The act of iudicare hostes (‘declare public enemy’) was a formal pronouncement of the Roman Senate, voted for the first time in 88 BCE following a proposal by L. Cornelius Sulla after his first march on Rome. Legal historians have generally interpreted it as an emergency measure intended to preserve legality in a situation of civil strife and viewed it as a consistently defined institutional framework throughout the final decades of the Republic. Through an analysis of Sulla’s performative political communication, (...) before, during and in the immediate aftermath of the march, this paper argues that the act of judging (iudicare) someone a public enemy (hostis publicus) was first deployed as a political action, void of legal effects. Later instances of iudicare suggest that this act underwent a process of institutionalization after 63 BCE. (shrink)

Stakeholder engagement and dialogue have a central role in defining the relations between organisations and their internal and external interlocutors. Drawing upon the analysis of dialogic motifs, power–conflict dynamics and sociopolitical perspectives, and based on a set of interviews with the stakeholders of a consumer-owned cooperative, the research explores the dialogic potential of stakeholder engagement. The analysis revealed a fragmented picture where the co-design and co-implementation aspects were mainly related to the non-business areas of cooperative life, while business logic dominated (...) the most central aspects. Stakeholder engagement was mainly related to consensus building, while dialogic engagement based on a pluralistic understanding was only partially considered and then neglected. The social capital in the local area, the growing size of the organisation and the related power structure embrace stakeholder engagement, influencing the orientation of the dialogic dynamic. The analysis indicates that a dialogic exchange is a relative concept which depends on the interests involved and the topics discussed. It also reveals that the key factors in the democratisation of stakeholder engagement are a mutual understanding and long-term opportunities. Common sociopolitical aspects are also important, but they do not necessarily guarantee the creation of dialogism paths. The research contributes to the critical dialogic literature in revealing whether and how stakeholder engagement has been implemented in a specific setting. It also shows the limitations of voluntarist stakeholder engagement initiatives. (shrink)

The ageing society poses significant challenges to Europe’s economy and society. In coming to grips with these issues, we must be aware of their ethical dimensions. Values are the heart of the European Union, as Article 1a of the Lisbon Treaty makes clear: “The Union is founded on the values of respect for human dignity…”. The notion of Europe as a community of values has various important implications, including the development of inclusion policies. A special case of exclusion concerns the (...) gap between those people with effective access to digital and information technology and those without access to it, the “digital divide”, which in Europe is chiefly age-related. Policies to overcome the digital divide and, more generally speaking, e-inclusion policies addressing the ageing population raise some ethical problems. Among younger senior citizens, say those between 65 and 80 years old, the main issues are likely to be universal access to ICT and e-participation. Among the older senior citizens, say those more than 80 years old, the main issues are mental and physical deterioration and assistive technology. An approach geared towards the protection of human rights could match the different needs of senior citizens and provide concrete guidance to evaluate information technologies for them. (shrink)

This article aims to present four case studies of the different responses to governmental measures to fight the COVID-19 pandemic by supreme and constitutional courts, especially in cases of jurisdictions that have been facing democratic erosion. The spread of the COVID-19 pandemic demanded immediate public policies and other political decisions from the branches of government. Executive authorities were the main actors in effecting constitutional public health norms. The expectation was that they will abide by the rule of law in fulfilling (...) their duties; that has not been the case under governments that promoted democratic erosion. The different contexts of the threats posed to the constitutional democracies led populist and illiberal leaders to opportunistically either try to—and then be contained by courts—or effectively consolidate the expansion of powers under the conditions of the pandemic. Concentrating on four jurisdictions (the USA, Hungary, El Salvador, and Brazil), the article demonstrates that courts can effectively work as bulwarks against waves of democratic erosion, especially in situations of stress, as it was the case in the global COVID-19 pandemic. This hypothesis is also proven by episodes in which courts did not sufficiently operate to curb illiberalism because they were already captured. The analyses enable classifying the court’s responses to the COVID-19 executive measures in a threefold pattern: deferential, restrictive, and of forced capitulation. (shrink)

This special issue of Science and Engineering Ethics is devoted to the ethical, societal and political implications of new and emerging technologies in the area of Human Security. Its aim is to address the wider implications of an altered security landscape. Specifically, and in accordance with SEE’s main area of interest, contributions to this special issue focus on those ethical considerations warranted by scientific and technological advances in the field of human security. The topic of the present reflection is Christian religious belief. Specifically, we will use Husserlian tools in order to examine the positional nature of this particular type of belief. We will be less interested in the question concerning the success conditions of this experience and more in its noetic structure. According to our proposal, to believe by faith supposes (although it is not exhausted by) accepting the existence of mundane evidence speaking against this fundamental belief. The believer acknowledges the existence (...) of this contradicting en-doxical basis and nevertheless believes what she believes. We will refer to this simultaneous movement of accepting and cancelling as the concessive structure of the religious attitude. The para-doxical movement of experiencing conflicting evidence as being subjectively ineffective is a key component of this attitude. At least some inchoative conflict with the world is required in order for the religious belief to be religious. Lastly, we will try to show that, with a distinctive terminology, the idea that the Christian religious attitude involves a conflict between subjectivity and world is present not only in Kierkegaard but also in phenomenological figures like Scheler and even Husserl. Instituciones como el Consejo de Europa o el Instituto Cervantes y expertos como Byram o Deardorff han desarrollado modelos y bases educativas que dan luz a los docentes para ejecutar programas para el desarrollo de una ciudadanía pluricultural, que se comunica y está inmersa en la diversidad.Este estudio analiza si dichos modelos permiten establecer unos descriptores que definan la competencia intercultural desde una perspectiva procedimental. De esta manera, se pretende establecer un análisis de las bases teóricas y prácticas de la (...) competencia intercultural, tanto en el nivel del marco teórico como en el nivel de actuación del alumnado. Product structures are represented in engineering models by depicting and linking components, features and assemblies. Their understanding requires knowledge of both design and manufacturing practices, and yet further contextual reasoning is needed to read them correctly. Since these representations are essen- tial to the engineering activities, the lack of a clear and explicit semantics of these models hampers the use of information systems for their assessment and exploita- tion. We study this problem by identifying different interpretations of structure rep- resentations, (...) and then discuss the formal properties that a suitable language needs for representing components, features and combinations of these. Las exigencias del diálogo entre la fe y la cultura actual han obligado a plantearse seriamente la tarea de "inculturación" del cristianismo, una misión necesaria aunque compleja y delicada. Tras definir los términos principales del tema, se exponen los criterios a seguir y los equilibrios necesarios para su adecuada realización. A continuación se describe el objeto principal de este estudio: la inculturación de la catequesis. En primer lugar, los agentes o personas responsables de la inculturación (la comunidad cristiana, los diferentes (...) servicios o ministerios, el papel de los catequistas), los aspectos o lugares particularmente implicados (pequeñas comunidades cristianas, catequesis locales, catequesis populares, etc.). El estudio termina destacando algunos de los posibles riesgos y dificultades que la tarea de inculturar la catequesis debería intentar superar. (shrink)

El artículo presenta y comenta las catequesis de Benedicto XVI en las audiencias públicas de los miércoles. A lo largo de los años los temas tratados son: los salmos y cánticos litúrgicos de laudes y vísperas; la Iglesia, su naturaleza e identidad; los Padres de la Iglesia; San Pablo (en el Año Paulino, 2008). En 2009, Benedicto XVI lanza una serie dedicada al Año Sacerdotal. En los últimos años de pontificado (2009-2011), presenta figuras de la historia de la Iglesia en (...) la Edad Media en los siglos XII y XIII, y a continuación personalidades femeninas de la historia eclesial de la Edad Media, y Moderna.
