The article starts from an examination of the authorship of the ‘Geleitwort’, the programmatic statement which appeared in the Archiv für Sozialwissenschaft when it came under new editors in 1904. Recently scholars have begun to view it as an important text by Max Weber recovered from obscurity, but this is a mistake. Examination of major contemporary works by Weber and Werner Sombart – the obvious co-author – as well as the first public disclosure of an entirely new MS. by Weber, (...) show that in all probability the text was drafted by Sombart and then revised fairly lightly by Weber. This story of a combined, if unequal, authorship leads into two broader seams of intellectual history: the relationship between Weber and Sombart, and the history of the Archiv as a journal. An unusual starting point thus casts fresh and unexpected light on some of the most central figures and episodes in German social science at the beginning of the 20th century, not least Weber's seminal essay on “Objectivity” in social science. ☆ This paper relies on intellectual interchange and the generosity of colleagues to a quite unusual degree. This collection of more than two hundred of Nietzsche's letters offers a representative body of correspondence on subjects of main concern to him--philosophy, history, morals, music and literature. Also included are letters of biographical interest which, in Middleton's words, mark the stresses and turnings of his life. Among the addressees are Richard Wagner, Erwin Rohde, Jacob Burkhardt, Lou Salome, his mother, and his sister Elisabeth. The annihilating split in Nietzsche's personality that has been associated with his collapse on a street (...) in Turin in 1889 is described in a moving letter from Franz Overbeck which forms the Epilogue. As is shown in the introduction of the book, the notion "illocutionary act" is used with quite a number of essentially different meanings; consequently, it is quite unclear what an "illocutionary act" is actually supposed to be. This problem is the starting point of the thesis. An argument is stated, to the effect that the introduction and use of scholarly terms like, for instance, "illocutionary act", or "performative sentence", is not entirely arbitrary. It is argued that technical terms should not (...) be re-defined without a reason, but in the absence of reasons to the contrary should be used in the way in which they have originally been introduced. This argument is applied to the notion "illocutionary act". John L. Austin is the one who introduced this notion. Consequently, his conception of these acts should be adopted unless there are good reasons to the contrary. Therefore the book provides a detailed analysis of Austin's account, and his original conception of these acts is reconstructed. The most popular alternative account of "illocutionary acts" is John R. Searle's. Therefore, secondly, the book provides an analysis of Searle's famous account of "illocutionary acts" - the first really detailed one available, including Searle's own work. It is shown that what Searle presents is in fact extremely sketchy, and can certainly not be viewed, as it often is, as an elaborated theory. It is further argued that the fundamental assumptions about language which Searle intends to illustrate with his account of "illocutionary acts" are mistaken, so that in general a theory following the lines Searle suggests is doomed to failure. Finally it is shown that Searle's account of "illocutionary acts", as far as it goes, is not an adequate adoption of the conception Austin introduced. Hence Searle's account is no reasonable alternative to Austin's account. (shrink)

That certain paper bills have monetary value, that Vladimir Putin is the president of Russia, and that Prince Philip is the husband of Queen Elizabeth II: such facts are commonly called ‘institutional facts’. IFF are, by definition, facts that exist by virtue of collective recognition. The standard view or tacit belief is that such facts really exist. In this paper we argue, however, that they really do not—they really are just well-established illusions. We confront realism about IFF with six criteria (...) of existence, three established and three less so but highly intuitive. We argue that they all tell against the existence of IFF. An obvious objection to IFF non-realism is that since people’s behaviour clearly reflects the existence of IFF, denying their existence leaves an explanatory gap. We reject this argument by introducing a variant of the so-called ‘Thomas Theorem,’ which says that when people collectively recognize a fact as existing, they largely behave accordingly, regardless of whether that fact really exists or not. Der vorliegende Sammelband widmet sich einem Thema der Sprachphilosophie: den Grenzen der Sprache. Die Begrenztheit des Sprechens, das Versagen der Sprache und das Schweigen sind Bereiche, denen das Interesse dieses Buches gilt. Groß e Bedeutung gewinnt deshalb die Frage, in welchem Sinne und ob überhaupt von einem Jenseits der Sprache gesprochen werden kann. Dabei steht das Verhältnis von Immanenz und Transzendenz im Mittelpunkt. Das Unnennbare, Unaussagbare, das Unheimliche, das hinter dem Rücken des Sprechenden lauert, ist der Sprache selbst transzendent. Trotzdem (...) gelingt es, das Transzendente sprachlich einzuholen. Es ist der Sprache immanent: ein immanentes Transzendentes. Darin scheint sich eine Potenz der Sprache anzudeuten, selbst darüber zu sprechen, worüber man nicht sprechen und gleichwohl nicht schweigen kann. Kaum ein Thema der Sprachphilosophie eignet sich daher mehr für einen interdisziplinären Band als gerade dieses. Es ist nicht nur Gegenstand der Philosophie, sondern verweist auf und korrespondiert mit wichtigen Forschungsrichtungen aus der Wissenschaftstheorie, der Theologie, der Sprachwissenschaften, der Germanistik, der Ästhetik, der Musikwissenschaften, der Wirtschaftswissenschaften, der Soziologie und Ethnologie und schließlich auch der Medizin. Überwindet Technik das unheimlich Unbeherrschbare? Oder wird sie uns selbst unheimlich? Zwei scheinbar widersprüchliche Narrative prägen die Geschichte und auch die Theorie der Technik: Das Narrativ der Entzauberung beschreibt, wie eine als fremd und gefährlich erfahrene Natur durch Verwissenschaftlichung und Technisierung gezähmt wurde. Das Narrativ der Verzauberung schildert, wie uns Artefakte und technologische Möglichkeiten unheimlich werden, insbesondere wenn sie sich zu verselbständigen scheinen oder mit „autonomem“ Eigensinn gegenübertreten. In den heutigen Debatten um selbstlernende, ubiquitär verteilte, im Assistenzmodus unsichtbare, dabei opake (...) Techniken schwingt das unheimliche Moment einer „Verselbständigung“ von Technik mit – und trägt im Anschluss an die Mechanisierungs- und Automatisierungsdiskurse des 20. Jahrhunderts zur „Dämonisierung“ der Technik bei. Technik macht Welt einerseits vertraut und nachvollziehbar: Paradigmatisch wird dies in der Idee, dass etwas dann verstanden wird, wenn es technisch rekonstruiert werden kann. Andererseits wird die technische Reproduktion von Welt – oder deren radikale Umgestaltung zu einer entfremdeten – als etwas Verstörendes erlebt. Spätestens, wenn Artefakte zu tun scheinen, „was sie wollen“ oder technische Großsysteme die Lebenswelt nach ihren „Eigenlogiken“ prägen, ist eine schon von Freud benannte Grenze erreicht, an der wir verunsichert werden, ob wir überhaupt noch in der modernen Welt leben. The original definition of a technical term, the paper argues, should not be altered without a good reason. This notion is applied to the conception of illocutionary acts suggested by Alston, which markedly differs from the conception originally introduced by John L. Austin. Alston appears to agree with the argument; at least, he does attempt to justify his re-definition. The paper argues, however, that the reasons he gives fail.

Gricean communication is communication between utterers and their audiences, where the utterer means something and the audience understands what is meant. The weak transmission idea is that, whenever such communication takes place, there is something which is transmitted from utterer to audience; the strong transmission idea adds that what is transmitted is nothing else than what is communicated. We try to salvage these ideas from a seemingly forceful attack by Wayne Davis. Davis attaches too much significance to the surface structure (...) of sentences of the type ‘S communicates the belief (desire …) that p to A’ by assuming that the communicated entity is denoted by the grammatical object following ‘communicates’. On our proposal, what is communicated in all Gricean cases is a thought. And since S communicates the thought that p to A only if S means that p and A understands what S means, the thought that p will be transmitted from S to A. (shrink)

The idea motivating their account, Cappelen and Lepore (C&L) say in Insensitive Semantics (2005), is that semantic content is context invariant, and that all colleagues who take, or even consider, different accounts are just on the wrong track. It is the purpose of their book to disprove all alternative accounts by way of an argument ‘by elimination’. The conclusion they arrive at is that their own account must be accepted by everyone as the only game in town at the end (...) of the day . The present paper is intended to examine this conclusion; its more significant findings are these. Firstly, C&L’s account is not, as they suggest, strictly minimalist, but in fact just a moderate version of contextualism. Secondly, prematurely associating semantical incompleteness and context sensitivity, they overlook some possible alternatives to their own view, among them at least one that is attractive. Thirdly, their argument ‘by elimination’ has an inductive structure, but is inexhaustive, and therefore inconclusive. Fourthly, for several different reasons, their attempts to reject arguments in favour of semantical incompleteness do not work. Finally, their contention that arguments in favour of semantical incompleteness employ metaphysical premisses for semantical conclusions rests on a faulty interpretation of these arguments. In the light of these findings, it is concluded that the central argument of Insensitive Semantics fails. (shrink)

The Speech act models of Searle and Bach/Hamish mistakenly reconstruct Austin's concept of "illocutionary act". In Austin's view, "illocutionary acts" are not pure acts of communication but social acts achieved by communicative behavior. Following Searle's "Speech Acts" and Strawson's "Intention and Convention in Speech Acts" today's speech act theory looks upon illocutionary acts as pure acts of communication, involving "conventionality" (in a certain sense) only as part of speaker's meaning. However, following Austin, to perform an illocutionary act is to bring (...) about conventional consequences which are not adequately dealt with in the speech act models of Searle and Bach/Hamish. Even telling the time necessitates technologies relating to measuring and counting. Technological developments have changed the temporal state of our reality. Key terms such as deceleration, synchronisation, prevention and de-temporalisation point to relevant problem areas in this respect. The directionality of space-number association (SNA) is shaped by cultural experiences. It usually follows the culturally dominant reading direction. Smaller numbers are generally associated with the starting side for reading (left side in Western cultures), while larger numbers are associated with the right endpoint side. However, SNAs consistent with cultural reading directions are present before children can actually read and write. Therefore, these SNAs cannot only be shaped by the direction of children’s own reading/writing behavior. We propose six distinct processes (...) – one biological and five cultural/educational – underlying directional SNAs before formal reading acquisition: (i) Brain lateralization, (ii) Monitoring adult reading behavior, (iii) Pretend reading and writing, and rudimentary reading and writing skills, (iv) Dominant attentional directional preferences in a society, not directly related to reading direction, (v) Direct spatial-numerical learning, (vi) Other spatial-directional processes independent of reading direction. In this mini-review, we will differentiate between these processes, elaborate when in development they might emerge, discuss how they may create the SNAs observed in preliterate children and propose how they can be studied in the future. Would this form of Christianity, rooted in the tradition of the Lutheran Reformation, be superseded by the Enlightenment if literary, historical and religious-philosophical criticism of the Bible were now allowed? The author argues the following hypothesis: the medical clinic is an experimental practice, in the sense given to this term by Claude Bernard, and the clinic is its specific laboratory. Its object is not the disease, but the patient. Careful examination of the clinic attests to its very close proximity to the experimental method, and the comparison also raises a number of difficulties. The main obstacle arises from the specificity of medicine, which involves treating individual human subjects whose words cannot (...) be suppressed. Spiel und Arbeit gelten oft als Gegensätze: Das Spiel als freie Betätigung menschlicher Vermögen, die Arbeit als deren Subordination unter einen äußeren Zweck. Die Festlegung des Spiels auf konsequenzlose Wiederholbarkeit hat ihm den Ruf des Unernsten eingetragen, während das Abzwecken der Arbeit auf die Nützlichkeit ihres Resultats im Bund mit der Sorge ums Dasein steht. Auf einen zweiten Blick scheint dieser Gegensatz jedoch, gerade in den hochentwickeltsten Ausprägungen beider Tätigkeitsformen, zu verschwinden. So kann eine hochgradige Rationalisierung von Spielpraktiken in Arbeit (...) umschlagen, wie etwa im Leistungssport, oder ein komplexer Arbeitsvorgang selbstzweckhafte Momente und Eigendynamiken gewinnen, die ihm Spielcharakter verleihen. Auch andere technologische Entwicklungen geben Anlass dazu, das Verhältnis von Spiel und Arbeit noch einmal grundsätzlich zu bedenken, etwa im Hinblick auf: adaptive Systeme in der Robotik, serious games, Kreativitätstechniken in Unternehmenskulturen, wissenschaftliche Experimentalanordnungen, Online-Rollenspiele oder die Kommodifizierung nicht-zweckrationaler Lebensvollzüge, die traditionell vom Begriff produktiver Arbeit ausgeschlossen waren – einschließlich der Spielräume, die durch neue Umwelt- und Biotechniken erschlossen werden. Unter der Leitdifferenz „Steuern – Regeln“ werden in der herkömmlichen Technikphilosophie die beiden Operationsmodi „klassischer“ Technik gefasst und beschrieben. Dies geschieht in zweierlei Hinsicht: zum einen in der Absicht, die sich seit der neolithischen Revolution ausprägende menschliche Technik im Unterschied zur „Zufallstechnik“ höherer Spezies oder der Urmenschen zu spezifizieren; zum anderen mit dem Ziel, das Verhältnis von Technik und Wissenschaft genauer freizulegen. Indessen fordern aktuelle Technologien, historische Zustandsbeschreibungen einer „Technoscience“ sowie neue epistemische Praktiken die Zweiteilung von „Steuern“ und „Regeln“ heraus. (...) Mit Blick auf sogenannte „new emerging sciences and technologies“ und andere Entwicklungen in den Informations-, Kognitions-, Nano- und Biotechnologien fragt dieser Band danach, wer oder was als Subjekt von Steuerungs- und Regelungsprozessen konzeptualisiert werden kann. Das Nichtwissen ist in aller Munde. Von Nichtwissenskulturen in der zweiten oder reflexiven Moderne ist die Rede, von Agnotologie als neuem Forschungszweig, von wicked problems und ihren clumsy solutions. Wo Nichtwissen sich durch Komplexitäts­steigerung unwiderruflich im zu Wissenden einnistet, fordert es als Grenze, Schranke und Kehrseite des Wissens die sogenannte Wissensgesellschaft heraus. Vor allem Risiko­poten­ziale und Gefahren kommen hier in den Blick, von denen wir gerade genug wissen, um Wissensansprüche zu formulieren, die sich womöglich nie einlösen lassen. Das klassisch erkenntnistheoretische (...) Problem: „Was können wir wissen?“ steht heute in einem Spannungsverhältnis zu der wissenspolitischen Frage: „Was müssen wir wissen?“ Was wir wissen müssen, ist einerseits so viel wie nötig, wenn es um Fragen von Sicherheit und Gesundheit geht – andererseits aber so wenig wie möglich, wenn es in Alltag, Wirtschaft oder Wissen­schaft darauf ankommt, Wissen an technische Systeme oder Expertenkulturen zu delegieren. Bezeichnet politisch handlungsorientiertes und wissenschaftliches Nichtwissen zunächst ein Defizit, ist technisches Nichtwissen gleichermaßen erstrebenswert und problematisch. Einige, die Technik für angewandtes Wissen halten, mögen darin eine contradictio in adjecto sehen, manche sich um eine dem technischen Nichtwissen geschuldeten Technik­feindlichkeit sorgen, andere daraus die nötige Demut gegen verstiegene Allmachts­fantasien beziehen, während ihre Gegenspieler von Maschinen träumen, die über den Horizont intellektueller Nachvollziehbarkeit immer weiter hinauseilen. À l’heure où l’essence de la médecine cherche à être ressaisie pour repenser une pratique en crise d’identité, la notion de personne peut apparaître comme un point d’ancrage possible. L’auteur examine l’usage qui en est fait dans la littérature professionnelle et dans les avis du Comité consultatif national d’éthique (CCNE) entre 2005 et 2010. La notion de personne apparaît complexe et sert des idéologies qui s’affrontent. Les traditions juridique, théologique et philosophique qui la sous-tendent ont cédé en partie à une (...) nouvelle conception affirmée par la Déclaration universelle des droits de l’Homme de 1948. Celle-ci n’évite pas deux écueils : l’exaltation de l’individu autonome et responsable de la modernité laisse un nombre croissant d’êtres parlants sur le bord du chemin ; l’attention portée au vivant minore le souci des conditions politiques et sociales de l’existence. Faisant retour sur l’éthique de la pratique, l’auteur suggère qu’elle n’a pas besoin, pour consister, de recourir à la notion polémique, complexe et problématique de la personne. (shrink)

Nul ne disconvient de l’existence d’un malaise dans la médecine contemporaine, mais les points de vue divergent concernant ses causes. Notre analyse prend comme point de départ le discord entre l’expérience vécue du malade et le statut de patient inauguré par la rencontre médicale, pour suggérer l’existence d’un motif de basse continue à une dysharmonie qui n’est pas la seule conséquence du contexte actuel, mais qui tient à un hiatus irréductible. Les mouvements tendanciels destinés à « corriger le tir » (...) risquent de manquer leur but, faute d’avoir pris en considération le caractère inévitablement bancal de la pratique médicale. Faisant retour sur ce qui « a lieu » dans la consultation, la question initiale en vient à être déplacée : conviendrait-il, tout bien considéré, de ne pas trop (chercher à) comprendre le malade? The thematic focus of this yearbook is concerned with the various relations of „art“ and „technology“. It seeks to interrogate and reflect their conceptual filiations, their complementarities and mutual stimulations, and contrasts and tensions. The very notion of the „work“ challenges us to explode or triangulate the dichotomy of art and technology. This connects to further problems in and for the philosophy of technology, such as the relation of arts and crafts, the question of Kitsch or camp in art and (...) technology, or the role of play as a basic modality of artful technical production. Finally, of course, comes design, packaging, marketing and the aesthetic effects of works. Connecting human minds to various technological devices and applications through brain-computer interfaces (BCIs) affords intriguingly novel ways for humans to engage and interact with the world. Not only do BCIs play an important role in restorative medicine, they are also increasingly used outside of medical or therapeutic contexts (e.g., gaming or mental state monitoring). A striking peculiarity of BCI technology is that the kind of actions it enables seems to differ from paradigmatic human actions, because, effects in the world are (...) brought about by devices such as robotic arms, prosthesis, or other machines, and their execution runs through a computer directed by brain signals. In contrast to usual forms of action, the sequence does not need to involve bodily or muscle movements at all. A motionless body, the epitome of inaction, might be acting. How do theories of action relate to such BCI-mediated forms of changing the world? We wish to explore this question through the lenses of three perspectives on agency: subjective experience of agency, philosophical action theory, and legal concepts of action. Our analysis pursues three aims: First, we shall discuss whether and which BCI-mediated events qualify as actions, according to the main concepts of action in philosophy and law. Secondly, en passant, we wish to highlight the ten most interesting novelties or peculiarities of BCI-mediated movements. Thirdly, we seek to explore whether these novel forms of movement may have consequences for concepts of agency. More concretely, we think that convincing assessments of BCI-movements require more fine-grained accounts of agency and a distinction between various forms of control during movements. In addition, we show that the disembodied nature of BCI-mediated events causes troubles for the standard legal account of actions as bodily movements. In an exchange with views from philosophy, we wish to propose that the law ought to reform its concept of action to include some, but not all, BCI-mediated events and sketch some of the wider implications this may have, especially for the venerable legal idea of the right to freedom of thought. In this regard, BCIs are an example of the way in which technological access to yet largely sealed-off domains of the person may necessitate adjusting normative boundaries between the personal and the social sphere. It is time to challenge the issue of pleasure associated with the core of medical practice. Its importance is made clear through its opposite: unhappiness—something which affects doctors in a rather worrying way. The paper aims to provide a discussion on pleasure on reliable grounds. Plato’s conception of techne is a convenient model that offers insights into the unique practice of medicine, which embraces in a single purposive action several heterogeneous dimensions. In Aristotle’s Ethics, pleasure appears to play a central (...) role for action’s assessment and intensification. Pleasure is also tightly associated with the Kantian faculty of reflective judgment, which operates at the heart of clinical reasoning. Indeed, practicing medicine means to deal with the particular and the manifold, requiring clinical judgment, but also relying on embodied habitus . With Bourdieu’s notion of habitus , pleasure is the mark of a happy practice, which presupposes a deep involvement in one’s field. Throughout our inquiry, the question of pleasure comes to offer a critical reappraisal of real medical practice and leads to consider ethics more as a component of techne than as a separate realm of concern. There are only a few ethical regulations that deal explicitly with robots, in contrast to a vast number of regulations, which may be applied. We will focus on ethical issues with regard to “responsibility and autonomous robots”, “machines as a replacement for humans”, and “tele-presence”. Furthermore we will examine examples from special fields of application (medicine and healthcare, armed forces, and entertainment). We do not claim to present a complete list of ethical issue nor of regulations in the field of (...) robotics, but we will demonstrate that there are legal challenges with regard to these issues. L’ usage de soi, de son existence, est le présupposé et la poutre maîtresse de tous les autres usages. Or l’usage de soi se fonde sur le détachement de soi. Est utilisée une existence à laquelle on ne peut pas (...) toujours s’identifier, qui ne se possède pas entièrement et qui, sans être vraiment étrangère, n’est pas non plus complètement familière. Autrement dit, l’usage de la vie concerne l’espèce qui, en plus de vivre, doit rendre sa vie possible. Le jeu de scène théâtral récapitule et amplifie les procédés par lesquels l’être humain se sert de son existence. L’activité de l’acteur est un modèle incomparable de l’usage de la vie et du souci de soi. « La médecine reste en quête d’une épistémologie propre, car l’opposition entre science des maladies et art de soigner ne parvient pas à rendre compte de l’unité d’une pratique. Cette épistémologie peut être dégagée en ressaisissant ce qui se produit dans la clinique, véritable laboratoire de la médecine : lieu de son effectuation et lieu de son élaboration, où l’expérience vécue et l’expérience acquise fournissent les coordonnées d’une expérimentation. La clinique a un point de départ : la demande d’un malade (...) en proie à une intrication symptomatique maladive qui convoque le corps mais aussi le langage, et dont le médecin fait cas. La complexion symptomatique fait l’objet d’une analyse critique (diagnostic) qui débouche sur la détermination d’une thérapie. La clinique est alors une technique productive de remédiations diverses qui mobilise un ensemble hétéroclite de savoirs et de facultés pour trouver des solutions aux problèmes concrets des individus qui s’adressent à elle. Quand bien même la clinique importe pour son usage des biotechnologies et des algorithmes, elle reste incertaine et conjecturale car individuée. Si bien qu’en son cœur, la pratique médicale garde des allures infra-techniques, mobilisant des esthésies, une praxis, une sagacité pratique. Cette hétérogénéité épistémologique est la seule qui soit adéquate à son objet. ». (shrink)

The particular situation of the French administrative detention center medical units appears to be an exemplary case to study the difficulties facing medical practice. Indeed, the starting point of our inquiry was an amazing observation that needed to be addressed and understood: why are professional interpreters so seldom requested in ADC medical units, where one would expect that they would be “naturally” present? Aiming to fully explore the meanings of the “absent interpreter”, this article takes into account the possible meanings (...) of this situation: the recourse to professional interpreters in France is far from expected given cumulative evidence of its benefits; perceptions of illegal immigrants and medical habitus itself may both hamper the use of a third party; the ADCs are a very stressful place for healthcare professionals, with conflicting missions, political issues enmeshed with medical goals, and heavy affective burden that may lead to self-protection. Silencing voices of suffering others might be seen as the hidden indecent truth of the “absent interpreter”. These reflections open a window to a larger issue with regard to the full range of medicine: what are the place, the role and the function of patient’s words and narratives in contemporary medicine? The highly invested somatic perspective and its political corollary giving primacy to bare life harbor potential risks of obscuring speeches and undervaluing narratives. (shrink)
