We approach law with deep ambivalence. On the one hand, we take immense pride in living under the rule of law. On the other hand, we often catch ourselves lamenting the existence of law. When we lament the existence of law, we are not just saying that there is too much of it. We are not just complaining about the amount of law. Rather, our complaint goes to the very nature of law itself. We complain that its rules are constraining, (...) that its generality ignores the particularity of each situation, that its coercive force rides roughshod over our autonomy, and the list goes on. However, notwithstanding the frustration with law, it is not that we want to get rid of it. This paper seeks to express and explain our conflicting sentiments about law – why we sometimes view law as a monumental moral achievement and why we are sometimes so frustrated with it. The answer, as this paper will argue, lies in the nature of norms. The value and limit of law is traceable to the value and limit of norms. Kierkegaard helps us see that. This paper will argue that our ambivalence about law mirrors Kierkegaard’s ambivalence about ethics. (shrink)

A conventional wisdom about the progress of physics holds that successive theories wholly encompass the domains of their predecessors through a process that is often called reduction. While certain influential accounts of inter-theory reduction in physics take reduction to require a single "global" derivation of one theory's laws from those of another, I show that global reductions are not available in all cases where the conventional wisdom requires reduction to hold. However, I argue that a weaker "local" form of reduction, (...) which defines reduction between theories in terms of a more fundamental notion of reduction between models of a single fixed system, is available in such cases and moreover suffices to uphold the conventional wisdom. To illustrate the sort of fixed-system, inter-model reduction that grounds inter-theoretic reduction on this picture, I specialize to a particular class of cases in which both models are dynamical systems. I show that reduction in these cases is underwritten by a mathematical relationship that follows the broad prescriptions of Nagel/Schaffner reduction, and support this claim with several examples. Moreover, I show that this broadly Nagelian analysis of inter-model reduction encompasses several cases that are sometimes cited as instances of the "physicist's" limit-based notion of reduction. An influential objection to the epistemic power of the imagination holds that it is uninformative. You cannot get more out of the imagination than you put into it, and therefore learning from the imagination is impossible. This paper argues, against this view, that the imagination is robustly informative. Moreover, it defends a novel account of how the imagination informs, according to which the imagination is informative in virtue of its analog representational format. The core idea is that analog representations represent (...) relations ‘for free,’ and this explains how the imagination can contain more information than is put into it. This account makes important contributions to both philosophy of mind, by showing how the imagination can generate new content that is not represented by a subject’s antecedent mental states, and epistemology, by showing how the imagination can generate new justification that is not conferred by a subject’s antecedent evidence. Imagination plays a rich epistemic role in our cognitive lives. For example, if I want to learn whether my luggage will fit into the overhead compartment on a plane, I might imagine trying to fit it into the overhead compartment and form a justified belief on the basis of this imagining. But what explains the fact that imagination has the power to justify beliefs, and what is the structure of imaginative justification? In this paper, I answer these questions by arguing (...) that imaginings manifest an epistemic status: they are epistemically evaluable as justified or unjustified. This epistemic status grounds their ability to justify beliefs, and they accrue this status in virtue of being based on evidence. Thus, imaginings are best understood as justified justifiers. I argue for this view by way of showing how it offers a satisfying explanation of certain key features of imaginative justification that would otherwise be puzzling. I also argue that imaginings exhibit a number of markers of the basing relation, which further motivates the view that imaginings can be based on evidence. The arguments in this paper have theoretically fruitful implications not only for the epistemology of imagination, but for accounts of reasoning and epistemic normativity more generally. (shrink)

Necessarily, if S lacks the ability to exercise control, S is not an agent. If S is not an agent, S cannot act intentionally, responsibly, or rationally, nor can S possess or exercise free will. In spite of the obvious importance of control, however, no general account of control exists. In this paper I reflect on the nature of control itself. I develop accounts of control ’s exercise and control ’s possession that illuminate what it is for degrees of control (...) —that is, the degree of control an agent possesses or exercises in a given circumstance—to vary. Finally, I demonstrate the usefulness of the account on offer by showing how it generates a solution to a long-standing problem for causalist theories of action, namely, the problem of deviant causation. The Trolley Problem arises from a set of moral dilemmas, most of which involve tradeoffs between causing one death and preventing several more deaths. The normative and descriptive Trolley Problems are closely related. The normative Trolley Problem begins with the assumption that authors' natural responses to these cases are generally, if not uniformly, correct. Thus, any attempt to solve the normative Trolley Problem begins with an attempt to solve the descriptive problem, to identify the features of actions that elicit their (...) moral approval or disapproval. The chapter explains an empirical research paper to provide an approximate descriptive solution to the Trolley Problem. More specifically, this research highlights the influence of two factors that exert a powerful influence when both are present. Abortion opponents are sometimes accused of having inconsistent beliefs, actions, and/or priorities. If they were consistent, they would regard spontaneous abortions to be a greater moral tragedy,...

Common-sense folk psychology and mainstream philosophy of action agree about decisions: these are under an agent's direct control, and are thus intentional actions for which agents can be held responsible. I begin this paper by presenting a problem for this view. In short, since the content of the motivational attitudes that drive deliberation and decision remains open-ended until the moment of decision, it is unclear how agents can be thought to exercise control over what they decide at the moment of (...) deciding. I note that this problem might motivate a non-actional view of deciding?a view that decisions are not actions, but are instead passive events of intention acquisition. For without an understanding of how an agent might exercise control over what is decided at the moment of deciding, we lack a good reason for maintaining commitment to an actional view of deciding. However, I then offer the required account of how agents exercise control over decisions at the moment of deciding. Crucial to this account is an understanding of the relation of practical deliberation to deciding, an understanding of skilled deliberative activity, and the role of attention in the mental action of deciding. These public figures, such as Protagoras and Gorgias, were wide-ranging experts before discipline-specialization, and represent the flourishing of linguistic, historical, and philosophical reflection in the time of Socrates.

This study is aimed at evaluating the influence of the god of iron on ironworking communities in Ǹsúkkā cultural area. In the study area, the Supreme God – Chúkwú Òkìkè, Chínēkè or Chúkwú Ábíàmà is believed to control the affairs of humanity. He is worshipped through intermediaries such as Ányánwù [Sun God], Àmádíòhà, Áhàjīōkù [fertility goddess], Àlà [earth goddess] and the god of iron, which is called by different names in the study area such as Ékwéñsū-Úzù, Òkóró-Údùmè, Chíkèrè Àgùrù and (...) Áshéné. But, how effective is the god of iron in the study area? To provide answers to this question, ethnographic research method, involving in-depth structured interviews, field observation and photographic documentations, was used to gather data on the subject matter while data collected were analysed descriptively. This article is of the view that the influence of the god of iron in the study area is whittling down as a result of Westernisation and Christianity.Contribution: The study indicates an increasing resistance to the Euro-centrism, which has suppressed beliefs in the god of iron and the associated practices. This article aims to provide a consistent explication of the doctrine of Divine Simplicity. To achieve this end, a re-construal of the doctrine is made within an “aspectival trope-theoretic” metaphysical framework, which will ultimately enable the doctrine to be elucidated in a consistent manner, and the Plantingian objections raised against it will be shown to be unproblematic.

An extensive body of research suggests that the distinction between doing and allowing plays a critical role in shaping moral appraisals. Here, we report evidence from a pair of experiments suggesting that the converse is also true: moral appraisals affect doing/allowing judgments. Specifically, morally bad behavior is more likely to be construed as actively ‘doing’ than as passively ‘allowing’. This finding adds to a growing list of folk concepts influenced by moral appraisal, including causation and intentional action. We therefore suggest (...) that the present finding favors the view that moral appraisal plays a pervasive role in shaping diverse cognitive representations across multiple domains. -/- . (shrink)

This article aims to provide a response to the problem of suffering through an explication of a new theodicy termed the Exemplarist Theodicy. This specific theodicy will be formulated in light of the moral theory provided by Linda Zagzebski, termed the Exemplarist Moral Theory, the notion of transformative experience, as explicated by L.A. Paul, Havi Carel and Ian James Kidd, and the virtue-theoretic approach to suffering proposed by Michael Brady, which, in combination with some further precisifying philosophical concepts—namely, compensation, total (...) empathy, and infinitely valuable connections—will provide us with a possible, morally sufficient reason for why God allows individuals to experience suffering. The Shape of Agency offers interlinked explanations of the basic building blocks of agency, as well as its exemplary instances. The first part offers accounts of a collection of related phenomena that have long troubled philosophers of action: control over behaviour, non-deviant causation, and intentional action. These accounts build on earlier work in the causalist tradition, and undermine the claims made by many that causalism cannot offer a satisfying account of non-deviant causation, and therefore fails as an account of intentional (...) action. The second part turns to modes of agentive excellence—ways that agents display quality of form—providing a novel account of skill, including an account of the ways that agents display more or less skill. Shepherd discusses the role of knowledge in skill, and concludes that while knowledge is often important, it is inessential. This leads to a discussion of the way that knowledge of action and knowledge of how to act informs action execution. Knowledgeable action includes a unique epistemic underpinning: in knowledgeable action, the agent has authoritative knowledge of what she is doing and how she is doing it when and because she is poised to control her action by way of practical reasoning. Many philosophers treat mental imagery as a kind of perceptual representation – it is either a perceptual state, or a representation of a perceptual state. In the sciences, writers point to mental imagery by way of a standard gloss – mental imagery is said to be (often, early) perceptual processing not directly caused by sensory stimuli (Kosslyn et al. 1995). Philosophers sometimes adopt this gloss, which I will call the basic view. Bence Nanay endorses it, and appeals to it in (...) a number of places to argue that mental imagery plays various functional or explanatory roles, as well as to argue that some mental phenomena should be seen as forms of mental imagery. In places he goes even further, relying on this view of mental imagery to explain how mental imagery is a unified kind despite heterogeneous appearances, and using this view to support his claim that mental imagery is a natural kind. Nanay’s book – which is a both a useful introduction to the many ways that mental imagery appears in discussions across philosophy, neuroscience, and psychology, as well as an extended argument for the multi-faceted relevance of mental imagery to a range of projects in the philosophy of mind and psychology – thus also serves as a nice test case for whether this basic view of mental imagery is good enough to aid theorizing across philosophy and the sciences. I think not. I will illustrate why by looking at two areas. First, I will discuss Nanay’s argument regarding mental imagery and object files. Second, I will discuss an issue Nanay raises, regarding the relationship between mental and motor imagery. A longer discussion might look to many more areas – as already mentioned, Nanay’s book covers a wide range of mental phenomena – with the same lesson emerging. The nature of mental imagery cannot be fully understood without facing an array of choice points, many of which push us to make commitments beyond the basic view. (shrink)

Many think that a specific aspect of phenomenal consciousness – valenced or affective experience – is essential to consciousness’s moral significance (valence sentientism). They hold that valenced experience is necessary for well-being, or moral status, or psychological intrinsic value (or all three). Some think that phenomenal consciousness generally is necessary for non-derivative moral significance (broad sentientism). Few think that consciousness is unnecessary for moral significance (non-necessitarianism). In this paper I consider the prospects for these views. I first consider the prospects (...) for valence sentientism in light of Vulcans, beings who are conscious but without affect or valence of any sort. I think Vulcans pressure us to accept broad sentientism. But I argue that a consideration of explanations for broad sentientism opens up possible explanations for non-necessitarianism about the moral significance of consciousness. That is, once one leans away from valence sentientism because of Vulcans, one should feel pressure to accept a view on which consciousness is not necessary for well-being, moral status, or psychological intrinsic value. Ned Block has recently pressed a new criticism of the higher-order thought (HOT) theory of consciousness. HOT proponents have responded in turn. The exchange affords a chance to find some clarity concerning the essential commitments of HOT, as well as a chance to find clarity on the issues that divide Block and HOT proponents. In this paper I discuss the recent exchange, and I draw some lessons. First, I side with HOT proponents in arguing that new criticism presents no new (...) problem for HOT. Second, I argue that the issues separating Block and HOT proponents suggest that two separate debates are being conflated, and I suggest that keeping them distinct will yield progress for consciousness studies. Since its publication, the Psychopathic Personality Inventory and its revision (Lilien- feld & Andrews, 1996; Lilienfeld & Widows, 2005) have become increasingly popular such that it is now among the most frequently used self-report inventories for the assessment of psychopathy. The current meta-analysis examined the relations between the two PPI factors (factor 1: Fearless Dominance; factor 2: Self-Centered Impulsivity), as well as their relations with other validated measures of psychopathy, internalizing and externalizing forms of psychopathology, general personality traits, and antisocial (...) personality disorder symptoms. Across 61 samples reported in 49 publications, we found support for the convergent and criterion validity of both PPI factor 2 and the PPI total score. Much weaker validation was found for PPI factor 1, which manifested limited convergent validity and a pattern of correlations with central criterion variables that was inconsistent with many conceptualizations of psychopathy. Duties to address global poverty face a motivation gap. We have good reasons for acting yet we do not, at least consistently. A ‘sentimental education’, featuring literature and journalism detailing the lives of distant others has been suggested as a promising means by which to close this gap. Although sympathetic to this project, I argue that it is too heavily wed to a charitable model of our duties to address global poverty—understood as requiring we sacrifice a certain portion of our (...) income. However, political action, aimed at altering institutions at both a global and a local level is likely to be necessary in order to provide effective long-term solutions to poverty globally. To rectify this, the article develops an alternative dialogical account of sentimental education, suitable for motivating support for political action to address global poverty. (shrink)

Autism spectrum disorders (ASD) are thought to result in part from altered cortical excitatory-inhibitory balance; this pathophysiology may impact the generation of oscillations on EEG. We investigated premotor-parietal cortical physiology associated with praxis, which has strong theoretical and empirical associations with ASD symptomatology. 25 children with high-functioning ASD (HFA) and 33 controls performed a praxis task involving the pantomiming of tool use, while EEG was recorded. We assessed task-related modulation of signal power in alpha and beta frequency bands. Compared with (...) controls, subjects with HFA showed 27% less left central (motor/premotor) beta (18-22 Hz) event-related desynchronization (ERD) (p = 0.030), as well as 24% less left parietal alpha (7-13 Hz) ERD (p = 0.046). Within the HFA group, blunting of central ERD attenuation was associated with impairments in clinical measures of praxis imitation (r = -0.4; p = 0.04) and increased autism severity (r = 0.48; p = 0.016). The modulation of central beta activity is associated, among other things, with motor imagery, which may be necessary for imitation. Impaired imitation has been associated with core features of ASD. Altered modulation of oscillatory activity may be mechanistically involved in those aspects of motor network function that relate to the core symptoms of ASD. (shrink)

It begins with the notion of `physical representation' (the kind of empirical representation of nature that we effect in doing physics), and then lays out the historically and conceptually central case of physical symmetry that frequently falls under the rubric of 'the Relativity Principle', or 'Galileo's Ship. This material is then used as a point of departure to explore the key hermeneutic challenge concerning physical symmetry in the (...) last century, namely understanding the physical significance of the notion of 'local' gauge symmetry. The approach taken stresses both the continuity with historically important themes such as the Relativity Principle, as well as novel insights earned by working with contemporary media such as the covariant phase space and derived critical locus formalisms. Recent developments in cosmology indicate that every history having a non-zero probability is realized in infinitely many distinct regions of spacetime. Thus, it appears that the universe contains infinitely many civilizations exactly like our own, as well as infinitely many civilizations that differ from our own in any way permitted by physical laws. We explore the implications of this conclusion for ethical theory and for the doomsday argument. Trust is commonly defined as a metaphysically-hybrid notion involving an attitude and an action. The action component of trust is defined as a special form of reliance in which the trustor has: (1) heightened expectations of their trustee; and (2) a disposition to justifiably feel betrayed if their trust is broken. The first aim of this paper is to reject the view that trust is a form of reliance. -/- The second aim of this paper is to develop and defend (...) a non-reliance-based variation of Katherine Hawley’s commitment trust account. Roughly, on my variant account, if X trusts Y to ϕ, then X has a belief with the following counterfactual as its content: ‘if I were to rely on Y to keep a commitment to ϕ, then I believe that Y would keep that commitment to ϕ.’ I defend this account against the objection that non-reliance accounts cannot explain the intuition that trust involves heightened expectations, and that it elicits justified betrayal when broken. I also respond to the argument that such accounts can’t provide adequate explanations of therapeutic trust, which is taken to be a counterexample of belief trust insofar as it describes instances where trustors trust trustees despite not believing that they are trustworthy. In this paper, I offer evidence that folk views of free will and moral responsibility accord a central place to consciousness. In sections 2 and 3, I contrast action production via conscious states and processes with action in concordance with an agent's long-standing and endorsed motivations, values, and character traits. Results indicate that conscious action production is considered much more important for free will than is concordance with motivations, values, and character traits. In section 4, I contrast the absence of (...) consciousness with the presence of consciousness in behaviorally identical agents. Most participants attribute free will to conscious agents, but not to nonconscious agents. Focusing in particular on two leading views of free will and moral responsibility, namely, Deep Self and Reasons-Responsive Views, I argue that these results present philosophers of mind and action with the following explanatory burden: develop a substantive theory of the connection between consciousness on the on.. The Nanosilver Linings role play case offers participants first-person experience with interpersonal interaction in the context of the wicked problems of emerging technology macroethics. In the fictional scenario, diverse societal stakeholders convene at a town hall meeting to consider whether a nanotechnology-enabled food packaging industry should be offered incentives to establish an operation in their economically struggling Midwestern city. This original creative work was built with a combination of elements, selected for their established pedagogical efficacy and as topical dimensions of (...) the realistic scenario. The product life cycle is used as a framework for integrated consideration of scientific, societal, and ethical issues. The Nanosilver Linings hypothetical case was delivered through the format of the 3-hour workshop Ethics when Biocomplexity meets Human Complexity, providing an immersive, holistic ethics learning experience for STEM graduate students. Through their participation in the Nanosilver Linings case and Ethics when Biocomplexity meets Human Complexity workshop, four cohorts of science and engineering doctoral students reported the achievement of specific learning objectives pertaining to a range of macroethics concepts and professional practices, including stakeholder perspectives, communication, human values, and ethical frameworks. Automated text analysis of workshop transcripts revealed differences in sentiment and in ethical framework preference between societal stakeholder roles. These resources have been recognized as ethics education exemplars by the U.S. National Academy of Engineering. (shrink)

In this interesting paper, Lavazza and Massimini draw attention to a subset of the ethical issues surrounding the development and potential uses of cerebral organoids. This subset concerns the possibility that cerebral organoids may one day develop phenomenal consciousness, and thereby qualify as conscious subjects—that there may one day be something it is like to be an advanced cerebral organoid. This possibility may feel outlandish. But as Lavazza and Massimini demonstrate, the science of organoids is moving fast, and I agree (...) that the ethical issues now deserve careful scrutiny. The ethical issues are not entirely separate from epistemological issues concerning how certain we could ever be that an organoid is conscious or that regarding any conscious state or process, an organoid is capable of tokening that state or undergoing that process. Lavazza and Massimini’s approach is theory-based—they claim that ‘we need a general theory of consciousness that attempts to explain what experience is and what type of physical systems can have it’. I am not convinced, however, that a theory of consciousness is what we need. Nor am I convinced that detecting the presence of consciousness is the most important moral issue. Let me say a word regarding theories of consciousness first. In general, to the extent that pervasive disagreement characterises expert discussion of some phenomenon P, one should modify one’s credence downward regarding any theory of the nature of P. It is well known that the nature of consciousness is elusive, and that attempts to understand it generate problems in metaphysics, philosophy of mind, psychology, and neuroscience. Less appreciated are the important – even if still elusive – connections between consciousness and issues in ethics. In this chapter we consider three such connections. First, we consider the relevance of consciousness for questions surrounding an entity’s moral status. Second, we consider the relevance of consciousness for questions surrounding moral responsibility for action. (...) Many of us are unmoved when it is objected that some morally or intellectually suspect source agrees with our belief. While we may tend to find this kind of guilt by epistemic association unproblematic, I argue that this tendency is a mistake. We sometimes face what I call the problem of unwelcome epistemic company. This is the problem of encountering agreement about the content of your belief from a source whose faults give you reason to worry about the belief's truth, (...) normative status, etiology, or implications. On the basis of an array of cases, I elaborate four distinct kinds of problems that unwelcome epistemic company poses. Two of these are distinctly epistemic, and two are moral. I canvass possible responses, ranging from stubbornness to an epistemic prudishness that avoids unwelcome company at all costs. Finally, I offer preliminary lessons of the problem and distinguish it from the problem of peer disagreement. (shrink)

This article treats the political thought of Simón Bolívar, a leading figure in South America's struggle for independence. It describes Bolívar's ideas by reference to both their broadly Atlantic origins and their specifically American concerns, arguing that they comprise a theory of `republican imperialism', paradoxically proposing an essentially imperial project as a means of winning and consolidating independence from European rule. This basic tension is traced through Bolívar's discussions of revolution, constitutions, and territorial unification, and then used to frame a (...) comparison with the founders of the United States. It suggests, in closing, that contextual similarities amongst the American revolutions make them particularly apt subjects for comparative study of the history of political thought. (shrink)

For Herbert Marcuse, the terrifying specter of communism at the end of the 1960s served the interests of counterrevolution in discrediting revolutionary aims and legitimizing all necessary repressive counter-measures against emancipatory programs. Slavoj Žižek adds a second function, namely, that during the Cold War the specter of communism also served to humanize Western liberal democracy, necessitating strong social welfare measures and thus forming capitalism with a human face. But with the fall of the Eastern Bloc the threat to this system (...) has become more spectral than ever, because any mild deviations from a neoliberal vision of free market capitalism now bring with them charges of totalitarianism. In the face of such formidable obstacles, Marcuse and Žižek argue that the nature and means of emancipation necessarily remain indeterminate. Hence, the emancipatory possibilities that they do sketch out remain overwhelmingly negative and spectral. This raises the question of whether a political theory ought to be sufficiently detailed as to be directly actionable. I conclude that their work largely satisfies the set of justifiable criteria for a successful political theory articulated or implied by Kant and Horkheimer, and therefore, remains highly relevant to our thinking of the political. This article aims to provide an a priori argument—termed the Flourishment Argument, for the veracity of the Christian conception of the Abrahamic religion that centres on God’s action of sending a divine and atoning prophet into the world. This specific informal argument will be presented through the formulation of a set of a priori reasons for why God would seek to interact with the world—developed in light of the work of Richard Swinburne, John Finnis, Linda Zagzebski and Alexander Pruss—which, in (...) combination, will provide individuals with grounds for believing in the veracity of these important Christian teachings. This article aims to provide an explication of the Christian doctrine of eternal generation. A model of the doctrine is formulated within the ground-theoretic framework of Jonathan Schaffer and E. Jonathan Lowe, which enables it to be explicated clearly and consistently, and two often raised objections against the doctrine can be successfully answered.

Here, I review work from three lines of research in cognitive science often taken to threaten free will and moral responsibility. This work concerns conscious deciding, the experience of acting, and the role of largely unnoticed situational influences on behavior. Whether this work in fact threatens free will and moral responsibility depends on how we ought to interpret it, and depends as well on the nature of free and responsible behavior. I discuss different ways this work has been interpreted and (...) argue that though work on conscious deciding and the experience of acting presents no real threat, work on situational influences is more difficult to dismiss. This work may present a real threat, and it may require us to revise our commonsense understanding of free and responsible behavior. But this work may also present ways to augment free and responsible behavior. Determining whether and how advancing science threatens, enhances, or simply describes free will is an ongoing task for scientists and philosophers alike. (shrink)

In this paper I explore the relationship between skill and sensitivity to reasons for action. I want to know to what degree we can explain the fact that the skilled agent is very good at performing a cluster of actions within some domain in terms of the fact that the skilled agent has a refined sensitivity to the reasons for action common to the cluster. The picture is a little bit complex. While skill can be partially explained by sensitivity to (...) reasons – a sensitivity often produced by rational practice – the skilled human agent, because imperfect, must navigate a trade-off between full sensitivity and a capacity to succeed.
