Technology assessment (TA) is – for several reasons – not detachable from ethical questions. The development of institutions and concepts for TA, especially in the USA and Western Europe, has been marked by an increasing tendency to focus evaluative and normative questions. In the following paper, we point out, in as far as the common notions of TA are implicitly normative, why reflection upon conceptual options of TA inevitably leads to ethical questions, and that the key question of participation necessarily (...) comes up in the context of societal decisions made under conditions of risk or uncertainty. Arrangements of participatory and discoursive TA are referred to as possible applications of discourse ethics, but there are consequences to consider, which result from discourses in TA not being ideal discourses. Concepts and performance of TA arrangements on biotechnology and gene technology in different European countries are compared, analysing what similarities and differences can be found with respect to ethical clarification. Crucial questions of how to conceptualise participatory TA (pTA) and current topics in ethics of technology are shown to coincide. A proposal is presented of how these – theoretical normative and empirical descriptive – considerations can be used in a comprehensive conception for participatory and discoursive TA. (shrink)

The concept of biodiversity has entered the law. Article intends to make the conceptual suppositions and the ethical profile of the biodiversity concept explicit. Article takes “biodiversity” as a hybrid concept located at the intersection of biological science, environmental ethics, and international conservation policies. It proceeds with sections on genealogy and definitions of the concept. Further, a matrix-scheme is construed serving the purpose to make debates on biodiversity more specific and precise. Moreover, different approaches in environmental ethics are assessed trying (...) to substantiate the conservation of biodiversity in its entirety (“all”), but mostly fail in the attempt. A “strong” sustainability approach, however, can justify the protection of many and most components. Finally, the dialectics of biodiversity is outlined. On the one hand, a method is outlined how to proceed in order to reach resonable judgements about conservation and utilization of specific components of biodiversity while, on the other hand, the philosophical dimension is taken into account. This philosophical dimension is two-fold: a) epistemology of living beings and b) biophilic existentialism. Finally, some open questions with respect to implementation of “biodiversity” into law are asked. (shrink)

The so-called structuralistic view of theory-formation is applied to the discourse-theory of normative validity in order to shed some light on the relation between the core and some basic application of discourse ethics. First, metatheoretical notions as core, model and intended paradigmatic applications will be introduced. Second, the two supreme principles of discourse ethics will be justified and a basic model will be explained. Two possibilities to define the very core of this ethical theory will be distinguished. In the following (...) section, special attention is given to three paradigmatic applications of the theory. It is argued for the moral validity of some basic norms of action including several types of moral and legal rights. The article ends up with a discussion on conceptual modifications which are due to the enlargement of the scope of discourse ethics and with some brief remarks on the state of discourse ethics being a comprehensive ethical theory. The article analyses a transdisciplinary wicked upstream–downstream conflict over water allocation in an arid region of Inner Mongolia. This conflict is about scarce water resources which can be either allocated to irrigation agriculture upstream or to preservation and restoration a rare ecosystem downstream. This conflict is located at the interface of environmental and agricultural ethics. The case study is about Heihe River, agricultural demands for irrigation in the region of Zhangye, and endangered Tugai forest at downstream Heihe in Ejina oasis. (...) Authors use a theoretical approach of environmental philosophy and rely on the concept of ‘strong sustainability’. From this background two normative yardsticks are derived: a constant natural capital rule and the overall satisfactory goodness of a river basin. Both yardsticks are not met at Heihe. Downstream, we see the endangered Tugai forest as a location which should be preserved de re. We argue for a viable institutional water saving strategy within the agricultural areas of Zhangye district by which Tugai forests at downstream Heihe might be restored. Our case study indicates that even wicked problems can find proper and prudent solutions. (shrink)

Environmental ethicists typically consider Jürgen Habermas’s theory of communicative action to exclude moral consideration for nonhuman animals. Habermas's early work indeed limits relationships with nature to instrumental ones. Yet, interspersed throughout Habermas's writings are clear indications that nonhuman life deserves moral consideration, and that humans can enter into communicative relationships with nonhumans, however asymmetrical. Habermas’s anthropocentric theoretical foundations can achieve a revised, reflective equilibrium congruent with his persistent intuitions that nonhumans also possess powers of communication (but not discourse) that would (...) grant them moral consideration, perhaps allowing us to enter into non-linguistic interspecies communicative activity. Habermasians can incorporate non-instrumental relationships with nature into discourse ethics’ set of applications without ignoring the special role of language in communication. Rather than holding that the differencia specifica between humans and nonhumans exists in communication, it makes more sense instead to displace this distinction between communicative action as a general category and the special case of discourse. Doing so permits intuitions of nonhuman moral considerability and communicative possibility without altering the discursive core of Habermas’s theory. (shrink)

On a currently popular reading of Locke, an idea represents its cause, or what God intended to be its cause. Against Martha Bolton and my former self (among others), I argue that Locke cannot hold such a view, since it sins against his epistemology and theory of abstraction. I argue that Locke is committed to a resemblance theory of representation, with the result that ideas of secondary qualities are not representations.

The article outlines the basic lines of a phenomenology of driving. The starting point is the thesis that “driving” does not occur in nature and is therefore a form of movement reserved for humans, which is linked to the invention of the wheel. This invention expanded the possibilities of mobility in technical and social terms. We argue that, on the one hand, travelling on wheels strengthens individuality and the feeling of freedom, but on the other hand it has a strong (...) socio-political component that is often ignored: Efficient driving requires a dense road network, and this only emerges as the achievement of a community. Referring back to Matthew B. Crawford’s philosophy of driving and Günther Anders’ philosophy of technology, the question of whether the “autonomous car” restricts or expands the freedom of drivers is discussed. Finally, it is shown that the concept of driving, as manifested above all in the automobile, has also had a significant influence on our concept of social progress. However, this concept has fallen into crisis due to the ecological collateral damage of combustion technology. (shrink)

Disputes over territory are a major contributing factor to the disruption of international relations. We believe that a cumulative, integrated, and continuously updated resource providing information about such disputes in an easily accessible form would be of benefit to intelligence analysts, military strategists, political scientists, and also to historians and others concerned with international disputes. We propose an ontology-based strategy for creating such a resource. The resource will contain information about territorial disputes, arguments for and against claims pertaining to sovereignty, (...) proffered evidence for such claims, political and military motives (overt or hidden), and associated conflicts. Our approach is designed to address several issues surrounding the representation of geopolitical conflict, including the tracking and individuation of disputes and the validation of disseminated information. This article seeks to show the interaction between cultural and anatomic evolution in the birth and differentiation of cultures and languages. The diversity which characterizes our world does not preclude logical regularities due to the coherence of the human mind, which evolved slowly through the paleontological phases of its emergence over millions of years. The anatomical retroaction of the hominids is analyzed to show that, in the long run, anatomy reflected ‘cultural selection’. With the anatomic evolution of man, culture became (...) a crucial component for all human beings and their anatomy simply adapted progressively to this fact. (shrink)

This article canvases the main areas of controversy: the nature of Lockean signification and his position on propositions and particles.

The idea of philosophy as a kind of therapy, though by no means standard, has been present in metaphilosophical reflection since antiquity. Diverse versions of it were also discussed and applied by more recent authors such as Wittgenstein, Hadot and Foucault. In order to develop an explicit, general and systematic model of therapeutic philosophy a relatively broad and well-structured account provided by Martha Nussbaum is subjected to analysis. The results obtained, subsequently, form a basis for a new model constructed around (...) the set of notions intrinsically connected with any, philosophical, psychological, or medical, form of therapy. The conceptual framework of: disease and its symptoms, the health ideal, the process of treatment with its techniques, therapeutic theory, physician, patient, and the physician-patient relationship is constructed and investigated in the context of its possible metaphilosophical use. An illustrative application of this scheme to philosophical therapy developed by Stoicism is, then, discussed. Finally, the issue of the therapeutic metaphilosophy's scope as well as the problem of therapeutic philosophy's specificity and integrity are briefly indicated. (shrink)

Like their contemporary counterparts, early modern philosophers find themselves in a predicament. On one hand, there are strong reasons to deny that sensations are representations. For there seems to be nothing in the world for them to represent. On the other hand, some sensory representations seem to be required for us to experience bodies. How else could one perceive the boundaries of a body, except by means of different shadings of color? I argue that Nicolas Malebranche offers an extreme -- (...) and ultimately unworkable -- attempt to solve this riddle. Most commentators claim that Malebranche defends an adverbial theory of sensation, according to which a sensation is merely a way in which an act of sensing happens. The adverbial reading is wrong, or so I argue. Once we arrive at a more accurate reading, we shall see that his position is much more strange than is currently thought. Nevertheless, Malebranche’s view is similar to the adverbial theory in one respect, albeit it at a very high level of generality. His view thus inherits two of the main problems that afflict adverbial theories. Although Malebranche fails to solve them, his ingenious attempts to do so are instructive. (shrink)
