We examined the dilemmas posed by the involvement of expert witnesses in court cases and the institutional constraints on the ethics of expert testimony. The causes for the incorporation of bad science into legal decisions, potential solutions to this dilemma, and the limitations of these solutions are considered. We concluded that law, science, and experts must respond to the problems posed by expert witnessing.

Psychiatric residents and psychiatrists have little difficulty in making judgments about a clinical course of action to take with patients. However, making ethical clinical decisions is more challenging, because psychiatric residents are usually provided little formal training in ethics. Further, many ethical dilemmas are complex, requiring knowledge of the psychiatric profession's ethics code, moral principles, law, and practice standards and of how they should be weighed in the decision-making process. The purpose of this article is to demonstrate this complexity in (...) regard to the identification of potential ethical dilemmas, understanding the issues that these dilemmas raise, and formulating potential solutions to them. Two common but important areas of treatment in which ethical dilemmas arise (informed consent and competence of care) are used as examples for our presentation. Industry wide ethical issues include conflicting pressures from suppliers and clients, competency requirements for agents and misleading advertising and sales claims (vaporware in industry jargon). Issues with travel suppliers include calculation and payment of commissions, fare loopholes, frequent flyer plans and the use and abuse of benefits directed to individual employees. At its inception innocent of philosophical or metaphysical designs, the Gaia hypothesis of James Lovelock and Lynn Margulis was soon liberated from the precincts of scientific cultivation to enter into cultural free association. Nonetheless, scientific and scholarly attention and debate have long precipitated a bona fide discourse of Gaia theory. Moreover, intellectually serious extra-scientific figures of Gaia have also been on the rise in the last decade. This essay treats a selection of these newer Gaian figures, specifically, Isabelle Stengers’s Gaia (...) the Intruder and Bruno Latour’s secular Gaia, in relation to Lovelock’s Gaia and Lynn Margulis’s evocations of autopoietic Gaia. When nuanced through second-order systems theory, the discourse of autopoietic Gaia satisfies Stengers’s and Latour’s demands for a non-holistic, heterogeneous yet coherent Gaia concept fit for communicative efficacy in the so-called Anthropocene epoch. This paper offers an account of the important role which an obligation to provide reasons can play in avoiding some of the systematic difficulties encountered in the theory of rational social choice. The paper builds on some of the insights offered by theories of structure-induced equilibrium. It argues that the obligation to provide reasons for certain choices, reasons which must be articulated and structured around a set of generally shared and publicly comprehensible categories of thought, can serve to make the (...) space of possible choices "concept-sensitive" in a very useful way. Concept-sensitivity has the effect of restricting certain movements within the choice space so that some of the difficulties for achieving an equilibrium in social choice, difficulties which arise out of an excess of rational doing, are avoided. The resulting equilibrium is path dependent, of course, but because it is dependent on a choice path which "makes sense" (or is ordered by thought precisely because it is concept-sensitive), it is not the sort of arbitrary path dependent social choice which was of such concern to Kenneth Arrow in his original Nobel prize winning work. The paper illustrates its points with examples taken from the law. The law is a method of making social choices which emphasizes (in a very self-conscious way, and one which has no parallel either in politics or the market) the justificatory significance of the obligation to give publicly accountable reasons which attend to those issues arising in an ordered way out of a highly structured adjudicative process. Thus, the paper has as one of its ambitions the bringing together of two accounts of rational decision-making which, to this point at least, have not had much contact, namely, the theory of rational social choice and the theory of legal reasoning. Types are fundamental for conceptual modeling and knowledge representation, being an essential construct in all major modeling languages in these fields. Despite that, from an ontological and cognitive point of view, there has been a lack of theoretical support for precisely defining a consensual view on types. As a consequence, there has been a lack of precise methodological support for users when choosing the best way to model general terms representing types that appear in a domain, and for building sound (...) taxonomic structures involving them. For over a decade now, a community of researchers has contributed to the development of the Unified Foundational Ontology (UFO) - aimed at providing foundations for all major conceptual modeling constructs. At the core of this enterprise, there has been a theory of types specially designed to address these issues. This theory is ontologically well- founded, psychologically informed, and formally characterized. These results have led to the development of a Conceptual Modelling language dubbed OntoUML, reflecting the ontological micro-theories comprising UFO. Over the years, UFO and OntoUML have been successfully employed on conceptual model design in a variety of domains including academic, industrial, and governmental settings. These experiences exposed improvement opportunities for both the OntoUML language and its underlying theory, UFO. In this paper, we revise the theory of types in UFO in response to empirical evidence. The new version of this theory shows that many of OntoUML’s meta-types (e.g. kind, role, phase, mixin) should be considered not as restricted to substantial types but instead should be applied to model endurant types in general, including relator types, quality types, and mode types. We also contribute with a formal characterization of this fragment of the theory, which is then used to advance a new metamodel for OntoUML (termed OntoUML 2). To demonstrate that the benefits of this approach are extended beyond OntoUML, the proposed formal theory is then employed to support the definition of UFO-based lightweight Semantic Web ontologies with ontological constraint checking in OWL. Additionally, we report on empirical evidence from the literature, mainly from cognitive psychology but also from linguistics, supporting some of the key claims made by this theory. Risk propagation encompasses a plethora of techniques for analyzing how risk “spreads” in a given system. Albeit commonly used in technical literature, the very notion of risk propagation turns out to be a conceptually imprecise and overloaded one. This might also explain the multitude of modeling solutions that have been proposed in the lit- erature. Having a clear understanding of what exactly risk is, how it be quantified, and in what sense it can be propagated is fundamental for devising high-quality (...) risk assessment and decision-making solutions. In this paper, we exploit a previous well-established work about the nature of risk and related notions with the goal of providing a proper interpre- tation of the different notions of risk propagation, as well as revealing and harmonizing the alternative semantics for the links used in common risk propagation graphs. Finally, we discuss how these results can be leveraged in practice to model risk propagation scenarios. (shrink)

The development of artificial womb technology is proceeding rapidly and will present important ethical and theological challenges for Christians. While there has been extensive secular discourse on artificial wombs in recent years, there has been little Christian engagement with this topic. There are broadly two primary uses of artificial womb technology—ectogestation as a form of enhanced neonatal care, where some of the gestation period takes place in an artificial womb, and ectogenesis, where the entire gestation period is within an artificial (...) womb. Ectogestation for the latter weeks or months of pregnancy could be possible within a decade or so, while ectogenesis for humans is far more speculative. Ectogestation is likely to significantly decrease maternal and neonatal morbidity and mortality, and so there is a strong case for supporting its development. Ectogenesis, however, may bring a number of challenges, including the commodification of children, and the pathologizing of pregnancy and childbirth. Its long-term effects on those who are created through this process are also unknown. In the event that it becomes ubiquitous, we may also find the central theological significance of pregnancy and birth diminished. The dilemma for Christians is that the development of ectogestation seems likely to normalise the use of artificial gestation, and, in time, pave the way for ectogenesis. (shrink)

Genome editing is revolutionising the field of genetics, which includes novel applications to food animals. Responsible research and innovation has been advocated as a way of ensuring that a wider-range of stakeholders and publics are able to engage with new and emerging technologies to inform decision making from their perspectives and values. We posit that genome editing is now proceeding at such a fast rate, and in so many different directions, such as to overwhelm attempts to achieving a more reflective (...) pace. An alternative location for reflection is during the much slower process of taking products from the lab to market. We suggest emphasising Responsible Innovation, putting the ‘I’ back into RRI, and encouraging companies to embrace an RRI approach. We review some previous attempts at developing industry-relevant frameworks for RRI. We then describe two examples of genome editing in livestock; hornless cattle and disease resistant pigs, and reflect on the sorts of questions that could be considered in these two genome editing examples. This paper seeks to take forward the discussion on RRI by extending it to bringing products to market in the context of genome edited livestock. (shrink)

What is the nature of the decision-related personal values of corporate management? Managers' attitudes and behaviors are built upon their personal value systems (PVS). Knowledge about the structure of management's PVS assists in understanding the attributes of corporate decision making. Utilizing a survey instrument developed and used by England (1967, 1975), this article updates this research into corporate managers' personal value systems. England's PVS consists of sixty-six pre-tested values clustered into five groups. As one could expect with personal values, statistical (...) tests reveal that even with dramatic changes in the business environment the overall personal values structure has not changed over the intervening three decades. The results also reveal that corporate managers retain their pragmatic value orientation as discussed by England. (shrink)

In recent years, there has been an increasing interest in the development of well-founded conceptual models for Service Management, Accounting Information Systems and Financial Reporting. Economic ex- changes are a central notion in these areas and they occupy a prominent position in frameworks such as the Resource-Event Action (REA) ISO Standard, service core ontologies (e.g., UFO-S) as well as financial stan- dards (e.g. OMG’s Financial Industry Business Ontology - FIBO). We present a core ontology for economic exchanges inspired by a (...) recent view on this phenomenon. According to this view, economic exchanges are based on an agreement on the actions that the agents are committed to perform. This view enables a unified treatment of economic exchanges, regardless the object of the transaction. We ground our core ontology on the Unified Foundational Ontology (UFO), discussing its formal and conceptual aspects, instantiating it as a reusable OntoUML model, and confronting it with the REA standard and the UFO-S service ontology. This view enables a unified treatment of economic exchanges, regardless the object of the transaction, and complies with the view that all economictransactions are about services. This ontology has led to the development of an Ontology-Driven Conceptual Modeling language dubbed OntoUML, reflecting the ontological micro-theories comprising UFO. Over the years, UFO and OntoUML have been successfully employed in a number of academic, industrial and governmental settings to create conceptual models in a variety of different domains. (...) These experiences have pointed out to opportunities of improvement not only to the language itself but also to its underlying theory. In this paper, we take the first step in that direction by revising the theory of types in UFO in response to empirical evidence. The new version of this theory shows that many of the meta-types present in OntoUML (differentiating Kinds, Roles, Phases, Mixins, etc.) should be considered not as restricted to Substantial types but instead should be applied to model Endurant Types in general, including Relator types, Quality types and Mode types. We also contribute a formal characterization of this fragment of the theory, which is then used to advance a metamodel for OntoUML 2.0. People of the western world now have unprecedented freedom to choose their religion. In this book, the world's leading sociologist of religion argues that the liberty and freedom to choose religion corrodes faith and that religion remains most vital when it is part of ethnic and national identity.

Certainly one of the key German philosophers of the twentieth century, Hans-Georg Gadamer also influenced the study of literature, art, music, sacred and legal texts, and medicine. Indeed, while much attention has been focused on Gadamer's writings about ancient Greek and modern German philosophy, the relevance of his work for other disciplines is only now beginning to be properly considered and understood. In an effort to address this slant, this volume brings together many prominent scholars to assess, re-evaluate, and question (...) Hans-Georg Gadamer's works, as well as his place in intellectual history. The book includes a recent essay by Gadamer on "the task of hermeneutics," as well as essays by distinguished contributors including Jürgen Habermas, Richard Rorty, Gerald Bruns, Georgia Warnke, and many others. The contributors situate Gadamer's views in surprising ways and show that his writings speak to a range of contemporary debates—from constitutional questions to issues of modern art. A controversial final section attempts to uncover and clarify Gadamer's history in relation to National Socialism. More an investigation and questioning than a celebration of this venerable and profoundly influential philosopher, this collection will become a catalyst for any future rethinking of philosophical hermeneutics, as well as a significant starting place for rereading and reviewing Hans-Georg Gadamer. This text addresses the issue of women's human rights and defends their sensitive or receptive application to the socio-political context. The value of women's human rights is recognized as instruments of social transformation, but also the limitations of a legal-legalistic conception. A broader political conception is required. Following Ch. Beitz, who defines human rights as global discursive and political practices whose objective is to regulate the behaviour of States and protect human interests, a non sceptical criticism of this conception is (...) made. The application of the human rights of women by States without considering the previous social and political structure can unintentionally reinforce the situation of oppression they suffer. In this sense, it is committed to the need to focus the human rights of women not only as protections, but also as demands. Demands that come from new forms of feminist activism such as decolonial or antineoliberal. Without renouncing the idea of women's human rights, it is committed to an application sensitive to claims and critical of the social and political context, combining short-range affirmative policies with long-range transformative policies. Interpretation and politics merge in one the famous story of Joseph's power of dream interpretation in the Hebrew Bible. Rome's College of Augurs reinforces the entwinement of interpretation, power, religion, and folklore that one can also find in the earlier context of the Delphic Oracle. Augury reminds us that understanding happens in the context of an event, a context that presupposes one is missing something, lacking the necessary vision or foresight, and help is called for. Most of the contemporary scholars (...) who write about philosophical hermeneutics, the tradition which includes Martin Heidegger and Hans‐Georg Gadamer, are allergic to politics in the proletarian sense of that word. Party politics and parliamentarian procedures receive almost no attention in the secondary literature on contemporary hermeneutics. Assertion about the political incompetence of philosophy opens the door to an esoteric tradition in philosophy that includes Plato's “secret doctrine”, and stretches back to Pythagoras and Heraclitus. The Greek god Hermes, the messenger and god of thieves, the giver of laws and the alphabet, is a key figure for thinking about the relationship between hermeneutics and rhetoric. The philosophers have been able to cloak their distaste for people in general, evident most tellingly in Plato's allegory of the cave. On more familiar rhetorical territory, Nancy Worman in Abusive Mouths in Classical Athens reminds Aristotle's distaste for audiences. The ancient rhetoricians recognized the importance of appearances, and for obvious (...) reasons emphasized in their treatises that they wanted orators to be virtuous and morally upright people. In most kinds of legal and scriptural interpretation, authors build cases from precedent. As a way to capture the salient features of this intersection of hermeneutics and rhetoric, the reader could conjure up the differences in biblical hermeneutics between Moses Maimonides (1135–1204) and Baruch Spinoza (1632–1677). The purpose of this work is to propose a sociological reading that includes the pós/des-colonial perspective in the Bible interpretation process. One of the main critics accomplished by the pós/des-colonial perspective is the Eurocentrism’s influence. It affirms that European methods should not be used as a rule for the Latin-American’s context and that the sociological reading, mainly developed based on Marx and Weber, was enough to explain our reality. Then, I present a short historical of Bible’s sociological reading and the (...) absence of relevant elements to be included by the pós/des-colonial perspective. In a second moment, it will be presented the pós/des-colonial reflection and their main contributions for the sociological method of reading the Bible. The intention is to propose a sketch of pós/des-colonial hermeneutics. In conclusion, I present a sociological interpretation’s exercise of the Bible in a post/de-colonial perspective. (shrink)
