Is Portmann's concept of inwardness objectively useful in understanding biological phenomena? If it is, it would seem that there is no unity to the physical sciences, because biology is as fundamental as physics. On the other hand, Portmann's interpretation of inwardness as a meaning or significance that we have to give our interpretation of biological phenomena suggests that it is sheerly subjective, and so should be reduced to objective correlates. This dilemma is false, however. One should realize that scientists construe (...) physical and chemical processes as processes devoid of intrinsic meaning, just as they construe biological processes as having this meaning, which is Portmann's inwardness. From this angle we can integrate the significance of physical and biological processes in a way which does not reduce the latter to the former. Most proponents of restorative justice admit to the need to find a well defined place for the use of traditional trial and punishment alongside restorative justice processes. Concrete answers have, however, been wanting more often than not. John Braithwaite is arguably the one who has come the closest, and here I systematically reconstruct and critically discuss the rules or principles suggested by him for referring cases back and forth between restorative justice and traditional trial and punishment. I show that we (...) should be sceptical about at least some of the answers provided by Braithwaite, and, thus, that the necessary use of traditional punishment continues to pose a serious challenge to restorative justice, even at its current theoretical best. Over the last decade, theorists have persistently criticised the assumption that the International Criminal Court (ICC) can produce a noteworthy deterrent effect. Consequently, consensus has emerged that we should probably look for different ways to justify the ICC or else abandon the prestigious project entirely. In this paper, I argue that these claims are ill founded and rest primarily on misunderstandings as to the idea of deterrence through punishment. They tend to overstate both the epistemic certainty as to and the (...) size of the deterrent effect necessary in order to thus justify punishment. I argue that we should in general expect reasonably humane punitive institutions to lead to better consequences than if we abolish punishment entirely, and I show that, contrary to widespread assumption among critics of the ICC, we should not expect the conditions characteristically surrounding mass atrocity to undermine this presumption. Properly understood, the ICC equals adding another “slice of cheese” to our comprehensive crime preventive system modelled along the lines of James Reason’s Swiss cheese model of accident causation and risk management. A Study of Ecclesiastical Conservativism and AnxietyA German translated form of the “IPAT Anxiety Scale Questionnaire” by Cattell & Scheier and a specially developed ecclesiastical conservativism questionary were given to a sample of 330 adult, catholic, urban Ss. Several item analyses and reliability computations showed the usefulness of the scales. Analyses of correlations and variances yielded the following main results: There are statistical significant functional interrelations between ecclesiastical conservativism and the variables age, educational level, professional type, and church attendance. The (...) same holds for anxiety level and the variables professional type and church attendance. Ecclesiastical conservativism and anxiety level indices have been found to be negatively interrelated. Especially this last result is being discussed on the backgrounds of submission to authorities, individual freedom, responsibility, and anxiety. (shrink)

Lean is a new open source theorem prover being developed at Microsoft Research and Carnegie Mellon University, with a small trusted kernel based on dependent type theory. It aims to bridge the gap between interactive and automated theorem proving, by situating automated tools and methods in a framework that supports user interaction and the construction of fully specified axiomatic proofs. Lean is an ongoing and long-term effort, but it already provides many useful components, integrated development environments, and a rich API (...) which can be used to embed it into other systems. It is currently being used to formalize category theory, homotopy type theory, and abstract algebra. Dieses zeigt sich als ein zunehmend gebrochen-fragiles; in dieser Schwächung kann sich jedoch eine neue Aufmerksamkeit für das Göttliche, das Menschliche und die Sprache entwickeln – in theologischer Diktion: Offenbarung Gottes nicht in einem „Mehr“, sondern in der Zurücknahme einer für den Menschen nicht fassbaren Fülle und im Abschied von fixierten Bildern.

English summary: This book concerns a metaphysical definition of artifacts, taken as a key term of the philosophy of technology. Due to the fact that classical determinations are not only insufficient at explicating the term but also inapplicable to real artifacts, the work tries to develop a concept of artifacts using the thought of truth given by Martin Heidegger. In so far as a hermeneutic interpretation of his oeuvre shows us, truth actually is an object-generating happening. That is why an (...) analysis of forms of judgments allows the description of factic things. Assuming that there are theoretical judgments concerning technique - wherefore technique is an historically contingent kind of metaphysics - artifacts are given as geometrical universals, meaning terms, without being able to subsume thought-independent of individuals, unless artifacts exceptionally are known as subjects of practical philosophy. German description: Diese Studie befasst sich mit der metaphysischen Bestimmung des Gegenstandes Artefakt, der fur die Technikphilosophie zentral ist. Da klassische Bestimmungen weder eine zureichende Explikation des Begriffes noch die eindeutige Identifikation solcher Sachen erlauben, greift der Autor dazu auf das Denken der Wahrheit bei Martin Heidegger zuruck. Eine hermeneutische Deutung von dessen Werk zeigt, dass Wahrheit als ein Geschehen zu betrachten ist, das Gegenstande generiert. In zunehmendem Maße wird es Gegenstand wissenschaftlicher Untersuchungen, und in Deutschland erscheinen in immer größerer Zahl Publikationen, die das chinesische Recht für die Rechtsvergleichung erschließen oder es rechtsvergleichend mit anderen Rechtsordnungen erörtern. In der neuen Schriftenreihe Schriften zum chinesischen Recht, die im Auftrag der Deutsch-Chinesischen Juristenvereinigung von Professor Dr. Uwe Blaurock, Freiburg, Professor Dr. Ulrich Manthe, Passau, Dr. Knut B. Pißler, Hamburg, und Professorin Dr. Christiane Wendehorst, Göttingen, (...) herausgegeben wird, sollen in erster Linie Monographien, wie etwa herausragende Dissertationen oder Habilitationsschriften erscheinen, darüber hinaus aber auch Tagungsbände sowie kommentierte Übersetzungen wichtiger chinesischer Gesetze oder zweisprachige Gesetzessammlungen. Es soll hiermit der wissenschaftliche Gedankenaustausch mit China gefördert und für rechtsvergleichend arbeitende Juristen eine Publikationsplattform geschaffen werden. Ausgehend vom § 398 der „Philosophischen Untersuchungen“, wird Wittgensteins Kritik an Freges Auffassung über Vorstellungen dargestellt. Anschließend wird eine Lösung zu einem Rätsel im genannten Paragraphen gegeben, die Licht auf einige – nicht ganz offensichtliche – wesentliche Unterschiede in unserer Rede über Gegenstände, Bilder und Vorstellungen wirft.

Das Buch von den Ursachen, eine im 9. Jhdt. bei Bagdad entstandene, im 12. Jhdt. ins Lateinische ubersetzte und zunachst Aristoteles zugeschriebene neuplatonische Schrift, gehort zu den zentralen philosophischen Texten, die an den Universitaten des 13. Jhdts. gelesen werden. Ihr anonymer Autor entwickelt darin eine an Proklos angelehnte, jedoch zugunsten der Schopfungstheologie der monotheistischen Religionen abgewandelte Ontologie. Der Kommentar bildet eine wichtige Quelle fur Erkenntnisse zu Entstehung und Inhalt des Buches. Auch zeigt er die Arbeitsweise eines der grossten Denker des (...) lateinischen Mittelalters und ist ein wichtiger Baustein fur das Verstandnis des philosophischen und theologischen Werkes Thomas von Aquins, in dem er immer wieder auf das Buch von den Ursachen zuruckgreift. Intuition-based argumentation is ubiquitous across most philosophical subfields. Moral and political philosophers in particular frequently justify normative principles on the basis of thought experiments that evoke judgments about specific (hypothetical) cases. Lately, however, intuitions have come under attack and their justificatory force is being questioned. This essay asks whether we can acknowledge the epistemic fallibility of intuitions, while nevertheless reaching reliable normative conclusions. To that effect I investigate three different strategies of relating specific intuitions and more general normative principles: the (...) intuitionist, coherentist, and foundationalist methods. Showing that none of them succeeds in making up for the problematic epistemic status of intuitions in the justificatory process, I conclude that normative principles are unreliable to the extent that they are based on thought-experiments. Im Aufsatz wird eine antirealistische und nominalistische Position nicht nur bezogen auf fiktionale Eigennamen entwickelt. Ausgangspunkt sind Überlegungen von Nelson Goodman und Kendall Walton. Der Gedanke dabei ist, dass wir fiktionale Ausdrücke und Darstellungen vermittels metasprachlicher Kategorienbäume verstehen. Dieser Lösungsversuch erlaubt es, von einem Verständnis des Ausdrucks ‚Osterhasen‘ zu sprechen, ohne auf die Annahme der Existenz von seltsamen fiktiven Gegenständen verpflichtet zu sein.

Wenn eine Person unter einer tödlichen Krankheit leidet und nicht über die Ressourcen für eine medizinische Behandlung verfügt, sind wir normalerweise dazu verpflichtet, ihr die notwendigen Ressourcen bereitzustellen. Wären wir aber in einem biotechnischen Zukunftsszenario, in dem die menschliche Lebensspanne durch Eingriffe in den Alterungsprozess erhöht werden kann, auch dazu verpflichtet, anderen Personen die notwendigen Ressourcen für solche Maßnahmen bereitzustellen? John Harris hat argumentiert, dass wir zu solch einer direkten biotechnischen Lebensverlängerung verpflichtet wären, da ein Leben zu verlängern das Gleiche (...) sei, wie ein Leben zu retten. Im vorliegenden Aufsatz wird gezeigt, dass Harris’ Argument nicht schlüssig ist, da entgegen seiner Prämisse ein begrifflicher Unterschied zwischen der Rettung und der Verlängerung eines Lebens besteht. Auf Grundlage von Harris’ zurückgewiesenem Argument werden dann aber zwei alternative Argumente für eine (prima facie) Pflicht zur direkten Lebensverlängerung konstruiert. Das erste Argument basiert auf der Überlegung, dass durch eine direkte biotechnische Lebensverlängerung trotz des begrifflichen Unterschieds mit einer substanziellen Wahrscheinlichkeit Leben gerettet werden würden. Das zweite Argument besagt, dass trotz deskriptiver Unterschiede eine moralische Äquivalenz zwischen der Rettung und der Verlängerung eines Lebens besteht, sofern durch die bloße Lebensverlängerung das Leben um die gleiche Dauer und Qualität verlängert wird wie durch die Lebensrettung. ---------------------------------------------------------------------------------------------------- ---------------------------------------------------------------------------------- When a person suffers from a deadly disease and is lacking the resources for a medical treatment, we are normally obliged to provide the necessary resources. But would we also be morally obliged to provide the resources for an extension of someone’s lifespan through anti-aging treatments which might be developed due to biotechnological progress? John Harris has argued that there would be an obligation to such a direct biotechnical life extension because extending a life is the same as saving a life. In the present paper, it will be shown that Harris’ argument is not sound since, contrary to his premise, there is a conceptual difference between extending and saving a life. On the basis of Harris’ rejected argument, though, two alternative arguments for a (prima facie) obligation to direct biotechnical life extension will be developed. The first argument is based on the idea that, despite the conceptual difference, one saves someone’s life with a substantial probability when extending it by direct biotechnical means. In the second argument, it will be argued that there is a moral equivalence between extending and saving someone’s life despite the descriptive differences as far as the additional lifetime has the same duration and quality in both cases. Resumo: No capítulo 5 do Livro III De anima (430a10-19) Aristóteles distingue entre o νοῦς ποιητικός (nous poietikós), chamado pelos Latinos intellectus agens (intelecto agente), e νοῦς παθητικός (nous pathetikós), chamado pelos Latinos intellectus passivus, ou seja, intellectus possibilis (intelecto possível), termos técnicos e filosóficos mais comuns. O capítulo 5 é de grande importância não só para a filosofia antiga e para os comentadores das obras de Aristóteles, como os comentários de Teofrasto, de Alexander de Afrodisias, de Simplício e Themístius (...) entre outros, mas também para a filosofia do mundo árabe e da Europa latina. Sabe-se que Aristóteles não escreveu um tratado próprio sobre o intelecto, embora possam ser encontradas várias observações acerca do intelecto em suas obras. Os tratados do Intelecto começam com Al-Kindi, Al-Farabi, Avicena e sobretudo Averróis, e se refletem, num sentido crítico e afirmativo, (nos debates) dos tratados latinos, por exemplo, nos tratados de Alberto Magno, de Tomás de Aquino, de Sigério de Brabant entre outros. Este artigo apresenta observações preliminares e preparatórias ao projeto de traduções bilíngue (Latim-Português) dos tratados medievais sobre o intelecto ‘Teorias do Intelecto na Idade Média’ que está em desenvovlimento no Centro Internacional de Estudos Medievais da UFU. Die christlichen Urzeugnisse des Neuen Testamentes, insbesondere die Evangelien, zeichnen sich aus durch eine dem religiös-kulturellen Mainstream zuwiderlaufende Leibfreundlichkeit. Die Konsolidierung des Christentums in den ersten vier Jahrhunderten bringt den Neuplatonismus mit sich und kombiniert ihn mit den aus der jüdischen Tradition stammenden Heiligkeitsvorstellungen. Damit setzt sich das dualistische Denken mit seiner Trennung von Körper und Seele wieder durch und überschreibt die egalitären Ansätze des frühesten Christentums durch Minderbewertung von Frauen und Körperfeindlichkeit. – Am Beispiel asketischer Praktiken sowohl der frühen (...) Kirche wie des Mittelalters lässt sich die Ambivalenz von Körperfeindlichkeit und Körperkult, bei der einerseits grundlegende körperliche Bedürfnisse wie Essen, Trinken, Schlaf, Sauberkeit, Sexualität extrem unterdrückt werden und andererseits eine obsessive Beschäftigung mit dem Körper zu beobachten ist, gut aufzeigen. Gleichzeitig führt die Entkörperlichung zu einer Verwischung der Geschlechter, die Chancen für Frauen bietet, die sich dieser Entkörperlichungsstrategie zu unterziehen gewillt sind. Das 19. Jahrhundert bringt eine Renaissance und Verstärkung des kultischen Heiligkeitsgedankens, welcher sich mit dem Ideal der Virginität und der Marienverehrung verbindet. (shrink)

Nicht erst seit dem Aufkommen des Begriffs der »Cancel Culture« scheint es, als könne man schlicht nicht mehr miteinander reden. Die unterschiedlichen Konzeptionen von Ziel und Methode, also von der Strategie gesellschaftlicher Auseinandersetzungen, variieren so stark, dass sie schlicht nicht mehr kommensurabel sind. Diese Situation lässt sich als das Resultat einer langen Geschichte strategischer Entwürfe und Gegenentwürfe begreifen.
