This paper consists of commentaries about and the reprint of an autobiographical essay authored by Italian medium Eusapia Palladino and published in 1910. The details of the essay are discussed in terms of the writings of other individuals about the life and performances of the medium. The essay conveys a view of Palladino as a person who has suffered much in life and has a mission to help scientific research into mediumship. Typical of the positive emphasis in autobiographies in general, (...) the medium did not discuss negative aspects of her performances. Due to the fact that the essay appeared during Palladino's visit to New York City in which many authors branded her as a fraud, it may be speculated that the purpose of this autobiography was to elicit sympathy from the American public. While some of the statements that Palladino made about phenomena are consistent with the statements of other authors who have written about her, there are several statements that show alternate or incomplete versions of particular events in her life. The differences suggests that Palladino's essay and other discussions about the medium's life are not reliable when it comes to specific details and to biographical accuracy. (shrink)

In print for the first time in over ten years, Act and Crime provides a unified account of the theory of action presupposed by both Anglo-American criminal law and the morality that underlies it. The book defends the view that human actions are always volitionally caused bodily movements and nothing else. The theory is used to illuminate three major problems in the drafting and the interpretation of criminal codes: 1) what the voluntary act requirement both does and should require; 2) (...) what complex descriptions of actions prohibited by criminal codes both do and should require ; and 3) when two actions are 'the same' for purposes of assessing whether multiple prosecutions and multiple punishments are warranted. The book both contributes to the development of a coherent theory of action in philosophy, and it provides both legislators and judges a grounding in three of the most basic elements of criminal liability. Motivated by contemporary debates concerning whether directors inappropriately deploy corporate funds for corporate political donations and the limited research into managerial influence on corporate political donations, we examine the impact of director influences from a network perspective. Using a sample of large listed Australian corporations and their political party donation activity during 2000–2007, we find that both the professional and non-professional networks of directors influence corporate political donations. We observe these influences in relation to donations at the federal and state (...) levels, and with respect to the choice of recipient political parties. (shrink)

This paper reports the results of a study of the top 500 private sector organizations and the top 100 public sector organizations in Sweden. It is a replication of the study by Svensson et al . (2004) . The aim of the study was to describe and compare the business ethics commitment of organizations across the two sectors. The empirical findings indicate that the processes involved in business ethics commitment have begun to be recognized and acted upon at an organizational (...) level in Sweden. Some support is provided to show that codes of ethics are developing in some of Sweden's largest private and public sector organizations – although this is happening to a lesser extent in the public sector. It is noted that an effect of a code of ethics on the bottom line of the business was acknowledged by respondents in both private and public sector organizations. We believe that the supporting measures of business ethics commitment appear to be underutilized in both private and public sector organizations in Sweden (among those that possess codes of ethics), thus indicating that the commitment to business ethics in Swedish organizations has potential for future development. The objective of this paper is to develop and describe a construct of the ethos of the corporate codes of ethics (i.e. an ECCE construct) across three countries, namely Australia, Canada and Sweden. The introduced construct is rather unique as it is based on a cross-cultural sample seldom seen in the literature. While the outcome of statistical analyses indicated a satisfactory factor solution and acceptable estimates of reliability measures, some research limitations have been stressed. They provide a foundation for further (...) research in the field and testing of the ECCE construct in other cultural and corporate settings. We believe that the ECCE construct makes a contribution to theory and practice in the field as it outlines a theoretical construct for the benefit of other researchers. It is also of managerial interest as it provides a grounded framework of areas to be considered in the implementation in organizations of corporate codes of ethics. (shrink)

Dialectical materialism was born in 1857, when Marx returned to studying Hegel. In opposition to Hegel, Marx adopted a realist epistemology. Abandoning the pragmatist ambiguities of his Economic?Philosophical Manuscripts, he became a materialist in the traditional sense of that word. Influenced by Hegel, Marx simultaneously attempted a dialectical proof for the labor theory of value. Abandoning his positivist critique in The Holy Family, he started using dialectic to discover beneath appearances an otherwise inaccessible reality. But his dialectic was incompatible with (...) his materialism. The identification of reality with Praxis, rejected at the level of philosophical statement, was retained at the level of economic argument. Turning Hegel upside down proved harder than Marx thought. This chapter offers a conceptual analysis of territory, distinguishes it from property accounts, and discusses different versions of property accounts, all derived from Locke’s ‘Second Treatise of Government’. It offers a conceptual analysis of territory and the various rights associated with territory. According to Locke, territorial right is established through the subjection, by free consent, of persons and their land to state authority. This theory is found to rest on a number of flawed assumptions, among them claims to natural rights (...) of property and an obvious link between private property and territorial jurisdiction. Cara Nine draws on Lockean principles to claim that a state is a collective that, like individuals, owns property, namely the territory of the state. After examining the historical antecedents of such ideas, the chapter points away from them and towards accounts of territory based on individual and collective claims of rights. (shrink)

Emotion regulation is an umbrella term to describe interactive, goal-dependent explicit and implicit processes that are intended to help an individual manage and shift an emotional experience. The primary window for appropriate emotion regulation development occurs during the infant, toddler, and preschool years. Atypical emotion regulation development is considered a risk factor for mental health problems and has been implicated as a primary mechanism underlying childhood pathologies. Current treatments are predominantly verbal- and behavioral-based and lack the opportunity to practice in-the-moment (...) management of emotionally charged situations. There is also an absence of caregiver-child interaction in these treatment strategies. Based on behavioral and neural support for music as a therapeutic mechanism, the incorporation of intentional music experiences, facilitated by a music therapist, may be one way to address these limitations. Musical Contour Regulation Facilitation is an interactive therapist-child music-based intervention for emotion regulation development practice in preschoolers. The Musical Contour Regulation Facilitation intervention uses the deliberate contour and temporal structure of a music therapy session to mirror the changing flow of the caregiver-child interaction through the alternation of high arousal and low arousal music experiences. The purpose of this paper is to describe the Therapeutic Function of Music, a theory-based description of the structural characteristics for a music-based stimulus to musically facilitate developmentally appropriate high arousal and low arousal in-the-moment emotion regulation experiences. The Therapeutic Function of Music analysis is based on a review of the music theory, music neuroscience, and music development literature and provides a preliminary model of the structural characteristics of the music as a core component of the Musical Contour Regulation Facilitation intervention. This chapter argues why we need a political theory of territory. We need it because the entire usable earth is divided into territorially distinct states, and the territorialization process is not complete yet, as states extend their control to the seabed, the oceans, and other uninhabited places. Yet we have no overarching theory of what justifies territory, how boundaries should be drawn or territorial disputes resolved. This lacuna extends to a range of disciplines, which have barely addressed territory itself. In (...) political philosophy, for example, there has been a focus on the relationship between state and citizen, but hardly any focus on territory. At the heart of this chapter, beyond motivating the book as a whole, is the claim that justifying authority over citizens is distinct from justifying authority over territory, and requires a separate argument. Though John Stuart Mill's long employment by the East India Company did not limit him to drafting despatches on relations with the princely states, that activity must form the centrepiece of any satisfactory study of his Indian career. As yet the activity has scarcely been glimpsed. It produced, on average, about a draft a week, which he listed in his own hand. He subsequently struck out items that he sought to disown in consequence of substantial revisions made by the Company's (...) directors or the Board of Control. He also listed items that achieved publication as parliamentary papers and they amount to about ten per cent of his drafts. The two lists, published in the most recent volume of his Collected Works, reveal, at the least, the ‘political’ despatches from which he did not seek to dissociate himself. The despatches were not entirely his work and authorship in the conventional sense may not be assumed. They were the product of an elaborate process, in which many hands were engaged. At worst, they were his work in much the same way that an Act of Parliament is the work of the Crown Solicitor who drafts the bill. At best they were his as are the drafts of a civil servant who believes in policy statements that he prepares for his political masters. The greatest English philosopher and social scientist of the nineteenth century was, in his daily occupation, an employee. His Company was charged with initiating policies for the Indian states and they were subject to the control of a minister of the Crown. (shrink)

Throughout the U.S., state laws require professionals who work with children to report cases of suspected child abuse to child protection services. Both practically and conceptually, however, significant problems arise from a lack of clarity regarding the threshold that has been set for reporting. Specifically, there is no consensus as to what constitutes reasonable suspicion, and little direction for how mandated reporters should gauge their legal and professional responsibilities when they harbor suspicion. In this paper we outline the context of (...) the problem, discuss the nature and scope of its conceptual underpinnings, and offer recommendations for moving towards a concrete, practical solution. Our culture and its scientific endeavor direly need a holistic characterization of mind and body. Many phenomena attest to the profound effects of beliefs on bodily function (e.g., open-label placebo's effects on chronic pain) and interoceptive systems’ role in mental processes (e.g., the emerging role of gut microbiomes in the mood). We need a mechanistic, integrative framework to account for these phenomena and generate novel predictions. Major advances have been made in understanding how the nervous system senses and regulates the (...) body and in modeling how the brain implements the computations that subserve such activities. However, the vestiges of Cartesianism have entrained a style of thinking in which systems from the brainstem downward exist as the implementation layer of computational processes supporting sensation and behavior, rather than a complementary locus of information processing. We are thus forced to perceive well-documented, belief-driven phenomena like placebo, ritual, and psychosomatic disorders as mysterious obstacles or dubious allies rather than as a wellspring of potential. If, as Locke believed, our words stand for Ideas hidden away inside our minds, how do we know that we all mean the same thing by them?

There has been recently a substantial rise of relativism in the epistemology of social science. It has seriously discredited normative function of the epistemology and changed the context of epistemological discussion. Some hold that the problem of relativism cannot be solved by scientific means, because it ultimately depends on personal beliefs. However, present paper shows that there are different scientific strategies of coping with relativism. The key argument is that the epistemological stance towards relativism is closely related to the conceptualization (...) of sense in general social theory. Some prominent examples of socialtheorizing are presented to support this point and demonstrate that different conceptualizations of sense are possible, and that these are connected to the approach to social-scientific cognition. Relationship between epistemological grounds and conceptualization of sense in work of Scheler, Weber, Bourdieu, Luhmann is briefly analyzed. The conclusion is drawn that future exploration of epistemological problems in social sciences may benefit from rethinking and refining the concept of sense. (shrink)

In early 2017, Nevada amended its Uniform Determination of Death Act, in order to clarify the neurologic criteria for the determination of death. The amendments stipulate that a determination of death is a clinical decision that does not require familial consent and that the appropriate standard for determining neurologic death is the American Academy of Neurology’s guidelines. Once a physician makes such a determination of death, the Nevada amendments require the withdrawal of life-sustaining treatment within twenty-four hours with limited exceptions. (...) Neurologists have generally supported Nevada’s amendments for clarifying the diagnostic standard and limiting the ability of family members to challenge it. However, it is more appropriate to view the Nevada amendments with concern. Even though the primary purpose of the UDDA is to ensure that all functions of a person’s entire brain have ceased, the AAN guidelines do not accurately assess this. In addition, by characterizing the determination of death as solely a clinical decision, the Nevada legislature has improperly ignored the doctrine of informed consent, as well as the beliefs of particular faiths and cultures that reject brain death. Rather than resolving controversies regarding brain death determinations, the Nevada amendments may instead instigate numerous constitutional challenges. (shrink)

The miniseries Frank Herbert’s Dune (2000) and Frank Herbert’s Children of Dune (2003) offer a stark warning that people must think for themselves rather than relying on authority. In particular, they warn against overreliance on leaders and on religious authorities. The series tell the story of how, in the far future, Paul Atreides becomes dictator and religious leader over the human race, bringing slaughter and oppression in his wake. The chapter will consider the views of philosophers like Plato, who believed (...) that power should be concentrated in the hands of leaders with absolute authority, along with the views of philosophers who advocated democracy, like John Locke, John Stuart Mill, and John Dewey. The chapter will also examine the views of philosophers on religion, especially philosophers critical of religion, such as Locke, Thomas Paine, and Bertrand Russell. It is argued that the series present a strong case against allowing others to think for us, because the story they tell matches the historical record of the real world. When leaders have been given the power to be arbiters of truth, they have too often exploited those beneath them, using their positions to accumulate wealth, power, and glory. When too much trust has been placed in religious authority, it has likewise too often led to exploitation and repression. What is worse, the power of religion is uncontrollable, easily leading to violence and destruction. Having said that, the series fail to reflect that religion does good in the world. This chapter argues that, as maintained by W. K. Clifford, whether people should accept religious views depends on whether they have good grounds to believe that these views are true. This implies that people must not accept religious views without thinking the views through for themselves. (shrink)

Greek philosophers, Socrates, Plato, and Aristotle promoted alternatives to these warrior values, some of which may provide a way out of the troublesome life of mayhem that J.T. and Jax seek to leave behind. The desire for freedom is strong in humans. (...) Aristotle believes that friendship is one of the most important things in life. The first kind of friendship is based on enjoying pleasurable things together‐riding Harleys, drinking beers, or whatever a person likes to do with others. Mike and I had worked together with the young of the parish, and one summer the two of us took a couple of boys camping in France, a trial of patience which made us known to each other at some depth. He was in fact a passionately (...) convinced Catholic, and very pastoral with it. We had many and long theological discussions. On his recent visit to Downside, I was showing him and some friends round our church, when, à propos ofquite what I don't remember, he made a remark about the Catholic cult of suffering, and said, "and it's all because ofthe crucifixion, isn't it? Why don't we recognize that the crucifixion was an accident?" I didn't react, because I was dumbfounded at what seemed to be the denial ofthe mystery ofthe cross by a friend who I had no reason to believe had stopped being a Catholic. And I'm sure he hasn't. He would certainly have told me ifhe had. It has taken me over a year to figure out what is going on here, and this would not have been possible without intensive study of the work of René Girard. The only alternative to saying that the crucifixion was an accident is to say that it was "ordained by God." It is only as ordained by God that this horrible event could be presented to people as a divine affirmation that suffering is to be sought and espoused. Also, it is only as ordained by God that the crucifixion can be thought of as "appeasing God" in some way. Both the moral and the dogmatic implication ofthe crucifixion—that suffering is a good thing, and that God required a victim—are grounded in the notion that God required the crucifixion ofhis Son. And it is because this idea is quite unacceptable, unworthy of God and ofthe human mind made in God's image, that my friend concludes that the crucifixion was not required by God, not written into the eternal scheme ofthings, but an accident. 156Sebastian Moore Once the problem is clarified in these terms, more and more instances come to mind, of rejection, by Christians and others, of the whole divine ordination ofthe cross. Gore Vidal refers to Christianity as "that lugubrious religion." Mary Hunt, a prominent American Catholic feminist, introduced a workshop with the statement, "we are not about naked guys nailed to crosses, blood all over the place!" Where divine ordering is accepted the special painfulness and darkness ofthe idea is noted. Anselm refers to the doctrine as the Narnia Chronicles, to commend the notion, by referring to a dark law written into the nature ofthings beyond our comprehension. The children's suggestion that Asian should simply not comply with the Snow Queen's requirement is rejected by Asian with a mysterious impatience—the children justhaven't grown up, like the romantics who, according to Matthew Arnold, "did not know enough." Again, during a day on "the roots of violence" that I led here yesterday there was much questioning about the role ofGod die Father in the crucifixion. The problem is crystallized in the famous cry from the cross, "Why have you forsaken me?" To my confessedly lame suggestion that Jesus was "only quoting a psalm," someone remarked, "to quote that psalm at thatjuncture and not mean it, is somewhatmisleading!" Again it's the same problem. How can God be understood as ordaining the crucifixion, compatibly with the notion of God as all-loving which Christianity of course affirms? Hans Urs Von Balthasar, who is 90% pro-Girard, in the other 10% wants to hold on to something he calls "the wrath of God." Thus the seeming necessity of having God require and ordain the crucifixion is the main crisis of Christian belief. The six-year-old Willie, in Thomas Klise's amazing novel, The Last Western, puts the problem with childlike directness. Something has been going wrong on many college campuses in the last few years. Speakers are shouted down. Students and professors say they are walking on eggshells and are afraid to speak honestly. Rates of anxiety, depression, and suicide are rising--on campus as well as nationally. How did this happen? First Amendment expert Greg Lukianoff and social psychologist Jonathan Haidt show how the new problems on campus have their origins in three terrible ideas that have become increasingly woven into (...) American childhood and education: What doesn't kill you makes you weaker; always trust your feelings; and life is a battle between good people and evil people. These three Great Untruths contradict basic psychological principles about well-being and ancient wisdom from many cultures. Embracing these untruths--and the resulting culture of safetyism--interferes with young people's social, emotional, and intellectual development. It makes it harder for them to become autonomous adults who are able to navigate the bumpy road of life. Lukianoff and Haidt investigate the many social trends that have intersected to promote the spread of these untruths. They explore changes in childhood such as the rise of fearful parenting, the decline of unsupervised, child-directed play, and the new world of social media that has engulfed teenagers in the last decade. They examine changes on campus, including the corporatization of universities and the emergence of new ideas about identity and justice. They situate the conflicts on campus within the context of America's rapidly rising political polarization and dysfunction. In his recently published Donner le temps II, Derrida raises, but does not develop, the possibility that Heidegger's notion of Gelassenheit (‘releasement’, ‘letting-be’) might escape the economic confines of exchange, debt, and repayment and therefore qualify as a pure gift. In this paper, I explore this possibility, explaining that Gelassenheit would have to be understood, first, not primarily as a human comportment but at the level of being itself, second, beyond appropriation, and third, as ‘without why’. If Heidegger's focus on (...) appropriation in ‘Time and Being’ remains entangled in the economy of exchange (as Derrida insinuates in the final session of Donner le temps II), Heidegger's anarchic treatment of ‘letting’ ( laisser, Lassen) in the final session of his 1969 seminar in Le Thor opens instead onto a ‘pure giving’ ( pur donner, reines Geben). In the near future developments in non-invasive prenatal testing may soon provide couples with the opportunity to test for and diagnose a much broader range of heritable and congenital conditions than has previously been possible. Inevitably, this has prompted much ethical debate on the possible implications of NIPT for providing couples with opportunities for reproductive choice by way of routine prenatal screening. In view of the possibility to test for a significantly broader range of genetic conditions with NIPT, the European (...) Society of Human Genetics and American Society of Human Genetics recommend that, pending further debate, prenatal screening for reproductive choice should only be offered where concerning serious congenital conditions and childhood disorders. In support of this recommendation, the ESHG and ASHG discuss a number of ethical issues on which they prompt further debate: the informational privacy of the future child, the trivialization of abortion, the risk of information overload, and issues of distributive justice. This paper responds to this call with further reflection on each ethical issue and how it relates to the moral justification of providing couples with opportunities for meaningful reproductive choice. The paper concludes that whilst there may be good reasons for qualifying the scope of any unsolicited prenatal screening offer to serious congenital conditions and childhood disorders, if prenatal screening is justified for providing couples with opportunities for meaningful reproductive choice, then health services may have obligations to empower couples with the same opportunity where concerning other conditions. The principle of indifference (hereafter ‘Poi’) says that if one has no more reason to believe A than B (and vice versa ), then one ought not to believe A more than B (nor vice versa ). Many think it’s demonstrably false despite its intuitive plausibility, because of a particular style of thought experiment that generates counterexamples. Roger White ( 2008 ) defends Poi by arguing that its antecedent is false in these thought experiments. Like White I believe Poi, but (...) I find his defense unsatisfactory for two reasons: it appeals to false premises, and it saves Poi only at the expense of something that Poi’s believers likely find just as important. So in this essay I defend Poi by arguing that its antecedent does hold in the relevant thought experiments, and that the further propositions needed to reject Poi are false. I play only defense in this essay; I don’t argue that Poi is true (even though I think it is), but rather that one popular refutation is faulty. In showing this, I also note something that has to my knowledge gone unnoticed: given some innocuous-looking assumptions the denial of Poi is equivalent to a version of epistemic permissivism , and Poi itself is equivalent to a version of epistemic uniqueness. Our topic is the notion of logical consequence: the link between premises and conclusions, the glue that holds together deductively valid argument. How can we understand this relation between premises and conclusions? It seems that any account begs questions. Painting with very broad brushtrokes, we can sketch the landscape of disagreement like this: “Realists” prefer an analysis of logical consequence in terms of the preservation of truth [29]. “Anti-realists” take this to be unhelpful and o:er alternative analyses. Some, like Dummett, (...) look to preservation of warrant to assert [9, 36]. Others, like Brandom [5], take inference as primitive, and analyse other notions in terms of it. There is plenty of disagreement on the “realist” side of the fence too. It is one thing to argue that logical consequence involves preservation of truth. Alfred Tarski’s work on truth has played such a central role in the discourse on truth that most coming to it for the first time have probably already heard a great deal about what is said there. Unfortunately, since the work is largely technical and Tarski was only tan- gentially philosophical, a certain incautious assimilation dominates many philosophical discussions of Tarski’s ideas, and so, examining Tarski on the concept of truth is in many ways an act of unlearning. -/- In (...) this paper I focus on those key ideas in Tarski’s work that have made a lasting impact on the philosophical discourse. These are the notions of T-sentence, Convention T, Tarskian truth definition, and Tarski’s general limiting theses on the expressibility and definability of truth. Though these ideas are in name familiar, we will seek in this essay to uncover and remove certain widespread misunderstandings of each. Tarski’s name also features prominently in discussions of the liar paradox, so we will take time out to explain Tarski’s connection to this ancient puzzle. (shrink)

Recent allegations of unethical decision-making by leaders in prominent business organizations have jeopardized the world's confidence in American business. The purpose of this research was to develop a measure of managerial moral judgment that can be used in future research and managerial assessment. The measure was patterned after the Defining Issues Test, a widely used general measure of moral judgment. With content validity as the goal, we aimed to sample the domain of managerial ethical situations by establishing links to dimensions (...) of managerial performance, as well as to the types of organizational justice issues managers encounter. Proposed scenarios were evaluated for realism by ethics officers and human resource managers. Results indicated that the new measure is reliable and correlates with a number of relevant variables in the hypothesized manner, demonstrating evidence of construct validity. Implications for future research and for human resources management are discussed. (shrink)

Carruthers offers a refreshing piece of “substantive philosophy.” Going beyond the limitations of pure analysis, he adopts a methodology which is one part analysis, one part empirical data, and a heavy dose of inference to the best explanation. The overarching goal is to advance the commonsense—yet unfashionable—thesis that natural language is the primary medium of thought, and to defend the related cognitive conception of NL. In particular, Carruthers argues that imaginative phonological representations of “inner speech” are constitutive of conscious thoughts, (...) and that thinking involves operations on such symbols. While there is still a role for mentalese cognition, such thinking is always unconscious, and probably of limited innate conceptual resources. The weak thesis is that, of natural necessity, all conscious propositional thought requires NL. The strong thesis is that, of natural necessity, distinctively human thoughts can only be tokened in natural language—hence even much of our unconscious thinking occurs in English. (shrink)
