John Rawls, father of contemporary distributive justice, professed the metaphysical neutrality of his theory, and formulated an additional theory to support such neutrality generally. This article exposes Rawls’s own theological underpinnings concerning his conception of the moral arbitrariness of existence, and his structural dichotomous approach for engaging it. I show how both of his theories are reminiscent of Calvin, employing methods of bifurcation, and thus generating tensions within both the concept of justice and moral personality. I end with analysis of (...) the relationship of this structural rationality to arbitrariness. This exposure of Rawls’s theological debt is part of a wider argument concerning the theological basis of distributive justice theory, and the relevance of Theology for philosophical ethics. Luck egalitarianism is an approach within current distributive justice theory which aims to focus redistributive efforts solely upon disadvantages that ensue from bad luck. This article considers how central assumptions and themes of both luck egalitarianism and its critics parallel those of providence theology and share some of their concerns. These relate to problems such as the basis of equality, the extent and nature of our knowledge, and of course, the paternalism that assessing people’s responsibility over their own disadvantages involves. I highlight the similarity of luck egalitarianism to the role of providence and providence theory thinking, and particularly the tension between egalitarianism as a theological concept and the condescension inherent to imitatio Dei ethics. I approach these issues by analyzing standard criticisms of the luck egalitarian project, espoused by Susan Hurley and Elizabeth Anderson. I then proceed to assess the values of luck egalitarianism itself and consider different models of providence, and the meaning of this analysis for normative ethics. The subject matter of this article is part of a wider comparison of distributive justice and providence theory, within which luck egalitarianism affords a very fruitful and highly relevant case study. This article argues that the religious epistemology of the rabbinic tradition, which preserves and respects multiple perspectives in intellectual debate, is best understood in comparison to the definitions of truth proposed by philosophical pragmatists, in particular William James and W. V. Quine, and in contrast to those of philosophical liberals, in particular J. S. Mill. Both the rabbis and the pragmatists emphasize the harmony that innovation must maintain with extant webs of meaning. Conceptions of objectivity and subjectivity in Jewish medieval (...) rationalism and in early modern mysticism are considered and compared with those of latter-day European and American epistemology. This article makes a case for a fundamentally pluralistic conception of truth and argues that it is exemplified in the social interaction of the talmudic sages. (shrink)

Distributive justice assumes a morally critical judgment of nature, which typically contradicts providential conceptions. Hence, simple conceptions of divine Providence cannot support distributive justice. This essay analyzes and develops a complex strand of theorizing about Providence within Jewish philosophy that is compatible with distributive justice. According to this conception, the actions of divine Providence express different and mutually exclusive considerations of justice. Therefore, the moral value of outcomes is intransitive between the situations of different people. And while each providential action (...) is justified from an ethical perspective, the total outcome is distinct from God's ultimate desire. Human ethics responds to this disparity by redistribution. This conception of Providence also contributes to the additional issue of intergenerational justice through the concomitant idea of life missions. The classical rendering of missions creates problems, however, for distributive justice. I conclude by formulating a conception of life missions that is compatible with both distributive and intergenerational justice. (shrink)

Alan Turing’s 1950 imitation game has been widely understood as a means for testing if an entity is intelligent. Following a series of papers by Diane Proudfoot, I offer a socio-technological interpretation of Turing’s paper and present an alternative way of understanding both the imitation game and Turing’s concept of intelligence. Turing, I claim, saw intelligence as a social concept, meaning that possession of intelligence is a property determined by society’s attitude toward the entity. He realized that as long as (...) human society held a prejudiced attitude toward machinery—seeing machines a priori as mindless objects—machines could not be said to be intelligent, by definition. He also realized, though, that if humans’ a priori, chauvinistic attitude toward machinery changed, the existence of intelligent machines would become logically possible. Turing thought that such a change would eventually occur: He believed that when scientists overcome the technological challenge of constructing sophisticated machines that could imitate human verbal behavior—i.e., do well in the imitation game—humans’ prejudiced attitude toward machinery will have altered in such a way that machines could be said to be intelligent. The imitation game, for Turing, was not an intelligence test, but a technological aspiration whose realization would likely involve a change in society’s attitude toward machines. (shrink)

If we arrange in chronological order the various statements Darwin made about God, creation, design, plan, law, and so forth, that I have discussed, there emerges a picture of a consistent development in Darwin's religious views from the orthodoxy of his youth to the agnosticism of his later years. Numerous sources attest that at the beginning of the Beagle voyage Darwin was more or less orthodox in religion and science alike.78 After he became a transmutationist early in 1837, he concluded (...) that the doctrine of secondary causes must be extented even to the history of life and that after the first forms of life were created, there was no further need for divine intervention, except where man was concerned. Man's body, he thought, was produced by the process of transmutation, but he believed for a time that man's soul was “superadded.” By mid-1838 he had become convinced that nothing, after the creation of life, was due to miracles. God works only through laws, which are capable of producing “every effect of evey kind which surrounds us.” The existence of man, the idea of God in man's mind, and the harmony of the whole system were in his eyes prearranged goals of deterministic laws imposed by God. Such a conception excludes the miracles on which Christianity depends; but it is not possible to say whether Darwin's loss of Christian faith, which occurred at about this same time, preceded and made possible his “materialism” or was rather caused or hastened by it.79 In the weeks after his reading of Malthus, Darwin's belief in a plan of creation gave way to the belief that God created matter and life and designed their laws, leaving the details, however, to the workings of chance. This remained his view until the 1860s.There is no exact parallel between this development of Darwin's religious views and the development of his ideas on evolution, but there is a general correspondence. When he believed in a plan of creation, Darwin's theory of transmutation did not depend on struggle or the selection of chance variations. Adaptation was, for him, an automatic response to environmental chance. From late 1838 to 1859 he believed in designed laws and chance, and this belief, too, has its parallel in his theory. The element of chance in natural selection meant that there could be no detailed plan,in which even man's idea of God would be a necessary outcome of nature's laws (man himself is not a necessary outcome of the working of natural selection).80 But Darwin still believed nature was programmed to achieve certain general ends. We might say that he believed in a general, though not a special, teleology. Natural selection was for him a law to maximize utility, creating useful organs, retaining vestiges for future use. For many years it was a law designed to produce organisms perfectly adapted to their environments. Only later did Darwin come to doubt even this sort of design in nature.81 One way of describing the development of Darwin's evolutionary thought is to say that it shows a gradual abandoning of his “theistic” assumptions, so that by the late 1860s his theory was informed to a slighter extent by notions of purpose and design than it was in 1838 or 1844 or 1859. Libertarian paternalism's notion of “nudging” refers to steering individual decision making so as to make choosers better off without breaching their free choice. If successful, this may offer an ideal synthesis between the duty to respect patient autonomy and that of beneficence, which at times favors paternalistic influence. A growing body of literature attempts to assess the merits of nudging in health care. However, this literature deals almost exclusively with health policy, while the question of the potential benefit of nudging (...) for the practice of informed consent has escaped systematic analysis. This article focuses on this question. While it concedes that nudging could amount to improper exploitation of cognitive weaknesses, it defends the practice of nudging in a wide range of other conditions. The conclusion is that, when ethically legitimate, nudging offers an important new paradigm for informed consent, with a special potential to overcome the classical dilemma between paternalistic beneficence and respect for autonomy. In the biblical Book of Ruth, Boaz instructs his workers not to molest Ruth. We draw insights on the problem of workplace sexual harassment in the family-firm setting from the Book of Ruth. We then integrate these insights with several discrete findings in the literatures on workplace sexual harassment and family firms: First, family firms are relatively strong when it comes to a culture of fairness and respect. Second, family firms sometimes lack formal codes of ethics, which could hamper integrity. (...) Third, religious exemplars can reinforce the positive culture of family firms and even substitute for a formal code of ethics. ABSTRACTThis paper introduces the category of ‘non-deceptive manipulation that causes false beliefs’, analyzes how it narrows the traditional scope of ‘deception’, and draws moral implications.

We reviewed 272 phase I oncology trial consent forms and then created an improved informed consent template in both English and Spanish by redesigning and rewording the consent form to be specific to phase I trials, to avoid repetition, and to use simplified language, identifiable sections framed by first-person questions, and tables to present information. The resulting consent form template is shorter than average and considerably easier to read . The template also meets the recommended eighth-grade maximum reading level for (...) consent forms. “de-extinction” refers to the process of resurrecting extinct species by genetic methods. This science-fiction-sounding idea is in fact already in early processes of scientific implementation. Although this recent “revival of the dead” raises deep ethical questions, the ethics of de-extinction has barely received philosophical treatment. Rather than seeking a verdict for or against de-extinction, this paper attempts an overview and some novel analyses of the main ethical considerations. Five dimensions of the ethics of de-extinction are explored: (a) the possible contribution (...) of de-extinction to promoting ecological values, (b) the deontological argument that we owe de-extinction to species we rendered extinct, (c) the question of “playing God” through de-extinction, (d) the utilitarian perspective, and (e) the role of aesthetic considerations in the ethics of de-extinction. A general feature arising from the paper’s discussion is that, due to de-extinction’s special character, it repeatedly tests the limits of our ethical notions. (shrink)

The nocebo effect, the mirror-phenomenon to the placebo effect, is when the expectation of a negative outcome precipitates the corresponding symptom or leads to its exacerbation. One of the basic ethical duties in health care is to obtain informed consent from patients before treatment; however, the disclosure of information regarding potential complications or side effects that this involves may precipitate a nocebo effect. While dilemmas between the principles of respect for patient autonomy and of nonmaleficence are recognized in medical ethics, (...) there has not yet been an ethical discussion focused on the potential dilemma raised by the nocebo effect of informed consent. This dilemma is especially pernicious, since it involves a direct causality of harm by the caregiver that is unparalleled by other potential harmful effects of information disclosure. A longstanding debate exists in both academic literature and popular culture about whether non-informative marketing tactics are manipulative. However, given that we tend to believe that some marketing tactics are manipulative and some are not, the question that marketers, their critics, and consumers need to ask themselves is that of how to actually determine whether any particular marketing tactic is manipulative and whether a given manipulative tactic is, in fact, immoral. This article proposes to operationalize criteria that can be used (...) by marketers for making such determinations and attempts to provide some clarification toward our under- standing of the concept of manipulation and the conditions for the moral acceptability of manipulative marketing practices. It argues that a marketing tactic is manipulative if it is intended to motivate by undermining what the marketer believes is his/her audience’s normal decision-making process either by deception or by playing on a vulnerability that the marketer believes exists in his/her audience’s normal decision-making process. Such a tactic is morally objectionable on several grounds, which make it morally impermissible unless outweighed by sufficient “redemptive” moral considerations. (shrink)

Earlier investigations of the hormonal control of vitellogenin (egg‐yolk protein) synthesis in mosquitoes relied on microsurgical manipulations to identify organs that secrete the various hormones that stimulate or inhibit vitellogenesis. Advances in the last 10 years, using radioimmunoassays, HPLC, mass spectrometry and tissue‐culture incubations, have shown that the control mechanism involves a complex interaction between ecdysteroids, juvenile hormones and peptide hormones.

Culture and social structure may affect the testosterone–behavior link by shaping the way we construe events; by muting, channelling, or amplifying the drives that testosterone produces; and by affecting the distribution and level of testosterone in various parts of the population. Research on testosterone, culture, and social class has produced suggestive results, opening broad areas for research.

This paper investigates modular combinations of temporal logic systems. Four combination methods are described and studied with respect to the transfer of logical properties from the component one-dimensional temporal logics to the resulting combined two-dimensional temporal logic. Three basic logical properties are analyzed, namely soundness, completeness, and decidability. Each combination method comprises three submethods that combine the languages, the inference systems, and the semantics of two one-dimensional temporal logic systems, generating families of two-dimensional temporal languages with varying expressivity and varying (...) degrees of transfer of logical properties. The temporalization method and the independent combination method are shown to transfer all three basic logical properties. The method of full join of logic systems generates a considerably more expressive language but fails to transfer completeness and decidability in several cases. So a weaker method of restricted join is proposed and shown to transfer all three basic logical properties. (shrink)

This paper presents a new approach to the demarcation of social emotions, based on their dependence on social appraisals that are designed to assess events bearing on social concerns. Previous theoretical attempts to characterize social emotions are compared, and their inconsistencies highlighted. Evidence for the present formulation is derived from theory and research into links between appraisals and emotions. Emotions identified as social using our criteria are also shown to bring more consistent consequences for social behavior than nonsocial emotions.
