The theory of reflexive modernization plausibly advocates postnational cosmopolitanism. As the nation state is eroding today, we are becoming citizens of a ‘global risk society’ whose unity and cohesion is generated by the risk that is threatening us world-wide. By the same token, this world risk society is no longer unified in any political sense. There is no world state; its very idea is even rejected. In this sense, the cosmopolitanism argued for in the theory of reflexive modernization proves predominantly (...) to be an extrapolation of civil society on a global scale, while, strictly speaking, having no cosmo‘political’ counterpart. Building on Marcel Gauchet’s political philosophy, the article questions the cosmopolitanism-beyond-the-political position of the theory of reflexive modernization. To do so, it goes substantially into Gauchet’s view of the representational role of the political as an essential dimension in society formation. (shrink)

Sinds extreem rechts recent een bepaald soort salonfähigkeit heeft weten te verwerven in het democratische bestel wordt de term door zelfverklaarde democraten te pas en te onpas gehanteerd om bijvoorkeur ‘rechtse’, maar bij uitbreiding ook alle andere tegenstanders te desavoueren die uit zijn op al te gemakkelijk politiek succes. Vanuit dat perspectief veroorzaakt de term ‘populisme’ geen enkel probleem: het is een dankbare politieke diskwalificatie die iedereen graag gebruikt, maar die niemand graag krijgt toebedeeld.

This essay sets up a dialogue between Lefort’s view on the relationship between the state and modern society and Foucault’s thesis of a governmental turn in the modern power regime, whereby the relations between state and society are thoroughly redrawn. What are the main results? 1) Whereas Lefort’s political ontology leaves room for divergent agencies from which the symbolic institution of the social may unfold, his preoccupation with democracy leans him to inseparably link the symbolic institution of modern society with (...) the functioning of the modern state. 2) By contrast, Foucault’s history of governmentality documents a shift from the political and legal power regime to the biopolitical regime. This shift seems to be accompanied by a turn in the regime of the symbolic institution of modern society. Where that institution hitherto relied on the state, today, a symbiosis of state and neoliberal governmentality seems to be taking over. 3) This shift in power regimes brings along major problems. In political respect, it leads to a re-adjustment of the instituting representations of contemporary society, to a depoliticization of political and social relations, and to the erosion of democracy. The trolley problem, first described by Foot (1967) and Thomson (The Monist, 59, 204–217, 1976), is one of the most famous and influential thought experiments in deontological ethics. The general story is that a runaway trolley is threatening the lives of five people. Doing nothing will result in the death of those persons, but acting in order to save those persons would unavoidably result in the death of another, sixth person. It appears that, depending on the situation, we have different (...) moral judgments about the permissibility of action. We will review and systematize all the proposals in the literature of the past 35 years that have attempted to grasp our moral intuitions in a simple deontological principle. In particular, seventeen proposals will be classified: six algorithmic, seven psychological, and four other invalid accounts. This review and classification sheds light on some subtle differences and clarify a few issues. (shrink)

In his Law of Peoples, Rawls severely restricts our duties of justice towards the global poor. Many of his critics have replied that there actually exists a global basic structure and that hence the difference principle applies on a global scale.However the shipwrecked of globalization do not contribute in any substantial way to the creation of global wealth. We show that Martha Nussbaum’s cosmopolitan solution to this problem is unsatisfactory because it ignores scarcity as one of the circumstances of justice.If (...) the marginalized of progress want to raise a claim of justice rather than appeal to our beneficence, they can only do so on the basis of a principle of compensation: their fate has been deteriorated by the development of a global economy they did not ask for. Towards the end of the article we point at some typical blind spots in the treatment of these problems in the literature on international distributive justice: the idea that development problems can be solved merely by transfers of money and the presupposition that the gulf between rich and poor is growing all the time. Models as Make-Believe offers a new approach to scientific modelling by looking to an unlikely source of inspiration: the dolls and toy trucks of children's games of make-believe.

This article seeks to demonstrate that in his recent reading of the role of religion in the postsecular public realm, Habermas overlooks a most fundamental dimension of religion: its power to symbolically institute communities. For his part, Gauchet starts from a vision of religion in which this fundamental dimension is central. In his evaluation of the role of religion in postsecular society, he therefore arrives at results which are very different from those of Habermas. However, I believe that Gauchet too (...) underestimates the extent to which religion’s power of symbolic community institution has remained intact within modern, postsecular society. In support of this position, I show how relatively heterogeneous phenomena within Western societies, such as the renewed importance of religion in the public realm, the revival of certain forms of nationalism and the associated demand for recognition of group rights and hence for forms of legal pluralism, may prefigure a new transformation of the public realm. This article gives an overview of the nursing ethics arguments on euthanasia in general, and on nurses' involvement in euthanasia in particular, through an argument-based literature review. An in-depth study of these arguments in this literature will enable nurses to engage in the euthanasia debate. We critically appraised 41 publications published between January 1987 and June 2007. Nursing ethics arguments on (nurses' involvement in) euthanasia are guided primarily by the principles of respect for autonomy, nonmaleficence, beneficence and justice. Ethical arguments (...) related to the nursing profession are described. From a care perspective, we discuss arguments that evaluate to what degree euthanasia can be considered positively or negatively as a form of good nursing care. Most arguments in the principle-, profession- and care-orientated approaches to nursing ethics are used both pro and contra euthanasia in general, and nurses' involvement in euthanasia in particular. In this paper I propose an account of representation for scientific models based on Kendall Walton’s ‘make-believe’ theory of representation in art. I first set out the problem of scientific representation and respond to a recent argument due to Craig Callender and Jonathan Cohen, which aims to show that the problem may be easily dismissed. I then introduce my account of models as props in games of make-believe and show how it offers a solution to the problem. Finally, I demonstrate (...) an important advantage my account has over other theories of scientific representation. All existing theories analyse scientific representation in terms of relations, such as similarity or denotation. By contrast, my account does not take representation in modelling to be essentially relational. For this reason, it can accommodate a group of models often ignored in discussions of scientific representation, namely models which are representational but which represent no actual object. This book develops a new approach to the mind called mental fictionalism. The key idea behind this approach is that the mind is a useful fiction. The book begins with our ordinary conception of the mind (known as folk psychology). At present, the dominant interpretation of folk psychology sees it as an attempt to describe our inner machinery (a view the author calls Cartesianism). The representational theory of mind (or representationalism) argues that our folk theory is true, and that our (...) thoughts (especially our propositional attitudes, such as beliefs and desires) are representations inside our heads. Mental fictionalism offers a new interpretation of folk psychology. According to mental fictionalism, when we attribute beliefs and desires, we do not claim that people have representations inside their heads; we merely pretend that they do. Our ordinary conception of the mind is fundamentally metaphorical: we project the ‘outer world’ of human culture (especially language) onto the ‘inner world’ of the mind. This is an enormously useful way of making sense of people and their behaviour. But we should not forget that this inner world is only a fiction. (shrink)

Mental fictionalism is the view that, even if mental states do not exist, it is useful to talk as if they do. Mental states are useful fictions. Recent philosophy of mind has seen a growing interest in mental fictionalism. To date, much of the discussion has concerned the general features of the approach. In this paper, I develop a specific form of mental fictionalism by drawing on Kendall Walton’s work on make-believe. According to the approach I propose, talk of mental (...) states is a useful pretence for describing people and their behaviour. I try to clarify and motivate this approach by comparing it to well-known alternatives, including behaviourism, instrumentalism and eliminativism. The descriptions and theoretical laws scientists write down when they model a system are often false of any real system. And yet we commonly talk as if there were objects that satisfy the scientists’ assumptions and as if we may learn about their properties. Many attempt to make sense of this by taking the scientists’ descriptions and theoretical laws to define abstract or fictional entities. In this paper, I propose an alternative account of theoretical modelling that draws upon Kendall Walton’s (...) ‘make-believe’ theory of representation in art. I argue that this account allows us to understand theoretical modelling without positing any object of which scientists’ modelling assumptions are true. (shrink)

In conclusion it is suggested that this shift in power regime is by and large responsible for the readjustment of the instituting representations of contemporary society, the de-politicization of political and social relations, and the erosion of democracy. Recent philosophy of science has seen a number of attempts to understand scientific models by looking to theories of fiction. In previous work, I have offered an account of models that draws on Kendall Walton’s ‘make-believe’ theory of art. According to this account, models function as ‘props’ in games of make-believe, like children’s dolls or toy trucks. In this paper, I assess the make-believe view through an empirical study of molecular models. I suggest that the view gains support when we (...) look at the way that these models are used and the attitude that users take towards them. Users’ interaction with molecular models suggests that they do imagine the models to be molecules, in much the same way that children imagine a doll to be a baby. Furthermore, I argue, users of molecular models imagine themselves viewing and manipulating molecules, just as children playing with a doll might imagine themselves looking at a baby or feeding it. Recognising this ‘participation’ in modelling, I suggest, points towards a new account of how models are used to learn about the world, and helps us to understand the value that scientists sometimes place on three-dimensional, physical models over other forms of representation. Modeling is central to scientific inquiry. It also depends heavily upon the imagination. In modeling, scientists seem to turn their attention away from the complexity of the real world to imagine a realm of perfect spheres, frictionless planes and perfect rational agents. Modeling poses many questions. What are models? How do they relate to the real world? Recently, a number of philosophers have addressed these questions by focusing on the role of the imagination in modeling. Some have also drawn parallels (...) between models and fiction. This chapter examines these approaches to scientific modeling and considers the challenges they face. (shrink)

The general claim advanced in this article is that Foucault’s genealogy of the modern state traces two ideal-typically different power arrangements at the origin of the modern state, roughly referred to as ‘sovereign power’ and ‘governmentality’. They are ideal-typically different in that they operate according to a different logic, including different ends, means and modi operandi. The more specific claim, then, is that due to this different logic, their ever changing interpenetration on the level of the state is imbalanced. In (...) order for ‘governmentality’ to operate according to the law, it must be backed by the juridical frameworks provided by sovereign power, but then again these juridical frameworks prove inadequate and insufficient to curb ‘governmentality’s’ operational procedures as well as the modalities and intensities of its implementation. In other words, in his genealogy of the modern state, Foucault tracks down ‘governmentality’ as a distinctive form of power which, although intertwined with the state, cannot juridically be contained by the state. It cannot be appropriately restrained by its legal regulations and, as such, constitutes an excess vis-à-vis those regulations. (shrink)

Relying on Niklas Luhmann's systems theoretical redescription of modern society, this article aims at questioning the basic theoretical notions of the ongoing inclusion/exclusion debate. The most remarkable aspect of Luhmann's reassessment of the inclusion/exclusion relationship within functionally differentiated societies is that individuals are basically situated within the exclusion domain of society, and thus cannot but partially be included within society's function systems and organizations. This reassessment not only allows Luhmann to raise fundamental questions with respect to the implicit norm of (...) full inclusion which still dominates the debate on inclusion and exclusion, but it also directs his attention to the different inclusion/exclusion conditions within function systems, organizations and interaction systems. Eventually Luhmann's position comes down to the idea that exclusion rather than inclusion is the rule, and, moreover, that inclusions differ from one another. The article closes off with a critical evaluation of Luhmann's redescription of the inclusion/exclusion debate. It is argued that systems theory might suffer from empirical deficiency, as it seems to have difficulties to detect and to depict the actual mechanisms of social exclusion without resorting to theories that are more geared to empirical reality and that are of help in observing it. Recent work in epistemology and philosophy of science has argued that understanding is an important cognitive state that philosophers should seek to analyse. This paper offers a new perspective on understanding by looking to work in philosophy of mind and cognitive science. Understanding is normally taken to be inside the head. I argue that this view is mistaken. Often, understanding is a state that criss-crosses brain, body and world. To support this claim, I draw on extended cognition, a burgeoning framework (...) in cognitive science that stresses the crucial role played by tools, material representations and the wider environment in our cognitive processes. I defend an extended view of understanding against likely objections and argue that it has important consequences for questions concerning the nature of understanding and its relationship to explanation. The evolutionary claim that the function of self-awareness lies, at least in part, in the benefits of theory of mind (TOM) regained attention in light of current findings in cognitive neuroscience, including mirror neuron research. Although certain non-human primates most likely possess mirror self-recognition skills, we claim that they lack the introspective abilities that are crucial for human-like TOM. Primate research on TOM skills such as emotional recognition, seeing versus knowing and ignorance versus knowing are discussed. Based upon current findings (...) in cognitive neuroscience, we provide evidence in favor of an introspection-based simulation theory account of human mindreading. (shrink)

The similarity view of scientific representation has recently been subjected to strong criticism. Much of this criticism has been directed against a ?naive? similarity account, which tries to explain representation solely in terms of similarity between scientific models and the world. This article examines the more sophisticated account offered by the similarity view's leading proponent, Ronald Giere. In contrast to the naive account, Giere's account appeals to the role played by the scientists using a scientific model. A similar move is (...) often made by defenders of resemblance theories of depiction, who invoke the role played by the artist, or by the viewers of a painting. In this article I look to debates over depiction to assess the difficulties facing those who wish to defend the similarity view of scientific representation. I then turn to examine Giere's account. Ultimately, I argue, this account is unsuccessful: while appealing to the role of scientists offers a promising way to defend the similarity view, Giere's own account does not capture what it is that scientists do when they use a model to represent the world. One important debate between scientific realists and constructive empiricists concerns whether we observe things using instruments. This paper offers a new perspective on the debate over instruments by looking to recent discussion in philosophy of mind and cognitive science. Realists often speak of instruments as ‘extensions’ to our senses. I ask whether the realist may strengthen her view by drawing on the extended mind thesis. Proponents of the extended mind thesis claim that cognitive processes can sometimes extend beyond our brains (...) and bodies into the environment. I suggest that the extended mind thesis offers a way to make sense of realists’ talk of instruments as extensions to the senses and that it provides the realist with a new argument against the constructive empiricist view of instruments. According to Gauchet we are living in a `society of individuals'. But a central term is missing from that formula, and not by any accident, for contemporary society has lost it from view: the term of the political. In sum, thus reads Gauchet's diagnosis, society today is haunted by a kind of individualism out of which no society can be conceived, as it obfuscates its political dimension. The aim of this article is to elaborate this diagnosis, and more specifically the (...) idea that there is no society, and therefore no individual either, without the political. In order to do so, I will explore the meaning of the formula `society of individuals'. Within the scope of this analysis, I shall primarily pay attention to the `primacy of the political' in Gauchet. To conclude, I will assess Gauchet's diagnosis, by fathoming in what sense contemporary individualism, besides being an `eclipse of the political', is also a threat to democracy. (shrink)

ABSTRACT One of the productive political-philosophical concepts Foucault developed is that of governmentality. According to Foucault, governmentality is in many respects the heir of pastoral power. However, Foucault has never conclusively demonstrated the genealogical link between pastoral power and governmentality. The hypothesis that I want to put forward is that the “missing link” in this genealogy should be situated in the governmental transformations that took place in the period of the Reformation and Counter-Reformation, more specifically in the period of the (...) “confessionalization”. To substantiate this claim, I briefly discuss the ideal-typical relationship between pastoral power and governmentality while indicating how Foucault accounts for this relationship. I then criticise his account by showing that it fails to expose the genealogical link between pastoral power and governmentality. Finally, I show how, from a genealogical point of view, the confessionalization theory makes a convincing connection between the revival of pastoral power during the Reformation and the development of a “confessional governmentality” in which religious and secular authorities intersect. Resistance as ‘Counter-conduct’. On the Usefulness of Foucault’s concept of Contre-conduite This paper intends to clarify the peculiarity of counter-conduct as a form of resistance and to examine its usefulness in our neoliberal era. In view thereof, it takes off with a general discussion of Foucault’s views of the relationship between power and resistance. Then the focus shifts more specifically to governmentality and its predecessor, pastoral power, as the specific type of power against which counter-conduct as a form of resistance (...) is directed. This investigation allows in the next step to fathom the uniqueness of counter-conduct as a peculiar form of resistance and to find out whether it is appropriate to resist neoliberal governmentality. The paper concludes by pointing out a major weakness of counter-conduct, viz. its unlikelihood to develop into forms of collective resistance. (shrink)

Over the past decades, mood enhancement effects of various drugs and neuromodulation technologies have been proclaimed. If one day highly effective methods for significantly altering and elevating one’s mood are available, it is conceivable that the demand for them will be considerable. One urgent concern will then be what role physicians should play in providing such services. The concern can be extended from literature on controversial demands for aesthetic surgery. According to Margaret Little, physicians should be aware that certain aesthetic (...) enhancement requests reflect immoral social norms and ideals. By granting such requests, she argues, doctors render themselves complicit to a collective ‘evil’. In this paper, we wish to question the extent to which physicians, psychiatrists and/or neurosurgeons should play a role as ‘moral gatekeepers’ in dealing with suspect demands and norms underlying potential desires to alter one’s mood or character. We investigate and discuss the nature and limits of physician responsibilities in reference to various hypothetical and intuitively problematic mood enhancement requests. (shrink)

Nochtans is de band tussen politiek en symboliek niet vreemd. Iedereen kent wel politieke symbolen of heeft het wel eens over symbooldossiers in de politiek. In wat volgt wil ik duidelijk maken dat dit te maken heeft met wat de politiek doet: het symboliseren van de gemeenschap.

The state of political philosophy In this article we attempt to do what is by definition impossible: providing a complete picture of the discipline of political philosophy today. We start by presenting the three thematic subfields in which most research seems to be taking place: democracy (including such topics as deliberation, representation, radical democracy, republicanism, and populism), justice (which covers such diverse topics as capabilities, intergenerational justice, and linguistic justice), and what we call the ‘postnational constellation’. This latter subfield in (...) particular is growing ever larger. The context of globalization increasingly urges political philosophers to reformulate all classical questions about democracy and justice, as is visible in discussions about global justice, governance, cosmopolitanism, federalism, or the ‘commons’. After surveying the main themes of contemporary political philosophy, we discuss a number of methodological evolutions and controversies. We look for instance at the role of intellectual-historical research; not only does the quality and the quantity of such research continue to rise, it is also well-connected to contemporary debates and clearly inspires and refines these debates. Most attention, though, is given to the ongoing confrontation between ‘normative’ political theorists and so-called ‘realists’. The former believe that political philosophers should not just contemplate social and political reality, but should also propose guidelines for the (re)design of social institutions, and should maybe even actively contribute to realizing these proposals. ‘Realists’, by contrast, believe that political philosophy, as a branch of philosophy, should aim for insight in the dynamics of political action, in human relations and motivations as they become visible in politics, and in the role of the political sphere in society. We conclude our article with a critical note on the incompleteness of our survey. (shrink)
