In 1929 and 1930 Wittgenstein holds some form of Phenomenology. This is a most surprising development of his thought. His Tractatus Logico-Philosophicus, published in 1921, represents a form of Philosophy radically opposed to Phenomenology. And yet, "Some Remarks on Logical Form," of 1929, and Philosophical Remarks, of 1930, each defends a form of Phenomenology, in the sense that in each one finds that Wittgenstein presents a version of the thesis that the phenomena of immediate experience are in some way central (...) to construal of meaningfulness. I study this period of Wittgenstein's Philosophy with the objective of clarifying his concern with the study of the phenomena. It will emerge that he holds not one, but rather two different forms of Phenomenology. "Some Remarks on Logical Form" gives voice to one conception of the phenomena and of their role in the determination of the rules which stipulate meaningfulness. Philosophical Remarks, on the other hand, contains a criticism of this view, as well as a different conception of the phenomena and of their role with respect to the rules of meaningfulness . It also emerges that the former kind of Phenomenology is very similar to the Phenomenology of Edmund Husserl, the founder of Phenomenology. I will examine Wittgenstein's Phenomenology of 1929, its similarity with the Phenomenology of Edmund Husserl, his rejection of this conception, and his Phenomenology of 1930. (shrink)

This paper discusses the varieties of capitalism in transitional societies in Latin America and Central / Eastern Europe. The intended purpose of these transitions from semi-closed import-substituting economies in the first case and state socialist ones in the second was to institutionalize open-market economies. Twenty or thirty years later, there is a variety of types of capitalism in these countries, which I classify into three: open-market, neo-mercantilist, and anemic. The question for sociology is whether these quite different variants represent temporary (...) stages or distortions in the same process of transition or whether, on the contrary, they may institutionalize as discrete forms of peripheral capitalism. Neither standard “legacy” argu­ments nor institutionalist theories offer satisfactory answers to this question. The multiple modernities approach, on the other hand, is more appropriate as a theoretical perspective, but it has not produced yet specific propositions applicable to this question. My paper makes two claims. First, the successful transfer of institutions depends on the congruence between these institutions and the broader institutional framework of the recipient economies, a point not developed by institutionalist theories. I offer a hypothesis in this regard: Two critical nodes of congruence are the regulatory and extractive capacity of the state and the strength of civil society. Second, market capitalism (as liberal democracy as well) is a complex institution, and some of its components “travel” more easily across societies and institutional frameworks, and therefore are easier to institutionalize. O presente estudo pretende salientar o trânsito das grandes formulações da concepção da temporalidade na tradição hindu: do tempo (kāla) à sua compreensão como instantâneo (kṣaṇa). Num ponto preliminar, salientam-se as condições linguísticas do pensar indo-europeu e a "gramática" sanscrítica a propósito do tempo. Sublinham-se de seguida os enquadramentos rituais e míticos, tanto ligados com a ciclicidade (saṃsāra), como com o imutável e eterno (ānantya). Depois percorrem-se, de forma sintética, os vários "sistemas" filosóficos salientando respectivamente: a concepção metafísica (no Vedānta (...) e Mīmānsā), a recorrência e irrealidade já num plano gnosiológico (no Sāṃkhya e no Yoga), e a formulação psicológica (tanto no Vaiśeṣika, como no Nyāya, além disso presente no Jainismo). Enfim, na última parte, faz-se menção aos principais traços característicos da doutrina budista da instantaneidade (muito característica sobretudo das escolas "subitistas"). Valoriza-se conclusivamente esta instância de um "agora" também como lição da espiritualidade hindu em geral. (shrink)

The somatic mutation theory (SMT) of cancer has been and remains the prevalent theory attempting to explain how neoplasms arise and progress. This theory proposes that cancer is a clonal, cell‐based disease, and implicitly assumes that quiescence is the default state of cells in multicellular organisms. The SMT has not been rigorously tested, and several lines of evidence raise questions that are not addressed by this theory. Herein, we propose experimental strategies that may validate the SMT. We also call attention (...) to an alternative theory of carcinogenesis, the tissue organization field theory (TOFT), which posits that cancer is a tissue‐based disease and that proliferation is the default state of all cells. The present book verses on the current discussion, between authors writing within the Thomistic tradition, on the issue of human rights, and pretends to adjudicate that discussion. The positions of authors who are critical of the notion of human rights, like Michel Villey and Alasdair MacIntyre, as well as that of those who try to justify their existence and explain their nature, like Jacques Maritain, John Finnis, and others, are carefully explained and evaluated. This book is the first to deal (...) in detail with this contemporary discussion and therefore represents an important contribution to the bibliography on the philosophy of human rights, as well as to the bibliography on the Thomistic tradition. For the last 50 years the dominant stance in experimental biology has been reductionism in general, and genetic reductionism in particular. Philosophers were the first to realize that the belief that the Mendelian genes were reduced to DNA molecules was questionable. Soon, experimental data confirmed these misgivings. The optimism of molecular biologists, fueled by early success in tackling relatively simple problems has now been tempered by the difficulties encountered when applying the same simple ideas to complex problems. We analyze three (...) examples taken from experimental data that illustrate the shortcomings of this sort of reductionism. In the first, alterations in the expression of a large number of genes coexist with normal phenotypes at supra-cellular levels of organization; in the second, the supposed intrinsic specificity of hormonal signals is negated; in the third, the notion that cancer is a cellular problem caused by mutated genes is challenged by data gathered both from the reductionist viewpoint and the alternative view proposing that carcinogenesis is development gone awry. As an alternative to reductionism, we propose that the organicist view is a good starting point from which to explore these phenomena. However, new theoretical concepts are needed to grapple with the apparent circular causality of complex biological phenomena. (shrink)

The somatic mutation theory has been the prevailing paradigm in cancer research for the last 50 years. Its premises are: (1) cancer is derived from a single somatic cell that has accumulated multiple DNA mutations, (2) the default state of cell proliferation in metazoa is quiescence, and (3) cancer is a disease of cell proliferation caused by mutations in genes that control proliferation and the cell cycle. From this compelling simplicity, an increasingly complicated picture has emerged as more than 100 (...) oncogenes and 30 tumor suppressor genes have been identified. To accommodate this complexity, additional ad hoc explanations have been postulated. After a critical review of the data gathered from this perspective, an alternative research program has been proposed. It is based on the tissue organization field theory, the premises of which are that carcinogenesis represents a problem of tissue organization, comparable to organogenesis, and that proliferation is the default state of all cells. When one reads the writings of one of the leading vitalists like Driesch one is forced to agree with him that many of the basic problems of biology simply cannot be solved by a philosophy as that of Descartes, in which the organism is simply considered a machine…. Some authors view the veil of ignorance as a preferred method for allocating resources because it imposes impartiality by stripping deliberators of knowledge of their personal identity. Using some prominent examples of such reasoning in the health care sector, I will argue for the following claims. First, choice behind a veil of ignorance often fails to provide clear guidance regarding resource allocation. Second, regardless of whether definite results could be derived from the veil, these results do not in themselves have (...) important moral standing. This is partly because the veil does not determine which features are morally relevant for a given distributive problem. Third, even when we have settled the question of what features to count, choice behind a veil of ignorance arguably fails to take persons seriously. Ultimately, we do not need the veil to solve distributive problems, and we have good reason to appeal to some other distributive model. (shrink)

This paper examines accounts of the moral wrongness of killing persons in addition to determining what conclusions, if any, can be drawn from the morality of killing persons about the equality of persons, and vice versa. I will argue that a plausible way of thinking about the moral wrongness of killing implies that the permissibility of killing innocent, nonthreatening persons depends on a person’s age. I address objections to this conclusion and discuss some potential implications of the view.

First, we will expose synoptically the core of the legal philosophy that the Chilean thinker develops on his works on the subject, including his conception about philosophy in general , and about legal science in particular . Secondly, we will expose the epistemological suppositions of his legal philosophy , and his consequent conception of law’s essence , the legal rule and its foundation, and (...) the axiological theory that Millas develops on the basis of the distinction and relationship between “is” and “ought” . I argue that the claim that all value is conferred is incompatible with the view that the capacity to set ends is unconditionally valuable. While this objection has been made, I offer a rebuttal and then a counterexample to the rebuttal. I also argue that, if all value were conferred, then the Kantian notion that moral wrongness consists in a practical contradiction is undermined.

El nominalismo es normalmente asociado con una concepción voluntarista de la ley natural, sobre todo por la asociación de ambas doctrinas en la obra de Guillermo de Ockham. Sin embargo, no existe una conexión necesaria entre tales doctrinas, y para mostrar aquello, se expondrá la doctrina de Thomas Hobbes al respecto. En este autor, el nominalismo filosófico, más extremo que el de Ockham, se encuentra asociado a una concepción totalmente necesitarista de la ley natural, hasta el punto de que puede (...) decirse que en Hobbes existe, en materia moral, una inversión de la doctrina ockhamista. En ambos casos hay recurso a Dios, pero en el caso de Ockham, para suministrar el contenido de la ley natural y, en el caso de Hobbes, para garantizar el carácter obligatorio de ésta. (shrink)

David Waldron Smithers was, among other things, a physician and a pioneer of cancer radiotherapy and a well-respected figure in British medicine and public health. From the 1940s until his retirement from medical practice in 1973, he was the director of the Radiotherapy Department at the Royal Marsden Hospital and London University Chair of Radiotherapy at the Institute of Cancer Research. Using massive amounts of clinical observations, which he interpreted from an organicist viewpoint, and his impressive synthetic thinking, he proposed (...) a coherent alternative perspective to the somatic mutation theory (SMT) which was then, and still is, the dominant theory of cancer. The purpose of this essay is to acquaint the modern audience with his seminal paper, published in 1962, because it deserves to be recognized as a true classic. In it, he examined the lack of fit between clinical observations and the SMT and proposed the rejection of this reductionist perspective. In addition, he built an organicist alternative in which carcinogenesis is seen as a problem of biological organization. His conceptual contribution to the cancer problem has inspired us and other authors over the last two decades. His essay “Cancer: An Attack on Cytologism,” originally published in The Lancet in 1962, is available as supplementary material in the online version of this article. (shrink)

The aim of this text is to examine the issue of truth telling in doctor-patient relationships, namely in the case of terminal patients. We analyze the problems and attitudes regarding truth telling that there are present when patients suffer from mortal diseases. We conclude that it is very important to keep a fluent and truthful communication in the doctor-patient relationship. The current environmental crisis can be approached, through many perspectives, as a civilizational crisis. Alternatives of human transcendence are identified in the Inca civilization to compensate for the malaise that characterizes the actual crisis. There is a multicultural dimension to the manifestations of Hoasca occurring in Amazonian countries. As employed by the Beneficent Spiritist Center União do Vegetal in a religious context, it can contribute to the reconstruction of buen vivir, which served as the principle of the civilizations that preceded (...) the colonization of the Americas by Europeans. Today, the State openly confronts the manifestation of the constitutional principles of buen vivir, religious freedom, and the protection of this cultural heritage. Here, the implications of the civilizational crisis and ways of overcoming it are approached from the standpoint of deep ecology, but the implications also reflect the doctrinal vision of the UDV to which the authors are affiliated.
