We present the Italian translation of a well-known contribution of Dieter Lohmar on the problem of phenomenological reduction which first appeared in German under the title Die Idee der Reduktion. Husserls Reduktionen und ihr gemeinsamer, methodischer Sinn. The different reductive strategies in the Husserlian works are traced back to a common model that shows continuity and progress of the phenomenological method from what Lohmar identifies as a reduction to the reeller Bestand up to the transcendental, primordial, life-worldly forms of (...) reduction. As Dieter Lohmar (Citation2002; Citation2012) has shown, in the Logical Investigation Husserl sketches a peculiar type of reduction, the so-called “Reduktion auf den reellen Bestand.” Husserl does not explicitly put this kind of reduction forward, though, and he does definitely not clarify how it works, and what its elements properly are. Lohmar proposes to understand it as a kind of empiricist reduction to mere sense-data. On the contrary, I believe that it should be considered as entailing also the apprehensional (...) forms of sense-data, though not the so-called apprehensional senses. In this article, I will offer some arguments and textual evidence in favour of this claim, and I will conclude by proposing that, despite Husserl’s unclarity on the issue, the reduction to the real components of experience, rather than being simply an ancestor of the transcendental-phenomenological reduction, should be seen as the regulative model of all later forms of reduction. Paper, $29.95.Donn Welton has put together a superb collection of twelve essays which "provide an alternative to the standard approach to Husserl by examining his method as a whole and by offering depth-probes into a number of issues, old and new, that (...) occupied [Husserl] during his exceptionally productive later period" (xi). Although classed under five subheadings by Welton, the essays are of three types generally. These are (1) essays which provide introduction to and overview of Husserl's philosophy, especially as expressed in his later works, (2) essays of comparison between aspects of Husserl's philosophy and other non-phenomenological or psychological theories, and (3) analytic essays which treat a particular thematic within (and transcending) Husserl's phenomenological philosophy.The book begins with Klaus Held's wonderfully coherent introductions to Husserl's phenomenological method and phenomenology of the life-world. Although these two essays are not new, they remain original and current overviews of Husserl's whole philosophy [End Page 122] translated into English for the first time. More importantly, they do not lapse into an obtuse jargon so typical of Husserlian scholarship. Both essays provide an excellent introduction to the major themes of Husserl's philosophy.Three essays within the collection are primarily comparative. Dieter Lohmar delves into a notoriously thorny issue within Kant's first critique, i.e., the schematism of concepts, in order to compare this against Husserl's concept of type. But he attempts herein to articulate something that "never really interested Kant" (97), i.e., the empirical genesis of the schemata. Apart from providing a clear account of the genesis of empirical schema within Kantian philosophy, Lohmar also clarifies the Husserlian conception of type as instituted in perceptual consciousness. Rudolf Bernet examines the appearing of Unconsciousness as presented by Freud in order to "show how it is possible that consciousness can bring to present appearance something unconscious... without thereby incorporating it into or subordinating it to the conscious present" (200). Bernet achieves two ends in this fine essay. He employs Husserl's theory of phantasy in inner-time consciousness in order to intimate a solution to the seeming aporia implicit in Freud's theory of unconscious consciousness. More importantly to Husserlian scholarship, however, Bernet also provides a fine articulation of Husserl's theory of phantasy as it develops from the "apprehension of a content of apprehension" schema to that of a non-positing, intuitive-reproductive presentification. Donn Welton's essay, "World as Horizon," attacks the semantic theory of claims and descriptions espoused primarily by Robert Brandom. What is lacking in Brandom's theory of claims and, by extension, in any abstracting semantic theory, Welton argues, is the proper starting point. Speech acts must be understood from within a theory of world "as a nexus of significance that situates not only our multiple discourses about different regions but also the regions themselves" (224).The bulk of the essays in this collection, however, are analytic in nature and range over themes as diverse as intentionality, inner-time-consciousness, self-reflection, intersubjectivity and the differing styles of phenomenological analysis within Husserl's philosophy. Perhaps the best essays in this collection, given its aim, are Lanei Rodemeyer's essay "Developments in the Theory of Time-Consciousness: an Analysis of Protention" and Anthony Steinbock's "Generativity and the Scope of Generative Phenomenology." Where Rodemeyer concentrates her attention on explicating the role of protention in all of Husserl's time-analyses—but most especially in the later Bernauer and C manuscripts, Steinbock looks from within Husserl's philosophy to a style of analysis that goes beyond Husserl to become "a communal effort, not just among contemporary phenomenologists, but as a project handed down and appropriated over the generations" (317 ff.). With the exception of David Carr's essay on subjectivity in the transcendental tradition, what is common to all these analytical essays is the dominant place of Husserl's late analyses of inner-time-consciousness and temporalization. In this paper we discuss the definitional problems of altered states of consciousness and their potential relevance in phenomenological investigation. We suggest that visionary states or visionary phantasy working induced by psychedelics, as extraordinary types of altered states, are appropriate subjects for phenomenological analysis. Naturally, visionary states are not quite ordinary workings of the human mind, however certain cognitive psychological and evolutionary epistemological investigations show that they can give new insights into the nature of consciousness. Furthermore, we suggest that contemporary (...) inquiries concerning altered states in consciousness studies give an opportunity to complete the contemporary phenomenological investigations of phantasy with the notion of visionary phantasy. Here we propose that the similarities and differences between Dieter Lohmar’s weak phantasy and Benny Shanon’s concept of vision are precisely discernible, and, consequently, it may be possible that weak phantasy and visionary phantasy are situated on the two outermost poles of the colorful spectrum of phantasy activity. Summary I outline an approach to the phenomenology of improvised music which takes typification and the development of multi‐ordered phenomenological structures as central. My approach here is firmly in line with classical Husserlian phenomenology, taking the discussion of types in Experience and Judgment (Husserl, 1973) and Brudzińska (2015) as guide. I provide a phenomenological analysis of musical types as they are found in improvisational contexts, focusing on jazz in the 20th century. Styles are higher‐order musical types. Musical types are structures (...) that are temporally “thick,” relying on sedimented typification and knowledge, driving expectations as definitional. In most forms of music (including improvised music), musical styles involve maintaining a balance between confirming expectations and flouting expectations. I show that improvised music has a phenomenal structure which is enriched by the communicative and “ real‐time” nature of improvised music. Improvised music can be seen as an exploration of a possibility space rendered by the juxtaposition of the musical types afforded by a performance environment (instrumentation, harmonic and melodic traditions, etc.). I show that improvisation in music is a multi‐vectoral form of communication. The communication is founded in what Dieter Lohmar calls “non‐linguistic thinking.” The expression is constituted in the results of active and synthesis. The culmination of improvisational exploration of possibility spaces is the precisification and enrichment of styles‐as‐types, while in some cases developing new styles in the process. (shrink)

Edmund Husserl, generally regarded as the founding figure of phenomenology, exerted an enormous influence on the course of twentieth and twenty-first century philosophy. This volume collects and translates essays written by important German-speaking commentators on Husserl, ranging from his contemporaries to scholars of today, to make available in English some of the best commentary on Husserl and the phenomenological project. The essays focus on three problematics within phenomenology: the nature and method of phenomenology; intentionality, with its attendant issues of temporality (...) and subjectivity; and intersubjectivity and culture. Several essays also deal with Martin Heidegger's phenomenology, although in a manner that reveals not only Heidegger's differences with Husserl but also his reliance on and indebtedness to Husserl's phenomenology. Taken together, the book shows the continuing influence of Husserl's thought, demonstrating how such subsequent developments as existentialism, hermeneutics, and deconstruction were defined in part by how they assimilated and departed from Husserlian insights. The course of what has come to be called continental philosophy cannot be described without reference to this assimilation and departure, and among the many successor approaches phenomenology remains a viable avenue for contemporary thought. In addition, problems addressed by Husserl--most notably, intentionality, consciousness, the emotions, and ethics--are of central concern in contemporary non-phenomenological philosophy, and many contemporary thinkers have turned to Husserl for guidance. The essays demonstrate how significant Husserl remains to contemporary philosophy across several traditions and several generations. In the present article, I address the issue of categorial representative contents, which, according to Husserl’s phenomenological theory, make knowledge possible by providing fullness to intuitive categorial acts. First, I discuss Husserl’s assertion that he no longer approves of his theory of categorial representation developed in Logical Investigations. I argue that the influential interpretation of Husserl’s self-criticism advanced by Dieter Lohmar is unfortunately misleading, as Husserl does not actually claim that categorial representatives are contents of reflection belonging to the (...) realm of inner sensibility, as Lohmar contends. After offering an alternative view of Husserl’s authentic position in Logical Investigations, I examine other possible reasons for his later dissatisfaction. These reasons relate to Husserl’s changing views on the role of categorial representatives in empty thinking acts—necessarily involved in cognition—and the necessity of spontaneously repeating the passive synthesis between the intentional matters that function as categorial representatives in the predicative activity yielding knowledge. El siguiente artículo tiene como objetivo principal estudiar el esquema husserliano de superposición de actos, que establece la fundamentación de toda experiencia predicativa en la antepredicativa, y, más precisamente, analizar el momento atencional que vincula ambos niveles de nuestras vivencias. De acuerdo con esto, el presente texto dispone de tres partes. En primer orden, estudiaré la distinción entre intuición sensible y categorial desarrollada por este filósofo en la sexta de sus Investigaciones lógicas. En segundo orden, y siguiendo los comentarios que (...) Dieter Lohmar hace de esta doctrina, revisaré con detención la función que juega el fenómeno de la atención en dicha teoría. Auch unter Befürwortern der Zulässigkeit einer Suizidassistenz durch Ärzte unter bestimmten Bedingungen besteht weitgehendes Einverständnis darüber, dass kein Arzt zu einer Suizidassistenz rechtlich oder berufsrechtlich verpflichtet sein sollte. Auch das Bundesverfassungsgericht hat in seinem Urteil vom Februar 2020 Suizidwilligen unter bestimmten Bedingungen nicht mehr als ein ungerichtetes in rem-Recht auf Suizidhilfe zugesprochen, das keinen Anspruch gegen einen einzelnen Arzt begründet. Mit dem letzten Satz seines Urteils hat es vielmehr die Freiheit jedes einzelnen Arztes – wie auch jedes anderen potenziellen Helfers (...) –, Nein zu sagen, nachdrücklich bekräftigt. Auf dem Hintergrund einer empirischen Untersuchung der Gründe, die in der Schweiz für die Ablehnung entsprechender Patientenanfragen gegeben werden, untersucht und gewichtet der Beitrag die Gründe, die für diese Freiheit sprechen, unter ethischen Gesichtspunkten und verteidigt ein bedingtes Recht auf Ablehnung gegen dessen jüngste Kritiker. In Fällen, in denen die Bedingungen erfüllt sind, durch die das Bundesverwaltungsgericht in seinem Urteil vom März 2017 „extreme Notlagen“ definiert hat, sollte jedoch zumindest eine moralische Pflicht anerkannt werden, den Patienten an einen Arzt zu verweisen, der zu einer Unterstützung bereit ist. Besonders in jüngster Zeit findet es Interesse bei älteren Menschen, die dem Tode nahe sind und über Zeitpunkt und Umstände ihres Todes ein gewisses Maß an Gestaltungsspielraum behalten wollen. Unter den Befürwortern dieses Verfahrens ist allerdings u. a. strittig, wieweit Sterbefasten als eine „passive“ Form von Suizid gelten kann. Auf dem Hintergrund der WHO-Definition des Suizids verteidigt der Beitrag eine affirmative Antwort und (...) diskutiert, wieweit sich daraus Konsequenzen für die ethische Beurteilung des Sterbefastens ergeben. The focus of this book is on conceptual and philosophical issues of perception including the classic notion of unconscious inferences in perception. The book consists of contributions from a group of internationally renowned researchers who spent a year together as distinguised fellows at the German Centre for Advanced Study.

Is causal analysis an appropriate method to discover causal laws? Some prerequisites for any successful application of mathematical causal models are worked out and discussed. It can be shown that these prerequisites cannot be fulfilled by present models and there are strong reasons to assume that they cannot be satisfied by any model. Therefore causal analysis will probably be of no importance for the discovery of causal laws in sociology.

Kontrovers ist insbesondere die begriffliche Einordnung der Kombination von terminaler Sedierung und Behandlungsabbruch sowie die Frage nach den dafür einschlägigen ethischen Kriterien. Ausgehend von einer Analyse von drei Szenarien mit unterschiedlicher kausaler Rollenverteilung argumentiere ich dafür, den Standardfall der Kombination von terminaler Sedierung und Behandlungsabbruch unter die (...) Kategorie der „passiven Sterbehilfe“ zu subsumieren und für sie dieselben ethischen Kriterien wie für den Behandlungsabbruch allein gelten zu lassen. Eine tentative vergleichende Bewertung ergibt, dass die terminale Sedierung als ultima ratio der Leidensminderung am Lebensende gegenüber der Alternative des assistierten Suizids insgesamt als ethisch vorzugswürdig gelten sollte, ohne jedoch die Alternative des assistierten Suizids als in toto unzulässig erscheinen zu lassen. Krause’s philosophy deserves to be memorized as the first link in a chain of thinking on animal rights that is still on the way today. Though Krause was not the first to talk of animal rights in the history of animal ethics, his theory of animal rights is pathbreaking in embedding a conception of animal rights in an all-encompassing metaphysical system. The essay situates Krause’s theory of animal rights in the framework of his general theory of rights and points to (...) the challenges Krause’s theory faces by the inevitability of trade-offs between animal and human rights. In der Einleitung zu Kerstings und Essers Target-Artikel fällt ein Stichwort, das mir in mehrfacher Hinsicht für den gegenwärtigen Stand des Nachdenkens über Sterben und Tod bezeichnend zu sein scheint: Pluralisierung der Todesbilder. Pluralisierung ist eine Herausforderung für jede einzelne der drei Fragestellungen des Artikels. In Bezug auf den Todesbegriff stellt sich die Frage, ob es einen – und nur einen – verbindlichen Begriff des Todes geben kann oder sollte; in Bezug auf das Verständnis des Todes als anthropologisches Grunddatum stellt (...) sich die Frage, ob es eine – und nur eine – gültige sinnverleihende Interpretation des Phänomen des Todes geben kann oder sollte; hinsichtlich des praktischen Umgangs mit dem Tod – dem eigenen wie dem anderer – stellt sich die Frage, ob sich bei aller kulturellen Diversität ein Katalog von basalen Normen findet, für den sich Allgemeinverbindlichkeit beanspruchen lässt. Wie viel Pluralismus ist notwendig, um der faktischen Vielfalt gerecht zu werden? Wie viel ist möglich, ohne Beliebigkeit und Orientierungslosigkeit heraufzubeschwören? Die Antworten der Autoren zeigen, dass sie in der Zulassung von Pluralismus zumeist das rechte Maß finden. Bei einigen scheinen sie mir allerdings zu weit zu gehen, bei anderen wiederum zu wenig weit. (shrink)

One moot point in bioethical debates about genetic testing concerns the conditions that have to be fulfilled to make individual genetic testing or individual participation in genetic screening programs truly voluntary. Though there is a relatively broad consensus about the non-viability of views on the extremes of the spectrum of opinions, there is considerable disagreement in the middle. This mirrors the difficulties in defining satisfactory demarcation lines between autonomous choice, pressured choice and coercion in cases in which the decision to (...) participate is triggered, wholly or partly, by factors such as material incentives, urgent health needs, massive social expectations, or moral pressure from relatives. In this contribution, some of the semantic conditions and ethical principles concerning coercion are explored with a view to applying them to genetic testing, especially in the context of insurance and participation in clinical trials. Zunächst sind die Folgen axiologisch oder werttheoretisch, d. h. danach zu beurteilen, wie weit sie als gut oder schlecht, wünschenswert oder vermeidenswert zu bewerten sind; sodann ist die Handlung normativ oder deontisch danach zu beurteilen, (...) wie weit sie auf dem Hintergrund der Folgenbewertung als moralisch geboten, erlaubt oder verboten gelten muss. One of the standard criticisms of classical utilitarian is that it is unable to provide an adequate ethical foundation for the wrongness of killing. It is reasoned that the five arguments against killing available to the classical utilitarian are indeed sufficient to provide such a foundation and that recourse to preference utilitarianism is neither called for nor helpful since it generates a number of problems of its own. On this basis, Singer’s discussion of selective abortion and the selective euthanasia of (...) newborns is criticized from within utilitarianism for not giving sufficient weight to direct and indirect social side-effects, especially if ‘external’ criteria are introduced into the valuation of human life. Seit Benthams Spott über die Menschen- und Bürgerrechte als „Unsinn auf Stelzen“ gilt es als ausgemacht, dass das zentrale Stück des Grundgesetzes, die Grundrechte, und der Utilitarismus nur schwer zusammenkommen können. Auch wenn prima facie strukturelle wie inhaltliche Gründe gegen den Versuch sprechen, beide miteinander vollständig vereinbar machen zu wollen, weist der Beitrag auf mehrere Punkte hin, an denen sich die Grundrechte und der Utilitarismus zur Deckung bringen lassen.

This contribution offers an introduction into the language of rights and the role rights play in ethics and law; with special reference to the rights of children. It emerges that there are a number of very different functions characteristic of 'rights talk'; both in ethics and law; and that many of them offer opportunities for strengthening appeals to moral and legal principles while others involve pitfalls that should be avoided. In conclusion; two of the theoretical questions raised by rights are (...) addressed: whether the concept of rights can be replaced without loss by the concept of obligation; and whether rights should be seen as social constructs derived from obligations; or whether it is more plausible to reverse the order of priority. Dieter Henrich and Contemporary Philosophy presents a comprehensive analysis of Henrich's work on subjectivity, evaluating it in the context of contemporary debates in both continental and analytic traditions. Familiarising the non-German reader with an important development in contemporary German (...) philosophy, this book explains the significance of subjectivity for any philosophy that attempts to offer existential orientation and contrasts competing conceptions in analytic philosophy and in the social philosophy of Juergen Habermas. Presenting Henrich's philosophy of subjectivity as a credible alternative to analytic philosophy of mind and a radical challenge to Heideggerian, Habermasian, neo-pragmatist, and postmodern positions, Freundlieb argues that a philosophy of the kind developed by Henrich can regain the cultural significance philosophical thinking once possessed.
