This article addresses the boundaries of law and historiography in scrutinizing some rarely analyzed aspects of the works of Reinhart Koselleck. The article studies the significance of the tradition of ‘politico-juridical’ concepts in Koselleck’s thought, by tracing the intellectual history and biographies of some notable legal historians that for the large part defined the legal historical discourse after the Second World War. It is argued that a research of the connections between Koselleck and these legal historians provides an insight into (...) the themes of the temporality of law and the universality of legal concepts in Koselleck’s articles. In contextualizing the thinking and texts of Reinhart Koselleck, this article benefits from previously unused primary sources and illuminates the reference group and intellectual atmosphere in which Koselleck worked in and around 1968. I present a formal theory of the logic and aboutness of imagination. Aboutness is understood as the relation between meaningful items and what they concern, as per Yablo and Fine’s works on the notion. Imagination is understood as per Chalmers’ positive conceivability: the intentional state of a subject who conceives that p by imagining a situation—a configuration of objects and properties—verifying p. So far aboutness theory has been developed mainly for linguistic representation, but it is natural to extend it to (...) intentional states. The proposed framework combines a modal semantics with a mereology of contents: imagination operators are understood as variably strict quantifiers over worlds with a content-preservation constraint. We need to understand the impossible. Francesco Berto and Mark Jago start by considering what the concepts of meaning, information, knowledge, belief, fiction, conditionality, and counterfactual supposition have in common. They are all concepts which divide the world up more finely than logic does. Logically equivalent sentences may carry different meanings and information and may differ in how they're believed. Fictions can be inconsistent yet meaningful. We can suppose impossible things without collapsing into total incoherence. Yet for the leading philosophical (...) theories of meaning, these phenomena are an unfathomable mystery. To understand these concepts, we need a metaphysical, logical, and conceptual grasp of situations that could not possibly exist: Impossible Worlds. This book discusses the metaphysics of impossible worlds and applies the concept to a range of central topics and open issues in logic, semantics, and philosophy. It considers problems in the logic of knowledge, the meaning of alternative logics, models of imagination and mental simulation, the theory of information, truth in fiction, the meaning of conditional statements, and reasoning about the impossible. Brentanos Reflexionen über das Verhältnis von Wahrheit und Evidenz wurden erst 1930 herausgegeben. Ihre Kenntnis ist unentbehrlich für das Verständnis seines Verhältnisses zu den an ihn anknüpfenden Denkern, insbesondere zu Husserl.

While ordinary decision theory focuses on empirical uncertainty, real decision-makers also face normative uncertainty: uncertainty about value itself. From a purely formal perspective, normative uncertainty is comparable to (Harsanyian or Rawlsian) identity uncertainty in the 'original position', where one's future values are unknown. A comprehensive decision theory must address twofold uncertainty -- normative and empirical. We present a simple model of twofold uncertainty, and show that the most popular decision principle -- maximising expected value (`Expectationalism') -- has different formulations, namely (...) Ex-Ante Expectationalism, Ex-Post Expectationalism, and hybrid theories. These alternative theories recommend different decisions, reasoning modes, and attitudes to risk. The methodology used were: Heideggeran Phenomenology, Semi- structured Interview Guide, Interpretative Phenomenological Analysis (IPA) by van Kaam and modified by Moustakas. The question I am addressing in this paper is the following: how is it possible to empirically test, or confirm, counterfactuals? After motivating this question in Section 1, I will look at two approaches to counterfactuals, and at how counterfactuals can be empirically tested, or confirmed, if at all, on these accounts in Section 2. I will then digress into the philosophy of probability in Section 3. The reason for this digression is that I want to use the way observable (...) absolute and relative frequencies, two empirical notions, are used to empirically test, or confirm, hypotheses about objective chances, a metaphysical notion, as a role-model. Specifically, I want to use this probabilistic account of the testing of chance hypotheses as a role-model for the account of the testing of counterfactuals, another metaphysical notion, that I will present in Sections 4 to 8. I will conclude by comparing my proposal to one non-probabilistic and one probabilistic alternative in Section 9. (shrink)

This note is a sequel to Huber. It is shown that obeying a normative principle relating counterfactual conditionals and conditional beliefs, viz. the royal rule, is a necessary and sufficient means to attaining a cognitive end that relates true beliefs in purely factual, non-modal propositions and true beliefs in purely modal propositions. Along the way I will sketch my idealism about alethic or metaphysical modality.

In this brief note I show how to model conceptual change, logical learning, and revision of one's beliefs in response to conditional information such as indicative conditionals that do not express propositions.

Kroedel has proposed a new solution, the permissibility solution, to the lottery paradox. The lottery paradox results from the Lockean thesis according to which one ought to believe a proposition just in case one’s degree of belief in it is sufficiently high. The permissibility solution replaces the Lockean thesis by the permissibility thesis according to which one is permitted to believe a proposition if one’s degree of belief in it is sufficiently high. This note shows that the epistemology of belief (...) that results from the permissibility thesis and the epistemology of degrees of belief is empty in the sense that one need not believe anything, even if one’s degrees of belief are maximally bold. Since this result can also be achieved by simply dropping the Lockean thesis, or by replacing it with principles that are logically stronger than the permissibility thesis, the question arises what the permissibility solution is a solution of. The combination of Fuzzy Logics and Description Logics has been investigated for at least two decades because such fuzzy DLs can be used to formalize imprecise concepts. In particular, tableau algorithms for crisp Description Logics have been extended to reason also with their fuzzy counterparts. It has turned out, however, that in the presence of general concept inclusion axioms this extension is less straightforward than thought. In fact, a number of tableau algorithms claimed to deal correctly with fuzzy DLs with (...) GCIs have recently been shown to be incorrect. In this paper, we concentrate on fuzzy \, the fuzzy extension of the well-known DL \. We present a terminating, sound, and complete tableau algorithm for fuzzy \ with arbitrary continuous t-norms. Unfortunately, in the presence of GCIs, this algorithm does not yield a decision procedure for consistency of fuzzy \ ontologies since it uses as a sub-procedure a solvability test for a finitely represented, but possibly infinite, system of inequations over the real interval [0,1], which are built using the t-norm. In general, it is not clear whether this solvability problem is decidable for such infinite systems of inequations. This may depend on the specific t-norm used. In fact, we also show in this paper that consistency of fuzzy \ ontologies with GCIs is undecidable for the product t-norm. This implies, of course, that for the infinite systems of inequations produced by the tableau algorithm for fuzzy \ with product t-norm, solvability is in general undecidable. We also give a brief overview of recently obtained decidability results for fuzzy \ w.r.t. other t-norms. (shrink)

The concept of autonomy is of crucial importance not only for philosophical but also for theological ethics. Referring to the contemporary debate on the universality or particularity of moral judgments the idea of universal moral principles is defended by reconstructing the fundamental similarities between J. Rawls's liberal theory of social justice and Aquinas's understanding of natural law. Despite this plea for a cognitivist approach in normative ethics and a strong concept of practical reason the communitarian movement has to be taken (...) seriously especially from a theological perspective. As both the concepts of happiness or human fulfillment and that of virtue need to be rehabilitated in post-Kantian ethics communitarianism could help us to overcome a too narrow and therefore partly blind understanding of moral theory.
