Artificial Intelligence and Law: How to Get There from Here.L. Thorne Mccarty - 1990 - Ratio Juris 3 (2):189-200.
. This paper offers a survey of the current state of Artificial Intelligence and Law, and makes recommendations for future research. Two main areas of investigation are discussed: the practical work on intelligent legal information systems, and the theoretical work on computational models of legal reasoning. In both areas, the knowledge representation problem is identified as the most important issue facing this field.

Ownership.L. Thorne McCarty - 1994 - Theoria: Revista de Teoría, Historia y Fundamentos de la Ciencia 9 (2):173-190.
This paper is an exercise in computational jurisprudence. It seems clear that the field of AI and Law should draw upon the insights of legal philosophers, whenever possible. But can the computational perspective offer anything in return? We explore this question by focusing on the concept of OWNERSHIP, which has been debated in the jurisprudential literature for centuries. Although the intellectual currents here flow mostly in one direction -from legal philosophy to AI- we show that there are also some insights (...)

We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...)

Corporate Social Responsibility and Long-term Compensation: Evidence from Canada.L. S. Mahoney & Linda Thorne - 2005 - Journal of Business Ethics 57 (3):241-253.
. This paper examines the association between long-term compensation and corporate social responsibility for 90 publicly traded Canadian firms. Social responsibility is considered to include concerns for social factors and the environment, 564-578; Kane, E. J., 341-359). Long-term compensation attempts to focus executives efforts on optimizing the longer term, which should direct their attention to factors traditionally associated with socially responsible executives. As hypothesized, we found a significant relationship between the long-term compensation and total CSR weakness as well as the (...)

    The development of a measure of auditors' virtue.T. Libby & L. Thorne - 2007 - Journal of Business Ethics 71 (1):89 - 99.
Auditors’ virtue comprises those qualities of character that manifest the ideals of the audit community (c.f., Maclntyre, 1984, After Virtue. (University of Notre Dame Press, Notre Dame)), and are instrumental in ensuring that auditors’ professional judgment is exercised according to a high moral standard (Thorne, 1998, Research on Accounting Ethics. (JAI Press, Greenwich, CT)). Nevertheless, the lack of valid and reliable quantitative measures of auditors’ virtue impedes research that furthers our understanding of how best to promote virtue in the (...)

Implications of variance in the time at which sibs become mature are considered, particularly with respect to the fragmentation of a parental genome over time. It is concluded that regardless of the adaptive derivation of various intra-sibship maturation schedules, they each have important genetic consequences.

All Canadian hospitals over 100 beds, of which at least some were acute care, were surveyed to determine the structure of CEC, how they function, the perceived achievements of these committees and (...)

Early versions of satellite and radiosonde datasets suggested that the tropical surface had warmed more than the troposphere, while climate models consistently showed tropospheric amplification of surface warming in response to human-caused increases in greenhouse gases. We revisit such comparisons here using new observational estimates of surface and tropospheric temperature changes. We find that there is no longer a serious discrepancy between modeled and observed trends in the tropics. Our results contradict a recent claim that all simulated temperature trends in (...)

Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...)

We used attractiveness judgements as a proxy to visualize the ideal female and male body for male and female participants and investigated how individual differences in the internalization of cultural ideals influence these representations. In the first of two studies, male and female participants judged the attractiveness of 242 male and female computer-generated bodies which varied independently in muscle and adipose. This allowed us to map changes in attractiveness across the complete body composition space, revealing single peaks for the attractiveness (...)

Nurses and physicians may experience ethical conflict when there is a difference between their own values, their professional values or the values of their organization. The distribution of limited health care resources can be a major source of ethical conflict. Relatively few studies have examined nurses' and physicians' ethical conflict with organizations. This study examined the research question ‘What are the organizational ethical conflicts that hospital nurses and physicians experience in their practice?’ We interviewed 34 registered nurses, 10 nurse managers, (...)

The editors of the JRE collected short essays from scholars of religion in response to a recent incident at Hamline University that made national headlines. Last fall, Hamline University administrators refused to extend a contract to an adjunct professor of art history after a Muslim student accused her of Islamophobia for showing a 14th‐century image of Mohammad in an online class. The event provoked intense conversations about issues of academic freedom, religious diversity, the status of contingent faculty, and race. These (...)

  23. Intuitionism in Mathematics.D. C. McCarty - 2005 - In Stewart Shapiro (ed.), Oxford Handbook of Philosophy of Mathematics and Logic. Oxford and New York: Oxford University Press.
This chapter presents and illustrates fundamental principles of the intuitionistic mathematics devised by L.E.J. Brouwer and then describes in largely nontechnical terms metamathematical results that shed light on the logical character of that mathematics. The fundamental principles, such as Uniformity and Brouwer’s Theorem, are drawn from the intuitionistic studies of logic and topology. The metamathematical results include Gödel’s negative and modal translations and Kleene’s realizability interpretation. The chapter closes with an assessment of anti-realism as a philosophy of intuitionism.

  24. Kant’s Derivation of the Formula of Universal Law.Richard Mccarty - 2010 - Dialogue 49 (1):113-133.
ABSTRACT: Critics have charged that there are gaps in the logic of Kant’s derivation of the formula of universal law. Here I defend that derivation against these charges, partly by emphasizing a neglected teleological principle that Kant alluded to in his argument, and partly by clarifying what he meant by actions’ “conformity to universal law.” He meant that actions conform to universal law just when their maxims can belong to a unified system of principles. An analogy with objects’ conformity to (...)

Through qualitative surveys, a team of law students, law professors, physicians, and residents explored the perceptions of neurology residents towards referral to appropriate legal resources in an academic training program. Respondents reported feeling uncomfortable screening their patients for health-harming legal needs, which many attributed to a lack of training in this area. These findings indicate that neurology residents would benefit from training on screening for social factors that may be impacting their patients’ health.

Sadness and fear, but not happiness, motivate inhibitory behaviour: the influence of discrete emotions on the executive function of inhibition.Justin Storbeck, Jennifer L. Stewart & Jordan Wylie - forthcoming - Cognition and Emotion.
Inhibition, an executive function, is critical for achieving goals that require suppressing unwanted behaviours, thoughts, or distractions. One hypothesis of the emotion and goal compatibility theory is that emotions of sadness and fear enhance inhibitory control. Across Experiments 1–4, we tested this hypothesis by inducing a happy, sad, fearful, and neutral emotional state prior to completing an inhibition task that indexed a specific facet of inhibition (oculomotor, resisting interference, behavioural, and cognitive). In Experiment 4, we included an anger induction to (...)

This book reclaims Hegel's notion of the "end of art"-or, more precisely, of "art's past character"-not just as a piece of the history of philosophy but as a living critical and interpretive methodology. It addresses the presence of the past character of art both in Hegel and contemporary philosophy and aesthetics. The book's innovative contribution lies in unifying the Hegelian thesis with discussions of contemporary art and philosophy. The author not only offers a Hegelian exegesis but applies the idea of (...)

Research ethics education has taken many forms since federal funding agencies issued regulatory guidance directing those supported by these agencies to complete required training. In the absence of a standard training approach among institutions such as universities, the design and content of courses, workshops, and seminars varies widely. Here we describe a southwestern United States research university program that employed six teaching strategies to assist students in deep learning of ethical principles and behavior.
