Research teams have used extra-uterine systems to support premature fetal lambs and to bring them to maturation in a way not previously possible. The researchers have called attention to possible implications of these systems for sustaining premature human fetuses in a similar way. Some commentators have pointed out that perfecting these systems for human fetuses might alter a standard expectation in abortion practices: that the termination of a pregnancy also entails the death of the fetus. With Biobags, it might be (...) possible, some argue, that no woman has the right to expect that outcome if the technology is able to sustain fetal life _after_ an abortion. In order to protect the expectation that the termination of a pregnancy always entails the death of the fetus, Elizabeth Romanis has argued that fetuses sustained in Biobags have a status different than otherwise ‘born’ children. In support of that view, she argues that these ‘gestatelings’ are incapable of independent life. This argument involves a misunderstanding of the gestational support involved, as well as a misapprehension of neonatology practice. Here, we argue that any human fetus sustained in a Biobag would be as ‘independent’ as any other premature infant, and just as ‘born’. Neonatologists would seem to have certain presumptive moral responsibilities toward any human fetus gestating in a Biobag. It remains a separate question whether the perfection and widespread application of Biobags for premature human beings would or should alter the expectation that ending a pregnancy also entails fetal death. Sullivan surveys the philosophical problem-areas surrounding multiculturalism as an ideology of group-identity. While endorsing the claims of underrepresented minorities for recognition, the article sides with traditionalists in prioritizing the autonomy of the self-fashioning individual over ethnic or cultural affiliations. The multicultural challenge to Western logocentrism, its assertion of the implicit power structures embedded in truth claims, and the excesses of postmodern relativism are all subjected to measured criticism. Finally, the essay examines Habermas' role in postwar Germany's embrace of multiculturalism as (...) a national platform of reinvention, and as a means to negate the trauma of the monocultural chauvinism of the Nazi era. However, Sullivan argues, it has taken cosmopolitanism too far. In this article, I consider a number of arguments that assume that beings who have immortal souls occupy a special position in the sphere of moral concern. First, I place these arguments in their historical and cultural contexts. Next, I formulate several conditions of adequacy that all such arguments must satisfy. Subsequently, I distinguish two different general kinds of such arguments: Inclusionary arguments attempt to use the immortality of soul as a criterion for either including someone into a sphere of (...) morality while excluding others or, at least, for elevating someone's position within this sphere. Modifying arguments attempt to strengthen or weaken moral considerations that already apply to a being included into the sphere of morality. I argue that, although some modifying arguments may fulfill all conditions of adequacy, they have very little practical importance. (shrink)

This is an English translation of Swieżawski’s original article titled “Początki nowożytnego arystotelizmu chrześcijańskiego,” published in Roczniki Filozoficzne 19 (1971): 41–56. The paper focuses on four main topics: (a) increased theological standing of Aristotle in the 15th century; (b) critical concerns over the compatibility of Aristotle’s philosophy with Christianity, as well as over its interpretation by Averroes; (c) search for the “historical Aristotle” and an objective assessment of the resultant interpretations of Aristotle’s philosophy; (d) identification of Thomism with Christian Aristotelianism.

In this essay, I develop a moderate hierarchical position about the moral status of animals that is based on two factors: on the level of mental development of a being who is affected and on the significance of the interests that are affected. I argue that this view accommodates two different sets of moral intuitions. On one hand, it explains why, in general, humans have the special moral standing that is typically attributed to us. On the other hand, it also (...) allows us to accommodate much of our intuition about how animals ought to be treated. In addition, this view is supported also by plausible general theoretical considerations. Subsequently, I explore some implications of this view for some real-life examples of our interactions with animals, especially, for the practice of raising them for food using industrial methods. I argue that this practice is morally wrong and that the correct approach is to adopt a (nearly) plant-based lifestyle. (shrink)

Ultimately, this affects the natural interplay between privacy, personal identity and identification. This book investigates that interplay from a systemic, socio-technical perspective by combining research from the social and computer sciences. It sheds light on the basic functions of privacy, their relation to identity, and how they alter with digital identification practices. The analysis reveals a general privacy control dilemma of (digital) identification shaped by several interrelated socio-political, economic and technical factors. Uncontrolled increases in the identification modalities inherent to digital (...) technology reinforce this dilemma and benefit surveillance practices, thereby complicating the detection of privacy risks and the creation of appropriate safeguards. Easing this problem requires a novel approach to privacy impact assessment (PIA), and this book proposes an alternative PIA framework which, at its core, comprises a basic typology of (personally and technically) identifiable information. This approach contributes to the theoretical and practical understanding of privacy impacts and thus, to the development of more effective protection standards. Polish philosophy of science has been the beneficiary of three powerful creative streams of scientific and philosophical thought. First and fore­ most was the Lwow-Warsaw school of Polish analytical philosophy founded by Twardowski and continued in their several ways by Les­ niewski, Lukasiewicz, and Tarski, the great mathematical and logical philosophers, by Kotarbinski, probably the most distinguished teacher, public figure, and culturally influential philosopher of the inter-war and post-war period, and by Ajdukiewicz, the linguistic philosopher who was intellectually sympathetic with (...) the anti-irrationalist (as he would say), logistic and meta-theoretical inquiries of the Vienna Circle. Second was independent and lively Polish Marxism, with its fine development of social research under Krzywicki, a social anthropologist and younger contemporary of Engels, and then after the war the economist Lange, the philosophers Schaff, Kolakowski, Baczko, and many others. Finally there has been a wide range of philosophical, scientific and humanistic scholar­ ship which lends its various qualities to the understanding of both the logic of science and the historical situation of the sciences: we mention only that great and humane physicist Infeld, the phenomenologist with deep epistemological interest Ingarden, the historian of scientific ideas Zawirski, the historian of philosophy and aesthetics Tatarkiewicz, and the mathematical logicians such as Mostowski and Szaniawski. Background: SNOMED CT is a large terminology system designed to represent all aspects of healthcare. Its current form and content result from decades of bottom-up evolution. Due to SNOMED CT’s formal descriptions, it can be considered an ontology. The Basic Formal Ontology (BFO) is a foundational ontology that proposes a small set of disjoint, hierarchically ordered classes, supported by relations and axioms. In contrast, as a typical top-down endeavor, BFO was designed as a foundational framework for domain ontologies in the (...) natural sciences and related disciplines. Whereas it is mostly assumed that domain ontologies should be created as extensions of foundational ontologies, a post-hoc harmonization of consolidated domain ontologies in use, such as SNOMED CT, is known to be challenging. Methods: We explored the feasibility of harmonizing SNOMED CT with BFO, with a focus on the SNOMED CT Clinical Finding hierarchy. With more than 100,000 classes, it accounts for about one third of SNOMED CT’s content. In particular, we represented typical SNOMED CT finding/disorder concepts using description logics under BFO. Three representational patterns were created and the logical entailments analyzed. Results: Under a first scrutiny, the clinical intuition that diseases, disorders, signs and symptoms form a homogeneous ontological upper-level class appeared incompatible with BFO’s upper-level distinction into continuants and occurrents. The Clinical finding class seemed to be an umbrella for all kinds of entities of clinical interest, such as material entities, processes, states, dispositions, and qualities. This suggests the conclusion that Clinical finding would not be a suitable upper-level class from an BFO perspective. On closer inspection of the taxonomic links within this hierarchy and the implicit meaning derived thereof, it became clear that Clinical finding classes do not characterize the entity (e.g. a fracture, allergy, tumor, pain, hemorrhage, seizure, fever) in a literal sense but rather the condition of a patient having that fracture, allergy, pain etc. This gives sense to the current characteristic of the Clinical Finding hierarchy, in which complex classes are modeled as subclasses of their constituents. Most of these taxonomic links are inferred, as the consequence of the ‘role group’ design pattern, which is ubiquitous in SNOMED CT and has often been subject of controversy regarding its semantics. Conclusion: Our analyses resulted in the proposal of (i) equating SNOMED CT’s ‘role group’ property with the reflexive and transitive BFO relation ‘has occurrent part’; and (ii) reinterpreting Clinical Findings as Clinical Occurrents, i.e. temporally extended entities in an organism, having one or more occurrents as temporal parts that occur in continuants. This re-interpretation was corroborated by a manual analysis of classes under Clinical Finding, as well as the identification of similar modeling patterns in other ontologies. As a result, SNOMED CT does not require any content redesign to establish compatibility with BFO, apart from this re-interpretation, and a suggested re-labeling. Regarding the feasibility of harmonizing terminologies with principled foundational ontologies post-hoc, our results provide support to the assumption that this does not necessarily require major redesign efforts, but rather a careful analysis of the implicit assumptions of terminology curators and users. Looking at the world through the window of opportunity costs directs attention to the good forgone rather than the good done by our decision making. In the paper it is illustrated by means of several examples that it may be useful for judicial decision makers to be better aware of this aspect of their choices. When they decide in favor of the realization of some good they should not neglect the shadow of the good that is thereby not done. Such (...) implications of living in a world of scarcity are driven home on the level of law enactment (de lege ferenda) as well as in the interpretation and application of the law (de lege lata) in our discussion of opportunity costs and the law. In their recent paper Bi-facial truth: a case for generalized truth values Zaitsev and Shramko [7] distinguish between an ontological and an epistemic interpretation of classical truth values. By taking the Cartesian product of the two disjoint sets of values thus obtained, they arrive at four generalized truth values and consider two “semi-classical negations” on them. The resulting semantics is used to define three novel logics which are closely related to Belnap’s well-known four valued logic. A syntactic characterization of these (...) logics is left for further work. In this paper, based on our previous work on a functionally complete extension of Belnap’s logic, we present a sound and complete tableau calculus for these logics. It crucially exploits the Cartesian nature of the four values, which is reflected in the fact that each proof consists of two tableaux. The bi-facial notion of truth of Z&S is thus augmented with a bi-facial notion of proof. We also provide translations between the logics for semi-classical negation and classical logic and show that an argument is valid in a logic for semi-classical negation just in case its translation is valid in classical logic. We have found that proposals addressing the old cosmological constant problem come in various categories. The aim of this paper is to identify as many different, credible mechanisms as possible and to provide them with a code for future reference. We find that they all can be classified into five different schemes of which we indicate the advantages and drawbacks.

Das Thema Staatstheorien bezieht sich auf eines der wichtigsten Gebiete der staatsbürgerlichen Erziehung und damit der stabilen freiheitlich-demokratischen Grundordnung überhaupt. Staatstheo-rien sind in verschiedenen Ausprägungen vorhanden und insofern sind Selektionskriterien und Begründungen erforderlich. Die Staats-theorien der Aufklärung werden zu Recht als maßgeblicher Ein-flussfaktor der heutigen westlichen Demokratieformen gesehen. Innerhalb der Aufklärung gibt es eine Kanonbildung der Vertrags- und Staatstheorien: Hobbes, Locke, Montesquieu und Rousseau besitzen seit geraumer Zeit einen festen Platz darin. Zwischen Demokratie und politischer Bildung herrscht ein enger und (...) systematischer Zusammenhang. Demokratie bedeutet dabei gleichzeitig Lebens-, Gesellschafts- und Herrschaftsform. Nicht zu-letzt aus dieser fundamentalen und umfassenden Bedeutung für das Zusammenleben in unserer Gesellschaft rechtfertigt sich die Relevanz des Themas Staatstheorien als Gegenstand einer wissen-schaftlichen Abhandlung. Den Leserinnen und Lesern soll die exorbitante Relevanz des The-mas für unser heutiges gesellschaftspolitisches Zusammenleben vor Augen geführt werden. (shrink)

It is one of the crucial insights of pragmatism that our judging is itself a discursive practice. Our judgments are normatively determined performances for which we are responsible. Therefore, judgments are a species of action. For in both actions and judgments, we subject ourselves and others to justifiable norms. Since these insights can already be found in Hegel, Hegel is now often interpreted as a champion of pragmatism. Hegel’s logic is thereby mainly understood as the continuation of the Kantian project (...) of transcendental philosophy. Based upon this pragmatist interpretation of Hegel, the paper reads F. H. Jacobi’s philosophy as an alternative pragmatism which is explicitly founded on our life praxis rather than our practice of judgment. (shrink)

In this paper, I outline and defend an alternative to Hartian legal theory that accepts the Hartian theory of a legal system yet rejects the Hartian theory of legal content in favor of a non-positivist alternative. I call this the- ory the justificatory view. A key argument advanced here in support of the justificatory view relies on the problem of theoretical disagreement that Ronald Dworkin poses for Hartian positivism. Moreover, I argue that a vir- tue of the justificatory view is (...) that its hybrid nature shields it from the forceful criticism that Brian Leiter marshals against Dworkin’s legal theory. As Leiter observes, though Dworkin’s legal theory may do better than posi- tivism with respect to explaining the marginal phenomenon of theoretical disagreement among legal officials, Dworkinian legal theory suffers the much greater failing of being unable to explain the background of massive decisional agreement characteristic of legal systems. I argue that because the justificatory view accepts and rests upon the Hartian theory of a legal system, it is no less able than Hartian legal theory to explain this back- ground of massive decisional agreement.Resumen:En este artículo esbozo y defiendo una alternativa a la teoría jurídica hartiana, que si bien acepta la teoría hartiana del sistema jurídico, re- chaza sin embargo la teoría hartiana del contenido jurídico y aboga por una alternativa no-positivista. Llamo a esta teoría la postura de justificación. Un argumento clave para defender la postura de justificación se erige sobre el problema del desacuerdo teórico que Ronald Dworkin formuló al positivismo hartiano. Además, sostengo que una de las virtudes de esta postura de justificación es que su naturaleza híbrida la protege de las enérgicas críticas que plantea Brian Leiter contra la teoría jurídica de Dworkin. Como observa Leiter, aunque la teoría jurídica de Dworkin sea más consistente que la teoría positivista para explicar el fenómeno marginal de los desacuerdos teóricos entre los oficiales del derecho, la teoría dworkiniana padece mucho más el problema de no poder explicar el contexto de acuerdos masivos en las decisiones que caracterizan a un sistema jurídico. Y esto lo sostengo porque la postura de justificación acepta y se basa en la teoría hartiana del sistema jurídico; por ello es igual de capaz que la teoría jurídica de Hart de explicar este contexto de decisiones que gozan de un acuerdo masivo. This chapter discusses some of the central theoretical perspectives on culture and cultural practices implied in Pragmatism and interactive constructivism. The first part of the chapter highlights three major perspectives on cultural theory to be found in Dewey's thought: culture and experience, culture and habit, and culture and communication. The chapter then compares basic conceptual tools and interpretive approaches and shows that Dewey's work continues to provide fundamental resources in this field. Through this connection, it presents a brief introduction to (...) theories of discourse and power and discusses some implications for current controversies regarding multiculturalism. It argues that Dewey's Pragmatism and the Cologne program of interactive constructivism share a robust interest in culture and cultural diversity. (shrink)

In this paper we analyse how risk factors in highly industrialised agriculture are connected to animal neglect. With Danish agriculture as a case study, we use two types of data. First, we use register data from Statistics Denmark to map how risk factors such as farmers’ financial and social troubles are connected to convictions of neglect. Second, we analyse narratives where interviewed farmers, involved in cases of neglect, describe how they themselves experienced the incidents. We find that while livestock farmers (...) in general have a low risk of animal neglect problems, a small percentage of them face severe financial difficulties, divorce and psychiatric problems, which are connected to an increased risk of being convicted for the neglect of farm animals. The narratives bring forward themes of pressure related to financial trouble, technological break down, family problems, stress and a growing concern among the farmers towards the governmental control in farm animal production. We discuss how these factors can be used to identify and help farmers with a high risk of being convicted of livestock neglect. (shrink)

Sensory augmentation challenges current societal norms and views of what is conceived as a “normal” human being. Beginning with self reflections of a bodyhacker, the author proposes an extended view onto the human or respectively cyborg body. Based on cognitive theories, it is argumented that we are already mental cyborgs. Our brains plastically restructure themselves in order to meet new requirements of the technological extended human.

Post-translational histone modifications and their biological effects have been described as a ‘histone code’. Independently, Barbieri used the term ‘organic code’ to describe biological codes in addition to the genetic code. He also provided the defining criteria for an organic code, but to date the histone code has not been tested against these criteria. This paper therefore investigates whether the histone code is a bona fide organic code. After introducing the use of the term ‘code’ in biology, the criteria a (...) putative organic code such as the histone code must conform to in order to be recognised as an organic code are described. Our current knowledge of histones and their major post-translational modifications, and the specific protein binding domains that recognise and translate these into specific biological effects, is then reviewed in detail. The histone modification system is then placed in the context of an organic code and it is concluded that it fulfils all the requirements of an organic code. The marks produced on histones by processes such as acetylation and methylation act as organic signs that are translated into unique biological effects, their biological meanings. These translations are accomplished by effector proteins that consist of a binding domain that recognises a specific histone mark and a regulatory domain that mediates the biological effect. Crucially, these domains can be experimentally interchanged between different effector proteins, thus altering the rules that specify the relationships between sign and meaning. The effector proteins therefore fulfil the role of adaptor molecules. (shrink)

In this paper we explore a new way to deal with social inequality and injustice in an educational way. We do so by offering a particular reading of a scene taken from Minnelli's film The Band Wagon which is often regarded as overly western-centred and racist. We argue, however, that the way in which words and movements in this scene function are expressive of an event that can be read as a new beginning and that it is for this reason (...) in and of itself educational. By drawing on Agamben's and Cavell's insights on childhood and what it means to acquire a language, we argue that in this scene a form of childhood is displayed which denotes a general condition for education to take place in children and grown-ups alike. Hence, education can be understood as a interruption of existing power structures and as a transformation of one's existence. (shrink)

Der Unterricht in Medizinethik soll Medizinstudierenden die Grundlagen dafür vermitteln, in ihrer zukünftigen ärztlichen Tätigkeit gute Entscheidungen treffen zu können. Im Rahmen einer Panelstudie wird derzeit die Entwicklung moralischer Positionen, medizinethischer Kenntnisse und Motivationen von Medizinstudierenden der Ludwig-Maximilians-Universität München über den Verlauf des Studiums untersucht. Für die Datenerhebung wurde ein Fragebogen entwickelt, der medizinethische Positionen und Kenntnisse sowie Motivationen erfasst. Im Wintersemester 2009/10 wurde die erste Querschnittsuntersuchung mit Studierenden im 1., 3. und 8. Semester sowie im Praktischen Jahr durchgeführt. Die (...) Mehrzahl der Befragten verfügte über einen geringen Kenntnisstand in verschiedenen Themenbereichen des Unterrichtsfachs GTE. Rechtliche Grundlagen und praktische Umsetzung von Therapiebegrenzungsmaßnahmen waren bis ins PJ-Semester vielen Studierenden nicht bekannt. Im Verlauf des Studiums veränderten sich die Motivationen weg von der Motivation, Menschen helfen zu wollen, hin zu Wissenserwerb und dem Ergreifen eines sicheren Berufs. Obwohl viele Befragte ein hohes Interesse an medizinethischen Fragestellungen und Unterricht im Bereich GTE angaben, zeigte sich kein nachhaltiger Zuwachs an medizinethischen Kenntnissen im Laufe des Studiums. In der Zusammenschau werfen die Ergebnisse die Frage auf, inwieweit verschiedene Ausbildungskonzepte Einfluss auf die individuelle ethische Entwicklung Medizinstudierender nehmen können. Eine Untersuchung dieser Fragestellung bleibt Gegenstand weitergehender Forschung. (shrink)
