Despite being eminently forgettable from the literary point of view, B. F. Skinner’s novel, Walden Two , provides us with an excellent opportunity, not so much to show what is wrong with mainstream accounts of free will, as Robert Kane thinks, but rather to explore another key and importantly neglected condition for genuine agency; namely, that properly lived human lives are those that are and must continue to be vulnerable to unforseable reversals, as Aldous Huxley speculates in his Brave New (...) World . In short, I argue, perhaps scandalously, that one of the central conditions for genuine agency is that our lives are and must continue to be, to a large extent, out of our personal control. The promise of too much personal control, not too little (as Kane thinks), is what is wrong with Skinner’s social utopia. (shrink)

Libanius' many volumes, on the other hand, compared where appropriate with the Vitae Sophistarum of Eunapius, present a situation which is well summarised by the following sentences from Walden's work The Universities of Ancient Greece : ‘There was, among the sophists of the fourth century…little, if any, of that spirit of brotherhood… that usually exists in a community of scholars at the present day. Instead there were jealousy, spite and often unrelenting hatred’. This striking divergence between Ausonius and his Eastern counterparts is unlikely to reflect a basic difference between East and West, or between Latin- and Greek-speaking milieux; the complaints of Augustine about his problems in Africa and Rome warn against such a simple answer. When one adds the evidence provided seven centuries later by the Frenchman Peter Abelard, whose plaintive Historia Calamitatum — an account of the disasters he suffered, not those which he caused — is remarkably similar to the prickly self-justification of Libanius in its account of bitter scheming and almost military manoeuvres in the educational world, one is forced to consider whether the evidence of Ausonius is not a serious anomaly, and to seek an explanation. One expects die spiritual landscape to be familiar, so familiar perhaps diat you need not read die book to feel you know it. But Waiden disappoints this expectation. Having read it, one may wonderjust what is so familiar or American about Thoreau's sensibility. And righdy so. Waiden is long on observation (...) and short on plot, as tedious in its detail as it is devoid of action. It is a wondrously slow, contemplative work and would be demanding enough for this reason alone, to say nothing of the enormous vocabulary, the abundant allusions to classical mythology, and die Latin and Greek scattered tiiroughout—all of which hint that despite his democratic rhetoric, Thoreau addresses himself to a rather small audience. Like the lusty chanticleer, "standing on his roost, ifonly to wake his neighbors up," Waiden speaks to the best part of the soul, to that in us which is divinely awake or mindful.1 Such speeches necessarily transcend not only America's borders, but common-sense understanding as well, "the sense ofmen asleep, which they express by snoring" (p. 325). As Thoreau puts it: "I desire to speak somewhere widiout bounds; like a man in a waking moment, to men in dieir waking moments" (p. 324). This desire "to speak somewhere without bounds" is philosophical. Waiden witnesses to die philosophical experience of the world. Originating in wonder and die desire to understand, Waiden moves dirough die senses, experience, the arts, and science. But its specifically philosophical character lies in Thoreau's evident desire to situate all tilings, including himself, in dieir ultimate context. Recognizing the integrity of this desire means appreciating that the full realization of one's nature requires discovering one's place in die cosmos. The first part considers Thoreau as a surveyor of the whole of things, a traditionally philosophical endeavor. The second part examines Thoreau's desire for truth and shows how it must be distinguished from the tenets of transcendental philosophy generally and Emerson's transcendentalism in particular. Contrary to a common opinion, a true estimation of Walden's philosophical depth hinges on seeing why Thoreau is not a transcendentalist. Some may worry that attention to these universal, theoretical features ofThoreau's workjeopardizes doingjustice to his famously idiosyncratic individualism. But Thoreau does not ask one to choose either allegiance to oneself or to universal laws: such a dichotomy is false and must be sublated. Thus the final part of this essay explicates how Thoreau envisions the web of particular and universal, the alignment of individual and cosmos. I conclude by framing my disagreement with Stanley Cavell's reading of Waiden. As the only well-known philosopher to have devoted a book-lengtii study to Waiden, his influence has been great, and on central points his reading sanctions the common emphasis on subjectivity.2 Two last prefatory remarks. First, Waiden is not a work in philosophy, at least not a treatise, for Thoreau does not explain his insights thematically. Nevertheless, the work has a distinct philosophical character, one I shall try to sketch with die degree of precision appropriate to it. This raises my second point. Precision does not sit easily with comprehensiveness or with the need to praise. All three are relevant to philosophical understanding, yet Thoreau evidently felt that synoptic contemplation and all its fruits, including "any memorable praise of God," were in die shorter supply (p. 78). As Thoreau tells it, he wished to "cut a broad swath and shave close, to drive life into a corner, and reduce it to its lowest terms," "to front only the essential facts," "and if [life] proved to be mean, why then to get the whole and genuine meanness of it, and publish its meanness to die world; or if it were sublime, to know it by experience, and be able to give a true account of it in my next excursion" (pp. 90—91). In Matthew 24, Jesus prophesied to his disciples about ‘wars and rumours of wars’ and other eschatological birth-pangs to prepare them in advance on how they are to be responding to eschatological events as they would be unfolding in the interim of his ascension and his promised Parousia. What then does Jesus mean by enlisting ‘wars and rumours of wars’ in this eschatological era to be functioning as ‘the beginning of birth-pangs’ and how should Christians be responding to wars and (...) rumours of wars as eschatological birth-pangs? Employing the redaction exegetical method, this study focuses on interpreting Matthew 24:6−8 to explain what Jesus most probably meant as he enlisted ‘wars and rumours of wars’ as eschatological birth-pangs; and with special reference to the Russia–Ukraine war that broke out on 24 February 2022, recommends from the Olivet prophecy how Christians are to be righteously responding to ‘wars and rumours of wars’ as eschatological birth-pangs. Contribution: This study explored Matthew 24:6−8 to unveil what Jesus means by enlisting wars and rumours of wars as eschatological birth-pangs. With special reference to the Russian military invasion of Ukraine, theological highlights were recommended on how Christians are to be responding to war and war rumours as end-time birth-pains. For a book that implores its readers to “simplify, simplify,” Walden has more than its fair share of obscurity. Lovers of simplicity have long mined it for its clear and comforting maxims, only to leave behind more than a few tough nuts for those who incline towards the esoteric—which, for Thoreau, is the essence of the philosophical. To the former set of readers he offers an apology: “You will pardon some obscurities, for there are more secrets in my trade than (...) in most men’s, and yet not voluntarily kept, but inseparable from its very nature.” To the latter he offers advice: “Books must be read as deliberately and reservedly as they were written.” The mysteries of the best books, Thoreau insists, are revealed only to those who, through their patience and persistence, prove themselves worthy of their teachings. “The heroic books, even if printed in the character of our mother tongue, will always be in a language dead to degenerate times; and we must laboriously seek the meaning of each word and line, conjecturing a larger sense than common use permits out of what wisdom and valor and generosity we have” (p. 83). Thoreau’s Walden, I mean to show, was both conceived and meant to be read as just such a heroic book, not only because of its author’s “epic ambition” to create a national literature, but also because a unique understanding of heroism is the subject of its most esoteric chapters. Tauber; xi & 317 pp. Berkeley: University of California Press, 2001, $40.00. Among the marvelous qualities of Thoreau's writing is its vivid concreteness and immediacy. As befits one who spent his life seeing for himself, Thoreau (...) shares a vision of a cosmos whose significance is there to be discovered in the things themselves, if only one cultivates the desire, faith, and discipline required for seeing to the bottom of things. An ironic and happy consequence of Thoreau caring more for the company of nature than for that of his fellow man is that it ultimately made him a finer, more engaging writer with a large audience. Whereas Thoreau might have lost himself and his subject-matter (not to mention the better part of his audience) amidst the twists and turns of Kant's or Fichte's conceptual plumbing, he came to his senses instead--and avoided their abstractions and the intellectual fuss they generate. Imagine how tedious and stale his reflections on the supposed bottomlessness of Walden pond would be if he had framed them explicitly in the terms of intellectual debates revolving around skepticism and realism, phenomena and noumena, and their like. It belongs to Thoreau's enduring genius and charm that he avoided such trappings. One can rely on him for a philosophically inflected appreciation of the realms of nature and spirit, while Plato, Aristotle, Hegel, and Nietzsche are more reliable for philosophically incisive articulations of the first principles governing these realms.Inevitably, scholarly books like Alfred Tauber's Henry David Thoreau and the Moral Agency of Knowing will not have the same fresh, original spirit as do their subjects. But though a scholar addresses someone's views rather than the things themselves, one nonetheless chooses whether to develop one's subject's views primarily in light of (what the scholar understands to be) the things themselves, or whether to focus on how the subject's views relate to the views of others. By claiming his book is philosophical, Tauber in effect claims that it is of the former sort, but in fact it is of the latter sort. As such, readers interested in Thoreau's Zeitgeist and contemporary influences, in past and recent assessments of his thought, as well as in some discussion of its place in contemporary intellectual currents will find Tauber's book timely and valuable. For example, prior to articulating his own view of Thoreau's relation to the science of his day, Tauber gives the reader a primer on the history of positivism. Similarly, in the course of assessing how Thoreau viewed the relation of self and nature, Tauber leads the reader through summary appraisals of (and here I give only a sampling) some relevant swatches of Kant, Fichte, and Barthes's thought. And this is not the half of it. Tauber also weaves into his argument reflections on Augustine's discussion of time in the Confessions, themes from Polanyi's Personal Knowledge and James's Principles of Psychology, as well as Goethe's interpretation of what should constitute scientific activity. This essay presents a critique of current views of Hugo Grotius which erroneously see him as a major theorist of natural rights and a formative influence upon the rights theory of Thomas Hobbes. Especially singled out for criticism are the misconceptions due to Richard Tuck in a number of writings that discuss the political ideas of Grotius and Hobbes and the relationship between them. In an examination of Hobbes's conception of natural rights, the essay reaffirms its originality and notes its (...) revolutionary potential contrary to the main intention of Hobbes's own political doctrine. A continuoxis t- norm is a continuous map * from [0, 1]² into [0,1] such that is a commutative totally ordered monoid. Since the natural ordering on [0,1] is a complete lattice ordering, each continuous t-norm induces naturally a residuation → and becomes a commutative naturally ordered residuated monoid, also called a hoop. The variety of basic hoops is precisely the variety generated by all algebras, where * is a continuous t-norm. In this paper we investigate the structure of the (...) variety of basic hoops and some of its subvarieties. In particular we provide a complete description of the finite subdirectly irreducible basic hoops, and we show that the variety of basic hoops is generated as a quasivariety by its finite algebras. We extend these results to Hájek's BL-algebras, and we give an alternative proof of the fact that the variety of BL-algebras is generated by all algebras arising from continuous t-norms on [ 0,1] and their residua. The last part of the paper is devoted to the investigation of the subreducts of BL- algebras, of Gödel algebras and of product algebras. (shrink)

This paper briefly reviews highlights from decades of debates in medicine, law, bioethics, psychology and social research about children’s and parents’ views and consent to medical treatment and research. There appears to have been a rise and later a fall in respect for children’s views, illustrated among many examples by a recent book on the zone of parental discretion, which is reviewed. A return to greater respect for children’s views and consent is advocated.

An interrogation of the term 'theory' from the perspective of linguistic discourse Zima offers a new definition of theory from a cultural and sociological perspective, with a view to encountering heterogenerous points of view in critical dialogue.

Equipoise is advocated as a means of achieving high scientific and ethical standards in randomised trials. As used in the context of research the word describes a state of uncertainty characterised by the belief that in a trial no arm is known to offer greater harm or benefit than any other arm. Clinicians who lack personal equipoise are advised to accept clinical or communal equipoise, based on current unresolved disagreement among the medical profession. Equipoise is mainly discussed in the literature (...) as an issue for senior doctors and research directors. Limitations of professional equipoise are reviewed, and data on the neglected topic of patients' equipoise are reported using the example of breast cancer trials. In theory, a patient who gives informed and voluntary consent to enter a randomised trial has achieved the equilibrium of equipoise. In practice, equipoise among patients ranges from personal to proxy acceptance. (shrink)

The article is concerned with the question of how legal institutions are structured with the use of constitutive, institutive, consequential, and terminative rules. To that end, the regulation of international treaties as laid down in the Vienna Convention on the Law of Treaties of 1969 is analysed. This leads to the discovery of two additional categories of rules: content rules and invalidating rules. Finally, the special status of unique legal institutions is investigated. Unique legal institutions – for example, heads of (...) state, parliaments, and supreme courts – enjoy validity in a legal system to the exclusion of the validity of any other legal institution of the same category in that system.
