We are pleased to present the following Review Forum of Harvey Whitehouse’s book, Arguments and Icons: Divergent Modes of Religiosity. Oxford: Oxford University Press, 2000. 204 pages. ISBN 0-19- 823414-7 (cloth); 0-19-823415-5 (paper). We have given the contributors and the book’s author sufficient space to discuss its themes carefully and thus make a significant contribution to the further analysis of religion and ritual generally.

Prison work creates ethical challenges for which a training program was initiated for Dutch prison staff to foster their Moral Craftsmanship (MCS). The concept of MCS is not yet defined and operationalized in literature. This explorative study aims to 1) define MCS, 2) identify conceptual elements of MCS, and 3) develop a measurement tool for MCS. A document and literature study provided input for the definition and selection of conceptual elements related within DCIA policy documents, identifying three conceptual levels of (...) MCS: individual (cognition, attitude, and actions), team, and leadership. This first MCSQ consists of seventy-one items distributed across the domains: values and norms, judgment and reasoning, consultation, implementation, looking back, interactions, and leadership. We tested its usability via ‘think-aloud interviews.’ Validation of the current version of the MCS-Questionnaire and consensus among experts about what to include or exclude in the concept of MCS are needed for further development. Beller, Bender, and Medin question the necessity of including social anthropology within the cognitive sciences. We argue that there is great scope for fruitful rapprochement while agreeing that there are obstacles (even if we might wish to debate some of those specifically identified by Beller and colleagues). We frame the general problem differently, however: not in terms of the problem of reconciling disciplines and research cultures, but rather in terms of the prospects for collaborative deployment of expertise (methodological and theoretical) (...) in problem-driven research. For the purposes of illustration, our focus in this article is on the evolution of cooperation. (shrink)

In this paper I argue that it is morally important for doctors to trust patients. Doctors' trust of patients lays the foundation for medical relationships which support the exercise of patient autonomy, and which lead to an enriched understanding of patients' interests. Despite the moral and practical desirability of trust, distrust may occur for reasons relating to the nature of medicine, and the social and cultural context within which medical care is provided. Whilst it may not be possible to trust (...) at will, the conscious adoption of a trusting stance is both possible and warranted as the burdens of misplaced trust fall more heavily upon patients than doctors. In his paper I found many aspects of Hinduism that directly engage the mimetic theory, and I hope that I can articulate some of these in such a way as to initiate discussion during the next hour or (...) so this afternoon. As one of the so-called "Girardians," my first impression in response to Professor Clooney's paper is that the complexity of Hindu attitudes toward violence and sacrifice seem to indicate an awareness of the ritualization and control of violence, as developed over a very long period of time. I. Language of Avoidance/Denial: The Horse I would like to start with a small detail, but one which seems to me key to many larger issues in light of the mimetic theory: the ritual directions and prayers [1.1] in which the words "to kill" and "to die" are carefully avoided through the substitutions of such words as "he takes hold of and "he makes consent." I might add here also, that the avoidance ofusing "real" words for what is "really" being doneDkilling the animalDreminds me to some extent of the use of language by contemporary torturers as analyzed in the book The Body in Pain: The Making and Unmaking ofthe World by Elaine Scarry. Scarry argues that the language used by torturers avoids any acknowledg- Julia W. Shinnick141 ment of the real actions they are committing, as well as any acknowledgment of the very real pain they are causing their victims; furthermore, it is a dehumanizing language, referring to the victims as, for example, submarines, in one particular type of torture. This discrepancy between language and actual action is intriguing in both cases. Granted, the sacrificers in the Rg Veda do not deny that they are sacrificing the horse, and the "apology" (the words to the horseD"Do not let the axe linger in yourbody...") is not part ofan act oftorture, but the words have in common with Scarry's report a certain denial or avoidance of the reality of both the actions ofkilling and/orharming and the result ofthese actions, pain and/or death. Furthermore, the avoidance of the words "to kill" and "to die" would fit in with the mimetic theory's idea ofprohibiting the ritual from bringing actual facts of the founding murder to consciousness. II.Sacrificial Instructions The words addressed to the horse in the Rg Veda [I.l]and the instructions for the treatment of animals to be sacrificedO'The axe penetrates the thirty-four ribs of the swift horse...so that the limbs may be unperforated, and recapitulating, joint by joint "Dseem to me to intersect with the mimetic theory in terms of ritual sacrifice as a reenactment of the founding conflict. As I understand it, in the mimetic theory, one reason for careful, detailed ritual instructions and the sense ofgreatdangerin sacrifice (the sense that if the ritual is not carried out exactly and correctly, something horrible might happen) has to do with a non-conscious fear of unleashing the mimetic crisis all over again. I see aspects of this in the minutely detailed instructions to the priest such as the importance of leading the horse but not holding on to it, and the desire to pacify the animal to be sacrificed. These kinds of details are of course also present in other sacrifice rituals. For example, in Perpetua's Passion: The Death and Memory of a Young Roman Woman, Joyce Salisbury speaks of the simultaneous sacrifice of hundreds of children in ancient Carthage during the Punic Wars. The children had to be (appear) "willing" to be sacrificed. Ifthey cried out, the sacrifice was considered invalid. The parents also had to be (appear) "willing;" ifthe mother shed a tear, the sacrifice was invalid. Thus, immediately before the fatal knife thrust, the sacrificing parents would caress their children and tickle them to make them laugh. This article examines the implicit promises of fairness in evidence based medicine , namely to avoid discrimination through objective processes, and to distribute effective treatments fairly. The relationship between EBM and vulnerable groups is examined. Several aspects of EBM are explored: the way evidence is created , and the way evidence is applied in clinical care and health policy. This analysis suggests that EBM turns our attention away from social and cultural factors that influence health and focuses on a narrow (...) biomedical and individualistic model of health. Those with the greatest burden of ill health are left disenfranchised, as there is little research that is relevant to them, there is poor access to treatments, and attention is diverted away from activities that might have a much greater impact on their health. Until about thirty years ago, the extent of disclosure about and consent-seeking for medical interventions was influenced by a beneficence model of professional behaviour. Informed consent shifted attention to a duty to respect the autonomy of patients. The new requirement arrived on the American scene in two separate contexts: for daily practice in 1957, and for clinical study in 1966. A confusing double standard has been established. 'Daily consent' is reviewed, if at all, only in retrospect. Doctors are merely exhorted (...) to obtain informed consent; they often minimise uncertainties about 'best' treatment and they feel duty-bound to provide patients with an unequivocal recommendation for action. 'Study consent' in a clinical trial is reviewed prospectively, and doctors are compelled by regulation to point out that there is insufficient evidence to make a rational choice between two compared treatments. It has been impossible to devise informed consent practices that satisfy, in full, the competing moral imperatives of respect for autonomy, concern for beneficence with emphasis on the value of health, and a vigil for justice. A way must be found to experiment with various discretionary approaches that would strike a realistic balance among competing interests. (shrink)

This paper sketches an account of public health ethics drawing upon established scholarship in feminist ethics. Health inequities are one of the central problems in public health ethics; a feminist approach leads us to examine not only the connections between gender, disadvantage, and health, but also the distribution of power in the processes of public health, from policy making through to programme delivery. The complexity of public health demands investigation using multiple perspectives and an attention to detail that is capable (...) of identifying the health issues that are important to women, and investigating ways to address these issues. Finally, a feminist account of public health ethics embraces rather than avoids the inescapable political dimensions of public health. (shrink)

The paper begins with a defence of a new definition of privacy as the absence of undocumented personal knowledge. In the middle section, I criticise alternative accounts of privacy. Finally, I show how my definition can be worked into contemporary American Law.

This work, a reworked doctoral thesis written for Roland Bainton at the Yale Divinity School, begins with an announcement of a specific scholarly purpose: "To clarify the relationship between the clergy and the magistracy which grew out of Zwingli's reforming work at Zurich... the main focus of the study is upon the early stages of Zwingli's career at Zurich.... The ensuing study accepts the assumption that Zwingli believed in a Christian society ruled by two God-ordained officers, the magistrate and the (...) pastor, and asks 'What place did Zwingli assign to the magistrate and the clergy in order to realize the rule of God?'" Using as his model the German habilitations schrift, the author exhausts every possible aspect of Zwingli's theological and political thought. All of Zwinglian scholarship is summarized here, and problems in Zwingli's thought are dealt with emphasizing its development and its contradictions. Basically Walton argues that most of the scholarship about Zwingli is wrong because it assumes that Zwingli advocated domination of the government by the clergy. Zwingli was a defender of a theory of government which envisaged a co-operation between the spiritual and secular authority in a Christian society in order to realize the will of God. Walton finds that Zwingli's success in reforming Zurich was based upon the fact that his formulation of a Church-State detente conformed to pre-existing conditions in that city. Zurich was dominated by a corporate form of government which had already permitted the magistracy to take on a semi-sacral character. Zwingli, Walton argues, fit his theory of government to the conditions as they existed at Zurich. This is a book for Zwingli aficionados. It is an example of extremely well-done Continental scholarship: precise, insightful, and dry. No doubt the work has already become a definitive work on Zwingli's notion of theocracy.--W. A. J. T he O bject of this paper is the development of a view of punishment which incorporates what is of importance in retributive and utilitarian justifications of the practice of punishment. This proposed theory was noted and referred to as the plene esse , but not fully worked out, in the course of a discussion paper in which my concern was to offer an alternative view, to that of Mr Anthony Quinton, by construing ‘the right to punishment’ as meaning that (...) ‘the offender has the right to be regarded as responsible for his actions’. Background. South Africa (SA) currently has a golden opportunity to legislate on human heritable genome editing (HHGE), as the country is revising its assisted reproductive technology regulations. A set of sub-regulations that deals with HHGE, which could seamlessly slot into the current regulations, has already been developed. The principles underlying the proposed set of sub-regulations are as follows: HHGE should be regulated to improve the lives of the people and should not be banned; the well-established standard of safety and efficacy (...) should be used in the regulation of HHGE; quality of life is what matters, and not preserving a ‘normal’ genome; parents’ reproductive autonomy must be respected; and equality of access to approved HHGE technology should be promoted. Objectives. To ascertain whether the proposed set of sub-regulations that deals with HHGE is aligned with public opinion in SA, and SA’s Bill of Rights. Methods. Public opinion in SA is determined with reference to a deliberative public engagement study on HHGE conducted among South Africans, and the relevant rights in the Bill of Rights are interpreted with reference to recent case law. Results. This proposed set of sub-regulations that deals with HHGE is aligned with public opinion in SA, and SA’s Bill of Rights. Conclusion. Despite the legal and ethical complexities of HHGE, the proposed set of sub-regulations provides a targeted and effective legislative approach. They fit seamlessly into the country’s existing health law framework, creating specific legal standards for HHGE that align with both public opinion and the country’s Bill of Rights. (shrink)

Sober and Wilson demonstrate convincingly the fallacies of arguments for fundamental biological and psychological selfishness and establish the plausibility of both biological and psychological altruism. However, I suggest that they are more generous to proponents of fundamental selfishness than they need be and that morality is closer to our evolved and learned capacities than they suggest. I am less generous toward advocates of fundamental selfishness than are our altruistic authors.

OBJECTIVES: To study and report the attitudes of patients and general practitioners (GPs) concerning the obligation of doctors to act for the good of their patients, and to provide a practical account of beneficence in general practice. DESIGN: Semi-structured interviews administered to GPs and patients. SETTING AND SAMPLE: Participants randomly recruited from an age and gender stratified list of GPs in a geographically defined region of South Australia. The sample comprised twenty-one general practitioners and seventeen patients recruited by participating GPs. (...) RESULTS: In practice, acting for the good of the patient not only accommodates the views of patients and GPs on expertise and knowing best, but also responds to the particular details of the clinical situation. Patients had a complex understanding of the expertise necessary for medical practice, describing a contextual domain in which they were expert, and which complemented the scientific expertise of their GPs. General practitioners identified multiple sources for their expertise, of which experience was the most significant. The role of the GP included responding to individual patients and particular clinical problems and ranged from the assumption of responsibility through to the proffering of medical advice. CONCLUSION: This study found that GPs acting for the good of their patients covered a variety of GP actions and patient preferences. Beneficence was not justified by presumed patient vulnerability or the inability of patients to understand medical problems, but furthered through a recognition of the different areas of expertise contributed by both parties to the consultation.
