêlées. Ceci est illustré par deux exemples, la conservation de la constance de la température du corps et de l'état de nutrition. La stabilité du « milieu interne » , C. à. d. l'homéostase, est la condition de l'indépendance individuelle de l'animal, et elle est le point d'appui de la liberté personnelle de l'homme. La régulation thermique est le fait de fonctions physiologiques qui s'exercent en accord avec l'existence personnelle. Cette liaison de l'existence et de la vie s'explique par le fait que, corporellement, l'homme ne réagit pas à des excitants physiques, mais à leur signification humaine. La régulation thermique dépend de la sensation de froid et de chaud et par conséquent aussi de relations et d'habitudes humaines. Le second exemple, de l'homéostase, de la conservation d'un état constant de nutrition, démontre, tout comme la régulation thermique, l'unité d'un état physiologique et du corps comme situation vécue. Ceci nous est montré par l'exemple de l'appétit qui dépend sans dute de sensations corporelles et d'équilibres intérieurs, mais tout autant des relations affectives. Le manque d'appétit, l'anorexie nerveuse, comme on l'appelle, se produit souvent d'une manière symptomatique dans les périodes critiques de l'existence, p. ex. à la puberté, au climacterium et à l'occasion de conflits psychiques. Il y a alors une disproportion entre le vouloir et le pouvoir que le psychologue ne peut comprendre que par rapport à la corporéité animée et animante, c'est à dire par le fait que la corporéité déjà organisée entre en conflit avec la corporéité organisante qui est constituée et par la motivation de la situation et par la liberté relative de l'homme qui donne à cette situation un sens déterminé. L'existence et la vie sont deux aspects de la réalité humaine, aspects qui sont susceptibles d'être analysés et auxquels le psychologue doit accorder son attention. La personne concrète est une unité de nécessité et de liberté, de nature et d'esprit, qui se forme elle-même dans sa vivante existence. (shrink)

Le mot 'goût' désigne non seulement le discernement et l'appréciation gustative des qualités des aliments et de la boisson, mais aussi le choix de ce qui, dans un milieu cultivé, est estimé comme étant 'de bon goût'. Ce qu'on appelle 'goût' chez les animaux est une forme du sens chimique, par laquelle l'animal remarque ce qui est comestible. C'est sur la base de cette fonction sensorielle que s'appuye le goût humain. Celui-ci se développe chez le jeune enfant dès qu'il apprend (...) à goûter, à prendre goût a quelque chose, et cela en conformité avec les préférences du milieu ambiant, références que peu à peu il adopte et fait siennes. La formation du goût comporte donc une relation permanente au milieu social ainsi qu'à la langue qui, dans la civilisation, précise tout discernement et toute appréciation. Le plaisir du goût qui juge de la qualité des aliments et des boissons a une valeur exemplaire pour toute relation à ce qui est éprouvé, apprécié et préféré d'une manière sensorielle. C'est cela qu'on dit être 'de bon goût'. Dans une société dont la civilisation et la prospérité sont en progrès, le bon goût exerce une fonction sociale. Mais cette fonction est différente de celle de l'art. Le beau à d'autres dimensions que ce qui est 'de bon goût'. Et dans le phénomène de la mode le bon goût semble pouvoir railler parfois le sens artitistique, sinon la civilisation elle-même. Le domaine du bon goût est comme un domaine intermédiaire et ambigu de la civilisation, où une nature humanisée et une humanité naturelle se fondent l'une dans l'autre. Ce domaine du goût prédominant confine d'une part au champ du besoin du boire et du manger en voie d'humanisation et d'autre part à l'espace illimité de l'art comme culture. Le goût, situé entre le sens naturel et le sens artistique, est la préfiguration du spirituel. Sa signification propre a trouvé son expression dans le langage à l'avènement de l'homo sapiens, cet être caractérisé par l'intelligence, le goût (sapor) de la mesure, de la proportion et de la valeur. In Jurismania, Paul Campos asserts that our legal system is beginning to exhibit symptoms of serious mental illness. Trials and appeals that stretch out for years and cost millions, 100 page appellate court opinions, 1,000 page statutes before which even lawyers tremble with fear, and a public that grows more litigious every day all testify to a judicial overkill that borders on obsessive-compulsive disorder. Campos locates the source of such madness, paradoxically, in our worship of reason and the resulting belief (...) that all problems are amenable to legal solutions. From an informal group of a dozen faculty and graduate students at Temple University, the Jean Piaget Society grew in seven years to 500 members who have interests in the application of genetic epistemology to their own disciplines and professions. At the outset Piaget endorsed the concept of a society which bore his name and presented a major address on equilibration at the society's first symposium in May, 1971. Had he not done so the society would no doubt have remained (...) a small parochial group, like so many others throughout the country, interested in Piaget and his theory. With the encouragement of Genevans and the leadership of its first four presidents, Lois Macomber, Barbara Press eisen, Marilyn Appel, and John Mickelson, the society undertook a number of programs to collect and disseminate the results of scholarly work in genetic epistemology. Particular emphasis was placed upon applications of Piaget's theory to developmental psychology, philos ophy, and education. One of these programs was the publication of an annual series on the development of knowing, of which this volume is the first. In 1973, the society asked Hans Furth with the assistance of Willis Overton and Jeanette Gallagher to initiate and plan a series of yearbooks with the result that in addition to this volume, a second volume on education was commissioned, and a third one on the decalage issue was planned. Quine (195 1), les Investigations philosophiques de Wittgenstein (1954), et Empirisme et philosophie de l'esprit de Wilfrid Sellars (1956). De ces trois œuvres, le long essai de Sellars, riche et intriqué, demeure le (...) moins connu et le moins discuté. Les historiens de la philosophie anglo-américaine récente ont souligné l'importance de l'essai de Quine, qui mettait en question la notion de " vérité analytique ". Ils ont également souligné l'importance de l'œuvre du dernier Wittgenstein. Ein eben erschienenes Buch „Der Typenbegriff im Lichte der neuen Logik“ (von C. Hempel und P. Oppenheim) wird zum Anlass genommen, methodologische Probleme der Verwendung von Typenbegriffen zu diskutieren. Drei verschiedene Arten von Attributen werden unterschieden : klassifizierende Merkmale, abstufbare Merkmale und Massgrössen. Abstuf- bare Begriffe können standardisiert werden. So entstandene Standards werden als Quasi-Typen bezeichnet. Echte Typen entstehen aus Merkmalkombinationen. Diese Kombinationen werden in einem Merkmalsraum vorgenommen mit Hilfe sogenannter Reduktionen. Drei Arten von Reduktionen werden unterschieden. Die für die (...) empirische Sozialforschung wichtigste Reduktion ist die pragmatische : sie fasst Klassen von Merkmalkombinationen so zusammen, wie es ein vorliegendes Erhebungsproblem erfordert. Im allgemeinen werden Typen intuitiv gebildet, und erst nachher wird die ihnen entsprechende Merkmalskombination aufgedeckt. Dieses Verfahren heisst Substruktion. An Beispielen wird seine Bedeutung für die Praxis dargestellt. Es wird betont, dass die typologischen Operationen (Reduktion, Substruktion und Transformationen) nichts darüber aussagen, was ein Typus ist und wie er gefunden wird. Sie weisen nur gewisse formale Eigenschaften auf, die allen typologischen Systemen gemeinsam sind.Un livre récemment paru „Le concept de type à la lumière de la nouvelle logique“ (de C. Hempel et P. Oppenheim : „Der Typenbegriff im Lichte der neuen Logik“ ) fournit Toccasion de discuter quelques-uns des problèmes que pose l'emploi des concepts de type. On distingue trois catégories de caractères : caractères classificatoires, caractères gradués et mesures de grandeur. Les concepts gradués peuvent être standardisés de telle manière que naissent des standards que l'on peut qualifier de quasi-types. Les types authentiques naissent par combinaison de caractères. Ces combinaisons s'opèrent dans un „lieu de caractères“ (Merkmalsraum) à l'aide d'un procédé nommé réduction. On distingue trois sortes de réduction. La réduction la plus importante pour la recherche sociale est la réduction pragmatique : elle embrasse des classes de caractères combinés en fonction des exigences d'une enquête donnée. En général, les types sont formés intuitivement, ensuite seulement on découvre la combinaison de caractères correspondante. Cette démarche s'appelle substruction. On en montre la signification pour la pratique dans une série d’exemples. On souligne que les opérations typologiques (réduction, substruction, transformations) ne nous permettent nullement de dire ce qu'est un type et comment il a été découvert. Elles indiquent seulement certains caractères formels qui sont communs à tous les systèmes typologiques. (shrink)

Elimination of state laws that preempt local antismoking ordinances is a national health objective. However, the tobacco industry and its supporters have continued to pursue statelevel preemption of local tobacco control ordinances as part of an apparent strategy to avoid the difusion of grassroots antismoking initiatives. And, an increasing number of challenges to local ordinances by the tobacco industry and persons supported by the tobacco industry are being decided in state supreme courts and courts of appeals. The outcomes of seemingly (...) similar cases about the validity of local smoke-free air ordinances vary signifcantly by state. This paper examines the common and unique aspects of the decisions and the potential implications of court rulings on preemption for future state tobacco control eforts and achievement of national health objectives around the elimination of preemption. Using a search strategy developed for the Centers for Disease Control and Prevention's State Tobacco Activities Tracking and Evaluation System, cases where a state or federal appellate level court made a fnding on the validity of a local smoke-free air ordinance or regulation were identifed in 19 states. In contrast to previous studies, we found that cases in approximately half of states were decided for local governments. We also found that across the states, courts were considering similar factors in their decisions including the extent to which: the local government possessed the authority to pass the ordinance, the ordinance conficted with the state constitution, and state statutes preempt the ordinance. The U.S. Court of Appeals for the District of Columbia upheld, in Presbyterian Medical Center of the University of Pennsylvania Health System v. Shalala, 170 F.3d 1146, a federal district court ruling granting summary judgment to the Department of Health and Human Services in a case in which Presbyterian Medical Center challenged Medicare's requirement of contemporaneous documentation of $828,000 in graduate medical education expenses prior to increasing reimbursement amounts. DHHS Secretary Donna Shalala denied PMC's request for reimbursement for increased GME (...) costs. The appellants then brought suit in federal court challenging the legality of an interpretative rule that requires requested increases in reimbursement to be supported by contemporaneous documentation. PMC also alleged that an error was made in the administrative proceedings to prejudice its claims because Aetna, the hospital's fiscal intermediary, failed to provide the hospital with a written report explaining why it was denied the GME reimbursement. St. Thomas's embeddedness within the Church's Tradition and his own historical context is integral to his approach to Scripture, yet it sets him at some distance from modern readers, for whom his interpretive vision may seem perplexing or even impenetrable. In this Primer, Boyle first provides an acclimation to this medieval context through a survey and explanation of pertinent technical terminology used by St. Thomas and characteristic of the scholastic theology of the time. With an eye to the medieval practice of considering Scripture according to the fourfold division of causes, Boyle builds on this initial foundation by exploring in turn St. Thomas's accounts of the end or use of Scripture (final cause), its divine and human authorship (efficient cause), its order and division (material cause), and its literary styles or genres (formal cause). Drawing on writings from across St. Thomas's corpus, but especially his work On the Commendation and Division of Sacred Scripture and the prologues to his biblical commentaries, Boyle masterfully elucidates both the hermeneutical principles and deep wisdom of the Angelic Doctor's approach to Scripture, imparting invaluable guidance not only for reading and understanding St. Thomas and other great masters of the Tradition, but also-and ultimately-for understanding Scripture in light of this Tradition and reading it with greater benefit and joy. Neurocognitive enhancement, or cosmetic neurology, offers the prospect of improving the learning, memory and attention skills of healthy individuals well beyond the normal human range. Much has been written about the ethics of such enhancement, but policy-makers in the USA, the UK and Europe have been reluctant to legislate in this rapidly developing field. However, the possibility of discrimination by employers and insurers against individuals who choose not to engage in such enhancement is a serious threat worthy of legislative intervention. (...) While lawmakers should not prevent individuals from freely pursuing neurocognitive enhancement, they should act to ensure that such enhancement is not coerced. This paper offers one model for such legislation, based upon a proposed US law, the Genetic Information Nondiscrimination Act of 2008, to address precisely this particular pitfall of the impending neuroscience revolution. Although considerable attention has been devoted to the concepts of “visible” and “invisible” victims in general medical practice, especially in relation to resource allocation, far less consideration has been devoted to these concepts in behavioral health. Distinctive features of mental health care in the United States help explain this gap. This essay explores three specific ways in which the American mental health care system protects potentially “visible” individuals at the expense of “invisible victims” and otherwise fails to meet the needs (...) of great numbers of people with serious psychiatric conditions: prioritization of the wrong patients, incentivization of excessive caution among providers, and a narrow definition of psychiatry's purview. While each of these practices has been discussed elsewhere in the literature, they are rarely considered as part of an interrelated and systemic problem. Reconceptualizing these three issues as aspects of the larger conflict between the interests of “visible” and “invisible” victims may prove a path toward reform. (shrink)

Substituted judgment has increasingly become the accepted standard for rendering decisions for incapacitated adults in the USA. A broad exception exists with regard to patients with diminished capacity secondary to depressive disorders, as such patients’ previous wishes are generally not honoured when seeking to turn down life-preserving care or pursue aid-in-dying. The result is that physicians often force involuntary treatment on patients with poor medical prognoses and/or low quality of life as a result of their depressive symptoms when similarly situated (...) incapacitated patients without such depressive symptoms would have their previous wishes honoured via substituted judgment. This commentary argues for reconsidering this approach and for using a substituted judgment standard for a subset of EMP/LQL patients seeking death. (shrink)

The public discourse surrounding sex and severe disability over the past 40 years has largely focused on protecting vulnerable populations from abuse. However, health professionals and activists are increasingly recognising the inherent sexuality of disabled persons and attempting to find ways to accommodate their intimacy needs. This essay explores several ethical issues arising from such efforts.

Between inventing the concept of a universal computer in 1936 and breaking the German Enigma code during World War II, Alan Turing, the British founder of computer science and artificial intelligence, came to Princeton University to study mathematical logic. Some of the greatest logicians in the world--including Alonzo Church, Kurt Gödel, John von Neumann, and Stephen Kleene--were at Princeton in the 1930s, and they were working on ideas that would lay the groundwork for what would become known as computer science. Though less well known than his other work, Turing's 1938 Princeton PhD thesis, "Systems of Logic Based on Ordinals," which includes his notion of an oracle machine, has had a lasting influence on computer science and mathematics. This book presents a facsimile of the original typescript of the thesis along with essays by Andrew Appel and Solomon Feferman that explain its still-unfolding significance. A work of philosophy as well as mathematics, Turing's thesis envisions a practical goal--a logical system to formalize mathematical proofs so they can be checked mechanically. If every step of a theorem could be verified mechanically, the burden on intuition would be limited to the axioms. Turing's point, as Appel writes, is that "mathematical reasoning can be done, and should be done, in mechanizable formal logic." Turing's vision of "constructive systems of logic for practical use" has become reality: in the twenty-first century, automated "formal methods" are now routine. Presented here in its original form, this fascinating thesis is one of the key documents in the history of mathematics and computer science. (shrink)

Priority for solid organ transplant generally does not consider the underlying cause of the need for transplantation. This paper argues that a distinctive set of factors justify assigning lower priority to willfully unvaccinated individuals who require transplant as a result of suffering from COVID‐19. These factors include the personal responsibility of the patients for their own condition and the public outrage likely to ensue if willfully unvaccinated patients receive organs at the expense of vaccinated ones. The paper then proposes a (...) three‐prong test for similar deviations from the current allocation standard that incorporates patient responsibility, foreseeability and avoidability, and the frequency of the occurrence. The integrity of the patient–physician relationship depends on maintaining professional boundaries. While ethicists and professional organisations have devoted significant consideration to the subject of sexual boundary transgressions, the subject of non-sexual boundaries, especially outside the mental health setting, has been largely neglected. While professional organisations may offer guidance on specific subjects, such as accepting gifts or treating relatives, as well as general guidance on transparency and conflict of interest, what is missing is a principle-based method that providers can use to (...) assess non-sexual interactions with patients that transcend norms of practice. This paper attempts to offer an operational model for such assessment that considers not only the traditional emphasis on beneficence, but also incorporates concerns over entanglement and concordance. Whether the law should permit individuals to opt out of accepted death standards is a question that must be faced and clarifiedWhile media coverage of the Terri Schiavo case in Florida has recently refocused public attention on end of life decision making, another end of life tragedy in Utah has raised equally challenging—and possibly more fundamental—questions about the roles of physicians and families in matters of death. The patient at the centre of this case was Jesse Koochin, a six year (...) old boy suffering from “inoperable and incurable” brain cancer. He had been undergoing care at Primary Children’s Medical Center in Salt Lake City since September 15, 2004 when “his tumor pushed his brain stem down through the skull”.1 Subsequently, two physicians independently determined that the child was “brain dead” and informed his parents that they would order life support removed within twenty four hours. Steve and Gayle Koochin overtly rejected the hospital’s definition of death. The couple, relying on traditional notions of cardiopulmonary death, obtained a restraining order to keep Jesse on a ventilator and ultimately removed the brain dead child from the hospital. The ongoing case raises the complex question of whether patients’ families should be permitted to opt out of widely accepted definitions of death in favour of their own standards.The definition of death has evolved rapidly in the United States over the past thirty five years. Physicians expressing opinions on medical matters that run contrary to the consensus of experts pose a challenge to licensing bodies and regulatory authorities. While the right to express contrarian views feeds a robust marketplace of ideas that is essential for scientific progress, physicians advocating ineffective or dangerous cures, or actively opposing public health measures, pose a grave threat to societal welfare. Increasingly, a distinction has been made between professional speech that occurs during the physician-patient encounter and public speech that transpires (...) beyond the clinical setting, with physicians being afforded wide latitude to voice empirically false claims outside the context of patient care. This paper argues that such a bifurcated model does not sufficiently address the challenges of an age when mass communications and social media allow dissenting physicians to offer misleading medical advice to the general public on a mass scale. Instead, a three-tiered model that distinguishes between citizen speech, physician speech and clinical speech would best serve authorities when regulating physician expression. (shrink)

In 1233 a certain R. Joseph bar Moses of Würzburg commissioned an illuminated copy of Rashi's Bible commentary, now in Munich. After the text was finished, the task of illuminating was put into the hands of a Christian painter, apparently a man named Heinrich, who kept a lay workshop in Würzburg . Three years later a giant Bible, now in Milan, was commissioned perhaps by the same patron, but not necessarily in the same city . It, too, was illuminated; this (...) time, however, it cannot be excluded that the paintings were made by Jewish artists. Both manuscripts are richly decorated with narrative scenes involving human figures. In the following decades it became more and more customary for wealthy Jews of Germany and northern France to have their Bibles, prayer books, and other texts adorned with figural miniatures. Yet there is no evidence that during the Middle Ages human figures were painted in any form in a Jewish context before the 1230s. A few textual references from the twelfth century indicate wall paintings and stained-glass windows in synagogues with images of animals and dragons, but none have survived. Some decades after the first illuminated books made their appearance, the most outstanding authority on religious law of his time, R. Meir ben Barukh of Rothenburg , was asked his opinion of this phenomenon. R. Meir was worried, as his reply shows, but not for reasons of religious law; his concern was that images in painted books would distract believers from their pious concentration during prayer. As a result of workplace clean air regulations and strict guidelines imposed by the Joint Commission on Accreditation of Healthcare Organizations in 1993, most hospitals in the United States are now virtually smoke free. Although evidence suggests that these restrictions both cause smoking employees to consume fewer cigarettes per day and induce some employees to quit smoking entirely, the policies have also driven many healthcare providers—including physicians—onto the public sidewalks for their cigarette breaks.
