This paper presents a new reconstruction of Wittgenstein’s famous (and controversial) rule-following arguments. Two are the novel features offered by our reconstruction. In the first place, we propose a shift of the central focus of the discussion, from the general semantics and the philosophy of mind to the philosophy of mathematics and the rejection of the notion of a function. The second new feature is positive: we argue that Wittgenstein offers us a new alternative notion of a rule (to replace (...) the rejected functions), a notion reminiscent of Category Theory’s notion of a morphism. We present an experiment designed to investigate three different mechanisms to achieve impartiality in distributive justice. We consider a first-person procedure, inspired by the Rawlsian veil of ignorance, and two third-party procedures, an involved spectator and a detached observer. First-person veiled stakeholders and involved spectators are affected by an initially unfair distribution that, in the stakeholders’ case, is to be redressed. We find substantial differences in the redressing task. Detached observers propose significantly fairer redistributions than veiled stakeholders or involved spectators. (...) Risk preferences partly explain why veiled stakeholders propose less egalitarian redistributions. Surprisingly, involved spectators, who are informed about their position in society, tend to favour stakeholders holding the same position as they do after the initial distribution. (shrink)

This paper explores Victoria Welby's fundamental assumption of meaning process (“semiosis” sensu Peirce) as translation, and some implications for the development of a general model of intersemiotic translation.

This article offers an explanation of perhaps Wittgenstein’s strangest and least intuitive thesis – the semantical mutation thesis – according to which one can never answer a mathematical conjecture because the new proof alters the very meanings of the terms involved in the original question. Instead of basing our justification on the distinction between mere calculation and proofs of isolated propositions, characteristic of Wittgenstein’s intermediary period, we generalize it to include conjectures involving effective procedures as well.

We perform an experimental investigation using a dictator game in which individuals must make a moral decision —to give or not to give an amount of money to poor people in the Third World. A questionnaire in which the subjects are asked about the reasons for their decision shows that, at least in this case, moral motivations carry a heavy weight in the decision: the majority of dictators give the money for reasons of a consequentialist nature. Based on the results (...) presented here and of other analogous experiments, we conclude that dicator behavior can be understood in terms of moral distance rather than social distance and that it systematically deviates from the egoism assumption in economic models and game theory. The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. This paper offers a new interpretation for Wittgenstein`s treatment of mathematical identities. As it is widely known, Wittgenstein`s mature philosophy of mathematics includes a general rejection of abstract objects. On the other hand, the traditional interpretation of mathematical identities involves precisely the idea of a single abstract object – usually a number –named by both sides of an equation.

During the past decade, a small but rapidly growing number of Law&Tech scholars have been applying algorithmic methods in their legal research. This Article does it too, for the sake of saving disclosure regulation failure: a normative strategy that has long been considered dead by legal scholars, but conspicuously abused by rule-makers. Existing proposals to revive disclosure duties, however, either focus on the industry policies (e.g. seeking to reduce consumers’ costs of reading) or on rulemaking (e.g. by simplifying linguistic intricacies). (...) But failure may well depend on both. Therefore, this Article develops a `comprehensive approach', suggesting to use computational tools to cope with linguistic and behavioral failures at both the enactment and implementation phases of disclosure duties, thus filling a void in the Law & Tech scholarship. Specifically, it outlines how algorithmic tools can be used in a holistic manner to address the many failures of disclosures from the rulemaking in parliament to consumer screens. It suggests a multi-layered design where lawmakers deploy three tools in order to produce optimal disclosure rules: machine learning, natural language processing, and behavioral experimentation through regulatory sandboxes. To clarify how and why these tasks should be performed, disclosures in the contexts of online contract terms and privacy online are taken as examples. Because algorithmic rulemaking is frequently met with well-justified skepticism, problems of its compatibility with legitimacy, efficacy and proportionality are also discussed. (shrink)

O presente estudo consiste em uma análise do processo de composição do Timeu-Crítias de Platão, sob o ponto de vista da modelagem do discurso. Pretende-se mostrar que o diálogo é marcado por uma engenhosa articulação de técnicas de composição, que combinam os aspectos pictorial e dramático da mímesis poética. Estabelecendo as Panateneias como referência implícita, a obra apresenta a performance de uma sequência de narrativas, produzidas como verdadeiras imagens discursivas. A originalidade platônica revela-se no Timeu-Crítias, portanto, no desempenho de uma (...) construção formal ao mesmo tempo dramática e imagética, mediante um singular agenciamento mimético de formas do discurso. Music and affects share a long history. In recent times, 4E cognitive sciences (embodied, embedded, enacted, and extended), situated affectivity, and related ecological theoretical frameworks have been conceptualizing music as a case of a tool for feeling. Drawing on this debate, I propose to further theorize the role of music in situating our affectivity by analyzing how the very affective affordances of music are technologically situated. In other words, I propose to shift the attention from music as a tool for (...) feeling to the tools for feeling music. I argue that the experience of music as a tool for feeling may be altered, enhanced, or lessened depending on the tools for feeling music. I investigate the extent to which AI might be a case of a tool for feeling music and examine the influence it could exert over musical affectivity. I conclude that AI can be considered a tool for feeling music of curatorial type and that the limitations and/or biases of AI as a method risk lessening the power of musical affective affordances. O presente artigo tem como tema as extensas discussões de Wittgenstein sobre uma das formas mais simples e elementares de infinitude em matemática: as dízimas periódicas. Tentamos organizar os vários argumentos do autor em uma única exposição continuada. No final do artigo, introduzimos, ainda que de forma breve, o famoso argumento sobre “execução de regras” de Wittgenstein, bem como a idéia de interpretações nãostandard de processos infinitos.

Cet article poursuit un double but : d’une part, situer dans le parcours philosophique de Wittgenstein une partie de l’histoire du « problème du champ visuel », thème clé de sa période intermédiaire ; d’autre part, mettre en lumière sa critique de l’idée d’un champ visuel (et celle de l’idée d’un objet interne). Nous croyons que ses arguments sont nouveaux, pénétrants, et ainsi leur intérêt dépasse les limites d’un exposé purement exégétique.

This article discusses some of Chateaubriand’s views on the connections between the ideas of formalization and infinity, as presented in chapters 19 and 20 of Logical Forms. We basically agree with his criticisms of the standard construal of these connections, a view we named “formal proofs as ultimate provings”, but we suggest an alternative way of picturing that connection based on some ideas of the late Wittgenstein.

Wittgenstein’s philosophy of mathematics involves two highly controversial theses: the idea that mathematical propositions are not about (abstract) objects and the idea that no mathematical conjecture is ever answered as such, because the advent of the proof always determines a semantical shift of the meanings of the terms involved in the conjecture. The present article offers a reconstruction of Wittgenstein’s arguments supporting these theses within a very restricted setting: Archimedes’ discovery of an algorithm for calculating the number Pi.

O artigo se propõe a uma investigação da potência filosófica presente na poesia japonesa clássica conhecida como waka. O aspecto formal mais proeminente do waka é a sua curta estrutura composta geralmente de 31 sílabas moraicas divididas, respectivamente, em 5 versos de 5, 7, 5, 7 e 7 sílabas cada. Para erguer-se como uma forma poética, o waka emprega o recurso rítmico da pausa e uma retórica que vinculam cada poema individual ao todo da tradição através de precedentes. Defendemos que (...) na tradição intelectual constituída pelo waka há uma filosofia do real – que denominamos intertextualidade do real – que entende a realidade como vazia e impermanente. Dessa forma, seria o waka a forma mais adequada através da qual exprimir o real uma vez que ele é mais profundo e excelente a medida em que cria um movimento de esvaziamento e tornar impermanente através de seus recursos formais e retóricos: seu cerne, sua disposição e significado e suas palavras. El artículo procura analizar el contexto en que surge el reciente debate acerca de agua identificando los principales protagonistas que vienen conformando ese campo que es, al mismo tiempo, teórico, técnico y político. Demuestra como los organismos multilaterales y sus intelectuales (con el discurso de la escasez) vienen impulsando políticas que buscan transferir el papel del Estado en beneficio de los agentes empresariales estimulando procesos de privatización de agua y de su mercantilización. Este artigo oferece uma nova reconstrução para os argumentos do famoso segundo capítulo de Word and Object de Quine e sua idéia da Tradução Radical . De acordo com essa abordagem, o maior alvo de Quine é a noção de composicionalidade como sendo o elemento fundamental para qualquer teoria do significado. Em poucas palavras, não poderia haver nenhuma “teoria do significado”, para Quine, simplesmente porque a noção de composicionalidade deveria ser rejeitada como a concepção central da semântica. Além disso, tomamos (...) o cuidado de diferenciar argumentos empíricos de argumentos a priori de natureza modal. Esses últimos constituem-se no que propomos chamar de Teorema do Automorfismo de Quine , a idéia de que há maneiras alternativas de se reconstruir a estrutura gramatical de qualquer língua incluindo predicação e que poderiam manter invariantes todas as nossas predisposições para comportamento verbal sob quaisquer estados de coisas, atuais ou meramente possíveis. Em nosso entender, é esse teorema que determina fundamentalmente a rejeição da composicionalidade por Quine e, assim, de todas as teorias do significado. (shrink)

Arendt’s reflections on the reverberations of the bureaucratic way of governing give rise to two distinct and, above all, complementary argumentative trajectories: 1) its investigation as a form of domination originating from imperialism and later used as a model of totalitarian; 2) the role of bureaucrats. Both help to understand why the bureaucracy not only survived the fall of totalitarian regimes, but also remained the organizational model of nations. At the intersection of these readings, the essay “Auschwitz on Trial” presents (...) two types of participants in the Nazi bureaucratic apparatus: bureaucratic assassins (desk murderes) and subordinate men. In common among them was a lack of responsibility for the crimes perpetrated by the regime and thoughtlessness; however, their degree of participation in the hierarchy and their punishability in post-war trials differed greatly. In these terms, this article aims to analyze the similarities and differences between subordinate men and bureaucratic murderers. To do so, it is assumed that understanding them helps to understand bureaucracy as a form of government that makes public freedom and the free exercise of spiritual activities unfeasible. (shrink)

O objetivo deste artigo é tentarmos elucidar a extravagante tese de Wittgenstein de que todo e qualquer avanço matemático envolve alguma “mutação semântica”, ou seja, alguma alteração nos próprios significados dos termos envolvidos. Para isso, argumentaremos a favor da ideia de uma “incompatibilidade modal” entre os conceitos envolvidos, como eram antes do avanço, e o que se tornam após a obtenção do novo resultado. Também argumentaremos que a adoção dessa tese altera profundamente nossa maneira tradicional de construir a ideia de (...) “progresso” em matemática. (shrink)

En este artículo presentamos las principales corrientes de la Filosofía Experimental y atendemos a una de las críticas más severas a la que se ha sometido este reciente programa de renovación metodológica. Según Antti Kauppinen la Filosofía Experimental está condenada al fracaso porque no puede obtener mediante sus métodos el tipo de intuiciones que interesan a los filósofos –las intuiciones robustas del hablante competente. Aun aceptando parte de las críticas de Kauppinen, en este artículo sostenemos, en primer lugar, que la (...) supuesta incapacidad de la Filosofía Experimental para acceder a las intuiciones robustas de los hablantes tiene que ver en gran medida con los métodos experimentales empleados hasta ahora por los filósofos experimentales. En segundo lugar, defendemos que el proyecto de reforma llevado a cabo desde la Filosofía Experimental resultará viable solo si se adoptan una serie de consejos metodológicos procedentes de la economía experimental. Únicamente entonces podrán los experimentalistas responder con éxito a la objeción de Kauppinen. (shrink)

Social identity poses one of the most important challenges to rational choice theory, but rational choice theorists do not hold a common position regarding identity. On one hand, externalist rational choice ignores the concept of identity or reduces it to revealed preferences. On the other hand, internalist rational choice considers identity as a key concept in explaining social action because it permits expressive motivations to be included in the models. However, internalist theorists tend to reduce identity to desire—the desire of (...) a person to express his or her social being. From an internalist point of view, that is, from a viewpoint in which not only desires but also beliefs play a key role in social explanations as mental entities, this article rejects externalist reductionism and proposes a redefinition of social identity as a net of beliefs about oneself, beliefs that are indexical, robust, and socially shaped. En el terreno de la moral, el contraste entre lo ¿que el filósofo Wilfrid Sellars denominó «la ¿imagen manifiesta» y la «imagen científica» es enorme y tiene unas consecuencias prácticas ineludibles. Este libro reduce la distancia entre esa imagen manifiesta y la imagen científica, dotando al lector de referencias fundamentales, enfoques diversos y un amplio abanico de temáticas a partir de investigaciones experimentales sobre nuestra conducta moral.

En este artículo se presenta un análisis de la confianza como un proceso de elección racional, poniéndese en cuestión la capacidad de la teoría de la elección racional estándar para dar cuenta del fenómeno. Por eso se prefiere abordar la confianza desde la perspectiva de la racionalidad limitada.

This paper examines the asymmetrical aspect of causal relation, confronting it to Humean and Neo-Humean's view. Following Hausman and Ehring, we favor a situational approach to causal asymmetry. We explore the Hausman's analysis of flagpole's example, clearing the connexions between causation and explanation. Our general diagnosis is that the Neo-humean tradition wrongly supposes that nomic relations, with the exception of minor details, exhaust the causal relations.

O artigo investiga a concepção do poder em Hannah Arendt. O pano de fundo dessa reflexão, na autora, é o mal inerente às práticas de extermínio dos governos totalitários. A nossa exposição ressalta a dimensão constituinte do poder, na qual o poder está associado à capacidade de iniciar e de fundar ações com os outros. Nesse sentido, distancia-se da dimensão constituída do poder: Estado, governo e soberania. Em Arendt, poder diferencia-se de dominação. Os termos que compõem nossa abordagem são: mundo (...) comum, condição humana, ação, espaço público, desobediência civil e potência. (shrink)

O artigo enseja discutir os dilemas e as possibilidades da política na atual configuração societária. Partiremos da definição de sociedade do conhecimento como sociedade em rede apresentada pelo sociólogo Manuel Castells e, em seguida, exporemos os conceitos arendtianos de totalitarismo e ação, importantes para uma reflexão sobre a política nos dias atuais. Abordaremos as implicações da questão judaica na teoria política arendtiana, na qual sobressai uma perspectiva agônica do poder, isto é, o poder não como lugar das forças anônimas, sistêmicas, (...) reprodutoras do status quo, mas de fundação, resistência, civilidade e revelação dos homens como agentes. O pensamento de Hannah Arendt mostra-se fecundo para compreensão das vias de acesso às práticas que repõem, na sociedade do conhecimento, a política na sua significação original. (shrink)

In this work, I analyze our concept of cause in the face of criticism of Bertrand Russell in his article “On the Notion of Cause”. For Russell, there is an estrangement between the notion of cause and mature science of physics. The word cause (and its correlates) would not be used in physics, thus eliminating the main justification of philosophy for his job—the foundation of science. Thus, the various causal notions and the principle of causality should be abandoned by philosophers (...) as something outdated. The aim of this study is to assess the extent to which our notion of cause, with its asymmetric nature, can be explained by physics and investigate the question of the existence of causes in our world. Nossa intenção é explicitar a noção de juízo em Hannah Arendt, partindo da legitimidade como contexto de problematização e tomando a finitude humana como horizonte de tematização. Nosso principal argumento é o de que em Arendt o juízo é concebido como político e o gosto é o modelo do seu modus operandi. Essa concepção é fruto da recepção arendtiana da Terceira Crítica, a Crítica da Faculdade do Juízo, de Kant. Assim, a partir da ligação de juízo a gosto, apresentaremos as (...) seguintes dimensões do juízo: intersubjetiva, autônoma e compreensiva. (shrink)

O presente artigo tem o objetivo de analisar a recepção da obra de Arendt a partir da categoria biopolítica. A categoria biopolítica instalou-se no centro do debate ético, político-filosófico contemporâneo, especialmente, após a requalificação de tal conceito dada por Foucault. Trata-se de mostrar que o termo biopolítica é anterior a Foucault, mas só com ele tal categoria adquiriu dimensão crítico-filosófica, considerando-o, no entanto, que é com Agamben que se dá a potencialização do debate acerca do tema biopolítica, exatamente, porque ele (...) inclui as reflexões de Arendt na trilha que leva à compreensão da naturalização da vida humana nas atuais configurações da sociedade. Assim, não obstante a inexistência de diálogo entre Arendt e Foucault, tenta-se analisar como, de alguma forma, Arendt, através da categoria campo de concentração e da centralidade da atividade do trabalho (labor), antecede e possibilita, no mundo moderno, a consistência analítica que a biopolítica passou a ter hodiernamente, argumentando que, apesar de a autora não usar o sintagma biopolítica, de alguma forma, o conceito, o campo de significação do termo, encontra-se efetivamente presente na obra de Arendt.
