Elimination of state laws that preempt local antismoking ordinances is a national health objective. However, the tobacco industry and its supporters have continued to pursue statelevel preemption of local tobacco control ordinances as part of an apparent strategy to avoid the difusion of grassroots antismoking initiatives. And, an increasing number of challenges to local ordinances by the tobacco industry and persons supported by the tobacco industry are being decided in state supreme courts and courts of appeals. The outcomes of seemingly (...) similar cases about the validity of local smoke-free air ordinances vary signifcantly by state. This paper examines the common and unique aspects of the decisions and the potential implications of court rulings on preemption for future state tobacco control eforts and achievement of national health objectives around the elimination of preemption. Using a search strategy developed for the Centers for Disease Control and Prevention's State Tobacco Activities Tracking and Evaluation System, cases where a state or federal appellate level court made a fnding on the validity of a local smoke-free air ordinance or regulation were identifed in 19 states. In contrast to previous studies, we found that cases in approximately half of states were decided for local governments. We also found that across the states, courts were considering similar factors in their decisions including the extent to which: the local government possessed the authority to pass the ordinance, the ordinance conficted with the state constitution, and state statutes preempt the ordinance. Despite governmental and private antismoking initiatives, tobacco smoking remains a significant public health and economic challenge. The Centers for Disease Control and Prevention estimates that for each year between 1997 and 2001, cigarette smoking and exposure to secondhand smoke caused approximately 438,000 U.S. residents to die prematurely, resulting in 5.5 million years of potential life lost, and in $92 billion dollars of lost productivity. Also, despite convincing scientific data that laws against indoor smoking protect people from the negative health effects (...) of cigarette smoke, not all states have afforded their residents this protection. As of July 2007, 16 states neither restricted nor banned indoor smoking in restaurants, private worksites, or government worksites, and many state statutes only required separate rooms for smokers rather than eliminating all smoking inside buildings. The theory opens up new forms of understanding about how ordinary practitioners negotiate the meanings of 'improvement' in their everyday practice. Although influential in (...) certain circles, Saint-Martin failed to penetrate the mainstream of Enlightenment thought, and what influence he did have in philosophy was largely felt outside of this period altogether, revealing itself in figures such as Maistre, 2 Lamartine, 3 and German Romantics like Franz von Baader. 4 In his own lifetime Saint-Martin was met with incredulity by the forces of rationalism. Voltaire was given a copy of Saint-Martin's 1775 text Des erreurs et de la vérité by a friend of d'Alembert. Saint-Martin taught that the objects we see around us are only "fantastic and deceptive images" and that the truth lies precisely where we cannot see it, Mercier explained. "Physical experiences," the cornerstone of the dominant sensationalist doctrine, were for the martinists only "errors," an "eternal source of folly and deception," wrote Mercier. 6 One review of Saint-Martin's works described their effect as analogous to that of a "pyramid covered in hieroglyphs, erected by an unknown man in a public square," in other words, completely mystifying. 7 The revolutionary Barnave would link martinism with all the other "metaphysical follies," which were, he believed, the result of an overly speculative tendency in eighteenth-century thought. 8For his part Saint-Martin rejected what he considered to be the anti-spiritual tendency of Enlightenment thought. Malebranche, Elucidation 15 One of the signatures of 17th century rationalists (...) is their replacement of the Scholastics's dependence on the deliverances of the senses with a dependence on the deliverances of the intellect as the key to gaining knowledge.1 Correct use of the intellect leading to freedom from the passions and to certain knowledge figures prominently in the works of Spinoza and Leibniz. Descartes's Meditations uses skeptical doubt to withdraw the mind from the senses, and his reliance on the meditative genre not only reveals to his readers the intellect as a distinct source of knowledge, but also trains them to use properly their will or faculty of judgment. Commentators have argued persuasively that overthrowing the sense-based epistemology and metaphysics of the Aristotelians depended on "discovering" the primacy of one's intellect over the senses, and using the deliverances of the mind to establish solid foundations for a new metaphysics and epistemology.2 Indeed, [End Page 83] outlining the proper use of the mind's faculties arguably lay at the basis of the Cartesian program in particular. This importance can be seen in Arnauld and Nicole's influential Port-Royal Logic, which aimed at training its readers in the proper use of the intellect.3Few would question Nicolas Malebranche's inclusion in the rationalist tradition.4 For while Malebranche famously takes ideas out of the Cartesian mind and transports them to God's—thus privileging the divine over the natural light—he shares Descartes's belief that our intellect, not our senses, holds the key to metaphysical truths such as the essence of matter, the mind-body distinction, and the existence of God.5 Yet, recently, Nicholas Jolley has contended that Malebranche's later commitment to "efficacious ideas" undermines his earlier belief in the power of the cognitive faculties: he believes that Malebranche abandons his view that the mind makes "real use" of the intellect to know intelligible objects.6 Jolley's position builds upon Alquié and Robinet's claims that around 1694-95 Malebranche moved from a vision "in" God to a vision "by" God. Now God's ideas act on and modify the soul with both sensations and intellectual concepts, rather than the human intellect contemplating ideas in the Divine Reason.7Alquié and Robinet argue that Malebranche, pushed by the battles with Arnauld and Régis over the status of ideas, introduced the language of "efficacious" ideas to explain how the union of the human and the divine mind is supposed to work.8 Robinet in particular suggests that in cashing out the metaphor of God enlightening human minds, Malebranche moved from a static "ontologist" view of idea-objects in God to an active "illuminationist" view whereby divine ideas cause(intellectual [End Page 84] and sensory) perception by modifying the soul.9 Once one accepts this view of the place and function of efficacious ideas in Malebranche's metaphysics, it seems natural to accept Jolley's declaration that the only way for the mind to apprehend ideas in God is if those ideas "act directly on the mind; [if] they thereby cause cognitive states to arise in a substance which is devoid of all genuine cognitive capacities of its own."10 Indeed, Jolley suggests that Malebranche ultimately made the soul passive in all its states, including its volitional ones.11In this paper, I argue that a strong interpretation of efficacious ideas, whereby they appear to become true causal agents, must be rejected precisely because it pushes us into an incorrect reading of Malebranche's theory of the divine and human faculties. In this paper I will argue that a false assumption drives the attraction of philosophers to a divine command theory of morality. Specifically, I suggest the idea that anything not created by God is independent of God is a misconception. The idea misleads us into thinking that our only choice in offering a theistic ground for morality is between making God bow to a standard independent of his will or God creating morality in revealing his will. Yet what is God (...) is hardly independent of him, and in coupling a perfect being theology with the doctrine of divine simplicity we discover that God’s “reason” is God. Accordingly, obeying the truths of goodness that we humans speak of as contained in the divine wisdom hardly impugns the divine sovereignty. By modifying divine command ethics to give primacy to God’s love or justice, thinkers such as Robert M. Adams, Philip L. Quinn, and Edward J. Wierenga admit the repugnance of this picture in spite of their verbal allegiance to divine command ethics. Accordingly, they implicitly concede that basing morality on God’s sheer power should not be the preferred option for the Christian theist. (shrink)

In Three Challenges to Ethics, James Sterba's central claim is that environmentalism, feminism, and multiculturalism challenge traditional Western ethics, as exemplified by Aristotelian, Kantian, and utilitarian moral theory. Sterba understands these views respectively as the claims that Western ethics is biased (...) against non-human creatures, women, and non-Western cultures. If taken seriously, these schools of thought require making adjustments in our concepts of what sorts of things can have goods or interests, who is rational, and what sorts of intuitions get counted among the data we examine. Sterba offers a decisive argument for giving these views a fair hearing. He argues that to dismiss these views without a fair hearing is to beg the question in favor of the accepted views.There are two primary projects that run through this book. The first project examines whether or not entire groups of people or categories of thought can be dismissed. The second project shows that particular schools of thought and individual thinkers challenge traditional ethics by examining the important contributions they make. [End Page 126]The views of women, non-white, and non-Western thinkers have been and are frequently dismissed prior to any hearing (sometimes by relying on historically dated and biased hearings) on the assumption that only white men of European descent can make meaningful contributions to Western culture. It isn't unusual for people who hold this view to point to the historical absence of contributions from women or non-whites as evidence for their inability to contribute. When a few representatives are brought forth, it is claimed that these few exceptions actually prove the rule. Without real evidence that shows that, as a rule, particular categories of people cannot make contributions to the discussion (which seems a priori false, if anything does), we have both a moral and intellectual obligation to take all people and positions seriously. His discussion of whether or not to take environmentalism, feminism, and multiculturalism seriously is framed by the straightforward concern about whether or not those who reject these problems, thinkers, and ideas as genuine or legitimate are begging the question in favor of their own position. He shows decisively that if those who work in this area and who do intellectual work generally do not want to be accused of begging the question with regard to these issues, then they must assess these positions and the corresponding work on a par with the work of Western male philosophers. By holding ourselves accountable to our own standards, we are obligated to give even possibly unpromising views a fair hearing, a hearing on a par with positions we favor. Using the standards of Western reasoning, we must provide evidence that these positions are inherently worthless in order to dismiss them wholesale or at the very least reasons to dismiss individual thinkers. In order to do this, we must begin by evaluating these positions fairly.Having made this case, Sterba moves on to show that there is good evidence to take these various challenges and the particular challengers seriously. In the first chapter of the book Sterba discusses the challenge posed to traditional ethics by relativism, and having shown that there are at least good reasons for rejecting relativism, goes on to discuss the demands of morality. He also has a concise introduction to the ideas of Aristotle, Kant, and utilitarianism.The rest of the book addresses the three challenges, first by presenting an introduction to the particular challenge, which is both brief and detailed, and then showing how each set of criticisms can be accommodated by moral theory. He discusses, arguably, the three most important moral positions, Aristotle, Kant, and the utilitarians, along with their traditional [End Page 127] responses. He then goes on to show how the challenges to traditional ethics can be accommodated, largely by Kantian ethics. Education is a key mechanism for the restoration of inter-community relations in post-conflict societies. The Northern Ireland school system remains divided along sectarian lines. Much research has been conducted into the efficacy of initiatives developed to bring children together across this divide but there has been an absence of studies into the impact of educational division on teachers. A number of policies, separately and in combination, restrict teachers’ options to move across and between the divided school sectors. The recruitment of (...) teachers is excepted from fair employment legislation; details of teachers’ community identity are consequently not collected, and little is known about the impact that ethnic identity, educational policies and sectoral practices have had on teacher deployment. This quantitative project investigates the extent to which the deployment of teachers in mainstream schools in Northern Ireland reflects the enduring community divide. It is observed that, whilst primary schools are staffed mainly by community-consistent teachers, there has been an increase in cross-over teachers in post-primary schools – particularly in the grammar sector. Around one-in-five teachers have had no educational experience outside of their community of origin; this cultural encapsulation may contribute to a reluctance to engage with contentious issues in reconciliation programmes. In this paper, we argue that the so-called Knobe-Effect constitutes an error. There is now a wealth of data confirming that people are highly prone to what has also come to be known as the ‘side-effect effect’. That is, when attributing psychological states—such as intentionality, foreknowledge, and desiring—as well as other agential features—such as causal control—people typically do so to a greater extent when the action under consideration is evaluated negatively. There are a plethora of models attempting to account for (...) this effect. We hold that the central question of interest is whether the effect represents a competence or an error in judgment. We offer a systematic argument for the claim that the burden of proof regarding this question is on the competence theorist. We sketch an account, based on the notion of the reactive attitudes, that can accommodate both the idea that these sorts of judgments are fundamentally normative and that they often constitute errors. We demonstrate in this article how critical realism can be used to explain indeterminacy in role behaviour systematically. In so doing, we both rebut various criticisms of critical realism made recently by Kemp and Holmwood and attempt to illustrate the weaknesses and absences of approaches that concentrate unduly on the collection of expectations of actors concerning roles and the behaviour of incumbents. Within a framework that recognises that structure and agency are ontologically distinct but necessarily empirically related entities, we argue (...) that structures should be seen as sources of indeterminacy within role behaviour for at least four reasons: the co-determination of roles through the intersection of structures; conflicting role expectations caused by contradictions inhering within structures; asymmetries of power within social relations; and asymmetric repetition within structural reproduction/transformation. In light of this discussion of structural sources of indeterminacy, we then go on to demonstrate how critical realism is also able to analyse systematically the agential sources of indeterminacy within role behaviour and expectations through theories of psychobiography and reflexivity. We thus conclude that critical realism contains the conceptual tools required to illuminate the point of intersection between structure, culture and agency which is central to understanding both role behaviour and the plurality of expectations concerning such behaviour. The community separation of the school system in Northern Ireland limits opportunities for daily cross-community interaction between young people. The deployment pattern of teachers is largely consistent with this divide. Pupils are therefore unlikely to be taught by a teacher from a community background other than their own. Nonetheless, recent research has shown that an increased proportion of teachers are diverting from the community consistent path and are teaching in a school not associated with their own community identity, although this (...) remained a very uncommon choice. Narrative interviews with a purposive sample of these ‘cross-over’ teachers provide illustrations of the factors that preserve the separation of the teaching profession by community identity. Thematic analysis of this data reveals that policy, perceptions and practice combine to restrict the possibility of cross-community career movement by teachers. If the out-workings of community division in Northern Ireland are to be addressed, then these issues will need to be considered, and actions taken to mitigate this segregation. (shrink)

This work contains, perhaps, a larger amount of vigorous orthodoxy than can elsewhere be found in so small a compass. It is a plea for a laissez-faire policy, and is full of wisdom of a kind that is needed, in view of the drift of opinions toward “stateism.” Its effect on public policy will be like that of an anchor planted on a shoal on one side of a channel in order to warp a vessel off from an opposite shoal. Background: There is little research into medical students’ or doctors’ attitudes to abortion, yet knowing this is important, as policy makers should be aware of the views held by professionals directly involved in abortion provision and changing views may have practical implications for the provision of abortion in the future. Methods: We surveyed 300 medical students about their views on abortion, their beliefs about the status of the fetus and the rights of the mother, their attitude towards UK law and (...) their willingness to be involved in abortion provision as qualified doctors. Results: 62% of medical students were pro-choice, 33% pro-life and 7% undecided. Students’ views correlated with gender, year of study and holding a religious belief. Their beliefs about abortion, the status of the fetus and the rights of women significantly correlated with their attitudes towards the UK law and their willingness to be involved in abortion provision. Students’ willingness to be involved in abortion provision was related to their views on abortion, the extent of participation required, the circumstances of the pregnancy and the stage of pregnancy. Conclusions: The percentage of pro-choice students was lower than that found in research on general practitioners’ attitudes to abortion. It is unclear whether this is because students become more pro-choice as they progress through their medical career or because there is genuinely a change in attitudes to abortion. (shrink)

We add to the constructivist approach of Quartz & Sejnowski (Q&S) by outlining a specific classification of sources of constraint on the emergence of representations from Elman et al. (1996). We suggest that it is important to consider behavioral constructivism in addition to neural constructivism.

STEM faculty are encouraged to incorporate ethical, social, and historical content into their undergraduate STEM courses. This is a challenge, for there is more than enough foundational material, and interdisciplinary content can introduce a steep learning curve for students and faculty. As part of the NSF-funded Fall 2020 STEM Futures Education Project (https://serc.carleton.edu/stemfutures/about.html), we presented a plan for developing 1–2-day ethics modules that STEM faculty can easily incorporate into their courses and that STEM departments can use to craft ethics credentials (...) that suit their purposes. Each module would have a materials list with readings, videos, and podcasts; a series of discussion questions; 2–3 interactive small group activities; and a list of prompts for an essay assignment. Some modules would have suggestions for community-based and project-based learning, and all would employ learner-centered and inclusive pedagogies to create a more inclusive and ethical culture in STEM undergraduate education. The modules empower STEM faculty with limited expertise in the humanities to deliver this new content responsibly, especially at 2- and 4-year institutions that need more resources to support team teaching.
