How do technically-skilled women negotiate the male-dominated environments of technology firms? This article draws upon interviews with female programmers, technical writers, and engineers of diverse racial backgrounds and sexual orientations employed in the San Francisco tech industry. Using intersectional analysis, this study finds that racially dominant women, who identified as LGBTQ and presented as gender-fluid, reported a greater sense of belonging in their workplace. They are perceived as more competent by male colleagues and avoided microaggressions that were routine among conventionally (...) feminine, heterosexual women. We argue that a spectrum of belonging operates in these occupational spaces dominated by men. Although white and Asian women successfully navigated workplace hostilities by distancing themselves from conventional heterosexual femininity, this strategy reinforces inequality regimes that privilege male workers. These findings provide significant theoretical insights about how race, sexuality, and gender interact to reproduce structural inequalities in the new economy. (shrink)

In the sociology of the body, the analysis of physiognomy is a neglected topic. The idea that one can judge the character of another from their facial or bodily characteristics is a pervasive phenomenon. However, its historical and cultural spread does not entail that we inevitably tie it to notions of human essence. This study focuses upon a particular periodic resurgence of physiognomic discourse in the West, at the end of the 18th and the entirety of the 19th century. In (...) contrast to previous arguments, I argue that physiognomic discourse was able to exploit 19th-century phrenology as a conduit for its own perpetuation. I point out that the perception of the other that physiognomy promotes is largely based upon an atemporal view of the body. I suggest that this physiognomic perception remains an entrenched but changeable component in contemporary relations between self and other. (shrink)

This paper seeks to respond to some of the recent criticisms directed toward bioethics by offering a contribution to a “critical bioethics”. Here this concept is principally defined in terms of the three features of interdisciplinarity, self-reflexivity and the avoidance of uncritical complicity. In a partial reclamation of the ideas of V.R. Potter, it is argued that a critical bioethics requires a meaningful challenge to culture/nature dualism, expressed in bioethics as the distinction between medical ethics and ecological ethics. Such a (...) contesting of the “bio” in bioethics arrests its ethical bracketing of environmental and animal ethics. Taken together, the triadic definition of a critical bioethics offered here provides a potential framework with which to fend off critiques of commercial capture or of being “too close to science” commonly directed toward bioethics. How may emergent biotechnologies impact upon our relations with other animals? To what extent are any changes indicative of new relations between society and nature? This paper critically explores which sociological tools can contribute to an understanding of the technologisation of animal bodies. By drawing upon interview data with animal scientists I argue that such technologies are being partly shaped by broader changes in agriculture. The complexity of genomics trajectories in animal science is partly fashioned through the deligitimisation of the (...) productivist paradigm but continue to sit in tension around particular conceptions of sustainability in farm animal production.In spite of this deligitimisation process genomics is now being framed in the context of a new productivism (termed the livestock revolution) bound up in projected global changes in animal consumption during the first half of the 21st century. This potentially jars against both social trends that seek to re-enchant animal life and sustainability discourses which include social and environmental contexts. Nevertheless the possibility of a new productivism is supported by various interconnected trends including the emergence of a discourse of the 'bioeconomy' and a liberal regulatory apparatus for farm animal breeding technologies. Ultimately an understanding of the possibility of emerging new bio-capitalisations on animal life should be set in a broader context of competing agricultural paradigms as well as ongoing tensions over 'naturalness' in human/animal relations. Drawing upon a concept of ‘critical bioethics’ [7] this paper takes a species-broad approach to the social and ethical aspects of enhancement. Critical Bioethics aims to foreground interdisciplinarity, socio-political dimensions, as well as reflexivity to what becomes bioethical subject matter. This paper focuses upon the latter component and uses the example of animal enhancement as a way to think about both enhancement generally, and bioethics. It constructs several arguments for including animal enhancement as a part of enhancement debates, and considers (...) some connections between human and animal enhancement. The paper concludes in a plea for an ‘enhancement’ to our critical abilities to examine some of the underlying social, moral and ethical assumptions bound up in varied anticipated ‘enhanced’ futures. This article examines Swedish migrant women to the United States. It asks how racially privileged European migrants adapt to US racial and gender hierarchies that require them to relinquish their economic security and gender autonomy in a neoliberal state? Drawing upon interviews and focus group discussions with 33 Swedish women and three of their spouses, and participant observation between 2006 and 2008 in a network for Swedish speaking women living in the US, the article discusses how a group of ‘white’ (...) migrant women who arrive in the US with an ideology of gender egalitarianism negotiate a more socially conservative and economically vulnerable lifestyle, as the wives of upper-middle-class men. The article argues that while Swedish women benefit from their racial and social privileges in the US they lose their sense of economic security, acquiring new anxieties that make them reluctant to renounce their Swedish citizenship which they conceive of as a ‘flexible’ resource. It takes a long time for a man to learn to transfer a principle of morality which he fully recognizes in one field to another field of slightly different location and character, particularly if the application of strict morality in the new field is going to hurt his personal interest. I remember a story of a country court in a warranty case which furnishes an instance in point. One man had sold another a cow, and had represented that cow as possessing certain good qualities--adding, however, that he did not warrant her. The cow proved not to possess the qualities alleged, and the buyer sought to recover the purchase-money. As there was no dispute about the facts, the plaintiff's attorney thought that he had an easy case; for it is a well-established principle of law that a disclaimer of warranty in such a sale does not protect the transaction from the taint of fraud, if the matters in question were ones which the seller really could know and the buyer could not. He showed a sufficient number of legal precedents to illustrate this principle, but was somewhat dumbfounded when the opposing lawyer rose and said: "May it please the court, every one of the cases cited by my learned brother is a horse case. In this paper I revisit previous critiques that I have made of much, though by no means all, bioethical discourse. These pertain to faithfulness to dualistic ontology, a taken-for-granted normative anthropocentrism, and the exclusion of a consideration of how political economy shapes the conditions for bioethical discourse (Twine Medicine, Health Care and Philosophy 8(3):285-295, 2005; International Journal of Sociology of Agriculture and Food 16(3):1-18, 2007, 2010). Part of my argument around bioethical dualist ontology is to critique the assumption of a (...) division between the “medical” (human) and “agricultural” (nonhuman) and to show various ways in which they are interrelated. I deepen this analysis with a focus on transnational pharmaceutical companies, with specific attention to their role in enhancing agricultural production through animal drug administration. I employ the topical case of antibiotics in order to speak to current debates in not only the interdisciplinary field of bioethics but also that of animal studies. More generally, the animal-industrial complex (Twine Journal for Critical Animal Studies 10(1):12-39, 2012) is underlined as a highly relevant bioethical object that deserves more conceptual and empirical attention. Review of Dawid, Twining & Vasileki 'Evidence, Inference and Inquiry' (2011).

Law's Ethical, Global and Theoretical Contexts examines William Twining's principal contributions to law and jurisprudence in the context of three issues which will receive significant scholarly attention over the coming decades. Part I explores human rights, including torture, the role of evidence in human rights cases, the emerging discourse on 'traditional values', the relevance of 'Southern voices' to human rights debates, and the relationship between human rights and peace agreements. Part II assesses the impact of globalization through the lenses (...) of sociology and comparative constitutionalism, and features an analysis of the development of pluralistic ideas of law in the context of privatization. Finally, Part III addresses issues of legal theory, including whether global legal pluralism needs a concept of law, the importance of context in legal interpretation, the effect of increasing digitalization on legal theory, and the utility of feminist and postmodern approaches to globalization and legal theory. In his later writings, William Twining has been developing the notion of general jurisprudence, the aim of which is to integrate all theoretical approaches to law in a coherent whole. Central to the undertaking is the relationship between analytical jurisprudence and empirical evidence. Twining is critical of analytical jurisprudence for not adequately taking account of empirical evidence. While he has established a suitable framework within which to develop general jurisprudence, the argument in this essay is that the social (...) understanding of law, which is an essential part of general jurisprudence, cannot be achieved by starting with analytical jurisprudence, but needs to be approached through the methodology of interpretive social theory along the lines advanced by Max Weber. This approach has two main advantages: it enables the social understanding of law to be fully integrated into general jurisprudence, and it shows how analytical jurisprudence, rather than being in opposition to social understanding, can contribute to it. This work is an essay in Peirce's epistemology, with about an equal emphasis on the "epistemology" as on the "Peirce's." In other words our intention has not been to write exclusively a piece of Peirce scholarshiJ> hence, the reader will find no elaborate tying in of Peirce's epistemology to other portions of his thought, no great emphasis on the chronology of his thought, etc. Peirce scholarship is a painstaking business. His mind was Labyrinthine, his terminology intricate, and his writings are, (...) as he himself confessed, "a snarl of twine." This book rather is intended perhaps even primarily as an essay in epistemology, taking Peirce's as the focal point. The book thus addresses a general philosophical audience and bears as much on the wider issue as on the man. I hope therefore that readers will give their critical attention to the problem of knowledge and the sugges tions we have developed around that problem and will not look here in the hope of finding an exhaustive piece of Peirce scholarship. The path of those who would approach the study of Bentham's writings on Evidence has been considerably smoothed by the recent publication of William Twining's work on the evidence theories of Bentham and Wigmore. The material on evidence is now being tackled by the Bentham Project. It presents no easy task. The central core, The Rationale of Judicial Evidence, edited and published by John Stuart Mill in 1827, exists only in the printed version, the MSS from which Mill worked (...) having disappeared. But a substantial body of related material which survives has yet to be thoroughly investigated, though William Twining has made a gallant start. A new edition of the work hitherto known as ‘An Introductory View of the Rationale of Evidence’, first printed in full in the Bowring edition of the Works of Jeremy Bentham is in preparation. The first fruits of this endeavour is that the title of that work as it should appear in due course in the new Collected Works will be Introduction to the Rationale of Evidence: An Introductory View for the Use of Lawyers as well as Non-lawyers, the title in fact given to the work by Bentham. It is intended that what follows should similarly be of use to non-lawyers as well as lawyers. (shrink)

The paper focuses on the character of the literary and contends that if, instead of accepting the legitimacy of the question “what is literature?” and trying to answer it, one were to subject the question itself to a critical scrutiny—i.e. in order to lay bare what the question presupposes about the literary—it becomes obvious that any attempt to answer the question by uncritically accepting the legitimacy of the puzzle it puts forward can only give rise to contradictions. For the question (...) requires and presupposes for an answer an ontologically independent foundation, and the latter, given its immutability, requires the positing of a reality/representation disjunction—where the latter of the pair permits of and accommodates the experience of change—thereby ensuring that representation, too, requires a foundation, which, due to the impossibility of a foundation being the foundation of its other, that is, mutability, ends up undermining the very possibility of a disjunction, and, hence, the coherence of the foundationalist enterprise. Given that the problem of incoherence is bound to recur in all attempts to explain the literary in a foundationalist framework and given that the logic of foundationalism is one with the logic of nihilism—for the incoherence necessitates the denial of the possibility of literature—a release from the contradictions and a reinstatement of the reality of literature can come about only if one is awakened to the incoherence of the foundationalist undertaking. The resulting turn away from foundationalist thinking to differential thinking—where the incoherence of the demand for coherence is grasped and the reality of time reinstated—sheds light on the twining of the destinies of the literary and the philosophical: if philosophy as differential thinking awakens us to the displacement of being in the flow of time, literature sets into work the displacement of meaning in the functioning of language. This confirms that not only are the attempts to unearth a ground for the literary a mistake, but denying the reality of the literary event—i.e. upon failing to find a ground—is equally a mistake. Amajor shift in critical attitudes toward the arts took place in the eighteenth century. The fine arts were now looked upon as a group, divorced from the sciences and governed by their own rules. The century abounded with treatises that sought to establish the overriding principles that differentiate art from other walks of life as well as the principles that differentiate them from each other. This burst of scholarly activity resulted in the incorporation of aesthetics among the classic branches of (...) philosophy, heralding the cognitive turn in epistemology. Among the writings that initiated this turn, none were more important than the British contribution. The Arts in Mind brings together an annotated selection of these key texts. It is important to know as precisely as possible when a human being comes into existence. This can occur in ordinary circumstances after sexual intercourse. It can also occur in a nonsexual manner by various types of cloning and genetic engineering techniques and in naturally occurring monozygotic identical twining in vivo. Many scientists and physicians, in an effort to avoid being accused of abuse of human embryos in their research and in the practice of abortion, have falsified the facts (...) about human conception for many years throughout the world, creating moral confusion and error. Bhakti has been an all-pervasive concept in the philosophical and religious traditions of India. The origin of bhakti can be traced in the Vedas wherein the root-word bhaj and various synonyms appear and in that point in time no distinction was made between secular and religious love. Narada Bhakti Sutra is a premier treatise on the nature of bhakti that emphasizes the connection between bhakti and prema and treats the age-old enigma about the nature of love in an original fashion. (...) NBS has usually been interpreted in a theistic manner, often with theistic interpolations into the text. This paper interprets NBS with a philosophical approach to discover its unique insights on the perennial philosophical issue, namely, 'what is love?' and shows that NBS harks back to the age of the Vedas in which secular love and religious love were inter-twined. During the Twentieth century, Tocqueville has been presented as the «oracle» of democracy, shown by him in De la Démocratie en Amérique as a system shaped up by the constant pressure of the égalité's principle. In recent years, however, a new image of this author is presented by many scholars, following above all the analysis of his writings on the Algerian colonization. Commonly interpreted as marginal, this section of Tocqueville's theoretical work is instead discussed here as a tool to redefine (...) his pivotal concepts of equality and democracy. The article is developed discarding an interpretation of Algerian production as, alternatively, Tocqueville's exception or his truth. In the absence of comprehensive immigration reform at the federal level, many American states and localities are undertaking their own legal reforms. The new state and local laws have been challenged by immigrant-rights organizations and individuals on the grounds that the federal government has already pre-empted the field. The lawsuits bring a new narrative voice—that of judges—into the boiling U.S. immigration debate. Judges engage the controversy over local enforcement of immigration enforcement, as they have other contentious disputes, both as pragmatic (...) decision-makers and as spokespersons for justice. The tensions this dual role entails are explored here in the context of a single, controversial case. Close-up analysis of the judge’s narrative strategy reveals a range of specific techniques to create moral distance from a decision, combined, ironically, with the enlistment of moral themes to justify the ruling. The inter-twining of rule-of-law and justice rhetoric mirrors and also shapes a broader politics of justice in the United States. (shrink)

A carpet vendor has to measure her customer's living room for some new broadloom. She has forgotten her tape measure, but does have a meterstick. She lays the meterstick on the floor, snug up against the wall, with the left edge of the stick in one corner of the room. She then makes a pencil mark at the right edge. Next she shifts the stick right until the left edge of the stick is at her mark, and again marks the (...) right edge. She does this three times, but then finds that less than a full length remains to be measured. She turns the stick around so that the zero is now at the right side and lays it in the right corner and notes that her last pencil mark is at 70 cm. She concludes that the wall she is measuring is 3.7 meters in length. She then measures the opposite wall and concludes that it, too, is 3.7 meters in length. She then repeats the process for the remaining two opposite walls, and finds that they each measure 4.1 meters. To see if the room is rectangular, she runs a piece of twine from one corner to its opposite, pulls the twine taut and then cuts it to fit exactly. The last decade has witnessed a particularly intensive debate over methodological issues in legal theory. The publication of Julie Dickson's Evaluation and Legal Theory (2001) was significant, as were collective returns to H.L.A. Hart's 'Postscript' to The Concept of Law. While influential articles have been written in disparate journals, no single collection of the most important papers exists. This volume - the first in a three volume series - aims not only to fill that gap but also propose a systematic (...) agenda for future work.
