O artigo tem por objeto o exame de três registros de gritantes e distintos paradoxos na Doutrina do Direito de Kant. Registros feitos em tempos e contextos históricos diferentes por Friedrich Bouterwek, Marcus Willaschek e Balthazar Barbosa Filho. Bouterwek atribuiu a Kant a mais paradoxal das proposições jamais enunciadas por qualquer autor, a de que a mera ideia de soberania deve obrigar-nos a obedecer como a nosso inquestionável senhor a quem quer que se haja estabelecido como tal, sem que caiba (...) indagar quem lhe deu o direito de comandar-nos. Willaschek aponta a incompatibilidade de duas teses centrais da doutrina kantiana: a do caráter externo dos vínculos jurídicos e a da incondicionalidade obrigacional do direito positivo, pois não é possível entender como é possível termo-nos como obrigados por imperativos jurídicos e, ao mesmo, vermo-nos internamente isentados do dever de obedecê-los. O ponto crítico de Balthazar é alegar que não pode haver na filosofia kantiana uma crítica da razão político e jurídica, simplesmente porque o conceito de imputação, base da normatividade própria dessas esferas, pressupõe uma pluralidade de agentes livres que, justamente, só pode ser uma pressuposição, pois nosso acesso à normatividade prática só pode ter lugar em primeira pessoa. No exame a que o artigo submete essas alegações, o artigo argumenta, em objeção à tese de Balthazar, que o caráter universal e categórico da força que vincula o sujeito quando confrontado com a lei moral em primeira pessoa necessariamente se desvaneceria se, ao mesmo tempo, ele não fosse tomado pela evidência de que a realidade objetiva dos princípios morais é não só instanciável, mas assegurada pela múltipla instanciação. Com relação às dificuldades levantadas por Willaschek e Bouterwek, o artigo argumenta que o princípio exeundum e statu naturali, enquanto norma metapositiva, anterior à divisão do domínio prático entre doutrina do direito e doutrina da virtude, permite ao mesmo tempo compreender a exigência de obediência ao poder constituído e a restrição das obrigações jurídico-políticas exclusivamente ao foro externo.AbstractThe object of the article is to examine three claims about three distinct and allegedly blatant paradoxes in Kant's Doctrine of Right. These three critical points had been made in distinct times and contexts by Friedrich Bouterwek, Marcus Willaschek e Balthazar Barbosa Filho. Bouterwek attributed to Kant the most paradoxical of all paradoxical propositions, the statement that by the mere idea of sovereignty we are obliged to obey as our lord who has imposed himself upon us, without questioning from where he got such right. Willaschek points out the incompatibility of two main theses of Kantian doctrine of right: the claims that the legal bounds are of external character and that they are the source of unconditional obligations, since it seems impossible to understand how it would be possible to be obliged by juridical norms and decisions and at the same time to be exempted of the internal duty of compliance. The radical objection of Professor Balthazar is the claim that in the context of Kantian Philosophy it is impossible to admit a critique of the juridical and political reason because the concept of imputation, ground of the normativity in these domains, requires not only the presupposition of free agents, but a true and secure epistemic access to them, which is, according to him, impossible considering that the moral law and the other practical principles are accessible for us only in the first person. In the course of the appraisal of such claims, the article contest that objection arguing that the universal and categorical force of the normative bound experienced by the subject when confronted with the moral law in the first person would ineluctably vanish if, at the same time, he had not been taken by the evidence that the objective reality of the moral principles is secured by multiple instancing. Regarding the difficulties raised by Willaschek and Bouterwek, the article argues that the principle exeundum e statu naturali, as a norm of meta-positive character, prior to the division of practical domains between the doctrine of right and the doctrine of virtue, is the cue both to the understanding of the requirement of unquestioning obedience to the constituted power and to the restriction of the validity of this requirement only in foro externo. RESUMEN Juan Marinello Vidaurreta, eminente trabajador de las letras, que no cambió la pluma por la política, sino que hizo de la política incesante gestión de creación espiritual. Vivió tres etapas decisivas de Cuba: los rezagos de la colonia española; la República mediatizada, que combatió; y el socialismo, que ayudó a consolidar. El objetivo es demostrar la confluencia del pensamiento martiano y marxista desde el análisis de la cultura en la obra de Juan Marinello Vidaurreta. Se asumió la concepción dialéctica (...) materialista como metodología general para conocer el objeto de investigación en sus antecedentes y tendencias actuales. Además permitió ampliar el conocimiento sobre el tema objeto de estudio, a través del análisis de texto, el contenido y el discurso; la crítica de fuentes posibilitó extraer inferencias a partir de la teoría preexistente y la información empírica acopiada. El pensamiento marinelliano se fue formando como resultado de la influencia del movimiento progresista cubano, del pensamiento martiano y marxista-leninista, lo más avanzado del pensamiento latinoamericano y universal. Subyace en su obra una concepción integradora y totalizadora de la cultura, de base martiana y marxista. ABSTRACT Juan Marinello Vidaurreta eminent worker of the letters that did not change the pen by the policy, but that made of the policy, incessant management of spiritual creation. He lived three decisive stages of Cuba: the lags of the Spanish colony; the mediated Republic, which fought; and socialism, which helped to consolidate. The objective is to demonstrate the confluence of Marti's and Marxist thinking from the analysis of culture in the work of Juan Marinello Vidaurreta. The dialectical materialist conception was assumed as general methodology to know the object of research in its antecedents and current trends. In addition it allowed expanding the knowledge on the subject under study, through the analysis of text, content and discourse; the critique of sources made it possible to draw inferences from the preexisting theory and the empirical information collected. Marinellian thought was formed as a result of the influence of the Cuban progressive movement, of Marti and Marxist-Leninist thought, the most advanced of Latin American and universal thought. It underlies in his work an integrative and totalizing conception of the culture, of Marti base and marxist. (shrink)

El objetivo de este artículo es explicar las características básicas de la concepción aristotélica de la continuidad sostenida a lo largo de su Física. Tal como intentaré mostrar, es imposible comprender realmente qué entiende Aristóteles por “continuidad” si no se comienza por dilucidar la particular posición que tiene la continuidad junto a otros términos, dentro del marco de su teoría física, tales como “sucesión”, contigüidad” y “contacto”. En este punto, mostraré cómo una correcta aproximación a la noción de “continuidad” exige (...) especificar la relación, así como también la diferencia, entre “continuidad” y “contigüidad”, ya que no es del todo claro cómo debemos entender esta diferencia terminológica al interior de la física aristotélica. Luego, y finalmente, mi análisis se concentrará en examinar qué afirma Aristóteles en relación a la “continuidad” propiamente tal. Éste análisis, a su vez, aborda los conceptos más importantes de la teoría aristotélica de la continuidad y aborda, a su vez, el llamado carácter operativo de la concepción aristotélica del continuum.The aim of this paper is to explain the basic characteristics of Aristotle’s theory of continuity in his treatise on Physics. As I shall try to show, it is impossible to really understand what Aristotle means by the term ‘continuity’ unless we place it context with other significant terms he uses in developing the framework of his physical theory, for example: ‘succession’, ‘contiguity’ and ‘contact’. In addition, I will explain the importance of specifying particularly both the relation and difference between the terms ‘continuity’ and ‘contiguity’, since other commentators have placed a variety of interpretations on this terminological difference. Then, and finally, my analysis will concentrate on examining what Aristotle deduces from his theory of continuity. In conclusion, this analysis goes further than any other in detailing and explaining the most important concepts of Aristotle’s theory of continuity. (shrink)

Resumen: El presente artículo revisa los usos de la figura del testigo en dos novelas chilenas de reciente publicación: La dimensión desconocida de Nona Fernández y Monte Maravilla de Miguel Lafferte, ambos relatos cuyas tramas están basadas en casos, lugares y personajes históricos reales relacionados con violaciones a los derechos humanos en Chile durante la dictadura pinochetista. En ambos casos, la figura del testigo es compleja e intrincada, ya sea porque es un victimario arrepentido, una niña que se convertirá en (...) la narradora del futuro o un fantasma que resulta ser real. De paso, y a la luz del testigo como figura articuladora común tanto para el derecho como para la literatura, el artículo quiere reflexionar acerca de las posibilidades de los procesos judiciales, en tanto narrativas, como fuentes de memoria colectiva para dar cuenta del horror. El rol del testigo resulta clave en ambos campos discursivos: mientras en los procesos judiciales el testigo es el sujeto de la enunciación del testimonio y, con ello, elemento de prueba en la determinación de responsabilidades, en la literatura el testigo tiene implicancias tanto narratológicas como éticas importantes, las que le proporcionan una riqueza al testimonio que lo vuelven una forma eficaz de memoria que más que contar lo sucedido, se acerca a mostrarlo.: This article reviews how the witness figure has been used in two chilean novels that have been recently published: La dimensión desconocida, from Nona Fernández and Monte Maravilla, from Miguel Lafferte. Both script plots are based in real cases, places and historical characters, related to Pinochet´s dictatorship. They present a complex and intrincate witness figure, through the form a regretful torturer, a girl who will be the future´s narrator or a ghost that happens to be real. Meanwhile, in light of the witness understood as an common articulating figure for the law, as well as for literature, the article wants to reflect on judicial processes posibilities, while narrative, as colective memory sources that can be held accountable for the horror. The witness role turns out to be essential in both discourse fields: meanwhile in judicial procesess the witness is the subject of the testimony enunciation and, as such, an evidence element for criminal liabilities determination, in literature, the witness has important narrative as well as ethics implications, wich give such richness to the testimony, that it becomes an effective way of memory that not only narrates what happened, it closes to show it. Para ello, aclara en primer lugar, el concepto de teoría del significado y examina las características que tiene la propuesta de Davidson. Finalmente, estudia la cuestión de si el concepto de significado que Davidson nos ofrece corresponde o no a la noción intuitiva de significado.

Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. One important limitation of the current renditions of interpretivism is that its emphasis on the moral dimension of sport has overlooked the aesthetic dimension lying at the core of this account of sport. The interpretivist’s failure to acknowledge and consider the aesthetic implicitly distances this realm from the moral. Marcia Muelder Eaton calls this distancing the separatist mistake. This paper argues that interpretivism presupposes not only moral but also aesthetic principles and values. What it sets out to demonstrate is that (...) interpretivism is an integralist, or nonseparatist, account of sport, one in which ethical and aesthetic values are not exclusive. Making explicit and specifying interpretivism’s combined moral-aesthetic approach to sport not only helps to better distinguish the whole range of values that make up sport as well as their interconnection but also encourages sportspeople to pursue more coherent sport and, thus, more enriching lives.
