As Socially Responsible Investment (SRI) enters the mainstream of professional and institutional investment practice, some perplexities arise. Some SRI market participants are well schooled in finance but are hesitative as to how to apply non-financial criteria in the management of portfolios. Governments too are giving SRI more attention and, in some countries, are discussion whether and how to regulate the SRI market. Advocacy groups are targeting SRI projects through media campaigns using political discourse. Many of the pertinent questions that come (...) with these perplexities are of the philosophical or ethical type and concern legitimisation, demarcation of responsibilities, interpretation of norms and policy formulation. The inclusion of non-financial criteria into investment decision-making leads to a ‹puzzle in SRI’ for which this article offers a solution. The puzzle arises when the day-to-day implementation of an SRI-policy coincides with the process of administering justice. Three questions make up that puzzle: (1) what should an␣investor do when allegations arise about a corporation, (2) what should an investor do when a corporation is brought before a court, (3) what should an investor do when a corporation is found guilty by a court. This article argues, by distinguishing between the rationality of the investor and that of the judge, that allegations, court cases or court verdicts should not be reasons to disinvest from a corporation. In this survey of business ethics in Europe, we compare the present state of business ethics in Europe with the situation as described by Enderle (BEER 5(1):33–46, 1996 ). At that time, business ethics was still dominated by a mainly philosophical, normative analysis of business issues with a maximum of 25 chairs in business ethics all over Europe. It has since expanded dramatically in numbers as well as diversified into many different domains. We find this rich diversity in the conception (...) of business ethics back in the answers of our respondents to every single question. The concepts they propose, the courses they teach, the subjects under research as well as the training and consultancy offered to clients and even the challenges for the future all reflect this diversity. Decisive for the expansion of business ethics in Europe has been the advance of CSR and the official backing of CSR by the European Commission. We further argue that the prevalence and importance of business ethics and CSR differs throughout Europe. A rough approximation based on our survey results and literature review is that it is more important and more developed in core and Nordic European countries and somewhat less in Southern and Eastern European countries. The real East with countries like Belarus and Bulgaria remains a challenge. (shrink)

In this paper, the process for firms to decide whether or not to invest in corporate social responsibility is treated from a real option perspective. We extend the Husted framework with an important extra parameter that allows us to understand the timing of CSR investment and explain why some companies drag their feet over CSR investments. Our model explicitly allows for the impact of the opportunity cost of delaying the CSR investment decision, providing firms with tools to determine the optimal (...) moment of exercising the CSR investment option. We illustrate our timing model through a case study and analyze governmental support strategies for CSR from a real options perspective. (shrink)

Many people believe that we have responsibility towards the distant future, but exactly how far this responsibility reaches and how we can find a reasonable ethical foundation for it has not been answered in any definitive manner. Future people have no power over us, they form no part of our moral community and it is unclear how we can represent them in a possible original position. All these problems can be circumvented when you take an impersonal decision criterion like maximizing (...) total or average utility. Such a sum-ranking criterion is neutral with respect to distance in time or space: my utility, my neighbour's and that of our descendants all carry the same weight. This makes future people an integral part of present decisions. Time-neutrality was defended by, among others, Sidgwick, Pigou and Ramsey. (shrink)

Whether all of this is for good or ill is a topic of heated debate. One positive view is that globalization is an unmixed blessing, with the potential to boost productivity and living standards everywhere.This (...) is because a globally integrated economy can lead to a better division of labour between countries, allowing low-wage countries to specialize in labour-intensive tasks while high-wage countries use workers in more productive ways. It will allow firms to exploit bigger economies of scale. And with globalization, capital can be shifted to whatever country offers the most productive investment opportunities, not trapped at home financing projects with poor returns. In fact, the arguments in favour of globalization differ little from the arguments in favour of a free market in a closed economy.Critics of globalization take a gloomier view. They predict that increased competition from low-wage developing countries will destroy jobs and push down wages in today's rich economies. There will be a `race to the bottom' as countries reduce wage taxes, welfare benefits and environmental controls to make themselves more `competitive'. Pressure to compete will erode the ability of governments to set their own economic policies. The critics also worry about the increased power of financial markets to cause economic havoc, as in the European currency crises of 1992-93, Mexico in 1994-95 and South-East Asia in 1997-98. And “chaos theorists” have even predicted a clash of civilizations, as Western norms and values attempt to impose themselves on other societies through the medium of globalization.But despite all the buzz about globalization, or rather because of it, globalization has turned into a notoriously difficult concept to define. It is an inflated term that is employed so loosely that almost anything can be used to illustrate its operation. This limits the analytical usefulness of the concept. The intention of this paper is to relate the various standpoints regarding anxiety and uncertainty. Within the humanities and social sciences, research is pursued in many different disciplines without much interaction between them. Everyone's thinking is based on concepts which are domain-specific, and the distinctions, methods and arguments used are the ones that are generally accepted within the discipline. The divergent conclusions constitute pieces of a puzzle that are seldom if ever put together. There are even doubts about whether such (...) a puzzle can be put together. It can hardly be denied, however, that inspiration is to be found in a consideration of the views and findings of colleagues from other disciplines who are working on the same problems. Now that we have as our guests two prominent academics, each with specific views about our subject, we should take this opportunity to discuss together some of the sociological, anthropological, economic, philosophical and theological approaches to anxiety and uncertainty.If a number of well-known authors are to be believed, lack of trust, uncertainty and insecurity affect the most affluent and modern societies. In French one speaks of précarité , in German of Unsicherheit and Risikogesellschaft , and in English of “fear”, “risk” and “insecurity” . All modern Western societies seem to be afflicted with the same dismal and frustrating human experience.Belgian society is no exception to this. In recent years we have regularly been subjected to the emotional reactions provoked by sensational events in the areas of politics , justice and public health . Less spectacular but no less real were the results of opinion polls which showed that confidence in public institutions in general, and politics in particular, is at an all-time low. (shrink)

Moral purism is a commonly held view on moral worthiness and how to identify it in concrete cases. Moral purists long for a moral world in which (business) people—at least sometimes—act morally worthy, but in concrete cases they systematically discount good deeds as grounded in self-interest. Moral purism evokes moral cynicism. Moral cynicism is a problem, both in society at large and the business world. Moral cynicism can be fought by refuting moral purism. This article takes issue with moral purism. (...) The common strategy to tackle moral purism is to reject the exclusion thesis which states that self-interest and the ‘pure’ moral motive (and thus moral worthiness) exclude each other. We develop a different strategy. We argue that moral purists are mistaken in the way they judge moral worthiness in concrete cases. They employ the wrongprocedureand the wrongcriteria.We develop a proper procedure and proper criteria. We build on Kant, who we argue is unfairly regarded as the champion of moral purism. In order to see how Kant can develop a consistent (non-purist) philosophy, the exclusion thesis must be embedded in Kant’s transcendental philosophy. Properly embedded, Kant turns out to be both anti-purist and anti-cynical. (shrink)

This gives rise to four types of alleged inside transactions. We argue that the literature on insider trading has often targeted inside transactions type II, III and IV but that these arguments do not necessarily hold for type I transactions. We look for consequentionalist as (...) well as non-consequentionalist arguments against type I transactions and demonstrate that these are hard to find. Throughout the article we refer extensively to the economic literature on insider trading in order to overcome a relative divide between the economic, legal, and philosophical discussion on insider trading. Transparency is a crucial condition to implement a CSR policy based on the reputation mechanism. The central question of this contribution is how a transparency policy ought to be organised in order to enhance the CSR behaviour of companies. Governments endorsing CSR as a new means of governance have different strategies to foster CSR transparency. In this paper we discuss the advantages and disadvantages of two conventional policy strategies: the facilitation policy and the command and control strategy. Using three criteria (...) (efficiency, freedom and virtue) we conclude that both strategies are defective. Most attention is paid to the facilitation strategy since governments nowadays mainly use this. In evaluating this strategy we analyse the Dutch case. As an alternative we introduce a third government policy: the development of a self-regulating sub-system. By construing an analogy with the historical development of corporate financial disclosure, we point out that the vital step in the creation of a self-regulating subsys- tem is the creation of strong informational intermediate organisations. For years business ethics has limited the moral duties of enterprises to negative duties. Over the last decade it has been argued that positive duties also befall commercial agents, at least when confronted with large scale public problems and when governments fail. The argument that enterprises have positive duties is often grounded in the political nature of commercial life. It is argued that agents must sometimes take over governmental responsibilities. The German republican tradition argues along these lines as does Nien-Hé (...) Hsieh. Agents in commercial life are bound by positive duties because at some point they become citizens that must take on the responsibilities of the state. In this paper we leave undisputed the claim that corporations must acknowledge positive duties. However, we demonstrate that the political grounding fails, at least in the sense that this theory insufficiently acknowledges a long standing liberal tradition that vindicates apolitical markets and clear borderlines between politics and economics. We carve out an alternative route to the grounding of one specific positive duty—the duty to further justice. Our argument is based on the moral nature of commercial agents and tries to demonstrate that the duty to further justice ensues from liberalism. Taking a Kantian perspective, it conceptualizes the duty to further justice as a moral duty, orientated toward the political domain. It is grounded in the obligation to attain moral autonomy in the civil condition. (shrink)

One of the essential parts within the transition towards sustainable economies, is the way how higher education prepares its students for their future role in business. In order for them to contribute to corporate social responsibility within the enterprise context, they need specific skills and competences related to sustainable development. Derived from the societal role of business schools in preparing the future business leaders and entrepreneurs, the focus of this paper is the participation in, and the contribution of business schools (...) to the issues of efficiency measures for sustainability. This topic could be wider situated within the context of higher education for sustainable development, which aims at integrating competences for sustainable development into the curriculum, and integrating sustainability measures within campus operations, research and societal role. The paper furthermore looks at a business school context as a case for institutional efficiency measures. The paper describes how business schools could implement efficiency measures and apply instruments within their own context, looking at the campus as a ‘living laboratory’ for sustainability innovation. The paper describes how tools and instruments to foster sustainability integration are applied on campus, its benefits and possible problems. The paper focuses on the application of three instruments: Assessment Instrument for Sustainability in Higher Education; Ecological Footprint Analysis; and Principles for Responsible Management Education. It builds upon the data and results from several action research projects within two Belgian business schools. As a conclusion, the paper will reflect upon the essential characteristics of these initiatives, as a way to enhance efficiency measures for sustainability both within the business school itself, as within a wider business context. Ecological footprint analysis has been used worldwide in a variety of organizations educational institutions) and at different levels organizations, cities, regions, countries). Universities also calculated their ecological footprints, for various reasons: e.g. to answer the societal appeal to integrate sustainability into their core business, to perform a sustainability assessment of their operations, to use as an educational tool with students, to use for policy development. In general, performing an ecological footprint analysis is a way for higher education to ‘practice what (...) they preach’, to monitor sustainability performance and raise awareness among the university's community. This article focuses on the calculation of the ecological footprint and discusses the possibilities to use this tool for campus operations, educational purposes and policy development. (shrink)

Probabilistic models have much to offer to philosophy. We continually receive information from a variety of sources: from our senses, from witnesses, from scientific instruments. When considering whether we should believe this information, we assess whether the sources are independent, how reliable they are, and how plausible and coherent the information is. Bovens and Hartmann provide a systematic Bayesian account of these features of reasoning. Simple Bayesian Networks allow us to model alternative assumptions about the nature of the information sources. (...) Measurement of the coherence of information is a controversial matter: arguably, the more coherent a set of information is, the more confident we may be that its content is true, other things being equal. The authors offer a new treatment of coherence which respects this claim and shows its relevance to scientific theory choice. Bovens and Hartmann apply this methodology to a wide range of much discussed issues regarding evidence, testimony, scientific theories, and voting. Bayesian Epistemology is an essential tool for anyone working on probabilistic methods in philosophy, and has broad implications for many other disciplines. (shrink)

What happens when the meaning of life based on a divine revelation no longer makes sense? Does the quest for transcendence end in the pursuit of material success and self-absorption? Luc Ferry argues that modernity and the emergence of secular humanism in Europe since the eighteenth century have not killed the search for meaning and the sacred, or even the idea of God, but rather have transformed both through a dual process: the humanization of the divine and the divinization of (...) the human. Ferry sees evidence for the first of these in the Catholic Church's attempts to counter the growing rejection of dogmatism and to translate the religious tradition into contemporary language. The second he traces to the birth of modern love and humanitarianism, both of which demand a concern for others and even self-sacrifice in defense of values that transcend life itself. Ferry concludes with a powerful statement in favor of what he calls "transcendental humanism"--a concept that for the first time in human history gives us access to a genuine spirituality rooted in human beings instead of the divine. As the need for more diversity in business ethics is becoming more pressing in our global world, we provide an historical study of a Fair Trade (FT) movement, born in rural Mexico. We first focus on the basic assumptions of its founders, which include a worker–priest, Frans van der Hoff, a group of native Indians and local farmers who formed a cooperative, and an NGO, Max Havelaar. Distant Suffering examines the moral and political implications for a spectator of the distant suffering of others as presented through the media. What are the morally acceptable responses to the sight of suffering on television, for example, when the viewer cannot act directly to affect the circumstances in which the suffering takes place? Luc Boltanski argues that spectators can actively involve themselves and others by speaking about what they have seen and how they were affected by it. Developing ideas in (...) Adam Smith's moral theory, he examines three rhetorical 'topics' available for the expression of the spectator's response to suffering: the topics of denunciation and of sentiment and the aesthetic topic. The book concludes with a discussion of a 'crisis of pity' in relation to modern forms of humanitarianism. A possible way out of this crisis is suggested which involves an emphasis and focus on present suffering. (shrink)

This article concentrates on the critique by John Rawls and Derek Parfit of the use of a discount rate in economics. In a presentation of the basic economics underlying the use of a discount rate, the inherently problematic nature of people’s preferences with respect to time are highlighted. The second part discusses the role of the discount rate in economic optimal growth models. An outline of the economic theory of optimal growth is provided, pointing out how Rawls’s analysis of justice (...) between generations fits nicely into this economic discussion, thus explaining his interest in the discount rate. For Rawls the basic problem with the discount rate is that one variable is caught between two objectives: guaranteeing an efficient and at the same time a fair solution. Finally Derek Parfit’s analysis of the use of discount rates is examined. Parfit points out that a discount rate is often used as a crude rule of thumb which wrongly represents our reasons for discounting. The article concludes with a discussion of a study undertaken by a number of respected economists for the IPCC which exhibits all the mistakes that Parfit warns us against. (shrink)

A coherent story is a story that fits together well. This notion plays a central role in the coherence theory of justification and has been proposed as a criterion for scientific theory choice. Many attempts have been made to give a probabilistic account of this notion. A proper account of coherence must not start from some partial intuitions, but should pay attention to the role that this notion is supposed to play within a particular context. Coherence is a property of (...) an information set that boosts our confidence that its content is true ceteris paribus when we receive information from independent and partially reliable sources. We construct a measure cr that relies on hypothetical sources with certain idealized characteristics. A maximally coherent information set, i.e. a set with equivalent propositions, affords a maximal confidence boost. cr is the ratio of the actual confidence boost over the confidence boost that we would have received, had the information been presented in the form of maximally coherent information, ceteris paribus. This measure is functionally dependent on the degree of reliability r of the sources. We use cr to construct a coherence quasi-ordering over information sets S and S’: S is no less coherent than S’ just in case c_r is not smaller than c_r for any value of the reliability parameter. We show that, on our account, the coherence of the story about the world gives us a reason to believe that the story is true and that the coherence of a scientific theory, construed as a set of models, is a proper criterion for theory choice. Reading with the spine: Cora Diamond and Vladimir Nabokov on the moral relevance of literature as aesthetical exposure When philosophers analyze the moral value of literature, literary theorists brace themselves: the reduction to a set of propositions is quickly made. In her work on the philosophy of literature, Martha Nussbaum has always resisted such reduction: literature derives its power from the interweaving of form and content. Yet her analyses are characterized by reductions that negate that very power. In the first (...) part of this paper, I briefly discuss some of these reductions. I do this starting from the practice of literature: although Nussbaum states that she is pluralistic and wants to let the richness of the work speak for itself, in her analyses she overlooks certain aspects of literary autonomy, and thereby also excludes their moral potential. In the second part, I contrast Nussbaum's view on the moral relevance of literature successively with those of Cora Diamond and Vladimir Nabokov. Although both are convinced that literature has a moral relevance and that moral themes can be part of the aesthetic value of the work, that power only comes to the fore when one is open to the literary nature of the work, in a more amoral way. Diamond's notions of exposure, complexity and adventure and Nabokov's conception of close reading and the inherent morality of uninhibited art form the starting point for a moral value of literature with more literary sensitivity. The question underlying is: how can the moral value of literature be conceived without foregoing its literary dimensions? (shrink)

This study explains how the myths of Greece and Rome were transmitted from antiquity to the Renaissance. Luc Brisson argues that philosophy was ironically responsible for saving myth from historical annihilation. Although philosophy was initially critical of myth because it could not be declared true or false and because it was inferior to argumentation, mythology was progressively reincorporated into philosophy through allegorical exegesis. Brisson shows to what degree allegory was employed among philosophers and how it enabled myth to take on (...) a number of different interpretive systems throughout the centuries: moral, physical, psychological, political, and even metaphysical. How Philosophers Saved Myths also describes how, during the first years of the modern era, allegory followed a more religious path, which was to assume a larger role in Neoplatonism. Ultimately, Brisson explains how this embrace of myth was carried forward by Byzantine thinkers and artists throughout the Middle Ages and Renaissance after the triumph of Chistianity, Brisson argues, myths no longer had to agree with just history and philosophy but the dogmas of the Church as well. Critical evaluations of the current movement of corporate social responsibility commodification have neglected an important question: How do CSR professionals manage the tensions resulting from the search for both profit and social responsibility? This article addresses this question by analyzing the discourse of CSR consultants with the aim of understanding how they deal with such tensions through identity work. Our findings suggest that people who claim, or who are ascribed, paradoxical professional identities may engage in ‘paradoxical identity mitigation’ – a (...) process whereby the concomitant and paradoxical use of linguistic strategies is aimed at simultaneously embracing and distancing oneself from contradictory identity demands. In uncovering how CSR professionals discursively manage the tensions engendered by CSR commodification, our results also advance current knowledge of CSR by shedding light on the underlying processes whereby new ‘hybrid’ identities are constituted and mobilized by actors to make sense of their professional activities. This paper addresses a problem for theories of epistemic democracy. In a decision on a complex issue which can be decomposed into several parts, a collective can use different voting procedures: Either its members vote on each sub-question and the answers that gain majority support are used as premises for the conclusion on the main issue, or the vote is conducted on the main issue itself. The two procedures can lead to different results. We investigate which of these procedures is (...) better as a truth-tracker, assuming that there exists a true answer to be reached. On the basis of the Condorcet jury theorem, we show that the pbp is universally superior if the objective is to reach truth for the right reasons. If one instead is after truth for whatever reasons, right or wrong, there will be cases in which the cbp is more reliable, even though, for the most part, the pbp still is to be preferred. (shrink)

In their recently published book Nudge (2008) Richard H. Thaler and Cass R. Sunstein (T&S) defend a position labelled as ‘libertarian paternalism’. Their thinking appeals to both the right and the left of the political spectrum, as evidenced by the bedfellows they keep on either side of the Atlantic. In the US, they have advised Barack Obama, while, in the UK, they were welcomed with open arms by the David Cameron's camp (Chakrabortty 2008). I will consider the following questions. What (...) is Nudge? How is it different from social advertisement? Does Nudge induce genuine preference change? Does Nudge build moral character? Is there a moral difference between the use of Nudge as opposed to subliminal images to reach policy objectives? And what are the moral constraints on Nudge? (shrink)
